La réutilisation des données en dehors de la plateforme Facebook a été beaucoup discutée selon l'angle de la vie privée et de la nécessité d'un consentement préalable à la circulation et au traitement des informations personnelles. Les changements de réglages ont révélé au grand public que les conditions d'utilisation du réseau permettent de transférer les données des utilisateurs à des entreprises, la licence octroyée à Facebook étant transférable. A force d'abus répétés sur le terrain de la vie privée, le débat (...) à propos de Facebook ignore largement la question de l'appropriation des données et de leur partage volontaire. Le contrôle du partage s'effectue de manière restrictive dans les réglages de la plateforme, en vue de ne pas autoriser l'accès et la réutilisation par certaines personnes et applications extérieures. Mais le choix de permettre leur rediffusion en dehors du profil personnel semble absent. En effet, le contrôle peut également être envisagé de manière positive, comme le fait d'autoriser d'autres personnes et applications à réutiliser les données. Starting from a teleological understanding of the rule of law, this article argues that private power is a rule of law concern as much as public power. One way of applying the rule of law to private power would be to limit instances of ‘lawlessness’ and arbitrariness through formal requirements and procedural guarantees. However, we argue that private power is, to a significant extent, constituted by law in the first place – and that its lawful exercise is no less pernicious (...) than its unlawful exercise. Drawing on this constitutive function of law, we propose a normative core of the rule of law grounded on the moral equality of individuals. Attention to individuals’ needs, capabilities, and public autonomy points to requirements of distributive justice and democratic participation as part of the power-conferring function of law. Through a discussion of contestations of fossil fuel policy, the article shows the critical and empowering potential of a reconfigured rule of law. (shrink)

Ontology has been traditionally guided by sophia, a form of knowledge directed toward that which is eternal, permanent, necessary. This tradition finds an important early expression in the philosophical ontology of Aristotle. Yet in the Nicomachean Ethics, Aristotle's intense concern to do justice to the world of finite contingency leads him to develop a mode of knowledge, phronsis, that implicitly challenges the hegemony of sophia and the economy of values on which it depends. Following in the tradition of the early (...) Heidegger's recognition of the ontological significance of Aristotle's Ethics and of Gadamer's appropriation of phronsis for hermeneutics, this article argues that an ontology guided by phronsis is preferable to one governed by sophia. Specifically, it suggests that by taking sophia as its paradigm, traditional philosophical ontology has historically been determined by a kind of knowledge that is incapable of critically considering the concrete historico-ethico-political conditions of its own deployment. This critique of sophia is accomplished by uncovering the economy of values that led Aristotle to privilege sophia over phronsis. It is intended to open up the possibility of developing an ontology of finite contingency based on phronsis. Such an ontology, because it is guided by and must remain responsible to the concrete individual with which it is engaged, would be ethical at its very core. (shrink)

Against the background of the 2022 national elections in the Philippines, in which the Church failed in the moral fight against the return of the Marcoses and the continuation of the Duterte regime in power, this article makes a social discernment as to why the Church has not succeeded in its social mission in shaping the social consciousness of the Filipino people. Why has the Catholic social tradition not taken root in the Philippine soil and in the Filipino soul? The (...) author argues that the Church has located itself in the center rather than grounding itself in the margins. The author proposes a reappropriation of the Catholic social tradition from the margins to more dynamically transform Philippine society. (shrink)

Memes are a prominent example of a kind of digital artifact. It is widely agreed that an integral component of meme-making is the way in which it makes use of other existing material. In this paper, I examine three different ways of understanding this making use of. First, it has been seen in economic terms, as a kind of poaching. Secondly, the cultural concept of (re)appropriation has been deployed. Finally, Lévi-Strauss’s notion of bricolage is often mentioned. I argue that despite (...) some interesting insights deriving from the first two approaches, it is the third that gives the most comprehensive and interesting take on meme-making. (shrink)

