The institutional reform of the Belgian state seems to run parallel with a redefinition of the whole of Belgian society. 'Subnationalism' has overtaken the traditional ethno-linguistic definitions which used to provide a basis for political identification and mobilisation. The territorial demarcation of the regions and the politicisation of cultural life on both sides of the linguistic border constitute basic ingredientsfor 'nationbuilding'projects in Flanders and Wallonia. A number of elements are distinguished to explain why the 'nationalism' of the regions will have (...) repercussions on the political developments in the capital area. Language and territoriality have always played a special role in Brussels. Changes in connection with definitions of territoriality and identity now seem to create opportunities to redefine the relationship between the communities in Brussels. It is not inconceivable that, in the long run, the linguistic divide wilt fade out and wilt be replaced by an identification on the basis of a territorial criterion shared by all the Brussels' inhabitants. Ethical thought experiments such as the trolley dilemma have been investigated extensively in the past, showing that humans act in utilitarian ways, trying to cause as little overall damage as possible. These trolley dilemmas have gained renewed attention over the past few years, especially due to the necessity of implementing moral decisions in autonomous driving vehicles. We conducted a set of experiments in which participants experienced modified trolley dilemmas as drivers in virtual reality environments. Participants had to make decisions between (...) driving in one of two lanes where different obstacles came into view. Eventually, the participants had to decide which of the objects they would crash into. Obstacles included a variety of human-like avatars of different ages and group sizes. Furthermore, the influence of sidewalks as potential safe harbors and a condition implicating self-sacrifice were tested. Results showed that participants, in general, decided in a utilitarian manner, sparing the highest number of avatars possible with a limited influence by the other variables. Derived from these findings, which are in line with the utilitarian approach in moral decision making, it will be argued for an obligatory ethics setting implemented in ADVs. (shrink)

Most commentators agree that Leibniz advocates some version of a doctrine of the ideality or reducibility of relations, but there is considerable disagreement about what exactly this doctrine means. I argue that Leibniz’s views on relations are more complex than has been previously appreciated, and that, despite some ‘reductionist’ strands in Leibniz’s position, it is seriously misleading to describe him as a reductionist about relations without adding some important qualifications. The complexity of Leibniz’s views on relations tends to be obscured (...) by the common assumption that they can be captured in one unified thesis, or a small number of closely related theses, and by the widespread neglect to take Leibniz’s division of reality into several ontological levels into consideration. I disentangle ten Leibnizian theses about relations, extrinsic denominations, and their relation to intrinsic denominations. Some of these theses express a kind of dependence of extrinsic denominations on intrinsic ones, and some of them can even be counted as articulations of a form of reductionism. But, overall, the general tenor of Leibniz’s position on extrinsic denominations remains non-reductionist. (shrink)

In light of new biomedical technologies, such as artificial reproduction, stem cell research, genetic selection and design, the question of what we owe to future persons-and unborn life more generally-is as contested as ever. In A Theory of Unborn Life: From Abortion to Genetic Manipulation, author Anja J. Karnein provides a novel theory that shows how our commitments to persons can help us make sense of our obligations to unborn life. We should treat embryos that will develop into persons (...) in anticipation of these persons. But how viable is this theory? Moreover, what does it mean to treat embryos in anticipation of the future persons they will develop into? Exploring the attractiveness of this approach for Germany and the U.S. - two countries with very different legal approaches to valuing unborn life-Karnein comes to startling conclusions to some of today's greatest ethical and legal debates. The view that agents are not obliged to do more than their initial fair shares when their fellow duty bearers fail to comply has prominent defenders, including Liam Murphy and David Miller. While Murphy thinks that asking agents to take up other agents’ slack would be unfair, Miller claims that slack-taking cannot be required because primary responsibility does not migrate from noncompliers to compliers. This paper argues, by contrast, that there are a number of circumstances in which there is a (...) duty to take up the slack even though it is unfair and even though responsibility stays where it is. The central claim is that what agents owe to third parties is a separate issue from how they relate to fellow duty bearers. This proposal also runs counter to familiar defenses of slack-taking that weigh its unfairness against the moral importance of the interests at stake for third parties. (shrink)

