This paper critically examines Alan Patten’s theory of neutrality of treatment. It argues that the theory assumes an inadequate conception of personal autonomy that undermines its plausibility. Because of this assumption the theory is unable to account for various configurations of power that work against personal autonomy. However, I suggest that the theory can resolve the problem by developing and reinterpreting its conception of autonomy and introducing an additional strategy for addressing the power misbalances that result from the market-based (...) interactions between individuals and their conceptions of the good. Liberal neutrality requires that, given the diversity of conceptions of the good life held by people, the state should be in some sense neutral between these conceptions. Just what that sense is has been a matter of debate but it seems generally accepted that neutrality is a property of the justifications for government action and not of the consequences of such action. In other words, the state must be neutral by avoiding invoking any conception of the good in (...) its justification for laws and policies and by avoiding having any laws and policies that can be justified only by reference to some conception of the good. It need not, so it seems generally accepted, ensure that the consequences of its laws and policies do not favor some conceptions of the good over others. Against this commonly held view, in this chapter I argue that justificatory neutrality is inadequate as a full picture of what liberal neutrality means and that some conception of consequential neutrality is more plausible. This article questions a number of widely held views of the role of values in psychotherapy. It begins with a discussion of the now largely discredited view that psychotherapy can be value free. It also broadens this challenge to question the popular idea that values form an inescapable part of the therapeutic encounter. While this view is correct in outline, it is necessary to reject the underlying conception of values as largely arbitrary preferences that the client and the therapist bring (...) to the encounter, as this fails to do justice to the inherently ethical nature of psychotherapy. It argues that we should recover the Greek notion of therapy as essentially concerned with the character of a person. In other words, the goal of therapy is virtue. (shrink)

The dominant approach to the subjectivity of the clinician in psychiatry is a negative one. Based on the idea of objectivity as "a view from nowhere", contemporary psychiatry stipulates that the psychiatrist's impressions and emotions may only interfere with the results of the psychiatric examination. Even the person-centered approach in psychiatry fails to address this issue directly because it focuses almost exclusively on the person of the patient. A positive approach to the psychiatrist's subjective experience has not achieved wide recognition (...) and has only been adopted in psychotherapy and in particular in psychoanalysis and psychodynamic psychotherapy. For a variety of policy reasons, governments throughout the world are now adopting different legislative and administrative strategies that support the development of FLOSS. Some governments have actually begun to procure FLOSS, whereas others have channeled public funds to large-scale FLOSS projects. This study demonstrates both the benefits and the risks of government policy favoring FLOSS from the perspective of economics, technology, and politics, and to further analyze whether these same policy goals can be achieved through government support of FLOSS. The most fundamental argument of the study is that, in lending its support to FLOSS, the difference between a government user and a business user is that the government should take into account society’s long-term interests, not merely its own interests as a consumer. We examine the use of the notion of natural selection in the philosophical debate on functions in biology. This debate has been largely shaped by the way in which different accounts assess various selective pressures in justifying claims about biological functions. Cummins (Functions: new essays in the philosophy of psychology and biology. Oxford University Press, Oxford, pp 157–172, 2002), one of the main proponents of the causal role account of biological functions, argues that a correctly understood neo-Darwinian notion of natural (...) selection has nothing to do with functional talk in biology. In this paper, we counter Cummins’ account by showing that progress in the molecular approaches to evolutionary biology—specifically scientific data available in neo-functionalization research—offers valuable support to the etiological selectionist approach to functions in biological and biologically-related sciences. Finally, we use the presented data to build our own account of biological functions, which tries to avoid the wrong turns taken by both major strands in the biological function debate, namely causal role and etiological accounts. According to our account, the function of a certain gene or a protein in the biological system that contains it is a particular causal activity, or a group of causal activities whose manifestation is in a specific way determined by corresponding mechanisms of genetic expression. Also, we argue that in many important cases this particular expression of genetic activity was positively selected at a certain point in evolutionary history. Since we take selection as an important but not the only factor that grounds biological functions, we are committed to a weak etiological account. (shrink)

