We explore the ethics of using motivational interviewing, an evidence-based, client-centred and directional counselling method, in conversations with next of kin about deceased solid organ donation. After briefly introducing MI and providing some context around organ transplantation and next of kin consent, we describe how MI might be implemented in this setting, with the hypothesis that MI has the potential to bring about a modest yet significant increase in next of kin consent rates. We subsequently consider the objection that using (...) MI in this context would be manipulative. Although we cannot guarantee that MI would never be used in a problematically manipulative fashion, we conclude that its use would, nevertheless, be permissible as a potential means to increase next of kin consent to deceased solid organ donation. We propose that MI be trialled in consent situations with next of kin in nations where there is widespread public support for organ donation. (shrink)

The Qur’an contains many miracle stories, from Moses’s staff turning into a serpent to Mary’s conceiving Jesus as a virgin. In _Understanding the Qur’anic Miracle Stories in the Modern Age_, Isra Yazicioglu offers a glimpse of the ways in which meaningful implications have been drawn from these apparently strange narratives, both in the premodern and modern era. It fleshes out a fascinating medieval Muslim debate over miracles and connects its insights with early and late modern turning points in Western thought (...) and with contemporary Qur’anic interpretation. Building on an apparent tension within the Qur’an and analyzing crucial cases of classical and modern Muslim engagement with these miracle stories, this book illustrates how an apparent site of conflict between faith and reason, or revelation and science, can become a site of fruitful exchange. This book is a distinctive contribution to a new trend in Qur’anic Studies: it reveals the presence of insightful Qur’anic interpretation outside of the traditional line-by-line commentary genre, engaging with the works of Ghazali, Ibn Rushd, and Said Nursi. Moreover, focused as it is on the case of miracle stories, the book also goes beyond these specific passages to reflect more broadly on the issue of Qur’anic hermeneutics. In ‘Treating Adolescents Differently’, Skelton, Black, and Forsberg develop their wellbeing-based justification of the asymmetrical treatment of adolescent consent and refusal in the context of health care to justify the differential and paternalistic treatment of adolescents more generally. The core of the Skelton, Black, and Forsberg’s view is a variabilist theory of what is fundamentally and non-instrumentally prudentially good for adolescents, which includes the prudential value of what they call shielding—or the value of being insulated from full responsibility for their (...) choices. This theory of wellbeing, they argue, explains why adolescents may be treated differential and paternalistically in numerous domains. It is good for them to be shielded because it allows for a variety of freedom from making certain kinds of decisions in the absence of a safety net provided by others in supportive and caring relationships. Skelton, Black, and Forsberg argue that their account of the justification of differential and paternalistic treatment of adolescents has attractive implications for a range of cases and holds up well in the face of philosophical criticism. Some form of assisted dying (voluntary euthanasia and/or assisted suicide) is lawful in the Netherlands, Belgium, Oregon, and Switzerland. In order to be lawful in these jurisdictions, a valid request must precede the provision of assistance to die. Non-adherence to the criteria for valid requests for assisted dying may be a trigger for civil and/or criminal liability, as well as disciplinary sanctions where the assistor is a medical professional. In this article, we review the criteria and evidence in respect of (...) requests for assisted dying in the Netherlands, Belgium, Oregon, and Switzerland, with the aim of establishing whether individuals who receive assisted dying do so on the basis of valid requests. We conclude that the evidence suggests that individuals who receive assisted dying in the four jurisdictions examined do so on the basis of valid requests and third parties who assist death do not act unlawfully. However, further research on the elements that may undermine the validity of requests for assisted dying is warranted. More research on the reasons why requests for assisted dying are refused is also desirable. (shrink)

The Israeli approach to advertising consists of two complementary sets of norms, legal norms and moral‐ethical norms. Advertising legislation demands honest disclosure. The Israeli legislator refrains from intervening in fundamental rights such as freedom of expression, free trade, occupation, and liberty of contract in advertising. However, there are also few interventions to prevent phenomena that are dangerous or abusive, especially to groups needing protection. The Israeli courts do try to apply moral considerations in cases tried by them, (...) but living up to moral responsibilities is different from complying with legal obligations. Advertisers in Israel have a(i) Treatise(r), consisting of ten ethical guidelines, which neither sums up advertising ethics in its entirety nor is legally binding. Sociological and psychological features of the culture need to be examined in order to spell out what truth and honesty in advertising actually mean in this society, and the manner in which these values are practised. Lacking sanctions in public law against misleading consumers or manipulation based on false facts, consumers must find remedy in civil actions which rely on moral and ethical rules. (shrink)