The focus of this article is on elderly patients’ and nursing staff perceptions of privacy in the care of elderly patients/residents in five European countries. Privacy includes physical, social and informational elements. The results show that perceptions of privacy were strongest in the UK (Scotland) and weakest in Greece. Country comparisons revealed statistically significant differences between the perceptions of elderly patients and also between those of nurses working in the same ward or long-term care facility. Perceptions of privacy by patients (...) and their nursing staff were quite similar in Finland, Germany and the UK. In contrast, in Greece and Spain these perceptions were different: nurses believed that they took account of their patients’ privacy needs more often than the patients themselves felt this was the case. Among Spanish and UK patients, an association was found between lower levels of independence and comparatively less positive perceptions of privacy. No associations were established between nurses’ perceptions and their demographic factors. Feministische Aktivist*innen haben sich schon immer verschiedener Medien bedient, um zu kommunizieren, sich zu artikulieren und zu vernetzen. Durch die Digitalisierung und die damit verbundenen Möglichkeiten erweitern sich feministische Aktionsräume und verlagern sich zunehmend ins Social Web. So lässt sich feststellen, dass Plattformen wie twitter, instagram oder auch facebook vielfach genutzt werden, um feministische Anliegen in die Öffentlichkeit zu tragen. Der gegenwärtige mediale Diskurs um feministische Ideen und Forderungen wird dabei maßgeblich durch antifeministische Akteur*innen beeinflusst, deren Anliegen es ist, feministische (...) Stimmen aus dem medialen Raum zu verbannen. Die vorliegende Arbeit greift diese Thematik auf und geht der Frage nach, wie feministische Aktivist*innen antifeministische, digitale Gewalt wahrnehmen und damit umgehen. Die Ergebnisse verweisen darauf, dass insbesondere Aspekte der Sexuellen Identität und der Mehrfachdiskriminierung entscheidend sind für das Ausmaß der digitalen Gewalt, die erfahren wird. Weiterhin wird deutlich, welche Rolle Solidarität, Vernetzung und Empowerment im Kampf gegen den Antifeminismus spielen. Die Autorin Anja Roß studierte Pädagogik und Soziologie an der Universität Bielefeld. Sie arbeitet als wissenschaftliche Mitarbeiterin am Institut für Pädagogik an der Universität Oldenburg. Drawing on interviews with women and men who serve on the supervisory boards of German stock-listed companies, this qualitative study examines why some female directors seek to augment gender equality in their organizations while others do not. Those who take action do so both in formal board processes and in informal settings. A sense of belonging to women as a social group and a sense of responsibility for women in the organization are key factors in explaining why some female directors (...) contribute to gender equality. In addition, the study highlights the relevance of a board culture supportive of gender equality and positive expectations by other organizational members about female directors’ role in advancing gender equality. Board chairs influence how supportive female directors perceive the organizational context to be. Where the organizational context is not seen as supportive, those who take equality-related action anyway are experienced directors. Surprisingly, the presence of other women on the board does not appear to be related to whether or not female directors take action. Examining female directors’ actions and paying close attention to both their identities and their specific organizational settings shows how the interplay between social identity and situational opportunities and constraints affects board behavior. The agri-food system is facing a range of social-ecological threats, many of which are caused and amplified by industrial agriculture. In response, numerous sustainable agriculture narratives have emerged, proposing solutions to the challenges facing the agri-food system. One such narrative that has recently risen to prominence is regenerative agriculture. However, the drivers for the rapid emergence of regenerative agriculture are not well understood. Furthermore, its transformative potential for supporting a more sustainable agri-food system is underexplored. Through a genealogical analysis of (...) four prominent sustainable agriculture narratives; organic agriculture, conservation agriculture, sustainable intensification, and agroecology; we consider how regenerative agriculture’s growing momentum can be contextualised within existing narratives and explore the implications this might have for its transformative potential. This analysis reveals that the genealogies of these sustainable agriculture narratives have led to a number of contestations and complementarities which have coalesced to drive the emergence of regenerative agriculture. We also find that, in contrast to agroecology, regenerative agriculture shares with other Global North narratives a limited scope for offering transformative pathways for agricultural production. This is largely due to their inadequate consideration of power and equity issues in the agri-food system. We argue that regenerative agriculture therefore risks inhibiting deeper agri-food system transformations that address both social and ecological challenges and is not the unifying sustainable agriculture narrative it claims to be. Nonetheless, regenerative agriculture could contribute towards a broader plurality of sustainable agriculture narratives that collectively might enable a transformation to a more sustainable, diverse, and just agri-food system. We investigate whether female executives influence perceived employer attractiveness for female job seekers. Drawing on signaling theory, we argue that female members in top management may signal organizational justice and organizational support and may therefore enhance perceived employer attractiveness. Findings from a scenario experiment with 357 participants indicate that female job seekers are more attracted to an organization with a female executive holding a non-stereotypical office [such as Chief Financial Officer ] as compared to an organization with an all-male top (...) management. Results of a structural equation model show that perceived organizational justice mediates the positive effect of a female holding a non-stereotypical office on perceived employer attractiveness, but perceived organizational support does not. Our results challenge the widely held view that women in top management will generally help attract female job seekers; rather, they suggest that a single female executive holding a stereotypical female office even reduces perceived employer attractiveness. Compulsory labor, justice and the foundations of social law The author argues that normative questions in social law are in need of a more philosophical approach. This is particularly true for the evaluation of Work-first arrangements. She proposes to evaluate workfare policies from the perspective of the reciprocity principle as it is deployed in the work of the liberal egalitarians John Rawls and Stuart White. While Rawls’ interpretation of the reciprocity principle seems to be at odds with Dutch jurisprudence on (...) workfare policies, which allows for Work-first arrangements within the boundaries that are set by article 4 of the European Convention on Human Rights (a prohibition on compulsory labor), White’s approach rather encourages work obligations for welfare recipients, on the condition that citizens acquire individual drawing rights on collective participation funds. Background: Despite the growing potential of mobile-based technologies, innovative interventions targeting the reduction of acute stress in daily life remain under-researched. Music listening is an easy-to-administer activity that is associated with lower levels of biological and self-reported stress. However, the application of music as an intervention in moments of acute stress in daily life remains to be examined. We developed a just-in-time intervention delivering music in moments of stressful experiences in daily life and tested its feasibility using a mixed methods (...) approach.Methods: