Swedish hunters sometimes appeal to an inviolate ‘right to exist’ for wolves, apparently rejecting NIMBY. Nevertheless, the conditions existence hunters impose on wolves in practice fundamentally contradict their use of right to exist language. Hunters appeal to this language hoping to gain uptake in a conservation and management discourse demanding appropriately objective ecological language. However, their contradictory use of ‘right to exist' opens them up to the charge that they are being deceptive – indeed, right to exist is a 'disguised (...) NIMBY!' We address this situation by distinguishing hunters’ criticisms of wolves from the procedures for reaching objective policy decisions. (shrink)

There is considerable controversy about the mandatory ethics review of research. This paper engages with the arguments offered by Murray Dyck and Gary Allen against mandatory review, namely, that this regulation fails to reach the standards that research ethics committees apply to research since it is harmful to the ethics of researchers, has little positive evidence base, leads to significant harms (through delaying valuable research) and distorts the nature of research. As these are commonplace arguments offered by researchers against (...) regulation it is useful to assess their strength and the conclusion that they are taken to support, namely, that we ought to move back to a system of trust in researchers without compulsory regulation. Unfortunately, these arguments are at best weak and to some degree come into conflict in terms of supporting the desired conclusion. (shrink)

Ian Tattersall is curator emeritus of the Spitzer Hall of Human Origins at the American Museum of Natural History, and an authoritative voice on the subject of human origins. The book offers anyone a chance to catch up on the current state of the art. One thing we learn is that the comparison with apes is misleading. None of our ancestors were much like an ape. Hominid forebears have been evolving rapidly and dramatically away from apes for more than two (...) million years. Hunting is another red herring. We did not evolve to be hunters, or under conditions where hunting success was crucial to survival. Technology also does not drive our evolution. New stone technologies never emerge with new species. In each case, old kinds of hominids begin to do new things with stone and other material. What most differentiates early hominids from chimpanzees, and disqualifies emphasis on hunting, is that coming down from the trees to walk on two legs made hominids opportunistic generalists. As Tattersall tells it, the acquisition of modern human qualities was not a gradual, progressive accumulation of adaptations, nor is the emergence of our species predictable from earlier trends, or a threshold effect of gradually rising brain size. It was an abrupt and recent event, primarily in response to deteriorating (increasingly dry and cold) climate. We did not adapt genetically to the changed conditions, but accommodated to them through culture, creating a lifestyle with a new level of freedom from the environment, which might change without making people unable to cope. Maybe that is why many today remain indifferent to the threat of climate change. We are accustomed not to worry about such things. We have always pulled through. Such optimism is bred in the bone. But it was only right in the past, and this comfortable habit may be our doom. (shrink)

We describe food transfer patterns among Ache Indians living on a permanent reservation. The social atmosphere at the reservation is characterized by a larger group size, a more predictable diet, and more privacy than the Ache typically experience in the forest while on temporary foraging treks. Although sharing patterns vary by resource type and package size, much of the food available at the reservation is given to members of just a few other families. We find significant positive correlations between amounts (...) transferred among pairs of families, a measure of the "contingency" component required of reciprocal altruism models. These preferred sharing partners are usually close kin. We explore implications of these results in light of predictions from current sharing models. (shrink)

In this paper, we determine whether illegal hunting should be construed as a crime of dissent. Using the Nordic countries as a case study where protest-driven, illegal hunting of protected wolves is on the rise, we reconsider the crime using principles of civil disobedience. We invoke the conditions of intentionality, nonevasion, dialogic effort, non-violence and appeal to parameters of reasonable disagreement about justice and situate the Nordic illegal hunting phenomenon at a nexus between conscientious objection, assisted disobedience and everyday resistance. (...) This examination leads us to contend that the crime has heretofore received an inadequate response limited to punishment and deterrence. This contention finds support in the worsening predicaments of illegal hunting following harsh sanctions and stigmatization. Although hunters publicize injustices through their crimes, we find that killing wolves as a means to deliberative ends disqualifies hunters’ dissent as legitimate disobedience, creating an obligation of deliberative uptake on the part of society. Nonetheless, in a critical contribution to the field of criminal justice, we argue that it is instead the conditions of deliberative suboptimality experienced by hunters that create this obligation of uptake. Hence, in order to fulfill this obligation, we contend that the burden falls on regulatory agencies to better articulate the justifications for the policies that coerce hunters. We also advocate creating novel institutions to provide hunters with effective opportunities for contesting wildlife conservation directives. (shrink)

About 25 years ago, it came to light that a single combinatorial property determines both an important dividing line in model theory and machine learning. The following years saw a fruitful exchange of ideas between PAC-learning and the model theory of NIP structures. In this article, we point out a new and similar connection between model theory and machine learning, this time developing a correspondence between stability and learnability in various settings of online learning. This book explores Kant's views on the concept of God and on the attempt to demonstrate God's existence as a means of understanding Kant's work as a whole and of achieving a proper appreciation of the contents of Kant's moral faith.

