The Value of Literature provides an original and compelling argument for the historical and contemporary significance of literature to humanity.

The debate on the cognitive value of literature is undergoing a change. On the one hand, several philosophers recommend an epistemological move from “knowledge” to “understanding” in describing the cognitive benefits of literature. On the other hand, skeptics call for methodological discussion and demand evidence for the claim that readers actually learn from literature. These two ideas, the notion of understanding and the demand for evidence, seem initially inconsistent, for the notion of understanding implies that the (...) cognitive benefits of literature are ultimately nonverbal and thus inarticulate. In this article, I defend both the move from knowledge to understanding and the demand for evidence. After proposing that the cognitive value of literature is best construed in terms of enhancing the reader's understanding, I argue that the place to look for evidence for the cognitive benefits of literature is not the laboratory but the practice of literature. A review of Rafe McGregor´s The Value of Literature.

The paper proposes to integrate literary studies in consciousness research to develop a strong ethical and existential dimension in the field. More specifically, it considers the value of fictional narrative for developing concepts of selfhood and personal identity that cohere with the reductionist explanations of human consciousness and self in modern empirical consciousness research. My central claim is that looking to the literary representations of human consciousness and existence that reject or are free from conventional essentialist ideas of self, (...) agency, and anthropocentrism can help 'normalize' the reductionist scientific descriptions of humans and reduce their psychologically and socio-culturally disruptive impact. The paper uses Virginia Woolf's The Waves as an example, showing how the novel's non-anthropocentric and non-essentialist conceptions of self and consciousness overlap with materialist theories in neuroscience and -philosophy but present these in a distinctive narrative framework and poetic terms that bring out the inherent emancipatory potential of the materialist explanation of human existence and offer the reader the possibility of relating to these experientially and emotionally. ABSTRACT One striking feature of On the Genealogy of Morals is how it is written. Nietzsche employs a literary style that provokes his readers' emotions. In Beyond Selflessness, Christopher Janaway argues that such a literary approach is integral to Nietzsche's philosophical goals. Feeling the emotions Nietzsche's style arouses is necessary for understanding the views he defends. I argue that Janaway's position is mistaken. The evidence at our disposal fails to establish that emotion is ever necessary for cognition. However, I maintain (...) that we do have good evidence for a slightly weaker claim. The emotionally sensitive person is epistemically better off than the cold and dispassionate person. There are some truths he or she will be more likely to believe and will have better reasons for believing. I conclude that Janaway is right to defend the philosophical importance of Nietzsche's literary writing style. His error is simply that he overstates the case. (shrink)

This article is part of a wider study entitled Value of Nursing, and contains the literature search from electronic databases. Key words for the search included `values of nursing', `values in nursing', `organisational values' and `professional identity'. Thirty-two primary reports published in English between 2000 and 2006 were identified. The findings highlight the importance of understanding values and their relevance in nursing and how values are constructed. The value of nursing is seen to be influenced by cultural (...) change, globalization, and advancement in technology and medicine. These factors are crucial in providing a more structured and measured view of what nursing is, which will result in greater job satisfaction among nurses, better nurse retention and enhanced patient care within a supportive and harmonious organization. The findings of this review have implications for policy makers in recruitment and retention in determining the global value of nursing. (shrink)

Quando apprendiamo da un testo letterario, invece, è perché esso ci offre nuove prospettive, approfondisce la nostra comprensione o ci invita a riflettere e ad arrivare a conclusioni nostre.There is an old tension between philosophy and literature that has been brought to the point by David Hume who stated that poets are «liars by profession». Literary texts, as works of fiction that talk about people who have never lived and events that have never taken place, do not contain true propositions and hence do not have any cognitive value. This article aims to show that the anticognitivistic argument is based on a false conception of cognitive progress, which reduces learning to the acquisition of information. We can learn from literary texts, however, because they offer new perspectives, deepen our understanding and invite us to reflect and arrive at our own conclusions. (shrink)

