The author studies with the problems of formation of the tenancy institution, the social composition and land tenure by the tenants. The obligations, share and territorial location of the peasants - tenants in the Southern Urals are analyzed. Complicated land relations between the tenants and Bashkir’s are revealed. The results of the undertakings by the government in land relations rights regulation of Bashkir’s and their tenants are analyzed. The purposes, the main content of the decrees of (...) 1830-1850s on land arrangement of the tenants are distinguished. It is emphasized that the activity of Russian authorities on land tenure had not liquidated the uncertainty of land relations between Bashkir’s and their tenants. (shrink)

Under a policy first enacted in 1988 and expanded in 1996, federally funded public housing authorities (“PHAs”) and private landlords renting their properties to tenants receiving federal housing assistance have been required to include a provision in all leases under which drug-related criminal activity as well as criminal activity that in any way poses a threat to other tenants or nearby residents constitutes ground for initiating eviction proceedings. This strict liability eviction policy, which has become known as the (...) “One-Strike Rule,” was part of a broader congressional effort to combat the “reign of terror” that Congress believed drug dealers were imposing on public housing and assisted housing tenants. Like many of the crime-related policies enacted in the 1980s and 1990s, the One-Strike Rule has done little to reduce crime rates, but has been wildly successful in ensuring that the situation of poor households receiving federal assistance remains highly precarious. Calls for reform of the One-Strike Rule are almost as old as the policy itself, but given the political outlook of the current administration, the prospects for reform at the federal level are dim. While federal law and a combination of gridlock and unwillingness in the congressional and executive branches foreclose a range of possible strategies for reform, there is nonetheless room to mitigate the socially corrosive effects of the One-Strike Rule through legislative efforts at the state and local level. Courts in various jurisdictions have upheld state laws that protect vulnerable tenants despite the federal strict liability policy, and these holdings help to provide a framework for how state and local governments seeking to protect tenants can do so without their efforts necessarily falling prey to the Supremacy Clause. This article describes that framework and proposes three concrete measures that fit it. The article is structured as follows: after explaining the One-Strike Rule and the threat it poses to vulnerable tenants (Section II), the article discusses the burden the Rule imposes on tenants and the benefits it is supposed to bring to other parties, and argues that the resulting distribution of burdens and benefits is unjust (Section III). The article then lays out three concrete measures that state and local governments can enact to protect tenants who face eviction for criminal activity under the Rule without falling prey to a federal preemption challenge: requiring “good cause” for eviction, giving tenants the right to cure a breach of their lease, and providing tenants with free counsel in landlord-tenant court (Section IV). When considering metalanguage activity, the fact of "reported discourse" is encompassed within the broader field of "representation of other discourse", in which the discourse in progress represents another discourse. While the relationship thus established is traditionally considered at the level of statements, through the realizations of the various modes of representation of the other discourse (direct discourse, indirect discourse, bivocal discourse, autonymic borrowing modalization, second assertion modalization), this article proposes to examine the articulation between a representing unit and a represented (...) unit at the level of the text. It shows how the representation of the other discourse can appear as a primary defining criterion for a variety of discourse genres (summary, press review, pastiche...) thus brought together in a generic space. Finally, he sets out to delimit a specific zone within this space, bringing together genres in which the representing discourse has the property of substituting or "taking the place of" the represented discourse, provided it obeys social and institutional prescriptions, such as the genres of the "minutes" or the "report of meeting". This article examines the process for the eviction of tenants, which offers landlords a swift path for obtaining an eviction order against their tenants, as a case study exposing the politics of procedure. It shows that the PET is but one stage in a longstanding battle waged between two interest groups—landlords and tenants—involving both substantive law and procedural law. But while the story of their conflict over substantive law, fought in the parliament through the regular legislative process, (...) is well-known, the story of the procedural amendments, despite their immense impact, remains shrouded in mystery and is told here for the first time. The reason for that, we argue, is that despite the vast impact of