In this uncontrolled pilot study, the ecological momentary music intervention was tested by 10 chronically stressed women aged 23.5 ± 3.3 years. Over 18 consecutive days, whenever participants reported stressful experiences, they were encouraged to listen to a self-compiled playlist. Subjective stress levels and saliva samples were assessed at three time points per stress report. We analyzed app-based log data, in-the-moment responses, questionnaire data, and semi-structured interview data.Results: On average, participants’ compliance with the study protocol lay at 70%. Overall, 65 stressful experiences were reported, 51 of which were followed by music listening, for an average duration of 12:53 min. Complete data were provided for 46 stressful experiences. Participants reported immediate relaxation and distraction through music listening. The interviews revealed that the intervention was easy to use and that music listening in moments of perceived stress was viewed as a new and pleasant activity. Several aspects of the protocol were identified, which should be improved in future studies.Conclusion: Since repeated stressful experiences in daily life can pose a threat to physical and mental integrity, interventions that are easily applicable and deliver support when needed most are necessary. Following minor adaptations, the EMMI can be considered as a feasible approach to target psychobiological stress responses in daily life, which is worthy of investigation in future larger-scale trials. When the first publication of Hans-Georg Gadamer's magnum opus Wahrheit und Methode came to life in I960, the work was initially received with a slight sense of puzzlement and yet concurrently acknowledged as monumental. The title, in English, Truth and Method, was regarded by the philosophical community both in Germany and abroad as being somewhat obscure, as Gadamer himself would later admit, but the ingeniousness of the book's content could hardly be debated. Since its initial publication, Truth and Method has, (...) respectively helped to expand and light up the horizon of modern hermeneutics by provoking, at once, a reconsideration of the phenomenon of understanding while, at the same time, enlivening the debate over scientific methodology and its exclusive claim to truth. The central aim of the present thesis has been to focus on Part I of Truth and Method, concentrating primarily on the 'guiding humanistic concepts' and the experience of truth in art, to clarify Gadamer's understanding of truth and to shed new light as to how the experience of tmth is to be grasped in relation to the human sciences, i.e. the humanities. The humanistic concepts, I believe, are vital to understanding the experience of truth. One reason, which leads me to this conclusion, is that in Truth and Method Gadamer begins his philosophical undertaking with the elucidation of the humanistic concepts rather than with a direct exposition of truth. By opening with the humanistic concepts, Gadamer seems to demonstrate subtly the phenomenological and ontological nature of knowledge and understanding. The outcome of this manoeuvre is that one comes to realise that truth does not simply belong to method and that it is not something which can be defined solely as 'absolute certainty'. Moreover, in my interview with Professor Gadamer, the humanistic concepts, he explained to me, are the most 'natural' and 'original' concepts. By natural and original he means that these concepts are intrinsic. They evolve from life as well as being a part of life, i.e. a way of living. Thus these concepts, he affirmed, represent 'a way of life' and a way to truth. Consequently, insofar as comprehending the phenomenon of truth, I believe any and every investigation of the concept of truth must begin with the understanding of the humanistic tradition. The following thesis however does not end simply with the humanistic concepts. It also devotes to examining the truth-claim or the 'truth-experience' of art. This part of the inquiry centres on two important questions: How are we to understand art? What does it mean to experience art? The challenge here has been to show how Gadamer overcomes Kant's subjectivation of the aesthetic experience and to demonstrate how and why Gadamer considers the experience of art as the 'self-presentation' of being. In surveying the various works of criticism I have tried to draw attention to what seem to me to be the most insightful comments and analyses. If 1 have failed in any way to supply proper acknowledgement to ideas, which might seem close to other critical works, I offer my apologies. As I am sure those in the research business know well, in reflection ideas often interfuse with one's own, making it difficult sometimes to discriminate between one's own ideas from another's. Interactions among membrane proteins regulate numerous cellular processes, including cell growth, cell differentiation and apoptosis. We need to understand which proteins interact, where they interact and to which extent they interact. Dekonstruktion und Demokratisierung stehen dabei weder in einem parallelen noch einem additiven Verhiiltnis, auch wenn die Konjunktion "und" dies suggerieren mag. Es (...) handelt sich um zwei offene, einander verschiebende Prozesse, deren Verschriinkung diese Studie darlegen mochte. Over the last three decades, the art market has undergone a remarkable transformation. Before the 1990s, artworks were sold with hardly any concern about whether they had been stolen or looted, whereas now any reputable gallery or auction house checks the “provenance” of any substantial work before sale. This transformation reflects interlocking changes in law, norms, and institutions. New York’s and more broadly the United States’ assertion of jurisdiction and application of U.S. substantive law has destabilized title to stolen and (...) looted goods worldwide because American statutes of limitations generally provide weaker protection for those who possess stolen or looted goods even in good faith. Application of American law has had a profound effect, especially for the high end of the market, because European or Asian investors who purchase art outside of the U.S. may eventually want to sell or display their works in the U.S. Defective title under American law thus affects prices worldwide. The tightening and broader application of American law reflects both longstanding legal principles and changes in social norms towards the redress of historical wrongs, most notably prominent campaigns relating to art confiscated or sold under duress in Nazi Germany. New institutions, most importantly searchable databases recording stolen and looted art such as the Art Loss Register, are also changing perceptions about minimum standards for good faith purchase, which in turn affects both social norms and court cases. These new norms, induced by both legal changes and better information, have influenced the market even for less valuable art, for which sale or display in the U.S. is not a relevant consideration and for which the threat of costly legal action is not credible. The fact that social and institutionalized norms play an important role in protecting original owners is probably good, because norms and institutions can be effective even where law is not and often do so at lower cost. In this article, I discuss the commemoration of public figures such as Nelson Mandela and Yitzhak Rabin. In many cases, our commemoration of such figures is based on the admiration we feel for them. However, closer inspection reveals that most (if not all) of those we currently honour do not qualify as fitting objects of admiration. Yet, we may still have the strong intuition that we ought to continue commemorating them in this way. I highlight two problems that arise here: (...) the problem that the expressed admiration does not seem appropriate with respect to the object and the problem that continued commemorative practices lead to rationality issues. In response to these issues, I suggest taking a fictionalist position with respect to commemoration. This crucially involves sharply distinguishing between commemorative and other discourses, as well as understanding the objects of our commemorative practices as fictional objects. (shrink)

