Many historical studies tend to underline two central Kantian themes frequently emerging in Georges Canguilhem’s works: (1) a conception of activity, primarily stemming from the Critique of Pure Reason, as a mental and abstract synthesis of judgment; and (2) a notion of organism, inspired by the Critique of Judgment, as an integral totality of parts. Canguilhem was particularly faithful to the first theme from the 1920s to the first half of the 1930s, whereas the second theme became important in the (...) early 1940s. With this article, I will attempt to show that a third important theme of technique arose in the second half of the 30s also in the wake of Kant’s philosophy, especially Sect. 43 of the Critique of Judgment. This section, which states that technical ability is distinguished from a theoretical faculty, led Canguilhem to a more concrete and practical conception of activity. I will then suggest that it was by considering technique that the concept of normativity, which characterizes Georges Canguilhem’s philosophy of life, also took shape. (shrink)

In accordance with societal norms and values, consumers readily indicate their positive attitudes toward sustainability. However, they hardly take sustainability into account when engaging in exchange relationships with companies. To shed light on this paradox, this paper investigates whether defense mechanisms and the more specific concept of neutralization techniques can explain the discrepancy between societal norms and actual behavior. A multi-method qualitative research design provides rich insights into consumers’ underlying cognitive processes and how they make sense of their attitude–behavior divergences. (...) Drawing on the Ways Model of account-taking, which is advanced to a Cycle Model, the findings illustrate how neutralization strategies are used to legitimize inconsistencies between norm-conforming attitudes and actual behavior. John Finnis proposes that practical reason finds the basic meaning of all human choice and action in a set of self-evident ends. Finnis terms these ends, "basic goods." He suggests that "integral human fulfillment" is attained by honoring a set of equally self-evident requirements governing consistent respect for these same "basic goods." Such requirements have the character of moral obligation. In this view, the civil law exists to advance the observance of one such requirement: "that one foster and favour the (...) common good." The normative evaluation of law follows from this same requirement. Finnis considers Aquinas his precursor. Thomas does indeed assume the existence of self-evident goods of choice and action, but, in contrast to Finnis's goods, which are not based in ontology, Thomas's represent modes of becoming fully a human being according to a conception of human nature. H. L. A. Hart is a liberal thinker who was Finnis's contemporary and teacher at Oxford. A comparison of Finnis and Hart shows that Hart's characteristically modern perspective interprets the data of moral consciousness in a way which rejects not only Aquinas's ontology, as does Finnis, but goes further and rejects Finnis's cognitive interpretation of "basic goods." Comparison also shows that Hart shares Finnis's concept of law as technique, but unlike Finnis, who still grasps law in relation to a moral purpose, Hart's considers such a technique to be morally neutral. These patterns of similarity and difference between the natural law jurisprudence of John Finnis and the theories, respectively pre-modern and liberal, of Aquinas and Hart point to the distinctive character of Finnis's "basic goods" reasoning and highlight some of its salient strengths and weaknesses. The need for conceptual work in marketing ethics is addressed by examining the five techniques of neutralization as a means for partially explaining unethical behaviors by marketing practitioners. These techniques are often used by individuals to lessen the possible impact of norm-violating behaviors upon their self-concept and their social relationships. Borrowed from the social disorganization and deviance literature, the five techniques of neutralization are: (1) denial of responsibility, (2) denial of injury, (3) denial of victim, (4) condemning the condemners and (...) (5) appeal to higher loyalties. Examples of marketing professionals using each of the five techniques are given, and a conceptual model linking the techniques of neutralization with unethical behavior is presented. New Breeding Techniques such as CRISPR-Cas9 are revolutionizing plant breeding and food production. Experts believe that the social debate about these technologies could be similar to those on green genetic engineering: emotional and highly controversial. Future debate about Genome Editing could benefit from a better understanding of the GMO (genetically modified organism) controversy. Against this background, this paper (a) presents results of a content analysis of position papers criticizing green genetic engineering in Germany. In her book Social Goodness, Charlotte Witt gives an account of the normativity of social norms, crucially appealing to (and naming) social role normativity. Social role normativity is a distinctive kind of normativity that follows from social roles. For example, teachers ought to teach and students ought to do their homework. According to Witt's artisanal model of social role normativity, we should make sense of social role normativity by reference to artisanal roles, like being a carpenter. Just as carpenters have (...) skills, techniques, and expertise associated with their craft, social roles have skills, techniques, and expertise associated with them. The artisanal model presents the individual craftsperson, taught by a uniquely qualified expert, as the paradigm. Because of this, I argue that the artisanal model struggles to capture the messiness of the actual world, where expertise is distributed, unstable, and contested. To accommodate the real world, we should move away from Witt's individualistic artisanal model. Instead of focusing on individual artisans, our account of social role normativity should focus on communities and institutions that promote artisanal practices. (shrink)

