La Ley Orgánica General Penitenciaria (en lo sucesivo LOGP) en el año 1979 creó la figura del juez de vigilancia penitenciaria, dedicándole 3 artículos (76,77 y 78). Fueron necesarios dos años más, para que un Acuerdo del Consejo General del Poder Judicial de 9 de julio de 1981, pusiera en funcionamiento esa clase de juzgados, los cuales se constituyeron formalmente el 1 de octubre de 1981.

Foucault plantea que no hay una sola racionalidad desde la que sean pensables todas las dimensiones de la actual complejidad, por el contrario, la comprensión del presente abre el espacio al análisis histórico de las instituciones sociales y de sus procesos, por medio de dispositivos teórico-metodológicos desarrollados por el enfoque divergente del autor, que amplía la reflexión de los procesos de construcción, reconstrucción y modificación de las representaciones y las identidades sociales. Uno de los ejes de análisis es el sentido (...) común, por ello surge la pregunta ¿cómo el sentido común ordena la palabra? y ¿qué hay de amenazante en las palabras de las personas? Aunado, el análisis del discurso saca a la luz el juego de su poder de afirmación de dominios de objetos. Otro eje es el poder, instrumento conceptual para entender, pensar y ordenar el mundo social, a los sujetos y a sus prácticas sociales y culturales. Poder, productor de conocimiento y realidad, que determina las vías por las cuales se construyen las verdades aceptadas en una época determinada. Foucault lo propone como un poder productor, creador de un régimen de verdad que desarrolla un pensamiento sistematizador y racional, lo mismo que creador de subjetividades. (shrink)

Psychopedagogy has experienced a great scientific development since 20th century as a result of disciplinary integration of psychology and pedagogy. However, epistemological problems of its professional and research practices have not been taken into account in scientific literature due to its theoretical complexity, insufficient attention by professionals who research in this discipline and perhaps for underrate general theoretical problems of sciences. The objective of this article is to offer different arguments in favour of a scientific status of psychopedagogy as an (...) interdisciplinary science, according to logical and historical assessment and the same way the determination of main epistemological problems that it confronts. La psicopedagogía ha venido manifestando un gran desarrollo desde el siglo XX, como resultado de la integración disciplinar de la psicología y la pedagogía. Sin embargo, los problemas epistemológicos asociados a su práctica investigativa y profesional no han sido abordados en la literatura científica, debido a su complejidad teórica, a una atención insuficiente por parte de los profesionales que investigan en esta disciplina y quizás a un menosprecio por los problemas teóricos generales de las ciencias. El objetivo de este artículo es ofrecer varios argumentos a favor del estatus científico de la psicopedagogía como ciencia interdisciplinar, a partir de una valoración histórica y lógica de su evolución, así como la precisión de los problemas epistemológicos fundamentales que afronta. Una de las obras fundamentales para entender el pensamiento de Max Scheler lleva por título la expresión angustiniana "ordo amoris". ¿Se trata de una mera coincidencia o se puede estrechar la relación entre ambos pensadores? El artículo muestra que un análisis exhaustivo de la cuestión nos lleva a concluir que existe una profunda influencia del santo de Hipona en Scheler, revelada explícitamente en las citas agustinianas de Scheler, e implícitamente en nociones centrales del pensamiento scheleriano, como la "Gesinnung" o "disposición (...) del ánimo". Entrepreneurship has undoubted social value as it contributes to socio-economic development of the context where entrepreneurship takes place. When the entrepreneurial activity is undertaken among especially vulnerable groups in the labor market, the multiplying effect of this value is made explicit in society, in general, and in the collective of people with disabilities, in particular. The objective of this research study is to explore under which conditions this happens through the analysis not only of the relationship between the competencies that (...) PWDs attribute to themselves and their development of the entrepreneurial activity but also of that between entrepreneurship and certain conditions that potentially create value by increasing the autonomy among this collective. A quantitative methodology based on the analysis of the survey carried out on a sample of 224 entrepreneurs with physical, sensory, or organic disabilities throughout Spain has been used. According to the results, entrepreneurs with disabilities have a higher self-evaluation competency. Furthermore, significant results concerning the link between the form of autonomous cohabitation of this collective and entrepreneurship have been obtained. (shrink)

