We examine the occurrence of ethicsrelated terms in 10-K annual reports over 1994-2006 and offer empirical observations on the conceptual framework of Erhard et al. 2007). We use a pre-Sarbanes-Oxley sample subset to compare the occurrence of ethics-related terms in our 10-K data with samples from other studies that consider virtue-related phenomena. We find that firms using ethics-related terms are more likely to be "sin" stocks, are more likely to be the object of class action lawsuits, and are more likely (...) to score poorly on measures of corporate governance. The consistency of our results across these alternative measures of ethical behavior suggests that managers who portray their firm as "ethical" in 10-K reports are more likely to be systematically misleading the public. These results are consistent with the integrity-performance paradox. (shrink)

After comparing three main views regarding the existing and nature of qualities and quality-Instances - extreme nominalism (qualities do not exist), nominalism (qualities exist and are abstract particulars), and realism (qualities exist and are multiply exemplifiable entities in their instances) - an attempt is made to clarify the real difference between nominalism and realism to show the superiority of the latter. This is done by criticizing two alledged realist positions offered by Nicholas Wolterstorff and Michael Loux. Do people who cause themselves to be ill (e.g. by smoking) forfeit some of their rights to healthcare? This paper examines one argument for the view that they do, the restoration argument. It goes as follows. Smokers need more health‐resources than non‐smokers. Given limited budgets, we must choose between treating everyone equally (according to need) or reducing smokers' entitlements. If we choose the former, non‐smokers will be harmed by others' smoking, because there will be less resources available for them than (...) if no‐one smoked. This is unfair: why should non‐smokers suffer because of others' unhealthy lifestyle choices? We should therefore choose the latter and reduce smokers' entitlements. This paper criticises the restoration argument on the following grounds. In order to avoid generating unpalatable conclusions elsewhere, it must be combined with a principle according to which activities which are sufficiently ‘socially valuable’ (e.g. parenting) are immune from restoration claims. This however means that what was supposed to be one of the argument's most attractive features, its compatibility with ‘liberal neutrality’ with respect to the value of different lifestyles, doesn't really exist. Hence, the restoration argument is nowhere near as attractive as it at first appears to be. (shrink)

Physicalists are committed to the determination without remainder of the psychological by the physical, but are they committed to this determination being a priori? This paper distinguishes this question understood de dicto from this question understood de re, argues that understood de re the answer is yes in a way that leaves open the answer to the question understood de dicto.

Despite a plethora of laws prohibiting discrimination in employment, supporting and enforcing equal employment opportunity (EEO) principles has proven to be an enormous challenge for those charged with this responsibility. The question often asked is who should exercise this role in organizations. Not surprisingly, there has been a call for HRM to become the guardian of EEO in organizations but should human resource managers be male or female, and/or would line managers be better positioned to assume this responsibility? This paper (...) overviews the literature and then summarizes an empirical study that attempted to address the possible impact of these options as they exist in organizations. One hundred and eighty respondents who met the criterion of having interviewed one or more job applicants in the previous 6 months were systematically selected from business telephone listings. Based on self-reported behaviors, no significant difference was found between the expected and actual distributions of HR and line managers in respect to whether decisions were made on unlawful grounds. The percentage of each respondent category that asked unlawful questions varied from 1% to 36% depending upon the attribute (unlawful ground of discrimination) under consideration. This begs the question as to what value HR managers contribute to EEO in the selection process. The second finding was that significantly less female managers admit to making decisions on the basis of unlawful questions than male managers. Thus, support was found for female line managers as guardians of EEO but no clear justification for HRM in this role. (shrink)

