This study aims to analyse the pros and cons of imposing penalties or fines in law enforcement regulations for violating health protocols in Indonesia. Some people consider that the norm of the fine sanctions in statutory provisions regulating health protocol violators is unconstitutional, but others say it is constitutional. As a country with the largest Muslim population in the world, a study of the perspective of Islamic law is essential. This article uses a normative legal research methodology using two main (...) approaches: the statutory and conceptual approaches. The results show that fines are found in the criminal law clusters and state administrative law. Penalties in state administrative law in their enforcement do not require intervention from other institutions. Still, they can be carried out directly by government officials whose authority has been determined in the laws and regulations. Meanwhile, from the Islamic perspective, the fine sanctions can be applied, in the context of hifz Al-Insan, in Maslahah Mursalah as part of the maqasid al-Syari’ah. The obligation to obey government regulations is part of a person’s obedience to God’s commands. Contribution: This study’s findings can support the government in enforcing the law to combat the spread of the coronavirus disease 2019 (COVID-19) in Indonesia and other countries because, constitutionally, the law is legal. Then, the legality of fines for violators of the COVID-19 health protocol, from an Islamic perspective, does not contradict maqasid al-shari’ah. So, there should be no doubts for Muslims to obey these regulations. (shrink)

This study aims at reducing, and even eliminating, the thoughts of small Muslim groups in Indonesia, which state that the replacement of Pancasila as a Khilafah will raise the Indonesian state to become a developed country. This study uses a normative legal research methodology with two approaches: a historical and a conceptual approach. The historical approach was used to review the history of the implementation of the Khilafah system in Islam and the early history of the emergence of Pancasila as (...) a national government system. Meanwhile, the conceptual approach was used as a road map to examine the Khilafah and Pancasila concepts in the constitutional system. The results of this study revealed that Pancasila represents the Indonesian nation's ideology, which is in tune with Islamic law, and can answer all the needs of its people. Through Pancasila, the Indonesian people can live in harmony amidst existing pluralism. Therefore, there is no space for ideology other than Pancasila to fill and become the foundation of the Indonesian nation.CONTRIBUTION: This article attempts to answer Muslim people's doubts with extremist ideology who want to change Pancasila into Khilafah. No movement seeks to change the Pancasila government system with other government systems. (shrink)

The essay is an attempt to describe the ‘different’ personal life experience of the author. The problems of inclusion in the Ukrainian society of the Soviet period are touched upon and positive examples of inclusion at the present stage of formation of the civil society are given. The question was raised about the need for a philosophical analysis of the formation and functioning of the ’public sphere of disability’, the role and place of disabled people in modern Ukrainian society, as (...) well as the identification of key agents of discussion based on the classical communicative action model of Jürgen Habermas, in addiction to modern directions of development of this model. Vasil’ Sukhomlinskyi’s holistic pedagogical doctrine of the ‘School of Joy’ is considered as a field of activity for specialists in educational philosophy, practical and social philosophy in the light of the problems of integration and inclusion of people with special needs. This paper describes an axiomatic theory BT, which is a suitable formal theory for developing constructive mathematics, due to its expressive language with countable number of set types and its constructive properties such as the existence and disjunction properties, and consistency with the formal Church thesis. BT has a predicative comprehension axiom and usual combinatorial operations. BT has intuitionistic logic and is consistent with classical logic. BT is mutually interpretable with a so called theory of arithmetical truth PATr and with (...) a second-order arithmetic SA that contains infinitely many sorts of sets of natural numbers. Resumo: A memória nacional do Cazaquistão caiu no esquecimento, durante os 70 anos de regime soviético, o que levou à ameaça de perda parcial do patrimônio cultural nacional. A política colonial russa impediu a visita a lugares sagrados, como tradição, para honrar os antepassados e perpetuar a memória nacional. Quando o Cazaquistão se tornou independente, a memória histórica perdida foi restaurada pela formação da ideologia espacial e constituiu uma “canonização nacional” espontânea. Os iniciadores da renovação dos lugares de memória no (...) país, incluindo os locais sagrados, foram os descendentes dos antepassados sagrados e os cidadãos patriotas. Em 2017, o Estado adotou o programa Rukhani Zhangyru, que visa à restauração de locais históricos com potencial para o desenvolvimento da consciência nacional e a unificação nacional em torno da história viva. A esse respeito, o principal objetivo deste trabalho é estudar os pontos de crescimento de uma nova ideologia espacial, na paisagem cultural do Cazaquistão. This paper describes axiomatic theories SA and SAR, which are versions of second order arithmetic with countably many sorts for sets of natural numbers. The theories are intended to be applied in reverse mathematics because their multi-sorted language allows to express some mathematical statements in more natural form than in the standard second order arithmetic. We study metamathematical properties of the theories SA, SAR and their fragments. We show that SA is mutually interpretable with the theory of arithmetical truth PATr (...) obtained from the Peano arithmetic by adding infinitely many truth predicates. Corresponding fragments of SA and PATr are also mutually interpretable. We compare the proof-theoretical strengths of the fragments; in particular, we show that each fragment SAs with sorts <=s is weaker than next fragment SAs+1. (shrink)

