Outside Belongings argues against a psychological depth model of identity--one in which individuals possess an intrinsic quality that guarantees authentic belonging. Instead, Probyn proposes a model of identity that takes into account the desires of individuals, and groups of individuals, to belong. The main ideas she considers--"the outside", "the surface", and "belonging"--allow her to articulate, in concrete terms, her precise concerns about sexuality and nationality.

Outside Ethics brings together some of the most important and provocative works by one of the most creative philosophers writing today. Seeking to expand the scope of contemporary moral and political philosophy, Raymond Geuss here presents essays bound by a shared skepticism about a particular way of thinking about what is important in human life--a way of thinking that, in his view, is characteristic of contemporary Western societies and isolates three broad categories of things as important: subjective individual preferences, (...) knowledge, and restrictions on actions that affect other people. He sets these categories in a wider context and explores various human phenomena--including poetry, art, religion, and certain kinds of history and social criticism--that do not fit easily into these categories. The author of the article framed the question of the possible relevance of the treatment of the Schelling's philosophy in the context of a phenomenological one. Thereby, he points its problematic character, referencing Husserl's treatment of German idealism after Kant (including the thought of Schelling) as the romantic idealism. At the same time, he also states the influence of Schelling on the few phenomenologists who made their careers after Husserl. The article's author reviews the concept of the «being outside-itself» (...) or «ecstasy» in Schelling and Heidegger (as one of the phenomenologists) for the further concretization of the theme. The ecstasy in Schelling is the new name for the idealistic intellectual intuition, by which a singular subject loses its own position as subject and thereby gets to the position of the absolute subject. The absolute subject is one which cannot be an object already. Schelling identifies the ecstasy understood in this way with the wondering as philosophical initiation in Ancient Greece. Such ecstasy leads to unknowing knowledge in Schelling's words. The concept of being outside-itself means the structural element of being of human Dasein, i.e. of temporality in Heidegger. This philosopher thinks that a human being is always already outside itself ontologically, before any intuition both sensual and intellectual. The human subject is not closed in on itself, for then it has to transcend from its immanence to the outside. It is always outside itself, it is ecstatic. In its ecstasies, it is always in the world, instead of being inside the world and other people. Heidegger bases his critique of the traditional metaphysics of the subject on such understanding of the ontological structure of Dasein, i.e. of the true «subject». In conclusion, the article's author states that the approaches to the problem of being outside-itself of both mentioned philosophers are in principle, quite different. Schelling tries to rehabilitate the subjectivity by the reduction of the singular subject to the absolute one. On the contrary, the finitude of human Dasein is the necessary condition of its being in Heidegger. The ecstasy is interiorization in Schelling, but it is exteriorization, which has been always already realized, in Heidegger. However, the author of the article also pinpoints a certain isomorphism of the treatments of ecstasy in both thinkers. In the different ways they attempt to overcome the crisis of the understanding of the subject as closed in itself, create the conditions of this isomorphism. (shrink)

Metaphysics is a repeated act by way of representation ; the instantaneous judgment is solidified, the inevitable conclusion is made, and at the same time other possibilities are excluded. Outside thinking is a blow to the spiritual tradition of metaphysics, which holds that representation will lead to a differential activity concerning the relationship between stranger things. Such relationship follows a kind of horizontal logic, the latter discards the presupposition on the origin of things, that is, it no longer presumes (...) that this point or that point has greater privilege than other points. Things do not develop from a central point. Rather, things are the result of innumerable points in cooperative relationships between strangers. These cooperative relationships are arbitrary. A number of hugely valuable natural resources fall outside of the borders of any nation state. We can legitimately expect political theory to make a contribution to thinking through questions about the future of these extraterritorial resources. However, the debate on the proper allocation of rights over these resources remains relatively embryonic. This paper will bring together what have often been rather scattered discussions of rights over extraterritorial resources. It will first sketch some early modern contributions to thinking through (...) rights over the ocean. It then discusses the guidance available within more contemporary contributions to debates on resources beyond the state. Finally, it concludes by emphasising the key questions with which future work on this topic must engage. (shrink)

