Scientists and clinicians are starting to translate genomic discoveries from research labs to the clinical setting. In the process, big data genomic technologies are both a risk to individual privacy and a benefit to personalized medicine. There is an opportunity to address the social and ethical demands of various stakeholders and shape the adoption of diagnostic genome technologies. We discuss ethical and practical issues associated with the networking of genomics by comparing how the European Union and North America understand and (...) practice notions of privacy and consent in research. An overview of international policy suggests the embedding of genomics within digital networks and the Internet creates conditions that challenge the management of privacy and consent in the age of big data. The risks of re-identification, informational harms, and data security vulnerabilities are issues that need to be better addressed in the clinical setting to reconcile the unpredictable pathway of research and practice in the networked information society. Ma is a curriculum. The Japanese concept of ma refers to the interval between two markers. In a dialectic exploration, the spaces between--private/public, teacher/student, old/new, self/other, among others are probed in ways that contribute to the significant research in teaching and learning that has been undertaken in the last decades.

Urban communities in 21st century America are facing severe economic challenges, ones that suggest a mandate to contemplate serious changes in the way America does business. The middle class is diminishing in many parts of the country, with consequences for the economy as a whole. When faced with the loss of its economic base, any business community must make some difficult decisions about its proper role and responsibilities. Decisions to support the community must be balanced alongside and against responsibilities to (...) owners, shareholders and relevant “stakeholders” in a relatively new context. Corporations in urban communities “hollowed out” by white flight or urban sprawl must decide what level of support they can and should provide. This paper examines corporate decisions within the emerging urban prosperity initiatives, using the framework of integrative social contract theory proposed by Donaldson and Dunfee. We suggest that urban prosperity initiatives present a mandate on corporations sufficiently strong as to qualify as an authentic norm. Further, we argue that strict adherence to a corporate bottom line approach or “corporate isolationism” is not congruent with contemporary community standards. (shrink)

In the twentieth century, most PhD-trained academic philosophers in both the United States and United Kingdom were white men. The first black woman to earn a PhD in Philosophy was Joyce E. Mitchell Cook. A preacher's daughter from a small town in western Pennsylvania, Cook earned a BA from Bryn Mawr College. She went on to earn degrees in Psychology, Philosophy and Physiology from St Hilda's College at Oxford University before earning a PhD in Philosophy from Yale University in (...) 1965. At Yale she served as Managing Editor of the Review of Metaphysics and was the first woman appointed as a teaching assistant in Philosophy. She taught at Howard University for nearly a decade and held positions in national government service in Washington, DC, before retiring to a life of independent study of the black experience. Although she did not publish much in her lifetime, Cook deserves to be remembered as: first, an academic trailblazer who proved that race and gender are not barriers to excellence in philosophy; second, a public philosopher who broke barriers as a foreign and economic affairs analyst and presidential speech writer; third, among the first philosophical bioethicists of informed consent and experimentation on humans; and, fourth, an analytic philosopher of race, opposing claims that blacks suffer from inherited intellectual inferiority. Cook's achievements can inspire women of all backgrounds who love philosophy to pursue graduate studies and academic careers. (shrink)

