In the twenty-first century, human rights play a very important role in modern society. The Universal Declaration of Human Rights, released on 10 December 1948th was thought to become an everlasting source of fundamental human rights and freedoms. The Declaration corresponds to the situation that global community was facing 60 years ago. Today it is a collection of articles that is the cornerstone of the whole system of human rights protection. However, gross human rights atrocities, (...) the dynamic process of legislation, technological progress and changing social values have prompted many to revise the concept of human rights. Today many areas of life have changed: we have untraditional marriages and families, the individual enjoys a completely different social status than 60 years ago. These factors have prompted the creation of an entirely new dimension to human rights and freedoms based on personal autonomy, dynamics and self-regulation. Nowadays, the realization of rights and the aspiration to personal happiness are closely connected with personal autonomy. Autos and nomos—these two terms describe the ability of an individual to initiate one’s actions, to realize them by making independent decisions. This article analyzes whether this ability is a natural right or a privilege, what factors determine the exercise of this right, and what is the role of the state in this process. (shrink)

Drawing its strength from the UN Charter and UDHR, human rights ethics is a beacon of hope and a promise that requires continuous reaffirmation during these turbulent times. These two documents, with their unwavering faith in ‘fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small,’ have shaped our understanding of human rights as global and universal ethics. However, this faith (...) is now being severely tested by four countercurrents: extremism, exclusionism, selectivism, and populism. These countercurrents pose significant and urgent human rights threats that activists, academics, and policymakers must confront by reasserting the basic core values of the UN Charter and UDHR. The issue of human rights has always been a matter shared by politicians, lawyers, philosophers and sociologists. Since the adoption of the Universal Declaration of Human Rights scholars and human rights activists have discussed whether the Declaration has become a symbol of human rights universality. Two decades later Muslim states have started discussions if human rights are indeed universal. They argued that human rights is a product of western imperialism and therefore the Arab (...) states are not bound by the human rights catalogue proposed by the West. In 2008, the Arab Charter on Human Rights drafted within the framework of the League of Arab States came into force. This fact was welcomed by the international community, non-governmental organizations, and High Commissioner for Human Rights. The Arab Charter on Human Rights was seen as a possibility for the Arab States to confirm the commitment to the universality of human rights. However, the adopted text was disappointing and once again raised the doubt that Arab States are not truly committed to universal human rights. Several cognitive accounts of human communication argue for a language-independent, prelinguistic basis of human communication and language. The current study provides evidence for the universality of a prelinguistic gestural basis for human communication. We used a standardized, semi-natural elicitation procedure in seven very different cultures around the world to test for the existence of preverbal pointing in infants and their caregivers. Results were that by 10–14 months of age, infants and their caregivers pointed in all cultures (...) in the same basic situation with similar frequencies and the same proto-typical morphology of the extended index finger. Infants’ pointing was best predicted by age and caregiver pointing, but not by cultural group. Further analyses revealed a strong relation between the temporal unfolding of caregivers’ and infants’ pointing events, uncovering a structure of early prelinguistic gestural conversation. Findings support the existence of a gestural, language-independent universal of human communication that forms a culturally shared, prelinguistic basis for diversified linguistic communication. Under the traditional classification of medieval positions on the issue of universals, both Aquinas and Buridan would have to be deemed to be “conceptualists”: they both deny the existence of mind-independent, Platonic universals (against “realists”), and they both attribute universality primarily to the representative function of our universal concepts, and thus only secondarily to universal names of human languages (against “nominalists”). Yet, Aquinas is quite appropriately classified as a “moderate realist,” and Buridan as an “Ockhamist nominalist.” This paper (...) will argue that what justifies these more refined classifications is the two authors’ radically different conceptions of the representative function of our universal concepts. The paper will show how this difference results in their opposing judgments concerning the demonstrability of the thesis of the immateriality of the human intellect and will reply to Buridan’s main objection to Aquinas’s argument for this thesis, by pointing out the objection’s conflation of merely indifferent, non-distinctive singular representation with genuinely universal intellectual representation. In its conclusion, the paper will briefly gesture at an important contemporary implication of Aquinas’s thesis concerning a metaphysical limitation of artificial intelligence. (shrink)