A central theme of law and society is that people's ideas about law and the decisions they make to mobilize law are shaped by community norms and cultural context. But this was not always an established concept. Among the first empirical pieces to articulate this theory was David Engel's 1984 article, 'The Oven Bird's Song: Insiders, Outsiders, and Personal Injuries in an American Community'. Over thirty years later, this article is now widely considered to be part of the law and (...) society canon. This book argues that Engel's article succeeds so brilliantly because it integrates a wide variety of issues, such as cultural transformation, attitudes about law, dispute processing, legal consciousness, rights mobilization, inclusion and exclusion, and inequality. Contributors to this volume explore the influence of Engel's important work, engaging with the possibilities in its challenging hypotheses and provocative omissions related to the legal system and legal process, class conflict and difference, and law in other cultures. In Subjects That Matter, Namita Goswami attends to philosophy’s institutional and disciplinary failures to reconcile its identitarian claims to universality and reason with the feminist and postcolonial modes of thinking it traditionally keeps at bay. This essay places Goswami’s critique within a context of “the thought from outside,” which, beginning with Foucault’s reading of Blanchot, continuing through the geopolitics of Dussel’s philosophy of liberation, and prominent in Catherine Malabou’s conceptualization of plasticity, demonstrates how political critiques of philosophical hegemony contain (...) an implicit theorization of “literature.” If “literature” gives voice to the thought from outside, does it in turn “decolonize” philosophy? If so, what itinerary of thought ought to follow the relationship between this literary decolonization of philosophy and its imbrication within the fold of philosophical thought? How to conceptualize the plastic relation between inside and outside, between center and periphery, without subordinating the latter to the hegemony of the former? This essay argues for a coherence between Goswami’s and Malabou’s materialist understandings of difference and a conceptualization of literature as an “outside” to philosophy that operates “excentrically” “inside” philosophy. Awareness of how researchers’ locations and sympathies influence their research agendas and outcomes has long been a topic for methodological consideration. This article complicates that question by considering the position of the researcher in relation to the position in society of the religions researched, and asks whether what we understand as constituting criticism or advocacy varies depending on whether the religions in question are powerful, dominating traditions or small, new, and/or beleaguered traditions. The Locations Matrix is an application of the (...) insights of standpoint analysis to the question of critical research in the sociology of religion. Researchers’ own locations—as an insider, an outsider, an apostate and/or an advocate—have consequences for the questions they ask, and to whom they address them, as well as how they interpret the data they collect. Galenson's (...) book "Painting Outside the Lines: Patterns of Creativity in Modern Art. The working thesis of this book is that Modern artists have worked creatively and innovatively in one of two distinctly different manners. The terminology Galenson uses to describe these distinct ways of working are "finders" and "seekers." Finders are artists like Pablo Picasso, who at age 26, make startling and important innovations with little advance indication that such a burst is about to take place. Seekers are artists like Paul Cezanne, whospend their entire working lives engaged in the pursuit of a singular approach or achievement. The differences between these methodologies are carefully presented through the details of the working lives of a variety of Modern artists. French nineteenth century and early twentieth-century artists and mid-twentieth-century American artists are used as the source data for these comparisons.Early in the book Galenson presents lists of chronological events within the lives of artists and market valuation of their work within this chronology. The dramatic clarity of the relationships presented in this data sets the stage for the detailed information that follows. Factors that in some cases only partly, and in others nearly completely, explain an artist's way of working are offered through biographic information, information about the aesthetic and cultural milieu, and about the economic and educational structures that are predominant during the relevant time in the life of the artist.The relationship between the aesthetic and cultural milieu surrounding an artist and the capacity or inclination of an artist to be innovative is an important aspect of the book's analysis. The scope of the book is limited to Modern artists because of the shift that took place at the outset of Modern art, during the mid 1860s, that brought a strong emphasis on innovation and change for their own sake as an important characteristic within a work of art. This emphasis "created incentives for painters to produce new approaches to art" (p. 111). Prior to the time of Modern art, innovation and change were often unnecessary for an artist to be successful. Modern art introduced the demand that innovation and change be necessary ingredients in art, and therefore the search for innovation became a significant element within the work of many artists. The manner in which this search took place, as presented through the data at hand, reveals