For a variety of policy reasons, governments throughout the world are now adopting different legislative and administrative strategies that support the development of FLOSS. Some governments have actually begun to procure FLOSS, whereas others have channeled public funds to large-scale FLOSS projects. This study demonstrates both the benefits and the risks of government policy favoring FLOSS from the perspective of economics, technology, and politics, and to further analyze whether these same policy goals can be achieved through government support of FLOSS. The most fundamental argument of the study is that, in lending its support to FLOSS, the difference between a government user and a business user is that the government should take into account society’s long-term interests, not merely its own interests as a consumer. Piracy is the greatest threat facing the music industry worldwide today. This study developed and empirically tested a model examining the antecedents of consumer attitude and behavioral intention toward music piracy behavior. Two types of music piracy behavior, unauthorized duplication/download and pirated music product purchasing, were examined. Based on a field survey in Taiwan, the results showed that attributive satisfaction, perceived prosecution risk, magnitude of consequence, and social consensus are very important in influencing customers attitude and behavioral intention toward two (...) types of music piracy behavior. In addition, singer/band idolization can affect the attitude and behavioral intention in the case of pirated music product purchasing. Perceived proximity was found to affect the attitude and behavioral intention in the case of pirated music product purchasing. However, it only influenced behavioral intention in the case of unauthorized duplication/download. (shrink)

Many perception and processing effects of the lexical status of tone have been found in behavioral, psycholinguistic, and neuroscientific research, often pitting varieties of tonal Chinese against non-tonal Germanic languages. While the linguistic and cognitive evidence for lexical tone is therefore beyond dispute, the word prosodic systems of many languages continue to escape the categorizations of typologists. One controversy concerns the existence of a typological class of “pitch accent languages,” another the underlying phonological nature of surface tone contrasts, which in (...) some cases have been claimed to be metrical rather than tonal. We address the question whether the Sequence Recall Task, which has been shown to discriminate between languages with and without word stress, can distinguish languages with and without lexical tone. Using participants from non-tonal Indonesian, semi-tonal Swedish, and two varieties of tonal Mandarin, we ran SRTs with monosyllabic tonal contrasts to test the hypothesis that high performance in a tonal SRT indicates the lexical status of tone. An additional question concerned the extent to which accuracy scores depended on phonological and phonetic properties of a language’s tone system, like its complexity, the existence of an experimental contrast in a language’s phonology, and the phonetic salience of a contrast. The results suggest that a tonal SRT is not likely to discriminate between tonal and non-tonal languages within a typologically varied group, because of the effects of specific properties of their tone systems. Future research should therefore address the first hypothesis with participants from otherwise similar tonal and non-tonal varieties of the same language, where results from a tonal SRT may make a useful contribution to the typological debate on word prosody. This study intends to explore the effects of political, social and cultural values on consumers’ ethical beliefs regarding questionable consumption behaviors. The variables examined include status anxiety, social Darwinism perception, perceived trust of people, and cultural orientation. Based on a field survey in Taiwan, the results showed that consumers with low ethical beliefs have higher perception of social Darwinism and status anxiety than consumers possess neutral and high ethical beliefs. The result also showed that the neutral ethics group had higher (...) trust on people than the low ethics groups. Finally, the high ethics group expressed significantly higher perception of vertical collectivism than those consumers of the low and neutral ethics group. (shrink)

Young migrants have been the major migrant labor force in urban China. But they may be more vulnerable in quality of life and mental health than other groups, due to their personal characteristic and some social/community policies or management measures. It highlights the need to focus on psychological wellbeing and probe driving and reinforcing factors that influence their mental health. This study aimed to investigate the influence of subjective/objective status and possible pathways of young migrants’ life satisfaction and psychological distress. (...) Data on 9838 young migrants in the China Migrants Dynamic Survey were analyzed by LISREL 8.8. A total of 94.03% migrated for jobs or business. Subjective status, including subjective socioeconomic status, social adaptation, and psychological integration, had positive effects on life satisfaction, whereas social adaptation and psychological integration negatively affected psychological distress. Objective status, including objective socioeconomic status and health insurance, had adverse effects on life satisfaction, whereas they positively affected psychological distress. Social participation and city belonging had only significant positive mediating roles on life satisfaction. It is essential to increase social adaptation and decrease integration stress according to younger internal migrants’ practical needs. It is also necessary to enhance community/social resources and activities in the context of developing sustainability in the community to assist in mental health promotion. (shrink)