Recently, constructive neutral evolution has been touted as an important concept for the understanding of the emergence of cellular complexity. It has been invoked to help explain the development and retention of, amongst others, RNA splicing, RNA editing and ribosomal and mitochondrial respiratory chain complexity. The theory originated as a welcome explanation of isolated small scale cellular idiosyncrasies and as a reaction to ‘overselectionism’. Here I contend, that in its extended form, it has major conceptual problems, can not explain observed (...) patterns of complex processes, is too easily dismissive of alternative selectionist models, underestimates the creative force of complexity as such, and – if seen as a major evolutionary mechanism for all organisms – could stifle further thought regarding the evolution of highly complex biological processes. Despite the widespread presence of public arts funding in liberal societies, some liberals find it unjustified. According to the Neutrality Objection, arts funding preferences some ways of life. One way to motivate this challenge is to say that a public goods-styled justification, although it could relieve arts funding of these worries of partiality, cannot be argued for coherently or is, in the end, too susceptible to impressions of partiality. I argue that diversity-based arts funding can overcome this challenge, because (...) it invests in non-excludable infrastructure that fosters cultural literacy. We all have some interest as citizens in living in a society which fosters cultural literacy, seeing as this helps others to understand us, supports us to understand ourselves, and helps alleviate confusion and alienation we feel toward social difference. While some of these benefits can be enjoyed by those who make and consume art, they are also gained by those who don’t, because arts funding affects the makeup of public spaces and the communicative practices we all use to make sense of the world. Neutral monism is a position in metaphysics defended by Mach, James, and Russell in the early twentieth century. It holds that minds and physical objects are essentially two different orderings of the same underlying neutral elements of nature. This paper sets out some of the central concepts, theses and the historical background of ideas that inform this doctrine of elements. The discussion begins with the classic neutral monism of Mach, James, and Russell in the first part of the paper, then (...) considers recent neo-Russellian versions in the second half. The chances for a revival of neutral monism are probably slight; its key ideas and starting points lie far from those in contemporary philosophy of mind. A better route might be through the philosophy of science and a deeper understanding of causation. (shrink)

Among the methodological rules of the social sciences we find the principles of value-neutrality and the principle of criticism. Both principles are of vital importance in the social sciences, but both seem to conflict with one another. The principle of criticism excludes value-judgments from the social sciences, because they cannot be empirically tested. Hence, criticism methodologically implies value-neutrality. Yet there is the opposing view that it is precisely the critical social researcher who looks beyond mere 'social facts' taking (...) into account the value framework of the society. Thus, criticism does not lead to value-freedom, but points to the value impact of the so-called social facts. In this paper, the two principles are stated. Then it is shown how and why they are incompatible. Finally, several suggestions are discussed to resolve this methodological conflict. (shrink)

The neutral theory of molecular evolution has been instrumental in organizing our thinking about the nature of evolutionary forces shaping variation at the DNA level. More importantly, it has provided empiricists with a strong set of testable predictions and hence, a useful null hypothesis against which to test for the presence of selection. Evidence indicates that the neutral theory cannot explain key features of protein evolution nor patterns of biased codon usage in certain species. Whereas we now have a reasonable (...) model of selection acting on synonymous changes inDrosophila, protein evolution remains poorly understood. Despite limitations in the applicability of the neutral theory, it is likely to remain an integral part of the quest to understand molecular evolution. (shrink)

Mathematics is often positioned as either neutral or non-neutral by mathematicians. However, in practice, issues of neutrality arise in situated contexts, and the positioning of mathematics as either neutral or non-neutral is done for many purposes. We interpret positioning of mathematical work, with different degrees of neutrality, as a response to conflicts of interest and power dynamics. Using a framework from ecofeminist critical theory, we examine the ways that mathematical neutrality is positioned and communicated to different audiences (...) in ways that can appear contradictory. Our goal is to demonstrate that the neutral/non-neutral dualism is insufficient for the analysis of neutrality in mathematics, which requires instead a robust analytical lens. We situate our discussion of these issues in the context of communication regarding the mathematical analysis of partisan gerrymandering in the United States. Through a study of communication to different audiences by mathematicians regarding mathematical techniques used to study partisan gerrymandering, we illustrate various ways in which dualistic views of neutrality are insufficient to describe and understand the complicated role of neutrality in this context. Scientists and engineers lack the equivalent of an ethics committee to which their colleagues in the medical profession may turn when ethical dilemmas arise. In the US workers in aerospace industry have campaigned for a Technology Bill of Rights. In the UK there has been a vigorous movement around the concept of socially useful and environmentally desirable technology. The organisation Scientists for Social Responsibility has set up a panel of scientists who can advise younger colleagues on issues of ethical responsibility.

