This chapter provides a historical account of the transformation of pregnancy through philosophical theory and legal practice. What has remained seemingly consistent across history, though, is the lack of rights a pregnant woman can enjoy. Whilst it may manifest differently across time and place, unfortunately misogynistic attitudes persist, and this is reflected in the continual degrading of the gestator (and gestation), which is reinforced by certain philosophical theorising and technological advancement. We thus urge caution in making philosophical claims about the (...) epistemic transformation in pregnancy, given the epistemic (and other) injustices already faced by pregnant people. We recognise that there are transformations that occur because of pregnancy, but we argue that there ought not be with respect to the pregnant person's autonomy, agency, and control over their bodies. Through an analysis of legal cases, we can see that the practice falls out of line with the theory regarding how pregnant people are treated. But perhaps it is both the theory and the practice that need to change so as to bring them in line. How we theorise about pregnancy is intertwined with our cultural views, our technological advancements, and our medical and legal practices, requiring multi-disciplinary study for a more holistic overview. In this chapter, we contribute to this endeavour by bringing some such strands together, regarding the transformation that pregnancy is, that pregnancy makes, and that pregnancy has had historically, in philosophy, and in legal practice. In his excellent book, Four-Dimensionalism: An Ontology of Persistence and Time (Sider, 2001), Theodore Sider defends a version of four-dimensionalism which he calls the ‘stage-theory’. This paper focuses on Sider's argument from vagueness and argues that, due to the problematic nature of the argument from vagueness, Sider’s case in favor of four-dimensionalism is in the end not successful.

Nobody's going to object to the advice "Do the right thing", but that doesn't mean everyone's always going to follow it. Sometimes this is because of our volitional limitations; we cannot always bring ourselves to make the sacrifices that right action requires. But sometimes this is because of our cognitive limitations; we cannot always be sure of what is right. Sometimes we can't be sure of what's right because we don't know the non-normative facts. But sometimes, even if we were (...) to know all of the non-normative facts, we'd still not be sure about what's right, because we're uncertain about the normative reasons those facts give us. In this dissertation, I attempt to answer the question of what we're to do when we must act under fundamentally normative uncertainty. It's tempting to think that, in such circumstances, we should do what we regard as most probably right. I argue that this view is mistaken, for it is insensitive to how degrees of actions' values compare across different normative hypotheses; if an action is probably right, but, if wrong, is terribly, terribly, wrong, it may be rational not to do that action. A better answer is that we should do the action with the highest expected value. I spend the first part of the dissertation providing arguments for and rebutting arguments against this view of action under normative uncertainty. I spend the next part of the dissertation explaining what degrees of value are, and showing how they can be compared across normative hypotheses. In the remaining parts of the dissertation, I consider two questions related to our primary question -- first, what is one required, or obligated, to do under normative uncertainty; and second, what is it rational for one to do when one is not only normatively uncertain in the way we've been discussing, but also uncertain about what it is rational to do under this sort of normative uncertainty. Unique in both perspective and approach, this is the first book to use classical American pragmatism as an ethical framework for dealing with ethical issues in business. The book first explores ethical theory from both the traditional and pragmatic perspectives. Then, using the pragmatic perspective, discusses the nature of the corporation and its relationship to society, the various environments in which business functions, and specific issues in the contemporary marketplace and workplace.

This paper aims to provide a starting point for a non-representational approach to language. It will do so by undoing some of the reifying tendencies that are at the heart of the ontology of scientific psychology. Although non-representational theories are beginning to emerge, they remain committed to giving explanations in terms of ontological structures that are independent of human activity. If they maintain this commitment it is unlikely that they will displace representationalism in domains such as language. By following some (...) of Wittgenstein’s remarks on language, I explain the phenomenon of reification by carefully considering the formative, situational flow of language—thus without invoking representations. In this way, the paper sketches a direction of approach for a non-representational theory of language, undercutting the most important assumptions that justify an explanatory ontology devoid of human activity. In a recent PSA paper (2001a) as well as some other papers ((1995), (2000), (2001b)) and a book chapter (1999, ch. 7), Stathis Psillos raised a number of objections against structural realism. The aim of this paper is threefold: 1) to evaluate part of Psillos’ offence on the Russellian version of epistemic structural realism (ESR for short), 2) to elaborate more fully what Russellian ESR involves, and 3) to suggest improvements where it is indeed failing.

In this comment on Yli-Vakkuri and Hawthorne's illuminating book, Narrow Content, I address some issues related to externalist conceptions of linguistic meaning.

