This paper addresses the relationship between epistemic difference and hermeneutical injustice, starting from an example discussed by Townsend and Townsend: the case of the Kichwa Indigenous People of Sarayaku v. Ecuador before the Inter-American Court of Human Rights. My thesis is that translation is inevitably at work in communicative exchanges involving epistemic difference, and that considering the problem of translation allows us to refine our understanding of epistemic injustice and mobilise further resources to respond to it. In a first step, (...) I will discuss McGlynn’s critique of Townsend and Townsend’s approach, and in particular the notion of discursive injustice elaborated by Kukla. Drawing on the notion of symbolic institution as theorised by the Belgian phenomenologist Marc Richir, I will show how translation is at work in this case, seeking to pinpoint the hermeneutical injustice at play. In a second step, I will reflect on the different paradigms of translation and argue for a broad, processual and layered conception of it. Building on Antonio Gramsci’s concept of translatability of languages, I will introduce the notion of epistemic translatability as that which allows translational strategies to be devised across epistemic difference in order to counter hermeneutical injustice. Chat Generative Pre-Trained Transformer (ChatGPT) has been a growing point of interest in medical education yet has not been assessed in the field of bioethics. This study evaluated the accuracy of ChatGPT-3.5 (April 2023 version) in answering text-based, multiple choice bioethics questions at the level of US third-year and fourth-year medical students. A total of 114 bioethical questions were identified from the widely utilised question banks UWorld and AMBOSS. Accuracy, bioethical categories, difficulty levels, specialty data, error analysis and character count (...) were analysed. We found that ChatGPT had an accuracy of 59.6%, with greater accuracy in topics surrounding death and patient–physician relationships and performed poorly on questions pertaining to informed consent. Of all the specialties, it performed best in paediatrics. Yet, certain specialties and bioethical categories were under-represented. Among the errors made, it tended towards content errors and application errors. There were no significant associations between character count and accuracy. Nevertheless, this investigation contributes to the ongoing dialogue on artificial intelligence’s (AI) role in healthcare and medical education, advocating for further research to fully understand AI systems’ capabilities and constraints in the nuanced field of medical bioethics. In the tradition of justified true belief theory, I provide an epistemic responsibility-based philosophical analysis of collective knowledge which is both coherentist and reliabilist.

In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. The power, depth, and humanity of the work and life of Josiah Royce gains in richness by following his reflections on the problems of philosophical pedagogy. While engaged as a professor of philosophy, author, advisor, and administrator, Royce developed and refined guidelines for the philosophy of education, and the art of philosophical pedagogy. Except for a few personal recollections from his students and colleagues, an article by Frank M. Oppenheim that appeared thirty-five years ago, and the annotated bibliography to his (...) writings, Royce's works on pedagogy have not been collected, nor have they received critical attention. The scope of this study is to follow Royce's pedagogical reflections from 1883 to 1913, providing contextual support and critical receptions so that the student of the philosophy of Royce may profit from his studies on the embodiment of ideals as the philosophical engagement of the art of education. About 35 years ago Wheeler introduced the motto “law without law” to highlight the possibility that Physics may be understood only following regularity principles and few relevant facts, rather than relying on a treatment in terms of fundamental theories. Such a proposal can be seen as part of a more general attempt summarized by the slogan “it from bit”, which privileges the information as the basic ingredient. Apparently it seems that it is possible to obtain, without the use of physical (...) laws, some important results in an easy way, for instance, the probability distribution of the canonical ensemble. In this paper we will present a general discussion on those ideas of Wheeler’s that originated the motto “law without law”. In particular we will show how the claimed simplicity is only apparent and it is rather easy to produce wrong results. We will show that it is possible to obtain some of the results treated by Wheeler in the realm of the statistical mechanics, using precise assumptions and nontrivial results of probability theory, mainly concerning ergodicity and limit theorems. The work of translation/resequencing are of equal weight in an interpretative commentary that carry one towards the possible world pictured by the Eleatic master. As far as the translation and resequencing, presented here in its entirety, I have held fast to Eco’s recommendation for translations, that “goodwill... prods us to negotiate the best solution for every line. Among the synonyms for "faithfulness," the word "exactitude" does not exist. Instead there (...) is loyalty, devotion, allegiance, piety.” The “Notes to Translator’s Introduction,” and more so, the “Notes to the Fragments,” are a condensed version of a few frames of references, both cultural and theoretical, that stand in, for the present, as signposts. Conhecido como Debate Hart-Dworkin, o entrechoque de opiniões entre esses dois autores gerou intensa discussão acerca do positivismo jurídico e das teorias que buscam refutar suas teses fundamentais. Neste contexto, Ronald Dworkin se empenha em repreender a doutrina positivista demonstrando que as noções elementares dessa teoria não são capazes de produzir uma doutrina eficaz sobre a natureza do direito. No presente artigo, pretendo analisar as críticas lançadas por Dworkin ao positivismo jurídico e às conceituações de Herbert Hart, com específica atenção (...) para o conceito de discricionariedade que Dworkin imputa ao positivismo. A partir de uma discussão teórica envolvendo as principais obras desses autores, procuro confirmar a hipótese de que a teoria positivista moderna não está comprometida com o sentido atribuído por Dworkin à noção de discricionariedade, prejudicando assim o fundamento da crítica de Dworkin acerca da interpretação no positivismo jurídico. Ao final, irei considerar também a gravidade desta vicissitude para a teoria dworkiniana como um todo, avaliando se as críticas de Dworkin restam comprometidas ou resistem a este empecilho. (shrink)

