Postmodern Education as a Factor of Innovative Distance Learning in Quarantine.Kateryna Kyrylenko, Zhanna Davydova, Larysa Derkach, Ruslana Zinchuk, Iryna Synelnykova & Andrii Husak - 2022 - Postmodern Openings 13 (1):481-497.
The article talks about the postmodern education system, its focus on the modernization of distance learning in connection with quarantine, which requires new integration approaches to the organization and content of the educational process in higher education institutions. Innovative pedagogical technologies of distance learning are analyzed, in particular, the essence of inverted learning technology is described. A systematic approach to the integration processes in postmodern education as a result of the search for new innovations and the organization of distance learning (...)

  2. Qualitative Naturalism as Dewey’s Ultimate Solution to the Mind-Body Problem.Andrii Leonov - forthcoming - The Pluralist.
In this paper, I argue that Dewey’s ultimate solution to the mind-body problem is grounded not in his emergentist metaphysics per se but rather in his metametaphysical qualitative naturalism. The latter precedes Dewey’s emergent theory of mind, as postulated in his Experience and Nature. Thus, Dewey’s emergentism is rather a consequence of his qualitative naturalism. As such, Dewey’s ultimate metametaphysical solution to the mind-body problem precedes his emergentist metaphysics, and not vice versa. The essence of Dewey’s qualitative naturalism can be (...)

    The Sequential Principle of Relative Culpability: Douglas N. Husak.Douglas N. Husak - 1995 - Legal Theory 1 (4):493-518.
A rational defense of the criminal law must provide a comprehensive theory of culpability. A comprehensive theory of culpability must resolve several difficult issues; in this article I will focus on only one. The general problem arises from the lack of a systematic account of relative culpability. An account of relative culpability would identify and defend a set of considerations to assess whether, why, under what circumstances, and to what extent persons who perform a criminal act with a given culpable (...)

Ignorance of Law: A Philosophical Inquiry.Douglas N. Husak - 2016 - Oxford University Press USA.
This book argues that ignorance of law should usually be a complete excuse from criminal liability. It defends this conclusion by invoking two presumptions: first, the content of criminal law should conform to morality; second, mistakes of fact and mistakes of law should be treated symmetrically.

Overcriminalization: The Limits of the Criminal Law.Douglas N. Husak - 2007 - Oup Usa.
Husak's primary goal is to defend a set of constraints to limit the authority of states to enact and enforce criminal offenses. In addition, Husak situates this endeavor in criminal theory as traditionally construed. This book urges the importance of this topic in the real world, while most Anglo-American legal philosophers have neglected it.

  6. The Criminal Law as Last Resort.Douglas Husak - 2004 - Oxford Journal of Legal Studies 24 (2):207-235.
In this article I examine one condition a minimalist theory of criminalization might contain: the criminal law should be used only as a last resort. I discuss how this principle should be interpreted and the reasons we have to accept it. I conclude that a theory of criminalization should probably include the (appropriately construed) last resort principle. But this conclusion will prove disappointing to those who hope to employ this principle to bring about fundamental reform in the substantive criminal law. (...)

Criminal Law at the Margins.Douglas Husak - 2020 - Criminal Law and Philosophy 14 (3):381-393.
I describe how our understanding of some of the central principles long held dear by most criminal theorists may have to be interpreted in light of the need to devise lenient responses for low-level offenders. Several of the most plausible suggestions for how to deal with minor infractions force us to take seriously some ideas that many legal philosophers have tended to resist elsewhere. I briefly touch upon four topics: whether informal can substitute for or count against the appropriate state (...)

