Clinical trials are a central mechanism in the production of medical knowledge. They are the gold standard by which such knowledge is evaluated. They are widespread both in the United States and internationally; a National Institute of Health database reports over 106,000 active industry and government-sponsored trials (National Institutes of Health n.d.). They are an engine of the economy. The work of trials is complex; multiple people with diverse interests working across multiple settings simultaneously participate in them, and they are (...) underwritten by multiple organizational structures and diverse funding mechanisms. In this article, we will consider how the regulation of populations is not just a feature of prisons, but of all institutions and organisations that control members though hierarchies, divisions and norms. While nurses and other allied health professionals are considered to be predominantly self‐regulatory, practice is guided by a code of conduct and codes of ethics that act as rules that serve to uphold the safety of the patient, whether they are a sick person in a hospital bed or (...) an inmate in a prison. The codes of conduct espouse a number of rules that to a certain extent govern the behaviour of individual and groups of practitioners through reciprocal rewards and punishments. Supervision is one method of monitoring the effectiveness of the codes of conduct and ethics while regulating both the minimum standard of individual practice and of training organisations. It is posited that one of the possible effects of clinical supervision is to make the person effectively self‐regulatory as, an autonomous practitioner. We take the view that professional autonomy is a highly problematic concept requiring closer examination. (shrink)

Research on language processing has shown that the disruption of conceptual integration gives rise to specific patterns of event-related brain potentials —N400 and P600 effects. Here, we report similar ERP effects when adults performed cross-domain conceptual integration of analogous semantic and mathematical relations. In a problem-solving task, when participants generated labeled answers to semantically aligned and misaligned arithmetic problems, the second object label in misaligned problems yielded an N400 effect for addition problems. In a verification task, when participants judged arithmetically (...) correct but semantically misaligned problem sentences to be “unacceptable,” the second object label in misaligned sentences elicited a P600 effect. Thus, depending on task constraints, misaligned problems can show either of two ERP signatures of conceptual disruption. These results show that well-educated adults can integrate mathematical and semantic relations on the rapid timescale of within-domain ERP effects by a process akin to analogical mapping. (shrink)

Byun et al. describe how deaf signers deal with communication problems in first encounters with signers of different languages. They show that the basic Conversation Analytic repair mechanisms for dealing with verbal troubles are largely reproduced in gesture and sign, including details of turn‐taking structure, timing and form. This underlines the role of repair as a basic resource for linguistic and interactional creativity across modalities.

This article discusses the possibilities and pitfalls of constructing a code of ethics for university professors. Professional, educational, legal, and policy questions regarding the goals, format, and content of an academic ethics code are raised and a series of aspirational principles and enforceable standards that might be included in such a document are presented for discussion and debate.

This chapter offers an analysis of the speech conditions constitutive for the staging of political disagreement. Rather than seeking to offer an explanation for various situations of protest, however, it aims to identify what, if anything, is unique or peculiar to such modes of address. Drawing on the resources of speech act theory, the chapter suggests a reading of ‘dissensual speech’ as a form of ‘unauthorised’ speech through which the ‘people’ appear, however, evanescently. It analyses the peculiarities of dissensual speech (...) in the following ways: first, in terms of specifying its modes of utterance, which are identified with phatic and agonic modes of address and, second, in terms of its performative attitudes. In analysing the latter, I turn to Foucault’s notion of parrēsiastic speech in order to confront a paradox that arises with my reading of dissensual speech viewed in terms of ‘performatives’, since parrēsia—‘speaking truth to power’—is radically opposed to two fundamental rules that govern performatives and illocutionary forces: that they are conventional and that their enunciator must be authorised to use them. The chapter proposes a resolution to this contradiction by showing that an affinity exists between parrēsiastic speech and dissensual speech insofar as both entail ‘risk’ to the speaker in uttering a truth. The question then is whether it is possible to collectivise that risk, or whether parrēsia necessarily remains the speech of the individual martyr. (shrink)

Recently, there have been a number of government proposals and reforms seeking to ensure that standard setting in risk regulation is carried out in a more accountable and transparent manner. These proposals were a direct and indirect response to distrust in government both in relation to risk regulation and across government more widely. The problem, however, is that few of these proposals and reforms have been grounded in an understanding of the nature of standard setting in risk regulation. Such standard (...) setting has three significant features. It is directly concerned with normative issues about risk acceptability, is carried out in circumstances of scientific uncertainty, and requires some form of expert judgment. Rather, these proposals were based on a presumption that standard setting is primarily an analytical process which is verifiable and objective. There are a number of likely consequences of the disjunction between the nature of standard setting and these developments which include problems of ossification, the submersion of normative debate, and a fundamental shift in the nature of public administration. These problems provide an excellent example of the dangers of implementing accountability mechanisms without regard to the complexities of the decision-making context. (shrink)