When debating the cognitive value of the novel, philosophers often focus on the resemblance between real and fictional world. Therefore, it is a hardly surprising that modernist literature, such as Franz Kafka’s novels, are rarely used as examples to support claims about the novel’s cognitive value. In my paper, I therefore offer a starting point for the development of a theory on the novel’s cognitive value that also works for modernist literature by building on Paul (...) Ricoeur’s conception of productive imagination. Starting from a case study of a short story of Kafka, I develop an account of the novel’s cognitive value that is based on the tension between the literary work’s invitation to interpretation and its simultaneous resistance against interpretation. Peter Lamarque's splendid and informative book, The Philosphy of Literature , deserves a much fuller response than I can give in this brief note. It is brimful with insights into the nature of literature, and into the debates between philosophers interested in literature, and I cannot imagine anyone failing to learn from it. The question I propose to take up is by no means the most important that Lamarque raises, nor am I even certain that I can (...) add anything useful to his own discussion of it. Yet I find myself puzzled by it, and hope that it may repay further thought. (shrink)

Literature and Understanding investigates the cognitive gain from literature by focussing on a reader's close analysis of a literary text. It examines the meaning of 'literature', outlines the most prominent positions in the literary cognitivism debate, explores the practice of close reading from a philosophical perspective, provides a fresh account of what we mean by 'understanding' and in so doing opens up a new area of research in the philosophy of literature. This book provides a different (...) reply to the challenge that we can't learn anything worthwhile from reading literary fiction. It makes the innovative case that reading literary fiction as literature rather than as fiction stimulates five relevant senses of understanding. The book uses examples of irony, metaphor, play with perspective and ambiguity to illustrate this contention. Before arguing that these five senses of understanding bridge the gap between our understanding of a literary text and our understanding of the world beyond that text. The book will be of great interest for researchers, scholars and post-graduate students in the fields of aesthetics, literary theory, literature in education and pedagogy. (shrink)

This study examines the value of literary interpretation. A case is argued on the basis of the possibility of literary works being understood as 'about' diverse 'themes'. The process of understanding literature, it is argued, inevitably involves the concerns and the personal and historical situatedness of the interpreter. In the performance history of Shakespeare's The Tempest we see clearly how the thematic focus and the representation of the elements of the work changes, sometimes radically, over time. An interpretation (...) of The Tempest with an emphasis on today's concerns is the basis for a discussion which shows the interdependence of the questions of why literary works have survived as valued objects of attention over time, and how literature can matter to the reader. Hans-Georg Gadamer's philosophical hermeneutics shows, in its emphasis on the historical situatedness of understanding, how the reader'S situation and concerns feeds into the process of making sense of literary works and thereby makes literary interpretation interact with the life of the interpreter. 'Themes', or what the work is seen to 'be about', is central to the process of literary interpretation. This, in particular, is where literature has its openness to accommodate application to diverse concerns and situations. To remedy the deficiency of Gadamer's hermeneutics on this point, the role of themes in literary interpretation is first illustrated by an interpretation of Conrad's Heart of Darkness and then analyzed. The study argues that while different literary interpreters may have different purposes, for their procedures to constitute interpretations three criteria need to be observed. In having to reach an equilibrium between the requirements of faithfulness to the literary work on the one hand, and the understanding of it through one's own situation and concerns on the other, the process of literary interpretation makes a valuable contribution to understanding. A principle claiming equal entitlement to continued life has been strongly defended in the literature as a fundamental social value. We refer to this principle as ‘equal value of life'. In this paper we argue that there is a general incompatibility between the equal value of life principle and the weak Pareto principle and provide proof of this under mild structural assumptions. Moreover we demonstrate that a weaker, age-dependent version of the equal value of life (...) principle is also incompatible with the weak Pareto principle. However, both principles can be satisfied if transitivity of social preference is relaxed to quasi-transitivity. This study aims to examine the philosophical life values of the Manggarai people in Western Flores, which are reflected in the proverbs of the Manggarai language (Go'et). Go'et is an oral literature that contains the values that govern the life of the Manggarai people. This study uses a qualitative descriptive approach design involving semantics theory to interpret the meaning of Go'et. The data in this study were obtained by conducting in-depth interviews with one of the Manggarai community leaders with (...) the initials AW (52) and secondary data available on the Manggarai Nuca Lale website. The data obtained were then validated using the Indonesian-Mangarai dictionary to find samples that fit this study. Nine data are relevant to the scope of this study based on the results of data collection that have been done. From the data found, the researcher concluded that there are three central values in go'et which contain advice and instructions for living a life under the norms that apply to the Manggarai community, such as unity, Manners and Wisdom, and passion and hard work. These findings are consistent with the fact that the Manggarai people uphold the values of unity, cooperation, and harmony among community members. (shrink)

