A brain model based on glial-neuronal interactions is proposed. Glial-neuronal synaptic units are interpreted as elementary reflection mechanisms, called proemial synapses. In glial networks (syncytia), cyclic intentional programs are generated, interpreted as auto-reflective intentional programming. Both types of reflection mechanisms are formally described and may be implementable in a robot brain. Based on the logic of acceptance and rejection, the robot is capable of rejecting irrelevant environmental information, showing at least a "touch" of subjective behavior. Since reflective (...) intentional programming generates both relevant and irrelevant structures already within the brain, ontological gaps arise which must be integrated. In the human brain, the act of self-reference may exert a holistic function enabling self-consciousness. However, since the act of self-reference is a mysterious function not experimentally testable in brain research, it cannot be implemented in a robot brain. Therefore, the creation of self-conscious robots may never be possible. Finally, some philosophical implications are discussed. (shrink)

Exploring who, what and how we remember, this piece proposes that to remember requires, on the one hand, an auto-memoration, and at the same time, on the other hand, auto-memoration always detours through the world and through the other, which requires ‘con-memoration’. Referring to Derrida and Nancy, this piece argues that the memories of ourselves, and of others, is always already mediated because structured by differance and the other, and thus entails also a forgetting.

This essay starts with the possibility of situating Derrida’s aporetic ethics in the domain of normative ethics and argues that Derrida’s reflection on ethics is enrooted in the specific way he conceives the phenomenological notion of auto-affection. In the second section, I analyze, in the early work, auto-affection with signs and show its centrality in Derrida’s first encounter with Levinas’s philosophy. Derrida refuses to substitute the hetero-affective relation to the Other for auto-affection as the source of (...) universal law and normativity. He does not sacrifice universality and tackles the problem of autonomous ethical decision-making even though he welcomes through affectivity the signification of the singular other, which is irreducible to conceptual, emotive, and normative self-relation. This background helps us understand the rootedness of ethical aporias in a reflection on auto-affection. (shrink)

Os auto-debates que mais têm cha-mado a atenção dos filósofos são aqueles em que pareceria que a racionalidade é violada: do (...) wishful thinking ao auto-engano, passando pela akrasia e outras formas aparentemente paradoxais do pensar e do agir. Servindo-se de concepções da racionalidade e do debate desenvolvidas pelo autor, este artigo procura analisar a natureza do auto-debate e seus tipos, e mostrar que a irracionalidade que se costuma atribuir a alguns de seus exemplos típicos só se justifica devido a uma concepção que limita a racio-nalidade a seu modelo lógico-dedutivo.The debate with oneself is a common phenomenon. We make decisions every day – important or trivial, theoretical or practical – concerning issues in which we have to choose among at least two options. In order to do that we have to compare these options either by quietly reflecting about the merits of each one, or impulsively adopting one of them and discharging the others. The kinds of self-debate that have most attracted philosophers' attention are those in which rationality is apparently violated: from wishful thinking to self-deception, including akrasia and other apparently para-doxical forms of thinking and of acting. This paper tries to analyze the nature and differ-ent kinds of self-debate using the conceptions of rationality and of debate developed by the author, and tries to show that the irrationality that is usually attributed to some of its typical examples is only justified due to a conception that limits rationality to its logical-deductive model. Scholars are increasingly concerned about social biases in facial analysis systems, particularly with regard to the tangible consequences of misidentification of marginalized groups. However, few have examined how automated facial analysis technologies intersect with the historical genealogy of racialized gender—the gender binary and its classification as a highly racialized tool of colonial power and control. In this paper, we introduce the concept of auto-essentialization: the use of automated technologies to re-inscribe the essential notions of difference that were established under (...) colonial rule. We consider how the face has emerged as a legitimate site of gender classification, despite being historically tied to projects of racial domination. We examine the history of gendering the face and body, from colonial projects aimed at disciplining bodies which do not fit within the European gender binary, to sexology's role in normalizing that binary, to physiognomic practices that ascribed notions of inferiority to non-European groups and women. We argue that the contemporary auto-essentialization of gender via the face is both racialized and trans-exclusive: it asserts a fixed gender binary and it elevates the white face as the ultimate model of gender difference. We demonstrate that imperialist ideologies are reflected in modern automated facial analysis tools in computer vision through two case studies: commercial gender classification and the security of both small-scale and large-scale spaces. Thus, we posit a rethinking of ethical attention to these systems: not as immature and novel, but as mature instantiations of much older technologies. (shrink)

In this paper we examine Husserl’s ethics contribution to the understanding of human action determined by self-responsibility. We admit that self-responsibility is that ‘capacity’ of any subject to take a reflective stance on himself and his life. In this sense, the subject only experiences fully being responsible when guides his reason in the multidimensionality of his actions, aiming at a personal and cultural renewal. To show this, we firstly analyze the project of renewal of man and culture in the personalist (...) ethics proposed by Husserl, viewed from the history of parricide Karamazov. Secondly, we inquire about one of the two dimensions of human personality, self-awareness and presence of oneself, to approach the complex intentional act in which this selfconsciousness takes place. Thirdly, we analyze how the ability of self-determination, the other key dimension of the person, makes possible the self-appraisal by which the new man values his actions, motives, means and ends. We conclude that the self guides his life in full participation and emotional manifestation out of experiences that strengthen the ‘self’ and the ‘us’. (shrink)

Far from the harmony of the Greek statues, the Renaissance proportions in which is reflected metaphysical beauty, the clarity of Realism and the tranquility of Impressionism, the art of the 20th century is turning to new expressive possibilities and new, often incomprehensible, perhaps even meaningless, forms of communication. One of the most provoking artistic expressions is auto‑destructive art that appears in the 60s of the last century. The creator of the concept and author of the manifesto on auto‑destructive (...) art, Gustav Metzger (1926–2017) successfully combined his own political and ethical preoccupations with his work and showed a great degree of engagement with current issues of society and its (re) humanization. Auto‑destructive artistic expression should not be interpreted as a negation of painting, but rather as a creative process that carries a strong social and ethical message. (shrink)