The author reviews the literature in professional education that cites Ernest Becker’s work from the 1960s-70s. Some of Becker’s main ideas from his own writing on education are also reviewed. The purpose here is to establish a sketch, not a full-study, of the importance of Becker’s educational legacy and begin some critique of the biases of professional educators in regard to utilizing Becker’s work. This critical reflectivity is an appropriate model of Becker’s own integrative approach to knowledge and learning. The (...) aim is to ensure that future applications may be cautious to certain reductive tendencies and offer more diverse perspectives that are truer to Becker’s oeuvre and core ideas about human behavior and societies in general, and education specifically. The author concludes that the future of Education, formal and informal, would do well to take a long serious look at Becker’s work, especially as the world’s children, youths and adults are is becoming more and more vulnerable to frightening conditions, with cascading collapse of systems, including extinctions of all kinds already well underway in an era of global threats nearing extremes. Becker’s oeuvre is both realistic and idealistic, offering Education a way to radically improve to help make for a better world. (shrink)

The Networks of Centres of Excellence programme is perhaps Canada's most dramatic science policy innovation since theFirst World War. This article traces its development, using documentary analysis and interviews with the policy actors responsible for conceiving and implementing the programme.Established in 1989, the networks were explicitly designed to change the norms of science. The intention was to instil an approach to long-term fundamental research that considered possibilities of use from the start. Despite the ubiquity of uncertainty, scientific attention has focused primarily on probabilistic approaches, which predominantly rely on the assumption that uncertainty can be measured and expressed numerically. At the same time, the increasing amount of research from a range of areas including psychology, economics, and sociology testify that in the real world, people’s understanding of risky and uncertain situations cannot be satisfactorily explained in probabilistic and decision-theoretical terms. In this article, we offer a theoretical overview of an alternative approach to (...) uncertainty developed in the framework of the ecological rationality research program. We first trace the origins of the ecological approach to uncertainty in Simon’s bounded rationality and Brunswik’s lens model framework and then proceed by outlining a theoretical view of uncertainty that ensues from the ecological rationality approach. We argue that the ecological concept of uncertainty relies on a systemic view of uncertainty that features it as a property of the organism–environment system. We also show how simple heuristics can deal with unmeasurable uncertainty and in what cases ignoring probabilities emerges as a proper response to uncertainty. (shrink)

The evidence on gender discrimination in lending remains controversial. To capture gender biases in banks’ loan allocations, we observe the impact on the applicants of a microfinance institution and exploit the natural experiment of a regulatory change imposing a strict EUR 10,000 loan ceiling on microcredit. Descriptive statistics indicate that the presence of the ceiling is associated both with bank-MFI co-financing and with harsher treatment of female borrowers. To investigate causal links, we develop an econometric approach that addresses the concerns (...) of selection biases, multicollinearity, and endogeneity. Our empirical findings suggest that the change in the MFI’s gender-related attitude was triggered by banks through co-financing. Hence, we speculate that co-financing pushes ceiling-constrained MFIs to import whatever biases in loan granting that the banks are prone to. Overall, this paper stresses that apparently benign regulations such as loan ceilings can significantly harm the women’s empowerment efforts made by MFIs. (shrink)

Nudging is considered a promising approach for behavioural change. At the same time, nudging has raised ethical concerns, specifically in relation to the impact of nudges on autonomous choice. A complexity is that in this debate authors may appeal to different understandings or dimensions of autonomy. Clarifying the different conceptualisations of autonomy in ethical debates around nudging would help to advance our understanding of the ethics of nudging. A literature review of these considerations was conducted in order to identify and (...) differentiate between the conceptualisations of autonomy. In 33 articles on the ethics of nudging, we identified 280 autonomy considerations, which we labelled with 790 unique autonomy codes and grouped under 61 unique super-codes. Finally, we formulated three general conceptualisations of autonomy. Freedom of choice refers to the availability of options and the environment in which individuals have to make choices. Agency involves an individual's capacity to deliberate and determine what to choose. Self-constitution relates to someone's identity and self-chosen goals. In the debate about the ethics of nudging, authors refer to different senses of autonomy. Clarifying these conceptualisations contributes to a better understanding of how nudges can undermine or, on the other hand, strengthen autonomy. (shrink)

It has been widely accepted that Kant holds the “Opacity Thesis,” the claim that we cannot know the ultimate grounds of our actions. Understood in this way, I shall argue, the Opacity Thesis is at odds with Kant's account of practical self-consciousness, according to which I act from the (always potentially conscious) representation of principles of action and that, in particular, in acting from duty I act in consciousness of the moral law's determination of my will. The Opacity Thesis thus (...) threatens to render acting from duty unintelligible. To diffuse the threat, I argue, first, that we need not attribute the Opacity Thesis to Kant. Kant's concern with the ubiquity of moral self-opacity does not imply the strong skeptical conclusion that knowledge of the grounds of one's action is impossible. Second, I show how moral self-opacity in cases of morally bad action emerges from the intrinsic inability of representing oneself, insofar as one is pursuing the indeterminate end of “happiness.” Thus, moral self-opacity does not undermine the will's self-consciousness but is born of it.
