Suppose you own a garden-variety object such as a hat or a shirt. Your property right then follows the ageold saw according to which possession is nine-tenths of the law. That is, your possession of a shirt constitutes a strong presumption in favor of your ownership of the shirt. In the case of land, however, this is not the case. Here possession is not only not a strong presumption in favor of ownership; it is not even clear what possession is. (...) Criminal juries make decisions of great importance. A key criticism of juries is that they are unreliable in a multitude of ways, from exhibiting racial or gendered biases, to misunderstanding their role, to engaging in impropriety such as internet research. Recently, some have even claimed that the use of juries creates injustice on a large-scale, as a cause of low conviction rates for sexual criminality. Unfortunately, empirical research into jury deliberation is undermined by the fact that researchers are unable to (...) study live juries. The indirect sources of evidence used by researchers suffer from various problems, the most important of which is dubious levels of ecological validity. Real jury research—studying live jury deliberation—is controversial. However, as I argue, the objections to it are unconvincing. There is in fact a moral imperative to facilitate real jury research. Attention-deficit hyperactivity disorder is one of the most common neurodevelopmental disorders in children and adolescents. People who have this disorder are characterized by presenting difficulties in the processes of sustained attention, being very active, and having poor control of their impulses. Despite the high prevalence of this disorder and the existence of various tests used for its diagnosis, few data are available regarding the usefulness and diagnostic validity of these tools. Given the difficulties that these subjects present in executive functions, (...) the aim of this study was to evaluate whether the Neuropsychological Assessment of Executive Functions battery for Children allows to establish specific profiles of executive performance for people with attention-deficit hyperactivity disorder. The sample was made up of 197 participants of both sexes, aged between 6 and 12 years age. A nonexperimental design was followed, using a comparative descriptive study method. The results indicated that the scales of phonological fluency, color path, rings, and interference are the most associated with the diagnosis of ADHD, providing data on inhibition, mental flexibility, sustained and selective attention, planning, verbal fluency, and working memory, among others. The practical implication of these results is in line with providing support in the clinical diagnosis that is carried out in children’s mental health units. In addition, the ENFEN tool can be valued as a suitable psychometric instrument in the psychoeducational field, helping professionals in a school environment to be more aware of the areas of cognitive development in which a student diagnosed with ADHD will have more difficulties and, in doing so, providing more adjusted and effective psychopedagogical measures when it comes to supporting students in their adaptation to the school environment. The main purpose of this paper is to shed light on Pierre Bourdieu’s conception of language. Although he has dedicated a significant part of his work to the study of language and even though his analysis of language has been extensively discussed in the literature, almost no attention has been paid to the fact that Bourdieu’s account of language is based on a number of ontological presuppositions, that is, on a set of universal assumptions about the very nature of language. (...) This article aims to fill this gap in the literature by offering a detailed overview of 10 key features which, from a Bourdieusian point of view, can be regarded as inherent in language. On the basis of this enquiry, the study seeks to demonstrate that—contrary to common belief—there is not only a Bourdieusian sociology of language but also a Bourdieusian philosophy of language, which provides a useful theoretical framework for examining the unavoidable conditions of the real speech situation. The paper draws to a close by reflecting on the flaws and limitations of Bourdieu’s approach to language. (shrink)

The world is undeniably full of injustice. Many feel that much political philosophy is practically impotent and engaged instead in overly abstract theorising insufficiently sensitive to the realities of the world. One response to this concern is David Miller’s influential model of evidence-based political philosophy, which claims to be sensitive to empirical evidence from the social sciences, takes seriously people’s opinions, and defends the role of facts in grounding normative principles. Using various examples from the field of global justice, one (...) of Miller’s key areas of work, I show that Miller’s method is unconvincing on two levels. His theoretical argument for fact-dependence is flawed, and his practical argument for an opinion-sensitive political theory is either guilty of status quo bias or, in an attempt to escape it, becomes self-defeating. While the paper is primarily critical, I endeavour also to draw out the implications of my critiques for the role of the ‘real world’ in theorising. (shrink)

We will give a simple philosophical "proof" of the negation of Cantor's continuum hypothesis (CH). (A formal proof for or against CH from the axioms of ZFC is impossible; see Cohen [1].) We will assume the axioms of ZFC together with intuitively clear axioms which are based on some intuition of Stuart Davidson and an old theorem of Sierpinski and are justified by the symmetry in a thought experiment throwing darts at the real number line. We will in fact (...) show why there must be an infinity of cardinalities between the integers and the reals. We will also show why Martin's Axiom must be false, and we will prove the extension of Fubini's Theorem for Lebesgue measure where joint measurability is not assumed. Following the philosophy--if you reject CH you are only two steps away from rejecting the axiom of choice (AC)--we will point out along the way some extensions of our intuition which contradict AC. We also prove that the same result holds for the bimodal system S4+S5+C, which is a strengthening of a 1999 result of Shehtman 369).