In this paper I make the case that we should reject an argument that even knowledge of pointless truths has pro tanto final value. The argument draws on Greco’s virtue epistemological account of knowledge, according to which knowledge is an achievement and achievements have final value in virtue of being constitutive of the good life. I argue for my position by drawing on a case of knowledge of a pointless truth unlike previous cases of pointless truths discussed in (...) the literature. This is a case in which knowledge of a pointless truth is very cheaply gained, and so it is a case in which the disvalue of the cost of gaining the knowledge cannot plausibly outweigh the supposed pro tanto final value of knowledge. According to the French philosopher Alain, art must regain its existence as a real and solid object to counteract deceitful imagination. In line with this view is Yves Michaud’s description of the “gaseous” state of contemporary art. Paradoxically, the wide circulation of many ‘artistic’ products, destined to be consumed and invoke emotions, does not indicate that we are in presence of an important affirmation of ethical and aesthetical values. As it were, the proliferation of aesthetic objects has destroyed the symbolic (...) value of art. The Italian philosopher Gianni Carchia has underlined how the disappearance of the axiological dimension has led art towards imposture and under the yoke of imagination, which both assist the strategies of the demonic. At this point a question arises: is it possible to eradicate the power of the demonic and evil from our existential condition? According to Jung it’s impossible. In Castelli’s view, the union between art, evil and the demonic has characterized the artistic panorama of the sixteenth century. In the twentieth-century, we owe to Hermann Broch – who brought the raising power of kitsch under philosophical scrutiny − the idea of a complicity between degraded art and evil. Not all scholars agreed that Kitsch represented evil. Many philosophers argued that the growing popularity of Kitsch among the masses posed a problem concerning the demand for art. For this reason, philosophical speculation had better not take a Manichean attitude and reject Kitsch outright, on the contrary, Kitsch should be studied with the aim of transforming the “hunger for art”, of which it is a manifestation, into a desire for ethical and artistic values. Can literary fictions convey significant philosophical views, understood in terms of propositional knowledge? This study addresses the philosophical value of literature by examining how literary works impart philosophy truth and knowledge and to what extent the works should be approached as communications of their authors. Beginning with theories of fiction, it examines the case against the prevailing ‘pretence’ and ‘make-believe’ theories of fiction hostile to propositional theories of literary truth. Tackling further arguments against the cognitive function and (...) class='Hi'>value of literature, this study illustrates how literary works can contribute to knowledge by making assertions and suggestions and by providing hypotheses for the reader to assess. This chapter begins with some brief biographical information and some general remarks about Friedrich Nietzsche's philosophical methodology and style. Throughout his life, Nietzsche's books had a very small circulation. But by the end of his life, he was beginning to receive greater acclaim, and he was to have an enormous influence, not just within philosophy, but in the wider cultural sphere. In some recent literature on Nietzsche, the divide between naturalism and non‐naturalism has figured prominently. This reflects a broader (...) debate about where exactly to situate Nietzsche, with respect to his eighteenth and nineteenth century predecessors, as well as with respect to debates in contemporary philosophy, particularly surrounding moral psychology, the philosophy of action, and the philosophy of mind. The chapter also presents the discussion of his books themselves, beginning with The Birth of Tragedy (1872) and ending with his autobiography Ecce Homo (1888). Mitchell Greenʼs conception of the thesis of Literary Cognitivism states that literary fiction can be a source of knowledge that depends crucially on its being fictional. By a modal argument the authors show that the criterion of fictionality cannot be crucial to the epistemic value of literary fiction. Rather, it lays in a certain kind of distance, e.g. a temporal, cultural, or interpersonal one. This will be motivated by drawing parallels to Gadamerʼs hermeneutics, especially his conception of fusion of (...) horizons. In doing so, we agree with Green’s characterisation of knowledge that can be gained from engaging with literary fiction, but present a different approach to the source of this knowledge. At the same time, this approach enables us to extend the epistemic value of literary fiction both quantitatively and qualitatively. (shrink)