In attempts to come to grips with Kant’s thought, the influence of the philosophy of Christian Wolff (1679-1754) is often neglected. In this paper, I consider three topics in Kant’s philosophy of mind, broadly construed, where Wolff’s influence is particularly visible: consciousness, self-consciousness, and psychology. I argue that we can better understand Kant’s particular arguments and positions within this context, but also gain a more accurate sense of which aspects of Kant’s accounts derive from the antecedent traditions and which constitute (...) genuine philosophical innovations. Despite the United Nations Declaration of the Rights of Indigenous Peoples, assimilationist policies continue, whether official or effective. Such policies affect more than the right to group choice. The concern is whether indeed genocide or “only” ethnocide (or culturecide)—the elimination of a traditional culture—is at work. Discussions of the distinction between the two terms have been inconsistent enough that at least one commentator has declared that they cannot be used in analytical contexts. While these terms, I contend, have distinct senses, (...) yet in cases of governmental and other institutional assimilationist policy for indigenous peoples, such ethnocide effectively entails genocide. Insofar as any people’s cultural practices and beliefs are essential for life and health, individuals in groups value, if tacitly, their culture as highly as their language or any artifact: Thus, attempts to eradicate a culture through assimilation in fact eradicate individuals’ lives and health and so are effectively murderous. Acknowledgement by worldwide organizations that assimilationist ethnocide is effectively genocide should affect policy concerning indigenous peoples and thus has significance for international law. 윤리문화의 개념에는 세 가지 차원이 있다. 생활문화로서의 윤리문화, 결합체적 사슬(syntagmatic chain)로서의 윤리문화, 계열체적 집합(paradigmatic set)으로서의 윤리문화가 그것이다. 이 중에서, 이 글은 제주인의 윤리적 문화문법을 탐색하였다. 문화문법은 어떠한 조치로도 쉽사리 변하지 않는 문화의 하드웨어(hardware)와 같다. 제주윤리문화의 패러다임을 파악하기 위해서는 문화문법을 낳은 조건적 요소들에 관한 광범위한 검토가 있어야 한다. ① 자연적․지리적 특성, ② 언어적인 특성, ③ 역사적 경험의 특성, ④ 의․식․주의 특성, ⑤ 친족구조의 특성, ⑥ 종교․신앙의 특성, ⑦ 인구학적 특성 등이 그것이다. 필자는 제주의 무속신화에 나타난 윤리적 문화문법을 탐구한 바 있고, 제주의 (...) 가족제도를 분석하여 효규범의 윤리문화를 검토한 적이 있다. 이 글에서는 기존 연구에서 얻은 가설을 바탕으로 의식주생활에 함의된 제주인의 윤리적 문화문법을 탐색하였다. 제주윤리문화의 패러다임은 평등성, 가족성, 현세성, 합리성, 온정성, 묘합성으로 요약된다. 제주의 무속신화에서 탐색된 이러한 문화문법들은 특정시기의 결합체적 사슬과 엮였던 시대인 가족제도와 의식주생활에서도 재생 반복하여 나타나고 있다. Foucault's rejection of the repressive hypothesis is generally taken as a critique of Freud. Its real target is, however, the left Freudian tradition, which received its paradigmatic articulation in the work of Herbert Marcuse. Marcuse sought to show that the conflict between the repressive demands of civilization and instinctual desires of the individual didn't represent a transhistorical state of affairs, as Freud maintained. He argues, rather, that it represents a particular historical constellation that can be transcended. Foucault purports to reject (...) the entire structure in which the problem arises, that is, the conflict between the demands of civilization and bodily based desire. The thesis of this article is, however, that he doesn't reject the conflict, but simply displaces it. In his scheme, the displaced conflict takes place between the apparatus of sexuality and bodies and pleasures. Furthermore, Foucault maintains that the emancipation of bodies and pleasures from their entrapment in the apparatus of sexuality constitutes the desirable political program. The diagnosis of the situation and the suggested political remedy are, in other words, exactly parallel to Marcuse's. (shrink)

The Wisconsin card-sorting test (WCST) is a commonly used clinical tool for the detection of frontal lobe dysfunction, specifically executive dysfunction. Patients with lesions outside the frontal lobes sometimes show deficits on the WCST, however, and some researchers have implicated hippocampal dysfunction as the cause of the deficit. But a critical role for the hippocampus seems to be untenable because amnesic patients with bilateral medial temporal lobe (MTL) lesions perform the WCST normally. In the case of epileptic patients, an alternative (...) explanation of the card-sorting impairment is the propagation of abnormal discharges from MTL to frontal lobe structures, causing remote interference with executive circuits. Over-flexibility in the definition of Friston blankets obscures a key distinction between observational and interventional inference. The latter requires cognizers form not just a causal representation of the world but also of their own boundary and relationship with it, in order to diagnose the consequences of their actions. We suggest this locates the blanket in the eye of the beholder.

Research in pharmacogenomics and precision medicine has recently introduced the concept of Polygenic Scores (PGSs), namely, indexes that aggregate the effects that many genetic variants are predicted to have on individual disease risk. The popularity of PGSs is increasing rapidly, but surprisingly little attention has been paid to the idealisations they make about phenotypic development. Indeed, PGSs rely on quantitative genetics models and methods, which involve considerable theoretical assumptions that have been questioned on various grounds. This comes with epistemological and (...) ethical concerns about the use of PGSs in clinical decision-making. In this paper, I investigate to what extent idealisations in genetics models can impact the data gathering and clinical interpretation of genomics findings, particularly the calculation and predictive accuracy of PGSs. Although idealisations are considered ineliminable components of scientific models, they may be legitimate or not depending on the epistemic aims of a model. I thus analyse how various idealisations have been introduced in classical models and progressively readapted throughout the history of genetic theorising. Notably, this process involved important changes in the epistemic purpose of such idealisations, which raises the question of whether they are legitimate in the context of contemporary genomics. Under what circumstances, if any, are we warranted to assert that a theory is true or at least approximately true? Scientific realists answer that such assertions are warranted only for those theories that enjoy explanatory and predictive success. A number of challenges to this answer have emerged, chief among them the argument from pessimistic meta-induction. According to this challenge, the history of science supplies ample evidence against realism in the form of successful theories that are now considered false. The main (...) realist reaction to this challenge questions the legitimacy of the pessimistic meta-inductivist inference. Advocates of this approach argue that upon closer scrutiny the historical record can be reconciled with scientific realism. When a successful theory is abandoned, not all of its components are discarded but only those that are inessential or idle for the theory’s success. Their abandonment is thus inconsequential for the realist. So long as the essential components survive into the new theory there is no cause for alarm. More precisely, an outdated theory T which enjoyed some measure of success must, according to the realist, be: (i) partially true precisely because some of its theoretical claims are.. (shrink)