In this paper, I present a new reading of Simone de Beauvoir’s first major work, L’Invitée ( She Came to Stay ), in order to reveal the text as a vital place of origin for feminist phenomenological philosophy. My reading of L’Invitée departs from most scholarly interpretations of the text in three notable respects: (1) it is inclusive of the “two unpublished chapters” that were excised from the original manuscript at the publisher’s request, (2) it takes seriously Beauvoir’s claim that (...) phenomenological philosophy is often better expressed in novels than essays or treatises, and (3) it views the novel’s main characters, Françoise and Xavière, as one woman who has multiple, contradictory, excessive selves. Thus approached, L’Invitée provides us with a thick description of one woman’s embodied consciousness and thereby shows us with specificity what a consciousness whose underlying structures reflect sexual difference looks like. This consciousness not only experiences itself as being both gendered, categorized, disciplined, and defined and in excess of these genders, categories, disciplines, and definitions at the same time, but also experiences its own self-relation through the presence of multiple selves who are each simultaneously attracted to and negating of the other. As such, the defining features of this consciousness involve experiences that I have respectively labeled “ontological multiplicity” and “auto-jealousy.”. (shrink)

In Voyous, Jacques Derrida develops his argument starting from the presupposition that democracy as such is the entity whose integrity and immunity are at stake and, therefore, under investigation. This gesture reflects the setting in which ten years before, in Foi et savoir, he had cast his reasoning about the logic of immunity. There, it was one of the sources of religion, the immunity of the sacred, that operated according to this logic. The hyphen between these two essays, beside Derrida’s (...) own crossed references, is the genealogical reasoning on the meaning and essence of the concept of democracy: contrary to what Derrida claims, it will be maintained that Athenian democracy had a clear immune matrix, whose constant exercise is clearly defined, in spite of himself, by Vernant, and it will be shown how modern democracy has been forced to change policy. Modern democracy is an entity characterized by an immune deficiency. In order to save Derrida’s intuition from both the collapse of different vantage points and from a quite bizarre reticence in taking into account of the immune value of rituals, our starting point will be René Girard’s œuvre and his reading of the role of immune logic in sacred systems and, more generally, in modernity. The threshold between the auto-immune reaction, immune deficiency and auto-immune disease, between the sacrifice who delimits and constitutes the self and the holocauste du peuple en détail, is the space where, constantly exposed to the risk of auto-denial, democracy lives. To Weber’s grand and capacious sociological categories, economy and society, I have added a third literary and philosophical term: tragedy. Now, to be sure, Weber thought a great deal about tragedy,2 and was drawn to tragic themes in many of his most salient and influential sociological studies. One need think only of his account of the bureaucratic “routinization” of prophetic charisma in The Sociology of Religion,3 or his depiction of modern humanity’s self-imposed “iron cage” in the rousing final pages of The Protestant Ethic and the Spirit of Capitalism,4 a text to which I will return at the end of this essay.5 But tragedy entails far more than systemic collapse or self-inflicted disaster. In this essay, I want to explore some of the implications of combining close attention to the lived experience of concrete individuals to the highly theoretical, systems-level analysis inspired by such Weberian categories. Put another way, how may Cultural Anthropology, and more specifically Ethnography, deepen such a globally-oriented Sociology? Here, I intend to supplement Weber’s sociological dyad, economy and society, with a conception of tragedy drawn from the cognate social sciences of Comparative Religion and Cultural Anthropology; I will be using Attic Greek tragedy as a benchmark. More specifically, I wish to highlight some of the ways in which the first book-length ethnographic study of the Greek economic crisis may add vital nuance to Weber’s more theoretical, world-systems approach. This chapter tracks the development of the concept of self-awareness (jikaku, 自覚) in the thought of the Japanese modern philosopher Nishida Kitarō (西田幾多郎) (Kitarō Nishida) (1870–1945), founder of the Kyoto School. Nishida’s oeuvre can be divided into distinct periods, from the 1910s to the 1940s until his passing, during which he thematized and focused on different issues. Nevertheless, self-awareness is a unifying theme throughout. In the chapter we trace how Nishida develops this concept through distinct periods in his career. His (...) initial focus upon pure experience gives way to his focus upon its articulation in reflection vis-à-vis intuition as the unfolding of the will. This then leads to his thematization of the place wherein judgment or propositional thought unfolds and the broader contextual place wherein that place is situated. That thematization of place, in turn, develops into a look at the world where we interact as historical and social bodies with others (nature, other people, etc.). Nishida understands self-awareness in accordance with each of these themes in the respective periods of his oeuvre. But common to all of them is how Nishida understands self-awareness as a self-mirroring – self-reflection as reflexivity – founded upon the premise assumed by the articulated image or object of awareness, a premise necessarily irreducible to, and in excess of, the image or object. This is the a priori that Nishida for the most part calls the “absolute nothing” (zettai mu, 絶対無). To explain this Nishida makes use of Josiah Royce’s notion of a self-representative system as well as Richard Dedekind’s notion of an infinite system in his set theory. On the basis of Nishida’s references to the mathematics of set theory, I further compare his understanding of self-awareness to Kurt Gödel’s Incompleteness Theorems as well as to more recent mathematical theorists, influenced by Gödel, whose understanding of the infinite resonates with Nishida’s understanding of the absolute nothing as assumed by self-awareness. Bennabi created the concept of Post- Almohad Man and its “Colonsability” - a tendency to be colonized which allows the aggressor to be transformed into the colonizer. Is Bennabi’s theory applicable to Iraq? Should killing a Post- (...) Almohad Man be the aim, as Bennabi postulated, and only this will allow society to develop? The unborn healthy foetus is looked upon as a blessing by one and all. A plethora of thoughts arise in the brains of expectant parents. But what goes on in the brain of the yet unborn still remains a mystery. 'Foetal mind' is a reflection of functions of its organs of sense, an instrument of knowledge that may even be reduced to machine to demonstrate the effect of sense organs and brain contact. Testimony to this fact are the various (...) waveform patterns obtained non-invasively from the foetal Middle Cerebral Artery (MCA) by using Colour Doppler Ultrasound. Our study, conducted for evaluating the foetal MCA in a rural obstetric population in Maharashtra, India, explains how the MCA - a major artery supplying foetal brain, can give abundant information about foetal heart and foetal stress. When only the foetal heart is stressed by the presence of arrhythmias or ectopic beats, these changes are manifest in the foetal MCA velocity waveform pattern as seen on Colour Doppler study. When the entire foetus is under stress, as in cases of intra uterine growth retardation (IUGR), changes again manifest in the foetal MCA velocity waveform pattern and are designated as the foetal Brain Sparing Effect. Thus scientific evaluation of foetal MCA waveform can objectively demonstrate that the overtly non-communicating foetal brain indeed remains an internal organ of sense and a vital instrument of knowledge to clarify the various effects of sense organs and brain contact. Although the brain parenchyma or cerebral metabolism has not been studied here, cerebral vessels serve as a window to cerebral metabolism, as auto regulatory function of brain leads to changes in haemodynamics of cerebral vessels. Also, like other vessels, MCA mirrors foetal distress and IUGR; but unlike other vessels, e.g. the umbilical or uterine artery, which show these changes in the form of reduction or even reversal of diastolic flow, MCA shows an increase in diastolic component due to brain sparing effect. The unique connection between physical changes in the foetal heart, brain and mental operations are thus critically clarified to some extent, and this helps untangle and comprehend the lattice of mental operations. Although this preliminary study has its limitations, it still carries forward the present corpus of knowledge on the strength of its evidential and critical enquiry and helps unravel the concept of foetal consciousness. The paper starts out with a discussion of the difference between mythology and feasible concepts in robotics. Based on a novel brain model and an appropriate formalism, a distinction is made between auto-reflection and hetero-reflection of the robot and self-reflection of its constructor. Whereas conscious robots are able to auto-reflect their mechanical behavior and hetero-reflect the behavior with regard to the environment, the capability of self-reflection must remain within the constructor of the robot. This (...) limitation of the construction of conscious robots is mainly brain-theoretically and philosophically founded. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

