Healthcare (including public health) is special because it protects normal functioning, which in turn protects the range of opportunities open to individuals. I extend this account in two ways. First, since the distribution of goods other than healthcare affect population health and its distribution, I claim that Rawls's principles of justice describe a fair distribution of the social determinants of health, giving a partial account of when health inequalities are unjust. Second, I supplement a principled account of justice for health (...) and healthcare with an account of fair process for setting limits or rationing care. According to the presentist, only the present moment exists and, as time passes, what’s present changes. However some argue that, if only one moment exists, the presentist cannot explain the passage of time. While the presentist historically appeals to surrogates—proxies which exist in the present but play the role of non-existent past times—to evade this sort of worry, the appeal to surrogates has come under renewed attack from Lisa Leininger. But hope is not lost for the presentist. I argue that (...) presentists do have the resources available to address the underlying issue Leininger articulates. Moreover, there’s disagreement amongst presentists about which version of presentism is best. For instance, David Ingram has recently argued that thisness presentism is preferable to other versions of presentism because it’s able to handle certain problems other versions of presentism cannot. However, I argue that this assessment is premature. More specifically, I argue that Ingram’s response to an objection from Lisa Leininger fails to address the core issue she raises. Consequently, I argue that presentists shouldn’t embrace thisness presentism just yet. In this way, my aims here are to: sharpen Leininger’s objection, highlight tenable presentist replies to it, and advance the discussion about which version of presentism should be favoured. (shrink)

Paul Hirst’s defence of liberal education and his forms of knowledge thesis are likely to seem out of step with contemporary calls to decolonize knowledge by ‘delinking’ it from ‘Western’ Enlightenment traditions. In view of the decolonial challenge, and emphasizing too that Hirst’s work should be located in its time, we consider the extent to which his account of liberal education still has a place in the postcolonial era. We outline Hirst’s defence of liberal education and how it changed over (...) time, and show how philosophy of education in the tradition in which he has been so influential departed from Hirst’s account of liberal education, with some of these trends anticipating postcolonial imperatives. While there is a pressing need for attention to the significance of colonialism in philosophy of education, the discipline has moved on and diversified considerably over the last half century, including by developing more expansive conceptions of liberal education with the potential to contribute to the postcolonial project. Some elements of Hirst’s defence of liberal education are compatible with the postcolonial project, but it would need adjustment to make it relevant to the postcolonial era. After addressing the postcolonial critique of liberal thought in general as complicit in colonialism, we conclude by assessing what contribution Hirst’s conception of liberal education could make to the postcolonial project, noting a degree of openness to aspects of the decolonial project. In A Theory of Justice, John Rawls defines a hypothetical contract situation and argues rational people will agree on reflection it is fair to contractors. He solves the rational choice problem it poses by deriving two lexically-ordered principles of justice and suggests the derivation justifies the principles. Its soundness aside, just what justificatory force does such a derivation have?On one view, there is no justificatory force because the contract is rigged specifically to yield principles which match our pre-contract moral judgments. Rawls provides ammunition for this claim: “By going back and forth, sometimes altering the conditions of the contractual circumstances, at others withdrawing our judgments [about what is just] and conforming them to principle, I assume that eventually we shall find a description of the initial situation that both expresses reasonable conditions and yields principles which match our considered judgments duly pruned and adjusted.”. Bioethics' traditional focus on clinical relationships and exotic technologies has led the field away from population health, health disparities, and issues of justice. The result: a myopic view that misses the institutional context in which clinical relationships operate and can overlook factors that affect health more broadly than do exotic technologies. A broader bioethics agenda would take up unresolved questions about the distribution of health and the development of fair policies that affect health distribution.

A moral right to health or health care is a special instance of a right to fair equality of opportunity. Nation-states generally have the capabilities to specify the entitlements of such a right and to raise the resources needed to satisfy those entitlements. Can these functions be replicated globally, as a global right to health or health care requires? The suggestion that “better global governance” is needed if such a global right is to be claimed requires that these two central (...) capabilities be present. It is unlikely that nation-states would concede these two functions to a form of global governance, for doing so would seriously compromise the authority that is generally included in sovereignty. This claim is a specification of what is often recognized as the “sovereignty problem.” The argument of this paper is not an “impossibility” claim, but a best guess about whether the necessary conditions for better global governance that supports a global right to health or health care can be achieved. How can health plans make fair determinations about when “experimental” (and costly) treatments such as high dose chemotherapy with autologous bone marrow transplantation should be covered despite lack of clear clinical consensus about their benefits? Different models for managing “last chance” therapies evolving in some health plans offer promising examples of how issues of fairness and legitimacy in decisionmaking can be addressed.

This essay explores the relationship between nature and grace and the theological impact of this relationship on feminist anthropological debates. Engaging this debate through an examination and critique of Serene Jones’ ‘eschatological essentialism’, this essay suggests that Jones mistakenly characterizes constructivism, and thus turns too quickly to an essentialist paradigm without considering its risks. Using Judith Butler and Karl Barth, this essay proposes an account of identity that the author calls a ‘Christological constructivism’. Suggesting that the person and work of (...) Christ instantiates a grace that disrupts nature, Daniels argues for an account of identity as ‘more-than’, suggesting that this anthropology engenders healing for women, and men, within communities religious and otherwise. While Theodor Adorno is known for his philosophical reconstruction of aesthetic modernism, he also analyzes—and is critical of—the demotion of natural beauty in the hierarchy of aesthetic concerns following Kant. Recent scholars have acknowledged that natural beauty is important in Adornian aesthetics, but many do so in a manner that repeats the subordination of natural beauty and the aesthetic experience of nature to that of art. Against this tendency, in this article I demonstrate that not only does Adorno contest the (...) inferiority of the aesthetic experience of nature but his unconventional description and theoretical articulation of natural beauty is especially pertinent for our time of climate crisis. By unpacking his endorsement of Walter Benjamin's casting both nature and history in terms of transience, I argue that Adorno proposes an experience of natural beauty that is expressive of social historical content, offers a vision of a different relationship with nature, and discloses ethical claims on us to act in this world. The Ethics Working Group of Clinton's Health Care Task Force developed a list of principles and values that should govern health care reform. These principles and values are compatible with central moral and political traditions, as well as with more rigorous theoretical accounts of justice and health care, but they are "freestanding" points of agreement, not presupposing any particular theoretical background. Though imprecise and not ranked by priorities, the principles guide thinking about the fairness of alternative reform proposals.