This article revisits French sociologist Marcel Mauss’ notion of ‘techniques of the body’ to analyze the emergence of corporeal and behavioral norms instituted to prevent the spread of the coronavirus pandemic. Centering its analysis on the early stages of COVID’s global spread, the article examines a range of everyday, micro-practices that reveal how the pandemic changed our awareness, uses, and assessments of our own and others’ bodies. In a context where to not touch was to care, people often struggled to (...) find a balance between maintaining social civility and sustaining collective health. Failure to adapt the body to pandemic conditions, or instances of COVID faux-pas, resulted in discomfort, embarrassment, or annoyance on the part of those who perceived this behavior as irresponsible, dangerous, and selfish. Changing bodily practices thus became subject to judgment in ways that sometimes obscured the uneven distribution of risk and protection afforded to differently privileged or vulnerable human communities as they grappled with the uncertain phenomenologies of pandemic living and dying. COVID-19 corporealities, both fleshly and virtual, thus reveal the conjoined articulation of the social, biological, cultural, moral, and psychological in our bodily movements, expressions, and assessments. In contrast to Mauss’ theorization, many techniques of the body in the Covidscape were experienced as new, contextual, shifting, and improvised. They spoke to necessity and challenge of articulating a different relationship to the world and to others, enacted in the minute and mundane practices of everyday life, through which macro-level processes and forces are embodied and evaluated. This article introduces compliance disclosure regimes to business ethics research. Compliance disclosure is a relatively recent regulatory technique whereby companies are obliged to disclose the extent to which they comply with codes, ‘best practice standards’ or other extra-legal texts containing norms or prospective norms. Such ‘compliance disclosure’ obligations are often presented as flexible regulatory alternatives to substantive, command-and-control regulation. However, based on a report on experiences of existing compliance disclosure obligations, this article will identify major weaknesses that prevent them (...) from becoming effective mechanisms to discipline a certain type of behaviour. It will be argued that regulatory recourse to compliance disclosure obligations is nonetheless worthwhile if we view them as mechanisms that can initiate a dialogue about norm interpretation, application and norm desirability. From this perspective, compliance disclosure obligations serve less to discipline companies by making corporate practices transparent, and more to trigger a process of norm development, in which the law, companies and their stakeholders interact. This article provides an illustration of how mandatory disclosure, if it is restricted to a unilateral communication process, may produce no effective results (or even prove counterproductive), whilst highlighting the alternative potential of disclosure as an initiator of dialogue, supported by laws, geared towards the development and refinement of norms applicable to business in a global context and the values they promote. Throughout the last decades, state and civil society actors in Germany have undertaken a number of initiatives in order to enter into a structured conversation with Muslim communities, and to find spokespersons who serve as partners for political authorities. This process has commonly been analysed in terms of its empowering effects for Muslims via the emerging ‘institutionalisation’ of Islam. The modes and techniques of power at stake in this process have yet often been undermined. Through the lens of Foucault's concept (...) of governmentality, the starting point of my article is one particular dialogue forum, initiated by the German state in 2006 – the ‘Deutsche Islam Konferenz’ (DIK) – whose primary goal is to institutionalise and regulate the communication between Muslims and state actors and thereby to regulate the conduct of Muslims. Focusing mainly on the way in which gender and Islam have been coupled and played out in this initiative, I argue that the DIK is less a dialogical encounter than a tool of a broader civilising liberal project. Through the inquiry into the modes of power operating in this state led dialogue initiative the article shows that while aiming to secure Muslim's ‘integration’ into German society and to liberate Muslim women from restrictive gender norms, the DIK operates as an enactment of a particular notion of freedom with normative and normalising implications. This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...) from 0.52 to 0.78. In contrast, a machine learning based approach for the classification was implemented. A performance of \ was reached. Traditionally, machine learning classifiers lack of transparency with regard to their decisions. We extended our approach using so-called local linear approximations, which is a novel technique to analyze and inspect a trained classifier’s behavior. We can show that there are significant similarities of manually crafted knowledge, i.e., rules and pattern definitions, and the trained decision structures of machine learning approaches. (shrink)