Are identity criteria grounding principles? A prima facie answer to this question is positive. Specifically, two-level identity criteria can be taken as principles related to issues of identity among objects of a given kind compared with objects of a more basic kind. Moreover, they are grounding metaphysical principles of some objects with regard to others. In the first part of the paper we criticise this prima facie natural reading of identity criteria. This result does not mean that identity criteria could (...) not be taken as grounding principles. In the second part, we propose some basic steps towards a conceptual reading of grounding. Homotopy Type Theory is a proposed new language and foundation for mathematics, combining algebraic topology with logic. An important rule for the treatment of identity in HoTT is path induction, which is commonly explained by appeal to the homotopy interpretation of the theory's types, tokens, and identities as spaces, points, and paths. However, if HoTT is to be an autonomous foundation then such an interpretation cannot play a fundamental role. In this paper we give a derivation of path (...) induction, motivated from pre-mathematical considerations, without recourse to homotopy theory. (shrink)

We analyze expressive small clauses like you fool (and their counterparts in other languages) as contributors of expressive content. Independently known restrictions on expressive content in turn allow us to derive their limited distribution. The theory has ramifications for child language. It correctly predicts which root-level small clauses will survive into adult grammar and which will be blocked by the acquisition of higher functional projections. It also opens the way to an analysis of children’s one- and two-word utterances as denoting (...) expressive, rather than straightforwardly propositional, content. (shrink)

We have previously argued that historical cases must be rendered canonical before they can plausibly serve as evidence for philosophical claims, where canonicity is established through a process of negotiation among historians and philosophers of science (Bolinska and Martin, 2020). Here, we extend this proposal by exploring how that negotiation might take place in practice. The working stock of historical examples that philosophers tend to employ has long been established informally, and, as a result, somewhat haphazardly. The composition of the (...) historical canon of philosophy of science is therefore path dependent, and cases often become stock examples for reasons tangential to their appropriateness for the purposes at hand. We show how the lack of rigor around the canonization of case studies has muddied the waters in selected philosophical debates. This, in turn, lays the groundwork for proposing ways in which they can be improved. (shrink)

According to recent approaches in the philosophy of medicine, biomedicine should be replaced or complemented by a humanistic medical model. Two humanistic approaches, narrative medicine and the phenomenology of medicine, have grown particularly popular in recent decades. This paper first suggests that these humanistic criticisms of biomedicine are insufficient. A central problem is that both approaches seem to offer a straw man definition of biomedicine. It then argues that the subsequent definition of humanism found in these approaches is problematically reduced (...) to a compassionate or psychological understanding. My main claims are that humanism cannot be sought in the patient–physician relationship alone and that a broad definition of medicine should help to revisit humanism. With this end in view, I defend what I call an outcomes-oriented approach to humanistic medicine, where humanism is set upon the capacity for a health system to produce good health outcomes. This paper historicizes the taken‐for‐granted acceptance of reflection as a fundamental professional practice in nursing. It draws attention to the broad application of reflective practice, from pedagogy to practice to regulation, and explores the epistemological basis upon which the authority of reflective discourse rests. Previous work has provided a series of critiques of the logic and suitability of reflective practice across all domains of nursing. The goal of this paper is to commence a history of nursing's reflective identity. This article describes the path‐mapping theory of how humans integrate analogical mapping and general problem solving. The theory posits that humans represent analogs with declarative roles, map analogs by lower‐level retrieval of analogous role paths, and coordinate mappings with higher‐level organizational knowledge. Implemented in the ACT‐R cognitive architecture, the path‐mapping theory enables models of analogical mapping behavior to incorporate and interface with other problem‐solving knowledge. Path‐mapping models thus can include task‐specific skills such as encoding analogs or generating (...) responses, and can make behavioral predictions at the level of real‐world metrics such as latency or correctness. We show that the path‐mapping theory can successfully account for the major phenomena addressed by previous theories of analogy. We also describe a path‐mapping model that can account for subjects' incremental eye‐movement and typing behavior in a story‐mapping task. We discuss extensions and implications of this work to other areas of analogy and problem‐solving research. (shrink)