Clare, the titular character of The Time Traveller's Wife, reflects that "Everything seems simple until you think about it." This might well be a mantra for the whole of philosophy, but a fair few terms tend to stick out. "Knowledge", "goodness" and "happiness" for example, are all pervasive everyday terms that undergo significant philosophical analysis. "Luck", I think, is another one of these terms. Wishing someone good luck in their projects, and cursing our bad luck when success seems so close (...) to our reach or failure could have so easily been otherwise, happens so often that we rarely stop to reflect on what we really mean. Philosophical reflection on the nature of luck has a rich tradition, that is by no stretch confined to the Western philosophical canon. However, it has only very recently become one of the goals of philosophy to provide a clear account of what luck actually amounts to. This, in part, is the goal of this thesis. The thesis has two primary motivations. The first is to offer and defend a general account of luck that overcomes the problems faced by the current accounts of luck that are available in the current philosophical literature. The second is to apply this general account of luck to the areas of metaethics and epistemology where luck has been a pervasive and problematic concept, and demonstrate how this account of luck may resolve or further illuminate some of the problems that the notion has generated. The thesis is roughly split into two parts. The first half of the thesis focuses on the former objective of offering an account of luck. Chapter 1 offers a selected history of the philosophy of luck that spans from the Ancient Greeks to the present day, so that we might properly situate the current work on luck as part of the broader historical importance of the concept. Chapter 2 will set out the major rival to the theory of luck that I will offer - the lack of control account of luck. LCAL has various iterations across the literature, but is most clearly articulated by Wayne Riggs and E.J. Coffman. Both Coffman and Riggs add and adapt their own conditions to LCAL specifically so that the account may overcome several problems that have been levied against it. These further conditions are not incompatible so, to provide the strongest lack of control account possible, I have combined them to form a lack of control account I have called Combined LCAL - LCAL. The latter part of the chapter pits LCAL against some of the problems that have been raised against LCAL. However, despite the efforts of both Riggs and Coffman, even LCAL fails to counter some of these objections. For these reasons I have rejected LCAL has a viable candidate for an account of luck. Chapter 3 sets out a modal account of luck, as argued for by Pritchard, where an event is lucky only if it occurs in the actual world, but not in a relevant set of nearby possible worlds. Here I further elaborate on how we should understand the modal distances using Lewisian possible world semantics, and what worlds should be taken into consideration when fixing the relevant set of nearby possible worlds. I argue that these relevant sets of worlds should be fixed according to the domain of inquiry of which the luck is being applied - this I call the type of luck. Examples of this is the current literature are resultant luck - the type of luck concerned with the results of our actions, and veritic luck - the type of luck concerned with the modal safety of our belief formation. Due to the multitude of types of luck across disciplinary areas, a general modal account of luck requires flexibility in what factors should fix the relevant sets of possible worlds. I achieve this by providing a [TYPE] function for the general modal account of luck, which is used as a mean of inserting the relevant fixing conditions for any domain of inquiry. Chapter 3, in a similar vein to Chapter 2, pits the general modal account of luck against some of the problems that have been levied against MAL, specifically the Buried Treasure problem raised by Lackey and the agent causation problem as raised by Levy. More successfully, the modal account offered stands up against these criticisms. For these reasons, the modal condition understood with the [TYPE] function and Lewisian semantics concerning modal distances, will be adopted to make up one half of the conditions for my account of luck. Chapter 4 will look at the second condition for an account of luck - the significance condition. The chapter will set out the reasons for adopting a significance condition at all, and some of the ways in which the condition has been articulated by Rescher, Pritchard and Ballantyne. All of these current views of the significance condition will be found wanting due to their inability to make sense of certain kinds of luck in specific normative domains. For example, Ballantyne's account of significance focuses on the interests of an agent, yet for certain types of moral luck, the interests of the agent are irrelevant. Instead, I propose a relativised significance condition, where the value of the event is relative to the value of the normative domain in which the luck is being ascribed. Epistemic luck requires a focus on the epistemic significance of the event for the agent, moral luck requires a focus on the moral or ethical significance of the event for the agent, and so on. This I call the kind of luck. Similar to the [TYPE] function for the modal condition for luck, the significance condition requires a [NORMATIVE DOMAIN] function where the relevant normative domain can be inserted depending on the kind of luck. This version of the significance condition will be conjoined with the modal condition as set out in Chapter 3 to form the correct general account of luck. Chapter 5 is the first chapter of the second half of the thesis that concerns applying the account of luck set out in part 1 to more specific domains of inquiry. Chapter 5 concerns moral luck, more specifically, resultant moral luck. Moral luck has traditionally been understood in terms of lack of control. This chapter looks at how Pritchard and Driver have attempted to understand moral luck using modal conditions. However, it is argued that these attempts would be more successful if we adopted the account of luck that I have offered in previous chapters. The chapter will go on to look at two possible problems that may be faced by this modal account of luck, and how it may resolve these problems. Chapter 6, the final chapter, looks at epistemic luck, specifically how the adoption of the modal account I have offered resolves a particular problem targeted at anti-luck epistemology by Ballantyne. The problem, Ballantyne argues, is that given that luck requires a significance condition, the degree of significance affects the degree of luck and that the degree of luck involved in our belief formation affects whether we are in a position to know the target proposition, that the result is that degree of significance affects our ability to know. For at least some instances of this - such as the aesthetic significance that we assign to the target proposition - the result will be that non-epistemic factors that have no relevance at all whether an agent is in a position to know will affect that agent's position to know. The resolution to this problem can be found in a two part solution. The first part is to demonstrate that any degree of veritic epistemic luck results in the agent failing to know. The second is that through the relativisation of the significance condition, any type of value will not affect an agent's position to know, only the epistemic value. With these two considerations in mind, the latter of which that can only be held through the adoption of the modal account of luck I have offered, the problem may be resolved. (shrink)

In 2009, health authorities from Taiwan formally attended the 62nd World Health Assembly of the World Health Organization as observers, marking the country’s participation for the first time since 1972. The long process of negotiating this breakthrough has been cited as an example of successful global health diplomacy. This paper analyses this negotiation process, drawing on government documents, formal representations from both sides of the Taiwan Strait, and key informant interviews. The actors and their motivations, along with the forums, practices (...) and outcomes of the negotiation process, are detailed. While it is argued that non-traditional diplomatic action was important in establishing the case for Taiwan’s inclusion at the WHA, traditional concerns regarding Taiwanese sovereignty and diplomatic representation ultimately played a decisive role. The persistent influence of these traditional diplomatic questions illustrates the limits of global health diplomacy. (shrink)