This chapter shows how Derrida's deconstruction in Voiceand Phenomenon exposes a double necessity that undergirds Husserl's phenomenological inquiry in the “First Logical Investigation,” especially with respect to expression and indication. It turns to Derrida's reflections on the aporia of blindness in Memoirs of the Blind in order to further develop the logic of double necessity and to examine Derrida's divergence from Merleau‐Ponty's thought. The chapter examines Derrida's critique of the auto‐affective movement of temporalization in Voice and Phenomenon that reveals (...) the impossibility of pure auto‐affection. It explores the limits of Merleau‐Ponty's phenomenology where he has moved beyond Derrida's deconstruction of Husserlian phenomenology. For Derrida, Merleau‐Ponty's emphasis on speech and perception reveals his entrenchment in the phenomenological prioritization of presence; “soaring up to the sun of presence, it is the path of Icarus”. In Voyous, Jacques Derrida develops his argument starting from the presupposition that democracy as such is the entity whose integrity and immunity are at stake and, therefore, under investigation. This gesture reflects the setting in which ten years before, in Foi et savoir, he had cast his reasoning about the logic of immunity. There, it was one of the sources of religion, the immunity of the sacred, that operated according to this logic. The hyphen between these two essays, beside Derrida’s (...) own crossed references, is the genealogical reasoning on the meaning and essence of the concept of democracy: contrary to what Derrida claims, it will be maintained that Athenian democracy had a clear immune matrix, whose constant exercise is clearly defined, in spite of himself, by Vernant, and it will be shown how modern democracy has been forced to change policy. Modern democracy is an entity characterized by an immune deficiency. In order to save Derrida’s intuition from both the collapse of different vantage points and from a quite bizarre reticence in taking into account of the immune value of rituals, our starting point will be René Girard’s œuvre and his reading of the role of immune logic in sacred systems and, more generally, in modernity. The threshold between the auto-immune reaction, immune deficiency and auto-immune disease, between the sacrifice who delimits and constitutes the self and the holocauste du peuple en détail, is the space where, constantly exposed to the risk of auto-denial, democracy lives. Although interest in Corporate Social Responsibility (CSR) in emerging markets has increased in recent years, most research still focuses on developed countries. The scant literature on the topic, which traditionally suggested that CSR was relatively underdeveloped in emerging markets, has recently explored the context specificity, suggesting that it is different and reflects the specific social and political background. This would particularly apply to local companies, not so much to foreign subsidiaries of multinationals active in emerging markets. Thus far, empirical research (...) that systematically documents a range of CSR activities of local companies and their performance has been scarce. This paper reports the results of a survey conducted among companies in the Mexican auto industry. CSR performance was investigated across three dimensions: environmental, labor, and community, using measures from existing research and global, ' Western' standards of practice, to identify the type of CSR activities and the level of CSR performance that exists, if at all, in the emerging-market context. Results show that local companies do engage in the type of CSR activities commonly associated with CSR in developed countries. To the extent that comparisons could be made, our findings also indicate that CSR activities and levels among the sample are comparable to what is known about CSR in developed-country settings. Moreover, six of the nine CSR dimensions are intercorrelated, which suggests that CSR in the Mexican auto parts industry is more structural than incidental. (shrink)

