The Committee on Economic, Social and Cultural Rights (CESCR) has a new mechanism to receive individual complaints and issue views, which makes the question of how the Committee should interpret the broad articles of the International Covenant on Economic, Social and Cultural Rights more pressing than ever. Most commentators on the legitimacy of the CESCR’s interpretation have argued that interpreters should make better use of Articles 31–33 of the Vienna Convention on the Law of Treaties (VCLT) in order to improve (...) the legitimacy of their findings. In this article, we argue conversely that the individual communication mechanism should be evaluated and reformed in terms of legitimate authority. In the context of the Committee’s process of interpretation, we contend that proportionality is better suited than the various interpretive options of the VCLT to offer a consistent procedure that is able to generate legitimacy by attenuating the tension between personal and collective autonomy. This paper will explore the notion of ‘poetic enthusiasm’ in early 18th-century verse. The representation of poetic enthusiasm—the claim to false inspiration, and the fanaticism that was perceived to accompany it—was frequently politicized in this period. Through a conflation of religious and literary discourses, poetic enthusiasm was seen to represent the sae kind of anarchy in the realm of literature that the religious enthusiasm associated with Dissent did in the context of the established church. This paper will establish first of (...) all the way in which Tory and Royalist authors such as John Oldham, John Dryden, and Alexander pope used the established satirical caricature of the religious enthusiast to attack their Whig contemporaries. It will go on to suggest, however, that the relationship between politics and enthusiasm is more complex than this equation between Toryism and anti-enthusiasm suggests. While the Tory attack on literary enthusiasm was premised on an elision of political and literary codes, writers such as Dryden and Pope were also trying to separate out an exclusively poetic meaning for the term. Enthusiasm remained and unstable term because although writers recognized that its religious and political applications were different from its literary sense, they could not easily keep the two apart. Over the past seventy-five years, the UN secretary-general has come to occupy a highly visible position in world politics. While the UN Charter describes the post merely as the “chief administrative officer” of the organization, today it is widely recognized that the secretary-general also plays a central role in political matters. What makes the role of the UN secretary-general special? Where does the office's authority come from? As part of the special issue on “The United Nations at Seventy-Five: Looking (...) Back to Look Forward,” this essay looks back at the tenures of previous UN secretaries-general and applies ideas from sociological institutionalism to argue that the UN secretary-general holds the position of a “guardian” of the UN Charter. The UN secretary-general, more than anyone else within the UN system, represents the UN overall. From this flows great responsibilities and challenges, as the UN secretary-general is often expected to step in when other parts of the UN are unable or unwilling to act, and to take the blame when things go wrong. But this special position also endows the office with a substantial degree of authority, which future holders of the office can use to shape policies and mobilize support as the UN seeks to address urgent global challenges. Peter Frankental, Head of Business Networks, Amnesty International, explores the role of The UN Universal Declaration of Human Rights as a corporate code of conduct. Frankental observes a changing business context, which overall increases the risk to business of dealing with other parties, including countries, subcontractors, joint venture partners and their stockholders. The paper proceeds to examine the barriers to integration of human rights, and identifies dilemmas that firms need to resolve. While in the author’s view ethical behaviour does not (...) confer competitive advantages in the short run, companies that base their codes of conduct on the UN Universal Declaration of Human Rights are likely to find themselves in the stronger position to protect their reputation, brands and assets in the longer term. The present paper is about the author’s current research on children’s education in urban contexts. It departs from the rising offer of programmes for school children in out-of-school contexts (e.g. museums, libraries, science centres). It asks what makes these practices educational (and not just interesting, entertaining and/or audience building). Based on Biesta ( 2006a , 2010 ) theory of education, the author frames and analyses the educational characteristics of, and possibilities of articulating, in and out-of-school educational practices. This paper aims (...) at understanding if the occasional outing from primary school premises promotes interruptions in the humanist foundations of school. In order to analyse relations between different institutions and professionals (to be) engaged in educational activities and programmes, Nóvoa ( 2002 , 2009 ) essays will be brought to the discussion, namely his conception of the ‘Public Space of Education’—as a space where culture, education, arts, sports and leisure are shared responsibilities, and where diverse institutions are networked aiming towards societal pluralism. I argue for the possibility of using cities’ public spaces as contexts with a worldly quality to complexify children’s education. Nevertheless, I draw attention to the unbearable educational lightness that these practices may carry if they do not go beyond the praise of chance; as well as to their unsustainable weight if they perpetually repeat school’s normal orders and add up rational discourses. Resumen Ante el dilema de si la Lógica de Hegel debe entenderse como una ontología o como una continuación del proyecto kantiano de la lógica trascendental, el artículo sostiene que no es propiamente una ontología, ni un análisis de conceptos y categorías subjetivas. Su vocación metafísica se basa en el postulado según el cual la reflexión del pensamiento sobre sí mismo tiene consecuencias para la comprensión del ser de lo que no es pensamiento, de modo que resulta ser un proyecto (...) novedoso de ontología mediada por la autorreflexión del pensar.This text faces the dilemma whether Hegel’s Logic must be understood as ontology or as continuation of the Kantian project of transcendental logics. It upholds the thesis that Hegel’s Logic is not properly an Ontology -a direct and immediate description of object’s immanent way of being- nor an analysis of merely subjective concepts and categories. The metaphysical vocation of Hegel’s Logic draws rather on the claim that thought’s self-reflection has necessarily consequences for the comprehension of the being of all that is not thought. Hence, we are facing a groundbreaking project of an ontology that is mediated by thought’s self-reflection. (shrink)