Empathy is generally regarded as important and positive. However, descriptions of empathy are often inadequate and deceptive. Furthermore, there is a widespread lack of critical attention to such deficiencies. This critical review of the medical discourse of empathy shows that tendencies to evade and misrepresent the understanding subject are common. The understanding subject’s contributions to the empathic process are often neglected or described as something that can and should be avoided or controlled. Furthermore, the intrinsic and closely interwoven relationship between (...) medical understanding and empathy is generally not explored. Instead of challenging objectivistic and instrumental ideals, the medical discourse of empathy tends to accommodate to inadequate ideals of objectivity and instrumentalism. Thus, important aspects of physician’s rationality, understanding, and morality are neglected and important opportunities for reflection, dialogue, and critique are forfeited. Both the critical and constructive parts of this paper are heavily inspired by philosophical hermeneutic insights, e.g. that physician’s empathy is always historically situated and part of a moral commitment. At the end of this paper, an alternative description of empathy - i.e. appropriate understanding of another human being - is outlined to facilitate the inclusion of hermeneutic insights and accentuate the inherent relationship between empathy and morality. Il s’intéresse aux aspects concrets d’un objet genré et politisé. En effet, le tracé, le remplissage à la couleur, la signature et l’échange de ce tissu prennent place à la fin de la première phase du conflit en Irlande du Nord caractérisée par les emprisonnements politiques. Dans les années 1970, les prisonniers républicains adaptent une activité féminine, la (...) broderie. Illustrant cette pratique, le mouchoir d’Armagh passe pour un exemple de tissu, certes hétérogène et marqué d’emprunts, mais qui conserve ses qualités liées au genre. Clothes protect our vulnerable skin and they keep us warm or cool. They help us show that we are young or old, rich or poor, at work or play, and whether we may be good to know. But though they are basic, much as food and shelter are - and also may be beautiful - they have long had a bad press in serious, moral and philosophical writing. The main reason for this is that they are external to us, a (...) cover we may hide behind, and one on which some people spend too much money, perfecting a pompous plumage of vanity: also they, and the fashions for them, may not last long. Nonetheless, when we choose our own clothes, we know the choice is a sensitive matter and far from being merely superficial. John Harvey considers the overlapping values that clothes have for us. Clothes both cover and advertise the bodies within them. They help make us the men and women we are, and help us to attract each other. They enroll us in groups, from our own circle to our generation worldwide; and they show just how, as individuals, we want to be noticed. Clothes, like their wearers, may compete in claiming power. They may also, on and off the catwalk, compete to claim the spotlight. In sum they show how we think we matter - and they can matter themselves in ways that may be intimate and even crucial to us. At all times clothes have demanded attention, even when they have been castigated for their vanity, and contemporary opinion is still divided. Are clothes the most frivolous of consumer disposables - or are they, however extravagant, art? Though we wear and see them every day, the value that they have for us is multiple and fugitive and hard to catch exactly. "Clothes" attempts to sort the many-coloured wardrobe which marks off mankind from other creatures. (shrink)

Judges in Street Clothes provides an historical, theoretical, and practical analysis of the ethical restrictions placed on the public lives of judges. The State’s interest in maintaining an independent and impartial judiciary is considered against a judge’s right to engage in educational, religious, charitable, civic, and professional activities.

Drawing upon Roland Barthes’ posthumously published notebooks from his 1974 trip to China, in which he remarks upon the ‘complete absence of fashion. Clothing degree zero’, this article offers a ‘late’ reading of Barthes’ interest in fashion, suggested here as a form of writing. In reference to the late works, specifically Barthes’ penultimate lecture course on the Neutral and Travels in China, supplemented by François Jullien’s comments on Barthes’ trip to China (regarding the use of the term ‘blandness’), as (...) well as mention of Michelangelo Antonioni’s film Chung Kuo-Cina (which Barthes viewed with ‘methodological’ interest), it is possible to draw together a reading of fashion as a neutral form. As a final step, reflection is given to Susan Buck-Morss’ reading of ‘history as passing’, as discontinuous moments (whereby fashion is symptomatic of such transformations). Barthes’ writerly mode – which works upon incidental details (also found in the work of Antonioni) – is revealed to be a pertinent method. (shrink)

Moral discourse is propositionally clothed, that is, it exhibits those features – such as the ability of its sentences to intelligibly embed in conditionals and other unasserted contexts – that have been taken by some philosophers to be constitutive of discourses that express propositions. If there is nothing more to a mental state being a belief than it being characteristically expressed by sentences that are propositionally clothed then the version of expressivism which accepts that moral discourse is propositionally clothed (‘quasi-realism’) (...) is self-refuting. Fortunately for quasi-realists, this view of belief, which I label ‘minimalism’, is false. I present three arguments against it and dismiss two possible defences (the first drawn from the work of Wright, the second given by Harcourt). The conclusion is that the issue between expressivists and their opponents cannot be settled by the mere fact that moral discourse wears propositional clothing. (shrink)
