The phenomenon of rigid designation - in particular, de jure rigidity - is typically treated metaphysically. The picture is: reference is gained in a way that puts no constraints on what an object in other worlds, or counterfactual situations must be like, in order to be the referent of that term, other than 'being this thing'. This allows 'pure metaphysical' investigation into, and discovery of 'the nature' of the referent. It is argued that this presupposes a 'privileged' ontology, of a (...) sort that is far from obvious. An alternative picture of rigidity is sketched, terms have associated criteria of identity and criteria of application for counterfactual situations. A term is rigid when these coincide. Aside from being a better account of rigidity, it also undermines the picture of rigid terms allowing us to 'metaphysically' investigate the nature of the referent: matters of identity and essence for the referent are settled by these semantic constraints (though it can be done in a way that allows are a posteriori necessities). Alan Bailey offers a clear exposition and defence of the philosophy of Sextus Empiricus, one of the most influential of ancient thinkers, the father of philosophical scepticism.

In this paper, we argue that there are important ethical questions about healthcare improvement which are underexplored. We start by drawing on two existing literatures: first, the prevailing, primarily governance-oriented, application of ethics to healthcare ‘quality improvement’ (QI), and second, the application of QI to healthcare ethics. We show that these are insufficient for ethical analysis of healthcare improvement. In pursuit of a broader agenda for an ethics of healthcare improvement, we note that QI and ethics can, in some respects, (...) be treated as closely related concerns and not simply as externally related agendas. To support our argument, we explore the gap between ‘quality’ and ‘ethics’ discourses and ask about the possible differences between ‘good quality healthcare’ and ‘good healthcare’. We suggest that the word ‘quality’ both adds to and subtracts from the idea of ‘good healthcare’, and in particular that the technicist inflection of quality discourses needs to be set in the context of broader conceptualisations of healthcare improvement. We introduce the distinction between quality as a measurable property and quality as an evaluative judgement, suggesting that a core, but neglected, question for an ethics of healthcare improvement is striking the balance between these two conceptions of quality. The author (physics, Northeastern U.) draws on history, theories of human development, and 30 years of teaching to argue that scientific thinking, which is analytic and objective, goes against the grain of traditional human thinking and arose in Greece because of unique historical factors. Having taken an active interest in middle-level science education in recent years, he concludes with recommendations for an overhaul of science teaching to steer away from the pervasive over-abstraction at inappropriate grade levels. This paper assumes that success on false-belief tasks requires a kind of folk psychological know-how, i.e. gradable knowledge how to perform skilful social cognitive acts. Following Ryle, it argues the folk psychological know-how required for success on a false-belief task cannot be reduced to conceptual knowledge as this would lead to an infinite regress. Within the skilled performance literature, Intellectualists have attempted to solve Ryle’s regress by appealing to automatic mechanisms similar in kind to some Theory-of-Mind explanations of folk psychology. (...) Exploring this similarity, the paper examines the epistemic commitments of two recent pragmatic Theory-of-Mind accounts of cross-cultural false-belief task data. By drawing on Fridland’s argument against Intellectualist explanations of know-how, it is argued that neither of these pragmatic Theory-of-Mind accounts can adequately explain gradable folk psychological know-how and escape Ryle’s infinite regress objection if these accounts are indeed committed to Intellectualism. The paper ends by supplementing Fenici’s account with the enactive framework to both bolster Fenici’s explanation of false-belief task know-how and avoid Ryle’s regress objection. (shrink)

In 1964, the American Medical Association invited liberal theologian Abraham Joshua Heschel to address its annual meeting in a program entitled “The Patient as a Person” [1]. Unsurprisingly, in light of Heschel’s reputation for outspokenness, he launched a jeremiad against physicians, claiming: “The admiration for medical science is increasing, the respect for its practitioners is decreasing. The depreciation of the image of the doctor is bound to disseminate disenchantment and to affect the state of medicine itself” [1, p. 35]. Heschel’s (...) reference to “disenchantment” suggests that he may have been familiar with the work, or at least the outlook, of sociologist Max Weber, whose 1917 address “Science as a Vocation” portrays the modern world as disenchanted by the progress of rationalism. Heschel’s life’s vocation had been to uncover the inner meaning of religious faith and to translate that faith into principled action. Heschel saw disenchantment not as an inescapable aspect of modern life but rather as the byproduct of physicians’ conscious choices to seek worldly success and material comfort. Yet, because of their privileged position as witnesses to human vulnerability, physicians possess an obligation to develop their own personhood, to re-enchant medicine, and through medicine to spark a positive transformation in all of modern life. As Heschel says, “The doctor must realize the supreme nobility of his vocation, to cultivate a taste for the pleasures of the soul. … The doctor is a major source of moral energy affecting the spiritual texture and substance of the entire society” [1, pp. 34, 38]. While Heschel’s conception of the physician’s role is romanticized and idealized, changes in the organization and practice of medicine have validated his concerns. (shrink)