Background/IntroductionInfertile couples that travel to another country for reproductive treatment do not refer to themselves as “reproductive tourists”. They might even be offended by this term. “Tourism” is a metaphor with hidden connotations. We will analyze these connotations in public media discourses on “reproductive tourism” in Israel and Germany. We chose to focus on these two countries since legal, ethical and religious restrictions give couples a similar motivation to travel for reproductive care, while the cultural backgrounds and conceptions of reproduction (...) are different. Results: Our research shows that the use of the metaphor “reproductive treatment” and its hidden messages depends on the writers’ intention and the target population. Although the phenomenon of patients travelling for reproductive treatment can fit into the definitions of tourism, the term emphasizes aspects that do not reflect patients’ reality. In both the German and the Israeli public media debate the term “reproductive tourism” is either used to criticize the economic aspects of the phenomenon or to attract patients as potential clients. Conclusions: Ethicists should be cautious when borrowing metaphors like “reproductive tourism” from the public debate. Our findings support Penning’s suggestion to use instead an unloaded term like cross-border reproductive care to describe the phenomenon in a more neutral way and to make it explicit whenever criticism is necessary. The practitioner of the shamanic system among the Bugis-Makassar people in Indonesia is known as dukun or sanro, a person believed has a supranatural power, using their power either to help others or bringing harm, such as disease”. This is an interpretative-descriptive anthropological research. We made observations by directly observing, listening, and recording events related to the problem. We also conducted in-depth interviews with dukun and customers using interview guides and other tools such as recorders. We found that there are (...) several types and characteristics of dukun in Makassar, such as dukun penolong (helpers), traditional healers, and dukun using black magic. In Bugis-Makassar social structure, dukun does not have a clear position even with some of the stigma. However, dukun nowadays is becoming more open and increasingly strengthening their position in society, especially in the political arena. Dukun, along with several people believing them cannot be assessed from the rational point of view since they have their own reasoning and logic (rationality behind irrationality). They still function in the socio-political life of Indonesian society. The mysticism practiced by politicians in Indonesia, especially in Makassar, is shown when politicians such as several regional head candidates used the services of dukun to boost their success in winning the regional election. For example, dukun can help candidates to create an aura of authority, protect the candidates from black magic, create illusions to the voters, influence the voters, and other supranatural things. The customers, such as politicians, tend to have their own motivation based on rationality when deciding to have a relationship with a dukun. Motivation for seeking spiritual and political supports by utilizing the network of dukun for political purposes has a reciprocal effect which benefits both parties. (shrink)

Adolescents are routinely treated differently to adults, even when they possess similar capacities. In this article, we explore the justification for one case of differential treatment of adolescents. We attempt to make philosophical sense of the concurrent consents doctrine in law: adolescents found to have decision-making capacity have the power to consent to—and thereby, all else being equal, permit—their own medical treatment, but they lack the power always to refuse treatment and so render it impermissible. Other parties, that is, individuals (...) who exercise parental responsibility or a court, retain the authority to consent on an adolescent’s behalf. We explore four defences of the doctrine. We reject two attempts to defend the asymmetry in the power to consent to and refuse medical treatment by reference to transitional paternalism. We then consider and reject a stage of life justification. Finally, we articulate a justification based on the distinctiveness of adolescent well-being. (shrink)

Following Oliver Ramsbotham’s observation that conflict resolution and analysis have not taken radical disagreement seriously enough, and in light of his lament that he has not yet found an adequate philosophy of radical disagreement, this article claims that the philosophy of Alasdair MacIntyre provides some coreelements of any adequate philosophy of radical disagreement. MacIntyre’s theory suggests that the problem of radical disagreement is in fact more radical thanRamsbotham affirms. Ramsbotham’s account of the strategic engagement of discourses (SED) approach is critiqued (...) in light of MacIntyre’s diagnosis of radical disagreement, which calls into question its theoretical and philosophical basis. The main problem is held to be that of internal radical disagreement, which SED appears to skirt over. This is elucidated through a brief exploration of two philosophical approaches to moral-political disagreement in relation to Israeli peace activism and the Colombian conflict. (shrink)