Pavel Florenski es un exquisito escritor ruso, filósofo, científico y teólogo, nacido en Rusia en 1882 y fusilado por el régimen soviético en 1937, influenciado por L.Tolstoi y colega de M. Bulgakov. Sacerdote ortodoxo casado, es autor de una obra tardíamente conocida, en la que destaca La columna y el fundamento de la fe, y que yo he podido conocer gracias a un amigo italiano, Nunzio, al tiempo que me regala la obra El pensamiento polifónico de P. Florenski2. Me quedo (...) sorprendido por el interés de este pensador efectivamente polifónico, cuya clave musical está en la noción radical de la relación, lo que me recuerda a nuestro Angel Amor Ruibal, pues la relación separa y repara todas las cosas y sus antinomias, si bien en el ruso la relación se constituye específicamente a través del simbolismo, y de un simbolismo de signo platónico-cristiano. En efecto, el platonismo de Florenski es un platonismo encarnado, así pues un idealismo encarnatorio, según el cual hay que conectar la inmanencia fenoménica con la trascendencia nouménica, y viceversa, de acuerdo con la divisa propia de todo humanismo cristiano: salvaguardar lo divino es salvaguardar lo humano. Recently, some philosophers have defended the idea that knowledge is an interest-relative notion. According to this thesis, whether an agent knows P may depend on the practical costs of her being wrong about P. This perspective marks a radical departure from traditional accounts that take knowledge to be a purely intellectual concept. I think there is much to say on behalf of the interest-relative notion. In this paper, I report on some new evidence which strongly suggests that ordinary people’s attributions (...) of knowledge are in fact sensitive to practical interests. This is noteworthy because recent experiments have been interpreted by many to support the opposite conclusion. I also argue that the new results support an invariantist but interest-relativist account of knowledge, a thesis known as Interest Relative Invariantism (IRI). I do not make the case here that IRI gives us the very best explanation of the results presented here. Any such attempt would require an in-depth survey of the last few decades of work in epistemology. I only want to argue here that IRI gives us a simple and elegant explanation of the new data, and that the same cannot be said about traditional contextualism, a leading competitor to IRI. (shrink)

I argue that truth is relative (in the sense recently defended by some prominent analytical philosophers) by focusing on some semantic issues raised by Einstein's theory of relativity together with our ordinary attributions of truth.

This study investigates the differences in ethical beliefs between males and females. One hundred and seventy five business students were presented with four scenarios and given the Reidenbach-Robin instrument measuring their ethical reactions to these scenarios. Contrary to previous research, the results indicate that the two groups have similar ethical beliefs, and they process ethical information similarly.

Individuals and businesses make numerous payments every day. They sometimes have choices about what forms of payment to make or accept, and at other times are effectively forced to use a particular form. Often there is an asymmetric power relationship between payer and payee that raises the issue of whether one side unfairly exploits the other. Is it unethical exploitation for an employer to pay employees with a fee-laden payroll card over other more convenient forms of payment? Does the fee (...) structure of payment networks such as Visa and MasterCard unfairly exploit merchants? The bitcoin payment system is an ethical as well as technological evolution as it was designed to be an electronic payment system that does not rely upon trust. Can an entire payment system like bitcoin be “evil,” as charged by Krugman? Payment tools as such are ethically neutral, but can be used in an ethical or unethical manner. (shrink)

Ampliamente conocidos son los señalamientos realizados en Ser y tiempo por Martin Heidegger en torno al contraste entre la corporalidad pensada modernamente con base en una mezcla de cuerpo-alma, de raigambre cartesiana, y la corporalidad existenciaria a partir del Ser-en-el-mundo del Dasein. Después de ello y con pocas alusiones en algunas de sus lecciones, la tematización mayor en torno al cuerpo se remonta a los Seminarios de Zollikon. El presente artículo busca nuevas vías de tematización a partir de lo que (...) Heidegger piensa como ambigüedad de la verdad en las diversas versiones de la conferencia “De la esencia de la verdad. La verdad del cuerpo dejaría ver al cuerpo en su errar como Körper y, por otro lado, en tanto misterio como Leib. Tal perspectiva permite una comprensión no unilateral del cuerpo y a la vez abre las posibilidades para pensarlo desde el Ser-en-el-mundo, tal como Heidegger había anunciado en diversos momentos de su obra. The writings and speeches of the Mexican president Andrés Manuel López Obrador (2018-2024) have been characterized by a constant reference to a teleological history. Using Karl Löwith’s proposals, I analyse the president’s liberal-progressive idea of history and I propose that in this respect he has followed a certain speculative philosophy of history, which I call philosophy of Trans-Historic-History.