This paper draws upon my research into the posthumously published fragmentary remains of Hölderlin and Novalis's philosophical reflections to describe how their explanations of the possibility of self-consciousness are far more convincing than those provided by their philosophical contemporaries, and still have much to contribute to contemporary debates concerning the nature of 'consciousness' and 'selfhood.' The paper begins by sketching the background to their accounts of self-consciousness, that is, Fichte's critique of Kant's 'reflection model' of self-consciousness and the subsequent critique (...) of Fichte's 'solution' to this problem by more orthodox Kantians. I shall then present an account of how Hölderlin and Novalis may be said to enact a 'synthesis' of the opposed Kantian and Fichtean positions, to formulate an account of self-consciousness that on one hand acknowledges the power of—in Henrich's words—Fichtes ursprüngliche Einsicht into the inadequacy of the Kantian 'reflection model,' whilst, on the other hand, re-appropriating such a 'reflection model.' They thus argue that I am only aware of myself as T by means of a reflective act, whilst at the same time arguing that such awareness nevertheless involves a non-reflective 'dimension.' For Hölderlin and Novalis, therefore, consciousness is always intentionally directed, and yet in being intentionally directed, it is also non-reflectively related to itself or "self-luminous" sea conception of consciousness which has similarities with Sartre's conception of the 'pre-reflective cogito.'. Whereas mainstream theories of environmental art and sustainable development consider art as a domain suitable for the application of environmentally friendly procedures, such as the circular economy, trash management and digitization, this research article focuses on the internal development of the autopoetic and self-referential art machine, which generates an art-specific sustainability. The circular environmental economy coexists with the circular art economy, which implies changes in the aesthetics and poetics of the artwork; it deploys upcycling to use art trash in creating (...) a new, higher value object. Art-specific sustainability contributes to the power and complexity of the art machine with new conceptual interventions and devices. These devices allow art to resist threats from other fields and to redefine itself. As sustainable development agendas of international organizations take into account the social, political, and economic initiatives that promote ethics, inclusion, and tolerance, this article discusses the contributions of contemporary environmental art to expanded concepts of the political and science. In particular, art activism, in cooperation with civil society, can be an important driver in areas that parliamentary politics overlooks. (shrink)

The doctrine of the communication of natures has played a primarily descriptive role in the history of Christology, and so it is perhaps unsurprising that it has largely gone missing from contemporary theology. This is a serious oversight. But Karl Barth is a noteworthy exception to the reductionist trend, and he provides the Reformed tradition's most complete and substantive engagement with the communication of natures and its implications for dogmatic theology. Through a close reading of volume IV/2 of the Church (...) Dogmatics , this essay considers Karl Barth's vital emphasis upon the communicatio naturarum and the role it plays in his actualist Christology. Barth demonstrates that the traditional threefold communication (of attributes, graces, and operations) has material as well as formal importance. According to Barth, we see in Christ not the mere coincidence of two natures, nor an interpenetration, nor the transformation of one into the other – but mutual operation and interpretation, where divinity and humanity each acquires and has its determination in the other. The purpose of this article is to offer an alternative, more nuanced analysis of the labelling of frontline workers as heroes than originally proposed. Here, we argue that the hero narrative in itself need not be problematic, but highlight a number of wider factors that have led to the initial rise in support for labelling frontline workers as heroes. Through our related work, we have gathered similar stories from frontline workers where they feel betrayed, let down or otherwise short-changed by (...) the hero label, and we have sought to make sense of this through understanding more about how the hero label is used rather than what it means. In this article, we propose a way forward where there is greater discussion around the hero label in this context where individuals can be heroes but still struggle, still fail and still feel vulnerable, and where heroism is viewed as a state of interdependence between heroic actor and the wider group. It is true that heroes can inspire, lead, guide and build morale and camaraderie, but collective responsibility is held with us all. We can draw hope and energy from our heroes, but we must dig deep and be proactive, particularly in the face of adversity. In doing so, we support the heroes to lead from the front and ensure that even though we cannot physically help; we are not making their situation worse. (shrink)

