The Multiple Debtors Case: the Extent of the Tortious Duty to Compensate Damage—Solidary or Proportional Liability? (text only in Lithuanian).Simona Selelionytė-Drukteinienė - 2010 - Jurisprudencija: Mokslo darbu žurnalas 121 (3):233-250.
Among the most complicated issues in the law of delict, in the case of multiple debtors, is to determine the scope of each co-debtor’s liability. The rule of proportional liability clearly favours debtors more than the aggrieved party. And, on the contrary, the solidary liability best suits the interests of the aggrieved party as the risk of co-debtor’s insolvency is transferred to the debtors. Furthermore, in the latter case, the debtors who attempt to allocate the scope of their liability among (...)

Changing the school culture.Per Dalin - 1993 - [s.l.]: IMTEC Foundation. Edited by Hans-G. Rolff & Bab Kleekamp.
How do schools change? What do we know about the change process? Does the individual school have the capacity to change - and under what conditions? This book, based on research carried out at the Oslo-based international school improvement programme, IMTEC, poses, debates and answers all these questions. It promotes the Institutional Development Programme (IDP) - tested for over 15 years in several countries - which is a revolutionary change strategy for schools. Dalin examines thoroughly how it can be adapted (...)

DLD: An Optimized Chinese Speech Recognition Model Based on Deep Learning.Hong Lei, Yue Xiao, Yanchun Liang, Dalin Li & Heow Pueh Lee - 2022 - Complexity 2022:1-8.
Speech recognition technology has played an indispensable role in realizing human-computer intelligent interaction. However, most of the current Chinese speech recognition systems are provided online or offline models with low accuracy and poor performance. To improve the performance of offline Chinese speech recognition, we propose a hybrid acoustic model of deep convolutional neural network, long short-term memory, and deep neural network. This model utilizes DCNN to reduce frequency variation and adds a batch normalization layer after its convolutional layer to ensure (...)

The recent Lithuanian court practice shows discrepancies in cases dealing with partitioning of common partial divided property. Moreover, no doctrinal research has been concluded on the limits and conditions of the co-owners‘ right to demand that his share should be partitioned from the common partial ownership in Lithuania. Taking into account that proper implementation of co-ownership rights is based on common agreement of co-owners, when no agreement is reached between co-owners regarding the fact and the mode of partitioning, a question (...)

This article discusses the problematic aspects relating to the employee dismissal based on application of the disciplinary liability. It contains analysis of two grounds for termination of the employment contract without any previous notice: 1) imposing several disciplinary sanctions upon the employee in the course of twelve months, and 2) the employee has only one breach of labour discipline but a gross one. The article is based on legal acts and judgements of Judicial Assemblies of the Civil Division of the (...)

The article examines the problem of compensation for the value of lost opportunity at the pre-contractual stage. It has been determined that such measure of recovery depends on the nature of pre-contractual liability. However, although the Supreme Court of Lithuania recognizes the possibility for the aggrieved party of pre-contractual negotiations to recover the value of lost opportunity, the motivation of the Supreme Court’s decisions is too incoherent. Moreover, Lithuanian courts have not yet adopted any methods of awarding and calculation of (...)

In China, antiquarianism or jinshixue, literally the “study of bronze and stone,” is first used to describe the activity of studying historical artifacts in texts of the eleventh century. The modern Chinese term for archaeology—kaoguxue, “investigating antiquity”—on the other hand, is a term borrowed from the title of a catalog of collectibles by Song scholar Lü Dalin (1046–1092). The aim of this article is to retrace the formation of the concept of archaeology that developed from antiquarian traditions to its reintroduction (...)

Šiame straipsnyje yra nagrinėjami etiniai atliekų tvarkymo aspektai žiedinės ekonomikos kontekste. Straipsnio autorės siekia papildyti technologinį ir ekonominį atliekų tvarkymo diskursą, kuris vyrauja žiedinėje ekonomikoje, ontologine ir etine santykio su atliekomis analize. Pasitelkiant rūpesčio etiką, straipsnyje akcentuojamas reliacinis santykio su atliekomis aspektas, pagal kurį pirmenybė teikiama dėmesingumui, atsakomybei, kompetencijai, atsakui ir dalyvavimui sprendžiant atliekų problemą. Nagrinėjant penkias rūpesčio pakopas, kurias išskyrė Joan Tronto, straipsnyje analizuojama, kaip etiniai sumetimai gali turėti įtakos individualiems ir kolektyviniams veiksmams žiedinės ekonomikos paradigmoje. Contractual Liability: for Fault or Strict?Simona Selelionytė-Drukteinienė - 2011 - Jurisprudencija: Mokslo darbu žurnalas 18 (4):1417-1441.
The author investigates the necessity of fault as the prerequisite of contractual civil liability. The author makes the conclusion that Lithuanian law, following most of the countries belonging to the civil law tradition and contrary to the common law systems, as well as Vienna convention, UNIDROIT principles, PECL and DCFR, begins with the theory that fault is a requirement for contractual liability. Strict liability in Lithuanian law is the exception of this general rule. Nevertheless, the author argues that the general (...)

Superior responsibility has been a widely recognised form of responsibility for omission in both treaty and customary international law. Superiors are held responsible for the acts of their subordinates when they fail in fulfilling their duties to prevent or punish crimes of subordinates. Duties to prevent and punish arise only after the superior knows about the subordinate’s crimes or has a reason to know about it. ‘Has a reason to know’ is a form of constructive knowledge and could be defined (...)
