Durkheim's underdeveloped notion of fatalism is the keystone for a bridge between two conceptual categories central to Marxian and Durkheimian theory: alienation and anomie. Durkheim does not necessarily disagree with Marx that excessive regulation can be socially damaging but chooses to highlight the effects of under- regulation. A Durkheimian critique of overregulation becomes possible if we turn away from anomie and toward Durkheim's idea of fatalism-a concept that I will argue here is unexpectedly consistent with Marx's notion of alienation. We (...) can infer that Durkheim presents us with a notion of an "optimal" human condition that exists between anomie and fatalism. The structure of modern societies, it will be argued, is characterized not just by excessive control leading to alienation or by a lack of integrative restraint leading to anomie but also by active efforts to optimally regulate social life. This paper looks at philosophical questions that arise in the context of AI alignment. It defends three propositions. First, normative and technical aspects of the AI alignment problem are interrelated, creating space for productive engagement between people working in both domains. Second, it is important to be clear about the goal of alignment. There are significant differences between AI that aligns with instructions, intentions, revealed preferences, ideal preferences, interests and values. A principle-based approach to AI alignment, which combines these elements (...) in a systematic way, has considerable advantages in this context. Third, the central challenge for theorists is not to identify ‘true’ moral principles for AI; rather, it is to identify fair principles for alignment that receive reflective endorsement despite widespread variation in people’s moral beliefs. The final part of the paper explores three ways in which fair principles for AI alignment could potentially be identified. (shrink)

Some have defended a Fregean view of perceptual content. On this view, the constituents of perceptual contents are Fregean modes of presentation (MOPs). In this paper, I propose that perceptual MOPs are best understood in terms of object files. Object files are episodic representations that store perceptual information about objects. This information is updated when sensory conditions change. On the proposed view, when a subject perceptually represents some object a under two distinct MOPs, then the subject initiates two object files (...) that both refer to a. My defense of this view appeals to its satisfaction of four constraints that I argue theories of perceptual MOPs should satisfy. Furthermore, I show that some existent accounts of perceptual MOPs fail to satisfy them. The defended constraints also indicate what is unique about perceptual, as opposed to linguistic or cognitive, MOPs. (shrink)

In light of recent criticisms by Woodward (2017) and Rescorla (2018), we examine the relationship between mechanistic explanation and phenomenological laws. We disambiguate several uses of the phrase “phenomenological law” and show how a mechanistic theory of explanation sorts them into those that are and are not explanatory. We also distinguish the problem of phenomenological laws from arguments about the explanatory power of purely phenomenal models, showing that Woodward and Rescorla conflate these problems. Finally, we argue that the temptation to (...) pit mechanistic and interventionist theories of explanation against one another occludes important and scientifically relevant research questions. Musical systems develop associations over time between aspects of musical form and concepts from outside of the music. Experienced listeners internalize these connotations, such that the formal elements bring to mind their extra-musical meanings. An example of musical form-meaning mapping is the association that Western listeners have between the major and minor modes and happiness and sadness, respectively. We revisit the emotional semantics of musical mode in a study of 44 American participants (musicians and non-musicians) who each evaluated the relatedness (...) of 96 melody-word pairs. Among the tonal melodies, we manipulated mode (major and minor) and timbre (clarinet and flute) while systematically controlling for other musical factors including pitch register and melodic contour. Similarly, among the English words, we manipulated word affect (happy and sad) while systematically controlling for other lexical factors including frequency and word length. Results demonstrated that participants provided a higher proportion of related responses for major melodies paired with happy words and minor melodies paired with sad words than for the reverse pairings. This interaction between mode and word affect was highly significant for both musicians and non-musicians, albeit with a larger effect for the former group. Further interactions with timbre suggested that while both clarinet and flute conveyed happiness when in the major mode, the clarinet was somewhat more successful than the flute at conveying sadness in the minor mode. Debriefing questionnaires suggested that the majority of the participants, including all of the non-musicians, had no awareness of the major-minor manipulation, and instead directed their attention to register and contour. We argue that the affective character of the major and minor modes is but one example of form-meaning mapping in music, and suggest further exploration of the roles of timbre, register, and contour in conveying musical emotions. The proper limit to paternalist regulation of citizens' private lives is a recurring theme in political theory and ethics. In the present study, we examine the role of beliefs about free will and determinism in attitudes toward libertarian versus paternalist policies. Throughout five studies we find that a scientific deterministic worldview reduces opposition toward paternalist policies, independent of the putative influence of political ideology. We suggest that exposure to scientific explanations for patterns in human behavior challenges the notion of personal (...) autonomy and, in turn, undermines libertarian arguments against state paternalism appealing to autonomy and personal choice. Multiple studies show that periodic reanalysis of genomic test results held by clinical laboratories delivers significant increases in overall diagnostic yield. However, while there is a widespread consensus that implementing routine reanalysis procedures is highly desirable, there is an equally widespread understanding that routine reanalysis of individual patient results is not presently feasible to perform for all patients. Instead, researchers, geneticists and ethicists are beginning to turn their attention to one part of reanalysis—reinterpretation of previously classified variants—as a means of (...) achieving similar ends to large-scale individual reanalysis but in a more sustainable manner. This has led some to ask whether the responsible implementation of genomics in healthcare requires that diagnostic laboratories routinely reinterpret their genomic variant classifications and reissue patient reports in the case of materially relevant changes. In this paper, we set out the nature and scope of any such obligation, and analyse some of the main ethical considerations pertaining to a putative duty to reinterpret. We discern and assess three potential outcomes of reinterpretation—upgrades, downgrades and regrades—in light of ongoing duties of care, systemic error risks and diagnostic equity. We argue against the existence of any general duty to reinterpret genomic variant classifications, yet we contend that a suitably restricted duty to reinterpret ought to be recognised, and that the responsible implementation of genomics into healthcare must take this into account. Confirmation bias has been widely studied for its role in failures of reasoning. Individuals exhibiting confirmation bias fail to engage with information that contradicts their current beliefs, and, as a result, can fail to abandon inaccurate beliefs. But although most investigations of confirmation bias focus on individual learning, human knowledge is typically developed within a social structure. We use network models to show that moderate confirmation bias often improves group learning. However, a downside is that a stronger form of confirmation (...) bias can hurt the knowledge producing capacity of the community. (shrink)