Speech recognition technology has played an indispensable role in realizing human-computer intelligent interaction. However, most of the current Chinese speech recognition systems are provided online or offline models with low accuracy and poor performance. To improve the performance of offline Chinese speech recognition, we propose a hybrid acoustic model of deep convolutional neural network, long short-term memory, and deep neural network. This model utilizes DCNN to reduce frequency variation and adds a batch normalization layer after its convolutional layer to ensure (...) the stability of data distribution, and then use LSTM to effectively solve the gradient vanishing problem. Finally, the fully connected structure of DNN is utilized to efficiently map the input features into a separable space, which is helpful for data classification. Therefore, leveraging the strengths of DCNN, LSTM, and DNN by combining them into a unified architecture can effectively improve speech recognition performance. Our model was tested on the open Chinese speech database THCHS-30 released by the Center for Speech and Language Technology of Tsinghua University, and it was concluded that the DLD model with 3 layers of LSTM and 3 layers of DNN had the best performance, reaching 13.49% of words error rate. Researchers' interest in the learning of vocabulary from word cards has grown alongside the increasing number of studies published on this topic. While meta-analyses or systematic reviews have been previously performed, the types of word cards investigated, and the number of word card studies analyzed were limited. To address these issues, a research synthesis was conducted to provide an inclusive and comprehensive picture of how the use of word cards by learners results in vocabulary learning. A search of the Web (...) of Science and Scopus databases resulted in 803 potential studies, of which 32 aligned with the inclusion criteria. Coding of these studies based on an extensive coding scheme found most studies assessed receptive vocabulary knowledge more often than productive vocabulary knowledge, and knowledge of vocabulary form and meaning were assessed more often than knowledge of vocabulary use. Results of effect size plots showed that more of the reviewed studies showed larger effects for the use of paper word cards than digital word cards, and for the use of ready-made word cards than self-constructed word cards. Results also indicated more studies showed larger effects for using word cards in an intentional learning condition compared with an incidental learning condition, and for using word cards in a massed learning condition compared with a spaced learning condition. Although a correlation was found between time spent using word cards and vocabulary learning outcomes, this correlation was not statistically significant. Learners that were more proficient in English learned more words from using word cards than those less proficient. These results suggest that future researchers should report learner proficiency, adopt reliable tests to assess vocabulary learning outcomes, compare the effectiveness of ready-made word cards and self-constructed word cards, and investigate the learning of different aspects of word knowledge. Teachers should provide learners guidance in how to use word cards and target word selection for self-construction of word cards. In addition, teachers should encourage learners to create word cards for incidentally encountered unknown words and use massed learning when initially working with these new words before using spaced learning for later retrieval practice. The primary aim of this paper is to provide a plausible fictional creationist explanation of when and how a fictional object comes into existence without a successful creative intention, focusing on the problem posed by Stuart Brock’s nominalist author scenario. I first present some intuitions about parallel scenarios for fictional objects and concrete artifacts as data to be explained. Then I provide a sufficient condition for the existence of artifacts that can explain both cases. An important upshot of this is (...) that there is an overlooked way to bring artifacts into existence that should merit serious consideration, and this leads to a version of the mind-dependence, but not the intention-dependence, view of artifacts. The object of this paper is to show the predominance of the influence of geometrical ideas in Aristotle's account of first principles in the Posterior Analytics— to show that his analysis of first principles is in its essentials an analysis of the first principles of geometry as he conceived them. My proof of this falls into two parts. I. A consideration of the parallel between Aristotle's and Euclid's account of first principles. II. When are logical theories equivalent? I discuss the notion of ground-equivalence between logical theories, which can be useful for various theoretical reasons, e.g., we expect ground-equivalent theories to have the same ontological bearing. I consider whether intertranslatability is an adequate criterion for ground-equivalence. Jason Turner recently offered an argument that first-order logic and predicate functor logic are ground-equivalent in virtue of their intertranslatability. I examine his argument and show that this can be generalized to other intertranslatable logical theories, which supports (...) the following: intertranslatability implies ground-equivalence. I also argue, however, that this ground-equivalence argument can be challenged as it faces a dilemma. The dilemma arises because the argument allows two distinct readings, the ‘internal’ and the ‘external’ reading. I argue that the argument turns out to be unsuccessful in both readings. The upshot of this dilemma in both philosophy of logic and metaphysics is considered. (shrink)

Background Conventional consent practices face ethical challenges in continuously evolving digital health environments due to their static, one-time nature. Dynamic consent offers a promising solution, providing adaptability and flexibility to address these ethical concerns. However, due to the immaturity of the concept and accompanying technology, dynamic consent has not yet been widely used in practice. This study aims to identify the facilitators of and barriers to adopting dynamic consent in real-world scenarios. Methods This scoping review, conducted in December 2022, adhered (...) to the PRISMA Extension for Scoping Reviews guidelines, focusing on dynamic consent within the health domain. A comprehensive search across Web of Science, PubMed, and Scopus yielded 22 selected articles based on predefined inclusion and exclusion criteria. Results The facilitators for the adoption of dynamic consent in digital health ecosystems were the provision of multiple consent modalities, personalized alternatives, continuous communication, and the dissemination of up-to-date information. Nevertheless, several barriers, such as consent fatigue, the digital divide, complexities in system implementation, and privacy and security concerns, needed to be addressed. This study also investigated current technological advancements and suggested considerations for further research aimed at resolving the remaining challenges surrounding dynamic consent. Conclusions Dynamic consent emerges as an ethically advantageous method for digital health ecosystems, driven by its adaptability and support for continuous, two-way communication between data subjects and consumers. Ethical implementation in real-world settings requires the development of a robust technical framework capable of accommodating the diverse needs of stakeholders, thereby ensuring ethical integrity and data privacy in the evolving digital health landscape. Allen Buchanan proposes a methodological framework with which theorists may evaluate different theories of secession, including the National Self-Determination theory. An important claim he makes is, because the right to secede is inherently institutional, any adequate theory of secession must include, as an integral part, an analysis of institutional morality. Because the National Self-Determination theory blatantly lacks such an analysis, Buchanan concludes that this theory is inherently flawed. In this paper, I consider Buchanan’s framework and the responses from supporters of (...) national self-determination theory. I try to clarify the confusion shared by both parties. I conclude that, although Buchanan’s theory of institutional morality is sound, his critiques of the national self-determination theory fails. (shrink)