“[A]ny truly neutral state,” writes George Sher in this important and timely new book, “must needlessly cut its citizens off from important goods”. For that reason, he argues, liberal neutrality, the view that government must remain neutral between competing conceptions of the good life, is indefensible. There is, moreover, a uniquely best, rationally defensible conception of the good life—not a subjective view that insists that all value depends on satisfying actual or hypothetical desires, but an objective view that recognizes (...) that some value depends on the realization of certain broad capacities that humans share. However, this objective or perfectionist view, as Sher calls it, is not communitarian, since it rejects the idea that society’s history or conventions must ratify its values or that civic participation or engagement in common projects must be among its recommendations. It is a liberal perfectionism, since it requires procedural and substantive liberal rights and recognizes that there are many different ways of realizing the human capacities whose exercise generates value. Hence, although government may legitimately promote the good, “the ability to promote the good is not all-or-nothing”. (shrink)

Elizabeth Barnes has recently developed an account of disability that is sensitive to the role of self-evaluation. To have a physical disability is, according to Barnes, to have a body that is merely different from the norm. Yet, as Barnes notes, some disabilities will genuinely frustrate some life plans. It may be the case, therefore, that a disability is instrumentally bad for a person and that acquiring one may be a genuine loss. Equally, however, a person may genuinely value a (...) disability such that it is instrumentally good for them and that they experience the acquiring of it as a gain. Notably, Barnes explicitly restricts this analysis to physical disabilities, leaving open the status of mental disabilities. Nevertheless, Barnes does not rule out the extension of her model to this category, and she expresses a desire to see future work on other disabilities built upon it. This article takes up this challenge, making the case that to possess a mental disability is merely to possess a minority mind. (shrink)

Some philosophers think that life is worth living not merely because of the goods and the bads within it, but also because life itself is good. I explain how this idea can be formalized by associating each version of such of a view with a function from length of life to the value generated by life itself. Then I argue that every version of the view that life itself is good faces some version of the following dilemma: either (1) good (...) human lives are worse than very long lives wholly devoid of pleasure, desire-satisfaction, knowledge, or any other goods, or (2) very short lives containing nothing but suffering are worth living. Since neither result is plausible, we ought to reject the view that life itself is good. On the view I favor, any given life may be worth living because of the goods that it contains, but life itself is neutral. (shrink)

This Article aims to draw the connection between how we conceptualize legal rights over information resources and our capacity to develop technologically neutral legal norms in the information age. More specifically, it identifies and critically examines three competing approaches to the idea of technological neutrality apparent in copyright jurisprudence. Ultimately, it is argued that true technological neutrality requires not simply the seamless expansion of legal rights into new technological contexts, but the careful, contextual recalibration of rights and interests (...) in light of shifting values and changing circumstances. As a normative principle, technological neutrality in copyright law thus demands a nuanced and relational understanding of the rights at play, and the social values that they seek to foster as technologies evolve. This paper examines the political philosophy of Liberalism with particular focus on the principles of liberal neutrality and value pluralism. These principles, which are advocated by the most prominent contemporary liberal theorists mark a significant departure from classical liberalism and its monistic approach to seeking truth and the good. I argue that the shift to neutrality and pluralism have done a disservice to liberalism and that the cultivation of discrimination skills is needed to deal with the complex tasks (...) of making decisions intelligently and effectively. According to the ideal of tolerance, the state is supposed to be neutral or evenhanded in its dealings with religious sects and doctrines. The tolerant state does not pursue policies aimed at favoring one sect over another.

(Winner of The Res Publica Essay Prize) This article defends a moderate version of state perfectionism by using Gerald Gaus’s argument for liberal neutrality as a starting point of discussion. Many liberal neutralists reject perfectionism on the grounds of respect for persons, but Gaus has explained more clearly than most neutralists how respect for persons justifies neutrality. Against neutralists, I first argue that the state may promote the good life by appealing to what can be called “the qualified (...) judgments about the good life,” which have not been considered by liberal perfectionists including Joseph Chan and Steven Wall. Then I clear up several possible misunderstandings of these judgments, and argue that: (a) moderate perfectionism does not rely on controversial rankings of values and is committed to promoting different valuable ways of life by pluralistic promotion; and (b) moderate perfectionism requires only an indirect form of coercion in using tax money to support certain moderate perfectionist measures, which is justifiable on the grounds of citizens’ welfare. Thus, I maintain that moderate perfectionism does not disrespect citizens, and is not necessarily unfair to any particular group of people. It is, in fact, plausible and morally important. The defence of moderate perfectionism has practical implications for the state’s policies regarding art development, drug abuse, public education, and so on. (shrink)

To understand differences in perspective between Kuttner and Rosenblum’s and my view of the plausibility of theory-neutral quantum experiments, meta-theoretical differences between experimental physicists and theoretical physicists are examined. According to F.S.C. Northrop the perspective of experimental physicists is more toward the operational specification of “facts,” while the perspective of theoretical physicists is more toward how theory influences how we see “facts” and, at the epistemological level, what constitutes “facts.” It is pointed out that the same difference in perspective occurs (...) among scientists in psychology. An example of how the purely experimental perspective could lead to Kuttner/Rosenblum-type impossible experiments in psychology is presented. (shrink)

Under such procedures they run the risk of attributing causation in settings where the implementation neutrality condition required for causal interpretation of parameter estimates is not satisfied.