Extension of the system that includes the key substrates for sensation, perception, emotion, volition, and cognition, and all representational sources for cognition, supports the view that there is an extended mind and an extended body. These intellectual views can be made practical in a humanist system based on extensions and in religious systems based on extensions. Independently, there is also an institutional extension of secularism. Hence, I maintain, there are five principal forms of extension.

I selectively summarize some of the main ideas in my book Why We Doubt, focusing on the elements that are discussed in the replies from commentators. In the book, I investigated our skeptical intuitions which form the basis of the skeptic’s arguments. I argue that these intuitive judgments or inclinations to judge are produced by the deployment of a subconscious heuristic, pbs, which serves us well most of the time but misfires in esoteric cases like those associated with global skepticism. (...) I do this by identifying the rational function of pbs and arguing that when we apply this rational function to global skepticism, it doesn’t yield a skeptical result. (shrink)

I respond to comments from Branden Fitelson, Chad Gonnerman and John Waterman, and Mark Walker. My response to Fitelson concerns how we should understand the notion of “sensitivity” which is central to my account of why we find skeptical premises intuitive. I argue against his recommendation except for a specific type of “loose” skeptical hypothesis. Gonnerman and Waterman push me to say more about the conditions under which we feel or not feel the skeptical pull. I clarify and expand on (...) the theory presented in the book. Finally, Walker presents a new type of skeptical challenge. To deal with this challenge, I distinguish between two types of skeptical hypotheses, a mild and more substantial one. Walker’s skeptical argument concerns mild skepticism. My account is aimed at more substantial accounts. However, I speculate about how we may respond to this challenge. (shrink)

Several countries have implemented COVID passports or health certificates to promote a safer return to in-person social activities. These certificates have been proposed as a way for people to prove that they have been vaccinated, that they have recovered from the disease, or that they have negative results on a diagnostic test. However, many people have questioned its ethical justification. This article presents some practical and ethical problems to consider if we want to implement these passports. Among the former, it (...) is discussed how accurate diagnostic tests are to ensure that a person is not contagious; whether vaccination guarantees immunity; what are the levels of immunity after infection, vaccination and protection against variants; the fact that passports can be forged; if they encourage vaccination and the problem that there is no universally recognized passport. Among the ethical issues it is discussed whether passports promote discrimination and inequality, and whether they violate the rights to privacy and freedom. It is concluded that passports have enough ethical justification to be implemented. (shrink)

La intervención de la ciudad con fines artístico-creativos en manos de colectivos o anónimos transeúntes, es una práctica cada vez más habitual en el espacio urbano. Esta pluralidad de manifestaciones, tanto icónicas como verbales, suscita ciertas controversias a la hora de nominarlas, sobre todo por tratarse de “obras” proscritas en su mayoría, por lo que su estatus artístico o literario es, a veces, discutible. A partir de la delimitación de la estructura de necesidades de algunas expresiones artísticas, en este trabajo (...) proponemos una taxonomía, basada en la lógica analógica de Jean-Marie Schaeffer, de las manifestaciones murales de tipo lúdico-textual inscritas en la ciudad. Para ello, tomamos como referentes a tres representantes vigentes de lo que llamaremos aquí, pintadas poéticas. Con este trabajo trabajo buscamos contribuir a esclarecer la ambigüedad conceptual que existe en torno a la noción de pintadas poéticas, y a revitalizar la discusión sobre el espacio urbano, el espacio virtual, la subversión y la institución artística. In ‘Ineffability’ Alston suggests that philosophical mystics take care to delimit the class of predicates which cannot be ascribed to God. It is suggested that some qualification of ‘ineffability’ is necessary lest the mystic be trapped into such simple contradictions as that of ascribing predicates like ‘ineffability’ to God, while denying that any predicates can be ascribed to God. By the end of Alston's dialogue Mysticus, the would-be defender of mysticism, is browbeaten into meekly asking, ‘Yes, I see that [qualifying (...) statements of God's ineffability] would be better. But how does it happen that so many philosphers make ineffability statements without qualification?’. (shrink)

It is nearly impossible to make an adequate historical balance of the various contemporary interpretations of the metaphysics of Thomas Aquinas. The article pays special attention to the numerous studies recently published concerning the Thomistic doctrines of being, personal being, participation, and the metaphysical concept of creation.