We set up a general context in which one can prove Sauer-Shelah type lemmas. We apply our general results to answer a question of Bhaskar [1] and give a slight improvement to a result of Malliaris and Terry [7]. We also prove a new Sauer-Shelah type lemma in the context of op-rank, a notion of Guingona and Hill [4].

Research involving human subjects is much more stringently regulated than many other nonresearch activities that appear to be at least as risky. A number of prominent figures now argue that research is overregulated. We argue that the reasons typically offered to justify the present system of research regulation fail to show that research should be subject to more stringent regulation than other equally risky activities. However, there are three often overlooked reasons for thinking that research should be treated as a (...) special case. First, research typically involves the imposition of risk on people who do not benefit from this risk imposition. Second, research depends on public trust. Je soutiens que les pragmatistes sont conduits à accepter une distinction du genre «type/occurrence» entre les formes d’une investigation et ses instanciations particulières, sous peine de banaliser leur vérificationnisme. Néanmoins, même la conception révisée que j’examine échoue à sauver les approches épistémiques de la vérité de certaines conséquences peu plausibles.

If, as Axel Honneth has recently argued, critical theory needs psychoanalysis for meta-normative and explanatory reasons, this does not settle the question of which version of psychoanalysis critical theorists should embrace. In this paper, I argue against Honneth's favoured version – an intersubjectivist interpretation of Winnicott's object-relations theory – and in favour of an alternative based on the drive-theoretical work of Melanie Klein. Klein's work, I argue, provides critical theorists with a more realistic conception of the person and a richer (...) explanatory account of human aggression and destructiveness than does Honneth's intersubjectivist view. As such, it better serves the ends for which Honneth claims that critical theory should turn to psychoanalysis in the first place. (shrink)

The target article focuses on evidence from nonlinguistic faculties to defend the claim that cognition generally traffics in language-of-thought (LoT)-type representations. This focus creates needed space to discuss the mounting accumulation of nonclassical evidence for LoT, but it also misses relevant work in linguistics that directly offers a perspective on specific hypotheses about candidate LoT representations.

The article opens with a brief discussion of the cultural economy of cities. A framework for investigating this phenomenon is then proposed, paying special attention to the interconnections between the system of production, its geographic milieu and the logistics of distribution. An overview of the structure and logic of the French film industry is laid out in which the fragmentation of production activities and labor markets is stressed. The policy system governing the French film industry is described in detail, and (...) the special role of the CNC (Centre National de la Cinématographie) is highlighted. The industry is then shown to be deeply interwined with the urban milieu of Paris, both in terms of its locational structure and its cultural dynamics. The final major section of the article deals with issues of industrial survival and competitiveness in the new global economy. It is suggested that French film policy needs to shift from a posture of defensive support of the industry to a more clearly articulated and aggressive concern with rebuilding market share in both the domestic and international arenas. Eric Katz in Zombie Arguments defends the thesis authenticity is indispensable to conservation. I agree. However, I argue authenticity appears in degrees and can be reclaimed by populations through their continuing evolutionary responses to the world. This means that interventions that diminish the value of a population through reducing their authenticity can be permitted in limited cases. When our actions retain the remaining authentic features in a threatened population we should allow such a diminishment as authenticity can be reclaimed in (...) time. (shrink)

In this brief paper I intend to make some distinctions between the activities that research ethics committees are required to undertake as part of their role in protecting research participants. These functions are, identifying ethical issues and risks within research projects, providing advice on how to resolve these issues and risks without compromising the validity of the research and finally, when this cannot be achieved, deciding whether the research should still be allowed to go ahead. Distinguishing these distinct functions allows (...) us to determine what an appropriate membership of a Research Ethics Committee is. I will sketch out the implications of these functions for the appropriate membership of NHS and university based ethics committees in the UK. (shrink)