In 1905 the Supreme Court of Georgia became the first state high court to recognize a freestanding “right to privacy” tort in the common law. The landmark case was Pavesich v. New England Life Insurance Co. Must it be a cause for deep jurisprudential concern that the common law right to privacy in wide currency today originated in Pavesich’s explicit judicial interpretation of the requirements of natural law? Must it be an additional worry that the court which originated the common (...) law privacy right asserted that a free white man whose photograph is published without his consent in a city newspaper is like a slave in bondage? I argue that the jurisprudence of Pavesich need not be troubling. Pavesich’s natural law argument was supplemented by several positive law arguments. The positive law arguments were a strong enough basis for finding a right to privacy in the common law, as indeed Samuel Warren and Louis Brandeis had previously argued. The observation that the Pavesich court’s natural law argument ran alongside positivistic arguments suggests that the arresting, high-toned natural law and slavery appeals in Pavesich are inessential rhetorical throwaways. But I maintain that the natural law argument and slavery analogy features of Judge Andrew Jackson Cobb’s opinion extolling the “liberty of privacy” are (1) of critical importance to a full contextual understanding of the decision and (2) illuminate the contemporary case for recognizing invasions of privacy as civil injuries to freedom and self-determination. One can poke holes in the logic of Thomas Aquinas and John Locke as scholars have done for centuries. But one can as easily choose to celebrate the spirit of the natural law tradition. The natural law tradition represents efforts rhetorically, rationally, and intuitively to derive principles of justice and goodness from basic facts about human characteristics, needs, and desires, where otherwise binding sovereign law may fall short. Depression is a widespread concern in the United States. Neuromodulation treatments are becoming more common but there is emerging concern for racial disparities in neuromodulation treatment utilization. This study focuses on Transcranial Magnetic Stimulation (TMS), a treatment for depression, and the structural and attitudinal barriers that racialized individuals face in accessing it. In January 2023 participants from the Twin Cities, Minnesota engaged in focus groups, coupled with an educational video intervention. Individuals self identified as non-white who had no previous (...) TMS exposure but had tried at least one treatment for their depression. Results revealed that the intervention did not notably change knowledge or stigma about TMS, but attitudes surrounding traveling for treatment changed. Notably, barriers like affordability, frequency of treatment, and lack of knowledge persist. Participants expressed a desire for more information, personal connection, and a tailored educational approach. The study suggests a need for multifaceted strategies to reduce disparities, focusing on education, community-based resources, and policy interventions. Immediate actions that can be taken include the creation of a TMS education program focused on patient engagement and awareness about TMS. (shrink)

Using data from interviews, student work, and classroom observations in a “History of Race” course at a private predominantly White high school, this article examines the racialized tensions that led the teacher (first author) to create an unofficial affinity group for students of color that met outside of class. The authors argue that the teacher's attempt to implement a curriculum that was culturally affirming for students of color by de-centering Whiteness led to White students’ resistance that necessitated the (...) creation of an unofficial “safe space” outside of the classroom for the students of color. The need for such a group demonstrates the difficulties inherent in presenting a more honest account of the role of race and racism in the United States that challenges narratives of historical progress. The article concludes that while students of color ideally should have access to culturally affirming knowledge inside social studies classrooms, this experience demonstrates why that kind of knowledge can only be engaged effectively within learning spaces that challenge the norms of conventional social studies education. Looking for Asian America illustrates their rich and surprising journey across the United States. Through Huie’s eyes, keenly aware of his own Midwestern roots and perspective, we witness such images as a Vietnamese Elvis, Miss Congeniality on her cell phone in San Francisco’s Chinatown, a Hmong street sign in rural North Carolina, a meditating Falun Gong protestor in Washington, D.C., a bubble tea Valley Girl, and a Chinese theme park in Orlando. Huie’s camera captures ABCs, FOAs, and a self-described “redneck” Chinese restaurant owner near the Okefenokee Swamp. Taken together the photographs reveal a complex portrait of the U.S. cultural landscape, and their dignified elegance invites a closer, deeper look. Accompanied by the personal reflections of both Wing and Tara Huie, the nearly one hundred spectacular photos tell a story that both mirrors and contradicts stereotypes of Asian Americans, ultimately questioning what it means to be ethnic and American in the twenty-first century. Wing Young Huie has received widespread acclaim for his works, including Lake Street USA, documenting the cultural landscape of his native Minnesota. We agree with McCullough, Coverdale and Chervenak1 that ‘medical educators and academic leaders are in a pivotal and powerful position to role model’ to counter ‘incivility’ in medicine, which can include ‘dismissing’ or ‘demeaning others’. They note that ‘women may be at greater risk for experiencing incivility compared with men’, as may other individuals who experience ‘patterns of disrespect based on minority status’. The authors promote ‘professionalism’ and ‘etiquette’ to foster civility within medicine. Yet theory and experience suggest that medical (...) educators and academic leaders are also in powerful positions to mobilise these concepts to perpetuate exclusions from, and biases within, medicine, upholding racist, sexist and ableist norms. Feminist methodology reveals how ethical theorising historically excluded views and experiences of marginalised individuals and groups and provides frameworks for interrogating supposedly universal norms. Presuming dominant values and experiences reflect universal ones can further marginalise already oppressed groups and individuals. A feminist analysis reveals how ‘professionalism’ or ‘etiquette’ are historically shaped by white or male identity and experience, including norms of attire, hair, accessories, speech or behaviour. Part of the hidden curriculum of medicine becomes intuiting how leaders implicitly or explicitly define ‘professionalism’. McCullough et al define ‘professionalism’ in medicine as ‘sustained commitments to scientific and clinical excellence… making the protection and promotion of health-related interest the physician’s primary concern …. Anita Silvers (1998) has criticized those who argue that members of marginalized groups are vulnerable to a special threat posed by physician-assisted suicide (PAS) and voluntary active euthanasia (VAE). She argues that paternalistic measures prohibiting PAS/VAE in order to protect these groups only serve to marginalize them further by characterizing them as belonging to a definitively weak class. I offer a new conception of vulnerability, one that demonstrates how rich, educated, white males, who are typically regarded as having (...) their autonomy enhanced by their social status, are just as, if not more, vulnerable to threats posed by PAS/VAE as a result of the harmful social messages at work just below the surface of contemporary Western culture. I use this new conception of vulnerability to reinforce arguments for continued statutory prohibitions on PAS/VAE. (shrink)