procedure on substantive right, many in the Israeli legal system mistakenly view civil procedure rules as highly technical and neutral directives for the day-to-day operation of the litigation process. The conclusion from such a view is that rulemaking should be left to expert legal technicians and court administrators and that transparency mechanisms or public participation are to be avoided as unnecessary due to the costs and burdens they impose on the rulemaking process. The article concludes with a call for overhauling the rulemaking process in Israel. We argue that the secretive and opaque process is anathema to democracy. Bearing in mind that procedural rules are inevitably imbued with substantive values and have an enormous effect on the substantive rights of the citizenry, the rulemaking process should be radically altered to enable all interested parties to take part in the process, making it far more transparent and subject to public scrutiny in all its stages. We are interested in the study of tweets from trial hearings (LTAP) which is a new digital form of the online journalistic genre: a cross over between judicial chronicles and reports. Supported by new technologies, LTAP serves as an intermediary between judiciary and general public. The LTAP falls into a generic subset of discourse which could be called a “discourse substitute”, since it's a discourse representing another discourse. Therefore, LTAP is thus constitutively a part of the representation of the other (...) discourse. Our goal is to characterize LTAP as a genre that "takes the place of" another discourse, while trying to grasp its specificity compared to other genres in this category. (shrink)

This note analyses the decision of the House of Lords in Fitzpatrick, which held that gay partners could fall within the legal definition of ‘family’ for some purposes. The note argues that despite the real (if overstated) benefits that this case bestows on gay partners in the form of legal rights, under analysis, the decision self-deconstructs to reveal that it is grounded on the principle of discrimination on the basis of sexuality. However, it is also suggested that the encounter between (...) discursive legal reasoning (underpinned by normative heterosexuality), and aversion of the family which is ‘other’ to this discourse, is one which leaves its mark on law, as the potential undermining or deconstruction of law’s normative assumptions. The note further argues that although this decision is properly seen as a moment in the struggle for gay rights, it also serves as a reminder that the fortunes of critical theories and political movements that seek to challenge the legal paradigm of the white, heterosexual male are inextricably linked. Fitzpatrick, whatever else it is, is also an object lesson in the debt that current campaigns for gay legal rights owe to feminist critiques of, and campaigns that have successfully challenged, the role of this norm in legal discourse. Firms’ real estate choices significantly affect their sustainability, due to real estate’s impact on the natural environment. This paper investigates the ecological responsiveness of firms in specific industries by analyzing the decisions these firms make in occupying office space. We analyze the decisions of more than 11,000 tenants to choose office space in green buildings or in, otherwise comparable, conventional buildings nearby. Controlling for building quality and location, we find that corporations in the oil and banking industries, as well (...) as non-profit organizations, are among the most prominent green tenants. Furthermore, measures of an industry’s human capital intensity are positively related to the propensity to lease green office space. These empirical findings confirm the theoretical framework on economic advantage and institutional pressure as important determinants for the ecological responsiveness of firms. (shrink)

Les tenants de la philosophie de Leibniz et de Wolff, dont les principaux représentants se regroupèrent au sein de la revue d’Eberhard, le Magazine philosophique, opposèrent à la Critique une position « dogmatique ». Que signifie, à l’époque de Kant, cet adjectif? Tel est l’objet de cet article qui s’attache à reconstituer la nature des arguments de ce qu’il est convenu d’appeler le « leibnizo-wolffianisme »; ce faisant, nous montrerons que le dogmatisme, que stigmatise Kant, non seulement n’existe plus (...) à son époque mais encore que ces adversaires « dogmatiques » sont plus proches de Hume que ne l’était la Critique. Lorsque paraît la Critique, le « Dieu des philosophes et des savants » est mort; défunte l’idée d’une adéquation totale de nos concepts au réel. Cette étude d’une des réceptions immédiates de la Critique nous permettra de questionner, en retour, les lectures plus tardives ( XXe siècle) de Kant qui, toutes, valorisent, dans la Critique, sa réfutation du dogmatisme et sa dénonciation de la structure ontothéologique de la métaphysique. Tenant compte du contexte postcolonial et du développement de ce qu’il est convenu d’appeler la « littérature-monde », l’article propose de procéder à la généalogie de l’idée de « littérature européenne » et d’en interroger la pertinence au regard des littératures « nationales » aussi bien que de la littérature « mondiale ».