More than 15 years of human behaviour genetic research at the University of Warsaw Human behaviour genetic research has been conducted at the University of Warsaw for more than 15 years. The main focus of this work have been the origins of individual differences in temperament and other personality traits. Other areas of interest include attitudes, risk factors for human health, and posttraumatic stress disorder. The majority of the research is conducted using quantitative genetic methods although recently (...) work using molecular techniques has also begun to develop. Now is a good time to take stock of the global progress made toward achieving the ideals enshrined in the Universal Declaration of Human Rights, which was passed by the UN General Assembly seventy years ago. Though the UDHR has played a vital role in advancing human rights globally, threats to human rights areever present. Two issues in particular stand out as barriers to further progress. The first is state sovereignty, which presents a fundamental challenge to any (...) effort to establish universal norms. Without strong global institutional mechanisms to ensure implementation, UDHR's impact remains limited. The second major concern is the “siloing” of human rights efforts, whereby civil and political rights have been given primacy over social and economic rights. Emphasis on some principles to the exclusion of others undermines the comprehensive advancement of human rights. The current state of affairs is a product of the collective failure to address human rights holistically and to implement real monitoring and accountability measures for states, which are directly charged with upholding them within their borders. ABSTRACT This essay focuses on two underlying presumptions that impinge on the effort of UNESCO to engender universal agreement on a set of bioethical norms: the conception of universality that pervades much of the document, and its disregard of structural inequalities that significantly impact health. Drawing on other UN system documents and recent feminist bioethics scholarship, we argue that the formulation of universal principles should not rely solely on shared ethical values, as the draft document affirms, but also on (...) differences in ethical values that obtain across cultures. UNESCO's earlier work on gender mainstreaming illustrates the necessity of thinking from multiple perspectives in generating universal norms. The declaration asserts the ‘fundamental equality of all human beings in dignity and rights’1 and insists that ‘the highest attainable standard of health is one of the fundamental rights of every human being without distinction of race, religion, political belief, economic or social condition’2 yet it does not explicitly recognize disparities of power and wealth that deny equal dignity and rights to many. Without attention to structural (as opposed to merely accidental) inequities, UNESCO's invocation of rights is so abstract as to be incompatible with its avowed intention. (shrink)

Philosophical significance of the levels of cognition consists in their possibility to consider a phenomenon as universal, general, particular,separate and single; stratificated methods of cognition and technologies of penetration into different aspects of the phenomenon essence. The methodological cognition with its own distinctive methods contains all other methods, thus unity pretends to be the Modern Philosophy, including monistic, systemic, dialectial, metaphisical and empirical methods of cognition, where there is no contradiction of Science and Religion. Frankental observes a changing business context, which overall increases the risk to business of dealing with other parties, including countries, subcontractors, joint venture partners and their stockholders. The paper proceeds to examine the barriers to integration of human rights, and identifies dilemmas that firms need to resolve. The scientific novelty lies in the establishment of interrelations of methods for analyzing the state of human resources of the university and the development of theoretical provisions for their assessment based on the integrated use of existing and developed (...) methods. Hume’s Science of Human Nature is an investigation of the philosophical commitments underlying Hume's methodology in pursuing what he calls ‘the science of human nature’. It argues that Hume understands scientific explanation as aiming at explaining the inductively-established universal regularities discovered in experience via an appeal to the nature of the substance underlying manifest phenomena. For years, scholars have taken Hume to employ a deliberately shallow and demonstrably untenable notion of scientific explanation. This article explores the very limited cases historically in the twentieth century when human rights was used in American policy debate as a defending principle for the provision of government-guaranteed universal healthcare. It discusses these cases and examines various reasons as to why this is so, noting the major emphasis in American political culture on negative rather than positive liberty. It examines the shift in political culture from the Roosevelt, Truman, and Johnson eras that embraced social and economic rights (...) and defined them as such to the post-Reagan era when conservative ideologies were ascendant. These ideologies reject the legitimacy of social and economic rights and remain dominant in the United States. It comparatively situates the American refusal to consider universal healthcare a human right with European affirmations of such a right and to those found in various treaties of international law. Finally, it analyzes how Barack Obama’s Patient