Although he was born in Gaza, Palestine, Elias Rashmawi was issued a permanent deportation order by the Israeli High Court because of his involvement in Palestinian organizing while a student in the United States. In November 2000, as the Second Intifada raged on, Rashmawi’s father passed away, and he was granted a limited permit to his homeland to attend the funeral. “How many fathers must die before we are all allowed to return,” he asks in this essay that reifies (...) the brevity and pain of his truncated visit. A concept of co-evolution is argued to complement Integrated Water Resource Management's gap in administrative integration. Co-evolution's complement to Integrated Water Resource Management is explored through issues surrounding joint water management arrangements between the Israelis and Palestinians in the late 1990s and early 21st century. How co-evolution contributes to such a water management approach highlights how we might think about what it means to encourage innovation. Conclusions of the article suggest co-evolution provides the language and description for the changing interactions (...) and political environment and therefore provides a sharper conceptualization for administrative integration. Employee mobility is a phenomenon that challenges workplace ethics. This paper argues that despite on‐going attempts by management and consultants to build and install employee loyalty, and despite the complexity of relationships between employees and their organization, employee mobility remains a common phenomenon in today’s market. Courts, at least Israeli courts, perceive the employee–employer relationship as almost purely contractual and thus strive to protect workers first, often ignoring deeper commitments such as loyalty. In the Qur'an, there are many verses that positively point to the value of man, as well as verses that touch on his mistakes, sins and flaws. In these verses, the value of man is not absolutely attributed to greatness, nor is it definitely characterized by evil. It can be said that the Qur'an measures the value of human beings through their beliefs and behaviors in general. Despite this general attitude of the Qur'an, the discourse of "ashref-i mahlûkat/the most honorable (...) creature" used for people in Muslim culture is a very assertive expression. According to our observations this expression, which is famous in the religious tradition, is generally associated with the seventieth verse of Isra Surah. However, there is no evidence in the aforementioned verse to support this statement in all its aspects. In the verse, it is said that man is not superior to all beings, but to some beings. Despite this, the proof of the statement that "man is the most valuable being" with this verse leads to the mistake of attributing a meaning that the verse does not say to it, even if it is not intentional. In this study, the authenticity of the expression "ashref-i mahlûkat" will be the subject of examination in the context of al-Isra 17/70, which is cited as evidence for this statement. (shrink)

This article assesses the importance of the biblical book of Daniel in the first four Islamic centuries, focusing in particular on the legendary materials contained in Daniel 1–6. The article is divided into three sections. In the first section the treatments of Daniel 1–6 in Isrāʾīliyyāt works are examined, and it is shown that summaries of Daniel 1–6 in these works display evidence of oral transmission. Additionally, it is shown that some authors’ familiarity with Daniel legends led them to insert (...) this character into “biblical” narratives that do not otherwise relate to him. In the second section it is argued that Daniel’s exploits were so widely known that they served as a sort of yardstick for judging the relative importance of some other “heroic” figures who are described in classical Islamic sources. In the third section it is postulated that the introductory sections of Ibn Hishām’s Sīra consciously relate stories with Danielic associations in order to bring the Sīra into line with the Christian Gospels. Basic human rights are supposed to protect people from abuse and harm. They are the means whereby we protect our humanity. One would expect, therefore, that basic human rights would be valid and sacred in any context, including industrial relations. However, the complexity of the employee–employer relationship obscures this issue, and it is not clear whether such rights can be protected or whether they are valid in the context of industrial relations. Since rights are relational, they are preconditioned on the (...) special nature of the relationship between employee and employer. Hence, the specific meaning that these rights have in industrial relations cannot be grounded in the notion of human rights as such, but rather depends on the special relationships between employers and employees. Though much legislation has been passed to regulate the relationship between employees and employers, the issues surrounding this relationship remain one of the most debated topics in business ethics. Our paper focuses specifically on the right to equal pay and the right to privacy. With respect to the right to property, the paper examines whether there is a conflict between general human rights and the fundamental right of employers to their property. The Israeli legislature has responded to this conflict by enacting ‘protective laws’ that legally outline and mandate certain human rights. Under these laws, employees are prevented and prohibited from waiving the rights granted to them by law, even if employed in private industries. Despite this legislative effort, market forces are at times stronger, and consequently some basic rights are not fully applied or implemented. (shrink)

This paper depicts the meanings of human dignity as they unfold and evolve in the Bible and the "Halakhah". I posit that three distinct features of a Jewish conception of human dignity can be identified in contrast to core characteristics of a liberal conception of human dignity. First, the original source of human dignity is not intrinsic to the human being but extrinsic, namely in God. Second, it is argued that the "dignity of the people" has precedence over personal autonomy (...) and liberty, which are core liberal pillars. The third characteristic pertains to the potential conflict between personal autonomy and liberty, and God's commandments. The theoretical analysis of human dignity is then examined in light of several Supreme Court decisions in Israel during the 1990s. I illustrate that Jewish religious and secular-liberal conceptions pull in different directions in the rulings of liberal and religious Justices in Israel. (shrink)