이 글은「화엄경의 문학성 연구」를 불교문학의 측면에서 접근하여『화엄경』에 내재된 문학성을 분석한 논문이다. 본 논문의 내용은 크게 2가지 측면에서 접근하여 분석해보았다. 먼저 제Ⅱ장에서는 불교와 문학과의 관계 교섭에 대하여 불교문학에 대한 이해와 불교전승의 특징과 화엄경에 대한 이해 그리고 문학과 불교의 접점을 중심으로 살펴보았다. 그리고 제Ⅲ장에서는 불교문학의 측면에서 분석한『화엄경』을 ‘화엄’ 이름에 담긴 문학적 비유와 산문체로 본『화엄경』의 특성 그리고 화엄경에 담긴 문학의 4가지 관점을 토대로 분석해보았다. 이러한 분석을 통해 알 수 있는 사실은「화엄경의 문학성 연구-불교문학으로 분석한 화엄경」에 담긴 불교문학은 불교적 소재를 주제로 삼아 작가가 문학적으로 풀어 (...) 낸 것과 연관 지을 수 있는 개념이다. 따라서 문학과 불교를 교섭하면서 불교라는 종교적 성격과 영역을 해명하는 역할을 한다는 측면에서 중요하다는 것이다. 특히『화엄경』에는 삼독에 빠진 우리들의 내면을 정화하여 불성(佛性)을 회복하는데 도움이 되는 유익한 가르침이 담겨있다는 것을 알 수 있다. 따라서 불교문학으로 분석한『화엄경』에는 처음 바른 깨달음[正覺]을 이루신 교설이 다양한 문학적 장르와 비유, 형식 등으로 설해져 있다는 것을 확인할 수 있었다. 경전의 이름에 담긴 ‘화엄(華嚴)’이라는 비유적 표현은 모든 존재가 깨달음에 들어가기 위해서는 불교의 실천행인 보살도를 의보와 정보로 장엄해야 한다는 함의가 내재되어 있다. 이것이 바로 불교문학의 매우 유용한 가르침인 것이다. This book analyses the use of the crucial concept of 'taste' in the works of five major seventeenth-century French authors, Méré, Saint Evremond, La Rochefoucauld, La Bruyère and Boileau. It combines close readings of important texts with a thoroughgoing political analysis of seventeenth-century French society in terms of class and gender. Dr Moriarty shows that far from being timeless and universal, the term 'taste' is culture-specific, shifting according to the needs of a writer and his social group. The notion of (...) 'taste' not only helped to shape a new dominant culture, but also registered the conflicts within that culture between a view of taste that presupposted the values of 'polite society' as an exclusive (though not necessarily aristocratic) group, and a view that stressed the value of the classical-humanist tradition as a source of standards ratified by a broader public. this study sheds light not only on the central concept, but also on the individual authors discussed and on the norms of French classical literature in general. How do we assign values to virtual items, which include virtual objects, properties, events, subjects, worlds, environments, and experiences? In this article, I offer a framework for answering this question. After considering different value theses in the literature, I argue that whether we think these theses mutually exclusive or not turns on our view about the number of value-salient kinds virtual items belong to. Virtual monism is the view that virtual Xs belong to only one value-salient (...) kind in relation to X. Virtual pluralism is the view that they belong to more than one value-salient kind. I argue for two claims. First, virtual monism is mistaken. Minimally some virtual Xs are Xs, while others are not. Second, dualistic virtual pluralism is also mistaken because it is too coarse grained. Instead, I argue for fourfold pluralism: virtual items either represent an original's properties or reproduce essential properties and do so to lesser or greater extents. This gives us four value-salient kinds of virtual X: virtual reproductions, simulations, representations, and simulacra of X. I apply this view to various debates in the literature and conclude with a discussion of less basic hybrid kinds. (shrink)

