This article aims to propose a critical and exploratory survey of utopian narratives published in Chile from 1829 to 1934 employing a qualitative and diachronic approach. The fundamental objective of this study is to make evident the thematic tendencies, formal recurrences, influences, and key differences in utopian works of fiction written over a century of Chilean history, connecting these with the overall development of Chilean society, in such a way as to express how the utopian narratives of this period reflect, (...) critique, or rebel against the hegemonic social projects present in the country. Last, this article also seeks to approach these works from the distinctive point of view of the field of utopian studies, thus establishing the relevance of its theoretical framework in the analysis of Chilean fiction. RESUMEN Las tensiones y los vínculos posibles entre razón y violencia son un problema mayor para la filosofía. La obra de Eric Weil se consagra precisamente al análisis de las figuras históricas de dicha tensión, y su obra mayor, Logique de la Philosophie, desarrolla lo fundamental de dicho propósito. Se analiza la manera como Weil, desde la categoría de la acción -última categoría concreta de la filosofía-, en vínculo con las categorías precedentes (absoluto, obra, finito) y con las categorías formales (...) (sentido y sabiduría), enfrenta este desafío siempre nuevo para la filosofía. ABSTRACT The tensions and potential links between reason and violence are a significant philosophical problem. Eric Weil's systematic work, as well as his numerous articles and lectures, is dedicated to the analysis of the historical figures of such tensions. His major work, Logique de la Philosophie, develops that objective. The article analyzes how Weil faces this always new challenge for philosophy, on the basis of the category of action -the last concrete category of his philosophy-, together with the preceding categories (absolute, unmediated particular, finite) and the formal categories (meaning and wisdom). A obra de Eric Weil se consagra precisamente à análise das figuras históricas dessa tensão, e sua obra maior, Logique de la Philosophie, desenvolve o fundamental desse propósito. Analisa-se a maneira como Weil, a partir da categoria da ação -última categoria concreta da filosofia-, em vínculo com as categorias precedentes (absoluto, obra, finito) e com as categorias formais (sentido e sabedoria), enfrenta esse desafio sempre novo para a filosofia. The “dynamic developmental theory” is based on hypofunctioning dopamine systems that follow an early overactivity phase. The theory does not consider recent experimental evidences from different attention-deficit/hyperactivity disorder (ADHD) models and the heterogeneity of the disorder. Alternatives are proposed that integrate available information gathered from clinical and experimental studies, with theoretical constructs.

Weil achève la présentation des reprises de l’attitude-catégorie de la Personnalité avec une thèse, à première vue, étonnante : « La personnalité est Dieu ». Cet article analyse la portée de cette affirmation et les conséquences qu’elle pourrait avoir pour la philosophie occidentale. L’analyse interroge la place de Dieu dans la raison moderne (formulée par les catégories weiliennes de la Condition, de la Conscience et de l’Intelligence), à l’origine de la réflexion qui mènera à la catégorie de l’Absolu. Elle met (...) aussi en évidence les éléments de la compréhension par Weil de certains moments fondamentaux de l’histoire de la pensée occidentale, compréhension qu’il laisse entrevoir au cours de l’analyse de cette reprise : son incidence sur le processus contemporain de sécularisation de la société occidentale ; la critique weilienne du romantisme et de l’esthétisme moderne ; la vision que porte l’auteur sur la théologie chrétienne. Este artículo trata sobre el concepto de Bildung en Hegel traducido como “formación”, buscando mostrar el carácter fundamental que tiene para él en su obra, desde los prólogos e introducciones de sus principales libros: Fenomenología del espíritu, Ciencia de la lógica y Filosofía del derecho. Se destaca a la “formación” como movimiento continuo de objetivación. Sobre esa base, se le relaciona con los otros conceptos con los que se ha identificado Bildung en idiomas como el castellano, el inglés y el (...) portugués: “educación” y “cultura”. Se expone la identidad dialéctica entre ellos y el posicionamiento de “formación” como punto de origen o general. Finalmente, se concluye sobre la relación fundamental de Bildung como “formación” con la “acción” como sustancia para la existencia universal. (shrink)

