The Strange Situation procedure was developed by Ainsworth two decades agoas a means of assessing the security of infant-parent attachment. Users of the procedureclaim that it provides a way of determining whether the infant has developed species-appropriate adaptive behavior as a result of rearing in an evolutionary appropriate context, characterized by a sensitively responsive parent. Only when the parent behaves in the sensitive, species-appropriate fashion is the baby said to behave in the adaptive or secure fashion. Furthermore, when (...) infants are observed repeatedly in the Strange Situation,the pattern of behavior is said to be highly similar, and this pattern is said to predict the infants' future behavior in a diverse array of contexts. After an exhaustive review of the literature, it is shown that these popular claims are empirically unsupported in their strong form, and that the interpretations in terms of biological adaptationare misguided. There is little reliable evidence about the specific dimensions of parental behavior that affect Strange Situation behavior, although there does appear to be some relationship between these constructs. Temporal stability in security of attachment ishigh only when there is stability in family and caretaking circumstances. Likewise, patterns of Strange Situation behavior only have substantial predictive validity in similarly stable families. Implications for future research and theorizing — particularly as they relate to the use of evolutionary biology in psychological theory — are discussed. (shrink)

Position papers on artificial intelligence (AI) ethics are often framed as attempts to work out technical and regulatory strategies for attaining what is commonly called trustworthy AI. In such papers, the technical and regulatory strategies are frequently analyzed in detail, but the concept of trustworthy AI is not. As a result, it remains unclear. This paper lays out a variety of possible interpretations of the concept and concludes that none of them is appropriate. The central problem is that, by framing (...) the ethics of AI in terms of trustworthiness, we reinforce unjustified anthropocentric assumptions that stand in the way of clear analysis. Furthermore, even if we insist on a purely epistemic interpretation of the concept, according to which trustworthiness just means measurable reliability, it turns out that the analysis will, nevertheless, suffer from a subtle form of anthropocentrism. The paper goes on to develop the concept of strange error, which serves both to sharpen the initial diagnosis of the inadequacy of trustworthy AI and to articulate the novel epistemological situation created by the use of AI. The paper concludes with a discussion of how strange error puts pressure on standard practices of assessing moral culpability, particularly in the context of medicine. (shrink)

In this paper, I will consider a unique case where changing one’s character is part of a process of moral betterment when facing oppression. By engaging with the Dutch-Jewish intellectual and Holocaust victim Etty Hillesum, I will highlight the situated dimension of moral betterment as a practice that is driven by the pressure of concurrent events. I will claim that moral betterment does not just come out of an internal will to change for the better. Instead, I will argue that (...) “bearing real suffering” (Hillesum 1996: 220) is what makes compassion a potential source of moral betterment. This is possible because in compassion, one experiences emotional friction between weakness and strength in facing the suffering caused by oppression. (shrink)

