The paper is a critical analysis of minimalistic interpretations of the notion of moral obligation. The main grounds and arguments for this interpretation are the liberal understanding of justice and priority of negative rights and obligations over positive ones. To move to a more expansive morality we need to change the balance between negative and positive obligations by reconsidering the status of general and positive obligations. However, raising the status of positive obligations immediately leads to the problem of “moral overburden”. (...) One possible way to overcoming moral minimalism could be based on treating positive obligations as a correlate of a set of rights that cannot be ignored. An important qualification is that the recognition of the right to a resource does not automatically mean placing an obligation on all persons satisfying some eligibility criteria. Instead, it could lead to a moral division of labor when different people take on the responsibility to meet positive moral obligations to those with a legitimate “natural right”. An additional consequence is that this approach helps to cope with the “moral overburden” of a moral agent. (shrink)

Growing philosophical interest in theories of obligation has many sources. Among the most important ones is the tendency to redefine the scope of the political. Then we are Inevitably confronted with the question about the nature and scope of our obligations towards others. An analysis of an important and popular distinction between obligations of justice and obligations of charity shows that their distinctive characteristics are seldom precise and clear-cut. Moreover, they are more superficial rather than substantive and do not allow (...) to draw a clear line between obligatory and desirable behavior, or legally and morally obligatory behavior. In present-day ethical theory there is a tendency towards expanding the scope of obligations of justice and redefining their content. Actions whichtraditionally might have been considered as display of good nature are more and more often perceived as obligations avoidance of which is unjust. This also changes the role of institutions. The borders and content of individual obligations of justice should be considered in close connection with the problem of constructing just social institutions. The subjects of justice (the moral individual and the social institute) are interrelated and the search for an optimalbalance between two viewpoints – those of private interest and impartiality – becomes a unifying project both for political and moral philosophers. The aim of this article is to present a variant of epistemic relativism that is compatible with a language practice especially popular among scientists. We argue that in science, but also in philosophy, propositions are naturally ‘relativized’ to sets of hypotheses or theories, and that a similar language practice allows one to interpret canonical problems of epistemology. We apply the model to Gettier’s problem, and derive a condition under which counterexamples à la Gettier to Plato’s account of knowledge do not (...) arise. We argue that these findings give further content to a well-known result by Zagzebski (1994). Our interpretation points to a type of epistemic relativism having links with contextualism in epistemology, and perspectivism in philosophy of science. (shrink)

Digital and analog: What do these terms mean today? The use and meaning of such terms change through time. The analog, in particular, seems to go through various phases of popularity and disuse, its appeal pegged most frequently to nostalgic longings for nontechnical or romantic modes of art and culture. The definition of the digital vacillates as well, its precise definition often eclipsed by a kind of fever-pitched industrial bonanza around the latest technologies and the latest commercial ventures. One common (...) response to the question of the digital is to make reference to things like Twitter, Playstation, or computers in general. Here one might be correct, but only coincidentally, for the basic order of digitality (the digitality of digitality) has not yet been demonstrated through mere denotation. And the second question—the question of the analog—is harder still, with responses often also consisting of mere denotations of things: sound waves, the phonograph needle, magnetic tape, a sundial. At least denotation itself is analogical. This article will aim to define the analog explicitly and argue, perhaps counterintuitively, that the golden age of analog thinking was not a few decades past, prior to the wide-spread adoption of the computer. In fact, the fields of structuralism and poststructuralism that emerged in the middle to late twentieth century, concurrent with the deployment of the digital computer, were characteristically digital, what with their focus on the symbolic order and logical economies. If anything, the golden age of analog is happening today, all around us, as evidenced by the proliferation of characteristically analog concerns: sensation, materiality, experience, affect, ethics, and aesthetics. Zusammenfassung Vor dem Hintergrund der Diskussion über soziale Ungleichheit wird analysiert, welche Rolle soziale Determinanten in den Prozessen der Aufnahme und der Aufrechterhaltung der Sportteilnahme spielen. In der vorliegenden Längsschnittstudie wurden 481 Personen im Anfangsalter zwischen 33 und 56 Jahren zu vier Messzeitpunkten bezüglich ihres Sportverhaltens befragt. In der Aufnahmephase haben Frauen eine mehr als dreimal höhere Wahrscheinlichkeit sportlich aktiv zu werden als Männer. Dieser Einfluss wird durch die familienbezogenen Variablen mediiert, was die Bedeutung der vermittelnden Instanz Interaktionskontext unterstreicht. Conventional understanding and research regarding prognostic understanding too often focuses on transmission of information. However, merely overcoming barriers to patient understanding may not be sufficient. In this article the authors provide a more nuanced understanding of prognostic awareness, using oncological care as an overarching example, and discuss factors that may lead to prognostic discordance between physicians and patients. We summarize the current literature and research and present a model developed by the authors to characterize barriers to prognostic awareness. Ultimately, multiple (...) influences on prognostic understanding may impede acceptance by patients even when adequate transfer of information takes place. Physicians should improve how they transmit prognostic information, as this information may be processed in different ways. A model of misunderstandings in awareness, ranging from patient understanding to patient belief, may be useful to guide future discussions. Future decision-making studies should consider these many variables so that interventions may be created to address all aspects of the prognostic disclosure process. (shrink)