Pour cela, il retrace le processus de migration des savoirs indigénistes depuis leur contexte d'origine au Mexique jusqu'au Brésil, et les transformations qu'ils connaissent au cours de leur trajectoire jusqu'à aujourd'hui, en s'appuyant sur la notion de « traditions de savoirs » pour la gestion des populations qui se sont développées à partir de l'époque coloniale. Cette approche participe d'une anthropologie du colonialisme, en ce qu'elle étudie les (...) conceptions de la diversité culturelle des populations dans les administrations publiques brésiliennes et les façons de gouverner celles-ci. The hegemonic discourse on humanism in the contemporary academy – a critical discourse in the form of a theoretical anti-humanism – is marked by a certain degree of impoverishment. This impoverishment is the result of many contextual factors, including the ideological purposes to which the discourse has been put, but also the effects of internal workings of the paradigm associated with anti-humanism itself. In this article, I trace the development of this discourse in its foundational early- and mid-twentieth century manifestations, (...) outlining its central characteristics as well as its tensions and aporias, both theoretical and political. I argue that the critical discourse, which has informed our contemporary understanding of humanism, needs to be meaningfully sublated and that a new discourse – one that has reflected deeply upon the anti-humanist discourse: its strengths and its weaknesses – should take its place. S’inscrivant dans le cadre des récentes tentatives de redécouverte et de réhabilitation historique et littéraire du XIXe siècle haïtien, cet article vise à explorer l’expression de l’universalisme révolutionnaire chez les poètes haïtiens du XIXe siècle, en offrant une nouvelle perspective sur leur utilisation de l’imagerie classique. En particulier, il s’agira de reconsidérer la réception de ces poètes pour révéler la profondeur idéologique souvent ignorée de leurs écrits, enracinés dans les valeurs républicaines des Lumières. En réponse aux accusations racistes de la (...) Métropole – qui réduisent l’insurrection qui a conduit à la déclaration d’indépendance du pays en 1804 à une question de race –, les poètes haïtiens adoptent dans leurs œuvres en vers un imaginaire épique et nationaliste, revendiquant une filiation explicite avec l’universalisme de la Révolution française. Cet imaginaire n’est pas un simple emprunt stylistique, mais une adhésion convaincue aux idéaux universels de la République, ainsi qu’un témoignage du rôle actif des intellectuels haïtiens dans le débat international sur l’abolition de l’esclavage. L’étude proposée ici partira de la contextualisation historico-politique dans laquelle la poésie nationale haïtienne est née et s’est développée, pour se concentrer ensuite sur l’analyse de l’iconographie révolutionnaire de la première production poétique haïtienne. Cet article étudie la conception de l’expérience esthétique qui se dégage de la lecture des Cahiers de Paul Valéry. Marquée par un formalisme rigoureux, la pensée de Valéry révèle qu’au-delà de l’exigence esthétique, il s’agit d’un projet plus large : celui de modifier l’expérience dans son ensemble. Au regard de cette ambition, l’importance accordée à la forme de l’œuvre se justifie par le fait qu’elle incarne un effort de structuration et d’activité mentale. In this paper I offer a critical reading of some aspects of Heidegger’s late philosophy and evaluate how these relate to his nationalist claim that we need to stay rooted in the soil of our homeland. In response to this claim, Žižek suggests thet being-rootless is the primordial state of being-human and that what we represent as our roots are secondary attempts to obfuscate this dimension. First, I will present Heidegger’s philosophy of technology to elucidate his thesis that the essence (...) of modern technology determinates the way we come to experience the totality of beings in our times as “standing reserve”. In the second section, I expound his aesthetics where art is seen as a mode of approaching entities that follows a different logic to that of the Gestell. However, this analysis of Heidegger’s philosophy of art will reveal a political dimension to the concept of earth which I take to be a reactionary attempt to neutralize the eventual dimension of the Gestell. In the third section, I offer a critical re-interpretation of Heidegger’s philosophy following Žižek’s clue. I argue that modern art is characterized by its self-reflexive character which can be deemed transcendental once we accept the ontological dimension of art following Heidegger. These works offer a rooting in our own rootless condition analogous to the grounding in the Abgrund of Hegel’s absolute knowledge. Finally, I offer an analysis of Quentin Tarantino’s Inglorius Basterds from the perspective of the conceptual framework developed in the previous pages. (shrink)