In the Platonic dialogue that bears his name, Protagoras in a myth and in a logos positively affirms the absolute character of universal moral values, such as force themselves upon all men; this makes one think that the famous man-measure dictum was subservient to the ends that the sophist had in view as a teacher of areté. Indeed, his condemnation in that dialogue of the sophists who, like Hippias, included in their teaching mathematical and naturalistic studies must be connected with (...) the criticism of mathematics reported by an Aristotelian text. These studies, that is to say purely theoretic disciplines, were considered by Protagoras not only useless for the spiritual formation of men and citizens, but also void of any certitude and objectivity whatever. We feel therefore allowed to suggest that also the man-measure principle had to perform an office of the same kind: to show that natural philosophy could not yield an objective knowledge of φύσις which formed its object, because such knowledge is denied to man. Aquest article reflexiona el model educatiu català i les implicacions del model de relacions amb la diversitat cultural a l’entorn educatiu, sobretot als àmbits de la socialització i l’ús de la llengua catalana, com a marcadors identitaris simbòlics rellevants. A més d’això, es reflexiona sobre els grups minoritaris a l’entorn educatiu català, en especial els alumnes d’origen no comunitari i d’origen gitano i les seves relacions amb la comunitat d’acollida.This article reflects on the Catalan educational model and the implications of (...) this model on the relations with the cultural diversity on the educational environment, especially on the socialisation and the use of the Catalan language, as relevant symbolic identity markers. On top of that, it reflects on the minority groups on the Catalan educational system, specially about the students of immigrant backgrounds and from Gipsy origin, and their social relations with the hostess community. Desde esa perspectiva, el presente artículo trata de ver cómo el sacrificio del corazón y la pulsión antropofágica, que identifican las grandes culturas prehispánicas de Mesoamérica, pueden ser proyectados como plano de contenido de una semiótica mixta a escala imperial. The Western Legal Tradition (WLT) is a child of the Cold War era. Originally conceived by the Harvard legal historian HJ Berman in his 1950 book on Justice in Russia, a work aimed at explaining to the West what laid beyond the Iron Curtain, this idea gives life to an account set out in an opposition in which the West and Soviet Russia are defined with the features missing to each other. In those pages is the blueprint for his two (...) well-known volumes published in 1983 and 2003, and for a third volume left unfinished. -/- The WLT grows from another legacy from the Cold War era: human rights history. While this theme entered public debate fuelled by the concern with human rights in the Eastern European countries during the Cold War era, this paper shows how the WLT absorbed this theme hijacking a core component of continental legal science (subjectives Recht) re-engineered by political theorists into the major identitary element of the WLT in an eternity history rooted in medieval canon law. Esta provocación estaría tamizada por el humor y, cabe señalar, es entendida como la intención de producir reacciones específicas en los lectores, no sólo orientadas a la risa, sino también al cuestionamiento de lo realizado en las corridas de toros de los domingos; hacer que la emoción y los comentarios de los aficionados (...) “entren en ebullición”. The aim of the present paper is to attack some of the conceptual problems that arise when the framework of mathematical learning theory is applied to the description of the behavior of the firm, in setting prices and production quotas, in a competitive market. The goal is to depict the process by which the firm fixes prices and production quotas as a stochastic learning process. A solution to such problems is proposed which is based on statistical-decision concepts. The conceptualization of (...) the behavior of the firm by means of concepts pertaining to mathematical learning theory gives rise to certain mathematical problems, which are formulated here in rather precise terms. In this study, the operational characteristics of the industrial hake fishing vessel "Santa Monica II" were characterized for the years 2020 and 2021, focusing on its catch production and fishing effort. A total of 234 trips and 1087 hauls were analyzed, considering a working depth of 100 fathoms on the continental shelf. Fishing effort was assessed based on years, seasonal periods, and months, allowing for a comparison of its productivity with 33 other vessels in the industrial fleet. The results revealed (...) that the vessel caught 18% of the total catch of the industrial fleet in 2020 and 17% in 2021. Subarea A was the most frequented in 2020, with 66 trips, while in 2021, Subarea B led with 78 trips. The Catch per Unit Effort (CPUE) was 6.24 tons per hour and 8.99 tons per haul in 2020, and increased to 8.20 tons per hour and 10.75 tons per haul in 2021, highlighting its performance. Additionally, a significant concentration of hake resources was observed in the upper part of the continental slope during the study years. (shrink)

The 1930-60s saw the beginning of a fertile stream of research based on a historical-comparative methodology focused on case-law viewed as the paradigm of the true living law. Today, the new frontier is in the information age and in thinking law as information.

What is comparative legal history? This essay argues that to understand this new field of legal-historical studies, we need first to clarify how legal historiography has changed over time. To this purpose, this essay begins from two main ideas. -/- First, the writing of legal history is deeply intertwined with an image of law that tells us what law is, how it is created and by whom. This is, in fact, the premise for writing legal history, as it determines the (...) object of investigation. Second, the decades between 1930 and 1960 saw a profound turn in European legal science. Some legal scholars challenged the legacy received from the 19th century and launched an attack on the ‘formalism’ at the heart of its intellectual framework. -/- Those path-breaking insights gave life to a wave of works self-styled as comparative legal history published in the period 1930–60. At their heart were some of the challenging ideas that have continued to fuel original legal-historical research in the last few decades (e.g. to place law in context, to think outside the doctrinal box, the dislike of abstract theorising) and which today are shared as an obvious truth. They are the fruit of the antiformalist turn of between1930 and 1960. (shrink)