Principia Ethica set the agenda for analytical metaethics. Moore’s unrelenting focus on fundamentals both brought metaethics into view as a potentially separate area of philosophical inquiry and provided a model of the analytical techniques necessary to pursue it.1 Moore acknowledged that he wasn’t the first to insist on a basic irreducible core of all ethical concepts. Although he seems not to have appreciated the roots of this thought in eighteenth-century intuitionists like Clarke, Balguy, and Price, not to mention sentimentalists like (...) Hutcheson and Hume, Moore gave full marks to Sidgwick. Jürgen Habermas is regarded as a central bioconservative commentator in the debate on the ethics of human prenatal genetic manipulations. While his main work on this topic, The Future of Human Nature, has been widely examined in regard to his position on prenatal genetic enhancement, his arguments regarding prenatal genetic therapeutic interventions have for the most part been overlooked. In this work I do two things. First, I present the three necessary conditions that Habermas establishes for a prenatal genetic manipulation (...) to be regarded as morally permissible. Second, I examine if mitochondrial replacement techniques meet these necessary conditions. I investigate, specifically, the moral permissibility of employing pronuclear transfer and maternal spindle transfer. I conclude that, according to a Habermasian perspective on prenatal genetic manipulation, maternal spindle transfer and pronuclear transfer are morally impermissible. Maternal spindle transfer is, in principle, morally permissible, but only when we have beforehand preselected a sperm and an egg for our reproductive purpose. These findings are relevant for bioconservatives, both for those who hold a Habermasian stance and for those who hold something akin to a Habermasian stance, because they answer the question: what should bioconservatives do regarding mitochondrial replacement techniques? In fact, the answer to this question does not only normatively prescribe what bioconservatives should do in terms of their personal morality, but it also points towards what kind of legislation regulating mitochondrial replacement techniques they should aim at. With its emphasis on indeterminacy, ambiguity, uncertainty, and chance, contingentism depicts normativity as one of our human practical possibilities rather than as a metaphysical bottleneck which we should necessary fulfill at the cost of repudiating concrete ways in which we grant epistemic and ethical meaning to our activities. Richard McKay Rorty's "neo-pragmatism" launched a powerful challenge to entrenched philosophical and pre-philosophical certainties of modernity, allowing us to articulate the powerful picture of normativity as a distinctive exercise and activity of human (...) beings. Normative Ethical theory underwent a period of refinement in some areas and proliferation in others during the 20th century. Theories prominent in the 19th century, such as Utilitarianism, underwent refinement in light of criticisms; other approaches, such as normative intuitionism and virtue ethics, were developed in new directions, ones that reflected the sophistication of analytical techniques developed by philosophers in the 20th century, particularly in ordinary language philosophy. The middle of the 20th century was marked by an interest in conceptual (...) analysis and what could be revealed about our concepts in the analysis of ‘ordinary’ language appeals to those concepts. For example, Gilbert Ryle argued that the hope of clearing up our concepts via formalizing them was futile, and instead the task of philosophy was to clear up confusions present in the ordinary use of concepts, concepts employed by ordinary people as well as specialists in a given area. Normative ethicists in the very early part of the 20th century had not yet adopted a ‘scientizing’ attitude to philosophy. They believed, for example, that one could rely on intuition in formulating ethical theories.1 Theorists in the early part of the century were also optimistic about the prospects of systematizing normative ethics in a way that would be faithful to our common sense normative judgments. This article is an analysis of the recognition of the Missionary Church of Kopimism as a faith community by the Swedish state. The analysis draws on post-Foucaultian writings on governmentality and seeks to understand what kind of normative and proscriptive understandings of “religion” guide the process. The authors argue that the recognition reveals fundamental aspects of the Swedish state’s performative role in the recognition of faith communities which challenges any unreflective classification of it as “secular.”.

