O presente artigo busca oferecer elementos suficientes para localizar a filósofa e poetisa Christine de Pizan no contexto intelectual do humanismo francês no início do XV. Esse objetivo responde a uma dificuldade que acompanha o estudo da atividade filosófica do período medieval em meio laico. Enquanto mulher, Pizan é necessariamente laica, e sua produção literária se deu fora dos limites normalmente delineados como objeto de estudo dos historiadores da filosofia medieval, qual seja, a produção tipicamente escolástica.

The present article deals with the not very common opinion among medieval philosophers according to which the identity principle is the true first principle, undermining the primacy of the principle of non-contradiction. Following a refutation of this position in the logical work of the Franciscan Geraldus Odonis, we intend to investigate its target as well as other cases of the same dispute in 14th century authors: Antoine Andre, John of Buridan, John of Baconthorpe and Nicolas of Autrecourt. O artigo aborda o tratado lógico de Geraldo Odon "De duobos communissimis principiis scientiarum" focando na noção de ens tertio adiacens: o ente significado pela totalidade da proposição e seu verificador. Odon o identifica ao sujeito dos princípios de não-contradição e terceiro excluído. O ens tertio adiacens também corresponde ao primeiro objeto adequado do intelecto e ao sujeito da lógica, a qual é entendida como a primeira ciência. Na segunda parte do artigo, localizamos Odon no debate historiográfico do realismo proposicional, (...) ao lado de Walter Burley. This paper deals with Geraldus Odonis' logical treatise "De duobus communissimis principiis scientiarum" by focusing on the concept of 'ens tertio adiacens': the being signified by the totality of the proposition and its truthmaker; Odonis identifies it to the subject of the principles of noncontradiction and excluded middle. The ens tertio adiacens also corresponds to the first adequate object of the intellect and to the subject of logic, which is understood as the first science. In the second part of the paper, we place Odonis in the historiographical debate of propositional realism, alongside Walter Burley. (shrink)

The article aims to introduce the Franciscan theologian Geraldus Odonis into the medieval historiographical debate about the different solutions offered to the famous liar paradox. In the first part the author presents briefly and in a schematic way the main kinds of solution to the sophism to then analyze Odon’s text, answering the question of its originality.