In the early 2000s, some scholars suggested integrative ethical education as an approach to reconcile the gap between cognitive-development education, based on rule ethics, and traditional character-ethics education, inspired by character ethics in Western ethical education. Darcia Narvaez also tried to establish a comprehensive and systematic model. Nonetheless, she has indicated four questions that need further research. This paper aims to respond to Narvaez’s project and its questions from the angle of Xunzi’s ritual education. It argues that Xunzi’s thought may (...) provide some insights for Narvaez’s approach. To present this, it begins its discussion with an introduction of the main ideas of Xunzi’s thought. Later, it tries to show the insights from certain notions and elements, such as Junzi, reasoned judgment, of Xunzi’s ritual education for Narvaez’s project of integrative ethical education. Quantum interference, manifest in the two slit experiment, lies at the heart of several quantum computational speed-ups and provides a striking example of a quantum phenomenon with no classical counterpart. An intriguing feature of quantum interference arises in a variant of the standard two slit experiment, in which there are three, rather than two, slits. The interference pattern in this set-up can be written in terms of the two and one slit patterns obtained by blocking one, or more, of the (...) slits. This is in stark contrast with the standard two slit experiment, where the interference pattern cannot be written as a sum of the one slit patterns. This was first noted by Rafael Sorkin, who raised the question of why quantum theory only exhibits irreducible interference in the two slit experiment. One approach to this problem is to compare the predictions of quantum theory to those of operationally-defined ‘foil’ theories, in the hope of determining whether theories that do exhibit higher-order interference suffer from pathological—or at least undesirable—features. In this paper two proposed extensions of quantum theory are considered: the theory of Density Cubes proposed by Dakić, Paterek and Brukner, which has been shown to exhibit irreducible interference in the three slit set-up, and the Quartic Quantum Theory of Życzkowski. The theory of Density Cubes will be shown to provide an advantage over quantum theory in a certain computational task and to posses a well-defined mechanism which leads to the emergence of quantum theory—analogous to the emergence of classical physics from quantum theory via decoherence. Despite this, the axioms used to define Density Cubes will be shown to be insufficient to uniquely characterise the theory. In comparison, Quartic Quantum Theory is a well-defined theory and we demonstrate that it exhibits irreducible interference to all orders. This feature of Życzkowski’s theory is argued not to be a genuine phenomenon, but to arise from an ambiguity in the current definition of higher-order interference in operationally-defined theories. Thus, to begin to understand why quantum theory is limited to a certain kind of interference, a new definition of higher-order interference is needed that is applicable to, and makes good operational sense in, arbitrary operationally-defined theories. Die vorliegende Studie zeigt, inwieweit Kant in der Kritik der Urteilskraft versucht, die Prinzipien der theoretischen und der praktischen Philosophie durch das bloß subjektive transzendentale Prinzip der Urteilskraft zu einem System zu verbinden. Auf der Sachebene steht damit das Problem des Übergangs von der Natur zur Freiheit im Zentrum der Untersuchung. Viele Kantinterpretationen betrachten diesen Übergang entweder als unmöglich oder suchen die Möglichkeit einseitig unter der Perspektive der moralischen Freiheit zu klären. Dagegen setzt der Verfasser auf eine eingehende Analyse der (...) Selbstgesetzlichkeit der Urteilskraft in ihrer Struktur und Funktion und legt damit eine Gesamtinterpretation der Kritik der Urteilskraft vor, die sich an alle wendet, die ein intensives Kantstudium anstreben. In der Bestimmung der Urteilskraft als Vermögen der "Darstellung" und "Reflexion", was mit der innerteleologischen Auffassung der Kantischen Vernunft übereinstimmt, welche die Vernunftkritik voraussetzt, tritt der Zusammenhang mit der ästhetischen Urteilskraft deutlich hervor. Als ausführende Instanz der Vernunftprinzipien bringt die Urteilskraft in ihrem reflektierenden Wirklichkeitsbezug das Zusammenwirken der Erkenntnisvermögen ans Licht. Die Einheit der drei Kritiken sowie die Einheit der beiden Hauptteile der Kritik der Urteilskraft selbst lassen sich nicht nur dadurch begreiflich machen, sondern der Übergang vom Sinnlichen zum Übersinnlichen gewinnt auch eine pragmatische Bedeutung im Kantischen Sinne. International relations (IR) scholars have increasingly integrated Hannah Arendt into their works. Her fierce critique of the conventional ideas of politics driven by rulership, enforcement, and violence has a particular resonance for theorists seeking to critically revisit the basic assumptions of IR scholarship. Arendt’s thinking, however, contains complexity and nuance that need careful treatment when extended beyond domestic politics. In particular, Arendt’s vision of free politics—characterized by the dualistic emphasis on agonistic action and institutional stability—raises two crucial issues that need (...) further elaboration for IR research that appropriates her thinking. One involves the orientation of her international thoughts. Although Arendt shows “idealistic” aspirations for authentic politics practiced by diverse equals in an institutionally articulated space of freedom, she never loses interest in the extant situation of “non-idealistic” politics. Engaging with Arendt’s theory orientation requires a careful analysis of difficult topics, such as her distinctive conception of the political and her critiques of the nation-state and international law. The other topic that needs clarification when Arendt’s thoughts are applied to IR involves specific ways of associating different sites of power. A close examination of Arendt’s council-based federalism reveals her distinctive idea of international politics, based on her acute awareness of the fundamental complexity that lies in power association and state agency. Bringing IR topics like state agency into conversation with her works generates illuminating questions for Arendt scholarship. Likewise, the ongoing debate on agonistic and institutional features of Arendt’s thoughts can provide crucial insights into critical studies of international politics. (shrink)