This article presents factors and criteria of interview in auto-confrontation with an objective of professional didactic, which we frequently conduct in our collaborative researches, when we analyze the activity. Our aim is to initiate reflections and debates about the status conferred to auto-confrontation in a process of research and about the issue answers by such method in professional training. Observing that auto-confrontation is discussing in human and social sciences as a tool of investigation, as a method or (...) as scientific object, we try to identify dimensions that make it to be both a method of investigation and a tool of professional training. Since we explain why auto-confrontation considering in theoretical context of professional didactic constitutes a tool for professional involvement, and that, in such case, it integration in vocational training engineering is relevant. This article argues the main following points. (1) Communism was fatefully dependent upon the action or inaction of its top leaders because of the vulnerability of the hyper-centralized power and hyper-centralized defense of the ruling class and the ruling party. No one was really able to seriously predict the historical contingencies such as Gorbachev and Yeltsin that played a decisive role. The most that social scientists and analysts could safely claim was that communism had become unsuccessful and problematical to such (...) an extent that force alone could maintain it. However, given the overall history of communism, who could have anticipated that such force would not be used. (2) The United States is toiling now in an overwhelmingly difficult and dangerous transition, not only from a ‘superpower’ to ‘merely’ a big power, but from a totalistic and laissez-faire capitalism to a limited and state-regulated capitalism. It is the most efficacious way of production and primary distribution. However, unless capitalism, national and global, becomes regulated and combined with some kind of socialism (solidarism) that is yet to be established, global crises will keep recurring. The best chance for enlightened socialist (solidaristic) humanism lies in secondary distribution based on equality and justice as its fundamental principles. (3) The very term ‘superpower’ suggests a kind of superhuman, almost divine power. The United States does not have such power because (among other things) apocalyptic weapons are at the disposal of some considerably weaker states (in every other respect). (4) The possibility of the self-destruction of humankind has become the over-determination of all other over-determinations in history. It follows that auto-apocalypse must be separated from the categorical and epochal dichotomy between modernity/ modernism and postmodernity/postmodernism and given an absolute priority, both theoretical and practical. This break should be characterized as post-postmodernity and reflection upon it as post-postmodernism. We are in vital need of a total anti-apocalyptic turnaround in overall thought, sensitivity, activity and organization. Unfortunately, it can now safely be predicted that more and more states and societies, even those founded on (internal) freedoms and desirous to maintain them, will become transformed into states and societies focused on the struggle for survival in the face of auto-apocalyptic threats. I believe that confronted more and more with such threats liberalism will actually, and later probably also explicitly, yield the place of the fundamental operative (unlike declarative) view of the world, ideology, imagology, and principle of social organization — to humankind existentialism. We have entered an existentialist ‘end of history’ instead of the proclaimed liberalistic ‘end of history’. (shrink)

Reflecting on the fall or failure of sovereignty, this essay considers Derrida’s recent work under the heading of auto-immunity, and develops some consequences of that work, first of all in the political sphere (especially around democracy), but also some more general consequences around conceptuality itself.

De este modo, aquel logos que era “en el principio” es él mismo un mito, si no se hiciera presente (vergegenwärtigt) a sí mismo como logos. El principio de la religión, el Eterno mismo, deja narrar en el judaísmo un mito que culmina en un logos y puede ser interpretado como tal. En el cristianismo, la auto-re-presentación del (...) principio de la religión como autorreflexión, esto es, la encarnación, pone al logos antes que al mito: “El que me ve a mí, ve al Padre” (Jn. 14, 9). Esto es lo que distingue al cristianismo de aquello que ha de permanecer ajeno al judaísmo, pues: “No puedes ver mi rostro y seguir viviendo” (Ex. 33, 11ss). --- “‘In the beginning was the logos’ –or was it rather the mythos? On the Re-presentation Principle in Judaism and Christianity”. Myth and logos are united in the description of myth which allows for a re-presentation (Vergegenwärtigung) and is comprehensible for the understanding: “muqologei=n”. Thus, that logos which was “in the beginning” would be itself a myth, if it does not present (vergegenwärtigt) itself as logos. The principle of religion, the Eternal itself, allows in Judaism the narration of a myth that ends in a logos and can be interpreted as such. In Christianity, the self-representation of the principle of religion as self-reflection, that is, incarnation, puts the logos before the myth: “He who has seen me has seen the Father” (Jn., 14,9). This is what distinguishes Christianity from that which will remain foreign to Judaism, since: “you cannot see my face; for no one shall see me and continue to live” (Ex. 33, 11ff). (shrink)

The article represents auto-ethnographical reflections about the author's journey towards reconciling diversity with the advent of democracy in South Africa. The author recounts aspects of his participation in the Truth and Reconciliation Commission. It focuses on aspects of Reformed theology and spirituality as instruments for reconciling diversity. Local and international theologians opposed apartheid, calling it an unjust and indefensible political system, using their Reformed conviction, often applying the very same notions and principles. The article discusses the opposition to apartheid (...) in the Reformed world, which culminated during the Ottawa meeting of the World Alliance of Reformed Churches in 1982 when apartheid was denounced as a 'sin and a heresy' - a legitimate cause for a Status Confessionisin a classical Reformed manner. The article demonstrates the way in which the TRC took note of all of this and includes testimonies of Reformed theologians and leaders who opposed apartheid, often paying a costly price. (shrink)

The relational and intersubjective model of subjectivity does not deny the subject, neither does the self-narrating exercise of synthesis of the heterogeneous evade the identity question. It is the role of language to found the meaning of ipseity, to articulate the needs and desires, to organize the dispersion experienced, and to tie action to moral principles of social responsibility. Reflection and self-reflection structure the human experiences of recognition. The correlation between the idea of freedom of individual choice and (...) the idea of collective responsibility is the opportunity for the affirmation of each one and for the establishment of reciprocity between everyone. Within this context, the dialogue between Ricœur, Honneth and Sen proves to be very inspiring.  . (shrink)

ABSTRACT Even if Lotman’s theory has often been presented as a semiotic theory based on categories of space, temporal categories are crucial as well. And as we can speak of polyglotism as one of the main features of culture, we should speak of polychronism as well. In each state of culture, in fact, we find many temporal codes, and the internal dialogue is not only based on codes coming from different spaces (in the normal sense of polyglotism), but also as (...) coming from different times (in the sense of a sort of polychronism). Lotman’s reflections about this aspect of culture could be very useful in order to understand some aspects of our society, where we find a form of presentism, the temporal dimension corresponding to localism within the spatial dimension, which globalization has produced. The paper assumes that the very source for an appropriate concept formation and categorization of the phenomena of consciousness is provided by pre-reflectively living through one’s own experiences (of perceiving, remembering, imagining, picturing, judging, etc.) and reflecting upon them. It tries to argue that without reflective auto-phenomenological theorizing about such phenomena, there is no prospect for a scientific study of consciousness doing fully justice to the phenomena themselves. To substantiate the point, a detailed reflective and descriptive analysis of re-presentational (...) experiences is presented, an essential property of which is their containing in themselves components that can only be individuated on the basis of reflection by the experiencing subject him- or herself. For heterophenomenology to account for them, autophenomenology is therefore presupposed. (shrink)