It is argued that the popular story that portrays Kant’s philosophical development as a gradual emancipation from his Leibniz-Wolffian roots that culminated in a total rejection of the Leibnizian philosophy by 1781 is not accurate. Kant’s many objections against the Leibnizian philosophy in the critical period are not directed against Leibniz himself but against the Leibniz-Wolffians. Kant considers Leibniz’s philosophy to be very close to his own, calling the Critique of Pure Reason the “true apology” of Leibniz. It is claimed (...) that this assessment is correct; the correctness is demonstrated with respect to Kant’s and Leibniz’s theories of space. (shrink)

Conrad Gessner was town physician and lecturer at the Zwinglian reformed lectorium in Zurich. His approach towards the world and mankind was centred on his preoccupation with the human soul, an object of study that had challenged classical writers such as Aristotle and Galen, and which remained as important in post-Reformation debate. Writing commentaries on Aristotles De Anima was part of early-modern natural philosophy education at university and formed the preparatory step for studying medicine. This article uses the case study (...) of Gessners commentary on De Anima to explore how Gessners readers prioritised De Animas information. Gessners intention was to provide the students of philosophy and medicine with the most current and comprehensive thinking. His readers responses raise questions about evolving discussions in natural philosophy and medicine that concerned the foundations of preventive healthcare on the one hand, and of anatomically specified pathological medicine on the other, and Gessners part in helping these develop. Asthereisa permanent shortage of human organs for transplantation purposes new methods to provide organs are being developed. The author deals with these new developments as there are artificial organs, genetically engineered animal organs and therapeutical cloning or embryonie stem cells to cultivate human organs. The goal of the article is to give an overview on these approaches and to summarize ethical aspects related to research, development and application of these methods.