Hannah Arendt’s fierce critique of sovereignty, along with her excavation of Greek agonism, has gained much traction among critical theorists of international politics who revisit the basic assumptions of conventional international theories, such as state sovereignty and power as domination. This paper engages with an increasingly popular stream within such critical international studies that appropriates Arendt’s agonism to envision a form of a global public acting in concert. I argue that Arendt’s thoughts cannot be reduced to a radical vision of (...) agonistic cosmo-politics. Rather, her thinking suggests that political actors appreciate and care for their public worlds while remaining alert to institutional ossification. Her appreciation of the constitutional state confirms that state agency is an important element of her thoughts. By examining the vicissitudes of publicity found in Arendt’s thinking and their reflexive effect on inter-polity relations, the article elucidates the grounds of her international agonism and brings home a form of international politics where states pursuing the domestic goal of greatness coexist and cooperate. Thus, the study suggests that critical scholars of radical agonism miss the important implications of an “institutional” Arendt for international politics. (shrink)

Because many involuntarily childless people have equal interests in benefitting from assisted reproductive technologies like in vitro fertilization as a mode of treatment, we have normative reasons to ensure inclusive access to such interventions for as many of these people as is reasonable and possible. However, the prevailing eligibility criterion for access to assisted reproductive technologies—'infertility'—is inadequate to serve the goal of inclusive access. This is because the prevailing frameworks of infertility, which include medical and social infertility, fail to precisely (...) capture and unify the relevance of certain involuntarily childless experiences as warranting assisted reproductive technology (ART) treatment. I argue that the least we can do for those who have an interest in accessing ARTs is to conceptualize involuntarily childless experiences in dialogue with interactionist and ecological models of disability, to outline a unified and more inclusive eligibility criterion. This study investigates the impact of cheap talk on price and participant profits using a repeated Bertrand oligopoly experiment. During the first 10 rounds, participants are not allowed to communicate with each other. Twenty additional rounds are then played in which the participants can text with one another using an instant message system. Some groups are allowed to text before every round, some before every other round, some every third round, some every fourth round, and others only every fifth round. (...) On average, when texting is allowed, groups attempt to collude to raise the price after being allowed to text. In summary, success in collusion with cheap talk is correlated with a combination of how often participants can text, the subject of their texts, and whether participants actually text when they can. It is shown that the following three common understandings of Newton’s laws of motion do not hold for systems of infinitely many components. First, Newton’s third law, or the law of action and reaction, is universally believed to imply that the total sum of internal forces in a system is always zero. Several examples are presented to show that this belief fails to hold for infinite systems. Second, two of these examples are of an infinitely divisible continuous body with finite (...) mass and volume such that the sum of all the internal forces in the body is not zero and the body accelerates due to this non-null net internal force. So the two examples also demonstrate the breakdown of the common understanding that according to Newton’s laws a body under no external force does not accelerate. Finally, these examples also make it clear that the expression ‘impressed force’ in Newton’s formulations of his first and second laws should be understood not as ‘external force’ but as ‘exerted force’ which is the sum of all the internal and external forces acting on a given body, if the body is infinitely divisible. This article investigates the impact of different emotions on trust decisions taking into account the experience of betrayal. Thus, an experiment was created that included one betrayal group and one control group. Participants in the betrayal group experienced more intense feelings governed by negative emotions than participants in the control group did. Moreover, participants in the betrayal group significantly lowered their trust of another stranger. On the other hand, we found some evidence that neuroticism exaggerated the relationship between experienced betrayal (...) and subsequent trust. (shrink)