how individual artists viewed the need for innovation and change within their own [End Page 123] work. In the United States, especially during the 1940s and 1950s — the peak years of creative output by Abstract Expressionist artists — the demand for their work was quite low. In this paper, we compare firm-specific attributes including outside director remuneration for two groups of firms. One of these groups consists of 96 firms that did not give stock options to the CEO during the sample period 1992 2001, while the other group of 571 firms granted stock options on a consistent basis during these years. Our results indicate that for the group with stock option grants, the remuneration to outside directors was significantly higher and the CEO had (...) longer tenure compared to the other group. New York/Mahwah: Paulist Press, 1992. Pp. i + 224. $12.95 (paper). The subtitle of the volume describes well its purpose and content. The author surveys in chronological order, beginning with the earliest ecclesiastical writers and ending with John Paul II, the various interpretations of the axiom extra ecclesiam nulla salus. (...) What prompted Sullivan to undertake a historical rather than systematic approach in his volume is the conviction that without taking into account the historical and cultural factors that conditioned the formulation of this axiom it is impossible to make sense of the shift from the exclusivism of the pre-Vatican II Church to the inclusiveness of Vatican II and post-Vatican II theology with regard to the salvation of those who are not members of,the Roman Catholic Church. The principle that guides Sullivan's attempt to disclose the meaning embodied in the manifold formulations of the axiom " there is no salvation outside the Church" is Pope John XXHI's distinction between " the substance of the ancient doctrine of the deposit of faith " and " the way in which it is presented," and the more recent emphasis of the Declaration Mysterium Ecclesiae (1973) on the historical condition affecting the expression of divine revelation. As a historical study, Salvation Outside the Church? is an excellent continuation of Louis Caperan's two-volume work Le probleme du salut des infideles, which is still unavailable in English. Obviously an over· view of almost two thousand years of theological discussion of this problem has to be highly selective if one is not to miss the forest for the trees, and Sullivan's choice of authors as well as of historical periods for discussion is judiciously made. If a complaint is to be made in this regard, it is that he has focused too much attention on magisterial documents, and Roman documents at that, and not enough on contemporary theology. True, he devotes a chapter to the theory of " anonymous Christians," espoused mainly by Karl Rahner (chapter 10), and defends it against criticisms by Henri de Lubac, Hans Urs von Balthasar, Hans Kiing, and Max Seckler. He is well aware that Rahner's theory has become the position of mainstream Catholic theology and cites authors who support it in one way or another (p. 181). However, a book that claims to present " the Catholic response " to the problem posed by the axiom extra ecclesiam nulla salus should, one would expect, have discussed in greater detail the various positions of contemporary Catholic theologians on this issue. It is to be fervently hoped that Sullivan will take up this task in his next book. 696 BOOK REVIEWS Sullivan's basic thesis is that the substance underlying the various negative formulations of the axiom extra ecclesiam nulla salus is the positive belief ithat " God has assigned to the church a necessary role in the accomplishment of his plan for the salvation of humanity " (p. 12). Such a thesis is, of course, neither new nor startling. Hans Kling had already said that much in his 1967 Die Kirche (English translation, p. 318). What is helpful in Sullivan's account is his explanation of both the intent of those who affirmed this axiom with its apparent exclusiveness and the limitations that prevented them from perceiving the universality of God's saving grace. With regard to intent, Sullivan shows con· vincingly that the patristic usage of the axiom is intended as a warning for those Christians who had separated themselves from the catholica either by schism or by heresy that they must remain within it in order to be saved, whereas ithe medieval usage is intended to warn pagans and Jews that they should accept the message of the Gospel now that it had been announced to them. With regard to limitations, Sullivan singles out two: the geographical and the psychological. On the one hand, there was before the discovery of America the conviction that the world was identical with Christian Europe. A feminist standpoint addresses the ideals or norms and attendant practices involved in science and knowledge with a mind to lived experiences of oppression. That such matters of social context and awareness of that context influence the ability of individual people to know their worlds constitutes the Situated Knowledge Thesis (Intemann 2016; Wylie 2003). Situated knowledges provide the evidence and inspiration for the central epistemological tenet of feminist standpoint theory. Individuals and liberatory communities obtain the epistemic advantage of a standpoint (...) through an Outside- In Process of thinking, drawing into science and knowledge the “outside” values and experiences of marginalized people. Several initiatives recognize the importance of transforming institutions, not just changing individuals, to