How do we know ourselves? When it comes to our states of mind, it might seem that self-knowledge enjoys a privilege: I know what I'm thinking because I have immediate access to my mind. Inspired by Sartre, two American philosophers, Richard Moran and Charles Larmore, have argued that this idea fails to account for our singular relationship with our own minds. In addition to knowing ourselves through theoretical reflection, we are also capable of practical reflection. We can answer the question (...) of what we think in a practical way: through a decision or a commitment, rather than a self-interpretation. But what is the relationship between these two types of self-reflection? What should we do when they conflict? This book seeks to answer these questions. In so doing, it shows the importance of another path to self-knowledge hitherto left aside by analytic authors: phenomenological reflection on our experience of the world. -/- Comment se connaît-on soi-même ? Concernant nos états d’esprit, il peut sembler que la connaissance de soi jouisse d’un privilège : je sais ce que je pense parce que j’ai un accès immédiat à mon esprit. Le mouvement de réappropriation des espaces physiques et virtuels de parole pour dénoncer les injustices et ceux qui les commettent a pris des formes multiples : de l’occupation de places publiques à la libération de la parole contre les violences systémiques, sexistes et racistes en particulier, via des mouvements comme #MeToo et #OnVeutRespirer. Les féminismes contemporains s’inscrivent ainsi dans un contexte de mobilisation caractérisé par la défiance vis-à-vis d’une démocratie représentative perçue comme confisquée par les élites et par un horizon (...) de « convergence des luttes » ne recomposant pas l’hégémonie d’un critère ou d’une idéologie. Comment, au sein de la société française contemporaine, l’entrecroisement des urgences écologique, sociale et sanitaire questionne-t-il le rapport à l’engagement, en particulier féministe? Cette interrogation est appréhendée à partir d’une enquête qualitative, menée de juillet 2019 à août 2020, auprès de plus de 120 responsables associatifs féministes, anti-racistes, écologistes, antispécistes, pour la justice sociale et/ou de lutte contre la pauvreté, mais aussi d’activistes avec des affiliations plurielles et fluides. Après avoir abordé la manière dont la question du « faire commun » se pose à l’ère de la Covid-19 et des controverses autour de la « cancel culture », nous examinerons comment les féminismes contemporains sont mis à l’épreuve par l’horizon d’une émancipation partagée dans une interdépendance apaisée. How can we best understand our aesthetic appreciation of sky and space? This essay begins by outlining the nature of spatial experience through some examples. Then it examines how our responses can be shaped by art and myth. Here we see how themes, such as ascension, that were current in prehistory and developed religions, can be reappropriated as components of a justifiable aesthetic experience. However, the task of finding defensible aesthetic responses to space as both experience and abstract idea does (...) present paradoxes. For example, how are we to respond to scientific updates about the ever greater vastness of space? The way forward presented here is to endorse, but not with any sense of uniqueness of misplaced grandeur, our freedom to contemplate with due seriousness both the near and the far and our own capacities, such as imagination and love, as also part of the wonder and mystery of the universe. Anglophone theoretical reflections on gender often assume the generalizability of their claims without first asking whether “gender” as a term exists, or exists in the same way, in other languages. Some of the resistance to the entry of “gender” as a term into non-Anglophone contexts emerges from a resistance to English or, indeed, from within the syntax of a language in which questions of gender are settled through verb inflections or implied reference. A larger form of resistance, of course, has (...) to do with fears that the category will itself release forms of sexual freedom and challenges to existing hierarchies within the second language. The well-organized political attack on gender and gender studies now occurring throughout the world has many sources, and that is not the focus of this essay. This essay maintains that there can be no