Protection and Affordable Care Act—while not adopting the rhetoric of human rights does, functionally, enable as a matter of public policy an entitlement to healthcare. Some ideas expressed in the collective monograph Universality in Morality (2020), edited by Ruben Apressyan, are here critically examined. The book is based on the results of a large-scale study by professional ethical philosophers devoted to the question of the nature of universality in morality and the mechanisms of universalisation of individual maxims and norms from antiquity to modern ethical theories, represented above all by the analytical tradition in philosophy. Of great interest is the analysis of related phenomena (...) in morality, which makes it possible to determine the causes and nature of the transformation of morality in different eras and the accompanying change in the terminological apparatus of absolute ethical universalism, considered to be the starting point in the analysis of key modern concepts of moral universality. The article also suggests possible avenues for continued research in this area which could prompt modifications not only to the history of the concept of universality in morality, but also to our assessment of the contribution of individual authors and entire eras to the progress of human civilisation. This concerns above all the moral theory of contractarianism and the Enlightenment. Focus on their ideas goes a long way to determining the direction of current historical-philosophical research that reconstructs the history of ethical teachings and individual concepts. The importance attached today to a new view of the theory of the social contract, considered not only from socio-political but also from moral positions, forces us to approach in a new way the question concerning the universality of the key philosophical categories developed within this theory throughout its history. Elaborating the ideas set forth in the monograph, the author also stresses the relevance of the problem of justifying the thesis about the moral law as an analogue of the universal law of nature in the modern context. The 1948 Declaration of Human Rights demanded a collaboration among exponents from around the world. Embodying many different cultural perspectives, it was driven by a like-minded belief in the importance of finding common principles that would be essential for the very survival of civilization. Although an arduous and extensive process, the result was a much sought-after and collective endeavor that would be referenced for decades to come. Motivated by the seventieth anniversary of the 1948 Universal Declaration of Human (...) Rights and enriched by the contributions of eminent scholars, this volume aims to be a reflection on human rights and their universality. The underlying question is whether or not, after seventy years, this document can be considered universal, or better yet, how to define the concept of “universality.” We live in an age in which this notion seems to be guided not so much by the values that the subject intrinsically perceives as good, but rather by the demands of the subject. Universality is thus no longer deduced by something that is objectively given, within the shared praxis. Conversely, what seems to have to be universal is what we want to be valid for everyone. A profound change in our scientific understanding of the role of human beings in the unfolding of our streams of conscious experiences was wrought by the 20th-century switch from classical mechanics to quantum mechanics. The streams of consciousness thoughts of human beings were converted from causally inert passive witnesses of the unfolding of a mechanically controlled and causally self-sufficient physical universe into logically needed dynamical inputs into the physical aspects of nature. These physical aspects, as they are now (...) understood, contain causal gaps that are neatly filled by inputs from the realm of our conscious thoughts in a way that allows our conscious intentions to tend to produce their intended consequences. The resolution of the UN was adopted on 10 December in 1948(A/RES/217). The research’ route of the article analyses the historical conditions where the UDHR was drafted. And intends to analyse and to debate if the political speech that crossed the cold war and emerged again, in the context of geostrategy conflicts, respects the substance of the original document. This research pathway determines and debate five fundamental questions: The connection between the articles of UDHR agreement and labour rights, economic democracy, (...) and, on the other hand, political liberty, the right of nations to decide from themselves and the imperative of universal peace. If the articles of UDHR are compatible or not with the political nature and evolution of liberal democracies and socialist regimes. If propaganda of the Cold War and the geopolitical confrontation, they subvert and distort the principles of the original UN Human Rights or defend those principles. If people around the world really know and are conscientious of UDHR principles and articles, or those propaganda created a phenomenon of global alienation. At last, what means a new generation of human rights. That methodology will be supported by the case study of the United States of America and People Republic of China. The new dilemmas and responsibilities which arise in bioethics both because of the unprecedented pace of scientific development and of growing moral pluralism are more and more difficult to grapple with. At the ‘global’ level, the call for the universal nature at least of some fundamental moral values and principles is often being contended as a