diversify STEM fields. Universities and colleges are distinctive gendered work organizations because workers are highly educated and have authority in hiring, evaluation, and policy. This article explores whether feminist sociologists are particularly well suited to guide institutional change to diversify the academy. Drawing on data from in-depth interviews with 24 feminist academic sociologists at the rank of associate or full professor, I analyze how their feminist and sociological (...) identities intersect with institutional locations to create opportunities to transform the academy. Outsiders within, feminist sociologists revise and use the master’s tools to produce knowledge that improves recognition of, and ability to reduce, structural inequalities. Proficiency with these tools confers insider legitimacy and access to a “seat at the table” where disciplinary expertise and political commitments contribute to institutional change. Inevitably, these professors confront resistance, and in response develop strategies to advance their goals. Insights from feminist sociologists suggest that to transform universities to reflect the diversity of institutions and lived reality of contemporary faculty, it may be more useful to identify a set of commitments and principles that inform policies and practices, rather than specifying actions to support culture change. Helping scientists and engineers challenge received assumptions about how science, engineering, and society relate is a critical cornerstone for macroethics education. Scientific and engineering research are frequently framed as first steps of a value-free linear model that inexorably leads to societal benefit. Social studies of science and assessments of scientific and engineering research speak to the need for a more critical approach to the noble intentions underlying these assumptions. “Science Outside the Lab” is a program designed to help early-career (...) scientists and engineers understand the complexities of science and engineering policy. Assessment of the program entailed a pre-, post-, and 1 year follow up survey to gauge student perspectives on relationships between science and society, as well as a pre–post concept map exercise to elicit student conceptualizations of science policy. Students leave Science Outside the Lab with greater humility about the role of scientific expertise in science and engineering policy; greater skepticism toward linear notions of scientific advances benefiting society; a deeper, more nuanced understanding of the actors involved in shaping science policy; and a continued appreciation of the contributions of science and engineering to society. The study presents an efficacious program that helps scientists and engineers make inroads into macroethical debates, reframe the ways in which they think about values of science and engineering in society, and more thoughtfully engage with critical mediators of science and society relationships: policy makers and policy processes. Virginia Foster Durr was born in 1903 in Birmingham, Alabama in a former planter class family, and in spite of the gradual decline in the family fortune, she was brought up as a traditional southern belle, utterly subjected to the demands of the ideology of white male supremacy that ruled the Jim Crow South. Thus, she soon learnt that in the South a black woman could not be a lady, and that as a young southern woman she was desperately in (...) need of a husband. It was not until she had fulfilled this duty that she began to open her eyes to the reality of poverty, injustice, discrimination, sexism and racism ensuing from the set of rules she had so easily embraced until then. In Outside the Magic Circle, Durr describes the process that made her aware of the gender discrimination implicit in the patriarchal southern ideology, and how this realization eventually led her to abhor racial segregation and the ideology of white male supremacy. As a consequence, in her memoirs she presents herself as a rebel facing the social ostracism resulting from her determination to fight against gender and racial discrimination in the Jim Crow South. This article delves into Durr’s composed textual self as a rebel, and suggests the existence of a crack in it, rooted in her inability to discern the real effects of white male supremacy on the domestic realm and in her subsequent blindness to the reality behind the mammy stereotype. This book focuses on the emergence and development of philosophical historiography as a university discipline in the 18th and 19th centuries. During that period historians of philosophy evaluated medieval philosophical theories through the lenses of modern leitmotifs and assigned to medieval thinkers positions within an imaginary map of cultural identities based on the juxtaposition of 'self' and 'other'. Some medieval philosophers were regarded as 'forerunners' who had constructively paved the way for modern rationality; whereas others, viewed as 'outsiders', had contributed (...) to the same effect by way of their struggle against established forms of philosophy. The contributions gathered in this volume each deal with the creative reception of a particular figure in modern history of philosophy. From the 9th century, with al-Farabi, to the 16th century, these philosophers belong to four historical worlds which have been characterized by European cultural history or have defined themselves as such: the (Jewish-)Arabic world (al-Farabi, Avicenna, Maimonides), Latin scholasticism (Roger Bacon, Henry of Ghent, William of