Este livro apresenta-se como o resultado da contribuição de professores e pesquisadores de diversos campos da filosofia e de diferentes universidades brasileiras durante a ocasião do I Encontro "Vozes femininas na Filosofia", ocorrido em junho de 2017, na UFRGS, em Porto Alegre, RS. Nossa motivação parte da constatação que a área de filosofia nas universidades brasileiras sofre uma evidente crise de representatividade: tanto nos cursos de graduação como nos programas de pós-graduação em filosofia, nos quais menos de 30% são mulheres, (...) entre docentes e discentes. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 62.2 (2001) 335-358 [Access article in PDF] Between East and West: Hegel and the Origins of the Russian Dilemma Ana Siljak Nikolai Berdiaev, the eminent twentieth-century Russian philosopher, wrote that the "problem of East and West" was an "eternal" one for Russia. 1 Attempting to make sense of the violent upheavals that shook Russia in 1917, Berdiaev believed that the source of Russian (...) troubles lay in the "inconsistency of the Russian spirit" due to the "conflict of the Eastern and Western elements in her." 2 Russia, he argued, always contained within its wide territory an invisible and shifting border between two continents, and thus Russian society was forever torn between two cultures. Berdiaev insisted that Russia could not discover its true calling or its place in the world until it resolved its internal conflict between East and West. 3Berdiaev was contemplating the course of the nineteenth century, when Russia's geographical destiny had deeply troubled Russian intellectuals. In the late 1830s Russian thinkers began their minute analyses of cultural and historical sources, hoping to determine the essential character of their nation and believing that their research would enable them to predict Russia's future. Often, diverse questions of progress and stagnation, tradition and innovation, and the individual and society were all framed within this overarching problem of East versus West.It is tempting to see this Russian dilemma as longstanding and natural, given Russia's position between two continents. Indeed, many recent scholars have argued that Russian encounters with Asia, taking place within the framework of Russia's territorial expansion eastward, forced Russians to examine their relationships [End Page 335] with the Eastern, Asian world. 4 It is true that European geographers and historians have debated the location of the border between Asia and Europe since the Middle Ages. Yet there is little evidence to suggest that Muscovy was concerned about its position between Eastern and Western countries. 5 Even Peter the Great, whom historians have credited for bringing European customs into Russia, was little concerned with the European/Asian divide in Russian culture. This paper discusses an algorithmic tool introduced in the Basque Country (Spain) to assess the risk of intimate partner violence. The algorithm was introduced to address the lack of human experts by automatically calculating the level of violence based on psychometric features such as controlling or violent behaviour. Given that critical literature on risk assessment tools for domestic violence mainly focuses on English-speaking countries, this paper offers an algorithmic accountability analysis in a non-English speaking region. It investigates the algorithmic risks, (...) harms, and limitations associated with the Basque tool. We propose a transdisciplinary approach from a critical statistical and legal perspective. This approach unveils issues and limitations that could lead to unexpected consequences for individuals suffering from partner violence. Moreover, our analysis suggests that the algorithmic tool has a high error rate on severe cases, i.e., cases where the aggressor could murder his partner—5 out of 10 high-risk cases are misclassified as low risk—and that there is a lack of appropriate legal guidelines for judges, the end users of this tool. The paper concludes that this risk assessment tool needs to be urgently evaluated by independent and transdisciplinary experts to better mitigate algorithmic harms in the context of intimate partner violence. Considering recent theoretical discussions about the concept of moral legitimacy, this study advances our understanding of its performance consequences. Specifically, it uncovers the mediating role of moral legitimacy in the relationship between regulations and industry performance. Our analysis of the U.S. state-level data on regulations in a controversial industry between 1994 and 2010 yields four significant findings. The results show that regulations not only decrease performance but also negatively impact moral legitimacy. Moreover, this study provides empirical evidence that moral legitimacy (...) is positively related to industry performance, providing much-needed direct support for this premise. Importantly, the results indicate that moral legitimacy mediates the effect of regulations on performance, but only when regulations are aligned with moral values. Overall, this study extends our understanding of how regulations influence moral legitimacy, and in turn impact industry performance. (shrink)

The last two decades have witnessed intense debate over the ethical legitimacy of placebo controlled trials. Most of the arguments for and against the use of PCTs turn on one of the following issues: the compatibility of the obligations of clinicians and researchers with PCTs, the scientific merit of PCTs, and the influence of patients' and subjects' perceptions, ability to consent, expectations, and rights on the permissibility of PCTs. I introduce each of these categories and assess the principal arguments in (...) each group. I argue that, although some of the arguments against PCTs have limitations, they do inform the debate in significant ways by pointing to important constraints on PCTs. Those concerning patients' and subjects' perceptions, capacity to consent, expectations, and rights are particularly instructive. They do not, for the most part, sustain an absolute prohibition of PCTs, but they do suggest types of PCTs that are inappropriate and they indicate issues that must be addressed when PCTs are conducted. I argue that we should look to the reasonableness and permissibility of informed refusals of care to evaluate the extent to which a trial is a legitimate PCT ; to determine which potential subjects should be considered eligible to enroll in a PCT ; and to inform the language that should be used in describing the study as part of the informed consent process. In her recent book Gillian Brock argues that states’ legitimacy depends on their being part of a just state system that protects human rights. Here I discuss some practical limitations raised by Brock’s legitimacy framework: mainly, (1) the problematic real-world implications of such an account, and (2) the epistemic challenges that judgements inspired by this account would have to face, were we to proceed solely on the basis of it.

In Croatia, the subject of medical ethics, or bioethics, was introduced into the curriculum in the early 1990s at the medical schools of the University of Rijeka and the University of Zagreb. Today, bioethics education has become a basic part of undergraduate medical education not only in Rijeka and Zagreb but also in Osijek.