This paper provides an analysis of U.S. farmland owners, operators, and workers by race, ethnicity, and gender. We first review the intersection between racialized and gendered capitalism and farmland ownership and farming in the United States. Then we analyze data from the 2014 Tenure and Ownership Agricultural Land survey, the 2012 Census of Agriculture, and the 2013–2014 National Agricultural Worker Survey to demonstrate that significant nation-wide disparities in farming by race, ethnicity and gender persist in the U.S. In 2012–2014, White (...) people owned 98% and operated 94% of all farmland. They generated 98% of all farm-related income from land ownership and 97% of income from farm owner-operatorship. Meanwhile, People of Color farmers were more likely to be tenants rather than owners, owned less land, and generated less farm-related wealth per person than their White counterparts. Hispanic farmers were also disproportionately farm laborers. In addition to racial and ethnic disparities, there were disparities by gender. About 63% of non-operating landowners, 86% of farm operators, and 87% of tenant farmers were male, and female farmers tended to generate less income per farmer than men. This data provides evidence of ongoing racial, ethnic and gender disparities in agriculture in the United States. We conclude with a call to address the structural drivers of the disparities and with recommendations for better data collection. (shrink)

Primo, ce que requiert le maximin intergénérationnel ne se confond-il pas avec l’interdiction de la désépargne posée par une conception commutative de la justice comme réciprocité indirecte? Secundo, ne sommes-nous contraints de prendre au sérieux, plus qu’ailleurs, les préoccupations aggrégatives des utilitaristes afin d’éviter une « stagnation éternelle dans la misère » et ainsi de renoncer au maximin? Tertio, n’est-ce pas un contexte où égalitarisme et (...) maximin ne diffèrent pas dans leurs conséquences pratiques? L’A. répond par la négative aux trois questions. Marquée à juste titre par le mouvement des Annales, l’historiographie française a intériorisé lidée qu’avant 1929 dominait ce que Henri Berr avait stigmatisé sous le nom d’ « histoire traditionnelle » : une histoire politique et individualiste ne tenant pas compte des déterminations collectives, sociales ou mentales. La fameuse Introduction aux études historiques de Langlois et Seignobos (1898) serait l’expression de ce «positivisme» qu’aurait initié Gabriel Monod, fondateur de la Revue historique en 1876. Cette vision traditionnelle de l’histoire de la (...) discipline est globalement remise en cause dans cet article qui montre que les années 1870-1930 sont au contraire un moment central dans l’historiographie tant au plan institutionnel qu’au plan intellectuel, qui nous intéresse surtout ici. C’est en effet dès cette époque que s’est cristallisée laspiration à faire de l’histoire une science sociale, ce qui se comprend aisément dès lors qu’on contextualise cette histoire et que l’on replace cette discipline dans l’ensemble du champ des sciences sociales. Les années 1890–1914 voient même se développer fortement une histoire économique et une histoire sociale. 1929 apparaît alors moins comme une révolution que comme une accélération dans une direction déjà marquée. What is law? The usual answer is that the law is a system of norms. But this answer gives us at best half of the story. The law is a way of relating to one another. We do not do this as lovers or friends and not as people who are interested in obtaining guidance from moral insight. In a legal context, we are cast as 'character masks', for example, as 'buyer' and 'seller' or 'landlord' and 'tenant'. We expect to (...) have our claims respected simply because the law has given us rights. We do not want to give any other reason for our behavior than the fact that we have a legal right. Backing rights up with coercive threats indicates that we are willing to accept legal obligations unwillingly. This book offers a conceptual reconstruction of the legal relation on the basis of a critique of legal positivism. (shrink)