In response to those who see rational deliberation as a source of epistemic norms and a model for well-functioning scientific inquiry, Solomon cites evidence that aggregative techniques often yield better results; deliberative processes are vulnerable to biasing mechanisms that impoverish the epistemic resources on which group judgments are based. I argue that aggregative techniques are similarly vulnerable and illustrate this in terms of the impact of gender schemas on both individual and collective judgment. The causal compatibility question asks whether a given causal structure graph — possibly involving latent variables — constitutes a genuinely plausible causal explanation for a given probability distribution over the graph’s observed categorical variables. Algorithms predicated on merely necessary constraints for causal compatibility typically suffer from false negatives, i.e. they admit incompatible distributions as apparently compatible with the given graph. In 10.1515/jci-2017-0020, one of us introduced the inflation technique for formulating useful relaxations of the causal compatibility problem in terms (...) of linear programming. In this work, we develop a formal hierarchy of such causal compatibility relaxations. We prove that inflation is asymptotically tight, i.e., that the hierarchy converges to a zero-error test for causal compatibility. In this sense, the inflation technique fulfills a longstanding desideratum in the field of causal inference. We quantify the rate of convergence by showing that any distribution which passes the nth-order inflation test must be On−1/2$\begin{array}{} \displaystyle {O}{\left(n^{{{-}{1}}/{2}}\right)} \end{array}$-close in Euclidean norm to some distribution genuinely compatible with the given causal structure. Furthermore, we show that for many causal structures, the (unrelaxed) causal compatibility problem is faithfully formulated already by either the first or second order inflation test. (shrink)

The paper discusses the disciplinary production of the normative feminine body and analyses the shift that has taken place in the rationality underpinning our current techniques of gender. I argue that Foucault’s radical intervention in feminist philosophy, and more generally in the philosophy of the body, has been the crucial claim that any analysis of embodiment must recognize how power relations are constitutive of the embodied subjects involved in them. His studies of disciplinary technologies show how bodies are constructed through (...) mundane, everyday habits and techniques as certain kinds of subjects. Similarly, feminist appropriations of Foucault’s thought have demonstrated how feminine subjects are constructed through patriarchal, disciplinary practices of beauty. My argument is that that there have been significant changes in the last decades in the rationality underpinning these techniques of gender, however, which have emerged in tandem with the rise of the neoliberal, economic subject. I will appropriate Foucault’s idea of governmentality, and particularly of neoliberal governmentality, as an alternative framework to discipline for studying the contemporary construction of the feminine body. I will show that it provides us with a more comprehensive conceptual framework for understanding the construction of the feminine body in its current form. (shrink)

Throughout the twentieth century, women's magazines in the United States have socialized their readers to the “proper” expression of love and anger in marriage. Our analysis of a random sample of marital advice articles from 1900 to 1979 examines this cultural convergence of gender, marriage, and emotion. A qualitative analysis identifies techniques for socializing readers to the emotional culture of marriage and shows a historical change toward equating love with self-fulfillment and advocating the expression of anger. A quantitative analysis then (...) specifies the timing of changes in emotion norms and showed an oscillation between modern and traditional norms that is related to waves of political liberation versus oppression. We discuss the relation between emotion norms and behavior and explore the effect of group conflict on the production of emotional culture. Emotion norms have become less rigid and more tolerant of diversity; but gender differences persist, and women are still responsible for maintaining intimate relationships. Historical trends in love and anger norms are nonlinear, not a continuous shift toward individualism, self-development, and free expression, as suggested by recent cultural theories. (shrink)

Background: According to Gelfand et al., COVID-19 infection and case mortality rates are closely connected to the strength of social norms: “Tighter” cultures that abide by strict social norms are more successful in combating the pandemic than “looser” cultures that are more permissive. However, countries with similar levels of cultural tightness exhibit big differences in mortality rates. We are investigating potential explanations for this fact. Using data from Germany and Japan—two “tight” countries with very different infection and mortality rates—we examined (...) how differences in socio-demographic and other determinants explain differences in individual preventive attitudes and behaviors. Methods: We compared preventive attitudes and behaviors in 2020 based on real-time representative survey data and used logit regression models to study how individual attitudes and behaviors are shaped by four sets of covariates: individual socio-demographics, health, personality, and regional-level controls. Employing Blinder-Oaxaca regression techniques, we quantified the extent to which differences in averages of the covariates between Japan and Germany explain the differences in the observed preventive attitudes and behaviors. Results: In Germany and Japan, similar proportions of the population supported mandatory vaccination, avoided travel, and avoided people with symptoms of a cold. In Germany, however, a significantly higher proportion washed their hands frequently and avoided crowds, physical contact, public transport, peak-hour shopping, and contact with the elderly. In Japan, a significantly higher proportion were willing to be vaccinated. We also show that attitudes and behaviors varied significantly more with covariates in Germany than in Japan. Differences in averages of the covariates contribute little to explaining the observed differences in preventive attitudes and behaviors between the two countries. Conclusion: Consistent with tightness-looseness theory, the populations of Japan and Germany responded similarly to the pandemic. The observed differences in infection and fatality rates therefore cannot be explained by differences in behavior The major difference in attitudes is the willingness to be vaccinated, which was much higher in Japan. Furthermore, the Japanese population behaved more uniformly across social groups than the German population. This difference in the degree of homogeneity has important implications for the effectiveness of policy measures during the pandemic. (shrink)