Este trabajo analiza la respuesta que el Estado español, como Estado-nación, está dando a la integración del inmigrante como ciudadano. Frente a quienes consideran que la residencia ha de ser la vía de acceso a la ciudadanía ante la crisis del Estado nación y la movilidad geográfica que impone la globalización económica a las personas, aquí se defiende, por el contrario, la relevancia política de la nacionalidad, como parte alícuota individual de pertenencia al poder constituyente, en relación armónica con un (...) concepto flexible de residencia. La investigación está dividida en cinco apartados, en los que se estudia la nacionalidad y el poder constituyente, las vías de acceso a la nacionalidad española, el conflicto Estado o nación, las peculiaridades de la nacionalidad originaria y , finalmente, los criterios que los Estados utilizan para la selección de la inmigración potencial. El recorrido crítico por la legislación española en materia de nacionalidad y ciudadanía acompañado de los debates teóricos al respecto, ha permitido concluir con una propuesta de lege ferenda centrada en una reforma radical en materia de nacionalidad. Digital technologies induce organised immaturity by generating toxic sociotechnical conditions that lead us to delegate autonomous, individual, and responsible thoughts and actions to external technological systems. Aiming to move beyond a diagnostic critical reading of the toxicity of digitalisation, we bring Bernard Stiegler’s pharmacological analysis of technology into dialogue with the ethics of care to speculatively explore how the socially engaged arts—a type of artistic practice emphasising audience co-production and processual collective responses to social challenges—play a care-giving role that helps (...) counter technology-induced organised immaturity. We outline and illustrate two modes by which the socially engaged arts play this role: 1) disorganising immaturity through artivism, most notably anti-surveillance art, that imparts savoir vivre, that is, shared knowledge and meaning to counter the toxic side of technologies while enabling the imagination of alternative worlds in which humans coexist harmoniously with digital technologies, and 2) organising maturity through arts-based hacking that imparts savoir faire, that is, hands-on knowledge for experimental creation and practical enactment of better technological worlds. Este artículo estudia críticamente el concepto de Ius Constitutionale Commune Latinoamericanum como fenómeno de judicialización de la política a nivel regional. Partiendo de la afirmación de que el derecho constitucional es político, se analizan algunos rasgos del ICCAL como la ideología que lo inspira, la teoría en que se apoya el concepto y el arreglo institucional que lo sostiene, para problematizar su carácter "común". Bajo el entendido que cualquier proyecto constitucional está indisolublemente ligado a un diseño institucional que lo lleva (...) a cabo, se critica la apuesta por un modelo juricentrista, anclado en la interpretación que la Corte Interamericana de Derechos Humanos hace de los derechos reconocidos como universales, para proponer un sistema basado en procedimientos deliberativos e igualitarios que fortalezcan la democratización de la región. This article critically examines the concept of Ius Constitutionale Commune Latinoamericanum as a phenomenon of judicialization of politics at the regional level. To problematize its "common" character and based on the assertion that constitutional law is political, some features of the ICCAL are analyzed: the ideology that inspires it, the theory in which the concept is supported and the institutional arrangement that sustains it. Under the understanding that every constitutional project is inextricably linked to an institutional design that carries it out, the commitment to a jury-centered model, anchored in the interpretation that the Inter-American Court of Human Rights makes of the rights recognized as universal is criticized. Proposing, in contrast, a system based on deliberative and egalitarian procedures that strengthen the democratization of the region. (shrink)