Ethicists have long recognized that two necessary features of ethical research are scientific validity and social value. Yet despite a significant literature surrounding the validity component of this dictate, until recently there has been little attention paid to unpacking what the social value component might require. This article introduces a framework for assessing the social value of research, and in particular, for determining whether a given research program is likely to have significant social value of (...) the kind necessary to fulfill the social value requirement. The article goes on to illustrate how this framework can provide a clearer account of the responsiveness requirement, an ethical dictum that is oft-repeated but whose content and value as a guideline in international research remains contested. Although I introduce this conception of social value in the context of the responsiveness requirement, the account offered can, and is intended to, stand alone as a tool for the assessment of the social value of research. As such it can be usefully applied to discussions about the value of comparative effectiveness trials, the assessment of the continued proliferation of me-too drugs and the research done to develop them, the demand for public access to study-generated data, and persistent deficits in the publication of negative results. In this paper we focus on conversational thinking to demonstrate the value of public reasoning in building a decent world and true democracies. We shall take into account the views of selected scholars, especially John Rawls and Jürgen Habermas, on law and democratic practice, to explain why post-colonial Africa is weighed down by sociopolitical hegemonies that have aversion to their opposition and eliminate room for strong institutions, rule of law and human rights. In light of conversational thinking, this eliminates (...) any chance for “creative struggle,” i.e. a philosophers struggle against the post-colonial imaginary/social agents to dethrone strong individuals and create strong institutions. In the absence of these indices which a conversational orientation may engender, it is difficult to transform bogus democracy into true democracy and thus to create a decent society. Post-colonial Africa mired in social regression, political crisis and economic stagnation urgently needs conversational tonics to overcome the ineffectiveness of bogus democracy. We postulate a thesis about three structural transformations forming what we call Democratic Transformational Programme. (shrink)

The current literature on the value of knowledge is marred by two unwarranted presumptions, which together distort the debate and conceal what is perhaps the most basic value of knowledge, as distinct from mere true belief. These presumptions are the Synchronic Presumption, which confines philosophical attention to the present snapshot in time; and the Analytical Presumption, which has people look for the value of knowledge in some kind of warrant. Together these presumptions conceal that the (...) class='Hi'>value of knowledge might inhere not in a necessary condition, but simply in a property that most knowledge possesses; and, in particular, that it might inhere, as I argue it does, in a certain property of 'resilience': the tendency to survive misleading counter-evidence over time owing to the subject's being in a position to weight it against evidence already possessed. In the recent philosophical literature on inquiry, epistemologists point out that their subject has often begun at the point at which you already have your evidence and then focussed on identifying the beliefs for which that evidence provides justification. But we are not mere passive recipients of evidence. While some comes to us unbidden, we often actively collect it. This has long been recognised, but typically epistemologists have taken the norms that govern inquiry to be practical, not epistemic. The (...) recent literature challenges this assumption and uncovers a rich range of questions about the epistemic normativity of inquiry. In this paper, I approach these questions from the formal side of epistemology. Developing out of the philosophy of science, as it did, this branch of epistemology has long discussed inquiry. And, building on the insights of Janina Hosiasson (1931), David Blackwell (1951), and I. J. Good (1967), it has produced a reasonably well-developed framework in which to understand norms of inquiry, both epistemic and practical. In the first half of the paper, I will present the pragmatic versions of this framework due to Hosiasson, Blackwell, and Good, and the epistemic version due to Graham Oddie (1997); in the second half of the paper, I put this framework to work, turning to some of the questions from the recent debate about inquiry and asking how the framework can help us answer them. Questions include: When should we initiate an inquiry, when should we continue it, when should we conclude it, and when should we reopen it? How do epistemic norms of inquiry relate to epistemic norms of belief or credence, and can they conflict, as Jane Friedman (2020) contends? How should we resolve the apparent puzzle raised by Friedman's example of counting the windows in the Chrysler Building? How should we direct our attention, as Georgi Gardiner (2022) asks? How should we choose and reason after receiving evidence we'd rather not have received? And how should we understand the epistemic error that occurs when someone is resistant to evidence in the way Mona Simion (2023) describes? (shrink)

This article discusses methods in the philosophy of literature and film. It begins by providing some background on PLF and how it differs from those philosophically influenced projects for understanding and interpreting literature and film most often undertaken by film and literary scholars. It then reviews the history of the study of literature and film before considering how particular filmic or literary works might function as evidence for, or as things to be explained by, general claims offered (...) within PLF. It examines the claim that literary and filmic works may themselves be sources of philosophical ideas and, sometimes, contributions to philosophy itself. It then describes Darwinian approaches to PLF. Finally, it considers the role of empirical evidence in assessing claims about the value of literature as a source of knowledge. (shrink)