testament of arrogance, if not directly as a new kind of subtler imperialism. The human rights framework itself, which provided the basis for the (...) most relevant international declarations and documents, is not exempt from the charge. However, the refusal of a top-down conception of the universal as a sort of product for exportation should not be confused with a relativistic landscape, where all the cows can be indifferently black or white. This contribution aims at outlining an approach, which reconciles universalism as enshrined in founding human rights declarations with respect for cultural diversity. In order to do so, two conceptual frameworks are discussed: the ‘tool-kit’ model and the morals/ethics difference. The example of the right to quality health care confirms the argument that striking a balance between cherishing pluralism and defending some fundamental rights and obligations does not amount to an assertion of moral imperialism. The first part of the article discusses the development of the philosophy of personalism from Mounier to Maritain and analyzes Maritain’s views on human rights. In the second part of the article, the author shows the decisive influence of the personalists Charles Malik (...) and Rene Cassin on the adoption of the document, which clearly bears the mark of the Christian personalistic discourse and notions. For the ancient Greeks, the world was both Eros, the god of chaos and creativity, and Logos, the regularity of the heavens as law. From chaos the world came forth. The world was home to ultimate creativity. Two thousand years later Kepler, Galileo, and then mighty Newton created deterministic classical physics in which all that happens in the universe is determined by the laws of motion, initial and boundary conditions. The Theistic God who worked miracles became the Deistic God who (...) set up the universe and let Newton’s laws take over. Eros, raw creativity, is dead, all is Logos.Quantum mechanics replaced the determinism of classical physics with fundamental indeterminism. This was a major crisis in physics, but remained entirely within the Newtonian paradigm of laws, here the Schrödinger equation, initial and boundary conditions. The Schrödinger equation entails the deterministic propagation of a probability distribution. The probabilities concern the indeterminate outcomes of quantum measurement events.The central issue of this article is to show that no laws at all determine or entail the becoming of our biosphere or any other among the 1022 solar systems in the universe. This claim is radical. If no laws determine or entail the becoming of biospheres, and biospheres are part of the universe, the Pythagorean dream that All is Number, All is Logos, is dead. There is no Final Theory that entails all that become in the universe. Eros is again, and always was, rambunctiously alive in the raw creativity of the becoming of life anywhere in the universe. The becoming of life is based on physics, on Logos, but beyond it, emerging from Eros.The reasons Eros is at play in the evolution of biospheres are fourfold.First, the universe will not make all possible complex things. That is, the universe is vastly non-ergodic. Yet complex things such as the human heart exist.Second, the reason human hearts exist is that organisms are Kantian Wholes in which the parts exist for and by means of the whole. Hearts exist because they fulfill the function of pumping the blood that keeps the whole organism alive. Such organisms propagate progeny that carry with them the hearts that keep them alive.Third, adaptations like hearts, the flagellar motor, the loop of Henle in kidneys that concentrates urine, and flight feathers, are tinkered-together contraptions stumbled upon in evolution. Parts and processes that arise in evolution are jury-rigged for unprestatable new functions that help keep the entire Kantian Whole organism alive and propagating in the evolving biosphere. There is no deductive theory of jury rigging. We cannot deduce the emergence of such novel functions.Fourth, the functions of parts of organisms emerge in unprestatable ways and form the unprestatable and ever-changing phase space of evolution. Since we cannot prestate the ever-changing phase space of evolution, we can write no laws of motion in differential equation form, so cannot integrate the equations we do not have. Thus, no laws entail the becoming of any biosphere.Evolving biospheres are everywhere creative. This is Eros, the chaos from which the world emerges. This profound creative emergence is the stuff of story, of narrative. Evolving biospheres always were and always will be both Eros and Logos, the stuff of story and the stuff of law. Knowledge about the ‘other’ is one of the founding pillars for the development of global political theory. Although human rights are an important part of the moral and legal discourse on global governance, there is still a gap between these theories and detailed accounts of human rights violations and the context for resistance. This article examines the treatment of the ‘other’ in a specific country (Iran), and the oppression as Muslims of Iranians living abroad, in order to begin (...) to fill this gap. More specifically, it is argued that anthropology, journalism and diaspora literature about Iran provide useful input for the field of global political theory on human rights, democratisation and global justice. This literature helps bring home the realities of human rights violations, contributes to a better understanding of injustice and ways of creating social change, and illuminates issues of universality and difference that are of direct relevance to global political theory.