Resumen El artículo sitúa su reflexión en el tema del ecumenismo, relacionándolo con las propuestas de aggiornamento expresadas por el Vaticano II. Hace también alusión al ámbito de las mudanzas en el seno del protestantismo, de las Iglesias ortodoxas e incluso del cristianismo romano. Además alude a los grandes nombres que trazaron la reflexión teológica en el período de crisis que antecedió al evento –hablamos de aspectos que acabaron incidiendo en los debates conciliares. Siguiendo a Gutiérrez, el artículo destaca tres (...) dimensiones relativas a la búsqueda del diálogo de la Iglesia con el mundo contemporáneo: la urgencia de ser actual, la perspectiva ecuménica y la solidaridad con los pobres. Analiza los “caminos equivocados” que fueron adoptados por la Iglesia en lo concerniente a las propuestas ecumênicas del Concilio: el tomar un “execesivo cuidado” en lo que respecta al mundo moderno, las posiciones de intolerância frente a lo diferente, la comprensión reduccionista del ecumenismo. Hace mención a la exigência de construir relaciones que tengan como bases: la gracia y el amor. Por último, propone la tesis de que “no puede existir un sentido del diálogo, un encuentro entre los seres diferentes, sin la libertad”. Palabras-clave : Iglesia. Vaticano II. Ecumenismo. Diálogo inter-religioso.This article focuses its discussion on the theme of ecumenism, in relation to the catholic proposal of aggiornamento expressed by Vatican II. The text refers to the changes within the Protestantism, the Orthodox churches and also within the Roman Christianity. It also mentions the relevant names that marked theological reflection in those times of crisis prior to the Council. Following the author´s thought, the text highlights three dimensions of the dialogue of the Church with the contemporary world: the urgency in getting things update, the ecumenical perspective and the solidarity with the poor. The article evaluates the "wrong path" taken by the Church in relation to the propositions of the ecumenical council: attitudes of intolerance to the different and the reductionist understanding of ecumenism. It also refers to the need to build relationships whose bases are the grace and love. The term etonism reflects the Angolan ancestral philosophy… Etona in Kikôngo, etonolo or etonuilo in Umbûndu: allegations, reasons, indulgence (tolerance). In Nyaneka form is etŏnya. These significances constitute the essence of the etonism: 1) reasons, 2) allegations, 3) indulgence, 4) evidence that generates the justice and the tolerance. «Who is correct tolerates who is wrong». Also, Etonism identifies 1) racism, 2) tribalism and 3) discrimination as a serious sequel of neo-colonialism, and calls the attention of the Angolan people, using roots (...) of angolanity safeguarding a harmonious society in the future. It suggests the tolerant reason as one of the main form of tranquility in Angola after-war. (shrink)

Em Imagem-tempo Deleuze quando do quarto comentário a Bergson fala em cinema do tempo remetendo a Orson Welles e ao filme Cidadão Kane. O cinema do tempo é apresentado a partir de três caracteres de um tempo não cronológico. Deleuze aponta para uma condição do cinema do tempo ao propor a substituição de uma vista pragmática longitudinal por uma visão ótica, vertical, em profundidade. A profundidade de campo é trabalhada enquanto um elemento conceitual no trato de uma metafísica da memória (...) em diálogo com as bases do cinema moderno, nesse sentido, os três caracteres de um tempo não cronológico e a inserção de uma nova relação entre tempo e espaço no cinema são constituintes de uma imagem tempo direta cujo problema filosófico perpassa a inserção do movimento no pensamento. O encontro do quarto comentário em Imagem-tempo com o primeiro comentário a Bergson em Imagem-movimento é o percurso para compreender a importância da profundidade de campo. Assim o cinema do tempo de Welles é entendido como o cinema de uma metafísica da memória a partir de duas fontes: o esforço atual de evocação para suscitar a imagem-lembrança e a exploração das zonas virtuais de passado para encontrar a imagem-lembrança. Partindo de alguns textos fundadores do conceito de ‘utopia’, pretendemos pôr em evidência que, no caso de José Saramago, em regra, a procura de uma (im)possível sociedade livre e perfeita assume contornos de tonalidades diversas. O desejo de cenários diferentes daqueles em que vivemos, mais justos e fraternos, não acarreta, necessariamente, a ideia de deslocalização ou de relocalização espacial implicada nas tradicionais utopias. Pelo contrário, cremos que o ideal utópico saramaguiano (numa perspectiva de leitura cuja subjectividade assumimos) supõe uma busca (...) que se traduz num processo de (re)aprendizagem que começa e acaba no próprio ser humano. Para tal, há que acreditar na capacidade e no poder do Homem para lutar contra várias espécies de adversidades, de obstáculos e de violências. Afinal, como disse, em 1997, a Eduardo Sterzi e Jerônimo Teixeira: “Sabemos mais do que julgamos, podemos muito mais do que imaginamos.” No delinear destes percursos de humana aprendizagem verificaremos ainda a presença (aparente) de afinidades com alguns vectores da tradição religiosa que o autor sempre recusou e a aproximação (efectiva) a uma outra dimensão espiritual: a de certos rituais maçónicos. Este artículo trata de estudiar la evolución de la figura del alcalde mayor de las aljamas de Castilla a partir de la institución del cadiazgo de la comunidad islámica (qādī al-qudat), modificada por el paso del tiempo y la intervención de las autoridades cristianas. Para ello se analizan las familias que desempeñaron este oficio en Castilla, todos ellos pertenecientes a la élite político-militar, comercial y jurídica de las aljamas mudéjares. La institución de la alcaldía mayor de las aljamas del reino, (...) estudiada como algo excepcional por Torres Fontes, no lo es tanto, y encaja perfectamente en la estructura organizativa de las aljamas y en las luchas internas por el poder que se gestan en ellas. A partir de ahí nos concentramos en el estudio de los elementos de continuidad y ruptura que se manifiestan e la institución de la alcaldía mayor de los moros respecto al cadiazgo islámico. (shrink)