Organizations can encourage the development of networks of loving relations and an overall culture of love that promotes flourishing. Although high-level expressions of this reality are not yet statistically normal, they are morally normative—and much can be gained from studying the relatively successful outliers. These exemplar organizations serve as pathfinders for groups that desire greater flourishing and wonder about practices that might work even in settings currently characterized by zero-sum competition. This article frames meanings of “love” and “flourishing” that are (...) practical in a business context—containing implications for other sectors characterized by a sense of collaboration, including sectors where scarcity and antagonism are normal (i.e., most human systems). For this purpose, we focus on Barry-Wehmiller, Inc. We explore some of the ritualized practices within this corporation, as reflected in the published literature and in the experiences and observations of Brian Wellinghoff (BW’s Senior Director, Leadership and Outreach), that have helped this organization to emerge as a beacon for others. We suggest that the degree to which such rituals are skillfully enacted helps to shape the flourishing experiences of the people within Barry-Wehmiller’s span of care—and serves as a beacon to those in other companies interested in learning from Barry-Wehmiller. This paper aimed to vindicate that Aristotle’s method of reaching the definition of something in Z 12 of Metaphysics is incomplete and suggest the way in which we can reach its true definition. This paper claimed that the definition reached by genus and differentia (say, “a human is a featherless, two-footed animal.”) is not true but merely a taxonomic definition¾“what a definition is like” (1038a35). The combination of essential differentiae of something does not express what it is intrinsically but what (...) other things are not, although the definition is the account of the essence. The combination of the differentiae ‘featherless’ and ‘two-footed’ are not what makes us humans in a positive sense. These differentiae simply set us apart from all other animals. Moreover, his method is arbitrary. The combination of essential differentiae is subject to change insofar as we can swap out one differentia for another. However, the essence of something cannot be changeable. In order to make “a definition like” be “a true definition,” this paper suggests another interpretation of the ultimate differentia. As he presents it, the ultimate differentia is the one that cannot be further divided. However, this paper interprets the ultimate differentia of something as its activity (ἐνέργειά) and its end (τέλος). Hence, it is necessary to combine Aristotle’s method of differentiation with the teleological ultimate differentia of something if we want to reach its true definition. Aristotle at various times refers to human as a rational animal, at other times as a featherless two-footed animal throughout his corpus. This paper suggests that one is taxonomic, an example of what definition is like, and the other one represents the achievement that can be made when we know the true end of a thing¾that is, true definition, if a human is for thinking with our logos. Tom Regan's four explanations of animal rights are examined and rejected as inadequate. A superior interest based account of animal rights is proposed. This derives an animal's right to freedom from harm from interests that are implicit in the conscious life of the animal. According to Tom Regan, there are four possible accounts for dealing with the issue of how animals should be treated: (1) the ?Kantian account?; (2) the ?cruelty account?; (3) the ?utilitarian account?; and (4) the ?animal rights (...) account? (Regan, 2001, pp. 41?55). In this paper I propose to briefly survey these four accounts and argue for a fifth view, the ?interests account?, which I believe is the most reasonable of the five accounts. (shrink)

No exact definition of an “organic” substance has been agreed upon by the chemical community and textbook definitions vary substantially. The question of what exactly constitutes an “organic” substance is explored in this paper. Various carbon-containing substances that have been by some considered to be “inorganic” are examined in an attempt to ascertain whether carbon in these compounds display different chemical behavior than what is expected of carbon in an “organic” substance. Types of substances considered are carbon allotropes, carbides, carbonates (...) and bicarbonates, cyanide and cyanate ions, carbido clusters, carbon oxides, and compounds without hydrogen.Graphic abstract. Much has been written about the ethics of humanitarian intervention in the past fifteen years. In this paper I discuss a variety of justifications that have been proposed (in fact, seven theories of justification), finding difficulties with each of them, and then I offer a theory of justification of my own. My approach to justification will differ from most of the earlier accounts in two ways. First, I begin the discussion of justification at a different point. Second, I seek to (...) expand the traditional discussion of humanitarian intervention to cover an area not usually addressed, namely, the question of the scope of justified humanitarian intervention. If humanitarian intervention is sometimes justified, precisely when is it justified? This is no merely academic question, given the belated appeal to humanitarian intervention on the part of those scrambling to provide a public justification of the war in Iraq. (shrink)