The UN Convention on the Rights of Persons with Disabilities (CRPD) was passed in 2006 and came into force in 2008. It sets out a number of core values, including dignity, individual autonomy, non-discrimination, participation and community inclusion. Although the CRPD has been recognised as an important step forward by many disabled people and their supporters and provides the foundation for building a good life, the author argues that it does not necessarily equate with it. The underpinning Western values of (...) choice, independence and control are important, but leave out groups of marginalised people for whom these goals may not be achievable. They also present challenges and dilemmas for those involved in supporting/caring roles. In this paper, the author reflects on the implications of the CRPD for the lives of people with learning disabilities, in particular those with profound needs and explores whether it provides a genuinely coherent framework for an inclusive society. This book analyses the dynamic relationship between art and subjective consciousness, following a phenomenological, pragmatist and enactive approach. It brings out a new approach to the role of the body in art, not as a speculative object or symbolic material but as the living source of the imaginary. It contains theoretical contributions and case studies taken from various artistic practices (visual art, theatre, literature and music), Western and Eastern, the latter concerning China, India and Japan. These contributions allow us to (...) nourish the debate on embodied cognition and aesthetics, using theory-philosophy, art history, neuroscience-and the authors' personal experience as artists or spectators. According to the Husserlian method of "reduction" and pragmatist introspection, they postulate that listening to bodily sensations-cramps, heartbeats, impulsive movements, eye orientation-can unravel the thread of subconscious experience, both active and affective, that emerge in the encounter between a subject and an artwork, an encounter which, following John Dewey, we deem to be a case study for life in general. Ce livre analyse la relation dynamique entre l'art et la conscience subjective, selon une approche phénoménologique, pragmatiste et enactive. Il vise à faire émerger une nouvelle approche du rôle du corps dans l'art, non pas comme objet spéculatif ou matériau symbolique, mais comme source vivante de l'imaginaire. Les contributions théoriques et les études de cas sont prises à diverses pratiques artistiques (arts visuels, théâtre, littérature et musique), occidentales et orientales, ces dernières concernant la Chine, l'Inde et le Japon. This article explores the different moral and legal arguments used by protagonists in the debate about whether or not to conduct a humanitarian intervention in Darfur. The first section briefly outlines four moral and legal positions on whether there is (and should be) a right and/or duty of humanitarian intervention: communitarianism, restrictionist and counter-restrictionist legal positivism and liberal cosmopolitanism. The second section then provides an overview of the Security Council's debate about responding to Darfur's crisis, showing how its policy was (...) influenced by both normative concerns and hard-nosed political calculations. The article concludes by asking what Darfur's case reveals about the legitimacy and likelihood of humanitarian intervention in such catastrophes and the role of the UN Security Council as the primary authorising body for the use of international force. The authors argue that this case demonstrates that for the cosmopolitan/counter-restrictionist case to prevail pivotal states need to put humanitarian emergencies on the global agenda and express a willingness to act without Council authorisation, though the question of how to proceed in cases where the Council is deadlocked remains vexed. Resumen: El presente trabajo explora el estatuto del arte en la filosofía de Spinoza, en el marco de la inversión copernicana que da origen a la estética y del barroco holandés. Si bien el pensamiento spinozista se inscribe en la conversión antropológica, en donde lo bello resulta ser un efecto en el sujeto y no una cualidad de los objetos, su comprensión del arte es inasimilable a la “estética” como ámbito diferenciado y autónomo que se consolida en el siglo XVIII, (...) y más bien concibe el arte integrado a la vida y a la experiencia común -a la vez que, en cuanto praxis de origen corporal al alcance de cualquiera, presenta puntos de contacto con las vanguardias históricas del siglo XX-. Spinoza, según se propone en este texto, concibe la producción de “obras de arte” menos como un hecho estético que como una actividad corporal éticamente orientada a la vida buena.: The present work explores the status of art in the philosophy of Spinoza, within the framework of the Copernican revolution that gives rise to aesthetics and the Dutch Baroque. Although the Spinozist thought is inscribed in the anthropological conversion by virtue of which beauty turns out to be an effect on the subject and not a property of objects, its understanding of art is unassimilable to "aesthetics" as a differentiated and autonomous area that it was consolidated in the eighteenth century, and rather conceived art integrated to life and common experience -at the same time, as praxis of bodily origin within the reach of anyone, presents points of contact with the historical avant-gardes of the twentieth century-. Spinoza conceives the production of "artworks" less as an aesthetic fact than as a body activity ethically oriented to the good life. (shrink)

Jeffrey Tulis’s The Rhetorical Presidency should not be read as a tale of decline. It is not a call for an “un‐rhetorical” presidency so much as an exploration of the fundamentally uneasy place that popular rhetoric occupies in constitutional governments. Popular rhetoric is one way that executives exercise their prerogative power, and the dilemmas about rhetoric that Tulis exposes arise from a fundamental fact about prerogative power that all presidents must confront: Strong constitutional governments seem almost necessarily to grant their (...) chief executives more discretionary authority than is consistent with the idea of constitutional government. Whatever rhetorical style or strategy a president adopts, he must respond in one way or another to this fact. (shrink)

Hegel famously accuses Christianity of ‘unhappy consciousness’: it has a normative goal – union with the divine – that it cannot, in principle, satisfy. Kierkegaard was intimately aware of this criticism and, unlike some of Hegel’s other accusations, takes it seriously. In this paper my co-author and I investigate the way in which Kierkegaard addresses this issue in two texts published in 1843: Fear and Trembling and ‘The Expectancy of Faith’. We are especially interested in how the two texts describe (...) faith’s relationship to finitude: for instance, whether the person of faith is permitted to expect that God will bless her in particular and concrete ways. My co-author and I offer competing interpretations. I argue that there is a deep tension in the way faith is described in the two texts; my co-author argues that there is consonance. (shrink)

Historians have recently used the Internet to circulate political statements about law. This paper explores the statements they issued against President Clinton's impeachment and President Bush's inauguration. It pays special attention to impeachment, comparing the position taken by historians with that taken by the law professors. While concluding that such statements can be useful, the author advises historians lacking the expertise to evaluate the positions taken in a statement to proceed carefully in signing it. She suggests that historians sign only (...) such documents whose scholarship they have made a preliminary assessment that they could individually defend publicly. She also urges historians to craft statements that give the public a sense of the methods they use in interpreting the past. (shrink)