The cybernetic definition of a living individual proposed previously (Korzeniewski, 2001) is very abstract and therefore describes the essence of life in a very formal and general way. In the present article this definition is reformulated in order to determine clearly the relation between life in general and a living individual in particular, and it is further explained and defended. Next, the cybernetic definition of a living individual is confronted with the real world. It is demonstrated that numerous restrictions (...) imposed on the cybernetic definition of life by physical reality imply a number of particular properties of life that characterize present life on Earth, namely: (1) a living individual must be a dissipative structure (and therefore a low-entropy thermodynamic system out of the state of equilibrium); (2) spontaneously-originated life must be based on organic compounds; (3) evolutionarily stable self-dependent, free-living individuals must have some minimal level of complexity of structure and function; (4) a living individual must have a record of identity separated from an executive machinery; (5) the identity of living individuals must mutate and may evolve; (6) living individuals may collect and accumulate information in subsequent generations over very long periods of time; (7) the degree of complexity of a living individual reflects the degree of complexity of its environment (ecological niche) and (8) living individuals are capable of supple adaptation to varying environmental conditions. Thus, the cybernetic definition of a living individual, when confronted with the real physical world, generates most of the general properties of the present life on Earth. (shrink)

In the discipline of practical theology, one finds a long history of linking the name of the field to diaconiology, in which you find the Greek word diaconia, directly translated as 'service'. For good and scientific reasons, the field changed its name to practical theology in some Faculties of Theology but that does not take away the fact that this field of research is still very much engaged in the broad area of 'service of all kinds'. The purpose of this (...) article was to do a descriptive investigation into the problems and challenges of service delivery in the suburb of Belhar (Cape Town), specifically looking at the role of leadership during a (new) time of struggle. As part of the normative task, the researcher took a closer look at the Belhar Confession as a prophetic stance in this regard. In an ironic twist, we see in these events the struggle between the real and the ideal that is typical of many places in the country facing problems with service delivery. The Church often thinks it knows what the world wants from it - inspiration, 'leadership,' clear teaching. But surely what the world is most hungry for is the simple knowledge that healing is possible - not by forgetting or minimizing outrages and sufferings but by sheer, obstinate, costly commitment to work with the grain of grace. The quest, as the subtitle indicates, is Cartesian in that it looks for Plato independently of the prevailing paradigms on where we are supposed to find him. The result of the quest is a complete pedagogical platform on Plato. This does not mean that the book leaves nothing out, covering all the dialogues and all the themes, but that it provides the full intellectual (...) apparatus for doing just that. It consists of two parts. The first is a general orientation in three chapters, one each pertaining to the life, thought, and works of Plato. Controversial and provocative, To Be Real is a blueprint for the creation of a new political force.

In section one, I briefly review the Harman/Doris argument and outline the most promising response. Then in section two I develop what I take the real challenge to virtue ethics to be. The final section of the chapter suggests two strategies for beginning to address this challenge.

When someone is prepunished, they are punished for a predicted crime they will or would commit. I argue that cases of prepunishment universally assumed to be merely hypothetical—including those in Philip K. Dick’s “The Minority Report”— are equivalent to some instances of the real-life punishment of attempt offenses. This conclusion puts pressure in two directions. If prepunishment is morally impermissible, as philosophers argue, then this calls for amendments to criminal justice theory and practice. At the same time, if prepunishment (...) is not imaginary, then the philosophers who reject it cannot claim that their view is supported by common sense. (shrink)