What lessons does Holocaust education hold for preservice teachers and how does Holocaust education aid their growth as social justice educators? In this qualitative teacher research study we attempt to answer these questions by analyzing the coursework and reflections of 16 social studies preservice teachers (PSTs) as they completed an in-depth study of the Holocaust through historical research, field trips, and reading young adult literature, and designed creative and engaging lessons to teach the Holocaust to secondary social studies students (grades (...) 6-12). Findings reveal “blind spots” in the PSTs Holocaust-related content knowledge, pedagogy, ability to make connections between the historical event and their students’ lives, and their acceptance the role of social justice education (Bazerman & Tenbrunsel, 2011). Over the course of the study, the PSTs improved their content and pedagogical knowledge, and took their first steps towards becoming social justice educators. We also found that for PSTs, taking on the role of Holocaust educators and social justice educators takes time and practice This study broadens scholarship on many common concerns in teacher education, such as dispositions, multicultural education, and teaching for social justice. The findings inform teacher educators, teacher candidates, and practicing teachers on the connections between Holocaust and social justice education, and provide a model for teaching social studies for social justice. The goal of achieving Universal Health Coverage (UHC) can generally be realized only in stages. Moreover, resource, capacity and political constraints mean governments often face difficult trade-offs on the path to UHC. In a 2014 report, Making fair choices on the path to UHC, the WHO Consultative Group on Equity and Universal Health Coverage articulated principles for making such trade-offs in an equitable manner. We present three case studies which illustrate how these principles can guide practical decision-making. These (...) case studies show how progressive realization of the right to health can be effectively guided by priority-setting principles, including generating the greatest total health gain, priority for the worse off, and financial risk protection. In this book, Jana S. Ros̆ker offers the first comprehensive overview and exegesis of the work of Li Zehou, who is one of the most significant and influential Chinese philosophers of our time. Ros̆ker shows us how Li's complex system of thought seeks to revive various Chinese traditions, and at the same time attempts to harmonize or reconcile this cultural heritage with the demands of the dominant economic, political, and axiological structures of our globalized world. Variously characterized as 'neo-traditional,' 'neo-Kantian,' (...) 'post-Marxist,' 'Marxist-Confucian,' 'pragmatist,' 'instrumentalist,' 'romantic,' and more, Li's work was central to the period known as the Chinese Enlightenment in the 1980s and has helped modify and transform antiquated patterns of Chinese intellectual discourse. He is one of the rare Chinese thinkers whose work has had not only had a deep and lasting impact on Chinese intellectuals, but has acquired a broad readership outside of China as well. Seen from a broader intercultural perspective, Li's unique and imaginative approach to a wide range of basic theoretical problems has created new styles of intellectual investigation, while reminding us of our belonging to a common humanity, regardless of differences in our individual cultures, languages, preferences, and traditions. How should disability justice be conceptualised, not by orthodox human rights or capabilities approaches, but by a legal philosophy that mirrors an African relational community ideal? This book develops the first comprehensive answer to this question through the contemporary literature on African philosophy, which is relied upon to construct a legal philosophy of disability justice comprising of ethical ideals of community, human relationships and obligations. From these ideals, an African legal philosophy of disability justice is offered as a criterion for (...) critically evaluating existing laws, legal and political institutions, as well as providing an ethical basis for creating new ones to ensure that they are inclusive to people with disabilities. In taking an alternative perspective on the subject, the book outlines and emphasises the need for a new public culture of obligations owed to people with disabilities, highlighting both the prospects and difficulties of achieving the ideal of disability justice that continues to elude the lived experiences of millions of Africans today. Public accounting firms can build integrity within their organizations through early detection of fraud. One way to reduce and detect fraud is to encourage whistleblowing as a prosocial behavior. We explore the impact of mentoring on intention to report fraud. A survey with 120 responses from the US public accountants suggests that quality mentoring relationships, a common feature in the profession, and caring ethical climate positively relate to internal reporting of fraud. Two intermediate variables, trust and affective commitment, mediate these (...) effects. Mentor-relationship quality also increases perceptions of caring ethical climate. The study contributes to two bodies of research by finding extended benefits from mentoring, beyond those typically discussed in academic literature; and identifying a previously unexplored firm intervention capable of positively influencing prosocial behavior and combating fraud. This book examines how, in a series of critical confrontations, Stirner rejected the efforts of his “Young Hegelian” contemporaries to recast Hegel as a revolutionary. For him, the various apocalyptic declarations of these “pious atheists” were only the expressions of adolescent dreams set upon the annihilation of real individuality.