Over the past five centuries, those who translate the Greek New Testament for English readers have increasingly found it appropriate to do so without recourse to a human soul. This is not simply a case of linguistic slippage, but the consequence of sustained exploration of the social‐historical milieu within which the New Testament writers lived and wrote. This chapter explains three areas of inquiry. First, the significance of historical inquiry for situating the New Testament materials more securely within their first‐century (...) milieu as a prophylactic against colonizing New Testament perspectives, in this case, with foreign assumptions about theological anthropology. Second, the significance of sociocultural forms of inquiry, including medical anthropology and social psychology, for shaping our understanding of humanity in the New Testament world. The era of AI-based decision-making fast approaches, and anxiety is mounting about when, and why, we should keep “humans in the loop” (“HITL”). Thus far, commentary has focused primarily on two questions: whether, and when, keeping humans involved will improve the results of decision-making (making them safer or more accurate), and whether, and when, non-accuracy-related values—legitimacy, dignity, and so forth—are vindicated by the inclusion of humans in decision-making. Here, we take up a related but distinct question, which has eluded the (...) scholarship thus far: does it matter if humans appear to be in the loop of decision-making, independent from whether they actually are? In other words, what is stake in the disjunction between whether humans in fact have ultimate authority over decision-making versus whether humans merely seem, from the outside, to have such authority? Our argument proceeds in four parts. First, we build our formal model, enriching the HITL question to include not only whether humans are actually in the loop of decision-making, but also whether they appear to be so. Second, we describe situations in which the actuality and appearance of HITL align: those that seem to involve human judgment and actually do, and those that seem automated and actually are. Third, we explore instances of misalignment: situations in which systems that seem to involve human judgment actually do not, and situations in which systems that hold themselves out as automated actually rely on humans operating “behind the curtain.” Fourth, we examine the normative issues that result from HITL misalignment, arguing that it challenges individual decision-making about automated systems and complicates collective governance of automation. Wang We might say that in deconstruction history is always posed as a question, at once urgent, ubiquitous, and insoluble, whereas ideological demystification conceives of its relation to history as an answer, a solution, to its critical hermeneutic. Certainly, this critical truism has special force in Romantic studies, (...) a field very much shaped by the complex relation between deconstruction and ideological critique over the last twenty-five years. But it could just as well be said that the full implications of this relation are especially clarified by the field of Romantic studies, not least because its object of study replays the tensions between these two modes of inquiry. Studying Romanticism means knowing it as a historical period but also knowing it as a figure that stands for something else: an aesthetic practice, a form of consciousness, a political aspiration, an ideology, the possibility of historicity itself. That as a figure Romanticism can be either transhistorical or tied to its historical identity makes its situation all the more complicated and compelling. Romanticism especially dramatizes the interlocking relation between period identity and trope, and the investment of literary studies in that dynamic. Romanticism is the period metaphor that both stabilizes and disrupts the very concept of period metaphors.1 The deconstruction and demystification of Romanticism is very much about the deconstruction and demystification of history, its existence as either question or calculation, trope or immanent being.But even as Romanticism asserts its special relation to history it must also confront an opposite trajectory, how its meaning is best understood through a constellation of other, larger historical identities, such as the Enlightenment and modernity itself. At present the potential disciplinary reorganization of Romanticism into the long eighteenth century is the most vivid academic expression of the question, where does the historical specificity of Romanticism reside, within itself or something larger, or both?Sorting this issue out is certainly a historical proposition, but as Romanticism's special relation to history reminds us, it is also, in Paul de Man's sense, rhetorical. Which is to say, Romanticism's relation to history is, paradoxically, not special-or, more precisely, it is a trope for something pervasive among all the period fields of literary studies, insofar as they remain particular and distinct from one another. This book explores and explains the reasons why the idea of universal history, a form of teleological history which holds that all peoples are travelling along the same path and destined to end at the same point, persists in political thought. Prominent in Western political thought since the middle of the eighteenth century, the idea of universal history holds that all peoples can be situated in the narrative of history on a continuum between a start and an end point, between (...) the savage state of nature and civilized modernity. Despite various critiques, the underlying teleological principle still prevails in much contemporary thinking and policy planning, including post-conflict peace-building and development theory and practice. Anathema to contemporary ideals of pluralism and multiculturalism, universal history means that not everyone gets to write their own story, only a privileged few. This paper examines Plato’s Sophist with particular attention to the cast of characters and the most curious and complicated dramatic situation in which Plato places this dialogue: the dramatic proximity of surrounding dialogues and the impending trial, conviction, and death of Socrates. I use these considerations as a propaedeutic to the raising of questions about how these features of the dialogue might affect our interpretation of the actual positions espoused in the Sophist. One clear effect of these considerations will (...) be to destabilize the commonly held view that in this dialogue Plato is “replacing” Socrates and Socratic aporia and questioning with the more didactic, formalistic, and doctrinal conception of philosophy espoused by the Eleatic Stranger. The multiple-choice video game Life is Strange was described by its French developers as a metaphor for the inner conflicts experienced by a teenager in trying to become an adult. In psychological work with adolescents, there is a stark similarity between what they experience and some concepts of existentialist philosophy. Sartre’s script for the movie Les Jeux Sont Faits (literally ‘‘games are made’’) uses the same narrative strategy as Life is Strange—the capacity for the main characters to travel (...) back in time to change their own existence—in order to stimulate philosophical, ethical, and political thinking and also to effectively simulate existential ‘‘limit situations.’’ This article is a dialogue between Sartre’s views and Life is Strange in order to examine to what extent questions such as what is freedom? what is choice? what is autonomy and responsibility? can be interpreted anew in hybrid digital–human—‘‘anthrobotic’’—environments. Alfred Schutz identified two different approaches to the problem of intersubjectivity. The first is the transcendental, which maintains the primacy of subjectivity, and identifies the problem of the other as a transcendental problem. For example, in Husserl’s phenomenological idealism, all meaning is relative to a transcendental constituting subject. Hence the “problem of intersubjectivity” is to show how the other comes to be constituted, comes to be meant as a sense. The difficulty with such an approach is that if the other (...) is a meaning relative to and analogous to the constituting subject, the transcendence and irreducibility of the other to consciousness seem to be undermined. Transcendental idealism never reaches the “other” because the other is precisely what I do not constitute, but can only encounter. The recognition of the inadequacy of the transcendental approach leads to a second, namely, the other is encountered on the basis and background of the natural attitude and/or life-world. When the transcendental approach is abandoned, the “problem of the other” turns into a series of descriptions of either encounters or social situations. Ontology is replaced by critical theory of society. In either case, an ontology of intersubjectivity seems to be excluded. (shrink)

Baylis, Tomlinson, and Hoffmaster each raise a number of critiques in response to Bliton's manuscript. In response, we focus on three themes we believe run through each of their critiques. The first is the ambiguity between the role of ethics consultation within an institution and the role of the actual ethics consultant in a particular situation, as well as the resulting confusion when these roles are conflated. We explore this theme by revisiting the question of What's going on? in (...) clinical ethics consultations. Moving from those issues associated with the role of the ethics consultant to those associated with the role of inquiry within the practice of ethics consultation, we then take up the serious challenge that Bliton seems shackled by the assumptions and institutional dispositions embedded in the medical culture in which he is working. This reveals the second theme, namely that there is a risk of co-optation when acting in a role that derives its legitimacy from institutional sources. Finally, we focus on an even more problematic implication stemming from the first two, namely that the focus on institutional power as the crucial factor for determining ethical significance has the effect of distorting, and perhaps obscuring, other forms of relational, interpersonal, and moral meaning. Philosophical preoccupation with the hard problem of self-consciousness often takes human becoming for granted. In archaeology, the opposite is the norm. The emphasis is on when and how we became human while the problem of self (how did the ability to think about one’s own self come about? ) is largely neglected. This article suggest that those two aspects of human becoming cannot be meaningfully disentangled: humans are both persons and members of a species. I argue that people are (...) class='Hi'>STRANGE. I use the acronym STRANGE to describe the Situated TRANsactional and GEnerative process by which the human species (nature) and the human self (culture) become co-constituted in the lived space of material engagement. I propose that to study this middle space of self-becoming a synergy of enactive and situated perspectives from philosophy and archaeology is needed. Drawing on material engagement theory I sketch out my vision of what this synergy entails based on the notions of self-bounding, enactive in/dividuation, and the situated person perspective. I use the archaeological examples of stone knapping (toolmaking) and early body ornamentation to substantiate some of the main issues and methodological challenges. (shrink)