Ockham, Marsilius of Padua), medieval lay philosophy (Ramon Lull, Petrarch), and Humanism in a broader sense (Nicholas of Cusa, Petrus Ramus, Andrea Cesalpino). Many elite athletes find the loss of their athletic abilities due to age or injury to be a profoundly challenging experience. While talent development is a well-studied phenomenon, far less attention has been paid to the issue of talent loss. We address this gap by exploring the experience and challenges faced by elite athletes who are losing, or who have lost, their talent. Drawing on three different understandings of the nature of talent, we argue that the experience of talent loss (...) is constituted by three distinct yet interrelated forms of disorientation. En plus de son œuvre logique, MacColl a aussi écrit et publié des travaux que l’on qualifierait aujourd’hui de cultural criticism. Ces écrits concernaient deux des thèmes centraux de la période victorienne : l’avancement et l’influence grandissante de la science, et le déclin de la religion. À l’image de son œuvre logique ignorée, jusqu’à très récemment, aucune attention n’a été accordée à ses œuvres littéraires ou celles relevant du cultural criticism. Cet article examine les travaux de MacColl qui ne relèvent (...) pas du domaine de la logique et discute la façon dont MacColl a approché et traité les deux thèmes de la science et de la religion. Il fournit ensuite une explication du peu d’attention accordée à ces œuvres malgré les talents intellectuels évidents de leur auteur. Cette explication impute l’oubli de l’œuvre de MacColl aussi bien à la façon dont il traite ces thèmes qu’à sa position d’outsider. En effet, MacColl vivait expatrié dans une ville provinciale française sans lien avec l’environnement culturel et littéraire de Londres. Par ailleurs, il était au sens véritable du terme, un auteur dont les sensibilités correspondent au milieu de la période victorienne, mais dont les œuvres paraissent tardivement à la fin de cette période et au cours de la période edwardienne, alors que les termes du débat sur la science et la religion avaient déjà changé. This paper deals with the question whether Muslims who live in the West might be considered as the future outsiders of the Islamic world. It suggests that the Muslims of the West might become those through whom, in a totally unexpected and unforeseen fashion, could come the progress – even the salvation – of an Islamic civilization that the author considers as currently locked into a state of moral, social, intellectual and spiritual stagnation. To this effect, the author focuses mainly (...) on the notion of individual and of human rights, and discusses how the Islamic and Western traditions might be brought together. Starting from the seminal experience of James Prescott Joule, this paper aims to debate the possibility of “making” science outside universities and academies. Joule himself studied as an autodidact and did not make his own discoveries while following an academic path; on the contrary, at first, the associations and academic societies of the time tended not to recognize his works officially. All of this happened throughout the nineteenth century during the period of the first relevant tendency to science popularization. (...) For example, looking at the second half of the England of the 1800s, we can refer to Michael Faraday’s open lessons for children like The Chemical History of a Candle. Following this perspective from a historical view, this paper explores the Italian attempts to communicate science—from the ‘50s to the ‘70s—to a larger public via television and other media, also considering the political and social backgrounds behind this choice. In particular, this paper also deals with Lucio Lombardo Radice’s work on TV programs and writings in social-political journals and daily newspapers, as a mathematician and pedagogist engaged on the importance of what he specifically called “Scientific mediation”, as a “method” to teach and popularize science to a larger public. The conduct of most of social science occurs outside the laboratory. Such studies in field science explore phenomena that cannot for practical, technical, or ethical reasons be explored under controlled conditions. These phenomena cannot be fully isolated from their environment or investigated by manipulation or intervention. Yet measurement, including rigorous or clinical measurement, does provide analysts with a sound basis for discerning what occurs under field conditions, and why. In Science Outside the Laboratory, Marcel Boumans explores the state (...) of measurement theory, its reliability, and the role expert judgment plays in field investigations from the perspective of the philosophy of science. Its discussion of the problems of passive observation, the calculus of observation, the two-model problem, and model-based consensus uses illustrations drawn primarily from economics. Rich in research and discussion, the volume clarifies the extent to which measurement provides valid information about objects and events in field sciences, but also has implications for measurement in the laboratory. The kinds of models discussed in this paper function as measuring instruments. We will concentrate on two necessary steps for measurement: (1) the search of a mathematical representation of the phenomenon; (2) this representation should cover an invariant relationship between the properties of the phenomenon to be measured and observable accociated attributes of a measuring instrument. Therefore, the measuring instrument should function as a nomological