This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. We consider the efficacy of various forms of reinforcement learning with punishment in evolving linguistic conventions in the context of Lewis-Skyrms signalling games. We show that the learning strategy of reinforcement with iterative punishment is highly effective at evolving optimal conventions in even complex signalling games. It is also robust and can be easily extended to a self-tuning variety of reinforcement learning. We briefly discuss some of the virtues of reinforcement with iterative punishment and how it may be related to (...) learning in nature. (shrink)

Während die Bedeutung Freges für die Philosophie der Gegenwart, soweit sich diese der analytischen Philosophie verpflichtet fühlt, allgemeine Anerkennung gefunden hat, ist seine Stellung innerhalb der eigenen Zeit noch weitgehend unaufgeklärt geblieben. So herrscht die Auffassung vor, Frege habe seine Ideen ganz aus sich selbst oder geradezu im Gegensatz zur deutschen philosophischen Tradition seiner Zeit gewonnen. Bei genauerer Textanalyse weisen Freges Schriften dagegen vielfältige Beziehungen zur zeitgenössischen Logik, Erkenntnistheorie, Sprachphilosophie und Philosophie der Mathematik auf, so dass bei ihm von einem (...) Bruch mit der kontinentalen Philosophie nicht die Rede sein kann. Weil die historischen Voraussetzungen unberücksichtigt geblieben sind, ist ein unzutreffendes Bild von Freges Einsichten entstanden. Dieses Bild wird durch die Entfaltung des historischen Kontextes korrigiert. There has recently been much debate about the idea of levying a tax on particular transactions on international financial markets. Economists have argued about how much revenue such an international financial transaction tax would raise and they disagree about what effects it would have on trade volumes, financial stability, and overall growth. Politicians have argued about the feasibility of introducing such a tax internationally and they disagree on its adequacy as a policy response to the current financial and economic crisis. (...) This article contributes to the debate about international financial transaction taxation by bringing the perspective of political philosophy to bear on the politicians’ and economists’ arguments about policy. I shall outline a framework for thinking about justice in finance, and defend the idea of an international financial transaction tax as an instrument for making the international financial system more just. Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Given a structure [math] and a stably embedded [math]-definable set [math], we prove tameness preservation results when enriching the induced structure on [math] by some further structure [math]. In particular, we show that if [math] and [math] are stable (respectively, superstable, [math]-stable), then so is the theory [math] of the enrichment of [math] by [math]. Assuming simplicity of [math], elimination of hyperimaginaries and a further condition on [math] related to the behavior of algebraic (...) closure, we also show that simplicity and NSOP1 pass from [math] to [math]. We then prove several applications for tame expansions of weakly minimal structures and, in particular, the group of integers. For example, we construct the first known examples of strictly stable expansions of [math]. More generally, we show that any stable (respectively, superstable, simple, NIP, NTP2, NSOP1) countable graph can be defined in a stable (respectively, superstable, simple, NIP, NTP2, NSOP1) expansion of [math] by some unary predicate [math]. The Kohlberg Gilligan Controversy has received intermittent but inconclusive attention for many years, perhaps reflecting the difficulty of bridging the two positions. This article explores the published evidence for Gilligan's claims of gender difference, gender identity difference, and role of caring in people's ethics. It seems that the evidence for pronounced gender differences in ethical attitudes within business is weak, even if gender identity is used instead of physical gender. The main propositions of Care Theory and recent advances in its (...) thinking are discussed. Special focus emerges on the notion of Attachment which seems to be the Care Theory ingredient both most able to survive critical scrutiny and most promising for bridging the divide between the Kohlberg and Gilligan paradigms. The Social Bonding Model and other possible bridge building conceptual structures are introduced. Finally, Max Weber's division between ethics of conviction and ethics of responsibility provides an overarching perspective both of the gap still to be bridged and the need to keep trying to bridge it. This paper appeals to the phenomenon of dreaming to provide a novel defense against arguments from evil. The thrust of the argument is as follows: when we wake up after a nightmare we are often filled entirely with relief, and do not consider ourselves to have actually suffered very much at all; and since it is epistemically possible that this whole life is simply a dream, it follows that it is epistemically possible that in reality there is very little suffering. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