Silvius: It is to be all made of sighs and tears...—Shakespeare, As You Like It (5.2.83–84)ISighs and tears permeate John Donne's poetry, as well they should. Crying in particular functions as a costly signal in biological terms: a blatant, physiologically-demanding, involuntary indicator of hurt feelings. "Tears dim mine eyes," (...) laments Donne's Sappho ("Sappho to Philaenis," l. 56); they are "Fruits of much grief" in "A Valediction of Weeping" (l. 7).1 The theory of costly signaling, related to the handicap principle, was developed fairly recently by Israeli zoologists Amotz and Avishag Zahavi. As the Zahavis explain: "in order to be effective, signals have to be reliable; in order to be reliable, signals have to be costly."2 Initially their idea was resisted, but it has since become widely accepted and it has proven very helpful in making sense of both animal and human behavior. Wasteful conspicuous consumption among upper-class Americans, as noted a century ago by sociologist Thorstein Veblen, exemplifies this handicap principle in action. Like gazelles jumping in place or stotting rather than running away when wolves appear, it indicates fitness by flaunting excess resources.Shedding tears when feeling sad is an evolved human adaptation that broadcasts unhappiness. The wailing of infants demands attention, and crying does something similar for grown-ups: among other things, it tests the commitment of hearers to appease the distressed. For instance, in Chaucer's tragic medieval romance Troilus and Criseyde, Pandarus advises [End Page 329] Troilus to provoke a suitable reaction from Criseyde by embellishing his billet-doux: "Towchyng thi lettre... Biblotte it with thi teris ek a lite" (touching thy letter... Be-blot it with thy tears a little).3 Early modern authors also knew their importance. In the words of Robert Herrick, "tears are tongues," while Claudius suspects that "There's matter in these sighs, these profound heaves" (Hamlet, 4.1.1).4As a case in point, Donne was overwhelmed by the death of his dear wife Anne in 1617. As his contemporaneous biographer Izaak Walton reported: "his very soul was elemented of nothing but sadness; now, grief took so full a possession of his heart, as to leave no place for joy."5 Donne even hoped to be literally entombed with her soon: "as the grave is become her house, so I would hasten to make it mine also; that we two might there make our beds together in the dark" (Walton, p. 51). This essay expounds on Raphael Cohen-Almagor’s recent book, Confronting the Internet’s Dark Side, Moral and Social Responsibility on the Free Highway, and advocates placing narrow limitations on hate speech posted to social media websites. The Internet is a limitless platform for information and data sharing. It is, in addition, however, a low-cost, high-speed dissemination mechanism that facilitates the spreading of hate speech including violent and virtual threats. Indictment and prosecution for social media posts that transgress from opinion to inciteful hate (...) speech are appropriate in limited circumstances. This article uses various real-world examples to explore when limitations on Internet-based hate speech are appropriate. In October 2015, twenty thousand Israelis joined a civil lawsuit filed against Facebook in the Supreme Court for the State of New York. Led by the civil rights organization, Shurat HaDin, the suit alleges Facebook allows Palestinian extremists to openly recruit and train terrorists to plan violent attacks calling for the murder of Israeli Jews through their Facebook pages. The suit raises important questions, amongst them: When should the government initiate similar suits to impose criminal sanctions for targeted hate speech posted to Facebook? What constitute effective restrictions on social media that also balance society’s need for robust dialogue and free communication, subject to limitations reflecting a need for order and respect among people? Our essay progresses in four stages. First, we examine philosophical origins of free speech and the historical foundations of free speech in the United States. Second, we provide an overview of American free speech jurisprudence. Third, we address particular jurisprudence that provides a framework for imposing limitations on free speech in the context of social media. American history and jurisprudence embrace free speech as a grounding principle of democracy, yet simultaneously subject speech to limitations. Finally, through a comparative exploration of real-world examples, we address the narrow instance when limitations on inciteful and targeted hate speech are appropriate. (shrink)