Our different senses put us in contact with the same world. In this paper, I use unusual objects and situations to bring out structural dissimilarities in the way our senses relate to the same world of material objects. In the first part, I briefly discuss the perceptual presence of spatial and material things. Using uncommon objects allows me to treat this issue without any need to invoke what it is like to have visual experiences. What comes to the fore in (...) these analyses, however, seems less obvious in experiences of the other senses. Therefore, in the second part, I propose a strategy, invoking unusual situations, to weed out the multisensory associations that enrich our normal relation to objects, in order to get a better grip on the perceptual correlate of the different senses. Although the actual correlates of the senses may not be material objects in each case, I explain why they are nonetheless occurrences in a spatial and material world. (shrink)

Attachment is an emotional bond between two people where one seeks care from the other. In the prototypical case, the child attaches to their mother. The most recent theoretical developments point out that attachment is multidimensional – meaning that the phenomenon pertains to multiple domains related to the relationship with the caregiver. However, researchers have so far modeled attachment computationally by mostly adopting a classical categorical (as opposed to dimensional) standpoint that sees the system as controlling caregiver proximity. In contrast, (...) we adopt here adimensional perspective(DP) and consider dimensions to be the system’s set-goals. We hypothesize that the resulting multidimensional controller should lead to valid (or even better) models of the phenomenon. To start testing this hypothesis, we built a DP-informed agent-based model of attachment inspired by the widely-studied Strange Situation Procedure. In this context, child and mother show the nature of attachment bonds through their behavioral and emotional expressions. By modeling them as point-agents moving in a two-dimensional arena, we simulated child-mother interactions for the avoidant and ambivalent attachment dimensions. The generated dynamical patterns – characterized by the alternation between approach and exploration – matched those described in the attachment literature, thereby confirming the implementability and validity of the DP. Hauerwas's refusal to translate the argument displayed in "With the Grain of the Universe" (his recent Gifford Lectures) into language that "anyone" can understand is itself part of the argument. Consequently, readers will not understand what Hauerwas is up to until they have attained fluency in the peculiar language that has epitomized three decades of Hauerwas's scholarship. Such fluency is not easily gained. Nevertheless, in this review essay, I situate Hauerwas's baffling language against the backdrop of his corpus to show (...) at least this much: "With the Grain of the Universe" transforms natural theology into "witness." In the end, my essay may demonstrate what many have feared, that Hauerwas is, in fact, a Christian apologist-though of a very ancient sort. (shrink)

Researching two different work settings, police work and hospice care, the authors experienced a strange sense of discomfort in their bodies during their fieldwork when investigating professional training and work situations, especially in encounters with citizens and patients. In some of those situations, the authors withdrew physically or mentally from the situation without wanting to do so, feeling emotionally affected by the uncertainty of the situations, not fully grasping the meaning of what was going on. In a (...) class='Hi'>strange way they felt awkwardly detached from their research activities and their bodily involvement in their fieldwork. In this article, the authors seek to explore the meaning of awkwardness embedded in some kinds of ethical dilemma. Through a phenomenological analysis based on the concept of intentionality of the body and a model of inner dilemmas, they reach a renewed understanding on the phenomenon of awkwardness as a natural way for researchers to respond to challenging fieldwork situations. Finally, they propose and unfold mutual interviewing and cooperative analysis as methods of investigating researcher's subjectivity in facing such situations. (shrink)