This paper begins with a Davidsonian puzzle in the epistemology of perception and introduces two solutions to that puzzle: the Truth-Maker View (TMV) and the Content Model. The paper goes on to elaborate (TMV), elements of which can be found in the work of Kalderon (2011) and Brewer (2011). The central tenant of (TMV) is the claim that one's reason for one's perceptual belief should, in all cases, be identified with some item one perceives which makes the proposition believed true. (...) I defend an argument against (TMV) which appeals to (a) the claim that the reason for which one believes should always to be identified with the explanans of the rationalising explanation to which one's belief is subject and (b) the claim that the explanantia of rationalising explanations must be identified with truths. This paper presents Michael Heller’s notion of “philosophy in science” and re-introduces Michael Heller’s classical text that first presented this concept of philosophy entitled How is “philosophy in science” possible?. The paper discusses the historical context of Heller’s idea as it emerged from the discussions and works of the Krakow philosophical scene and discusses the basic tenants of this philosophy, its analytic character, the role of intellectual tradition in the development of this philosophy, and the critical role played by (...) an interdisciplinary dialogue between philosophy, science, and theology. Despite the idea of philosophy in science having emerged about 40 years ago, this concept still inspires and fuels innovative research. The central topic for this book is the ethics of treating individuals as though they are members of groups. The book raises many interesting questions, including: Why do we feel so much more strongly about discrimination on certain grounds – e.g. of race and sex - than discrimination on other grounds? Are we right to think that discrimination based on these characteristics is especially invidious? What should we think about ‘rational discrimination’ – ‘discrimination’ which is based on sound statistics? To (...) take just one of dozens of examples from the book. Suppose a landlord turns away a prospective tenant, because this prospective tenant is of a particular ethnicity – arguing that statistics show that one in four of this group have been shown in the past to default on their rent. That seems clearly unfair to people of this ethnicity. But we are routinely being judged in this way – not just on the basis of our ethnicity, but assumptions are made about us and decisions taken about us based on our gender, religion, job, post-code, hobbies, blood-group, nationality, etc. Now suppose that another landlord turns away a convicted criminal, arguing that one in four of convicted criminals have been shown to be unreliable rent payers. Is our intuition the same as before? Should it be? This book is suitable for all students of philosophy, especially those with an interest in applied ethics. (shrink)

Dans le contexte de la pandémie de COVID-19, les pratiques décisionnelles liées à la répartition des ressources médicales et au traitement des personnes âgées nous renseignent sur les éthiques présentes en milieu de soin et au niveau sociétal. La comparaison entre la prise de décision dans le contexte quotidien et les particularités d’une éthique de pandémie met en lumière les tenants du passage entre une éthique hors pandémie et une « pandéthique ». L’approche éthique de santé publique, notamment utilitariste, (...) a été mise de l’avant d’une manière prépondérante dans les débats et dilemmes éthiques entourant l’allocation des ressources et la priorisation. En soulevant les oppositions et enjeux associés aux discours et aux choix du rationnement en fonction de l’âge émerge la question du traitement des personnes âgées en contexte de COVID-19, et de l’âgisme vécu dans ce contexte. En parallèle, les décisions et choix éthiques difficiles s’entremêlent au duty to care du soignant, et par conséquent à la possibilité de blessure morale. Un conflit émerge entre les pratiques éthiques décisionnelles et les valeurs personnelles ou professionnelles du soignant, alors que l’équilibre entre ses divers devoirs est bouleversé. Des approches et éthiques alternatives sont ainsi mises de l’avant à la lumière des situations vécues, notamment en contexte de soin de longue durée. La thèse développée vise à soutenir la valeur ajoutée de l’anthropologie aux processus décisionnels et son intégration plus formelle aux approches bien connues en bioéthique. À partir du regard anthropologique, nous ouvrons en conclusion sur des pistes de réflexion associées aux éthiques de la discussion, de la vulnérabilité, féministes, ou encore du care comme d’autres manières d’aborder la prise de décision en contexte de pandémie, à un moment où la réflexion éthique et sociale s’impose comme capitale. Community standards, ethical norms, and perceptions of fairness often serve as constraints on pure profit maximizing behavior. Consider the following examples: Most hardware stores refrain from raising prices on snow shovels after a major snow