ABSTRACT: What explains first-person authority? What explains the presumption that an utterance is true when it is a sincere intelligible determinate first-person singular simple present-tense ascription of intentional state? According to Rockney Jacobsen, self-ascriptions each enjoy a presumption of truth because they are systematically reliable. They are systematically reliable because they are typically both truth-assessable and expressive. Such self-ascriptions, if sincere, are certain to be true. This article presents a defence and a critique of Jacobsen's theory. It is argued (...) that the purported prevalence of expressive self-ascriptions is at best contingent. This contingency cannot explain why self-ascriptions are necessarily authoritative.RÉSUMÉ: Comment expliquer l'autorité de la première personne? Comment expliquer la présomption qu'un énoncé est vrai lorsque c'est une attribution d'un état intentionnel, sincère et intelligible, à la première personne du singulier de l'indicatif présent. Selon Rockney Jacobsen, les auto-attributions jouissent d'une présomption de vérité parce qu'elles sont systématiquement fiables. Elles sont systématiquement fiables parce qu'elles ont pour caractéristique d'être à la fois expressives et évaluables en termes de vérité. Si de telles auto-attributions sont sincères, elles sont certainement vraies. Cet article présente une défense et une critique de la théorie deJacobsen. The idea that states and the international community have a responsibility to protect populations at risk has framed internationalist debates about conflict prevention, humanitarian aid, peacekeeping and territorial administration since 2001. This book situates the responsibility to protect concept in a broad historical and jurisprudential context, demonstrating that the appeal to protection as the basis for de facto authority has emerged at times of civil war or revolution - the Protestant revolutions of early modern Europe, the bourgeois and communist (...) revolutions of the following centuries and the revolution that is decolonisation. This analysis, from Hobbes to the UN, of the resulting attempts to ground authority on the capacity to guarantee security and protection is essential reading for all those seeking to understand, engage with, limit or critique the expansive practices of international executive action authorised by the responsibility to protect concept. Jason Stanley’s How Propaganda Works characterises and explores one democratically problematic kind of propaganda, ‘undermining propaganda’, which involves ‘[a] contribution to public discourse that is presented as an embodiment of certain ideals, yet is of a kind that tends to erode those very ideals’. Stanley’s model for how undermining propaganda functions is Rae Langton and Caroline West’s treatment of moves in pornographic language games. However, Stanley doesn’t consider whether his theory of propaganda might in turn illuminate the harmful nature of (...) pornography, in light of the familiar contention that some pornography acts as a kind of misogynistic propaganda. Drawing on Catharine MacKinnon’s writings on pornography, this paper will explore one way of developing the claim that pornography sometimes functions as undermining propaganda, in something close to Stanley’s sense. Moreover, I will suggest that the discussion points to a new response to the so-called authority problem for Rae Langton’s silencing argument against the protected status of pornography.El libro de Jason Stanley How Propaganda Works caracteriza y explora un tipo de propaganda democráticamente problemático, la ‘propaganda debilitadora’, que envuelve ‘[una] contribución al discurso público que se presenta como si incorporase determinados ideales, pero que es de un tipo que tiende a erosionar esos mismos ideales’. El modelo de Stanley para el funcionamiento de la propaganda debilitadora es el del tratamiento de los movimientos en los juegos de lenguaje pornográficos debido a Rae Langton y Caroline West. Sin embargo, Stanley no reflexiona acerca de si su teoría sobre la propaganda podría, a su vez, iluminar la dañina naturaleza de la pornografía, a la luz de la conocida tesis de que hay pornografía que actúa como una forma de propaganda misógina. A partir de los trabajos de Catharine MacKinnon sobre pornografía, este artículo pretende explorar una forma de desarrollar la tesis de que la pornografía funciona en ocasiones como propaganda debilitadora, en un sentido próximo al de Stanley. This paper examines the institutional mechanisms supporting the ethical oversight of human participant research conducted by the United Nations (UN). The UN has served an instrumental role in shaping international standards on research ethics, which invariably require ethical oversight of all research studies with human participants. The authors’ experiences of conducting research collaboratively with UN agencies, in contrast, have led to concern that the UN frequently sponsors, or participates in, studies with human participants that have not received appropriate ethical oversight. It is argued that the institutional mechanisms in place to prevent research with human participants from being undertaken by the UN without ethical oversight do not, at present, extend substantively beyond the provision of guidelines and online training offered by a minority of UN bodies. The WHO and UNICEF are identified as notable exceptions, having implemented various measures to prevent health research with human participants from being undertaken without ethical oversight. Yet, it is highlighted that the WHO and UNICEF are not the only UN bodies that undertake health research with human participants and there are countless actors under the umbrella of the UN system that are regularly involved in non-health research with human participants. Arguments for the pursuit of the highest standard of ethical oversight by UN bodies are presented. Moving forward, the paper asks the question: is it time for the UN to set the standards for the oversight of ethical oversight? (shrink)

Second, the article refreshes semiotics methodology in very original way, by engaging the applied semiotics for furtive and instantaneous activities analysis. Third, the article is pretty clear and well structured, written in very comprehensible French. The theoretical frame it opens is thorough and far reaching. Fourth, the semiotic theory of movement comes in a very special moment when the whole world is football, but it covers also many other areas of applicability which reflect major trends such as the general gamification of life thanks to new media and digital technologies. It is crucial for semiotic theory to open its theoretic scope towards significant cultural trends and become more attractive for young researchers." Deuxièmement, l'article renouvelle la sémiotique appliquée de manière très originale, l'engageant dans une approche efficace des actions instantanées et furtives; la méthodologie sémiotique en général en tire donc aussi profit. Troisième point, en plus d'être profond, avec un cadre théorique d'ampleur et de grande portée, l'article est particulièrement bien structuré et écrit dans un français très compréhensible, ce qui est un véritable gain pour sa diffusion. Enfin, quatrièmement, s'il est indéniable que le texte pourrait bénéficier d'une visibilité complémentaire due à la ferveur liée au contexte récent de la coupe du monde de football au Qatar, il couvre surtout de nombreux autres domaines d'applicabilité qui reflètent des tendances majeures telles que la gamification générale de la vie, portée par les nouveaux médias et les technologies numériques. L'on y voit une belle opportunité pour la théorie sémiotique d'ouvrir son champ à la faveur de tendances culturelles significatives; ceci est une garantie pour continuer à attirer de nouvelles générations de chercheurs. Este artículo se propone estudiar la representación de la imagen del negro soldado en La revolución es un sueño eterno de Andrés Rivera. En efecto, frente a la negación por la historia del aporte épico de los afrodescendientes en las luchas por la emancipación, Andrés Rivera rescata la figura del afrosoldado argentino que se ha destacado heroicamente en los frentes bélicos para la defensa de la patria. Así, este trabajo analiza esta visión revolucionaria de la negritud argentina