It has become increasingly difficult for individuals to exercise meaningful control over the personal data they disclose to companies or to understand and track the ways in which that data is exchanged and used. These developments have led to an emerging consensus that existing privacy and data protection laws offer individuals insufficient protections against harms stemming from current data practices. However, an effective and ethically justified way forward remains elusive. To inform policy in this area, we propose the Ethical Data (...) Practices framework. The framework outlines six principles relevant to the collection and use of personal data—minimizing harm, fairly distributing benefits and burdens, respecting autonomy, transparency, accountability, and inclusion—and translates these principles into action-guiding practical imperatives for companies that process personal data. In addition to informing policy, the practical imperatives can be voluntarily adopted by companies to promote ethical data practices. (shrink)

Demonstrates the way in which the principles of analytic philosophy can be used in solving problems in contemporary American life.

Youths with disruptive behavior disorders and psychopathic traits showed reduced amygdala responses to fearful expressions under low attentional load but no indications of increased recruitment of regions implicated in top- down attentional control. These findings suggest that the emotional deficit observed in youths with disruptive behavior disorders and psychopathic traits is primary and not secondary to increased top- down attention to nonemotional stimulus features.

Recent developments, both in the cognitive sciences and in world events, bring special emphasis to the study of morality. The cognitive sciences, spanning neurology, psychology, and computational intelligence, offer substantial ad- vances in understanding the origins and purposes of morality. Meanwhile, world events urge the timely synthesis of these insights with traditional ac- counts that can be easily assimilated and practically employed to augment moral judgment, both to solve current problems and to direct future action. The object of the following (...) paper is to present such a synthesis in the form of a model of moral cognition, the ACTWith model of conscience. The purpose of the model is twofold. One, the ACTWith model is intended to shed light on personal moral dispositions, and to provide a tool for actual human moral agents in the refinement of their moral lives. As such, it relies on the power of personal introspection, bolstered by the careful study of moral exemplars available to all persons in all cultures in the form of literary or religious fig- ures, if not in the form of contemporary peers and especially leadership. Two, the ACTWith model is intended as a minimum architecture for fully func- tional artificial morality. As such, it is essentially amodal, implementation non-specific and is developed in the form of an information processing control system. There are given as few hard points in this system as necessary for moral function, and these are themselves taken from review of actual human cognitive processes, thereby intentionally capturing as closely as possible what is expected of moral action and reaction by human beings. Only in satisfying these untutored intuitions should an artificial agent ever be properly regarded as moral, at least in the general population of existing moral agents. Thus, the ACTWith model is intended as a guide both for individual moral develop- ment and for the development of artificial moral agents as future technology permits. (shrink)