How are we to rearticulate and retool those kaleidoscopic “problems” of social categories and identities each time differently, with different productivity, even as different “products”?—this capital, frontal problema, this “sufficient” bodily evidence in and of reality, “in front of you” and me. Such is the broad philosophical force, background and foreground, of the questions I dwell on here if only briefly. What interests me in particular, just as an example if not (...) exemplar, concerns the “Asian female” question, with which I happen to have some auto-ethnographical familiarity: the material specificity as well as translatability of some of the stereotypical identity markers of it categorically isolatable as such—I also show why a categorically responsive reflection matters, as my ultimate aim here is to advance a case for the social ontological centrality of this issue of Asian gender stereotypes to feminist and critical race theories. Riassunto : Negli ultimi anni sempre maggiore attenzione viene data alla possibilità che una forma minima, pre-riflessiva di auto-coscienza preceda l’auto-coscienza introspettiva. Diversi sono stati i tentativi fatti per sostenere che questa forma “sottile” di auto-coscienza sia un prerequisito necessario della coscienza. Dopo una breve considerazione dei problemi semantici ed epistemologici relativi all’uso del pronome di prima persona, questo articolo si concentrerà sulla letteratura che analizza le eccezioni al principio di immunità dall’errore per misidentificazione dalla prospettiva della (...) fenomenologia dell’agentività. Il nesso tra problemi epistemologici e fenomenologici intende mettere in questione l’idea per cui l’auto-coscienza sia una componente essenziale di ogni esperienza cosciente, anche e soprattutto quando sia emendata come una forma minima di auto-coscienza. Several attempts to argue that this “thin” notion of self-consciousness is a necessary prerequisite of consciousness have been provided. After briefly considering the semantic and epistemological issues related to the first-person pronoun, this paper refers to the literature that investigates exceptions to the Immunity to Error Through Misidentification principle from the point of view of the phenomenology of agency. We interrogate the relationship between the epistemological and the phenomenological issues for the purpose of questioning the idea that self-consciousness is an essential component of every conscious experience, even and especially when it is considered to be a minimal form of self-consciousness. The phenomenology of the self-attribution of agency seems to suggest that self-consciousness corresponds to an extended rather than a minimal self, namely to a reflective rather than a pre-reflective self-consciousness. This book aims to develop an account of living together with difference which recognises the tension that we are inescapably with others - both human and non-human - but at the same time are always differing from and with those with whom we find ourselves. A concern for coexistence and questions over how we might live together have been raised and approached from a host of conceptual starting points in recent times, including via calls for a rethinking of communism today, (...) the articulation of forms of 'cosmopolitics' or 'pluralism', the re-figuring of understandings of ecology as dark or feminist, amongst others. This book responds to such questions of coexistence by developing what it calls a 'co-existential analytic'. In doing so, this book introduces a range of post-phenomenological thought which offers means for thinking about such questions of living together with difference. The thought of Emanuel Levinas on the face of the other, Jean-Luc Nancy on being as being-with, Roberto Esposito on the munis, and Michel Henry on pathic auto-affection are introduced and critically reflected upon in terms of what they offer for thinking about such coexistence. Alongside these conceptual starting points, a series of encounters - with cinema, everyday life, politics, and literature - are used to animate and illustration the discussion. Ultimately, the book argues for a 'spacing' of subjectivities with that world and those encountered within it. This book is intended primarily for researchers and postgraduate students interested in questions of identity, difference, and subjectivity. He was eventually cleared of the crime of Judaizing, of performing Jewish rituals while pretending to be Catholic, but was sent to prison for one year for having concealed his Judaizing relatives from the authorities. He died while serving out his prison sentence. Many of the rest of his family, whom he brought over from Spain as part of the privileges of his office, were condemned as judaizantes pertinaz, persistent Judaizers. In the auto de fe of 8 December 1596 the governor's sister Francisca Núñez de Carvajál and four of her adult children were, in the language of the Holy Office, "relaxed to the secular arm for burning." Francisca's daughter, Mariana, was spared the stake in 1596 because she was deemed to have lost her senses. Once she regained them, she, too, was condemned as a persistent Judaizer and died in the auto de fe of 25 March 1601.From all accounts the Carvajál family was used by the Holy Office as a warning to the crypto-Jewish community of New Spain. Even Stephen Greenleaf, known for his balanced accounts on the Mexican Inquisition, 2 describes the persecution [End Page 81] of the Carvajáls as a "Counter Reformation tact," concluding that "the Holy Office wanted to use the Carvajáls as an example to the Jewish community of Mexico." 3 Yet more was at issue here than just a display of the naked power. The questions the inquisitors posed and the rhetoric they used suggest something beyond flexing a coercive muscle in front of the crypto-Jewish population of colonial Mexico.Not all members of the Carvajál family perished in the flames of so-called Counter Reformation intolerance. One of Francisca's sons, a Dominican monk, was able to maintain his commitment to his order even after being convicted of concealing his heretic relatives from the authorities. A son-in-law, Antonio Diaz de Cáceres, was reconciled after paying what biographer Martin A. Cohen considered an "unusually light" penalty, a public abjure de vehementia and a fine of a thousand Castilian ducats. Cohen explains this unusual pardon in terms of political intrigue. "Because he was a man of esteem and had served the king on several occasions," wrote Cohen, Antonio was spared the lash. 4 Yet political favors were not the only consideration. Systemic existential conditions are indelible aspects of a client's reflective and nonreflective modes of consciousness, and therefore fall within the purview of philosophical counseling. This paper focuses on the experience of the dehumanization that is a function of the monetization of all aspects of post-modern neoliberal society. Monetization demands radical self-abandonment, self-anesthesia, auto-aggressive self-exploitation and addiction for functionality within the system. The bankrupt logic of pandemic terrorism confirms that monetization has become the preeminent measure of value. Monetization distorts both (...) reason and value, concealing a covert nihilism masquerading as the new metaphysics. The symbiotic natural world evidences a level of cooperation and coexistence that escapes monetization. Therefore, a monetized society is a society at odds with the world ecosystemand life itself. Caught in a labyrinth ofmonetized dehumanization, clients often participate in the fictional metanarrative of belief in unlimited individual possibility as a hedge against anxiety, depression, powerlessness, anomie, and the logical loop of cognitive dissonance. This clause, absent (...) from earlier editions, while implicating the comic cowardice of the narrator also adumbrates a tragic sense of prudence. In the early years of the sixteenth century, not just Rabelais but the rest of his Renaissance world had come increasingly to know the heavy hand of censorship and persecution. Bookburning, of course, had lost its traditional source of terror with the invention of the printing press: no longer could a single bonfire extinguish all versions of a single manuscript. Instead, Church and State authorities had in the course of the Renaissance to invent new practices for controlling and regulating the circulation of dangerous words: bans on publication, excision of offensive passages prior to printing, indices of prohibited books, and so on. When left with no other alternative, however, one could still burn not just sample copies of the book but the offending author too, such as in the case of Giordano Bruno, whose auto-da-fé menacingly lit up the skies in the very first year of the seventeenth century. 1Today, with the advent of electronic media and the virtual extirpation of texts from the materiality of print and paper, it is even more difficult to abolish or even regulate the spread of refractory discourses. Written at a time, over half a century ago, when another wave of explicit attacks on writers shocked the intellectual world, Strauss’s essay, on the one hand, struck a hopeful chord by evoking the kinds of techniques available to writers in their efforts to evade or foil censorship, that is, by demonstrating that no censorship can fully succeed in terroristically bringing about an end to heterodox forms of expression. On the other hand, he posits at least the possibility for every text that it has an inexorable core that is esoteric. No censorship can be total, but there is also no such thing as a pristine state of letters prior to censorship. The Genesis of the Social and the Carnal Donation of the Non-Presentable. The Range of the Notion of Institution in Merleau-PontyThis article examines the range of the notion of institution that Merleau-Ponty proposes in his course at the Collège de France (1954-55), by notably insisting on the importance of the question of the genesis of the social for the deepening of his thought. By broadening his investigative domains in two complementary directions (that is, lateral passivity and socio-historical institution), Merleau-Ponty aims (...) in this course to grasp in a better way the lateral relations of our Urstiftung (originary institution) and the instituting subject who obliquely goes beyond the institution towards its sense. That leads him to introduce the perceptual field as being essentially lacunary, because it marks a place where the consciousness is present at the divergence in relation to consciousness. It is certain that the Phenomenology of Perception addressed this question by considering the social as a place where “I am given to myself”. However, the psychological starting point of this work, as well as the originary temporal and unilateral character of radical reflection, prevented one from really grasping the institutional junction of the concrete event and the symbolic matrix. One was not able to thematize an auto-articulation which appears suddenly between radical reflection and the unreflective. This is why Lévi-Strauss’ structuralist thought, by considering the social as symbolism, allows for a better understanding of this institutional nexus. But this idea does not lead to the dogmatic positing of the reality and the autonomy of the social. Instead, it encourages us to practice “the perception of history,” which consists in guessing, in the very process of sociological idealization, the carnal and wild donation of the non-presentable. This article aims to explore how the archival life of Olive Morris might radically rebuff the devaluation of Black womanhood and identity in Britain. Harnessing a Black feminist framework, I approach Lambeth Archives, where the Olive Morris Collection is found as a therapeutic space. Through an understanding of Olive as complex, I disrupt hegemonic expectations of Black women and propose that within the space of this research, Black womanhood be allowed the freedom of self-definition. In a conglomeration of the documents (...) and voices of the community that remembers Olive, marginalised epistemologies are legitimised. Their sometimes-conflicting accounts generate an unbounded image of Olive as a figure of Black British women’s history that harbours meaning as it is mobilised in social consciousness. Incorporating my own auto-ethnographic reflections, I explore the internal and external impact of Olive and my existence in this archival space. (shrink)