storm, even where short term profits might be increased. Most employers do not lower wages for existing employees, even as unemployment in the area increases. Automobile dealerships rarely raise sticker prices to cope with the long waiting periods for a popular model. Each of these anomalies (...) is consistent with the proposition that firms increase profits subject to fairness constraints.This paper examines perceptions of fairness in the residential real estate industry and explores how community standards affect economic decision-making. The residential real estate industry is unique. One party to the transaction (the landlord) frames decisions as pure business decisions. The other party to the transaction (the tenant) frames decisions more broadly. While a tenant's choice of apartments is in part viewed as a business decision, tenants consider a broad spectrum of non-business issues, as well. (shrink)

It has been noted before in the history of logic that some of Frege's logical and semantic views were anticipated in Stoicism. In particular, there seems to be a parallel between Frege's Gedanke (thought) and Stoic lekton; and the distinction between complete and incomplete lekta has an equivalent in Frege's logic. However, nobody has so far claimed that Frege was actually influenced by Stoic logic; and there has until now been no indication of such a causal connection. In this essay, (...) we attempt, for the first time, to provide detailed evidence for the existence of this connection. In the course of our argumentation, further analogies between the positions of Frege and the Stoics will be revealed. The classical philologist Rudolf Hirzel will be brought into play as the one who links Frege with Stoicism. The renowned expert on Stoic philosophy was Frege's tenant and lived in the same house as the logician for many years. In der Geschichte der Logik ist häufig bemerkt worden, dass einige der logischen und semantischen Auffassungen Freges in der Stoa antizipiert worden sind. Genannt wurden insbesondere die Parallelen zwischen dem Fregeschen Gedanken und dem stoischen Lekton sowie die Unterscheidung zwischen vollständigen und unvollständigen Lekta, die bei Frege ihre Entsprechung hat. Ein Wirkungszusammenhang ist allerdings nicht behauptet worden. Dazu gab es bislang auch keinen Anlass. Der vorliegende Beitrag versucht erstmalig, einen detaillierten Indizienbeweis für das Bestehen eines solchen Zusammenhangs vorzulegen. Dabei werden weitere charakteristische Übereinstimmungen zwischen Frege und der Stoa aufgewiesen. Als Mittelsmann wird der Altphilologe Rudolf Hirzel vorgestellt. Er wohnte lange Jahre als Mieter zusammen mit Frege im selben Haus und war ein anerkannter Experte der stoischen Philosophie. (shrink)

L'actuel débat sur l'« égalité face aux soins » et le « droit aux soins » est la conséquence directe des progrès techniques réalisés dans le domaine de la santé, mais il reste encore à fonder rationnellement les politiques suivies en la matière et à formuler une théorie adéquate de la justice distributive. Le présent article analyse le rôle et le statut du droit aux soins, ainsi que les considérations tenant à la justice qui vont à rencontre de la rentabilité (...) et de l'utilité sociales. Les choix de répartition budgétaire sont décisifs pour la formulation de revendications au nom de l'existence d'un droit positif aux soins, et il convient de se demander si un tel droit existe et quelles en sont les limites. Discussions today of « equal access » and « the right to health care » are the direct descendants of advances in the technology of health care, and we are still in search of a rationale for our policies and a theory of distributive justice adequate to the task. The role and status of rights to health care, together with considerations of justice in conflict with social efficiency and utility are discussed in this paper. It is argued that allocation decisions are central to claims on behalf of a positive right to health care, which forces questions both of whether there is such a right and of the limits to the right. S¿opposant par là à la majorité du flot de publications récentes sur l¿¿uvre de Derrida ce volume se propose d¿évaluer et de repenser d¿un point de vue critique les concepts clé de Derrida tenant compte de l¿état actuel de la recherche en études culturelles. Centrées autour de quatre domaines majeurs (man¿uvres ¿ sociétés ¿ images ¿ fictions), les sections offrent une lecture créatrice et actuelle de `Derrida¿ et des ouvertures que sa pensée permet vers une nouvelle idée de la théorie culturelle. Le vécu dont je tire ce récit