en Andrés Rivera. (...) Tras estudio, las dos primeras partes han demostrado que los soldados afroargentinos han tenido una participación heroica tanto en las Invasiones Inglesas como en las campañas de Liberación de San Martín, por lo que Andrés Rivera propone una representación sin estereotipias de la imagen del negro, a través de los campos de batalla, con igual valentía y dignidad que bancos e indios, frente a una literatura acostumbrada a representar al negro en la subalternidad. Las dos últimas partes han revelado la imagen dignificante de la negritud argentina, a través del personaje de Segundo Reyes, un esclavo devenido capitán de ejército, y su relación de amistad y de armas con Juan José Castelli, el orador de la Revolución y Representante de la Primera Junta en el ejército del Alto Perú. Así, el trabajo ha mostrado, de manera general, que la imagen del negro ha sido honrada por Rivera mediante las armas, la sociabilidad y la relación de hermandad con el “amo” blanco. The negation of the Afro-descendant contribution has been one of the constants in the history of Argentina. The symbolic participation of slaves in the struggles of the country has been often ignored by white and Europeanist history which represents the black as a secondary subject, a representation in the subalternity which also characterized the literature. But with the rise of the historical novel at the end of the 20th century, a new vision of the role and the image of the Afro-descendant was born, where the latter acquired a fundamental place in the country. This is what Andres Rivera proposes in his novel entitled La revolución es un sueño eterno, that we have in this work through parts: a reminder of the participation of black slaves in the struggles for emancipation, the approach from the trenches, the character of the black captain Segundo Reyes and the relationship between negritude and aristocracy. The first part traces the heroic participation of blacks in various battles of the country: English invasions, the, my revolution, the liberation war under San Martin, and the border struggles. The second part highlights the representation of “afroslodier”. With this approach, Andres Rivera speaks of the blacks not as a Community formed of slaves and free who, with regard to the whites and the Indians, stood heroically in all the struggles for the liberation of Argentina. To consolidate this approach without stereotype, the author uses an afro-argentine soldier character, a fisherman’s slave who becomes a captain of the army. The third part of the work analyses this revolutionary approach missing in literary history. And to highlight the loyalty and bravery of black soldiers alongside white figures, the author used, like Artigas and Ansina, duo Segundo Reyes, black captain, and Juan José Castelli, representative of the Government in the army of Alto Peru. The infallible friendship between the two during and after the wars which we analyzed in the last part shows how negritude and aristocracy are united by a perfect symbiosis made of fraternity and equal dignity. The article comments upon the report written by the French captain Aubert about the Romanian space during the XIXth century. It analyses the richness of documentation data contained by the report, through the lenses of the historical anthropological categories of “the other’s image”. The author concludes that the report was elaborated in a period when French interests for the Romanian space was rising.

RESUMEN Se desarrolló una investigación descriptiva transversal, con un enfoque cuantitativo, en la que la muestra fue seleccionada de manera intencional pura, no probabilística, según criterios establecidos por los autores del estudio. Quedó constituida por las variables del Sistema Comprehensivo Rorschach pertenecientes a 120 protocolos de sujetos con trastornos depresivos, de ellos 82 presentaron depresión moderada, y 38 depresión severa. Se aplicaron los siguientes métodos empíricos: entrevista, observación, Autoescala de Zung y Conde, y el Psicodiagnóstico de Rorschach. Los estadígrafos que (...) se utilizaron fueron el Test de Kolmogorov- Smirnov, el Test de Comparación de Proporciones y la prueba de Mann-Whitney. Como principales resultados se obtuvo que las variables del Sistema Comprehensivo Rorschach, que establecieron diferencias estadísticas altamente significativas entre los grupos de sujetos fueron: Lambda alta, Proporción afectiva baja, total de respuestas, las respuestas globales, Suma Ponderada de respuestas con el determinante color cromático y la Experiencia accesible. ABSTRACT A transverse descriptive investigation was developed, with a quantitative approach, in that the sample was selected in a pure intentional way, not probabilistic, according to criteria established by the authors of the study. It was constituted for the variables of the Rorschach Comprehensive System belonging to 120 protocols of individuals with depressive disorders, of them 82 presented moderate depression, and 38 severe depression. The following empirical methods were applied: interview, observation, Auto-scale of Zung and Conde, and Psycho-diagnosis of Rorschach. The statisticians used were the Test of Kolmogorov - Smirnov, the Test of Comparison of Proportions and the Mann-Whitney test. As main results, it was obtained that the variables of the Rorschach Comprehensive System, which established highly significant statistical differences between the groups of individuals were: tall Lambda, low affective proportion, whole of answers, the global answers, exaggerated sum of answers with the determinant chromatic color and the accessible experience. RESUMEN El mundo moderno creó un régimen temporal de horarios, presiones, exigencias de efectividad, rendimientos, etc., que somete a los individuos a procesos de alienación, pero esa lógica temporal no ha sido suficientemente politizada ni se ha llegado a ver qué pasa con nuestra experiencia de tiempo. La lógica temporal de la modernidad parece natural. El propósito de este artículo es volver sobre la realidad del tiempo. Aquí nos apoyamos en un primer momento en el proyecto crítico de Hartmut Rosa (...) y lo conectamos con una consideración del tiempo que debemos buscar en otros autores, presuntamente ajenos a la teoría crítica, a saber, Heidegger y Gadamer. ABSTRACT The modern world created a temporal regime of schedules, pressures, demands of efficiency, performances, etc., that submits individuals to processes of alienation, but that temporal logic has not been politicized neither has it been seen what happens with our experience of the time. The logic of time in modernity seems natural. The purpose of this article is to return to the reality of the time. Here we support in a first moment in the critical project of Hartmut Rosa and we connect it with a consideration of the time that we must look for in other authors, supposedly foreign to the critical theory, namely Heidegger and Gadamer. The question is: How is a global peace order possible in the shape of an international legal system? The article focuses on the problems of international law within the present system of the UN and tries to actualise the Kantian concept of perpetual peace (1795), with regard to positions of international lawyers. A peaceful international order must have the means to protect against unlawful violence, even by armed forces, e.g. to intervene against gross violations of fundamental human rights. The main characteristic of the French local tax system undoubtedly resides in a convoluted structure which impedes any progress in the development of tax competition between local authorities. On the contrary, recent legislative evolutions make obvious a trend of recentralization of the French local finance system illustrated by the fact the State is presently the first tax contributor to the local authorities’ budgets. As a