How, if at all, consciousness can be part of the physical universe remains a baffling problem. This article outlines a new, developing philosophical theory of how it could do so, and offers a preliminary mathematical formulation of a physical grounding for key aspects of the theory. Because the philosophical side has radical elements, so does the physical-theory side. The philosophical side is radical, first, in proposing that the productivity or dynamism in the universe that many believe to be responsible for (...) its systematic regularities is actually itself a physical constituent of the universe, along with more familiar entities. Indeed, it proposes that instances of dynamism can themselves take part in physical interactions with other entities, this interaction then being “meta-dynamism” (a type of meta-causation). Secondly, the theory is radical, and unique, in arguing that consciousness is necessarily partly constituted of meta-dynamic auto-sensitivity, in other words it must react via meta-dynamism to its own dynamism, and also in conjecturing that some specific form of this sensitivity is sufficient for and indeed constitutive of consciousness. The article proposes a way for physical laws to be modified to accommodate meta-dynamism, via the radical step of including elements that explicitly refer to dynamism itself. Additionally, laws become, explicitly, temporally non-local in referring directly to quantity values holding at times prior to a given instant of application of the law. The approach therefore implicitly brings in considerations about what information determines states. Because of the temporal non-locality, and also because of the deep connections between dynamism and time-flow, the approach also implicitly connects to the topic of entropy insofar as this is related to time. Purpose– This paper aims to introduce the concept of ETHICOMP as “community mentor” – the role that the ETHICOMP conference plays outside the standard conference fare, in which it nurtures and supports up-and-coming researchers in the field of computer ethics.Design/methodology/approach– This paper uses an auto-ethnographic methodology to reflexively explore the author’s career from PhD student to early career researcher spanning the years 2005-2013, and how the ETHICOMP community has played a significant role as a mentor in her life. The (...) literature on mentorship is discussed, particularly focussing on the importance of mentorship for women in philosophy-related academic careers, and criteria for successful mentorship are measured against the ETHICOMP “community mentorship”. Additionally, some key philosophical concepts are introduced and reflected upon.Findings– The paper produces recommendations for other philosophical communities wishing to grow their mentorship capabilities through communities around conferences.Originality/value– This paper sheds new light on the concepts of mentorship and the practical application of mentorship within an academic community. It also provides an account of the value of the ETHICOMP conference series that is beyond the usual academic output. (shrink)