theory of gender without translation and that Anglophone monolingualism too often assumes that English forms a sufficient basis for theoretical claims about gender. Further, because the contemporary usage of gender emerges from a coinage introduced by sexologists and reappropriated by feminists, it proves to be a term that is bound up with grammatical innovation and syntactical challenges from the start. Without an understanding of translation—its practice and its limits—there can be no gender studies within a global framework. Finally, the process of becoming gendered, or changing genders, requires translation in order to communicate the new terms for recognizing new modalities of gender. Thus, translation is a constitutive part of any theory of gender that seeks to be multilingual and that accepts the historically dynamic character of languages. This framework can help facilitate a way of recognizing different genders, and different accounts of gender identity as requiring both translation and its limits. Without translation and historical coinage, there is no way to understand the dynamic and changing category of gender and the resistances it now encounters. (shrink)

The terrorist attacks that struck France in 2015 had reverberations throughout the country’s intellectual fields. Among the most significant was a widespread polemic that turned around whether sociological explanations of the attacks amounted to excuses and justifications for terrorists. When prominent politicians and pundits made allegations of this nature, sociologists reacted in three main ways: most denied the allegations, others reappropriated the derogatory label of excuse, while others still accepted criticism and called for a reformation of sociology. These epistemological stances (...) can be properly understood only by studying the long history of debates around ‘sociological excuses’ in France and by analysing French sociology as a field of forces and struggles. This book outlines the most important points of intersection between early phenomenology and critical theory. It develops extensive analyses’ of specific instruments of the phenomenological method such as eidetic intuition and the procedures of genetic phenomenology. These procedures were both criticized and reappropriated by some of the most notable early critical theorists such as Adorno, Benjamin, Kracauer and Marcuse. As such, the book offers the first extensive account of the important phenomenological heritage of critical theory. The chapters focus on these early critical theorists and also discuss the applications of their methods within the treatment of numerous media-theory issues. For instance, the French news magazine Le Point published (...) an article on it called “How Saint Thomas Justifies Homosexuality.” This perception is bolstered by the cover artwork of Saints Sergius and Bacchus, who are considered in some circles to be patron saints of homosexual love. In fact, the book has two distinct parts. The first part is entirely on marriage between persons of the opposite sex. Oliva argues that Thomas Aquinas’s teaching on marriage was obscured in the nineteenth century, reappropriated by the Second Vatican Council, and now can be used to justify the reception of Communion and sacramental penance by Catholics who divorce and remarry while their spouse is still living and their marriage is not annulled. Only in the second part of the book does Oliva argue for the civil and ecclesiastical recognition of homosexual unions that are not marriages.The book is addressed to a general audience, although it refers to scholarship when needed. Oliva’s purpose is to use Thomas to contribute to contemporary theology and pastoral care. He does not entirely reject magisterial teaching on sexual ethics. For instance, he sympathetically discusses the treatment of heterosexual sex in Humanae vitae, and is generally opposed to simultaneous sexual relationships that are between more than two persons.In the first part of the book, Oliva notes that for Thomas marriage has a twofold perfection. The first perfection consists in the union of the spouses (which need not involve sexual acts), and the second in the generation and education of children. According to Oliva, only the first perfection is essential to marriage, which is shown by the fact that a marriage is valid even if the spouses voluntarily choose to abstain from the sexual act. Oliva eventually argues that recognition of this point should lead to the acceptance of second marriages (i.e., marriages after divorce) and the recognition that circumstances might prevent sexual acts in such marriages from being sinful.According to Oliva, Thomas’s understanding of the essence of marriage was used by the Fathers of the Council of Trent in what he describes as a decision to avoid the condemnation of divorce and remarriage for those in the Christian