La chose est d’autant plus étonnante qu’aux lendemains immédiats de Vatican II, Karl Rahner s’inquiétait de « l’étrange silence » des théologiens au sujet du Maître d’Aquin. Comme il se doit dans un article de bilan, J.-P. Torrell commence par dresser un tableau des éditions, biographies et traductions dont S. Thomas a bénéficié depuis 1974, année de célébration du septième centenaire (...) de sa mort. Après quoi, dans une seconde partie, il donne les « Orientations » dans lesquelles s’engagent aujourd’hui les études thomistes, insistant davantage sur la production théologique plutôt que sur la production philosophique, étant donné l’abondance et la complexité de cette dernière, tenant compte pour cela des productions américaines et allemandes autant que des productions francophones.A look at present day theological literature shows a fairly dense flowering of works on Saint Thomas. This is all the more astonishing as, just after Vatican II, Karl Rahner was uneasy about “the strange silence” of theologians concerning Master Aquinas. As expected in an overview, J.-P. Torrell begins by giving a list of publications, biographies, and translations on St. Thomas since 1974, the year of the celebration of the seventh centenary of his death. In the second part, he presents the “Orientations” of Thomistic studies today, insisting more on the theological production rather than the philosophical. In philosophical discourse, the notion of freedom demands rigorous examination. Traditionally, a distinction has been made between negative freedom (freedom from external constraints that impede one's self-realization) and positive freedom (freedom to utilize one's own capabilities). In the essay "A Strange Freedom: New Meanings of Liberalism and Humanism in the 21st Century [De vreemde vrijheid. Nieuwe betekenissen van vrijzinnigheid en humanisme in de 21ste eeuw]," philosopher and theologian Laurens ten Kate proposes a conceptualization of freedom that transcends this traditional (...) dichotomy. This is a creative freedom that is no longer bound to self-realization, but manifests itself precisely at the moment when the self is called into question. -/- The approximately seventy-page essay was published by Sjibbolet Publishers, a small, independent publishing house that emphasizes hermeneutics and is mostly known for publishing several translations of Giorgio Agamben's works into Dutch. In addition to these translations, Sjibbolet also publishes original Dutch-language philosophical works that merit inclusion in this category. The name Sjibbolet is derived from the work of Jacques Derrida and denotes the boundary between the self and the other. As the title "The Strange Freedom" suggests, this essay also explores this boundary. It is an expanded version of Ten Kate's inaugural address, delivered upon accepting the chair of Liberal Religiosity and Humanism [Vrijzinnige religiositeit en humanism]. Two closely intertwined themes are central to the work: the liberal condition and alien freedom. -/- In the Dutch word "vrijzinnigheid [liberal]” the root word "vrijheid [freedom]" is already present, accompanied by the root word "zin [sense]." In the first part of his essay, Ten Kate focuses primarily on sense in relation to what he terms the liberal condition. He states, "Freedom is not primarily a choice of a particular philosophy of life, but a situation to which everyone participates to some extent and to which one must relate (...)." According to Ten Kate, this is the situation in which the meaning of human life is no longer given nor received from above, but must be constructed. (shrink)

This article—mainly referring to the situation in Germany—consists of three parts. In a first section the current presence of neurosciences in the public discourse will be described in order to illuminate the background which is relevant for contemporary educational thinking. The prefix ‘neuro-’ is ubiquitous today and therefore concepts like ‘neuropedagogy’ or ‘neurodidactics’ seem to be in the mainstream of modern thinking. In the second part of the article the perspective changes from the public discourse to the disciplinary discourse; (...) a brief excursus into developmental psychiatry, neuropsychology and modern psychoanalysis will be made in order to demonstrate how the results of neuroscientific research are integrated in their theoretical frameworks. These three disciplines have no difficulty in integrating neuroscientific findings because each of them possesses a systematic core composed of ‘native concepts’. In contrast to them, educational theory has much more difficulty with such integration, as will be shown in the third part of the essay. On the one hand, neuroscientific thinking seems to be able to dominate education rather easily and without great resistance, especially in the fields of early childhood education, instruction and learning—mainly by simplifying educational processes and by reducing the complexity of the educational task to a mere ‘relationship problem’. On the other hand, this attraction of neuroscience in education might be understood as the reflection of a theoretical deficit in educational theory itself, with the significance of affect and emotion not receiving proper attention. In an article recently published in this journal, I raised a puzzle about the control of genetic information, suggesting a situation in which it might turn out that we have a duty to remain in ignorance about at least some aspects of our own genome. In this article, I propose a way that would make sense of how the puzzle arises, and offer a way to resolve it and similar puzzles in future: in essence, we would consider genetic information (...) to be something the distribution of which may be more or less just. We would not know in advance what a just distribution would be, though, and in some cases there might still be a justice-based reason to deny a person genetic information about himself. However, others might also have justice-based claims to be able to access that information. This suggests that there is a possible world in which one person is entitled to at least some genetic information about another, while that other person—to whom the information refers—is not, and that this world would be just. This paper examines the political and ethical problems which arise in the course of undertaking participatory research in developing countries. It argues that, rather than supplanting relationships of power within the knowledge creating process, most participatory research actually strengthens them. Instead a more complete form of dialogic research is required, which will involve struggles within our academies as well as in those other organisations in which our research is situated.

In recent years, the claim of the unrepresentability of the Shoah has stirred vivid debates, especially following the strong positions taken by the French filmmaker Claude Lanzmann and author of Shoah (1986). This claim of unrepresentability, it can be shown, draws part of its attraction from the fact that it oscillates undecidedly between a claim of logical impossibility (“the Shoah can’t be represented”) and a normative demand (“the Shoah shouldn’t be represented”). This essay analyzes the argumentative structure of the advocates (...) of the unrepresentability and shows why the often made connection to Kant is flawed. Although his Critique of the Power of Judgment affirms indeed that the prohibition of representation is the “perhaps most sublime passage in the Jewish Law”, turning the prohibition of representation into a supposedly Kantian claim does not hold grounds. The essay reconstructs the political framework of the debate, situates the Kantian passage in its precise philosophical context and then successively assesses the main arguments put forward by Jean-Luc Nancy, Jacques Rancière and Georges Didi-Huberman in their critique of Lanzmann’s categorical imperative. While showing why the rhetoric of the “unrepresentable” bear troubling structural analogies to what they want to fight (i.e. the politics of erasure, which always also include the erasure of the traces of erasure), a certain notion of the “unrepresentable” is rescued nevertheless at the end of the essay. Representation, so it is argued by returning to a Kantian distinction, is not a matter of Kanon, but a matter of Organon, which then puts the debate about the Sublime (which took place between Lyotard and Rancière in the 90’s) into a new perspective. Three visual habituation studies using abstract animations tested the claim that infants’ attachment behavior in the Strange Situation procedure corresponds to their expectations about caregiver–infant interactions. Three unique patterns of expectations were revealed. Securely attached infants expected infants to seek comfort from caregivers and expected caregivers to provide comfort. Insecure-resistant infants not only expected infants to seek comfort from caregivers but also expected caregivers to withhold comfort. Insecure-avoidant infants expected infants to avoid seeking comfort from caregivers and expected (...) caregivers to withhold comfort. These data support Bowlby’s (1958) original claims—that infants form internal working models of attachment that are expressed in infants’ own behavior. (shrink)