This paper focuses on epistemic practices within biomedical ethics that are related to disability. These practices are one of the reasons that there is tension between biomedical ethicists and disability advocates. I argue that appeals to conceptual neutrality regarding disability, which Anita Silvers recommends, are counterproductive. Objectivity as neutrality serves to obscure the social values and interests that inform epistemic practices. Drawing on feminist standpoint theory and epistemologies of ignorance, I examine ways that appeals to objectivity as neutrality serve (...) to maintain the status quo and ignorance regarding disability. I adapt Charles Mills’s notion of “white ignorance” in order to consider the systematic social ignorance regarding disability that is treated as knowledge. Bioethicists commonly dismiss the reports of disabled people regarding their quality of life as biased, while claiming that their own judgments are objective. Sandra Harding’s notion of strong objectivity is useful for thinking about ways that examination of values and interests informing epistemic practices related to disability in biomedical ethics could create better knowledge practices by taking the standpoint of disabled people seriously. In the noble tradition of Jaron Lanier's You Are Not a Gadget (Penguin, 2011), Curtis White's We, Robots takes the radical position that maybe we shouldn't cede every bit of control, humanity, and decision making to technology, and that the techno-futurists in our mix have things dangerously backwards. What a notion! In this sharply argued and rousing book, White not only attacks the technology-loving establishment, but offers a beautiful and essential alternative.

This paper examines Ronald Dworkin's claim that the right to free speech does not include a right to circumstances that encourage citizens to speak nor a right to competent and sympathetic understanding on the part of listeners. Drawing on familiar arguments for the existence of other human rights, the paper challenges Dworkin's claim. Even if, however, the challenge fails and it is not possible to show that there is such a right, that is not the end of the story. It (...) is argued that democratic societies should try to foster conditions in which citizens are encouraged to speak and are listened to sympathetically in the interests of the well-being and flourishing of the polity. Among Western philosophers, Schopenhauer is one of the few who seeks to clarify the nature of music, and its effects upon us. He claims that music is the most important of all the arts; and he argues that music is a kind of metaphysics that allows us to experience the ultimate reality of the world. In this essay, I evaluate Schopenhauer’s philosophy of music in the context of his overarching philosophy. Then I discuss the relevance of traditional Indian philosophies -- (...) including Advaita Vedanta and Buddhism -- which Schopenhauer recognized as forerunners to his own philosophical system. Here, the discussion of Om is particularly important. Schopenhauer’s discussion of music is insightful. But his insistence on the priority of the will is problematic. I suggest another perspective on willing, ultimate reality and music which follows the classical Indian philosophies that he affirms. (shrink)

Ryan Tonkens has issued a seemingly impossible challenge, to articulate a comprehensive ethical framework within which artificial moral agents satisfy a Kantian inspired recipe—"rational" and "free"—while also satisfying perceived prerogatives of machine ethicists to facilitate the creation of AMAs that are perfectly and not merely reliably ethical. This series of papers meets this challenge by landscaping traditional moral theory in resolution of a comprehensive account of moral agency. The first paper established the challenge and set out autonomy in Aristotelian terms. (...) The present paper interprets Kantian moral theory on the basis of the preceding introduction, argues contra Tonkens that an engineer does not violate the categorical imperative in creating Kantian AMAs, and proposes that a Kantian AMA is not only a possible goal for Machine ethics research, but a necessary one. In his Essay concerning Human Understanding, John Locke explicitly refers to Newton’s Philosophiae naturalis principia mathematica in laudatory but restrained terms: “Mr. Newton, in his never enough to be admired Book, has demonstrated several Propositions, which are so many new Truths, before unknown to the World, and are farther Advances in Mathematical Knowledge” (Essay, 4.7.3). The mathematica of the Principia are thus acknowledged. But what of philosophia naturalis? Locke maintains that natural philosophy, conceived as natural science (as opposed to natural (...) history), would give us demonstrations of the necessary connection between the (ultimately, simple) ideas constitutive of our complex ideas of various natural kinds of substances (e.g., gold). Indeed Locke goes so far as to suggest that a completely adequate natural science would also realize (perhaps, per impossibile) the goal of transforming the corpuscularian hypothesis into knowledge by demonstrating the necessary connection between the ‘microstructure’ (primary qualities of insensible corpuscles) of a particular natural kind of substance (e.g., gold) and the ideas of secondary qualities constitutive of the complex idea of that kind of substance. Locke’s conclusion concerning the possibility of the development of a natural science thus conceived is pessimistic: In vain therefore shall we endeavor to discover by our Ideas, (the only true way of certain and universal knowledge,) what other Ideas are to be found constantly joined with that of our complex Idea of any Substance: since we neither know the real Constitution of the minute Parts, on which their Qualities do depend; not, did we know them could we discover any necessary connexion between them, and any of their Secondary Qualities: which is necessary to be done, before we can certainly know their necessary co-existence (Essay, 4.3.14). It is understandable that, with such a conception of the science of nature, Locke found little of it in Newton’s Principia. In this paper, I further explore what might, perhaps with some hyperbole, be termed Locke’s ‘disappointment’ with the Prinicipia as a contribution to natural science. In particular, I argue that Locke’s adherence to the idealist epistemology of the Way of Ideas entails that mathematics cannot lend its certainty as a scientia to natural philosophy. Consequently, he finds more mathematics than natural philosophy in the Principia. (shrink)