est mon expérience d'homme vivant avec une maladie chronique, l'asthme, dont les périodes alternées, plus ou moins longues, de crise et de rémission me donnèrent envie d'extrapoler sur le thème plus large du plaisir et de la douleur, retenant déjà comme titre provisoire de mon ouvrage Le plaisir et l'ennui, ces deux termes visant une extension de l'analyse au-delà des seules questions de santé et de maladie, incluant par conséquent, leurs équivalents et synonymes (...) dans la vie individuelle et collective. Entre-temps, mes enfants qui n'ont connu que deux de leurs grands-parents, sur le tard, et presque rien de la vie au Fouta alors que nos références familiales et nos évocations quotidiennes en sont remplies ; qui m'ont vu entrer dans la vie active et m'engager politiquement sans en comprendre toujours les tenants et les aboutissants, revinrent plusieurs fois à la charge pour me suggérer d'écrire sur la famille, sur ma petite expérience d'enseignant et d'homme politique, sur les hommes et les femmes qui m'ont marqué et, surtout, sur la place que j'accorde à l'amitié, à la fraternité et à la solidarité, trois notions qu'ils m'ont entendu évoquer souvent et qui, à ce qu'il leur semblait, importent, aujourd'hui, plus aux yeux des jeunes qu'à ceux des adultes. Il est devenu un lieu commun de déclarer l a nature essentiellement indéfinissable de la philosophie. Dans cet article, nous essayons de réfut er cette thèse selon des critères à la fois philosophiques et pédagogiques, développant l'analyse dans le cadre des programmes actuels de l'enseignement secondaire, mais tenant compte des exigences, en général, d'une vraie introduction à la philosophie.

Une analyse minutieuse du dernier ouvrage de Hayek publié quatre ans avant sa mort, soit en 1988 , permet de mettre au Jour les tenants et aboutissants de la perspective évolutionnaire épousée par Hayek en matière d'économie politique. Examinant d'abord le concept d'ordre spontané, exposant ensuite le fonctionnement de Véconomie marchande comme système en expansion continue, je montre alors comment s'articulent pour Hayek compétence économique et compétence épistémique d'un côté, puis coordination économique et compétence morale de l'autre. L'analyse fait (...) apercevoir que, fondamentalement, l'optique de Hayek est évolutionnaire parce qu 'elle est résolument populationnelle, ce que les commentateurs de Hayek ont plutôt ignoré jusqu'ici, ce qui fournit l'occasion de passer en revue les critiques adressées par Hayek au principe de population de Malthus .Four years before his death, Hayek published a book in which he particulates the main reasons for adopting an evolutionary point of view in economics. This paper tries precisely to systematize these reasons as clearly as possible. I begin by a systematic discussion of the concept of spontaneous order. I then look at what mainly defines the catallaxy as a still extending market order. Following this line of theoretical argument, I then try to show how for Hayek economic competence and epistemic competence are to be seen as developing together in a free market economy. Furthermore, 1 try to show how for Hayek economic coordination and moral competence are to be seen as the unintended results ofrule-governed individual dimensions of behaviour mutually. (shrink)

Peut-on développer la concurrence, et espérer que les « adversaires » se conforment au droit? La concurrence introduit une logique guerrière. Or, des ennemis respectent rarement les règles! Celles-ci sont écartées, sous l’influence du modèle concurrentiel, quand elles ne servent pas l’intérêt des agents. Ces derniers agissent comme de véritables autorités à l’égard de leurs comportements : ils choisissent une option, en tenant compte des contraintes présentes dans l’environnement. Comment gérer une telle situation? On peut se demander s’il ne faut (...) pas changer le regard qui est porté sur la règle. Le droit peut-il être regardé encore comme la production normative d’une autorité? Ou peut-on lui substituer une vision fondée sur la capacité des agents à produire leurs propres normes, en fonction des contraintes rencontrées dans le contexte où ils sont situés? (shrink)