The article considers the philosophical potential of Heraclitean ambiguity and implications for how one might engage philosophically with Heraclitus. While works on Heraclitus most commonly offer new interpretations or dispute or add nuance to established interpretations, this work somewhat sidesteps interpretive disputes to consider the philosophical value and relevance of Heraclitus’s fragments themselves. Specifically, a hermeneutical tool proposed by William Desmond called a “companioning approach,” is supported. Desmond’s companioning approach is considered in the context of Pierre Hadot’s account of the (...) history of hermeneutical practices to show that it merely defines and legitimizes a longstanding hermeneutical activity. Further, a recent work by A. V. Halapsis shows that Heraclitus’s ambiguity may have been a consequence of his anthropological commitments and that he may have intended to allow for something like a companioning engagement. The so-called Trolley Problem was first discussed by Philippa Foot in 1967 as a way to test moral intuitions regarding the doctrine of double effect, Kantian principles and utilitarianism. Ever since, a great number of philosophers and psychologists have come up with alternative scenarios to further test intuitions and the relevance of conventional moral doctrines. Given that physicians routinely face moral decisions regarding life and death, the Trolley Problem should be considered of great importance in medical ethics. In this article, (...) five “classic” trolley scenarios are discussed: the driver diverting the trolley, a bystander pulling a lever to divert the trolley, a fat man being thrown from a bridge to stop the trolley, a bystander pulling a lever to divert a trolley so that a fat man may be run over, and a bystander pulling a lever so that a fat man falls off from a bridge to stop the trolley. As these scenarios are discussed, relevant moral differences amongst them are addressed, and some of the applications in medical ethics are discussed. The article concludes that Trolley scenarios are not the ultimate criterion to make ethical decisions in difficult ethical challenges in medicine cases but they do serve as an initial intuitive guide. This paper offers a new version of a historically influential, yet today unpopular, neglected, and on the whole insufficiently developed argument for socialism: socialism makes it possible for people to really act together. This idea of socialist action, combining the claims that there is a particularly valuable form of joint action and that socialism is about making such action possible, played an important role in the history of the labor movement, going back to the early Marx and running through various (...) strands of socialist thought. I shall argue that socialist action should be seen as central to the socialist project, its critique of capitalism, and the institutional alternatives envisaged by it. (shrink)

Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

Horn discusses some of the difficulties that researchers have encountered in analyzing the neural basis of memory and describes ways in which these difficulties have been overcome through the analysis of memories underlying habituation and imprinting. En Carl Schmitt en la Segunda República Española Gabriel Guillén Kalle analiza aspectos particulares de Carl Schmitt en ese periodo de nuestra nación en entreguerras. El autor reconoce que la recepción republicana fue primordialmente jurídica, mas esta perspectiva conlleva observar ese concepto de lo polítíco que atraviesa su obra entera. Guillén propone una estrategia para la relectura de Schmitt en ese periodo y para ello analiza a los principales autores que se ocuparon de él, sin desdeñar a algunos menos (...) conocidos como puede ser Zozaya. Un tema importante para nuestra nación es el control de constitucionalidad que Schmitt, siguiendo a Constant con la teoría del poder moderador, encuentra en el Presidente del Reich, y que en la segunda República española se dejó en un organismo, el Tribunal de Garantías Constitucionales que pretendía colocarse por encima de las pasiones, aunque por su composición -poco jurídica- condujo al fracaso. También es de interés cómo Medina sitúa el pensamiento schmittiano de los órdenes concretos en el idealismo objetivo necesitando de dualismos para su existencia. (shrink)