Historically developed along gender lines and arguably the most sex segregated of institutions, U.S. prisons are organized around the assumption of a gender binary. In this context, the existence and increasing visibility of transgender prisoners raise questions about how gender is accomplished by transgender prisoners in prisons for men. This analysis draws on official data and original interview data from 315 transgender inmates in 27 California prisons for men to focus analytic attention on the pursuit of “the real deal”—a (...) concept we develop to reference a dynamic related to how gender is accomplished by transgender inmates. Specifically, among transgender inmates in prisons for men, there is competition for the attention and affection of “real men” in prisons: the demonstrable and well-articulated desire to secure standing as “the best girl” in sex segregated institutional environments. Our empirical examination sheds light on the gender order that underpins prison life, the lived experience of gender and sexuality for transgender inmates in prisons for men, and how that experience reveals new aspects of the workings of gender accountability. This book gives a convincing philosophical explanation for the strong persistence of our diverse folk psychological intuitions about the self. For this purpose it introduces, on the one hand, the distinction between subject and self model as proposed by Metzinger, on the other hand, the distinction between a social/normative and a cognitive/organic perspective on the self. The book argues that one needs to take into account both distinctions, if one wants to answer notoriously difficult questions like the one that gives (...) the book its title: Is the self real? ABSTRACT The category of the right to the city, conceptualized over five decades ago by the French Marxist philosopher and sociologist Henri Lefebvre, is currently experiencing its second life. It has become a significant political slogan, which – in its counter-hegemonic aspirations towards social change and transgressing the existing order, primarily in the fight against the reality of neoliberal urbanization – rallies together various socio-political movements most often defined under the umbrella term of urban social movements. In my analysis of (...) Lefebvrian notions, I utilize the increasingly widespread category of ‘real utopia’. Additionally, this real utopia treats the right to the city in epistemological terms: as a peculiar type of knowledge co-produced at the intersection of academia and social activism, which remains a relatively rare interpretation among readers, interpreters and practitioners following Lefebvre. I search for these themes both directly in Lefebvre’s work as well as that of his continuators, observing the practices of producing knowledge useful to contemporary Polish right to the city movements. I argue that Locke’s various descriptions of real essence pick out one and the same thing, namely a nature that can be ascribed to many things, and in terms of which we can get matters of classification right or wrong. On my reading, Locke does not attack real essences of the sort that are the essences of real species, but rather the presumption that a sorting according to our species concepts and their names is a sorting of (...) things according to their real essences. And the lesson of Locke’s empirical argument against that presumption, I argue, is that our species concepts often function more like higher taxa, grouping together things that knowledge of their real essences would distinguish into distinct lowest species. We present an initial and elementary investigation of the formal specification and mechanical verification of programs that interact with environments. We describe a formal, mechanically produced proof that a simple, real time control program keeps a vehicle on a straightline course in a variable crosswind. To formalize the specification we define a mathematical function which models the interaction of the program and its environment. We then state and prove two theorems about this function: the simulated vehicle never gets farther (...) than three units away from the intended course and homes to the course if the wind ever remains steady for at least four sampling intervals. Buildings account for 40-odd percent of energy use, 25% of water consumption and one-third of global greenhouse gas emissions. With such a staggering impact, real estate holds tremendous economic, social and environmental potentialities for the global development agenda. This chapter intends to provide an overview of sustainable real estate in the Middle East by focusing on the state of the industry and identifying the challenges faced by the region. Finally, the trends shaping the future of sustainable real (...) estate are discussed. We claim that Kant's doctrine of the "transcendental ideal of pure reason" contains, in an anticipatory sense, a second-order theory of reality (as a second-order property) and of the highest being. Such a theory, as reconstructed in this paper, is a transformation of Kant's metatheoretical regulative and heuristic presuppositions of empirical theories into a hypothetical ontotheology. We show that this metaphysical theory, in distinction to Descartes' and Leibniz's ontotheology, in many aspects resembles Gödel's theoretical conception of the possibility of a (...) supreme being. The proposed second-order modal formalization of the Kantian doctrine of the "transcendental ideal" of the supreme being includes some specific features of Kantian general logic like "categorical", "hypothetical", and exclusive disjunctive propositions as basic forms. The current paper details a restricted semantics for active logic, a time-sensitive, contradictiontolerant logical reasoning formalism. Central to active logic are special rules controlling the inheritance of beliefs in general, and beliefs about the current time in particular, very tight controls on what can be derived from direct contradictions (P &¬P ), and mechanisms allowing an agent to represent and reason about its own beliefs and past reasoning. Using these ideas, we introduce a new definition of model and of logical (...) consequence, as well as a new definition of soundness such that, when reasoning with consistent premises, all classically sound rules are sound for active logic. However, not everything that is classically sound remains sound in our sense, for by classical definitions, all rules with contradictory premises are vacuously sound, whereas in active logic not everything follows from a contradiction. John Rist surveys the history of ethics from Plato to the present and offers a vigorous defence of an ethical theory based on a revised version of Platonic realism. In a wide-ranging discussion he examines well-known alternatives to Platonism, in particular Epicurus, Hobbes, Hume and Kant as well as contemporary 'practical reasoners', and argues that most post-Enlightenment theories of morality depend on an abandoned Christian metaphysic and are unintelligible without such grounding. He also argues that contemporary choice-based theories, whether they (...) take a strictly ethical or more obviously political form, are ultimately arbitrary in nature. This piece looks at the implications of Zizek's work on cyberspace for understanding the ideology of communicative capitalism. Emphasizing the role of the decline of symbolic efficiency in theorizing virtuality, the author extends the analysis into the field of practices known as Web 2.0. She argues that Zizek's work on drive opens up the internet as Real and employs it in a critique of Kittler and Hansen.