machine. However, invariant relationships are not necessarily ceteris paribus regularities, but could also occur when the (...) influence of the environment is negligible. This brief critique of Frances Kamm’s Bioethical Prescriptions (Oxford University Press, 2013) focuses on the phenomenon of philosophers taking on roles outside of academia, which Kamm discusses in chapter 24, “The Philosopher as Insider and Outsider: How to Advise, Compromise, and Criticize.” Kamm discusses various conflicts that can arise for philosophers who serve as advisors on governmental commissions. One goal many philosophers have in joining such commissions is (a) to promote the public good (p. 527), but this can come (...) into conflict with (b) the goals and norms governing one as a philosopher, as well as with (c) the goals and norms governing philosophers qua advisors to the governmental commissions. Kamm’s view is that (c) has precedence, up to a point, over (a) and (b). Questions that I explore are (1) what are the norms constitutive of being a philosopher; (2) how do the norms constitutive of other roles philosophers enter into differ from those of advisors to commissioners; and (3) when and why do some of the norms and goals outlined by Kamm take precedence over others? It has been a common belief among scientists, including mathematicians, that young scientists are especially good at bringing about scientific change. A number of studies suggest, however, that older scientists are not more resistant to change than young scientists are. It is nonetheless worth examining why a scientist’s or mathematician’s outsider status – due to age, educational background, or something else – can sometimes be effective in enabling scientific change. This paper focuses on the case of the solving of the (...) Four Color Problem by Wolfgang Haken and Kenneth Appel. Building on Donald MacKenzie’s paper ‘Slaying the kraken: The sociohistory of a mathematical proof’, I argue that Haken’s outsider status is central to understanding his success with the problem. The eponymous plague soon spreads uncontrollably with predictable catastrophic global consequences.When (...) the definitive history of armed conflict is written, the chapter on biological weapons will make for a long and disagreeable read. Now, happily, disavowed by most nations under the 1972 Biological Weapons Convention, the presumption is that any future deployment would be at the hands of rogue states, criminal gangs or perhaps terrorist organisations, to whom they could appeal because of their apparent ease of preparation and dissemination coupled with their sinister reputation and potential for causing mass casualties.But Herbert's villain is different. He is a trained scientist possessing expert skills and with access to pathogens, reagents and cutting-edge technology. Such a person might appear outwardly to be part of the conventional academic establishment except that their motives impel them to act covertly outside the accepted ethical and legal boundaries of their profession. Such ‘outsiders’ evade detection because they act alone and can, through their privileged position, anticipate and thwart regulation or investigation. But is this frightening scenario more than just a plot for apocalyptic novels? Is it a credible threat?In reality, such occurrences seem to be rare. According to Jean-Luc Nancy, a deconstruction of Christianity looks for the ‘unthought’ in the Christian religion. By this unthought dimension, he means ‘something’ in Christianity that at the same time ‘is not Christianity proper’ and ‘has not mingled with it’. It appears to be simultaneously outside and inside Christianity. This unthought undermines and ‘exhausts’ Christianity, and such self-exhaustion appears to be a key characteristic of Christianity. As a result, a deconstruction of Christianity primarily investigates the way Christianity deconstructs itself. (...) In this article, it is argued that this complex, unthought structure of Christianity expresses Christianity’s modern status, and is expressed in Christianity’s core traditions, i.e. in the ways in which Christianity deals with the name, the experience and the concept of God. In dialogue with Nancy’s work, this is demonstrated by offering short analyses of the Christian doctrines of Creation and the Trinity. These analyses show that the Christian God ‘incarnates’ the structure of being outside and inside in various specific ways: outside as well as inside Himself, the world, and even outside and inside Christianity. R. A. Duff has revived the tradition of “answerability” for crime. In this philosophical and jurisprudential tradition, a person is answerable to the criminal law of a state and the process of that state’s courts only if there is some appropriate relationship between the state and the person. Duff’s great contribution has been to develop the idea of accountability of persons to a state or other polity as a philosophical notion which, he argues, underlies all just implementations of criminal law. (...) Duff has centered his views around the relationship between the citizen and the polity (in today’s world, the state) to which the citizen belongs. His focus has been on insiders, rather than outsiders.This article argues that, in the current world, the relationship among cocitizens, outsiders, and the state is based in part on the moral idea that the state exists to protect citizens from evil acts, specifically those that we call public and criminal wrongs, wherever the acts originate. Outsiders understand this, and understand that states other than their own use criminal law to protect their citizens.Duff’s writings contain an idea which turns out to be very useful in cases of outside acts, even though he does not apply it directly to them. Some states or other entities may have only an incomplete relationship with an accused person (compared with the relationship of citizen and state), but nonetheless may have the moral and political authority to try her for crime. This paper extends this notion to show that such incomplete relationships exist in a great many common cases of outsiders (noncitizens who act outside the territory of a state) who commit crime. These relationships support criminal prosecution of outsiders, so long as we admit that protection of persons from crime is a legitimate goal of the criminal law. (shrink)