The article discusses the key stages of the development of ‘disability studies’. Public awareness of the problems of inclusion, as overcoming social inequality, is in the stage of formation in Ukraine and needs a socio-philosophical implementation. he main purpose of the article is to analyze the problem of social space of the city, which is convenient for the life of citizens with different set of opportunities, and the expediency of including disability as a social phenomenon in the broad philosophical context (...) of study. The field of thinking about the city in the study is outlined in the following concepts: the right to the city, the urban space for human development, social communications and the just principles of being. It is important to understand the vector of the development of the socio-cultural field of the city in terms of overcoming the "soulless indifference" (bliss) and for the development of communication between the citizens. The novelty of the work is determined by the rationale for the transformation of traditional disability models in modern conditions of social development. The relevance of the study is associated with the complexity of the phenomenon of disability, insufficient knowledge of the factors and problems of inclusion of people with special needs in society. With the growing number of people with disabilities in society, the problem of developing a culture of disability becomes urgent, the low level of which should be considered a challenge. A culture of disability implies a mutual desire of people with disabilities and society to move towards each other. The practical aspect of the research is related to the need for change of social consciousness, inclusion of persons with disabilities in the social space, development of social competences of people with disabilities and transformation of these people from the object of social assistance into an active subject and participant of the processes taking place in society., implementation of projects based on justice and citizenship. This article presents Epistemic Spatialization as a new framework for investigating the interconnected patterns of biases when identifying objects with convolutional neural networks (convnets). It draws upon Foucault’s notion of spatialized knowledge to guide its method of enquiry. We argue that decisions involved in the creation of algorithms, alongside the labeling, ordering, presentation, and commercial prioritization of objects, together create a distorted “nomination of the visible”: they harden the visibility of some objects, make other objects excessively visible, and consign yet (...) others to permanent or haphazard invisibility. Our approach differs from those who focus on high-stakes misidentifications, such as errors tied to structural racism. Examining the far more dominant series of low-stakes mistakes shows the scope of errors, destabilizing the goal of image content identification with considerable societal impact. We explore these issues by closely examining the demonstration video of a popular convnet. This examination reveals an interlocking series of biases undermining the content identification process. The picture we paint is crucial for a better understanding of the errors that result as these convnets become further embedded in everyday products. The framework is valuable for critical work on computer vision, AI studies, and large-scale visual analysis. (shrink)

New technologies provide new forums for the expression and challenging of racism. This article explores the potential of an interactive blog about asylum-seekers to serve as part of the Habermasian ‘public sphere’, facilitating debate between those with opposing views. We offer evidence that pro- and anti-asylum seeker arguments made in blogs construct a binary between those in favour and those against. Arguments are collectively constructed producing relatively coherent discourses, despite being articulated by different individuals. We then explore the ways in (...) which pro-asylum seeker postings utilize strategies which social scientists have identified as effective in challenging racism. As such, the blog is a site where what has come to be called ‘bystander anti-racism’ is being practised, producing a counter-hegemonic discourse. Our evidence suggests that despite arguments to the contrary, blogs are potentially useful sites for the development of communicative consciousness in relation to race issues, particularly the challenging of racism. I examine the conflict and dialogue perspectives to social change. Distinguishing between conflict and aggression, I argue that although conflict of interest is inevitable, it is also inevitable that we use aggression to cleal with our conflicting interests. The conflicting nature of human interests makes at least verbal conflict to be unavoidable, but I distinguish between verbal conflict and verbal aggression. With the help of Aristotle's components of persuasion, I further distinguish benueen verbal conflict approaches such as rational nonaggressive, rational (...) aggressive, and character- or emotion targeted verbal aggression. With insightsfrom the Akan of Ghana, I argue that effective constraints against aggressive behaviour can be built into social policy and, ultimately, culture. Incidentally, a critical but non-aggressive approach to verbal conflict rhymes with an agonistic mode of dialogue that redeems traditionally congenial dialogue from much of its weaknesses. (shrink)