The proper method for dealing with meta-ethical questions in introductory ethics courses requires that the instructor consider and address at least some of the meta-ethical views most commonly held by the instructor's own students. Too often the meta-ethical views that students bring to their courses are simply ignored,.and the relation of these views to the highly abstruse theories and positions discussed in the readings and in class is not made clear. It may be the case that many popular meta-ethical views (...) are confused, unclear, ill-supported, and subversive to the values presupposed by a rational inquiry into morality. But if this is true, then it is all the more important to address these popular views.' For students' uncritical acceptance of them can be a distinct hindrance to getting them to think critically about moral questions. Many popular beliefs about the status of morality deny the possibility of a rational inquiry about moral questions. These preconceptions must be addressed and attended to, otherwise some of our students are unwilling to engage in the kind of critical and rational reflection'on moral questions that we aim to achieve in courses in moral philosophy. We face a strange situation, in that many of our students come into our classes with the firm, if not always clearly formulated, belief that there is no point in trying to do what we are doing. It is almost impossible to get anywhere in our classes unless we can persuade our students to at least suspend this belief. This paper addresses one set or family of preconceptions about the status of moral judgments which, I think, needs to be considered in introductory ethics courses. My special concern will be the views and attitudes of students who think it objectionable or in some sense wrong to make moral judgments, and, therefore, objectionable or wrong to engage in philosophical reflection which has as its aim the rational justification of moral judgments. IntroductionChildhood maltreatment is a developmental risk factor and can negatively influence later psychological functioning, health, and development in the next generation. A comprehensive understanding of the biopsychosocial underpinnings of CM transmission would allow to identify protective factors that could disrupt the intergenerational CM risk cycle. This study examined the consequences of maternal CM and the effects of psychosocial and biological resilience factors on child attachment and stress-regulatory development using a prospective trans-disciplinary approach.MethodsMother-child dyads participated shortly after parturition, after 3 months, (...) and 12 months later. Mothers’ CM experiences were assessed at t0, attachment representation at t1 and psychosocial risk and social support were assessed at t1 and t2. At t2, dyads participated in the Strange Situation Procedure. Children’s attachmen status were classified as organized vs. disorganized, including their level of disorganized behavior, and heart rate and respiratory sinus arrhythmia were recorded as stress response measures of the autonomic nervous system. Maternal caregiving during SSP was assessed using the AMBIANCE scale. Child’s single nucleotide polymorphisms rs2254298 within the oxytocin receptor and rs2740210 of the oxytocin gene were genotyped using DNA isolated from cord blood.ResultsMaternal CM experiences were significantly associated with an unresolved attachment status, higher perceived stress and more psychological symptoms. These negative effects of CM were attenuated by social support. As expected, maternal unresolved attachment and child disorganized attachment were significantly associated. Maternal caregiving did not mediate the relationship between maternal and child attachment but influenced children’s HR and RSA response and disorganized behavior. Moreover, the rs2254298 genotype of the OXTR gene moderated the stress response of children from mothers with CM. Children carrying the rs2740210 risk allele of the OXT gene showed more disorganized behavior independent from maternal CM experiences.ConclusionWe replicated and extended existing CM and attachment models by co-examining maternal attachment, social support, and child genetic susceptibility on child attachment and cardiovascular stress regulation. The findings contribute to an extended understanding of risk and resilience factors and enable professionals to target adequate services to parents and children at risk. (shrink)