The article examines Kant’s philosophical legacy with an emphasis on the political and legal plane of the innovative and currently extremely relevant research of the German thinker. In particular, both systematic and historical ways of posing the question of the possibilities of achieving and establishing long-term peace are highlighted. The article explores the fundamental concept of Immanuel Kant’s categorical imperative in the context of its impact on political theory, moral self-determination, and the problem of the relationship between good and evil. Particular attention is paid to the question «What ought I to do?» from «The Critique of Practical Reason», which Kant examines through the lens of freedom, morality and will. Research into the history of understanding Heidegger's ideas allows to reveal how different thinkers were likely to grasp the specific subjective positions that defined the meaning of philosophizing as a cultural practice posited by modern era of intellectual history. The figure of Heidegger is crucial because it shed light on the more general context of the evolution of philosophizing within the system of scientific knowledge. A clear contrast between scientific rationalism and philosophical thinking, inherent for Heidegger's philosophy, is now hardly (...)

The article presents the postanarchist conceptualization of radical politics. The methodology of this study was a critical analysis and use of historical and philosophical methods, the method of contextualism, the method of discursive analysis. In connection with the intensification of protest movements, including those aimed at combating the omnipotence of the state, the spread of the ideology of anti-globalization is growing theoretical interest in anarchism. Anarchism today is not the only political doctrine. This is a large family of like-minded people, (...)

In the United States today, the use or possession of many drugs is a criminal offense. Can these criminal laws be justified? What are the best reasons to punish or not to punish drug users? These are the fundamental issues debated in this book by two prominent philosophers of law. Douglas Husak argues in favor of drug decriminalization, by clarifying the meaning of crucial terms, such as legalize, decriminalize, and drugs; and by identifying the standards by which alternative drug (...)

This important book was the first serious work of philosophy to address the question: Do adults have a moral right to use drugs for recreational purposes? Many critics of the 'war on drugs' denounce law enforcement as counterproductive and ineffective. Douglas Husak argues that the 'war on drugs' violates the moral rights of adults who want to use drugs for pleasure, and that criminal laws against such use are incompatible with moral rights. This is not a polemical tract but (...)

    Drug Proscriptions as Proxy Crimes.Douglas Husak - 2017 - Law and Philosophy 36 (4):345-366.
Our drug policy has been widely deemed a failure because the criminalization of drug use has not succeeded in reducing prevalence rates. I contend that the most promising basis to defend the justifiability of drug offenses is to construe them as proxy crimes: offenses designed to prevent the commission of other, more serious crimes. I make a case that many law enforcement officials use drug proscriptions for this purpose in the real world. When construed as proxy crimes, drug prohibitions are (...)

    Retributivism and Over-Punishment.Douglas Husak - 2022 - Law and Philosophy 41 (2):169-191.
Lately it has become a commonplace to complain about the injustice of mass incarceration. I share the sentiment that this phenomenon has been an injustice. But it also has become orthodoxy to allege that the acceptance of a retributive penal philosophy has been one of the chief factors that has brought about mass incarceration in the first place. As a self-proclaimed retributivist, I find these allegations to be troubling and unwarranted. The point of this paper is to take steps to (...)

Is Fair Opportunity a Comprehensive Theory of Responsibility?Douglas Husak - forthcoming - Criminal Law and Philosophy:1-10.
I challenge the adequacy of David Brink’s “master principle” of culpability. I allege that it fails to account for the moral relevance of ignorance of wrongdoing. I describe three cases in which I believe that Brink’s theory of normative competence cannot account for the significance of a variable that bears on culpability. In most of this paper I attempt to anticipate and reply to the various responses Brink might offer to my challenge.

Secondly, the notion of complexity in theology is used as evidence to support teleology. This approach is criticized by some (...)

According to the modern widespread approaches to the nature of external debt and its effects on economic processes, debt financing is among the distinctive features of the liberalization-oriented world of nowadays. Accordingly, unrestricted capital flows signify orientation at macroeconomic balance, since under the conditions when administrative barriers are absent capital distribution is even and symmetric, enabling leveling of factor prices. Associated with these arguments is a claim that prices of goods and services do not indicate non-negligible fluctuations and a financial (...)

Under what circumstances should ignorance that someone is violating a moral or criminal rule preclude or lessen his moral responsibility and/or penal liability? In this chapter, I first construct a schema or framework for how to think about this issue. Quite a bit of confusion and uncertainty, I am sure, derives from a failure to understand exactly what this question is asking.