Stakeholder theorists distinguish between normative stakeholders, those who gain moral standing by making contributions to the firm, and derivative stakeholders, those who can constrain the corporate association even though they make no contribution. The board of directors has the legal authority to distinguish among these stakeholder groups and to distribute rights and obligations among these stakeholder groups. To be sure, this stakeholder formulation appropriately seizes on the firm’s voluntary, associative character. Yet, the firm’s constituents contribute assets and incur risks to (...) participate in market, economic activities. And, as such, the firm’s “stakeholders” must share an imperfect language to assist in making two key economic decisions: (1) who are the legitimate and who are the derivative stakeholders; and (2) who should sit on the board? Still, stakeholder theorists have good reason to be skeptical of neoclassical economics. Its assumptions that all act opportunistically and that all can calculate rationally and fully hardly correspond to studies on the managerial experience of corporate coordination. However, advances in behavioral law and economics now provide a cogent economic logic that readily fits into a stakeholder mode. In brief, we argue that (1) the firm’s economic purpose designates legitimacy to core stakeholders, to those who add value, assume unique risk, and can incur harm; (2) the board serves as the principal who coordinates these core stakeholders to sustain competitive advantage and new wealth creation; and (3) state incorporation law, Delaware in particular, reinforces the board’s function. These, in turn, supply selection criteria for board membership. We aim to synchronize concepts from behavioral law and economics with stakeholder theory. (shrink)

Adolf Grünbaum contends that he has discovered in Freud's writings a hitherto overlooked thesis (the Tally Argument), enunciated by Freud to underwrite his psychoanalytic method of clinical investigation. (The Foundations of Psycho analysis, 1984:127-72). He claims that until at least 1917, and possibly up to 1926, Freud invoked the unique efficacy of analytic therapy to vindicate the Freudian theory of personality, including the specific aetiologies of the psychoneuroses and the general theory of psychosexual development (Foun dations : 140-1). In this (...) article I shall argue (1) that the Tally Argument itself is defective, and (2) that Freud did not invoke it as Grünbaum claims. In short, I shall argue that Grünbaum's Tally Argument thesis is untenable and, as a corollary, that his depiction of Freud as a 'sophisticated scientific methodologist' is misconceived. (shrink)

Drawing heavily upon natural history data from the Neotropical butterfly fauna, an attempt is made to develop a model, with testable hypotheses, to account for the evolution of egg-clustering and larval gregariousness. Given the high diversity of both plant and butterfly species in the American tropics, there is a higher incidence of egg-clustering there, including some species with aposematically-colored immature stages. Emphasis is placed on the need to examine both the physical (mechanical) toughness of larval food plants for larval feeding (...) success, and the spatial structuring of food plant populations. It is argued that when food plant spatial patchiness is high, the breadth of local food plant species usage low, plant growth rates high, fed-upon structures tough, butterfly dispersal low, and reproductive potential low, egg-clustering evolves. Such ecological character states, coupled with the occurrence of food plant patches in large sizes relative to the nutritional and fecundity needs of the butterfly specialist on the species, select for egg-clustering to ensure survival of the butterfly population in that habitat. It is emphasized that the model proposed here requires considerable examination through field studies. (shrink)

Clinical medicine is the application of scientific principles, rules of thumb, and a store of practical wisdom embodied in narratives of individual cases to the care of a person who is ill. Physicians are taught to observe and report the individual case both as a means of fitting nomothetic generalizations to the given circumstances and as a way of refining those generalizations. This narrative construction of illness is a principal way of knowing in medicine. In this view, disease is not (...) so much an entity as an identifiable chronological organization of the events of illness, and medicine, rather than a science, a rational science-using activity in the service of the ill. In this article I offer a defence of the use of deceptive placebos—inert treatments like sugar pills or saline injections—in clinical practice. In particular, I will defend what I call the ideal placebo case—where a doctor or nurse has good reason to believe that a deceptive placebo offers a patient’s best, or only, chance of some therapeutic benefit. Taking a Kantian approach to the question of clinical placebo use, I examine the Kantian prohibition on deception as interference with the will (...) of a rational agent, and argue that deception to promote the placebo effect can be carried out in a way that does not interfere with the patient’s will in the way prohibited by Kant. The deception involved in a placebo treatment is not carried out to interfere with or obstruct the function of the will, but merely to make possible a means to the patient’s ends that that would otherwise be unavailable. I will therefore argue that deception carried out in order to promote a therapeutic placebo effect can be done in a way that is consistent with respect for a patient’s autonomy, and may be a rare case of deception that is compatible with a Kantian ethical approach.