This paper addresses the implementation of semantic markedness as a subtle tool of ideology in U.S. mainstream newspapers The New York Times, Washington Post, and The Wall Street Journal in the context of the Israeli raids on Nablus between 2022–2023. Existing research on this topic suggests that international media associate lexemes connoting negative images with Palestinians as a part of its control over the worldview of the Israeli occupation of Palestine. Previous research also touches upon semantic markedness as (...) a tool that indicates gender-based discrimination against women. However, there is no critical scholarship directed towards the use of semantic markedness in media discourse and critical discourse analysis (CDA). This paper adheres to Jakobson and Lyon’s (1971; 1997) definitions of markedness and builds on discussion of semantic discourse and political ideology, respectively, as its framework. Using Halliday’s transitivity and semantic markedness as a tool of analysis, the findings of the paper reveal that the selected newspapers employ semantically marked lexemes to portray Palestinian resistance as disorganised militant units and hence justify the mass murder of Palestinians. This essay argues that schooling in Israel is tied too closely to ideology. This results in an indoctrinary orientation that contributes to divisiveness and imperils Israeli democracy. After reviewing and critiquing the roots of this orientation, I advance an alternative that understands education as an agent of the good rather than ideology. Israeli schooling requires a vision of goodness broad enough to encompass competing conceptions of Jewish life espoused by the majority as well as non-Jewish orientations affirmed by (...) various minorities. Such a vision can be grounded, I contend, in a democratic Jewish theology that emphasizes God as teacher rather than tyrant. (shrink)

The Israeli law of abortions (1977) legally authorises hospital committees to decide upon women's requests for selective abortion. One of the law's clauses determines that abortions can be approved in cases of an embryopathy. However, the law does not provide any clear definitions of those fetal ‘physical or mental defects’ in terms of severity and/or likelihood, which remain open to interpretation by the committee members. This paper aimed to determine which ethical methodologies are used by committee members and advisors (...) as they face the dilemma of abortion approval due to mild to moderate possible embryopathy. Twenty interviews demonstrated that they use mainly a combination of deontology and a contextual–relational model. Their ethical considerations are both contextual such as the family's/woman's relational network and are influenced by the ethical principles of autonomy and in cases of late abortions the value of life. The findings reveal a paradoxical picture: on the one hand, committee members hold liberal perceptions and in practice abortion requests are very seldom rejected. On the other hand, the Israeli abortion law and practice of abortion committees is still problematical from liberal and feminist rights perspectives. This paradox is discussed further by reflecting upon the relevant theory as well as the Israeli context. The paper concludes by suggesting that within the specific Israeli sociopolitical climate the requirement for committee approval of what should be a private decision might be necessary in order to placate religious or other opposition to abortion. Objectives—During recent decades, rabbis in Israel have been playing an increasing role in the consultation of patients or their families on medical issues. The study was performed to determine the attitude of physicians to rabbinical consultation by parents of sick children for purposes of basic medical decision making.Design and setting–A questionnaire was prepared which contained questions regarding physicians' reactions to specific medical situations as well as their demographic data. The study participants included all the available physicians who were employed in (...) the study period at one tertiary medical centre in Israel, which is not associated with any religious organisation. The questionnaire was presented personally to all of the physicians who were available for the study.Results–Between 63% and 77% of the respondents were accepting of rabbinical consultation in regard to medical decisions. Nevertheless, in cases of divergence from accepted medical practice and in emergencies, almost all stated they would take measures to resist the rabbi's advice. This attitude did not correlate with the physician's age, religious status or experience in medicine.Conclusions–Israeli physicians respect rabbis' suggestions in the area of medical decision making, though they would not let a rabbi's advice interfere with their decisions if they believed the rabbi's opinion went against medical need. In order to prevent an untoward effect of the rabbinical involvement in medicine, rules should be set to establish norms for rabbi-physician collaboration. (shrink)

In the past 3 years, three landmark laws relating to bioethics have been passed in the Israeli parliament. These are the Terminally Ill Patient Law (in 2005) and the Organ Donation Law and the Brain Death/Respiratory Law (in 2008). To reach consensus on these difficult issues in a multicultural society such as Israel was not an easy undertaking. Using learning from previous failed attempts, compromise, dialogue and work done in the absence of hysteria and publicity were crucial to the (...) process. In all three laws, compromises were obtained between the secular and religious factions, from which an acceptable law was developed. The Israeli experience is a model of a country working to synthesise an ancient tradition with the complexities of modern life and could serve as an example for other countries struggling with similar issues. A content analysis of 1,785 American ads and 1,467 Israeli ads maps the representation of violence in mainstream TV advertising in the two countries, finding violence present in 2.5% of the American commercials and in 1.5% of the Israeli commercials. The most frequently depicted conduct in the two countries is bare-handed assault. Sexual violence is not presented at all. A humorous mode of presentation is more frequent than a serious tone. On August 8, 2003, the Boston Globe reported that the German publisher of After the Terror had “halted printing…because of recent statements by the…author supporting Palestinian violence.” The charge appears to be true. On p. 151 Honderich writes: “Palestinians have exercised a moral right in their terrorism against the Israelis.” Even if he is correct in this assessment, he devoted only half a page to explaining a judgment that has provoked volumes from others. If anything in this book can be (...) said to be provocative verging on the irresponsible, I think it is this judgment. (shrink)