The clash between the public right to know and public safety is just one of the fundamental conflicts raised by Hurst and White in this, the first definitive study of ethics in the Australian news media. Hurst and White explore the concept of ethical conduct, apply it to journalism, then draw on a wealth of local examples where the news media's conduct was challenged. They examine the attempts to codify the principles - from the policies of press councils (...) to the journalists' own codes of ethics - and show where these are inadequate, muddled or honoured in the breach. BackgroundThe COVID-19 pandemic has magnified pre-existing challenges in healthcare in Africa. Long-standing health inequities, embedded in the continent over centuries, have been laid bare and have raised complex ethical dilemmas. While there are very few clinical ethics committees (CECs) in Africa, the demand for such services exists and has increased during the COVID-19 pandemic. The views of African healthcare professionals or bioethicists on the role of CECs in Africa have not been explored or documented previously. In this study, we aim (...) to explore such perspectives, as well as the challenges preventing the establishment of CECs in Africa.MethodsTwenty healthcare professionals and bioethicists from Africa participated in this qualitative study that utilized in-depth semi-structured interviews with open-ended questions. Themes were identified through thematic analysis of interviews and open-ended responses.ResultsKenya and South Africa are the only countries on the continent with formal established CECs. The following themes emerged from this qualitative study: (1) Lack of formal CECs and resolution of ethical dilemmas; (2) Role of CECs during COVID-19; (3) Ethical dilemmas presented to CECs pre-COVID-19; (4) Lack of awareness of CECs; (5) Lack of qualified bioethicists or clinical ethicists; (6) Limited resources to establish CECs; (7) Creating interest in CECs and networking.ConclusionsThis study illustrates the importance of clinical ethics education among African HCPs and bioethicists, more so now when COVID-19 has posed a host of clinical and ethical challenges to public and private healthcare systems. The challenges and barriers identified will inform the establishment of CECs or clinical ethics consultation services (CESs) in the region. The study results have triggered an idea for the creation of a network of African CECs. (shrink)

The current study examined whether Callous-Unemotional (CU) traits, a core component of psychopathy, modulate neural responses of participants engaged in a social exchange game. In this task, participants were offered an allocation of money and then given the chance to punish the offerer. Twenty youth participated and responses to both offers and the participant’s punishment (or not) of these offers were examined. Increasingly unfair offers were associated with increased dorsal anterior cingulate cortex (dACC) activity but this responsiveness was not modulated (...) by CU traits. Increasing punishment of unfair offers was associated with increased dACC and anterior insula activity and this activity was modulated by CU traits. Higher CU trait participants showed a weaker association between activity and punishment level. These data suggest that CU traits are associated with appropriate expectations of other individual’s normative behavior but weaker representations of such information when guiding behavior of the self. Moral values are real—we don't just make them up. Beauty is in the world—it's not just in the eye of the beholder. You are free—what you do is not always determined by electrochemical processes in your brain. And the universe we live in is God's creation. These are radical claims. But they are widely rejected in contemporary philosophy because they are almost always considered in relative isolation from one another. This book shows that when they are considered in conjunction, they (...) gain mutual support. And it shows this both clearly and concisely. But its systematic approach to philosophy also reveals that various philosophical positions currently widely accepted and defended can appear plausible and perhaps even compelling only when they are considered in relative isolation—as they, too, almost always are. When the issues on which these positions are taken are considered in conjunction, problems come into view and the alternative positions defended in this book emerge as superior. Toward a Philosophical Theory of Everything is a ground-breaking work that shows the importance of systematic thinking, while also defending positions, on central philosophical issues, that are widely rejected in contemporary philosophy.