This paper proposes an extended version of the interventionist account for causal inference in the practical context of biological mechanism research. This paper studies the details of biological mechanism researchers’ practices of assessing the evidential legitimacy of experimental data, arguing why quantity and variety are two important criteria for this assessment. Because of the nature of biological mechanism research, the epistemic values of these two criteria result from the independence both between the causation of data generation and the causation in (...) question and between different interventions, not techniques. The former independence ensures that the interventions in the causation in question are not affected by the causation that is responsible for data generation. The latter independence ensures the reliability of the final mechanisms not only in the empirical but also the formal aspects. This paper first explores how the researchers use quantity to check the effectiveness of interventions, where they at the same time determine the validity of the difference-making revealed by the results of interventions. While this order is useful, it introduces some dislocation if one approaches the book as a whole since the last essay in the book is the first chronologically, and part of the interest of the book lies in the changes in Paul Guyer's positions over time that are reflected in his careful reconsideration of topics that he has dealt with more extensively in his volumes on Kant's [End Page 422] philosophy. As one of the most important contemporary interpreters of Kant's aesthetics, those reconsiderations are well worth attending to.The focus of all of the essays is clearly on Kant's aesthetics. That perspective is clear even when Guyer is discussing the history of aesthetics prior to Kant. As he notes, "this history of the first decades of modern aesthetics has obviously been written with an eye to Kant" ("Origins of Modern Aesthetics: 1711–1735," pp. 32–33). It continues in the discussions of recent aesthetics. For example, Guyer concludes that "the effect that is intended on the revised Beardsleyan definition [of art] is in the tradition of the Kantian concept of the free play of imagination and understanding" ("From Jupiter's Eagle to Warhol's Boxes," p. 313). Danto and Mothersill are also, it is argued, in the Kantian tradition.There are, of course, some problems with this perspective, especially with regard to the pre-Kantian history of aesthetics. In the growing philosophical literature on the family and its value, the parents' fiduciary role often serves to explain why the family is valuable from a child-centred perspective. Recently it has been further argued that this fiduciary role also explains the distinctive value the family has for parents. By offering a critique of that argument, the paper advances an alternative parent-centred account of the value of the family. It points out the process in families whereby parents (...) reproduce some of their characteristics in their children and thereby establish a powerful sense of interconnectedness and continuity between their own identity and the child's. The fact that the family provides quite a unique platform for developing this type of interpersonal bond may account for the striking importance ascribed to families. Bionic systems, connecting biological tissues with computer or robotic devices through brain–machine interfaces, can be used in various ways to discover biological mechanisms. In this article I outline and discuss a “stimulation-connection” bionics-supported methodology for the study of the brain, and compare it with other epistemic uses of bionic systems described in the literature. This methododology differs from the “synthetic”, simulative method often followed in theoretically driven Artificial Intelligence and cognitive science, even though it involves machine models of biological (...) systems. I also bring the previous analysis to bear on some claims on the epistemic value of bionic technologies made in the recent philosophical literature. I believe that the methodological reflections proposed here may contribute to the piecewise understanding of the many ways bionic technologies can be deployed not only to restore lost sensory-motor functions, but also to discover brain mechanisms. There has been much debate in the philosophical literature about the nature of happiness. The central point of contention is whether happiness is best thought of as a psychological state or as a concept with a distinctively evaluative element. This essay argues that a purely psychological conception of happiness is incapable of accounting for our intuitive idea that happiness has great value and significance. A satisfactory account would acknowledge the importance of the psychological aspect of happiness but would (...) insist that this is not enough. To explain the role that happiness plays in our everyday life we need to adopt an evaluative conception that intimately links happiness with the idea that our life is going well for us. Only if we maintain this conceptual connection between happiness and the conditions of our lives can we go any way to explaining the intuition that happiness is valuable. (shrink)

The approaches of different authors to the determination of the purpose of science are discussed in this work. Author considers definitions of science based on different values. Author explores the correlation between science and value of control over natural objects, as well as cognitive values. Groups of cognitive values available in the literature are given as examples. The definition of science based on the understanding that science is unique complex self-organizing system is suggested. The historical aspect of the (...) problem of motivation scientific activity is considered. Attention to one of the most important values associated with science, the ability to ensure control over nature, is attracted. The provision that the motivation of scientific activity is not related to the value of control over natural objects is proved. It is shown that the leading motivation of the man of science - the need for knowledge of nature. This requirement is a manifestation of the evolutionary mechanism of survival of the species Homo Sapiens. (shrink)

Recent literature has examined the problem facing decision makers with bounded awareness, who may be unaware of some states of nature. A question that naturally arises here is whether a value of awareness, analogous to value of information, can be attributed to changes in awareness. In this paper, such a value is defined. Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both (...) insightful and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making.