Context: In 1974, Humberto Maturana and Francisco Varela published De Máquinas y Seres Vivos Autopoiesis: La organización de lo vivo in Santiago, Chile as a little book. A second edition of this publication was proposed in 1994, and the present document is a recent translation of Maturana’s reflections “twenty years after.” Problem: The book clearly enunciates what it means to say that living systems are molecular autopoietic systems, and this Preface reflects on the shift of understanding from earlier notions of (...) self-referred or auto-referred systems to the concept of autopoiesis. Implications: The Preface describes the systemic quality that is human living and human sense-making. It marks what we can retrospectively see as the bridge between the explicitly biological studies of Maturana (and Varela), and the later, more anthropological and therapeutic work of Maturana with Gerda Verden-Zöller between 1989 and 1994 and, especially, with Ximena Dávila Yáñez since the year 1999. Results: The underlying understanding implicit in this document outlines in great clarity the implications of Maturana’s fundamental insights. It presents both a logical and passionately argued case for mutual respect, grounded in scientific findings in biology. The Preface is a clear vision of why Maturana’s work has been so influential for reflexivity and constructivism. (shrink)

The following article attempts to be a contribution to the reflection on the lines of continuity, proximity relations and possibles elements of differentiationon two theoretical fields of growing importance within the social sciences: theory of systems of Niklas Luhmann and the deconstruction of Jacques Derrida. Along with accounting for the extent of both theories for reflection on the foundations of the social sciences, this article tries to install some useful questions for self-observation of the epistemological foundations of this (...) field of knowledge. El siguiente artículo reflexiona en torno a las líneas de continuidad, relaciones de proximidad y elementos de diferenciación posibles de detectar en dos campos teóricos de creciente protagonismo al interior de las ciencias sociales: la teoría de sistemas de Niklas Luhmann y la deconstrucción de Jacques Derrida. Junto con dar cuenta de los alcances de ambas teorías para la reflexión relativa a los fundamentos de las ciencias sociales, el artículo pretende instalar algunas interrogantes de utilidad para la auto-observación de los fundamentos epistemológicos de dicho campo del conocimiento. In The Right to Narcissism: A Case for Im-Possible Self-Love, Pleshette DeArmitt opens the space for an alternative to origin story so popular with political philosophers, namely, the social contract, which assumes a rational and self-identical subject. She does this obliquely by deconstructing narcissism as love of the self-same, or, love of what Kristeva might call “the clean and proper self.” Like Echo interrupting Narcissus’s soliloquy of deadly self-absorbed pleasure and his solitary auto-affection upon seeing his own reflection, (...) Pleshette interrupts the seeming proximity of self-same, the closeness of near, and the propinquity of proper by deflecting the image of Narcissus onto the voice of Echo, who comes into her own by repeating his words. How, asks Pleshette, can Echo’s reiteration of the words of another be anything more than mere repetition or reduplication? Echoing Derrida, she answers that it is through a declaration of love. Echo’s repetition of the words of Narcissus take on new meaning, and allow her to express herself, and her love, through the words of the other. After all words are words of the other. Language comes to us from the other. Echo becomes a self, a “little narcissist,” through an address from and to the other, through the appropriation and ex-appropriation of the other’s words. In this article we present a conjecture regarding the biology of subjectivity and feeling, based on biophysical and phenomenological considerations. We propose that feeling, as a subjective phenomenon, would come to life as a process of resistance to variance hypothesized to occur during the unfolding of cognition and behaviours in the wakeful and emoting individual. After showing how the notion of affect, when considered from a biological standpoint, suggests an underlying process of resistance to variance, we discuss how vigilance, emotional (...) arousal and attentional behaviours reflect a dynamics of controlled over-excitation related to cognitive integration and control. This can be described as a form of resistance to variance. We discuss how such a dynamics objectively creates an internal state of tension and affectedness in the system that could be associated with subjective states. Such a dynamics is shaped by the system's need to cope with its own inertia, to engage in intentional behaviours, attend, preserve coherence, grapple with divergent cognitive, emotional and motivational tendencies, and delayed auto-perturbations of the brain-body system. More generally, it is related to the need to respect the hierarchy of the various influences which affect its internal dynamics and organization. (shrink)

In times of crisis, connections among people, cultures, and societies seem to be the main antidotes available against the risks of individualism, auto-referentiality, and a revenge culture. Connectivity offers opportunities to nurture human generativity (Santi, 2021) in the service of better futures and cosmopolitan scenarios, contrasting the delusion of autarchical economies, the rhetoric of political nationalism, and the reinforcement of social polarization by way of competition/marginalization, which applies to education as well. The pandemia that occurred in 2020 brought both (...) risks of isolation and opportunities for connection: it has been a paradoxical and even paroxysmal situation that has challenged us to think about forms of dependence, especially in instructional contexts. The stimulus for an inquiry that was carried out with 817 students at the University of Padova was the provocative title of an album by well-known musicians: “Declaration of Dependence.” The aim was to think about dependencies in the form of regular roles such as “study/student” that are important for our human existence, and which were profoundly upset by the “sindemia” (Singer, 2009). Our aspiration was to explore what it means to belong to a thriving university whose over-arching goal is to serve the dependencies of people in a generative community of future horizons. Our efforts led to the drafting of the “Declaration of Dependence,” a shared manifesto by the research group that enumerated a thorough list of the students' self-declared dependencies, and which was later shared with the university community in multiple languages. This led, in turn, to the use of the Declaration to launch multiple focus groups, which discussed these dependencies in a setting devoted to dialogue and the practice of complex thinking. Subsequently, in a workshop carried out in 2020 at the 20th Biennial Conference of the International Council of Philosophical Inquiry with Children (ICPIC) in Tokyo, we opened an international dimension on the reflections that had preoccupied us in the Padova University context. Here, the aim was to reflect on the personal, collective and educational dependencies of the present historical moment through the practice of community of philosophical inquiry, which offers a paradigmatic time and space for sharing, listening, questioning, and gaining perspective. The conference workshop offered an international group of scholars and practitioners from various socio-political contexts the opportunity to deliberate on how the pandemic has impacted both their local and the global community. Considering the new educational and philosophical challenges presented by the pandemic, the group expressed an urgent need to deconstruct established boundaries and return to “origins.” Invoking metaphors taken from the natural world (Roversi et al, 2022), an inquiry into the nature and scope of our fundamental dependencies reminds us that we are part of a socio-cultural ecology that is grounded and nurtured in our relationship with others. A community that understands its dependencies as gifts that call us to the design of a better future could in fact represent a foreshadowing of a better tomorrow. (shrink)