Lacan critiqued imaginary intuition for confusing direct perception with unconscious pre-conceptions about people and the world. The emphasis on description goes hand in hand with a rejection of theory and the science of the unconscious and a belief in the naive self-transparency of the world. At the same time, knowing in and of the Real requires a place beyond thinking, multi-valued forms of logic, mathematical equations, and different conceptions of causality, acausality, and chance. This book explores some of the (...) mathematical problems raised by Lacan's use of numbers and the interconnection between mathematics and psychoanalytic ideas. Within any system, mathematical or otherwise, there are holes, or acausal cores and remainders of indecidability. As a maverick philosopher unafraid of challenging the ideas and methods of his colleagues, Clément Rosset’s work attempts to connect sometimes-lofty academic philosophy with the concerns of everyday life. For decades, he has worked to illuminate some of the most obscure metaphysical issues, often using popular film, theatre, novels, and comic books to illustrate his ideas, and as a result he has gained a reputation as both a happy sage and a singular mind. In _The Real and Its Double,_ (...) expertly translated by Chris Turner, Rosset takes on the question of the Real and humanity’s natural ability to sidestep and bypass it. The key to this type of evasion, Rosset suggests, is a certain form of oracular thinking that lies buried in the origins of Western metaphysics and psychology. Here, Rosset eschews the prolix and paradoxical psychological theories of Derrida and Lacan in favor of an exceptional lucidity that speaks to his Nietzschean-tragic love of life. If good philosophy can be defined as expressing complicated things in a simple way, then here, in one of his best-known works, Rosset has proven himself a master. (shrink)