Abstract:In the writings of the Chinese Madhyamaka master Jizang (549–623 c.e.), we often read arguments that deduce universal affirmation from universal negation. In previous scholarship, this seemingly paradoxical reasoning was often explained by ascribing to Jizang a type of transcendental realism—the view that reality transcends our ordinary language, logic, and reason—and reading it as his unique way of capturing such a transcendental nature of reality. More recently, an attempt at formalizing this transcendental realist interpretation of Jizang was made by Yasuo (...) Deguchi, who suggests that Jizang could have been tinkering with a type of dialethism. This article challenges the transcendental realist interpretation of Jizang by studying strong anti-realist tendencies found across his writings, and proposes a way to understand his deduction of universal affirmation from universal negation within the boundaries of ordinary reasoning and coherently with his anti-realist philosophy by introducing the modalities of "categorical truth" and "conditional truth.". On Brandom’s view, we can understand objectivity in terms of the view that what is objectively correct potentially transcends any given attitude. But Levine challenges this view. He distinguishes between two questions of objectivity: ‘How do we grasp the concept of objectivity?’ and ‘What determines the difference between what is correct and what is merely taken to be correct?’ And he argues that Brandom’s account of objectivity fails to address the second question of objectivity. Furthermore, based on classical pragmatist views, (...) he defends an alternative account, which he calls ‘an experiential-theoretical account of objectivity’. I agree with Levine that Brandom’s structural account of objectivity can hardly answer the second question of objectivity. In this paper, however, I argue that we can answer the second question of objectivity without accepting Levine’s claim that experience has a rational bearing on the contents of empirical thoughts. A distinction between knowledge and belief is set out and justified at the end of Book V of Plato’s Republic. The justification is intended to establish the claim of the philosophers to rule in an ideal state. I set out the argument and explain why considerable disagreement remains about the nature of the distinction and the assumptions on which it rests. I discuss the main options for interpreting the justification, briefly assessing their strengths and weaknesses. The Clinical Pastoral Education (CPE) model forthe provision of spiritual care represents theemergence of a secularized professionalpractice from a religiously-based theologicalpractice of chaplaincy. The transformation ofhospital chaplaincy into “spiritual careservices” is one means by which religioushealthcare ministry negotiates modernity, inthe particular forms of the secular realm ofbiomedicine and the pluralism of thecontemporary United States healthcaremarketplace. “Spiritual” is a labelstrategically deployed to extend the realm ofrelevance to any patient's “belief system,”regardless of his or her religious affiliation.“Theological” language is recast as a (...) tool forconceptualizing the “spiritual lens.” Suchmoves transform chaplaincy from a peripheralservice, applicable only to the few “religious”patients, into an integral element of patientcare for all. Such a secularized professionalpractice is necessary to demonstrate therelevance and utility of spiritual care for allhospital patients in an era of cost-containmentpriorities and managed care economics. This article explores the claim that law is characteristically in search of the past. We argue that the structure of memory defines our relationship with the past and this relationship, in turn, has important implications for the nature of law. The article begins by examining the structure of memory, drawing particularly on the work of Henri Bergson. It then draws out the implications of Bergson’s theory for the interplay of past and present, highlighting the challenges this poses for law’s project (...) of retrieval. Law, as an artifact, seeks its origins in human action, but this often yields a static view of legal discourse as the retrieval of pivotal moments. Bergson, by contrast, shows us that past and present influence each other dynamically, giving rise to an integrated whole. The article concludes by exploring the potential for law to transcend the structure of memory. We argue that even beyond the limits of memory legal reasoning encounters a kind of residue left by the ethical foundations of law. Law searches vainly for the past, but what it finds is itself. What I want to do in this paper is focus on the way in which Deleuze might be said to 'level the levels' of the Kantian philosophy. The levels which Deleuze levels are found in the distinction between the transcendentally ideal and the empirically real. Just what is at stake in these terms? If Kant's move is to insist on the sensible, we might almost want to say that it is an insistence on a matter that matters which underlies this (...) distinction of levels. 'Almost', because we have yet to understand matter or (maybe more importantly) what it is 'to matter', for anything to be, as Deleuze suggests (following Bateson), a 'difference that makes a difference' . If, however, we were to allow that what underlies Kant's necessary insistence on the empirically real is an anti-rationalist (not anti-rational) move, a move against a 'pure thought' and in favour of a muddy, dirty thought in which the mixing up, the synthesis of concept and intuition (mind and matter), was the central guiding thread, then the way in which this synthesis is produced would be of crucial importance. Legal coercion seems morally problematic because it is susceptible to the Hegelian objection that it fails to respect individuals in a way that is ‘due to them as men’. But in what sense does legal coercion fail to do so? And what are the grounds for this requirement to respect? This paper is an attempt to answer these questions. It argues that legal coercion fails to respect individuals as reason-responsive agents; and individuals ought to be respected as such in virtue (...) of the fact that they are human beings. This dissertation analyzes the three main philosophical movements which informed the intellectual world of Paul and his Greco-Roman contemporaries during the 1st century B.C.E. through the 2nd century C.E. In Part I, I analyze the moral transformation systems of the Middle Platonists , Neo-Stoics , and Greco-Roman Epicureans . I pay attention to the language of power in the analyses of Chapters 1--3, and to how power plays a salient role in philosophical discussions on the passions and on their role (...) in moral progress. What emerges from Part I are the following main conclusions: Despite the very different conceptualizations of the passions in Platonism, Stoicism, and Epicureanism, all three schools nonetheless viewed desire as a form of power and self-mastery over them as an expression of the sage's power. The power of the philosopher was the power of sight. That is, the sage saw himself and his potential errors correctly; and the sage saw the moral standard according to which one should conform. ;Part II is an attempt to show how a study of ancient philosophy of mind can help inform our understanding of Paul's letter recipients and Paul himself. The test case is the situation at Roman Corinth. Of all the philosophies of mind discussed in Part I, I make the initial case that the ideological framework which best explains the attitudes of the Corinthian strong over such issues such as sex with prostitutes is Epicurean philosophy and their ethics of the stomach. Sex is a natural desire and so is permissible in their moral framework. Finally, Chapter 5 examines extensively the external evidence for an Epicurean movement in the city of Roman Corinth. It makes the case for the presence of Epicurean converts among Corinth's urban leadership who, as immigrants, moved to Corinth from neighboring Greek cities and from Rome itself when Corinth was refound as a Roman colony in 44 B.C.E. The greatest epigraphic evidence for Corinthian Epicureans are the inscriptions dedicated to Junia Theodora and Gallio. (shrink)