In 2008, Dutch anti-Islam Member of Parliament Geert Wilders produced a short video called Fitna to visualize his argument that Islam is a dangerous religion. Thousands of men and women across the globe uploaded their own videos to YouTube to criticize or support the film. In this article, we look at these alternative videos from a feminist perspective, contrasting the gender portrayal and narratives in Fitna with those in the alternative videos. We contend that Fitna expressed an extremist Orientalist discourse, (...) in which women are presented as the current and future victims of the oppression of Muslim men and Islam. In contrast, the YouTube videos give voice to women themselves who come from across the globe, are relatively young and often active Muslims. Second, they express different view points in generically new ways, criticizing and ridiculing Wilders or producing serious and committed explanations of their own understanding of Islam. Third, although relatively few women appeared in the videos, those that did speak for themselves, not only take on Wilders, but also claim their right to speak within Islam. We propose to understand these videos as acts of citizenships through which women constitute themselves as global citizens, in some cases by engaging in ‘deliberation’ as it is understood in feminist political theory, in other cases by taking a ‘voice’ that can be responded to. Strong emergentists face a quadruple dilemma: accept the physical closure principle and deny strong emergentism, deny the closure principle and court either substance or property dualism, accept substance dualism and kill emergentism by accepting vitalism or accept property dualism and get locked into the fallacy of reconciling upward emergence with downward causation without the help of any external agency. Strong emergentists would most likely choose, and I seek to show that it contains contradictions that kill emergentism nonetheless. This is because (...) emergentists would ultimately have to admit the role of external agency or environmental input regarding upward/downward interaction. But once this happens, there seems no need to discuss emergence, since we are no longer entirely sure that properties alleged as emergent actually emerged from the base properties from which we would say they emerged. Ontologies play a vital role in organizing and constructing knowledge across various domains, enabling effective knowledge management and sharing. The development of domain-specific ontologies, such as the ONTO-TDM ontology for teaching domain modeling, is essential for providing a comprehensive and standardized representation of knowledge within a given discipline. However, to maximize the usefulness and relevance of such ontologies, it is crucial to automate their population with domain-specific information, reducing manual work and ensuring scalability. This paper presents a novel method for (...) ontology population by extracting and integrating relevant information from diverse sources. The method combines the TextRank algorithm with Word2Vec to enhance keyword extraction, capturing both semantic meaning and textual importance. Keywords are then annotated and used to train a machine learning classifier, which aids in integrating new instances into the ontology. Experiments show that the proposed method achieves a precision of 63.33%, a recall of 61.29% and an F1-score of 62.28%, significantly improving keyword extraction and ontology population accuracy compared to existing methods. This validates the method’s effectiveness in semi-automatically extracting relevant instances from diverse data sources, enhancing the efficiency and accuracy of ontology population, and advancing automated knowledge management in domain-specific contexts. In his proposal for a democracy by consensus, Wiredu argued that deliberation is an activity that depends solely on the logical persuasiveness of ideas. Emmanuel Chukwudi Eze and I had objected to this view of deliberation. Bernard Matolino has responded separately to Eze and me by sticking to Wiredu’s position that deliberation is a purely rational activity. In this article, I support my earlier claim that persuasion (and hence deliberation) is not an entirely logical activity, and our concern as human (...) beings is to recognize the influence of non-rational factors, for the purpose of minimizing the role of these non-rational factors. My general aim here is to explore the implications of a counterfactual situation in which we assume that deliberation is a purely rational activity, and these implications are unpalatable even to proponents of deliberation as a purely rational activity. My conclusion is that it is only by recognizing the role of non-rational factors in deliberation that we are driven to institute mechanisms to ensure that logic dominates over non-rational factors as much as practicable in either persuading or in being persuaded. Assuming that deliberation is a purely rational activity, on the other hand, forestalls any measures and allows non-rational influences to fester undeterred. (shrink)