The authors take a fresh look at the distinction between narrow and broad stakeholder theory, as represented by the business management models of Milton Friedman and R. Edward Freeman respectively. The main goal is a critical examination of the criteria and consequences of a practical application in the area of international law, a project that involves scrutinizing each version’s doctrinal assumptions as well as a comparative assessment. Emphasizing fundamental rights and corresponding duties, the starting point is that neither Friedman nor (...) Freeman has a philosophically developed framework for the otherwise central value concepts. As regards economic/social rights, this results in a broad defense that is as unsubstantiated as the attack which the narrow counterpart launches. However, once the Classical Choice Theory of Rights and the Modern Interest Theory of Rights are added to the case of Friedman versus Freeman, this can be adjudicated—using a number of different test procedures—in favor of a comprehensive typology of rights and the Modern Interest Theory of Rights. In the course of adjudication, the authors also supplement the broad approach with a framework for needs that accords with Freeman’s proposed logic of value concepts. (shrink)

One of the most fascinating but also one of the most criticised legal theories in the USA for the last years have been the Critical Legal Studies which emerged some thirty years ago and queried the hegemonic views on the law and the law system in the US. This essay especially tries to analyse the position of one of the leading representatives of this so called “movement” - Duncan Kennedy - towards the role of judges in the US-American legal system. As the American legislation and adjudication have intensified their ambitions to extend their power of jurisdiction - all thus going hand in hand with a restriction of the human rights - a view on a critical and progressive US-American theory of jurisdiction is of great importance. New forms of artificial intelligence on the one hand and the ubiquitous networking of “everything with everything” on the other hand characterize the fourth industrial revolution. This results in a changed understanding of human–machine interaction, in new models for production, in which man and machine together with virtual agents form hybrid teams. The empirical study “Socializing with robots” aims to gain insight especially into conditions of development and processes of hybrid human–machine teams. In the experiment, human–robot actions and interactions were (...) closely observed in a virtual environment. Robots as partners differed in shape and behavior. Participants were instructed to achieve an objective that could only be achieved via close teamwork. This paper unites different aspects from core disciplines of social robotics and psychology contributing to anthropomorphization with the empirical insights of the experiment. It focuses on the psychological effects on anthropomorphization and mechanization, taking the inter- and transdisciplinary field of social robotics as a starting point. (shrink)

