Our claim in this paper is that not being identified as the data source might cause harm to a person or group. Therefore, in some cases the default of anonymisation should be replaced by a careful deliberation, together with research subjects, of how to handle the issues of identification and confidentiality. Our prime example in this article is community participatory research and similar endeavours on indigenous groups. The theme, content and aim of the research, and the question of how to (...) handle property rights and ownership of research results, as well as who should be in charge of the research process, including the process of creating anonymity, should all be answered, before anonymity is accepted. This article aims to provide a critical map of toleration as it is displayed in contemporary democracy. It does so by presenting three conceptions of toleration to which current practices of toleration can be traced, and, precisely, these are the standard notion, the political conception based on the neutrality principle, and toleration as recognition. The author argues that the latter is the appropriate conception to address the politically relevant issues of toleration arising in pluralistic democracy, while the first is adequate (...) only for social relations. In order to illustrate this argument, she presents a case of a contested and never solved request for a place of worship by the Muslims of Vercelli which represents an example of a very restricted and minimal interpretation of the standard notion, labeled ‘disrespectful tolerance’. The case is meant to show that unacceptable forms of toleration are still practised, and that the standard notion, here interpreted in the most minimal and negative way, is inappropriate for democratic politics. A reductive theory of collective intentionality would imply that the ‘official’ intentions of an oppressive political authority cannot be constructed from the intentions of individuals when they follow the authority's rules. This makes it difficult to explain the unraveling of official group plans through time in a seemingly consistent fashion, and the corresponding source of coercion. A non-reductive theory, on the other hand, cannot capture whether the actions of individuals in an oppressive society are free or coerced, so long as (...) a manifest institutional structure and rules are in place. I put forward a hybrid account of group intentionality that is capable of articulating why oppressive political power is illegitimate, which comes down to the official and individual intentions in joint group actions diverging in such a way that individuals are not governed on the basis of dependent reasons. IN THE FIRST CHAPTER OF HIS BOOK Theories of Cognition in the Later Middle Ages, Robert Pasnau takes a position in a longstanding debate concerning the metaphysical status and the epistemological role of sensible forms in Aquinas’s theory of cognition. His main claim is that Aquinas was a materialist about sensation and developed “a theory of the sort that a modern materialist could love.”.

How do people respond to others' accidental behaviors? Reward and punishment for accidents might be depend on the actor's intentions, or instead on the unintended outcomes she brings about. Yet, existing paradigms in experimental economics do not include the possibility of accidental monetary allocations. We explore the balance of outcomes and intentions in a two-player economic game where monetary allocations are made with a "trembling hand": that is, intentions and outcomes are sometimes mismatched. Player 1 allocates $10 between herself and (...) Player 2 by rolling one of three dice. One die has a high probability of a selfish outcome, another has a high probability of a fair outcome, and the third has a high probability of a generous outcome. Based on Player 1's choice of die, Player 2 can infer her intentions. However, any of the three die can yield any of the three possible outcomes. Player 2 is given the opportunity to respond to Player 1's allocation by adding to or subtracting from Player 1's payoff. We find that Player 2's responses are influenced substantially by the accidental outcome of Player 1's roll of the die. Comparison to control conditions suggests that in contexts where the allocation is at least partially under the control of Player 1, Player 2 will punish Player 1 accountable for unintentional negative outcomes. In addition, Player 2's responses are influenced by Player 1's intention. However, Player 2 tends to modulate his responses substantially more for selfish intentions than for generous intentions. This novel economic game provides new insight into the psychological mechanisms underlying social preferences for fairness and retribution. (shrink)

Although the moral foundations of voting rights regulations have been the subject of widespread scrutiny, there is one aspect of the debate which has gone largely unquestioned and is currently accepted in every state’s actual voting rights regulations. This is the requirement of prior residence, which stipulates that immigrants are granted the right to vote only once they have lived in the host country for a certain period of time. It is this requirement I call into question in this paper. (...) Taking up the most plausible justifications for this requirement, I aim to put substantial pressure on its moral acceptability by arguing that it is not directly grounded by any of the principles that are currently defended as a means to determine the demos, nor a proxy for some other morally relevant feature, nor a warrantor for abilities held to be significant for the right to vote. In this paper, I revisit Kimberlé Crenshaw's argument in “Demarginalizing the Intersection of Race and Sex” (1989) to recover a companion metaphor that has been largely forgotten in the “mainstreaming” of intersectionality in (white-dominated) feminist theory. In addition to the now-famous intersection metaphor, Crenshaw offers the basement metaphor to show how—by privileging monistic, mutually exclusive, and analogically constituted categories of “race” and “sex” tethered, respectively, to masculinity and whiteness—antidiscrimination law functions to reproduce social hierarchy, rather than to remedy it, denying (...) Black women plaintiffs legal redress. I argue that in leaving the basement behind, deployments of “intersectionality” that deracinate the concept from its origins in Black feminist thought also occlude Crenshaw's account of the socio-legal reproduction of hierarchical power. Federal policies on human subjects research have undergone a progressive transformation. In the early decades of the twentieth century, federal policies largely relied on the discretion of investigators to decide when and how to conduct research. This approach gradually gave way to policies that augmented investigator discretion with externally imposed protections. We may now be entering an era of even more stringent external protections. Whether the new policies effectively absolve investigators of personal responsibility for conducting ethical research, and whether it (...) is wise to do so, remains to be seen. (shrink)