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes. Our aim in this paper is to provide a referential account of functional anaphora within a Skolem functions framework. We will give an interpretation of indefinite NPs as Skolem terms in order to show that the referential link established between an anaphoric pronoun and its antecedent is a descriptive one. Then we will argue that functional anaphora can be understood as a particular kind of E-type pronouns, in the sense that, for a large corpus, the pronoun can be replaced by (...) a descriptive expression of a first-order language. It will next be shown that the functional framework can be fruitfully applied to other kinds of sentences involving pronominal anaphora,especially in modal contexts. (shrink)

Many authors have argued that all studies of socially specific modalities of human action and experience depend on some form of “philosophical anthropology”, i.e. on a set of general assumptions about what human beings are like, assumptions without which the very diagnoses of the cultural and historical variability of concrete agents' practices would become impossible. Bourdieu was sensitive to that argument and, especially in the later phase of his career, attempted to make explicit how his historical-sociological investigations presupposed and, at (...) the same time, contributed to the elaboration of an “idea of the human being”. The article reconstructs Bourdieu's philosophical anthropology, starting with his genetic sociology of symbolic power, conceived as a form of critical theory, and concluding with an account of the conditio humana in which recognition appears as both the fundamental existential goal through which human agents strive to confer meaning on their lives and the source of the endless symbolic competition that keeps society moving. The agonistic vision of the social universe that grounds his sociological studies returns in his philosophical anthropology under the guise of a singular synthesis between Durkheim's thesis that “Society is God” and Sartre's idea that “hell is other people”. Based on an analysis of a landmark case Lim Mey Lee Susan v Singapore Medical Council in Singapore where a doctor was professionally disciplined for over-charging a wealthy patient, a judgement upheld by the Singapore High Court, this paper will discuss the notion of an ‘ethical price’ (EP) and its determination with respect to the provision of healthcare services. It will first examine the limitations of a legal approach for setting an ethical limit to pricing. From there, it will argue (...) that Confucian philosophy provides a useful ethical framework to explore EP, with focus on the context of Singapore. The following question is addressed: What is an ethical pricing standard for medical practice from a Confucian perspective? The strengths and limitations of a Confucian value base as regards the determination of an objective EP will be analysed through an examination of the shortcomings of the doctor’s behaviour in the Susan Lim case as well as other case scenarios. The paper will conclude with some practical suggestions on how Confucian-based ideas can be applied to decision-making on pricing and the importance of this for medical professionalism and ethics teaching. In continuation with the New Thought movement that arose in the United States in the 19th Century, there is now a massive self-help industry that markets books and seminars. This industry has also extended to healthcare in the form of positive thinking, i.e., the idea that happy thoughts are essential for health. While some of these claims may seem reasonable and commonsensical, they are not free of problems. This article posits that positive thinking has some ethical underpinnings. Extreme positive thinking (...) may promote alternative forms of medicine that ultimately substitute effective treatment, and this is unethical. The emphasis on positive thinking for cancer patients may be too burdensome for them. Likewise, unrestricted positive thinking is not necessarily good for mental health. After considering the ethics of positive thinking, this article proposes a more realistic approach. (shrink)

During the last few decades, the historical turn within the tradition of the analytic tradition has experienced growing enthusiasm concerning the procedure of rational reconstruction, whose validity or importance, despite its paradigmatic examples in Frege and Russell, has not always enjoyed a consensus. Among the analytic philosophers who are the frontrunners of this movement, Robert Brandom is one of a kind: his work on Hegel as well as on German Idealism has been increasing interest in, as well as awareness of, (...) Hegel´s possible contributions to some current problems in that tradition, and connecting Hegel scholars to current questions. Thus, this work aims to explore Brandom´s methodology of rational reconstruction, as well as his dialogue with history of Philosophy, mainly exposed in his Tales of the mighty dead (2002). As we will see, Brandom´s distinction between a de dicto and a de re approach intends to present a way of identifying and analyzing a given philosopher´s theoretical (hidden) commitments that can be useful to improve the quality of the dialogue with past philosophers. From such methodological exposition, I to turn to Kierkegaard in order to make explicit some of his ontological commitments and presenting Brandom’s approach as a valuable tool for doing history of philosophy. As we have discussed elsewhere, Franz Boas and John Dewey were intellectual and political allies at Columbia University for over thirty years.1 Dewey advocated for an increased role of anthropology for philosophical insight, and he often used anthropological knowledge as a starting point for his ethics and politics, including such knowledge as learned from Boas. We hold that Boas and Dewey shared a common core understanding of human global and evolutionary diversity, and that this shared understanding itself forms a core (...) component of their progressive projects.However, with regard to the problem of racism in the United States, Boas and Dewey had different engagements.