Outside directors’ regular board meeting attendance is important in improving the effectiveness of a governance system. Such attendance is evidence of their commitment to the firm as key other players in monitoring and decision making. Using a unique dataset for Korean firms, and three-level random coefficients models, we find that, foreign outside directors, an independent appointment process, professional knowledge of business operations and accumulated firm-specific knowledge are important factors that affect outside directors’ attendance of board meetings. The (...) results also confirm that both outside directors’ personal characteristics and the social context are crucial in understanding their board meeting attendance. Further analysis shows that a positive corporate environment that supports the outside director system encourages outside directors’ attendance at board meetings. (shrink)

Two obvious trends in corporate governance include broadening board accountability beyond shareholders’ interests and paying outside directors with equity compensation (stock and stock options). By integrating common agency and instrumental stakeholder theories, we examine the effect of stock compensation on secondary stakeholders and a firm’s participation in social issues, two areas where interests are less aligned with shareholder value. Consistent with our predictions, we found that while stock compensation may be an effective way to align directors’ goals to those (...) of shareholders, it has adverse effects on important non-shareholder constituencies in the company’s operating environment. In this article I take up a conceptual question: What is the distinction between ‘the law’ and the behavior the law regulates, or, as I formulate it, the distinction between what is ‘inside’ the law and what is ‘outside’ it? That conceptual question is in play in (at least) three different doctrinal domains: the constitutional law doctrines regarding the limits on the delegation of legislative powers; the criminal law doctrines regarding mistakes of law; and the constitutional rights doctrines that (...) turn on the distinction between state action and the acts of non-state actors. I argue that legal doctrines should turn solely on normative considerations and should not turn on answers to conceptual questions. However, the doctrines I discuss appear to turn on the conceptual question regarding what is ‘inside’ and ‘outside’ the law. I show how each of these doctrinal areas appears to raise this conceptual issue, and I explain how the doctrines might or might not escape being held hostage to conceptual controversy. (shrink)

This paper explains why Clark’s Extended Mind thesis is not capable of sufficiently grasping how and in what sense external objects and technical artifacts can become part of our human cognition. According to the author, this is because a pivotal distinction between inside and outside is preserved in the Extended Mind theorist’s account of the relation between the human organism and the world of external objects and artifacts, a distinction which they proclaim to have overcome. Inspired by Charles S. (...) Peirce’s philosophy of mind, in particular, the author tries to find a way out of this ‘inside–outside’ fallacy. External objects, artifacts or processes should, according to him, not be conceived as inanimate and unintelligent matter utilised by a separately living, inner mental sphere that has set certain pre-established goals for itself. Mind has rather an artifactual character. It is not extended by an inner biological cognitive core but rather unfolds itself through objects and artifacts. Mind as such is, especially in our modern technological culture, shaped by virtue of and through technical artifacts. Recognizing this artifactual dimension of mind will, the author concludes, enable a more critical analysis of contemporary claims that ascribe certain original and irreducible features to thinking. Sad1 and UNC84 (SUN) and Klarsicht, ANC‐1, and Syne homology (KASH) proteins interact at the nuclear periphery to form the linker of nucleoskeleton and cytoskeleton (LINC) complex, spanning the nuclear envelope (NE) and connecting the cytoskeleton with the nuclear interior. It is now well‐documented that several cellular functions depend on LINC complex formation, including cell differentiation and migration. Intriguingly, recent studies suggest that SUN proteins participate in cellular processes where their association with KASH proteins may not be required. Building on (...) this recent research, we elaborate on the hypothesis that SUN proteins may perform LINC‐independent functions and discuss the modalities that may allow SUN proteins to function at the INM when they are not forming LINC complex.