Methodological nationalism is a cognitive bias that construes states as the natural and necessary form of contemporary social organisation. This gives rise to a state-centred view which naturalises national communities, exaggerates the differences between citizens and migrants, and exceptionalises international migration. In this paper, I argue that methodological nationalism is not only empirically inaccurate, but also normatively problematic, because its assumptions prevent migration ethicists from properly theorising about discrimination. I begin by briefly presenting methodological nationalism and clarifying some misconceptions. I (...) also identify some features that would make a policy discriminatory and show that many contemporary migration policies are discriminatory. Looking at three variants of methodological nationalism (naturalisation, territorialisation, and ignorance), I argue that methodological nationalism marginalises concerns about discrimination in migration ethics and prevents migration ethicists from developing accounts that would be able to counter xenophobic arguments. Last, I consider the implications of my argument for migration ethics. (shrink)

The paper aimed to reconstruct Twardowski's approach to the problem of free will and his analyses of the consequences of various solutions to this problem in ethics and criminal law. According to Twardowski, if we understand ‘free will’ as the possibility of making resolutions other than actually made, then (most probably) nobody has free will. Our resolutions are determined by a set of mental dispositions (character) and incentives that activate these dispositions. However, the existence of freedom of will such understood (...) is not a necessary condition for the correct functioning of ethical systems or criminal law. On the contrary, ethical systems and criminal law seem to assume that at least some of our resolutions are determined by our relatively stable dispositions. Only then can these resolutions and the actions that follow them be ascribed to certain agents. Twardowski's views on free will are presented here in the context of the metaphilosophical positions of the Lvov–Warsaw School, the central European branch of analytic philosophy. His position is also juxtaposed with Brentano's view of free will and Łukasiewicz's approach to the determinism/indeterminism debate. This juxtaposition illustrates the variety of philosophical positions and the diversity of the metaphilosophical toolkit applied in early analytic philosophy. (shrink)

A literature review of 98 articles concerning clinical pain research in newborn infants was conducted to evaluate how researchers report the ethical issues related to their studies and how journals guide this reporting. The articles were published in 49 different scientific journals. The ethical issues most often mentioned were parental informed consent (94%) and ethical review approval (87%). In 75% of the studies the infants suffered pain during the research when placebo, no treatment or otherwise inadequate pain management was applied. (...) Discussion about benefits versus harm to research participants was lacking. A quarter of the journals did not have any ethical guidelines for submitted manuscripts. We conclude that ethical considerations did not play a significant role in the articles studied. Missing and superficial guidelines enable authors to offer studies with fragile research ethics. It classifies the types of contradictions found in the Bible and suggests how to deal with them. At times the conceptual apparatus created in the philosophy of science is used and a connection to scientific cognition is made, for foundations of philosophy of science can influence the attitude towards biblical contradictions. It emphasizes the role (...) of individual attitudes and the psychological conditionality of taking moral decisions, as well as the importance of shaping moral sensitivity. According to the PCCP thesis, the probability of a conditional A → C is the conditional probability P. This claim is undermined by Lewis’ triviality results, which purport to show that apart from trivial cases, PCCP is not true. In the present article we show that the only rational, “Dutch Book-resistant” extension of the agent’s beliefs concerning non-conditional sentences A and C to the conditional A → C is by assuming that P = P. In other cases a diachronic Dutch (...) Book against the agent can be constructed. There is a tension between our findings and Lewis’ results, which needs to be explained. Therefore, we present a probability space which corresponds in a natural way to the diachronic Dutch Book—and which allows the conditional A → C to be interpreted as an event in a mathematically sound way. It also allows to formalize the notion of conditionalizing A → C on ¬C which plays a crucial role in Lewis’ proof. Our conclusion is that Lewis’ proof is circular, so it cannot be considered to be a sound argument against PCCP. (shrink)

In late 2003, the Canadian media reported that the Islamic Institute of Civil Justice would start offering arbitration in family disputes in accordance with both Islamic legal principles and Ontario's Arbitration Act of 1991. A vociferous two-year debate ensued on the introduction of “Sharia law” in Ontario. This article analyzes representations of Muslim women's agency that came to the fore in this debate by examining reports in three Canadian newspapers. The debate demonstrated two notions of agency. The predominant perspective conceptualized (...) Muslim women's agency as their ability to resist domination, tying secularization to agency. A second strain of the debate portrayed agency as embedded in intersecting social forces of domination and subordination. The first perspective homogenized diverse Muslim communities, fostering the gendered racialization of these communities. Understanding agency as embedded, by contrast, enabled conceptualizations of Muslim women as agentic religious subjects. (shrink)

This paper explores the enactive approach in cognitive science with an eye on the later Wittgenstein’s philosophy. The aim is not that of answering the question: was Wittgenstein an ante litteram enactivist? He was not, because he was not an ante litteram (cognitive) scientist of any kind. The aim, conversely, is that of answering the question: can enactivism be Wittgensteinian? In answering positively, it will be argued that a Wittgensteinian framework can help enactive cognitive scientists in dissolving certain old problems (...) which they sometimes seem not to be able to get rid of. After the Introduction, the first two sections of the paper concern the Wittgensteinian standpoint on psychological concepts (Section 2) and the enactivist approach in its general terms (Section 3). Section 4 attempts a closer examination of some key concepts – chiefly representations, the inner, the “explanatory gap”, the “hard problem” of consciousness – considering both the enactivists’ and Wittgenstein’s attitude towards them. The Conclusion surmises the benefits of a Wittgensteinian perspective also hinting at some other problems which it can help to clarify. (shrink)