Las órdenes militares dispusieron desde su fundación de mano de obra esclava en sus tierras, pero la institución que mejor sirve para estudiar la esclavitud en los siglos XII y XIII en los reinos de León y Castilla son los hospitales para la redención de cautivos de la Orden de Santiago. Estas instituciones disponían de espacio para alojar a los cautivos mientras se negociaban rescates con los poderes islámicos, y atendían a la redistribución de aquellos musulmanes que, por no haber (...) sido redimidos, pasaban a ser esclavos de la propia orden o a ser vendidos en los mercados de los reinos cristianos. Los escasos documentos de la sección de Órdenes Militares del Archivo Histórico Nacional dedicados a esclavos ayudan a comprender el funcionamiento del tráfico, trabajo y liberación de este colectivo. The ability to use and make technical artifacts has been considered exclusive to human beings. However, recent findings in ethology in light of observations made in nature and in laboratory show the opposite. In the area of philosophy of technology there are few exceptions that take into account the ability of some non-human animals to manufacture and use tools. In this paper I want to show some reasons to reconsider other possibilities. It seems that capacities such as intentionality, culture or (...) even the complexity of the structures of manufactured object are not exclusive to human beings. I will suggest a different way of analyzing objects created by non-human animals, one that tries to explain the gradualness of the structure, but also the plasticity of the behavior exhibited by non-human animals. These two elements allow a deeper understanding of the great variety of objects that other animals also manufacture and use. (shrink)

Towards the middle of the 18th century, Pierre-Louis Moreau de Maupertuis proposed the “principle of least action” as a fundamental law of physics and as a proof of the existence of God. Samuel König and other contemporary authors criticized Maupertuis’ work. There ensued a fierce discussion concerning this subject, in which Leonhard Euler, the king Frédéric II of Prussia and Voltaire took part. This paper discusses that debate, emphasizing its extrascientific features and analyzing the interests that motivated the actions of (...) the people involved in that episode. RESUMO: Em meados do século XVIII, Pierre-Louis Moreau de Maupertuis propôs o “princípio de ação mínima”, que seria uma lei fundamental da física, além de constituir uma prova da existência de Deus. O trabalho de Maupertuis foi criticado por Samuel König e outros autores da época. Ocorreu uma violenta discussão a respeito desse assunto, da qual participaram Leonhard Euler, o rei Frédéric II da Prússia e Voltaire. Este artigo estuda o debate ocorrido, enfatizando especialmente os aspectos extracientíficos e analisando os interesses que motivaram as ações das pessoas envolvidas nesse episódio. (shrink)

In this paper I suggest an alternative reading of the value of Hegel’s systematic approach to nature from the perspective of environmental philosophy. Taking the paradigmatic example of the “new materialist” ontologies, I present the problems with an inflationary justification for the argument for the need of a shift in the “scientific” representation of nature. On the basis of these problems, I suggest that Hegel’s view of nature as axiologically impotent sheds light into why emancipatory environmental theory needs not hinge (...) on a determinate understanding of nature. In my reading, this rejection can be harmonized with the asymmetric nature of our responsibility towards non-human nature. (shrink)

