A single, fairly simple proposition lies at the heart of the present contribution, viz. that the development of early-modern literature on international law should be regarded as a specific form of the early usus modernus during the second half of the sixteenth century and the first half of the seventeenth century.In Section 1 that general proposition and some of its ramifications will receive some further explanation. First, the main characteristics of usus modernus will be set out, and, subsequently, (...) their applicability to early-modern literature on international law will be outlined. In addition, the question should be raised, what purpose the characterisation of that literature as part of the more general usus modernus may serve. These considerations may inevitably appear somewhat abstract. Section 2 will therefore aim to provide a particular illustration, based on two contemporary works on the law of naval warfare, viz. A. Gentili's Hispanicae Advocationis Libri Duo and H. Grotius' De jure praedae. (shrink)

This paper finds its origin in a debate between Georges Bataille (1897-1962) and Octavio Paz (1914-1998) on what is central to the idea of eroticism. Bataille posits that violence and transgression are fundamental to eroticism, and without prohibition, eroticism would cease to exist. Paz, however, views violence and transgression as merely intersecting with, rather than being intrinsic to, eroticism. Paz places focus on imagination, and transforms eroticism from a transgressive, to a ritualistic act. Eroticism thus functions as an intermediary, turning (...) animal sexuality into ceremony and rite. In this paper, I argue that Paz and Bataille are not fundamentally at odds in their conceptualisation of eroticism. Instead, Paz redefines the locus of eroticism by subverting its unsettling aspects. His conception of eroticism gives precedence to the imagination, which in itself is an act of violation. Imagination transgresses normal life, but this transgression – the violation of the habitual world – also introduces a glimpse of the numinous that Paz associates with belongingness. The paper further explores eroticism, as this is perceived today, and argues that it ultimately eliminates the threshold marked by transgression. The rise of the contemporary pornographic society is marked by a loss of imagination and transcendence, which ultimately reduces the subject into a mere automaton that demands instant gratification. One measure of the validity of [Joseph] Frank's insight is the extent to which other versions of his ideas appear in other contexts: for if "spatial form" refers to something real, it cannot have escaped notice by other readers. One thinks, for example, of Northrop Frye's description of the critic viewing all the elements of the poem as a simultaneous array before him; or of Gaston Bachelard's evocative descriptions of The Poetics of Space. Or Pound's interest in ideographic script; or (...) the frequent critical association of modern literature with impressionist painting. Or Eliot's poet synthesizing Spinoza, the sound of the typewriter, and the smell of cookery into a unified whole. Or—at the root of it all, perhaps—Poe's insistence on the unified effect of the story or poem.1 All of these instances reflect a more or less casual assumption of the basic premise of Frank's essay. More recently another critic, Frank Kermode, has offered an alternative description of this general problem. In The Romantic Image2 he assesses symbolist poetic theory; here the verbal image , autonomous and autotelic, presumably unites meaning and feeling without intervening reflection or discourse: the "image" so hypostatized seems very close to a "spatial" form, and certainly the suppression of discourse, of reflection generally, follows from the disruption of syntax and narrative that results from the impulse toward "spatial" effects. Provisionally, we might say that Joseph Frank's essay is grounded in an essentially formalist conception of the literary work as artifact, and that the striking features of his argument result from an attempt to assimilate extended works to a theory basically lyric in its orientation: as corollary, we must assume that the modern writers he cites had themselves operationally defined the concept in the course of their writing. · 1. "Alterity and Criticism: Retracing Time in Modern Literature" argues that the role of time in canonical literature underlies the experience of alterity and requires a new hermeneutic to clarify how the self emerges in literary texts. Romantic poetry from Goethe to Shelley and the modern prose tradition from Flaubert to Butor constitute different traditions but also indicate, on a textual basis, how alterity is crucial to reading, thus encouraging us to interpret literary texts in terms of (...) the related concerns of self, other and time. The article introduces the concept of mega-essay as an integrated format into literary circulation in the era of postmodernism. Its specificity is outlined in other forms of ensemble association of essay works: mega-essay as an integrated formation is a consolidated format, it differs from other forms of essay compilations with greater completeness, more thorough basis of design. It has a closed structure, because all its structural components are interconnected. They are closely related to the author's intention, outlined in the preface (...) or introduction, concluded on the basis of causal and associative principles. Based on the analyzed works of Ortega y Gasset, O. Zabuzhko’s «Notre Dame dʼUkraine», N. Zborovska’s «My Lesia Ukrainka», etc. conclusions are made about specific features of the mega-essays, in which the phenomenon chosen for comprehension is described in detail by incorporating internal and external contexts, authoritative references, other works, and if necessary, with the dominance of the essayistic method of presentation of opinions, related to the personal views of the author. Emphasis is placed on the affinity of ideas and selected essay formats of Ortega y Gasset and O. Zabuzhko, given their content and structural organization. Conclusions are made about the role and significance of essays of this format in postmodern European literature. (shrink)