Nuestro propósito se cifra en esta ocasión, en mostrar los motivos filosóficos que condujeron al Martin Heidegger a introducir la metafísica suareciana en la configuración de su ontología existenciaria. Tomaremos como hilo conductor la historia del ser y más en concreto, la de su olvido en favor del ente y que Heidegger desarrolló en diferentes escritos como un momento negativo, fundamental y previo a la exposición de su concepción de la Metafísica. En este relato dejaremos anotado, la función capital que (...) para el proyecto heideggeriano de reinterpetación de la Metafísica desempeñó, la idea de la metafísica griega y en particular de la aristotélica alcanzada por el pensador alemán. Abordaremos este problema con cierta extensión pues sostenemos que el concepto de la metafísica suareciana manejado por Heidegger está determinado por su comprensión de la Metafísica de Aristóteles. Y que se resume en su conocida interpretación onto-teológica. En último término, el peso de la reflexión heideggeriana sobre la metafísica de Suárez, recae sobre el concepto de existencia y su modo de aprehensión que es comprendido como un antecedente moderno e imperfecto del Dasein como vía de acceso al Ser. The lectures we examine in this essay, and which took place in 1978, are at the genesis of the trilogy Sentient Intelligence by X. Zubiri. In the first place, they demonstrate that Zubiri`s Philosophical project does not fit in with today´s fashionable concept of new realism, or with idealism. In the second place, they make it clear that what he considers Actuality cannot be understood as the passivity of intelligence. And lastly, maybe more than in any of his other writings, (...) these lectures concisely clarify how reality is meant to be understood in his work, as what he refers to as total concept. The systematic process in the application of the technical fundamentals of mini-athletics, allowed obtaining the results that show the highest percentage of the study sample in relation to the basic motor skill levels were at a normal level and in the same way in the execution. of the ability of the basic movements of mini-athletics as a base and training sport to use it in sports initiation, reaching the conclusion of being able to determine that there is a positive correlation between the study variables, accepting the research hypothesis that affirms that motor skills Basic skills affect the learning of the ability to execute movements in mini-athletics in zone 1 of Ecuador. El transhumanismo o el movimiento a favor del mejoramiento humano a través de la tecnología vive, actualmente, un momento álgido. Los avances en Inteligencia Artificial e ingeniería genética permiten que soñemos con seres capaces de vencer a la muerte y poseer capacidades hasta ahora desconocidas. Sin embargo, en este artículo veremos que no todo el mundo está de acuerdo con estas ideas y hay quienes consideran las promesas del transhumanismo más como pesadillas que como sueños. Estos son los conservadores. Los (...) conservadores consideran que las mejoras prometidas por el transhumanismo conllevarán el fin de la especie humana. Frente al transhumanismo, los conservadores defienden la conservación y protección de la esencia y la naturaleza humana. También se rebelan contra la manipulación ilimitada del ser humano y la limitación de estas prácticas a aquellas contenidas en la esencia humana. Todo ello les otorga cierta reminiscencia aristotélica en la que muchos de ellos se amparan y la cual vale la pena estudiar. (shrink)

The aim of this work is to analyse the concept of semi-sentence from a linguistic, formal and computational point of view. A semi-sentence can be characterised as a sentence which, from a grammatical perspective, is neither absolutely correct nor incorrect . This study focuses on: - a characterisation of the semi-sentences in the setting of the grammar of a language. This study will help to analyse in depth the concept of grammaticality [3]; - the correlate of semi-sentences in formal languages, (...) i.e., semi-strings, which arise from applying productions that deviate from that which is strictly permitted by the rules of grammar [6]; - a Prolog program for handling semi-grammaticality in a computational manner [2]. The objective of the research was to explain the environmental impact in a district of Lima as a consequence of the cement production carried out by the factory in a traditional way. The study was conducted under the interpretative paradigm, with a qualitative approach, descriptive level, basic type and phenomenological design. The informants were a diverse group to obtain responses: eight people, including municipal employees and specialists, managers and residents. A semi-structured interview guide was used as an instrument and the (...) in-depth interview technique was applied. The criteria of scientific rigor were met transferability, credibility, dependability and auditability. The textual responses were processed with Atlas.ti, coding and interpretation were carried out using the inductive method. The results report that the factory produces cement in a traditional rustic way and emits highly harmful clinker, gases and cement dust that is spread in the air, water and soil of the district. It has been concluded that the toxic substances have a significant negative impact on the environment, polluting the air, soil and water. As a consequence of pollution, people's health has been affected, developing diseases such as skin and lung disorders. (shrink)