According to a well-known principle in democratic theory, all those whose interests are affected by a decision should have a say in it. ‘How much of a say?’ is the next question. One answer is the Proportionality Principle, according to which ‘people should have a say in a decision proportionally to the extent that their interests are affected by it’. It is often suggested that this principle should be implemented through weighted voting. This article considers an alternative: weighting as part (...) of internal deliberation before the casting of votes. Instead of weighting votes as we count them, we could apply the Principle to the more fundamental process by which citizens form their judgements about how to vote. This alternative approach conceives of citizens as fulfilling dual roles: first, as _claim-makers_ advancing claims about what the collective decision should be, based _inter alia_ on how it impacts their own interests, and, second, as _adjudicators_ taking into account everyone’s claim by weighing it proportionally to the degree each claimant is affected by the collective decision. I examine the democratic and epistemic strengths of this alternative as well as its weaknesses, compared to the more standard way of implementing the Proportionality Principle via weighted voting. This article discusses some ethical questions raised by multiple citizenship and, more generally, citizenship as we know it. Despite a richness of legal and sociological discussions of multiple citizenship, purely ethical inquiry into multiple citizenship is still in its infancy. The aim here is not to provide a literature review of the further‐flung scholarship on this topic, but rather to point out that multiple citizenship is a topic worthy of specifically philosophical inquiry, and to show how it relates to existing (...) debates within political philosophy. The objective of this article is to identify and analyze the changes made to IFRS 3, 9, 10 and 16 since the beginning of COVID-19, and how these affect the presentation of financial statements, influencing decision-making. With the use of the deductive method and applying a qualitative approach, collecting information through the database of the Superintendency of Companies of Ecuador, an evaluative analysis of each company was carried out and how they applied the modifications offered by the IFRS, reviewing the (...) financial statements of 60 companies in the Commercial, Real Estate and Financial sectors where it was obtained that 15% of these companies presented changes in their financial statements, of this percentage 8.3% belong to companies in the commercial sector, 5. 1% comes from entities in the real estate sector and 1.6% are from companies in the financial sector. It is concluded that there is no significant change in the presentation of financial information since COVID-19. (shrink)

The main theme of the proposed paper concerns the professional training and artistic activity of Theodor Vasilescu, choreographer and dancer, specialized in folk dance, with a rich international activity during the communist regime. The analysis will focus on illustrating how the artist’s biography was influenced by a new trend in the satellite states of the U.R.S.S., namely that of transforming traditional dance into art with a political substratum. Also, the main thread of the article will consist in revealing the specific (...) type of relationship between the artist and the regime, dominated by a permanent awareness of the mutual benefits of this partnership: for the dancer Theodor Vasilescu it was the chance to develop a successful career, which for the propaganda apparatus implied a strong image campaign for Romania, abroad. Regarding the temporal framework, the analyzed period will focus on the regime of Nicolae Ceaușescu, 1965-1989, relevant in Theodor Vasilescu’s career path, as well as in the dissemination of his work results. There are three important aspects that will be analyzed in this article: first, the recovery of an important cultural trend in Romanian history, when, through the influence on the Soviet chain, folklore and traditional dance became an art form strongly subsumed to an ideology. This aspect led to the foundation of many Folk Ensembles with a specific type of artistic manifestations, including folk dance. At the same time, it will be illustrated how the regime was involved in financing and promoting this type of dance, by including it in the development of the most important national performances, by encouraging research in this field and creating professional opportunities through training and also by organizing an International Folklore Festival, “Romania 69”. This approach definitively changed the professional career of Theodor Vasilescu. The last aspect consists in presenting the international career of the choreographer, as a direct result of the increased interest that the communist regime had in promoting Romania’s image abroad. This made the Romanian folk dance very popular in countries such as Netherlands, Japan, Canada, Germany. Also, the frequent tournaments con-tributed to the increase of the Securitate’s interest in his daily activity. The main categories of sources for documentation will consist of: my personal archive which contains two interviews with Theodor Vasilescu, documents in the funds and collections of the National Archives of Romania (The Central Committee of the Romanian Communist Party, Propaganda and Agitation Section, Organizational Section), also those of the National Council for Studying the Securitate Archives.