Wiredu’s call for democracy by consensus is illustrated by his description of traditional African consensual rationality. This description contains the attribution of immanence to African consensual rationality. This paper objects to this doctrine of immanence. More importantly, the doctrine of immanence has led to the attribution of pure rationality to traditional African consensual practices. With reference to Aristotle’s three components of persuasion, I object to deliberation as purely rational and impervious to extraneous factors. I further argue that it is because (...) deliberation is not always perfectly rational that the process of consensus can suffer three forms of social conformity: conformity to dominant players, to numerical opinion majority, and to group-centrism. These forms of conformity mean that a consensus task order could lead to decisions of more inclusive value, but not necessarily decisions of more epistemic value. The concept of agonistic inquiry is employed to tackle what I see as the dangers of conformity and complacency in the project of inclusivity, and this is to strike a crucial balance between too-consensual and purely adversarial forms of deliberation. This article aims to put face to face the positions of Deleuze and Lacan in relation to the theories regarding the idea of the Oedipus complex inherited from Freudian psychoanalysis. This confrontation will become manifest by reviewing the concepts of desire, repression and castration, from the point of view of the subject’s relationship with language. In order to achieve this purpose, we will go through the topological proposals whereby both Deleuze and Lacan render account of that which is housed outside (...) the signifying logic, the paradigmatic axis of which is precisely the Oedipal Logic, thus forging a cutting-edge work in which the materiality of language, its sonority and texture will acquire relevance to rethink the status of the unconscious itself. Kwasi Wiredu proposed a democracy by consensus, inspired by the consensual practices of the traditional Akan of Africa. But his presentation of the traditional consensual practices has been criticized for inaccurateness. Helen Lauer embarks on what she sees as cleaning the debate of the misreading of Wiredu’s presentation of traditional consensual practices by his critics. This is commendable. However, we claim that she does not succeed in the task that she set out to do. We argue that her failure partly (...) has to do with her subscribing to a one-sided assessment of such a history, which influenced the manner she evaluated the debate and some of the fallacies that crept into analysis. Bernard Matolino argues that the communal foundation of classical African communitarianism should be discarded if communitarian theories would be of any use to modern African political theory. He sets out to propose a theory of communitarianism that not only suits modern African realities but would also be useful to any people including non-Africans. I argue that what he ends up doing is proposing cosmopolitanism, calling into question the “Afro” designation of the title of his theory. I also argue that his (...) position on the relationship between the individual and the community is technically not communitarianism of any sort, calling into question the “communitarian” appellation in his theory. His attempt to divorce communitarianism from communalism is unsuccessful, making communitarianism as unsuitable as a theory of world relations as Matolino claims it is unsuitable for contemporary multiethnic African societies. Given the ubiquitous nature of love, numerous theories have been proposed to explain its existence. One such theory refers to love as a commitment device, suggesting that romantic love evolved to foster commitment between partners and enhance their reproductive success. In the present study, we investigated this hypothesis using a large-scale sample of 86,310 individual responses collected across 90 countries. If romantic love is universally perceived as a force that fosters commitment between long-term partners, we expected that individuals likely to (...) suffer greater losses from the termination of their relationships—including people of lower socioeconomic status, those with many children, and women—would place a higher value on romantic love compared to people with higher status, those with fewer children, and men. These predictions were supported. Additionally, we observed that individuals from countries with a higher (vs. lower) Human Development Index placed a greater level of importance on romantic love, suggesting that modernization might influence how romantic love is evaluated. On average, participants worldwide were unwilling to commit to a long-term romantic relationship without love, highlighting romantic love’s universal importance. (shrink)