result, it becomes blatant that any new competence transfer to the local authorities without setting up (...) an explicit financing scheme for these transfers will put an end to the local authorities’ autonomy.L’ensemble du système fiscal local français est caractérisé par une structure complexe peu propice au développement de la concurrence fiscale entre collectivités locales. Bien au contraire, les évolutions récentes témoignent d’un phénomène de recentralisation des finances locales françaises par lequel l’Etat devient le premier contributeur à la fiscalité des collectivités locales. Au total, il semble évident que tout accroissement de transfert de compétences non accompagné d’une remise à plat du système fiscal local français ne peut conduire à terme qu’à la fin de l’autonomie des collectivités locales. Following the design of the author, reforms of the UN would consist of four rules. The first rule: Payments from the global community should correspond with the services provided by the UN. - For this purpose it is necessary to develop a system of compensation in which payment would be made only for the completion of a concrete service. Such a system would in effect serve as a continuous audit and guarantor of quality service at all times visible to the (...) entire public. The second rule: Servantura not dictatorship - The author has created a word "servantura" and has given it the following meaning: the performance of administrative service, guided by (1) ethical conduct, (2) democratic norms, (3) the newest scientific knowledge, (5) safe technology, (6) justice, (7) equality of people and (8) the priority of human life. On an idea of the author, servantura is a global managerial philosophy with a system of global service in which each decision should be in accordance with the wishes and the will of the entire global community, not of a separate group of nations, or a single nation, or person. The third rule: Noncommercial services. Commercialization of the UN should be considered a crime. Further commercial use of the UN should be stopped, as it will lead to aglobal catastrophe. The fourth rule: Without enemies or competitors, Full transparency and a strict prohibition of secrecy and privacy in the UN must be established. i.e. openness, publicity and a strict international prohibition on any secret structures or secret activities within the UN. RESUMEN La investigación científica constituye uno de los principios en los cuales se respalda la formación integral de los estudiantes de las ciencias médicas, por lo que los autores del presente texto se propusieron como objetivo exponer elementos de un plan de acciones establecido para reforzar los valores en los estudiantes de ciencias médicas centrado en la investigación científica utilizando un estudio de correlación en la facultad de Medicina de la Universidad de Ciencias Médicas, de Santiago de Cuba en el (...) periodo de septiembre 2016 a abril 2017. Los principales resultaron arrojaron que el 100 % de los estudiantes reforzaron valores como humanismo, responsabilidad y sinceridad principalmente, a partir del cumplimiento de las tareas asignadas durante las investigaciones que realizaron a diferentes instancias, por lo que se concluye que este accionar podría constituir un eje integrador en el proceso de formación profesional. ABSTRACT Scientific research is one of the main principles which supports students’ all-round medical sciences training, therefore, the authors of this paper aim to present elements of an action plan which is established to strengthen values in medical sciences students through scientific research by means of a correlation study in the Faculty of Medicine of the University of Medical Sciences in Santiago de Cuba from September 2016 to April 2017. The main results showed that 100 % of students strengthened values such as humanism, responsibility and honesty from the carrying out of allocated tasks during researches done in different institutions. This article is the first attempt to justify the "next" milestone in the development of legal realism: hyperrealism. The implications of digitalization have become the new fuel for the legal realist's jurisprudence prediction theory, that is, empirical research to predict the judge's or the court's decision. Indeed, that was impossible for American realists in the early twentieth century, and all the attempts failed. Therefore, tools such as Judicial Analytics allow us to prove that personal motives and prejudices affect a dispute's (...) resolution. Based on a systemic, comparative, and interdisciplinary analysis that intermingles legal theory, data analytics and digital technologies, the article substantiates the concept of hyperrealism itself. It evaluates the advantages and disadvantages of its primary tool—judicial analytics. The authors state the necessity of creating regulatory mechanisms of "curbing" to use them to improve justice and minimize the risk of rights violations. They propose using tools of expert evaluation, standardization, and ethical regulation of forensic analysis. (shrink)

L’herméneutique coranique de Fazlur Rahman (1919-1988) repose sur la recherche méthodique du sens objectif du texte. Inspiré par l’herméneutique romantique, telle qu’on peut la trouver chez E. Betti et qui nécessite pour le lecteur d’établir un lien intérieur avec l’esprit de l’auteur, Rahman considère que c’est l’intention divine qui est garante de l’objectivité du sens du Coran. L’empathie avec l’auteur est rendue possible par une conception historique de la révélation, selon laquelle la parole, qui est amenée par un Esprit intérieur (...) et immatériel, passe par le filtre de la conscience prophétique. La méthode historiciste d’interprétation de Rahman, qu’il appelle herméneutique du « double mouvement », repose sur les deux critères d’objectivité que sont le contexte historique de la révélation et la prise en compte de la totalité du livre sacré. Ainsi, l’interprète doit, dans un premier temps, aller à la période de révélation pour, à partir des circonstances particulières, comprendre les finalités objectives du texte, identifiées à l’intention divine. Puis, il doit appliquer ces principes, qui sont moraux et non juridiques, au présent en s’éloignant du sens littéral. Rahman illustre son propos en essayant de montrer que le souci de l’intention divine permet de voir que le Coran s’oppose à la polygamie et à l’esclavage, qui vont contre le principe moral d’une société juste et égalitaire. The author analyzes the concept of permanent establishment, provided for in Article 5 of the Organization for Economic Co-operation and Development Model Convention with respect to taxes on income and on capital. The main goal of the article is to discuss the institute of permanent establishment and to help understand it better. The (...) author does not seek to provide a thorough analysis of the content of Article 5, but rather, to concentrate on its main aspects. Even though the study of permanent establishment, provided in this article, related only to the context of the Convention, it can also be useful while analysing the concept of permanent establishment under the US Model Income Tax Convention and the 2001 UN Model Convention. Resumen Este artículo da cuenta de la forma en que el liberalismo del filósofo chileno Jenaro Abasolo (1833-1884), al conceder un rol activo al Estado en la “habilitación de la masa desheredada”, responde al adjetivo “social”. En Abasolo, el deber de asegurar en lo posible la prosperidad de las personas, se sostiene en el derecho natural y en una teología de la historia pan[en]teísta afín al krausismo. Abasolo piensa que la redención del desheredado en naciones aun juveniles debe apoyarse en (...) una forma de Estado “casi socialista”. Esto implica una acción de centralización y de tutela del pueblo que enfrenta a los autores del artículo a la