Il s’agira ici de faire apparaître la régressivité — possibilité perpétuelle d’adjoindre un degré supplémentaire à l’énoncé — comme le principe même de l’ironie, ce qui conduit à la concevoir non comme une grille sémiotique et axiologique, mais comme une dynamique.La réflexion part de la cellule de base qu’est le signe ironique en tant que structure hiérarchisée à deux degrés, selon la conception traditionnelle. Cette dualité est d’abord analysée du point de vue sémantique, dans le cadre tropologique, puis sur les (...) plans axiologique, actantiel et énonciatif, ce qui aboutit à l’hypothèse de l’ironie comme trope métadiscursif, cumulant l’usage et la mention . Dans ce cadre, l’ironie se conçoit comme une représentation de représentation, comme un processus d’auto-duplication agissant par réflexivité critique et comique, et donc capable de se perpétuer virtuellement à l’infini puisque, s’appliquant à lui-même, il peut toujours ajouter un degré au précédent, sans pour autant l’annuler : le signe à deux niveaux ne constitue que la réalisation minimale de l’ironie, dont le second degré peut lui-même être réfléchi par un troisième, etc. Le « pouvoir réfléchissant » de l’ironie fait ainsi sa « force ascensionnelle » régressive, selon deux expressions empruntées à Proust.Interne au signe, ce dynamisme permet aussi, à l’échelle d’une oeuvre, de greffer différentes sortes d’ironie les unes sur les autres : la puissance créatrice du processus régressif conduit à envisager son rôle dans l’oeuvre d’art, en l’occurrence À la recherche du temps perdu, dont le texte multiplie de façon exemplaire et retorse les strates d’ironie. La Recherche, qui aura préalablement servi de support à toutes les analyses, permettra, par l’intermédiaire de Bergotte — écrivain ironiste dont le génie consiste dans le « pouvoir réfléchissant » et l’énergie créatrice dans la « force ascensionnelle » —, de poser la question de l’actualisation de la régressivité ironique dans l’oeuvre littéraire.Regressivity, as the perpetual possibility of adding a further degree to an utterance is the very principle of irony, which is thus conceived not under a semiotic and axiological grid, but as a dynamics.Reflection starts from the ironic sign as the basic cell and as a two tiered hierarchical structure, according to the traditional conception. This duality is first analysed from a semantical point of view, within the tropological framework, then on the axiological, actancial and utterance theoretic levels. This leads us to the hypothesis that irony is a metadiscursive trope, bringing together use and mention . Within this framework, irony is a representation of representation, an auto-duplicative process which acts through critical and comical reflectivity, and which is liable to perpetuate itself indefinitely, since, being auto-applicative, a new degree can always be added to the previous one, without cancelling itself : the two tiered sign being only the minimal realisation of irony, whose second degree can itself be reflected through a third, and so on. The “reflective power” of irony thus produces its “ascending force”.This mechanism internal to the sign allows also, at the level of the work, to plug different kinds of ironies onto each other : the creative power of the regressive process allows us to envisage its role in the work of art, in the case at hand in Remembrance of Things Past, whose text multiplies the various layers of irony. Proust’s work, which is here the basis of all our analyses, allows Bergotte — the ironist writer whose genius consists in the “reflective power” and in the “ascending force” — to raise the question of the actualisation of the ironical regressivity of the literary work. This article was derived from my doctoral thesis, ‘Post-apartheid racism among Afrikaans speaking urban adolescents: A narrative-pastoral reflection’. The impetus for this study was the seemingly increasing occurrences of racism amongst post-apartheid Afrikaans-speaking urban adolescents in South Africa by taking a narrative practical theological perspective on the matter to help build meaningful cross-cultural dialogue. This study explored the level of dialogue of the participants using a postfoundational paradigm. Two questions guided the investigation: (1) How deeply embedded are objectifying of (...) cross-cultural relationships? (2) How can we instigate honest dialogue aiding us in being more aware of our biases to embrace diversity and going forward as a unity in diversity? This study was conducted in 2016 amongst white Afrikaans-speaking urban adolescents living in Pretoria-East, South Africa. I had four group conversations (A, B, C and D) with my co-researchers (research participants), with six to eight adolescents per group. I made use of certain empirical research methods, such as narrative interviewing and group discussions. From an epistemological perspective, a postfoundational, social constructionist perspective, including an auto-ethnographical approach, was followed. The research indicated that Afrikaner adolescents could live life unquestioned from a position of power and objectivity that was culturally inherited. It was found that by objectifying relationships ( I-It ), diverse engagement becomes almost impossible. Consequently, this article advocates for a dialogical ( I-Thou ) approach towards building relationships in a context where people feel vulnerable and shameful, have fears, but also gain trust to contribute to meaningful dialogue with ‘others’. This contribution focusses on some of the digital theological expressions of Stephan Joubert from an auto-ethnographic angle. Orientating from a practical theology perspective, I have chosen the social media platform Twitter, and more specifically the @stephanjoubert domain, as source to chart some significant tweet expressions for the purpose of describing the character and value of an aphoristic theology. In order to do so, I have used some randomly selected tweets of Stephan Joubert, spanning the period 2020–2021, which express aspects (...) of a relevant contemporary ecclesiology. Against the backdrop of the disastrous impact of the COVID-19 pandemic as well as some important dates on the Christian calendar, I specifically emphasise the significance of the formulation of an aphoristic theology using amongst other markers of simplicity, contextuality and relevance.Contribution: I conclude the reflection with some critical-evaluative remarks on the significance of aphoristic expressions for the development of a meaningful contemporary ecclesiology and theology.