In legal methodology (usul al-fiqh), the problem of the defining istiḥsān and the legitimacy of its definition is among the critical discussion topics. To overcome the rigorism of law, istiḥsān was used by the founder scholars of Ḥanafī school of law and Malik b. Anas - however this use received various objections. Although the Mālikī scholars also used istiḥsān strong criticisms of istiḥsān have been directed on the Ḥanafīs. After the severe criticism of Muḥammad b. Idrīs al-Shāfiʿī, the Ḥanafī scholars (...) carried out various intellectual activities to define istiḥsān and to prove that it is legitimate. This process -which started especially with Abū’l-Ḥasan al-Karkhī and Abū Bakr al-Jaṣṣāṣ, revealed a rich accumulation with the contribution of the legal theorists in other school of laws. It is known that al-Karkhī's definition of istiḥsān has become widespread among the legal theorists, and the legitimacy of istiḥsān in the works of legal theory was based on his definition. Al-Karkhī's considerations on the legaliticamy of using istiḥsān can be traced in his student al-Jaṣṣāṣ, in the following centuries, Abū Zayd al-Dabūsī, Abū l-‘Usr al-Bazdawī and al-Sarakhsī’s works. Al-Jaṣṣāṣ' explanations on the legitimacy of istiḥsān begin with the criticism of Imam al-Shāfiʿī's against istiḥsān. He provides the proof of legitimacy for istiḥsān in divided two sub-headings. Al-Jaṣṣāṣ, who deals with istiḥsān in two parts as word and meaning, argues that there is no disagreement about the use of istiḥsān and that all mujtahids accept istiḥsān, and even al-Shāfiʿī, who opposes to the use of istiḥsān, employs istiḥsān in this sense. The type of istiḥsān on which there is a deabte is the istiḥsān used in relation to its meaning. Al-Jaṣṣāṣ states that this use is a qiyas operation; he justifies his point of view by referring to the works of Muḥammad b. Hasan al-Shaybānī. Indeed, when we look at how al-Shaybānī explained the istiḥsān’s examples in his works, it is seen that there are two conflicting juristic analogy (qiyas) made in many examples. Moreover, al-Shaybānī openly considered some types of istiḥsān part of qiyas by stating that some examples “can be included in this type of istiḥsān” Ḥanafī scholars wanted to break the hostile atmosphere toward istiḥsān by defining and evaluating the istiḥsān in a way that their opponents could accept. The definition of Istiḥsān “to abandon the judgment given to similar ones due to stronger evidence.” has been generally accepted. In this definition, istiḥsān is defined by associating with qiyas, and referred to an istihsan that is presented as the more substantial evidence, and qiyas is the weaker evidence. Although it is appropriate to define istiḥsān in relation to qiyas, the claim that in the definition istiḥsān is put in stronger place than qiyas might casuse to some the contradictions- in particular when the example’s of al-Shaybānī are taken into consideration. Because in most cases, when qiyas conflicts with istiḥsān, istiḥsān is taken. But in an opposite case, qiyas might be taken. Apart from these, there are examples of the types of istiḥsān that al-Karkhī has classified in the works of al-Shaybānī, but sometimes there are also strange situations such as taking the qiyas by istiḥsān. This also means that the term is not sufficiently defined. The negative attitude towards istiḥsān in some Shāfiʿī circles and the criticisms against the legitimacy of istiḥsān continued in the works of the fiqh method. Istiḥsān is defined as making a judgment without evidence by Shāfiʿī circles. Therefore, they did not accept the abandonment of qiyas, which is a sharī proof, because of istiḥsān, which is a non-sharī notable proof. Based on the examples given by the users of istiḥsān, Ibn Ḥazm, one of the Ẓāhirītes, claims that istiḥsān opens the door to arbitrariness. According to him, a situation that is accepted as istiḥsān according to Ḥanafīs can be taken as istiḥsān according to Mālikīs. This creates an apparent contradiction. There are some valid points in the assessment of Ibn Ḥazm. Because while it is seen that the istiḥsān of Mālikīs is criticized in al-Shaybānī's book named al-Ḥujjah, it can be also found that the istiḥsān of Ḥanafīs is charged in the works of Abū’l-Walīd al-Bājī, one of the Mālikīs. The criticism toward istiḥsān was continued by Shāfiʿīs such as Abū Isḥāq al-Shīrāzī, Imam al-Haramayn al-Juwaynī and Abū Ḥāmid al-Ghazālī. While al-Juwaynī sees istiḥsān as a method based on the lust of the soul, not istinbat/legal deduction, al-Ghazālī understands istiḥsān as a personal comment. The main reason for the negative attitude towards istiḥsān is that the content based on the definitions, has been neglected most of the time. However, when we look at the works of al-Shaybānī, it can be seen that there is a proof of istiḥsān contrary to what is believed-and that this can be sometimes a work, sometimes a necessity, sometimes another comparison, or sometimes a custom. Biodiversity is a term easily applied in different and differing contexts. At first glance it seems to be a biological concept, defined and used in the realm of biological theory, serving for the description of particular aspects of the human and non-human environment. In this sense biodiversity even found its way into the texts of international conventions: “Biological diversity means the variability among living organisms from all sources including, inter alia, terrestrial, marine and other aquatic systems and the ecological complexes (...) of which they are part; this includes diversity within species, between species and of ecosystem.” [Harper and Hawksworth (1995)] But despite this clear and distinct definition, the intension of the term BD seems to be ambiguous. This is true for the single aspects of the definition itself, for example, the discussion over “what is a species?” took place in biology during the last 200 years and it is far from being finished [Claridge et al. (1997) Species]. This discussion asks not only for the “correct” biological definition of the term, but at the same time the methodological status of this term is in question. The result of this situation can be seen in the existence of at least 10–20 different definitions, considering biological as well as methodological aspects [Bachmann (1998) Theor Biosci 117:213–230]. Setting aside the fundamental scientific problems even the application of the term, its parametrisation and finally its relevance for biological theory-building is subject matter of controversies. The same is true for further particles of the definition, e.g. the term “ecosystem”, “complexity”, “gen”, “organisms”, etc. The intensity of the debate contrasts in a peculiar way to the reaction of (non-evolutionary) biologists, insofar as the biological research seems to be untouched by the irritating results of the debate itself. Referring to this strange situation, the aim of our article is a reconsideration of the term “biodiversity”. From an epistemological point of view it can be shown that a definition of biodiversity is possible which does not refer to biological knowledge and know-how—at least in its very first steps. Biodiversity then turns out to be a metaphor for specific aspects of societal organisation, the structuration and reproduction of nature-society relations within societies, and not for biological facts at all. A modern evolutionary perspective emphasizing life history theory and behavioral ecology is brought to bear on the three core patterns of attachment that are identified in studies of infants and young children in the Strange Situation and adults using the Adult Attachment Interview. Mating and parenting correlates of secure/autonomous, avoidant/dismissing, and resistant/preoccupied attachment patterns are reviewed, and the argument is advanced that security evolved to promote mutually beneficial interpersonal relations and high investment parenting; that avoidant/dismissing attachment evolved to (...) promote opportunistic interpersonal relations and low-investment parenting; and that resistant/preoccupied attachment evolved to foster “helper-at-the-nest” behavior and indirect reproduction. Parental mental disorders increase the risk for insecure attachment in children. However, the quality of caregiver–infant interaction plays a key role in the development of infant attachment. Dyadic interaction is frequently investigated via global scales which are too rough to uncover micro-temporal mechanisms. Prior research found that the latency to reparation of uncoordinated dyadic states is associated with infant behavioral and neuroendocrine regulation. We investigated the hypothesis that this interactive mechanism is critical in predicting secure vs. insecure attachment quality in (...) infancy. We also assessed the predictive quality of infant attachment regarding neuroendocrine reactivity later in childhood. A subsample of N = 58 dyads from a larger study were analyzed. At 3–8 months postpartum, maternal anxiety disorders were diagnosed via a structured clinical interview as well as dyadic interaction during the Face-to-Face-Still-Face was observed and coded on a micro-temporal scale. Infant attachment quality was assessed with the strange situation paradigm at 12–24 months of age. In an overlapping subsample of N = 39, we assessed child cortisol reactivity at 5 to 6 years of age. Generalized linear modeling revealed that longer latencies to interactive reparation during the reunion episode of the FFSF as well as maternal diagnosis at 3–8 months of age predict insecure attachment in children aged 12–24 months. Cox regressions demonstrated that dyads with infants who developed insecure attachment at 12–24 months of age were 48% less likely to achieve an interactive reparation at 3–8 months of age. Mixed models revealed that compared to securely attached children, children who had developed an insecure attachment at 12–24 months of age had an increased cortisol reactivity at 5 to 6 years of age during free play. The results confirm the hypothesis that the development of attachment is affected by experienced micro-temporal interactive patterns besides diagnostic categories. They also showed that infants of mothers with postpartum anxiety disorders have a more than fivefold increased risk of developing an insecure attachment than the infants of the control group. Moreover, results imply that these patterns may influence neurohormonal regulation even in preschool aged children. (shrink)