En particulier, la délibération et les problèmes qui en découlent n’ont pas été classées en plusieurs niveaux afin d’exposer les différents défis qui se posent lorsque (...) l’on tente de parvenir à un accord et les types d’approches délibératives impliquées dans chaque catégorie. I revisit in this article the question of the possibility of political integration of the Afri- can continent, something rst proposed by Kwame Nkrumah and then re-proposed by Muamar Gaddaf . My focus here is not to examine the extent of African leaders’ willing- ness to bring about integration, nor will I concentrate on the political intrigues surround- ing it (though these will be brie y acknowledged). Further, I will not contest Nkrumah’s economic argument (which is commonsensically correct and in (...) line with mainstream eco- nomics) but will, instead, take up the more normative question of the possibility, and thus practicability, of political integration in light of cultural and ethnic heterogeneity on the continent. I argue that political integration is possible, and I support the gradualist view- point by drawing lessons from Nicholas Taleb’s concept of antifragility and pointing out that there is almost as much heterogeneity at individual and simpler society levels as there is in ethnically diverse societies. Reflective function is defined as an individual’s ability to understand human behavior in terms of underlying mental states including thoughts, feelings, desires, beliefs, and intentions. More specifically, the capacity of parents to keep their child’s mental states in mind is referred to as parental RF. RF has been linked to adult mental health and parental RF to children’s mental health and development. The gold standard measure of RF is the interview-based Reflective Functioning Scale applied to the Parent Development Interview or (...) Adult Attachment Interview, which while well validated, is time-and labor-intensive to administer. Given the increasing need for reliable, valid, and rapid RF assessment in wide-ranging settings, two alternative measures were considered including the Reflective Function Questionnaire and Parental Reflective Function Questionnaire. We determined the convergent validity of these measures in comparison with the PDI-rated RFS. A sample of mothers and fathers was drawn from a sub-study of the ongoing Alberta Pregnancy Outcomes and Nutrition longitudinal cohort when their children were 42–60 months of age. Pearson correlations and multiple linear regression was conducted, followed by splitting the sample to compute Cohen’s kappas measures of agreement. Two subscales of the PRFQ correlated significantly with the gold standard PDI-rated RFS, providing evidence for convergent validity. As a brief multidimensional measure of parental RF, the PRFQ offers an alternative for measurement of RF in large-scale studies of parental development and child health. (shrink)

In his plea for consensual democracy in Africa, Kwasi Wiredu recommends unanimity about what is to be done, not what ought to be done, or unanimity on action rather than unanimity of values, beliefs and opinion. I caution the use of this procedural instrument by showing that some issues are so value-laden that a group decision cannot be value-neutral. It may sometimes be more productive to entertain value differences to keep them from going underground and becoming dangerous. However, the ability (...) to locate some common interest or ground seems to be crucial for such value confrontation. (shrink)

The literature on the construction of places of worship has predominantly shown difficulties, rejection and disharmony among religious communities. This study aims to describe and analyzed the success story of the construction of the Santa Monica church in Tangerang. This is a qualitative study conducted over a month-long period using primary and secondary data. Primary data were obtained through observation and interviews, while secondary data were obtained through formal and informal policy reviews available online. The informants involved in this study (...) amounted to eight people consisting of church leaders and administrators, local leaders, religious leaders, religious organizations and the Ministry of Religious Affairs. Data were analyzed using content analysis methods. The results of the study show that the ability of church leaders and administrators to build good social and cultural relations with the community was a key element in their success in obtaining permission to build the church. This was achieved through effective communication, dialogue and cooperation between the Catholic community, leaders and the predominantly Islamic local community. Active involvement in daily activities had a positive impact, fostering mutual trust and peaceful coexistence, ultimately resulting in the local community’s support and approval for the establishment of the place of worship. Thus, the church construction committee was able to meet all administrative requirements as stipulated by government regulations. This study recommends the importance of good social and cultural relations as the fundamental basis and determinant of success for religious communities seeking to construct places of worship. Contribution: This article contributes to the goal of HTS Theological Studies in promoting the transdisciplinary aspect of religious studies in the international theological arena, particularly in the study of religious harmony among communities in Indonesia. Prevailing literature argues that arguing is the only appropriate mode of deliberation. The literature acknowledges bargaining, story telling, and other forms of communication, but is unwilling to describe these as deliberation, properly speaking. The claim is that describing them as such would amount to concept stretching. In this article I argue that arguing exhausts neither the legitimate modes of deliberation nor the modes for effective deliberation. To do this I delineate two basic categories of issues we normally deliberate upon, and (...) demonstrate that arguing is more appropriate for one category, not so appropriate for the other. (shrink)