Such as is also the influence science-society. If the genetics influences the society, the society influences the genetics and the sciences of the reproduction. The goal is indeed nowadays to have a limited number of children, and to offer a life of quality with minimal sufferings. Without doubt these (...) social “norms” have indeed also an eugenetic effect. The interaction science-society appears at each important discovery by necessary adaptations.Before to decide what is moral and immoral, correct and false in the consequences of genetical techniques, one has to better understand the proposed applications and the signification of their results. It would be necessary that the society would develop a better information or even a biological culture.To fear that human beings would destroy the natural mechanisms, to phantasm on the fact that humans would go too far, corresponds in fact to make a scandal of his intelligence, to separate human beings from the nature, it is at the limit to want to limit humans to their animal origin. In this field, such as in others, humans do not need repressive morals: the ethically responsible choice is the choice of the publicity of knowledge. This education must help him to remain honest and free, to remove false sciences and prejudices. (shrink)

I briefly present and motivate a ‘skill hypothesis’ regarding the evolution of human normative cognition. On this hypothesis, the capacity to internally represent action-guiding norms evolved as a solution to the distinctive problems of standardizing, learning and teaching complex motor skills and craft skills, especially skills related to toolmaking. We have an evolved cognitive architecture for internalizing norms of technique, which was then co-opted for a rich array of social functions. There was a gradual expansion of the normative domain, (...) with ritual playing an important role in bridging the gap between concrete, enacted norms and general, abstract norms, such as kinship norms. We acknowledge the limitations in measures of moral reasoning and pursue an alternative technique by investigating past behaviors as they relate to present behavioral intentions. Our purpose is to evaluate the merits of patterned normative behavior for predicting present and future, morally relevant outcomes. Participants completed a policy capturing experimental design responding to questions that orthogonally varied the situational nature of the decision context. Results indicate that past normative behaviors are significantly and directly related to ethical behavioral intentions. We are all guided by thousands of norms, but how did our capacity for normative cognition evolve? I propose there is a deep but neglected link between normative cognition and practical skill. In modern humans, complex motor skills and craft skills, such as toolmaking, are guided by internally represented norms of correct performance. Moreover, it is plausible that core components of human normative cognition evolved as a solution to the distinctive problems of transmitting complex motor skills and craft skills, especially (...) skills related to toolmaking, through social learning. If this is correct, the expansion of the normative domain beyond technique to encompass more abstract norms of fairness, reciprocity, ritual and kinship involved the elaboration of a basic platform for the guidance of skilled action by technical norms. This article motivates and defends this “skill hypothesis” for the origin of normative cognition and sets out various ways in which it could be empirically tested. (shrink)

Some theorists are suspicious of normative political theology because they believe it undermines critical rationality. In my view, these theorists neglect theological traditions that resist dogmatism through intensified critique. Because authoritarian dogma is not unique to religion, theology offers sophisticated techniques that may be useful for those who are not themselves religious. A normative theology that intensifies critique represents a valuable resource for political reflection, and not only for the faithful.