gran dificultad de determinar cómo el autor chileno realiza la transición de una habilitación consumada a través de un buen grado de despotismo, hacia la libertad. Es decir, resulta controversial establecer la factibilidad de la realización de esta vía cuasi socialista a un liberalismo contrafácticamente orientado por el laissez faire. Abstract This article shows how the liberalism of the Chilean philosopher Jenaro Abasolo (1833-1884), by granting an active role to the State in the “empowerment of the disinherited mass”, responds to the adjective “social”. In Abasolo, the duty to ensure as far as possible the prosperity of the people is based on natural law and on a pan[en]theistic theology of history akin to Krausism. Abasolo thinks that the redemption of the disinherited in even juvenile nations must be supported by an “almost socialist” form of state. This implies an action of centralization and guardianship of the people that confronts the authors of the article with the great difficulty of determining how the Chilean author makes the transition from an empowerment consummated through a good degree of despotism, towards freedom. That is to say, it is controversial to establish the feasibility of the realization of this quasi-socialist path to a liberalism counterfactually oriented by laissez faire. (shrink)

Thanks to a methodological approach based on grounded theory, it is possible to establish that within the cultural aspects with greater presence highlights the conformation of Chilean linguistic identity, which is evidenced through the social assessment offered by the author of the national standard and, in addition, the opposition established between it and the peninsular norm. In the final years of his life, the Belgian phenomenologist Marc Richir started to question if philosophical writing would become pointless when artists, great poets for example, have already achieved so well what philosophers have always aspired to achieve. There is no doubt that Richir considers himself in alliance with artists, since he basically believes that “phenomenology is trying to say the same thing as poets or musicians, or even possibly painters, but with philosophical language”. He seems thereby to imply (...) that phenomenology is destined to become self-aware as a sort of art. There is no surprise in this regard if we notice how frequently, throughout his entire career of philosophical production, he employs the Kantian term of the sublime to express what constitutes the phenomenon as nothing but phenomenon. This article goes through his phenomenological interpretation of Kantian aesthetics, his elaboration of the affinity between phenomenology and art, and then his genealogical conception of art, in order to introduce an original thought on what he calls “the moment of the sublime”. RESUMEN La importancia de Rousseau para el surgimiento del idealismo poskantiano ha sido poco investigada. Oculta en gran medida por la recepción kantiana, la obra del pensador ginebrino parece tener tan solo una importancia accesoria. A partir del análisis interpretativo de las fuentes y su comparación con las principales doctrinas de Rousseau, nuestro trabajo busca mostrar, valiéndonos de las obras de Hölderlin y Hegel de la época de Tubinga y de los años inmediatamente posteriores (1791-1795), que la influencia del pensador (...) ginebrino posee una importancia decisiva para concebir el programa artístico y religioso de los autores estudiados. El análisis nos permitirá comprender que el mencionado autor no representa la figura de un filósofo, menos la de un ilustrado, sino más bien la de un sabio, el portador de una doctrina práctica cuyo principio fundamental se encuentra en la suprema dignidad del hombre y en la idea de libertad entendida como autonomía. ABSTRACT Rousseau's importance for the postkantian idealism has been poorly researched. Hidden by the Kantian interpretation, the work of the Geneva thinker seems to have no relevant influence. Departing from an interpretative analysis of the literary sources and a comparison with the main doctrines, our paper aims to show, using Hölderlin and Hegel's Tubingen and the immediately subsequent works (1791-1795), that Rousseau's influence has a decisive importance to understand the artistic and religious program of our authors. This analysis will allow us to understand that Rousseau is not a philosopher, nor an enlightenment figure, but rather a wise man, the bringer of a practical doctrine whose main principle consisted in supreme human dignity and the idea of freedom interpreted as autonomy. The character of the protagonist, the form and implications of Don Juan's salvation, the strategies and temporality of seduction, (...) even the play's generic status--all come under the law of self-cancellation. And so does the historical time in which the play is set: the time of absolute monarchy. The proportionality between terrestrial and eschatological time, organic to the play's Golden Age precursor, 1 is strangely neutralized in Zorrilla's work through an expanding temporality without equivalent in the afterlife; and the same is true of the king's dramatic role through his removal from the scene, which he regulates nonetheless as deus ex machina of the social edifice.A nineteenth-century reader, Francesc Pi i Margall, remarked that "Zorrilla hace a Don Juan escéptico o creyente según lo van exigiendo las peripecias de su drama, y merced a esa indeterminación del carácter, le pone repetidamente en contradicción consigo mismo" (Zorrilla makes Don Juan a skeptic or a believer depending on the drama's events, and by virtue of this indeterminacy, he brings his character repeatedly into contradiction with himself) [204]. This exploratory study investigates firms’ implementation of a new corporate governance code in Mauritius, a developing economy. The authors rely on annual report disclosures during a four-year period. The authors analyze the level of corporate engagement with the code’s requirements, including corporate social responsibility initiatives, relative to a 2004 benchmark over the three subsequent years. The study contributes to the literature in two ways. First, it provides much needed evidence of longitudinal implementation within developing economies that exhibit, or have started (...) to exhibit, a combination of ownership and control features found in more advanced economies and characterized in the literature as an “emerging governance” model. Second, the authors develop a more comprehensive assessment of implementation using a scoring system that combines trichotomous weighting of each governance component and trichotomous rating of implementation of each component. The authors argue that this system is superior to the un-weighted, dichotomous approach typically used in the literature. The analysis of weighted assessment scores for reveals a significant implementation of the code initially after 2004; but implementation began to level off by 2007 well below maximum assignable scores. Detailed requirements regarding directors’ appraisal and training, remuneration policies and remuneration information appear to be ignored by companies through 2007. A correlation analysis of the corporate governance scores and firm-based measures shows that the association between these different variables fluctuates significantly over the implementation window. El Ministerio de Salud Pública cubano ha otorgado especial importancia al tema relacionado con el desempeño profesional evaluativo de la información estadística en los profesionales de la salud, pero una revisión bibliográfica permitió constatar el insuficiente debate pedagógico encaminado a diagnosticar su estado actual para proponer alternativas que permitan su formación y desarrollo en los estudiantes. Este artículo tiene como objetivo caracterizar el desempeño profesional evaluativo de la