Notre réponse à la question de l'échec constitue aujourd'hui un problème pour la philosophie. Convaincus de ses prétendues vertus par des psys et des coachs pourtant peu convaincants sur ses tenants et ses aboutissants, nous nous méprenons en effet gravement sur l'échec. Dans une insatiable logique de la réussite, l'envie qui est la nôtre d'en tirer parti crée le besoin de le rendre autre qu'il n'est. Fût-il cuisant, fût-il complet, nous n'en parlons plus que comme d'un insuccès, nous ne (...) le pensons plus que comme une chance. Qui ne sait toutefois que les réussites dans la vie ne font pas forcément la réussite de la vie, ni les échecs son échec? Fermons donc l'oreille au nihilisme afin de rouvrir les yeux sur ces truismes : le bonheur n'est pas plus la réussite que la réussite le succès ; et si rater sa vie ne signifie pas nécessairement la gâcher, on ne peut manquer de la manquer au regard de l'inexorable loi de l'échec. Cela ressaisi, le seul désir qui mérite d'être cultivé ici-bas est d'échouer pour arriver, mieux : d'arriver â s'échouer. Aussi l'idée de l'échec conduit-elle in fine à entrer dans le registre de la marine, pour y envisager ex nunc notre existence comme une traversée. (shrink)

La Théorie de la justice de John Rawls a souvent été critiquée pour son individualisme de principe, qui compliquerait la prise en compte de nombreux enjeux sociaux tenant aux collectifs et aux relations entre groupes. Dans son Apologie de John Rawls, Alain Boyer a exploré avec pertinence les raisons de conclure à l’ouverture de la théorie aux enjeux proprement collectifs de la vie commune. Ce réexamen fournit l’occasion de revenir ici sur la nécessité de ne pas confondre l’agencement de la (...) maquette de choix rationnel dans l’ouvrage de Rawls avec des présupposés descriptifs sur la vie sociale. C’est aussi le motif d’un approfondissement des raisons de prendre en compte, pour une enquête du genre de celle que Rawls a menée, la dimension relationnelle et les attitudes partagées en société. « Le bon sens est la chose du monde la mieux partagée. » Il n’est pas rare de voir dans l’incipit du Discours de la méthode un de ces énoncés cartésiens qui, par leur simplicité et leur transparence, marquèrent une rupture avec la technicité de la philosophie scolastique des siècles précédents. Pourtant, à se pencher sur les commentaires qui ont été produits de ce texte, dès sa publication, il apparaît que pour un certain nombre de contemporains de Descartes, il y (...) avait là une référence à la théorie dite de l’intensio et remissio formarum – ou latitude des formes – qui, de Pierre Lombard à Nicolas d’Oresme en passant par Richard de Middleton, fit l’objet de discussions soutenues pendant plus de six siècles. Cette théorie énonce que seules les qualités accidentelles sont susceptibles de variations intensives dans une substance, contrairement aux propriétés essentielles qui, elles, sont invariables. L’énoncé de Descartes, aux atours de simple proverbe, cacherait en réalité un tour de force argumentatif : tenant pour acquis que la pensée constitue l’attribut essentiel de l’âme, Descartes mobiliserait la théorie de l’intensio et remissio formarum pour affirmer qu’en chaque âme, cette pensée n’est pas susceptible de plus et de moins. Il devient alors possible de définir certaines opérations épistémiques élémentaires qui s’observent à part égale en chacun de nous, et ne sont pas soumises à la variabilité des compétences individuelles.Mais ce point d’interprétation du texte de Descartes ne conserverait qu’un intérêt herméneutique s’il ne trouvait, outre-Manche et quelques dizaines d’années plus tard, un remarquable rebondissement : En 1690, John Locke, dans L’Essai sur l’entendement humain, identifie parfaitement la référence médiévale sous-jacente à cet énoncé canonique du cartésianisme, et la discute avec la plus grande rigueur. En indexant la pensée sur l’attention, et en remarquant que cette attention est susceptible de variations d’intensités au cours du temps, Locke en vient à se demander s’il ne faut pas renoncer au postulat cartésien selon lequel la pensée constituerait l’essence de l’âme, et lui préférer l’hypothèse selon laquelle cette pensée ne serait pour l’âme qu’une activité. The paper examines the argumentation strategies of the Constitutional Tribunal’s case law on the reprivatisation of Warsaw real estate, a significant social issue in modern Poland. Following the post-war expropriation by the communist regime, legal successors of dispossessed individuals (both heirs and buyers of the claims to particular land) initiated widespread litigations to reclaim property and obtain compensation. This process led to the forceful eviction of thousands of tenants and the relocation of public institutions. This complex legal landscape lacks (...) a comprehensive regulation for property restitution, resulting in reprivatisation cases being handled solely as court disputes without central legislation, leading to a decentralised system of reprivatisation. The Polish Constitutional Tribunal, with its unique