In this article, I draw on research carried out in Europe, primarily in Germany, on patients’ and scientists’ perspectives on mitochondrial replacement techniques in order to explore some of the complexities related to collective representation in health governance, which includes the translation of emerging technologies into clinical use. Focusing on observations, document analyses, and interviews with eight mitochondrial disease patient organization leaders, this contribution extends our understanding of the logic and meanings behind the ways in which patient participation and collective (...) representation in health governance initiatives take shape. My findings highlight the ways in which a commitment to a global mitochondrial disease patient community and a sense of patient solidarity influence expressions of support with regard to legalizing mitochondrial replacement techniques. My analyses illustrate how normative practices and expectations of participatory governance potentially foreclose opportunities for sustained collective patient engagement with the complex ethical, social, and political dimensions of emerging technologies and may silence diverse and potentially dissenting embodied and lived responses to the prospects of particular technological developments. Nevertheless, this situation does not preclude attempts to set moral rules and ethical principles as guidelines leading actions, behaviours, and conducts; it is a matter of fact that the history of humanity is full of numerous examples of such attempts. Codes of ethics, which play a key role in professional ethics, can be regarded as reflections on the aforementioned general rules and principles in professional life. From this aspect, they also seem disputable and questionable, and they cannot offer a complete prescription fulfilling all the necessary requirements either, yet they fill a great gap in finding solutions to problems that occur in various forms of professional life. Another similarity between codes of ethics, and general moral rules and ethical principles, is that they are all based on an account of humanity and morals; especially, it is impossible to establish a normative ethical theory or to write a worthwhile code of ethics without any philosophical account of humanity and morals. This paper attempts to offer such an account through a philosophical interpretation of ‘non-finito’ sculpture technique and thus to provide a philosophical foundation for any codes of ethics. Recent neuroscience studies have reported that neurofeedback training with the use of functional magnetic resonance imaging enables the regulation of an individual’s cognitive, emotion-related, and behavioral states through a real-time representation of her brain activities. Since this technique has been applied not only to clinical research to, for example, mitigate mental or psychiatric symptoms but also to non-clinical research to, for example, change the cognition or preferences of a so-called healthy participant, neurofeedback-based cognitive and/or moral enhancements may be realized (...) in the future. However, neurofeedback-based human enhancement is not the only issue that requires neuroethical consideration. I examine why and to what extent the dual application of neurofeedback technique will blur the lines between the mental, the social, and the moral, threatening some social norms, such as individual freedom and diversity. First, I consider the link between the mental and the social in psychiatry. Examining the definition of “mental disorder” provided by the American Psychiatric Association, I show that the mental is partly defined through social performance. Second, I make explicit the link between the social and the moral and argue that moral evaluation of an activity is gently but positively correlated with its social evaluation. Third, I demonstrate the links between the mental, the social, and the moral. In spite of a great deal of effort to distinguish these notions, the possibility of the dual application of this technique blurs the lines between them. Fourth, I examine whether such blurred lines signal sociocultural evolution or dystopia and argue that it can be understood as a beginning of the second advent of ethical virtue. I conclude that further cautious consideration of neuroethics is required because the establishment of this technique may have unique influences on our society. (shrink)

Merton envisioned his norms of science at a time when peer-reviewed journals controlled scientific communication. Technologies for sharing and finding content have since divorced the certification and amplification of science, generating systemic vulnerabilities. Certified amplification—a new Mertonian-styled norm—enjoins their recoupling and introduces a taxonomy of strategies adopted by institutions to close the certification-amplification gap, including the proportioning of the one to the other. In order to avoid the implication that ‘mitochondrial replacement techniques’ (MRT) would produce ‘three parent babies’, discourses around these techniques typically dismiss the contribution of the mitochondria to genetic parenthood and personal identity. According to many participants in debates about MRT, ‘real parenthood’ is a matter of contributing nuclear DNA, which in turn implies that men and women make the same contribution to the embryo. Even when the importance of the mitochondria is acknowledged, an emphasis on mitochondrial DNA still has (...) the effect of valorizing the role of DNA (and thus the paternal contribution to conception) at the expense of the role played by the cytoplasm of the oocyte in the development of the embryo and placenta, and that of the mother’s body in gestation. In this way, discourses around MRT falsely imply that what men and women contribute to reproduction and parenthood is the same—nuclear DNA—and thus erase the distinctive contribution that women make to conception. The potential of MRT to reconfigure relationships between the sexes in the service of patriarchal norms is perhaps one of the most significant things about it and should, we argue, be counted in the discussion of the ethical and policy implications of legitimating these procedures. This chapter argues for the importance of considering conceptual and normative commitments when addressing questions of responsible practice in data-intensive agricultural research and development. We consider genetic gain-focused plant breeding strategies that envision a data-intensive mode of breeding in which genomic, environmental and socio-economic data are mobilised for rapid crop variety development. Focusing on socio-economic data linkage, we examine methods of product profiling and how they accommodate gendered dimensions of breeding in the field. Through a comparison with participatory breeding methods, (...) we argue that the conceptual commitments underpinning current methods of integrating socioeconomic data into calculations of genetic gain can preclude the achievement of key social development goals, and that better engagement with participatory approaches can help address this problem. We conclude by identifying three key avenues towards a data-intensive approach to plant breeding that utilises the diverse sources of relevant evidence available, including socio-economic data, and maximises the chance of developing sustainable and responsible strategies and research practices in this domain: (1) reliable, long-term management of data infrastructures; (2) ongoing critical analysis of the conceptual foundations of specific strategies; and (3) regular transdisciplinary consultations including expertise in the social studies of agricultural science as well as participatory breeding techniques. The present study examines certain challenges that KDD (Knowledge Discovery in Databases) in general and data mining in particular pose for normative privacy and public policy. In an earlier work (see Tavani, 1999), I argued that certain applications of data-mining technology involving the manipulation of personal data raise special privacy concerns. Whereas the main purpose of the earlier essay was to show what those specific privacy concerns are and to describe how exactly those concerns have been introduced by the use (...) of certain KDD and data-mining techniques, the present study questions whether the use of those techniques necessarily violates the privacy of individuals. This question is considered vis-à-vis a recent theory of privacy advanced by James Moor (1997). The implications of that privacy theory for a data-mining policy are also considered. (shrink)