East. This interpretation of Trent is highly questionable and seems to rely partly on Giancarlo Pani’s recent popularization of Piet Fransen’s controversial scholarship (147 n. 41). In fact, Oliva does not show how Thomas’s understanding of marriage was supposedly used against those who wished to condemn divorce and remarriage. In general, he ignores the Council of Florence and various medieval and late Scholastic discussions of marriage, and generally passes over theologians from outside the Dominican Order. [End Page 137]Oliva correctly notes that the Catechism of the Council of Trent follows Thomas in distinguishing between three motives or ends of marriage, namely, society and mutual support, procreation, and the remedy for concupiscence. He passes over the other motives discussed in the Catechism, such as beauty, wealth, and the desire for heirs. Moreover, he does not mention the Catechism’s discussion of the three goods of marriage, namely, union, children, and fidelity, and how these might be related to marriage’s motives and essence. This oversight is odd because the Catechism’s treatment resembles Thomas’s discussion in the Summa contra Gentiles, book IV, chapter 78, in which Thomas explains how marriage is ordered to procreation. In general, Oliva neglects texts that might not fit well with his interpretation of Thomas, such as this chapter and the unedited IV Sentences, d. 33, q. 1, a. 2c.Oliva argues that Thomas’s teaching on the essence of marriage was neglected by the Magisterium and rejected by the 1917 Code, although it was revived to some extent... Juxtaposing the ecological insights of Arne Naess and Eihei Dōgen, Deane Curtin maintains that Dōgen’s metaphysical conception of sentience subsumes and corrects Naess’s ecologi­cal Self and its problem of limits. However, an alternative reading of Dōgen, one which deemphasizes the ontological status of the natural world in favor of how we epistemically view it, revitalizes Naess’s question of limits and enables us to reappropriate the problem as our problem. On associe habituellement Rousseau à la tradition républicaine, opposée schématiquement à la tradition libérale. Sans remettre en cause globalement cette thèse, il peut être intéressant de déplacer les termes de la problématique, en présentant la critique rousseauiste du libéralisme comme une critique menée de l’intérieur, plutôt que de l’extérieur. On peut en effet, à l’exemple de John Pocock, identifier un tronc commun aux pensées républicaine et libérale ou, à l’exemple de Charles Larmore, voir dans le républicanisme « une formulation plus (...) lucide de la théorie libérale ». Cela se traduit chez Rousseau par une stratégie consistant à se réapproprier les promesses contenues dans les prémisses du libéralisme, pour mieux en dénoncer les conséquences dogmatiques. De fait, on trouve chez Rousseau une défense des droits individuels, un souci de l’indépendance individuelle dans les relations économiques et plus généralement dans les rapports sociaux, une justification jusnaturaliste de la propriété privée, et même des emprunts à l’idée selon laquelle la mise en concurrence permettrait de définir les conditions d’un choix optimal. Cependant l’analyse de certains textes de l’Émile montre que Rousseau vise en définitive à dissiper l’illusion d’une autorégulation optimale des rapports sociaux et économiques : l’opacité et les distorsions des rapports économiques ainsi que l’usage spontanément irrationnel de la liberté individuelle impliquent la nécessité de gouverner la liberté, par l’éducation et par la législation. Aryeh Botwinick argues for the recovery of a radical democratic tradition that emphasizes the role of individual participation in the development and control of social and political institutions. Such involvement implies philosophical skepticism—the assumption that the truth about what is the best course of action cannot be known with certainty and that, therefore, every person’s opinion has an equal claim to be considered. The crucial stumbling block to reappropriating this radical egalitarian tradition is the supposed unviability of a consistent skepticism. (...) In an effort to chart a new course of philosophical inquiry into political matters, Botwinick grapples with the formulation of a consistent version of skepticism, claiming that it provides "a continually renewing impetus for the expansion of political participation." Twentieth-century philosophers have, for the most part, opted for some version of mitigated skepticism, which, the author argues, "has blinded them to the radical political implications of skepticism." Underscoring a pattern of convergence between Anglo-American and Continental philosophy, Botwinick proposes a number of strategies to rehabilitate the rationality of participatory democratic political institutions by articulating an acceptable version of consistent skepticism.