position within the legal system, has played a crucial role in shaping the legal framework and influencing the outcomes of reprivatisation cases. The study employs an analysis of all Constitutional Tribunal judgments related to the reprivatisation of Warsaw’s real estate, highlighting the evolution of the discourse of the Constitutional Tribunal in this regard. It consists of two parts: mixed method (quantitative and qualitative) was utilised to assess how Constitutional Tribunal judges justified their decisions (what types of argument they used), and the discourse analysis method was used to analyse how they approached reprivatisation in the real-world context. This study gives insight into the arguments and reasoning that the judges used and how their framing of the legal discourse changed over 30 years. (shrink)

This paper focuses on the _ethics of how_ to approach the introduction of MAiD as an organizational ethics challenge, a focus that diverges from the traditional focus in healthcare ethics on the _ethics of why_ MAiD is right or wrong. It describes a method co-designed and implemented by ethics and medical leadership at a tertiary hospital to develop a values-based, grassroots response to the decriminalization of assisted dying in Canada. This organizational ethics engagement method embodied core tenants that drew (...) inspiration from a variety of sources, including poetic ones. These tenants are: make the problem bigger; focus on values; cultivate open moral spaces; and trust emergence. The paper describes how these tenants were put into practice in order to create a rigorous and sustainable MAiD program that delivers high-quality care to patients and families while honoring the moral diversity of the hospital workforce. One of the goals in sharing this method is to provide a roadmap for healthcare organizations in Canada and other jurisdictions around the world that are facing the challenge of responding to patient requests for MAiD following the decriminalization of this care option. Plutôt que de rouvrir l'éternel débat entre tenants d'une histoire analytique de la philosophie et tenants d'une approche « authentiquement historique », il vaut mieux se demander si les premiers sont réellement condamnés à la trahison historique, et les seconds à la myopie historique. La démarche consistant à aborder le passé de la philosophie d'aval en amont est compatible avec une fidélité historique dès lors qu'on est prêt à reconnaître que ce ne sont pas seulement des textes qui (...) se transmettent à l'intérieur d'une tradition, mais des arguments, et que ceux-ci peuvent passer d'une tradition à l'autre. Instead of reopening the eternal debate between the partisans of an « analytical » approach to the history of philosophy and the partisans of an « genuinely historical » approach, let us rather ask ourselves whether the former are necessarily condemned to betray history and the latter condemned to historical myopia. Approaching the past of philosophy from downstream to upstream is compatible with a fidelity to history once we acknowledge the fact that not only texts, but also arguments are passed on within a tradition and outside it. Human Quality Treatment (HQT) is a theoretical approach expressing different ways of dealing with employees within an organization and is embedded in humanistic management tenants of dignity, care, and personal development, seeking to produce morally excellent employees. We build on the theoretical exposition and present a measure of HQT-Scale across several studies including cross-culturally to enhance confidence in our results. Our first study generates the 25 items for the HQT-Scale and provides initial support for the items. We then followed (...) up with a large study of managers (n = 363) from Nigeria in study 2, which confirms the theoretical properties of the five dimensions of HQT and highlights a two-factor construct: HQT Ethically Unacceptable and HQT Ethically Acceptable using a 20-item HQT-Scale. Study 3 with a large sample of New Zealand employees (n = 452) again confirms the nature of the construct and provides construct validity tests. Finally, using time-lagged data, study 4 (n = 308) focuses on New Zealand employees and job attitudes and behaviors, and a well-being outcome. That study not only confirms the theoretically implied effects but also shows the HQT Ethically Acceptable factor mediates the detrimental effects of HQT Ethically Unacceptable. Overall, our four studies provide strong support for the HQT-Scale and highlight important understandings of HQT and humanistic management in the workplace. (shrink)