Deductivism is not merely a logical technique, but also a theory of normativity: it provides an objective and universal standard of evaluation. Contemporary dialectical logic rejects deductive normativity, replacing its universal standard by an intersubjective standard. It is argued in this paper that dialectical normativity does not improve upon deductive normativity. A dialogico-rhetorical alternative is proposed.

The revolutionary potential of the CRISPR-Cas9 gene editing technique has created a resurgence in enthusiasm and concern in genetic research perhaps not seen since the mapping of the human genome at the turn of the century. Some such concerns and anxieties revolve around crossing lines between somatic and germline interventions as well as treatment and enhancement applications. Underpinning these concerns, there are familiar concepts of safety, unintended consequences and damage to genetic identity and the creation of designer children through (...) pursuing human enhancement and eugenics. In the policy realm, these morally laden distinctions and anxieties are emerging as the basis for making important and applied measures to respond to the fast-evolving scientific developments. This paper argues that the dominant normative framing for such responses is insufficient for this task. This paper illustrates this insufficiency as arising from a continued reliance on misleading genetic essentialist assumptions that generate groundless speculation and over-reactionary normative responses. This phenomenon is explicit with regard to prospective human genetic enhancements. While many normative theorists and state-of-the-art reports continue to gesture toward the influence of environmental and social influences on a person and their traits and capacities, this recognition does not extend to the substance of the arguments themselves which tend to revert to the debunked genetic determinist framework. Given the above, this paper argues that there is a pressing need for a more central role for sociological input into particular aspects of this “enhancement myth” in order to give added weight, detail and substance to these environmental influences and influence from social structures. According to Canguilhem, vitalism is not a metaphysical or ontological theory, but rather a general attitude or a perspective about life and living beings, both understood employing the axiological concept of ‘normativity’. This notion allows Canguilhem to enlarge the concept of life beyond the field of biological phenomena, encompassing also phenomena of the social world, included technique and (...) scientific knowledge and rationality. And (...) an artist might lead his public on to appreciate finer things than they had wanted at first; but he could do this only by being; from the first, if not merely entertaining, yet entertaining, and if not completely intelligible, yet very largely intelligible.” This constraint—let us call it intelligent (or purposeful) design, in keeping with a basic analogy that we will draw upon in these pages—had however been lost, Lewis observed. Hence, even “in the highest aesthetic circles one now hears nothing about the artist’s duty to us. It is all about our duty to him. He owes us nothing; we owe him ‘recognition,’ even though he has never paid the slightest attention to our tastes, interests, or habits.”1 In short, the artist of modernity need not pay the slightest attention to an intention, not even his own. Modern art need not be an expression of intelligence or [End Page 363] understanding; it is expression as such (tout court): personal and autonomous.2Lewis’s remarks do not point merely to the increasingly relativist tendencies of art in the Western world, to the lack of objective criteria or norms governing the artistic disciplines. They also point to the growing disregard among artists for the sociocultural expectations of their publicum. Mediating between the two is, without a doubt, the basis upon which both artistic and social norms were traditionally founded: nature, which served as a classic analogy for both art (understood in the broad sense, so as to include not only the fine arts, but also technology and practical sciences) and ethics in virtue of nature’s intrinsic inclination towards its defining end and perfection.With regard to the first of these analogies (that of art and nature), Mark Schiefsky explains that although art does bring about “results that nature itself cannot,” it does so in the classic understanding “by acting in a natural way—the way nature would act if it could generate the products of art.”3 As for the difference between the two, nature is moved to its specifying end by way of intrinsic inclinations that are implicit to it, whereas a work of art is moved to its end extrinsically, and thus with more or less violence.4 A sculptor, for example, who introduces a form into a piece of marble, does so by chiseling [End Page 364] and hammering away at the fine stone.5 “Art is,” Aristotle explains, “the principle and form of the thing that comes to be [let us say, a sculpture]; but it is located elsewhere [in, for example, the artist’s mind or in a sketch that he has made] than in that thing, whereas the movement of nature is located in the thing itself that comes to be [a tree, for example, or a baby], and is derived from another natural organism [a tree or human parents] which possessed the form in actuality.”6This classic distinction between art and nature parallels the distinction between art and ethics. The objective of this work is to propose ten efficient scaling techniques for the Wisconsin Diagnosis Breast Cancer dataset using the support vector machine. These scaling techniques are efficient for the linear programming approach. SVM with proposed scaling techniques was applied on the WDBC dataset. The scaling techniques are, namely, arithmetic mean, de Buchet for three cases p = 1,2, and ∞, equilibration, geometric mean, IBM MPSX, and Lp-norm for three cases p = 1,2, and ∞. The experimental results show (...) that the equilibration scaling technique overcomes the benchmark normalization scaling technique used in many commercial solvers. We are all immersed in a sea of social norms, but they are sometimes tricky to observe with any clarity. They are often invisible to us and emerge only when they are not observed. Social norms are important to understand because they are both limiting of our freedom, such as gendered and racialized norms, and at the same time the very conditions of our agency. Social Goodness presents an original, externalist answer to the question of the source or origin of (...) social role normativity. Rather than grounding social normativity in the attitudes of persons, the book argues for an externalism that roots social role normativity in the social world itself: in its positions, institutions, and larger architecture. The core insight of externalism is that the function or structural feature of an enterprise or activity can bring with it normative demands quite independently of the attitudes of those who engage with it. According to the artisanal model, just as a carpenter, ceramicist, or chef is responsive to and evaluable under a set of artisanal norms or techniques, so too is a mother and or an academic or a President. The source of normativity is this technique or expertise, independent of the preferences, endorsements, or recognitive attitudes of individuals. The artisanal model for social role normativity has resources to explain both the "stickiness" or persistence of social norms and our ability to criticize existing norms and to engage in normative self-creation--to create new normative selves. The artisanal model also has resources to capture and express the social situatedness, locality, and materiality of social roles. The relational ontology of social roles, implicit in the artisanal model, provides a useful frame to consider both hierarchical and oppressive social relations. (shrink)