HibbsIn 1857, after the United States Supreme Court ruling in Dred Scott, Frederick Douglass chastised the court for arrogating to itself the role of God, that of being absolute judge. While the Supreme Court has its own authority, he argued, "the Supreme Court of the Almighty is greater. Taney can do many things but he cannot change the essential nature of things—making evil (...) good and good, evil."1 The passage is one of many in Vincent Lloyd's Black Natural Law that underscore the appeals of African American leaders, as part of their critique of slavery and segregation, to a higher or more fundamental law than that of human law. Lloyd describes the function of natural law reasoning, which he traces through the writings of Douglass, Anna Julia Cooper, W. E. B. Du Bois, and Martin Luther King Jr., in this way: From the careful examination of a "particular view of human nature" and its implications, they "apply those implications to the specifics of an ethical or political debate."2 That sounds similar to the way some contemporary Catholic proponents of natural law depict their own deployment of it. Early in the book, Lloyd suggests that "European and Catholic natural law traditions can learn much from the black natural tradition."3Concerning what might be learned, he focuses on an expansive conception of reason in the African American tradition, a conception of reason that is integrated with the role of emotion or passion and that is not [End Page 943] individualistic, but communal. He also underscores the epistemic privilege of the oppressed, the way suffering injustice attunes us to justice. Beyond the themes mentioned explicitly by Lloyd, I would add the paradoxical claim that natural law teaching is not just about the accessibility of fundamental precepts of justice, but also about the human capacity for moral blindness and the way in which the violation of the natural law is in important ways its own punishment. Because of the regularity of such blindness, attention to the obstacles to the perception of the natural law must become "part of the very activity of natural law." The ways in which these matters are articulated by African American authors can be, as Lloyd suggests, highly instructive. I would add that Lloyd's treatment of natural law in the African American tradition can also be fruitful for recovering neglected features of Aquinas's account. In what follows, I want to take up each of these themes and set them in conversation with the texts of Aquinas. As Alasdair MacIntyre, among others, has urged, seeing one's own tradition from the perspective of another, can, at a minimum, help us see it more clearly.4 As MacIntyre also notes, any such attempt faces the difficulties of translating from one tradition or community of inquiry to another. I must, accordingly, stress the limitations to the current essay, which can be nothing more than a preliminary investigation. I will largely be taking Lloyd's interpretation of the authors he studies as my assumed starting point, although in some cases I will offer my own reading of texts and authors he considers.5 What I will provide will be no more than an initial conversation, a first reading of Lloyd's theses in relation to germane themes and arguments in Aquinas. A much longer exchange, based on an immersive study of selected African American texts and the chief commentaries on them would be needed to advance the [End Page 944] conversation further. This article examines infant attachment styles from the perspective of cognitive and emotional subjectivity. We review new data that show that individual differences in infants’ attachment behaviors in the traditional Strange Situation are related to (a) infants’ subjective construals of infant—caregiver interactions, (b) their attention to emotional expressions, and (c) polymorphisms in the oxytocin receptor (OXTR) gene. We use these findings to argue that individual differences in infants’ attachment styles reflect, in part, the subjective outcomes of objective experience (...) as filtered through genetic biases in socioemotional information processing. In present times, the notion of beauty finds itself in a strange situation. On one side, it has undergone a sort of new renaissance since the last decades of the XX century, thanks to the works of several philosophers and aestheticians. On the other side, it is a common loci both in aesthetics and art history that beauty has disappeared from modern and contemporary art, especially when visual arts and instrumental music are concerned. One of the most effective (...) arguments in sup-port of this thesis maintains that there is no connection between normative and descriptive judgments of beauty. I am going to argue that such connection exists, and that it lies in the intermediate role played by the properties of harmony and appropriateness, which belong to the aesthetic as well as to the non-aesthetic realm. This will help us to free the notion of beauty from the charges of ambiguity and abuse, and to restore its relevance in XX and XXI centuries arts. (shrink)