Drawing on biosemiotic theory and the Peircean idea of ‘abduction’, I shall propose the idea of a layered structure of bio / semiotic evolution, in which humanknowledge is systemic and recursive — and thus emergent both from what is forgotten and from earlier evolutionary strata. I will argue that abductions are those processes by which we move creatively between often unacknowledged types of knowledge which are rooted in our natural and cultural evolutionary past (e.g., unconscious, preconscious, or tacit knowledge; knowledge (...) that is experienced affectively) and the more familiar types of knowledge associated with self-conscious deductive and inductive reasoning. I shall suggest that these processes of ‘hooking back’ into the past in order to make new sense in the light of subsequent experience, are characteristic of all human inventiveness in both the arts and the sciences, and are facilitated by what Peirce called ‘The Play of Musement’.My reasons for attempting this task are that I hope to offer a semiotic and biosemiotic corrective to the widespread and culturally dominant idea that the progress ofhuman knowledge and cultural evolution depends on self rational efficiency, conceived of in terms of self-conscious deduction and induction alone — a conception which runs the risk of excluding from the account what is actually the most creative part of human knowing. Second, I will suggest that a properly semiotically informed understanding of human creativity — i.e., one which understands the Peircean semiotic as triadic and which draws on the post-Peircean theory that the semiotic drive in nature and in culture derives from the need to model the world as accurately as possible — should provide a very stern warning against the dangers of confusing the map with the territory. For creative artists and scientists (and life-livers, in general) progress, I shall suggest, inasmuch as they ignore the utilitarian dogma in practice. A biosemiotic understanding of human reasoning as an evolutionary semiotic process should thus contribute to a removal of the impediments of modernity which lie in the failure to properly grasp both what language (and semiosis in general) is, as well as the historical and prehistorical evolution that makes such semiosis possible. I reconstruct 20th-century Mexican philosopher José Vasconcelos’s answers to two important aesthetic-political questions: (1) Can aesthetic judgments bind community? and (2) Can aesthetic judgments drive political, social, and cultural change? My objectives are twofold: one, to show that Vasconcelos’s responses make original contributions to an important aesthetic-political tradition that begins with Kant, and two, to offer key ideas from Vasconcelos’s aesthetics to a wider audience, as an invitation to engage with his work in their research and teaching. In section I, (...) I argue that Kant’s remarks suggest that aesthetic judgments bind the community. In section II, I explain that Kant sometimes appears to suggest that aesthetic judgments promote political, social, and cultural change. Section III discusses two bridge figures—Schiller and Arendt—that help us better understand how Kantian aesthetics binds community and serves political purposes. In section IV, I argue that Vasconcelos aligns with the Kantian tradition exemplified by Schiller and Arendt when developing a plan for aesthetically-guided social and political progress. I also show that, during his time in various positions of power in the Mexican government, Vasconcelos brought ideas from the Kantian tradition to life. I conclude by reflecting on how Vasconcelos reveals new possibilities for the Kantian tradition. (shrink)

While developments of a shared intellectual tradition, the enactivist approach and the organizational account proffer importantly different accounts of organismic normativity. Where enactivists tend to follow Hans Jonas, Andres Weber, and Francisco Varela in grounding intrinsic affordance norms in existential concern, organizational theorists such as Alvaro Moreno, Matteo Mossio, and Leonardo Bich seek a more deflationary account of these normative phenomena. Critiques directed at both of these accounts of organismic normativity motivate the introduction of the precedential account of organismic normativity, (...) which I nevertheless locate within the enactivist approach, broadly construed. After detailing empirical evidence that would seem to vindicate the precedential account, I explore some of its implications. (shrink)

Kant is often regarded as one of the founding fathers of modern liberal democracy. His political theory reaches its climax in the ground-breaking work, Perpetual Peace (1795), which sets out the basic framework for a world federation of states united by a system of international law. What is less well known is that two years earlier, in his Religion within the Bounds of Bare Reason (1793/1794), Kant had postulated a very different, explicitly religious path to the politics of peace: (...) he presents the idea of an “ethical community” as a necessary requirement for humanity to become “satisfactory to God”. While many recent scholars have noted the importance of Kant’s concept of the ethical community, few recognize the force of his argument that such a community is possible only if it takes the form of a church; as a result, the precise status of his proposal remains unclear and under-appreciated. He argues in Division One, Section IV, of Religion’s Third Piece that the idea of this community can become a reality only through a “church” that is characterized by four rational requirements: unity, integrity, freedom, and the changeability of all church rules except these four unchangeable marks. Prior to Section IV, Division One portrays this ethical community as having a political form, yet an essentially nonpolitical matter. He compares it with Jewish theocracy, but observes that the latter failed to be an ethical commonwealth because it was explicitly political. Whereas traditional theocracy replaces the political state of nature (which conforms to the law, “might makes right”) with an ethical state of nature (which conforms to the law that I call, “should makes good”), or attempts to synthesize them, non-coercive theocracy transcends this distinction through a new perspective: it unites humanity in a common vision of a divine legislator whose only law is inward, binding church members together like families, through the law of love. Whereas the legal rights supported by democracy and a system of international law can go a long way to prepare for world peace, Kant’s conviction is that it will be ultimately impossible without support from healthy religion. Achieving genuine engagement and understanding between communities with radically divergent worldviews is challenging. If there is no common ground on which to stand and have a discussion, the likely outcomes of an apparent intercultural disagreement are a stalemate, or the (sometimes colonialist) imposition of a single worldview, or a kind of relativistic tolerance that falls short of genuine engagement. In this paper, we suggest a way forward that takes as its starting point the philosophical discussion of deep disagreement, using the (...) example of taniwha (powerful water beings that must be treated with respect) to outline a strategy for building intercultural understanding and enabling constructive intercultural dialogue.