This is an introductory book that targets the reader who has the ambition to apply economic analysis but may be missing a technical introduction to its mathematical techniques or seeks a structured elaboration of its philosophical principles. The book juxtaposes economic analysis with moral philosophy, political theory, egalitarianism, and other methodological principles and then passes to the details of methods such as model-building, derivatives, differential equations, statistical tests, and the use of computer programs.

This essay takes competitive aeromodelling as a test case for certain contentious issues in philosophy of sport. More specifically, I look at the challenge it presents to prevailing ideas of what properly counts as ?sport?, which in turn have their source in other, more basic or deep-rooted preconceptions. Among them are a range of ?common-sense? beliefs about the properly (naturally) human, the mind/body relationship, the role (if any) of scientific-technological innovation as a means of performance enhancement, and ? most fundamentally (...) ? the distinction between nature and culture in so far as it bears on these questions. My approach is broadly deconstructionist in taking them as genuine questions and in pressing hard on those unresolved problems thrown up by any attempt to secure a definition of ?sport? that would pre-emptively exclude any kind of advanced technological adjunct (or Derridean ?supplement?) that seemed to lead outside and beyond the realm of ?natural? human powers, capacities and skills. On the other hand I acknowledge ? as against ?strong?-conventionalist (e.g. Wittgensteinian) approaches ? that the category ?sport? cannot be relativised or culturally contextualised to the point where it loses all determinate sense or normative significance. My main purpose here is to assess various claims and counter-claims by running them past a fairly detailed account of competitive aeromodelling ? or one particular branch thereof ? and the kinds of difficulty it creates not only for conservative, essentialist or naturalising definitions but also for that other reactive trend towards all-out cultural-relativist or social-constructivist doctrines. In addition, though far from incidentally, I want to make the case that this is indeed a sport on any reasonable, fair, or adequately informed reckoning and that its recognition as such might help to clarify certain obscure corners of current philosophical thinking about these issues.