This paper seeks to contribute to the discussion on national corporate social responsibility plans from the perspectives of the three logics as articulated in Caritas in Veritate, by using the Irish national CSR plan as an example. Good for Business, Good for the Community: Ireland’s National Plan on Corporate Social Responsibility 2014–2016 maintains that CSR activities can enable organisations to build relationships and trust with communities. One of the consequences of the 2008 financial crisis was the decrease in trust in (...) banking systems and in business more broadly. It is well recognised that relationships of trust are essential to the life of the market, the state and civil society. Pope Emeritus Benedict XVI’s Caritas in Veritate contends that corresponding to the life of the market, the state and civil society are three logics: the logic of exchange, the logic of public obligation and the logic of gift. This paper proposes that the normative framework of the three logics of Caritas in Veritate can be read into the Irish national CSR plan. This paper argues that the examples of CSR initiatives proffered by the plan could point organisations in the direction of the logic of gift and therefore enable the rebuilding of relationships of trust with citizens and communities. In spite of its everyday connotations, the term independence as republicans understand it is not a celebration of individualism or self-reliance but embodies an acknowledgement of the importance of personal and social relationships in people’s lives. It reflects our connectedness rather than separateness and is in this regard a relational ideal. Properly understood, independence is a useful concept in addressing a fundamental problem in social philosophy that has preoccupied theorists of relational autonomy, namely how to reconcile the idea of individual (...) human agency with the inevitable and necessary influence of other people, both directly and indirectly. I derive my account from the work of Mary Wollstonecraft and Catharine Macaulay, whose contributions have remained largely overlooked by current republican theorists. I have three purposes in this chapter. First, I set out the relational character of independence. Secondly, I outline a republican approach to the problem of structural social threats to agency. Finally, I hope to establish the basis for a fruitful dialogue between republicans and relational autonomy theorists on the requirements and dynamics of individual agency and freedom in oppressive social situations. I identify three distinctive features of the internal logic of freedom as independence that give it a relational character: it always locates the person within a community; there is a mediating role played by the notion of arbitrariness in connecting individual and collective perspectives; a causal relationship exists linking each person’s freedom as independence such that that the dependence of one class of persons jeopardizes the independence of the whole community. André Gallois’s Occasions of Identity is a detailed, well-written presentation and defense of one attempt to solve many of the recently much discussed puzzles in the metaphysics of material objects. It is engaging not only for Gallois’s ingenious attempt to defend his view that objects can be “occasionally identical”—identical at one time but not another —but for his discussion throughout of the puzzles and of alternative solutions. Gallois does a fine job of keeping the motivations for a position, whether his (...) own or others’, in view while working out details and responding to objections. Even where one disagrees, there is excellent food for thought and discussion here. (shrink)

I begin by describing the hideous nature of sexuality, that which makes sexual desire and activity morally suspicious, or at least what we have been told about the moral foulness of sex by, in particular, Immanuel Kant, but also by some of his predecessors (e.g., Augustine) and by some contemporary philosophers. A problem arises because acting on sexual desire, given this Kantian account of sex, apparently conflicts with the Categorical Imperative. I then propose a typology of possible solutions to this (...) sex problem and critically discuss recent philosophical ethics of sex that fall into the typology's various categories. (shrink)

Although they were never to meet and corresponded only briefly, Catharine Macaulay and Mary Wollstonecraft shared a mutual admiration and a strong intellectual bond. Macaulay’s work had a profound and lasting effect on Wollstonecraft, and she developed and expanded on many of Macaulay’s ideas. While she often took these in a different direction, there remains a great synergy between their ideas to the extent that we can understand Wollstonecraft’s own feminist arguments by approaching them through the frameworks and ideas that (...) Macaulay provided. These included the principles of classical republicanism, particularly in its understanding of the values of freedom, equality and virtue, and an understanding of reason as grounded in immutable principles that apply equally to both sexes. On the question of women’s freedom and social equality with men, I argue that though Macaulay sets up the problem in far richer and more detailed philosophical terms, in the end it is Wollstonecraft that has the more compelling account of its far-reaching social implications and of how this might be addressed. Despite the many differing perspectives possible regarding the concept of a property right, one central aspect is, arguably, the primal exclusionary impulse and its special connection to a particular form of subjectivity, especially in terms of how people feel about space, enclosed space and any subsequent property rules applicable. Such aspects limit speculative thought concerning the enactment of challenging housing reforms. This essay therefore asks: Why is exclusion so relevant to spatial ethics, and is it only a particular form of (...) subjectivity that is involved in the phenomena of exclusionary impulses? As a response, new speculative thoughts are proposed that aim at challenging such specialised subjectivity, exclusionary impulses and spatial engagement: re-sanctification of enclosed space, de-objectification of being and a call to develop new or alternative subjectivities and modes of somatic thought. “Is it heretical to conclude that a noble rather than a base motive lay at the core of the Jewish unwillingness to join the apostolic church?”.