Weak Quantum Theory (WQT) and the Model of Pragmatic Information (MPI) are two psychophysical concepts developed on the basis of quantum physics. The present study contributes to their empirical examination. The issue of the study is whether WQT and MPI can not only explain ‘psi’-phenomena theoretically but also prove to be consistent with the empirical phenomenology of extrasensory perception (ESP). From the main statements of both models, 33 deductions for psychic readings are derived. Psychic readings are defined as settings, in (...) which psychics support or counsel clients by using information not mediated through the five senses. A qualitative approach is chosen to explore how the psychics experience extrasensory perceptions. Eight psychics are interviewed with a half-structured method. The reports are examined regarding deductive and inductive aspects, using a multi-level structured content analysis. The vast majority of deductions is clearly confirmed by the reports. Even though the study has to be seen as an explorative attempt with many aspects to be specified, WQT and MPI prove to be coherent and helpful concepts to explain ESP in psychic readings. (shrink)

It is becoming less and less controversial that we ought to aggressively combat climate change. One main reason for doing so is concern for future generations, as it is they who will be the most seriously affected by it. Surprisingly, none of the more prominent deontological theories of intergenerational justice can explain why it is wrong for the present generation to do very little to stop worsening the problem. This paper discusses three such theories, namely indirect reciprocity, common ownership of (...) the earth and human rights. It shows that while indirect reciprocity and common ownership are both too undemanding, the human rights approach misunderstands the nature of our intergenerational relationships, thereby capturing either too much or too little about what is problematic about climate change. The paper finally proposes a way to think about intergenerational justice that avoids the pitfalls of the traditional theories and can explain what is wrong with perpetuating climate change. The focus of this article is on elderly patients’ and nursing staff perceptions of informed consent in the care of elderly patients/residents in five European countries. The results suggest that patients and nurses differ in their views on how informed consent is implemented. Among elderly patients the highest frequency for securing informed consent was reported in Finland; the lowest was in Germany. In contrast, among nurses, the highest frequency was reported in the UK (Scotland) and the lowest in Finland. In (...) a comparison of patients’ and nurses’ perceptions, nurses had more positive views than patients in all countries except Finland. Patients with less need for nursing interventions in Greece and Spain gave their consent less often. The German and Greek patients were older, and the results also point to an association between this and their lower frequency of giving consent. In Spain, patients who were married or who had a family member or friend to look after their personal affairs were more likely to be included in the group whose consent was sought less often. This is the fourth of a set of five articles published together in this issue of Nursing Ethics in which the results of this comparative research project are presented. (shrink)

The influence of background music on cognitive functions is still a matter of debate. In this study, we investigated the influence of background music on executive functions (particularly on inhibitory functions). Participants completed a standardized cued Go/NoGo task during three different conditions while an EEG was recorded (1: with no background music, 2: with relaxing or 3: with exciting background music). In addition, we collected reaction times, omissions, and commissions in response to the Go and NoGo stimuli. From the EEG (...) data, event-related potentials (ERPs) were calculated for the Go and NoGo trials. From these ERPs, the N2 and P3 components were specifically analyzed since previous studies have shown that these components (and particularly the Go-NoGo difference waves) are strongly associated with inhibitory functions. The N2 and P3 components of the difference waves (N2d and P3d) were used for statistical analyses. The statistical analyses revealed no differences between the three conditions in terms of amplitudes and latencies of the N2d and P3d components. In addition, reaction times, omissions, and commissions were comparable across all conditions. Our results suggest that in the context of this paradigm, music as background acoustic stimulation has no detrimental effects on the performance of a Go/NoGo task and neural underpinnings. (shrink)

“12 × 12 = 144”. Psychological Certainty versus Logical Exclusion of Error in On Certainty, Illustrated by the Example of Artihmetic. The aim of this paper is to exemplify Wittgenstein’s distinction between a psychological certainty and the logical exclusion of error by considering his discussion of our use of simple calculations like “12 × 12 =144” in On Certainty. Three aspects seem to be relevant in this context: 1. Wittgenstein’s notes on our use of the word “to know” in the (...) context of these simple calculations (and on the irrelevance of inner states or processes for this use); 2. his discussion of the wish for “transcendental certainty” (OC 1975: 47); 3. his remarks on the logical exclusion of error. Wilke et al. make significant headway in gaining a better understanding of the influence affect cues may have on action perception and judgement. In our view their account also brings up a row of important questions demanding further research. This concerns the role of conceptual and non-conceptual content and the different effects emotions of the same valence may play in the perception and judgement of action.