"In Learning from Our Mistakes: Epistemology for the Real World, Talbott provides a new framework for understanding the history of Western epistemology and uses that framework to propose a new way of understanding rational belief. His proposal makes epistemology relevant to the real world, which he illustrates with a new theory of racial, gender and other kinds of prejudice, a new diagnosis of the sources of the inequity in the U.S. criminal justice system, and insight into the proliferation (...) of tribal and fascist epistemologies based on alt-facts and alt-truth. Talbott's new model of rational belief is not a model of a theorem prover in mathematics. It is a model of a good learner. Being a good learner requires sensitivity to clues, the maginative ability to generate alternative explanatory narratives that fit the clues, and the ability to select the most coherent explanatory narrative. Sensitivity to clues requires sensitivity not only to evidence that supports one's own beliefs, but also to evidence that casts doubt on them. One of the most important characteristics of a good learner is the ability to correct mistakes. Talbott articulates nine principles that help to explain the difference between rational and irrational belief. Talbott contrasts his approach with the approach of historically important philosophers, including Socrates, Plato, Aristotle, Hume, Kant, Wittgenstein, and Kuhn. He also contrasts his approach with a variety of contemporary approaches, including pragmatism, Bayesianism, and naturalism. Meinong’s thought has been rediscovered in recent times by analytic philosophy: his object theory has significant consequences in formal ontology, and especially his account of impossible objects has proved itself to be decisive in a wide range of fields, from logic up to ontology of fiction. Rejecting the traditional ‘prejudice in favour of the real’, Meinong investigates what there is not: a peculiar non-existing object is precisely the fictional object, which exemplifies a number of properties without existing in the (...) same way as flesh-and-blood detectives do. Fictional objects are in some sense incomplete objects, whose core of constituent properties is not completely determined. Now, what does it imply to hold that a fictional object may also occur in true statements? We shall deal with the objections raised by Russell and Quine against Meinong’s view, pointing out limits and advantages of both perspectives. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 63.1 (2002) 63-82 [Access article in PDF] Faith, Philosophy, and the Nominalist Background to Luther's Defense of the Real Presence Thomas Osborne Recent scholarship has brought into question the traditional interpretation of Luther as being hostile towards philosophy. 1 Graham White claims that Luther holds a place in the history of logic as a member of the Nominalist tradition. 2 Bruce D. (...) Marshall argues that Luther and Thomas Aquinas fundamentally agree on the relationship between faith and reason. 3 Both scholars recognize that Luther himself stressed the importance of logic and used late medieval philosophical techniques. Although I agree with this scholarship that Luther's thought must not be understood in isolation from late medieval thought, I will argue that Luther uses philosophical ideas in a way which conflicts with that of the scholastic tradition. The focus here is on Luther's understanding of the relationship between faith and reason in the context of Luther's controversy over the Eucharist with the Swiss sacramentarians, among whom Zwingli and Oecolampadius were the most prominent. 4 Although Luther uses philosophical [End Page 63] distinctions to argue against what he thinks are misinterpretations of the Bible, he does not in any explicit and systematic way use philosophy to arrive at a theological understanding of the Eucharist. Luther differs from his scholastic predecessors in that he uses philosophy not to develop theological conclusions but only to attack errors about the Bible, and so the concern here is with Luther's use of Nominalist doctrines about presence in his attack on the sacra-mentarians' belief that Christ cannot be present both at the right hand of God and in the Eucharist at the same time.In his discussion of the Eucharistic doctrine which is presented in The Babylonian Captivity of the Church (1520), Luther not only argues against the Catholic doctrine of the Eucharistic sacrifice but also against transubstantiation. 5 Luther explicitly states that he was influenced on this issue by Peter D'Ailly, a Nominalist follower of William of Ockham. D'Ailly and other Nominalists thought that transubstantiation was not the only possible way that Christ could be present in the Eucharist, since if God wished he could also make Christ present along with the substance of the bread and wine. 6 From a Nominalist [End Page 64] perspective transubstantiation requires two actions of God, namely, the annihilation of the substance of the bread and the placement of Christ's body under the species. Therefore, consubstantiation would be a simpler account of Christ's Eucharistic presence. If Christ's body were present along with the substance of the bread annihilation would not have to occur. But D'Ailly and the Nominalists argue that we know from Church authority that the real presence occurs through transubstantiation. On this issue the Nominalists differ from Thomas Aquinas, who gives philosophically-based arguments against consubstantiation. 7 When Luther attacks Thomas, he attacks not so much the use of philosophy in theology as Thomas's philosophy: "But this opinion of Thomas hangs so completely in the air without support of Scripture or reason that it seems to me he knows neither his philosophy nor his dialectic." 8Since the Nominalist belief in transubstantiation rather than consubstantiation rests on an acceptance of Church authority, the rejection of such authority would seem to lead to a rejection of transubstantiation. John Rawls, Jürgen Habermas, and Bruce Ackerman have identified legitimate political arrangements with those to which speakers in an idealized discourse could agree. Michael Walzer, Tim Heysse, and others have raised questions regarding this appeal to ideal speech situations, arguing that we ought to ground our political decisions in real, rather than ideal conversations. This paper responds to some of these criticisms by examining the value of agreement.

This essay sketches a method for identifying the insights that diverse religious traditions offer to the field of business ethics. Each article in this volume asserts or assumes faith-based claims about what is "truly real" as the ground of moral aspiration and obligation. Four distinct kinds of claims yield four kinds of wisdom, that is, moral guidance for business practice. 1) In Judaism and Islam, scriptural commands, as interpreted authoritatively down through these traditions, yield precise methods for rendering specific (...) moral judgments; in Roman Catholicism, similar guidance is provided through natural law. 2) In Buddhism, Judaism, and most of the surveyed Christian traditions, the values of compassion, love, and justice provide spiritual resources to counter pressures towards immoral behavior in business. 3) The African-American and Mennonite churches interpret their particular histories of oppression to offer distinctive models of fortitude and hope. 4) In Evangelical Calvinism, Mormonism, and Roman Catholic social teaching, convictions about God's redemptive and sanctifying activity offer a robust moral vision for successful striving. What is considered ugly, grotesque or unpleasant by the fashion world? The first collection presented by Rei Kawakubo in Paris was classified as offensive to Western aesthetic standards, for it questioned the French ideal of beauty and elegance. Through silhouettes covered in frayed, perforated and monochromatic fabrics, Kawakubo disrupted the established notion of the beautiful body, stripping it of the clichés of femininity, explicit sexuality and glamour. We prove that $${\mathbb{T}}$$ is complete and admits quantifier elimination when predicates are added for certain existential formulas.