Nowhere could there be found a man as busy as this, and yet this man seemed busier than he was. If both of those statements are strictly true, most men are not as busy as they seem, and diligence is largely a matter of (...) show. It seems that professional, as that word is used to distinguish the worker from mere amateurs, was indeed a creation of the nineteenth century; and there are a host of reasons—not least, the industrial revolution—for tracing many of our modern convictions about work to that era. As a student captivated by the prose of the so-called Victorian prophets, Carlyle, Ruskin, and their followers, I began to conclude that their most frequently quoted passage from all the Bible was this: “Whatsoever thy hand findeth to do, do it with thy might; for there is no work, nor device, nor knowledge, nor wisdom, in the grave, whither thou goest” . This article offers further support for Lance Cousins’ thesis that the P?li canon, written down in the first century BCE in Sri Lanka, was based largely on a Theriya manuscript tradition from South India. Attention is also given to some of Cousins’ related arguments, in particular, that this textual transmission occurred within a Vibhajjav?din framework; that it occurred in a form of ‘proto-P?li’ close to the Standard Epigraphical Prakrit of the first century BCE; and that that distinct Sinhalese nik?yas emerged (...) perhaps as late as the third century CE. In der Diskussion über Ökonomisierung im Gesundheitswesen werden oft wesentliche Begriffsunterscheidungen außer Acht gelassen. Um feststellen zu können, in welchem Fall die Rede von Ökonomisierung oder Ökonomismus im negativen Sinn angemessen ist, muss zwischen dem Gesellschaftsbereich Wirtschaft und der ökonomischen Dimension in allen Gesellschaftsbereichen (wie dem Gesundheitswesen) unterschieden werden. Es muss geklärt werden, wo ökonomische Ziele verfolgt werden sollen und wo andere Ziele mit ökonomischen Mitteln verfolgt werden sollen. Im Blick auf die Frage nach einer Marktsteuerung des Gesundheitswesens ist zu (...) unterscheiden zwischen dem Gut Gesundheit und Gesundheitsgütern sowie zwischen öffentlichen, privaten und meritorischen Gütern. Außerdem ist die Frage nach einer Marktsteuerung des Gesundheitswesens zu unterscheiden von der Frage nach der Verwendung marktwirtschaftlicher Instrumente zur Steuerung des Umgangs mit bestimmten Gesundheitsgütern durch den Staat. Erst diese begrifflichen Differenzierungen können zu einer angemesseneren Beurteilung der komplexen wirtschaftsethischen Fragen jenseits von wirtschaftsfeindlichen oder ökonomistischen, von marktfeindlichen oder marktradikalen Ideologien führen. Courts commonly allow willful ignorance to satisfy the knowledge element of a crime. The traditional rationale for this doctrine is that willfully ignorant misconduct is just as culpable as knowing misconduct. But it is not obvious that this “equal culpability thesis” holds across the board. Is it true in all cases of willful ignorance or only some? This is the question I investigate here. -/- Specifically, I argue against several common versions of the equal culpability thesis before defending my own (...) restricted version. First, I argue that the broadest version of the thesis, adopted by many courts, is overinclusive. Then I argue against several restricted versions of the thesis offered by legal theorists including Doug Husak, David Luban, and Deborah Hellman. My own account, by contrast, is premised on a duty of reasonable investigation. If my account is on the right track, the widely employed willful ignorance doctrine stands in need of reform. (shrink)

The social philosophy of meaning and emotions represented in the work of Susanne Langer was recognized by Talcott Parsons, but has yet to be incorporated into mainstream sociological theoritizations. Langer's work is as potentially important to contemporary microsociology, and the sociology of emotions, as the work of Peirce, Mead, or Schutz. The impediment to appreciating her work resides in contemporary confusions regarding the nature of logic. Sociologists often subscribe to Wittgenstein's denial of the validity of formal logic in constructing theories (...) of human behavior. Langer has been misunderstood because her theoretizations address more than discursive logics and meanings. The thrust of Langer's work is that logic and meaning exist on a nondiscursive level of emotions. Though her work is more than 50 years old, we are now in a position to appreciate it because we are now exploring and conceptualizing the notion of social inferencing as existing beyond formal logic. Krindž komedija može učiniti ljude toliko nelagodnima da se osjećaj neugode nastavlja i nakon što komedija prestane. Ovaj rad objašnjava taj učinak, koji nazivam "krindž preostatak". Ako se publika slabo poveže s likovima, smiju se. Ako se snažno povežu, imaju negativnu emocionalnu reakciju – na primjer, teško im je gledati ili žele napustiti prostoriju.Prvo, tvrdim da su šale u krindž komediji ilokucijski činovi osmišljeni da izazovu smijeh putem posredne neugode (Austin, 1975). Drugo, priznajem da te šale ne proizvode uvijek željeni (...) perlokucijski učinak smijeha – ponekad šala ne uspije prevladati neugodu, ostavljajući gledatelja samo u stanju nelagode. Treće, oslanjajući se na teoriju benigne povrede McGrawa i Warrena (2010), objašnjavam da višak neugode proizlazi iz maksimiziranja povrede u komediji uz relativno mali dodatak benignog. Na kraju, tvrdim da je zabavnost krindž komedije uvjetovana nedostatkom socijalno-psihološkog distanciranja. Budući da ne ostavlja prostor između gledatelja i lika, nelagoda se maksimizira, komedija postaje manje benigna (odnosno snažnija povreda) i polarizirajuća kao rezultat. Ovo objašnjava i) zašto krindž komedija kod nekih gledatelja proizvodi komičan "preostatak", gdje se osjećaj neugode nastavlja i nakon što komedija završi, i ii) zašto krindž komedija kod nekih izaziva smijeh, a kod drugih stresne reakcije.