A recent statement of consensus held that the principle of double effect would allow the induction of a previable fetus in order to eliminate a grave and present danger to the life of a mother suffering from peripartum cardiomyopathy. The author responds to this declaration, points out some limitations preventing it from being a vehicle for broader agreement, and offers an alternative, namely, medical induction of labor in cases of maternal–fetal vital conflict can be justified if the fetus has at (...) least a fair chance of survival. This support of induction in cases of periviability considers the interests of both fetus and mother and, unlike the earlier consensus statement, can be defended by those who hold that one’s moral intention includes both the ultimate and proximate ends, or the immediate consequences of one’s act. This paper presents an algorithm for analyzing social situations within a robot. We contribute a method that allows the robot to use information about the situation to select interactive behaviors. This work is based on interdependence theory, a social psychological theory of interaction and interpersonal situation analysis. Experiments demonstrate the utility of the information provided by the situation analysis algorithm and of the value of this method for guiding robot interaction. Mammalian cells frequently depend on homologous recombination (HR) to repair DNA damage accurately and to help rescue stalled or collapsed replication forks. The essence of HR is an exchange of nucleotides between identical or nearly identical sequences. Although HR fulfills important biological roles, recombination between inappropriate sequence partners can lead to translocations or other deleterious rearrangements and such events must be avoided. For example, the recombination machinery must follow stringent rules to preclude recombination between the many repetitive elements in a (...) mammalian genome that share significant but imperfect homology. This paper takes a conceptual approach in addressing the homology requirements for recombination in mammalian genomes as well as the general strategy used by cells to reject recombination between similar but imperfectly matched sequences. A mechanism of heteroduplex rejection that involves the unwinding of recombination intermediates that may form between mismatched sequences is discussed. This view is most vigorously articulated and defended in the course of his investigation of the problem of the self, in the section “Of personal identity.” My paper is a critical exploration of Hume's arguments for this influential thesis and an analysis of the context that informs this 1739 version of the nature of philosophical problems that anticipates the linguistic turn in philosophy. -/- .

For English-speaking readers, this book serves as an introduction to an important French intellectual whose work, especially on the issues of antisemitism and anti-Zionism, runs counter to the hostility shown toward Jews by some representatives of contemporary critical theory. It presents for the first time in English five essays by Éric Marty, previously published in France, with a new preface by the author addressed to his American readers. The focus of these essays is the debate in France and elsewhere in (...) Europe concerning the "Jew." The first essay on Jean Genet, one of postwar France’s most important literary figures, investigates the nature of Genet’s virulent antisemitism and hatred of Israel and its significance for an understanding of contemporary phenomena. The curious reappearance of St. Paul in theological and political discourse is discussed in another essay, which describes and analyses the interest that secular writers of the far left have shown in Paul’s "universalism" placed over and against Jewish or Israeli particularism. Well-stated modern political or democratic theory is rights-based. Meaningful democracy rests as a precondition on the equal rights of citizens. This idea stems from Rousseau’s distinction between a general will*one which is impersonal and tends toward equality, that is, the equal basic rights of citizens*and a transitory will of all. For instance, absent equal basic rights, one might imagine a possible world in which what I have called a self-undermining series of wills of all, or the results of socalled majority (...) rule, disenfranchises the population. In the USA, one might think, contrahistorically, of a regime in which the women, as a majority, disenfranchise the men, the Black, Latin, and Asian women disenfranchise the White women, and by a series of reductions by further ‘majorities,’ three people still have the suffrage, two of whom disenfranchise one. Based on Rousseau, John Rawls’ Theory of Justice thus emphasizes the priority of the equal liberty principle over an economic difference principle.1 The difference principle permits those inequalities which also benefit the least advantaged. But the priority of the equal liberty principle rules out any inequality, otherwise beneficial to the least advantaged, which enables the rich to control the government. This priority makes equal basic rights the inescapable precondition for any decent majority rule or distribution of income.