información estadística en estudiantes de Medicina. Los resultados obtenidos con la aplicación de (...) métodos y técnicas de investigación, tales como encuestas, test de conocimientos permitieron confirmar que ese desempeño actualmente se expresa a un nivel insatisfactorio de actuación. Se concluyó buscar formas más efectivas para su logro en estudiantes de Medicina. The Cuban Ministry of Public Health has given special importance to the subject of professional assessment of statistical information in the area of public health; however, a bibliographic review allowed authors to prove pedagogical debate unsatisfactory. The review was aimed at diagnosing its current state and therefore provide alternatives that allow its formation and development in medical students. The objective of the article is to characterize the assessable professional performance of statistical information in medical students. The results achieved through the application of research methods and techniques such as surveys and knowledge tests enabled to confirm that, nowadays, professional performance is below satisfactory performance levels. As a result, newer and more effective ways of achieving it in medical students will be searched for. (shrink)

RésuméSamuel Ibn Tibbon est connu surtout comme le traducteur du Guide des Égarés de Maïmonide et comme l'auteur de l’œuvre cosmogonique audacieuse d'inspiration avicennienne Ma'amar Yiqqawu ha-mayim. Le fait que Samuel Ibn Tibbon soit également l'auteur de la traduction d'arabe en hébreu du Tegni de Galien avec le commentaire d'Ibn Riḍwān, connu sous le titre d’al-Ṣināʿa al-ṣaġīra, est attesté par les colophons de deux manuscrits, mais a récemment été nié. La question n'est pas sans importance, car, si Ibn Tibbon est (...) bien l'auteur de cette traduction, alors, comme l'avait observé Steinschneider, le commentaire de ʿAlī Ibn Riḍwān est la première traduction d'arabe en hébreu d'une œuvre d'un auteur musulman. Dans cet article je réfute les arguments contre l'attribution de la traduction à Ibn Tibbon, et, au contraire, je montre positivement qu'un examen systématique des données confirme qu'il en est bien l'auteur. Je procède notamment par un examen de l’évolution du vocabulaire philosophique d'Ibn Tibbon, espérant que ses résultats seront utiles au-delà de l'objectif immédiat qui l'a déclenché. Today, two forces combine to produce a systematic transformation in all that is given. First, the economic force of the global market is propelled by a series of techno-scientific advances that continually reinvent that market. Second, the political force of modern democracies, in spite of their different actualizations, centers individual autonomy as the ultimate norm that would create each individual’s future. The human body, in virtue of its intrinsic plasticity and because it is always the body of a particular individual, (...) lends itself to this process of unlimited transformation in a privileged way. As such, the human body is the promise of enhancement without end. The following questions thus arise: Does the human body possess normative aspects that would bound or enclose its future transformations when considered from the modern frame of the autonomous individual? Could Merleau-Ponty’s notion of le corps propre point us in the direction of an answer? Is there a bodily given that authorizes self-experience, apart from any external or theological frame? Or, is the bodily given only a myth that obscures the human body’s actual capacity for unlimited transformation?Aujourd’hui, deux forces se combinent pour produire une transformation systématique sur tout ce qui est donné. Premièrement, la force économique du marché mondial est mue par une série de progrès techno-scientifiques qui le réinvente continuellement. Deuxièmement, la force politique des démocraties modernes, en dépit de leurs différentes actualisations, centre l’autonomie individuelle en tant que norme ultime qui pourrait créer le futur de chaque individu. Le corps humain, en vertu de sa plasticité intrinsèque et parce qu’il est toujours le corps d’un individu particulier, se prête lui-même à ce processus de transformation illimitée d’une manière privilégiée. Ainsi, le corps humain est la promesse d’une amélioration sans fin. Émergent alors les questions suivantes : le corps humain possède-t-il des aspects normatifs qui lieraient ou enfermeraient ses transformations futures lorsqu’il est considéré à partir du cadre moderne de l’autonomie individuelle? La notion merleau-pontienne de corps propre peut-elle nous donner une réponse? Y a-t-il un corporellement donné qui autorise une expérience de soi, en dehors de tout cadre extérieur ou théologique? Ou bien, le corporellement donné n’est-il qu’un mythe qui obscurcit la capacité actuelle de transformation illimitée du corps humain?Oggi, due forze contribuiscono a produrre una trasformazione sistematica di tutto ciò che è dato. In primo luogo, la forza economica del mercato globale, alimentata da una serie di progressi tecnologici che continuano a reinventare il mercato. In secondo luogo, la forza politica delle moderne democrazie, che, nonostante le loro differenti attualizzazioni, indicano l’autonomia individuale come norma ultima, in grado di garantire il futuro del singolo. Il corpo umano, in virtù della sua plasticità intrinseca e dal momento in cui esso è sempre il corpo di uno specifico individuo, si presta in modo privilegiato a questo processo di continua trasformazione. In quanto tale, il corpo umano è la promessa di un potenziamento illimitato. Il chè suscita le seguenti domande: vi sono degli aspetti normativi che verrebbero a limitare o vincolare le future trasformazioni del corpo umano, considerato nella prospettiva moderna dell’individuo autonomo? Fundamento: La investigación científica y la divulgación de los resultados obtenidos es uno de los puntales del desarrollo científico del país. Objetivo: Considerar la productividad científica de los especialistas de Higiene y Epidemiología de su Centro Provincial en Camagüey, a partir del número de publicaciones en los últimos cinco años. Método: Se diseñó un estudio transversal desde abril de 2008 hasta abril de 2013, a través de un cuestionario estructurado, de carácter anónimo y con el consentimiento informado de los mismos, (...) donde se recogieron las variables tiempo de graduado, publicaciones en los últimos cinco años, categoría docente e investigativa, conocimientos de técnicas estadísticas, motivación, participación en eventos científicos, dificultades para publicar y dominio del idioma inglés para consultar las bases de datos EBSCO y PUBMED. Resultados: Se mostró una escasa productividad científica independientemente del tiempo de graduado; el número de categorías investigativas por especialista es muy pobre y si bien la mayoría de los mismos reconoce que la especialidad le confiere los conocimientos y motivación necesarias durante su formación, al final expresan tener dificultades para publicar y en el manejo del idioma inglés para estos fines. Conclusiones: La formación del especialista de Higiene y Epidemiología no da salida, al menos de la manera deseada, a uno de sus perfiles básicos como es la investigación. Basis: Scientific research and promotion of the obtained results is one of the objectives of the scientific development of the country, mainly when a specialty is involved, in which this task is included in different versions of the study plans. Objectives: to consider starting from the number of publications in the last five years, the scientific productivity of the specialists of Hygiene and Epidemiology of the Provincial Center of Hygiene, Epidemiology and Microbiology of Camagüey. Method: To carry out this task a cross sectional study was designed by authors through a small, anonymous structured questionary and with the informed consent of all of them, in which the following variables were analyzed: graduation date, publications in the last five years, teaching or scientific category, knowledge of statistical techniques, motivation, participation in scientific events, difficulties for publishing and knowledge of the English language to consult de databases EBSCO and PUBMED. Results: Poor scientific performance is observed, apart from graduation experience, the number of scientific categories by specialists is very low and even though most of them accept that the specialty promotes knowledge and necessary motivations during their postgraduate studies, finally they confirm there are difficulties for publishing and to manage English language for this purpose. Conclusions: The teaching curriculum of Hygiene and Epidemiology specialist does not promote research, one of its basic fields. (shrink)