The history of scholarship, philosophical or otherwise, about Plato and his writings reveals a quandary pertaining to the interpretation of the contents of Plato's dialogues. To understand Plato one must come to terms with this problem: how ought Plato's writings to be interpreted?

This paper summarizes some of the major concepts of Raimo Tuomela’s social ontology as it is articulated and defended in his most recent major works and provides a set of objections to it. It also suggests some ways to plausibly revise Tuomela’s analysis of social groups in order to evade our concerns.

Digital contact tracing is used in different countries to help contain the COVID-19 pandemic. It raises challenging empirical and ethical questions due to its complexity and widespread effects calling for a broader approach in ethical evaluation. However, existing approaches often fail to include all relevant value perspectives or lack reference to empirical data on the artifact in question. In this paper, we describe the development of an interdisciplinary framework to analyze digital contact tracing from an empirical and ethical perspective. Starting (...) with an analysis of methodological tensions in the attempt to analyze digital contact tracing, we, firstly, set out three methodological premises regarding (a) a specific view of technology, (b) a fruitful normative perspective, and (c) ways to gather empirical knowledge about the object under investigation. Secondly, we inspect consequences of these premises to develop our research methodology. In doing so, we argue for a postphenomenological perspective on technology, solidarity as an important concept to guide the ethical perspective, and an empirical approach based on qualitative social science research and the concept of affordances. We illustrate these considerations by referring to our analysis of the German Corona-Warn-App as an instance of contact tracing based on the Exposure Notification Framework by Google and Apple. We then discuss the implications of using such a framework, including considerations concerning future developments of technologies similar to or inspired by the current concepts of contact tracing. In a recent paper in this journal Charles B. Saunders et al. argue that corporations have no social responsibility regarding alienation in the workplace in that there is no significant degree of alienation in the workplace, at least in white collar and management level positions in corporate America.Contrary to Saunders et al., this paper defines the concept of alienation. Having done that, it proceeds to show that the argument Saunders et al. make flounders on logical grounds. I conclude that Saunders (...) et al. provide no evidence for the claim that alienation is lacking (in any degree) in corporate America. (shrink)

It has recently been argued that there is probably no theory of punishment to be found in Immanuel Kant’s writings, but that “if one selects carefully among the many remarks and insights that Kant has left us about crime and punishment, one might even be able to build such an edifice from the bricks provided.” In this paper, I seek to provide part of a foundation of a Kantian theory of punishment, one which is consistent with many, if not all, (...) of Kant’s own insights on justice. Finally, I assess the plausibility of Kant’s view. (shrink)

This paper is an elaboration of my previous paper published in Philosophy, ‘Making Sense of retributivism,’ which was a criticism of John Rawls' attempt in ‘Two Concepts of Rules’ to develop a rule utilitarian theory of punishment wherein utilitarianism is best construed as a justificatory basis for the institution of punishment and retributivism is best construed as serving as a justificatory basis for particular forms of punishment. I challenge this claim, arguing that retributivism must and can provide a justification both (...) for the institution of punishment and for particular forms of punishment. In the end, I develop an analysis of the nature of desert as responsibility and proportionality. This notion of desert makes the best sense of retributivism. (shrink)

This paper is offered as a tribute to Joel Feinberg. The first section of the paper applies Feinberg's analysis of freedom of expression to a contemporary case of academic freedom. The second section engages Feinberg's work on rights and punishment. The paper ends with numerous quotations from Feinberg's vast array of writings, words that express his ideas on a number of important problems that occupied his mind throughout his fruitful and influential career.

Review of Lee Braver's 2012 book, Groundless Grounds: A Study of Wittgenstein and Heidegger.

This paper challenges the claim that the traditional Christian (Augustinian, Thomistic, Anselmian) idea of hell as a form of eternal punishment (damnation and torment) for human sin cannot be made consistent with the idea of proportionate punishment, and it raises concerns with the notion that divine justice requires divine forgiveness and mercy. It argues that divine justice entails or at least permits retribution as the meting out of punishment by God to those who deserve it in proportion to the degree (...) and amount of harm unduly and responsibly caused by sinners to others. For God to fail to punish those who deserve it in proportion to their harmful wrongdoings would imply God’s failure to be both just and omnibenevolent. (shrink)