The aim of the following paper is, firstly, to provide the reader with a brief exposition of the critical response offered by some current french feminists of the largely American, compensatory approach to feminist historiography. Secondly, I wish to show why the french feminist alternative itself provides an inadequate methodology for the resolution of the problems that it raises in its critique. Lastly, I shall suggest that the Wittgensteinian concept of ‘family resemblance’ contains the seeds of a plausible alternative to (...) either the compensatory or the french structuralist approach to feminist historiography. The upshot of this latter claim is that the historical subject may be most fruitfully conceived genealogically, that is, as the dynamic product of an inexhaustible complex of historical and contextual resemblances constructed on the behalf of a specific interpretational task. The ‘byproduct account’ of female orgasm, a subject of renewed debate since Lloyd (The case of the female orgasm, Harvard University Press, Cambridge, 2005), is universally attributed to Symons (The evolution of human sexuality, Oxford University Press, Oxford, 1979). While this is correct to the extent that he linked it to the adaptive value of male orgasm, I argue that the attribution of the theory as we understand it to Symons is based on a serious and hitherto unrecognised misinterpretation. Symons (...) had a different explanation of why women can orgasm, and beneath this explanation lies an obscure line of argument, including a particularly obscure use of the word ‘homologous’. In this pilot study we investigated the vocal strategies of Cantonese women when addressing an attractive vs. unattractive male. We recruited 19 young female native speakers of Hong Kong Cantonese who completed an attractiveness rating task, followed by a speech production task where they were presented a subset of the same faces. By comparing the rating results and corresponding acoustic data of the facial stimuli, we found that when young Cantonese women spoke to an attractive male, they were less breathy, (...) lower in fundamental frequency, and with denser formants, all of which are considered to project a larger body. Participants who were more satisfied with their own height used these vocal strategies more actively. These results are discussed in terms of the body size projection principle. (shrink)

This paper aims to clarify the influence of Husserl’s phenomenology upon Schutz’s phenomenological sociology. In developing his phenomenologicalsociology, even though Schutz was deeply influenced by Weber, he considers that the interpretative sociology developed by the latter has some difficulties. It is Husserl’s phenomenology that enabled him to overcome the difficulties of Weber’s interpretative sociology and to found a phenomenological sociology as an interpretative sociology in a true sense. In section 1, I will deal with the significance and difficulties of Weber’s (...) interpretative sociology. In section 2, I will deal with the influence of Husserl’s phenomenological psychology and furthermore, in section 3, the influence of Husserl’s transcendental phenomenology on Schutz’s phenomenological sociology. In section 4, I will mention that there are some motives in Husserl’s later phenomenology that could be useful for the development of the phenomenological sociology. (shrink)

This article seeks to understand contractual rights through an examination of the possible ‘property’ content in contracts in the context of the inducement tort and conversion. It argues that, contrary to popular perception, contracts and property are different shades of a similar phenomenon. Not being a reified ‘thing’ with stable features and structure, property is a relative rather than an absolute concept. To determine whether the holder of an intangible resource ought to be conferred with ‘property’ or exclusive control of (...) access to such resource, one has to evaluate the relevant practical, legal and moral considerations. Applied to the context of inducing breach of contract and conversion, this analysis demonstrates that a contractual right is in fact a composite collection of distinct interests and each tort may be protective of one or more of such interests. Thus, liability is imposed for inducing breach of contract because tort law recognizes the promisee's exclusive right to the peremptory status of the promisor's promise. On the other hand, the wrongfulness of converting a contract lies in the usurpation of a contracting party's control, or the exclusive entitlement to decide whether and how to exercise her rights under the contract. This chapter explores ways in which Roland Barthes's discussion of the encyclopaedia provides resources for thinking about education and research practice today. It begins with Barthes's analysis and critique of the Encyclopedie. Barthes, writing in 1964, engages with the Encyclopedie as an iconic product of its time, seeing it as conditioned by and, in effect, reinforcing a particular way of experiencing the world. The chapter considers ways in which a parallel critique is pertinent today and explores some current examples of (...) encyclopaedic form in relation to education and educational research. It examines the interplay between particular cultural products and their society, in which not only certain types of knowledge but also certain conception knowledge are produced and reinforced. The chapter presents particular understanding of language and knowledge that arises through these cultural products, particularly with regard to educational inquiry. (shrink)

According to the dominant account of harming, to harm an agent is to cause her to occupy a harmed state. Matthew Hanser rejects this “state-based” account, arguing that each version of it faces counterexamples. Instead, Hanser argues, to harm an agent is to cause her to suffer harm, where suffering harm is undergoing an event: in particular, it is losing or being prevented from receiving a basic good. In this thesis, I argue that this “event-based” account is, at best, a (...) version of the state-based account. The identity of any event as the suffering of a harm, I argue, derives from the fact that it causes the agent to occupy a harmed state. I then defend the “counterfactual comparative” version of the state-based account against three prominent objections. The intended upshot of my arguments is that the state-based account of harming is superior to its event-based counterpart. (shrink)

In his theory of interpretation, Peirce’s attention is drawn to the work of “mind,” especially its appropriation of signs. Mind interprets nature by using signs in every form of inquiry. Based on his three categories, Peirce defines interpretation as a determinate process of interpretations of interpretations. Communicative process thus means, instead of just being determined as an interpretant by an object, that the interpreter is determined by a “communicative effort.” In the communicative effort, for Peirce, temporal unit is the necessary (...) condition of meaning. In other words, in order to mean something, the communicative effort has to be performed in a continuum from a past to a future. Concealed possibilities can be actualized when the continuum is “broken,” genuinely divided. Peirce truly acknowledges that the possibility can be actualized when it is broken into parts. (shrink)

At present, there is a widely shared doubt about theoretical or practical validity of “nation state” as a framework to grasp the reality of the social. This doubt legitimately boils down to a more fundamental question, within or without the realm of social science, that is, whether or not the current conceptualization of the social is caught in a sort of anachronism that blocks thinking and acting in terms of transforming reality. In this paper, I would like to delineate the (...) situation not merely as a theoretical shortcoming of cotemporary social science but as a challenge: a call for reactivated social sensitivity. In an effort to meet this challenge, the socio-political significance of dialogue and human plurality as its critical element will be elaborated in search of cosmopolitan opening to the ways to think and act for the social in the making.