It's easy to be distracted by Doctor Strange's fancy spells, unique job title, or flashy cape, but we should also recognize that he is a Sorcerer Supreme, who demonstrates both discipline and intellect. Like the historical philosopher‐scientists, Doctor Strange studies metaphysics and its relationship to the physical world. When intellectuals (...) began to challenge Aristotle's teleological world‐view, they faced opposition from both the Catholic Church, who found Aristotle's views consistent with scripture, and the scientific community. Historian Peter Dear's book Revolutionizing the Sciences helps situate the work of ancient philosophers, like Aristotle, in the context of the history of the scientific revolution. (shrink)

Experience of something strange does not mean there is a strange thing that becomes experienced but rather it means that something is experienced as being strange. The same holds true for recognizing a stranger; the person recognized is not by herself a stranger but she becomes recognized as such. Thus, the denomination strange/stranger depends on the process of experience and recognition. Waldenfels has shown that experience is much more than simply an intentional act; it befalls a (...) person who in experiencing something reacts to a claim that comes from outside and that can never be answered entirely. Therefore, experience has some elements of strangeness in its own structure. It is these elements that allow something or someone to be experienced as being strange. However, what exactly is experienced as being strange greatly depends on the particular situation as well as on previous experiences. In this paper I thus argue that the experience of strangeness correlates with the history of previous experiences. Since cultures mainly are characterized by a common history of experiences, what counts as being strange differs from culture to culture. An Intercultural Philosophy, therefore, would have to go beyond the analysis of an experience of strangeness by itself experiencing interculturality. (shrink)

Strange as it may seem, this volume is the first booklength study of Jaspers in English And it is certainly very welcome and long overdue. The author studied under Jaspers in 1934-1935 at Heidelberg. After a brief biography he clarifies a number of issues which always arise and frequently obfuscate discussions of existential philosophers--such as the problems of demonstration and of clarity. Wallraff then treats in turn: philosophy and science, Jaspers' theory of society and its institutions; the existential themes (...) of freedom, communication, and ultimate situations. The following chapters concern Jaspers' metaphysical views: transcendence, cipher-reading, and the encompassing. Wallraff is thus plainly following the outline of Jaspers' thought which is provided by Jaspers' own magnum opus, Philosophy: I. World-Orientation; II. Existenz-illumination; III. Metaphysics. The treatment is always clear and sympathetic. The author avoids any sustained criticism of Jaspers; nor does he conduct any investigation of the once much discussed relationship between Jaspers and Heidegger. That they are not always willing to acknowledge this paradoxical fact, does not save them from the perplexing situation. The two assumptions, in brief, are: That nothing can act at a distance or across an interval of time, without something mediating between the bodies or events; (...) and That every cause precedes its effect and may be located at a distance from it. We live in strange, frustrating and paradoxical times. Like other trends on the left, Marxism is immobilised by theoretical confusion and practical ineffectiveness just when a relentless state-led war against the working class is nearing the end of its second decade, the greatest transfer of wealth from the poor to the rich in human history has reasserted the centrality of class with a vengeance, the international capitalist financial system teeters on the edge of collapse, whole countries are bankrupt, and (...) hundreds of millions of people are undergoing absolute immiseration and devastating attacks on their standard of living. The gap between what the objective situation demands and what the Left has to offer is so profound that public affairs has become little more than a debate between a powerful right and an eviscerated ‘centre’ – all this at a time of unprecedented crisis and opportunity. Indeed, we do not even seem to know what to talk about. Reminders of how theoretical blind alleys and historic openings have often gone hand in hand may help us orient ourselves to broad trends, but they only underline how essential it is that we begin addressing the profoundly important questions of contemporary life. Until we do, we should not be surprised that people put their trust in angels, consult soothsayers, and are not interested in what we have to say. (shrink)

This article considers a strange, understudied work of eighteenth-century musical theatre, Thomas D’Urfey’s Wonders in the Sun (1706). This highly intertextual, generically heterogeneous comic opera is a pastiche of literary and performative modes and ultimately a machine for generating wonder; it draws on elements from Aristophanes’ The Birds, seventeenth-century masque and semi-opera, as well as the lunar fictions. The article situates this play not only within a history of literary wonder and stage spectacle, but within the English tradition of (...) politicized animal fable. Discussing D’Urfey’s comic opera against selections from John Gay’s Fables, it argues that the utopian/dystopian animal in these imaginative satires reveals the period’s twinned fascinations with discovery and alterity, as well as emergent discomfiture with anthro- and Eurocentric Enlightenment beliefs.