There is a striking difference, however, between the ways female and male modernists define and describe literal or figurative costumes. Balancing self against mask, true garment against false costume, Yeats articulates a perception of himself and his place in society that most other male modernists share, even those who experiment more radically with costume as metaphor. But female modernists like Woolf, together with their post-modernist heirs, imagine costumes of the mind with much greater irony and ambiguity, in part because women's (...) clothing is more closely connected with the pressures and oppressions of gender and in part because women have far more to gain from the identification of costume with self or gender. Because clothing powerfully defines sex roles, both overt and covert fantasies of transvestism are often associated with the intensified clothes consciousness expressed by these writers. But although such imagery is crucially important in works by Joyce, Lawrence, and Eliot on the one hand, and in works by Barnes, Woolf, and H. D. on the other, it functions very differently for male modernists from the way it operates for female modernists.Sandra M. Does Augustine put his finger on time? -- Time for history -- Determination -- Self-determination -- Time, knowledge and truth.

In Literature, Life, and Modernity Richard Eldridge focuses on the question of a reader's or a viewer's response to a literary or dramatic work in a specific historical epoch ("modernity"). That is, in contrast with many other philosophical approaches to literature, he avoids fixing attention on any putative doctrinal (moral or political or diagnostic) claims in a literary work. Thereby, and in many other admirable ways, he avoids the danger of treating literature as philosophy manqué, concedes the (...) distinctness of literary experience, and only then asks about the significance of this experience. (In this way his approach is reminiscent to some extent of Schiller's; not bad company to be keeping.) This all amounts to a philosophy of literature of sorts,[1] but avoids a forced "philosophy in literature" or "literature as philosophy" treatment. There are themes and ideas at stake of course, but for distinct historical reasons, Eldridge also thinks of what he generally calls "modern" literature as characterized precisely by the absence of any thematic resolution, and so by a kind of play of possibilities, unsettledness, even homelessness. If indeed aestheticization and enchantment are perennial traits of state discourses and practices in China, it is perhaps unsurprising that a countertradition in modern literature should emphasize disenchantment. Cultural productions that originate from outside the sphere of the state have often questioned its authority. Where the state seeks to enchant, literature has sometimes sought to kindle doubt, to arouse debate. Although such debates have often been curtailed or suppressed, it is worth reexamining the connections between literary production (...) and political debates in different historical contexts throughout twentieth-century China. Drawing on theories that stress the intentionality of literature and the speech act value of the literary text, the present essay attempts to characterize the communicational dynamics both within the text and in the context of its reception. In this perspective, it revisits some of the literary debates that took place in China in the May Fourth and Republican periods (represented by Lu Xun), the early postwar years and the ROC—PRC transition (Lao She), in certain works written during the Cultural Revolution (Jin Fan/Liu Qingfeng), as well as post-1979 literature on the mainland (Yan Lianke). It does so by selecting texts that seem to have been produced with the intention of challenging the aesthetics of enchantment, using literary devices to interrupt readers’ enjoyment and thus open a space for public discussion of both aesthetics and politics.