In Chinese Gleams of Sufī Light, Sachiko Murata has stepped forward to bring a wider awareness to the interactions between Chinese Islam and native Chinese philosophic traditions. It includes a translation of The Great Learning of the Pure and Real, by Wang Tai-yü (ca. 1590-ca. 1658) and facing-page versions of William Chittick's English translation of the fifteenth-century Gleams (Lawā'iḥ) by 'Abd al-Rahman Jāmī and Murata's English translation of Liu Chih's (ca. 1662-ca. 1730) Chinese version of the same work. (Here, incidentally, I follow the book in using the Wade-Giles system.) One can see, comparing the translations, howLiu recast Jāmī's work in Chinese philosophic language, paraphrased some difficult passages, summarized others, and added his own commentaries.Interestingly, Liu eliminated Jāmī's Persian poetry. Murata thinks this is because Liu wanted to focus on the hard ideas; I suspect that it was because Liu realized that Persian prosody and imagery were too far from Chinese poetry to please his audience.Both Wang and Liu belonged to what must have been a rather loose but some-how connected circle of Chinese Islamic scholars. Both, also, almost necessarily used language fairly widespread in Chinese philosophy. Terms such as "emptiness" and "transformation" had many Chinese resonances, some most un-Islamic (Neo Confucian and Buddhist, for instance).Neither Chittick nor Murata give any glosses for key philosophical terms in either source language. Their philosophical and religious provenance, Chinese or Muslim, is correspondingly unclear.What is clear is that Neo-Confucianism had a strong influence on these scholars. Haqiqa "reality" is often translated as li "principle." Pen-jan "root nature" is used for the Arabic compound "essence and attributes." These examples are discussed in the introduction (p. 19). "Annihilation" becomes "conquering" (pp. 148-149). This is strange, because "Annihilation" (fana') is a technical term in Sufism for the disappearance of the self in God; it is an Arabic term, and literally means something like. "passing away." It signifies the forgetting or loss of self, such that only contemplation of the Divine remains. It is as close to the Divine as humans can get since, in Islam, humans cannot be absorbed into Allah (as, in Buddhism, they can be absorbed into Nirvāṇa or the Buddha-nature). "Conquering" seems a rather strange way to express this in Chinese. Perhaps Chinese Muslim readers of the time had developed this specialized sense for it.There are, of course, debatable translations here to contend with (both from Persian and Arabic to Chinese and from Persian and Chinese into English), but it appears that real incommensurability is involved. RESUMEN El presente trabajo describe los cambios estratégicos del Centro de Inmunología y Productos Biológicos de la Universidad de Ciencias Médicas de Camagüey que contribuyen a la formación profesional, la investigación y los servicios científico técnicos. Recoge los resultados obtenidos desde el 2015 hasta el 2017. Los referentes teóricos permiten un acercamiento epistémico que facilita la relación con el conocimiento y la creación de concepciones para abordar los problemas de salud. El centro tiene cuatro proyectos asociados a programas y 11 (...) institucionales. Se posee 2,7 publicaciones por autor y 18 participaciones en eventos, de ellos, ocho internacionales. Se perfecciona un sistema de gestión de la calidad, nueve servicios científico-técnicos, diversos servicios a la docencia y proyectos de investigaciones. Se aprovecha el potencial que genera el proceso de auto-organización del trabajo colectivo, para un mejor funcionamiento, sinergia y sustentabilidad de la gestión de una unidad de desarrollo e innovación. Scientist - technical staff perfects a system of management of the quality, nine services, diverse services to the teaching and projects of investigations. Abstract This paper argues that in modern (agro)biotechnology, (un)naturalness as an argument contributed to a stalemate in public debate about innovative technologies. Naturalness in this is often placed opposite to human disruption. It also often serves as a label that shapes moral acceptance or rejection of agricultural innovative technologies. The cause of this lies in the use of nature as a closed, static reference to naturalness, while in fact “nature” is an open and dynamic concept with many different meanings. We (...) propose an approach for a dynamic framework that permits an integrative use of naturalness in debate, by connecting three sorts of meaning that return regularly in the arguments brought forward in debate; cultural, technological, and ecological. We present these as aspects of nature that are always present in the argument of naturalness. The approach proposes a dynamic relation between these aspects, formed by gradients of naturalness, which in turn are related to ethical concerns. In this way we come to an overview that makes it possible to give individual arguments a relative place and that does justice to the temporality of the concept of nature and the underlying ethical concerns stakeholders have in respect to innovation in agriculture. Resumen: Este artículo intenta visibilizar algunos aspectos del rol fundacional de la narrativa de Juan Emar en las letras nacionales, en particular, su fecundo diálogo con la antipoesía de Parra. Se propone que tanto en Miltín 1934 de Emar como en la Antipoesía de Parra asistimos a la práctica de una carnavalización del motivo de lo divino-sublime. En esta dirección, ambas poéticas vanguardistas modulan en el espacio hispanoamericano una de las aristas del “proyecto inconcluso de la modernidad” : la muerte (...) nietzscheana de Dios y de su espacio simbólico; connotado por el tópico de la música de las esferas. Tópico que en ambos autores se da en el marco de un cuestionamiento a una estética de lo sublime que predominaba en la crítica de la época.: This article attempts to draw attention to the foundational role of the literary production of Juan Emar in the national letters, in particular, its fruitful dialogue with the antipoesía de Parra. It is proposed that both in Miltín 1934 and the Antipoesía de Parra we attend the practice of carnivalization of the divine-sublime. In this direction, both avant-garde poetics modulate one of the edges the “unfinished project of modernity” : the simbolic death of God and the simbolic space; connotated by the topico of the spheres music. Resumen La figura del Abba, central en el monacato cristiano primitivo, recibe en el pensamiento de Evagrio Póntico, primer sistematizador de la espiritualidad monástica, la significativa denominación de “Gnóstico” pues se trata del monje que ha alcanzado un cierto grado de ciencia espiritual -natural primero, sobrenatural después- luego de haber atravesado la Praktiké. Esta última constituye, en la comprensión evagriana del itinerario cristiano, la primera etapa del progreso espiritual caracterizada principalmente por el cumplimiento de los mandamientos con el fin de (...) obtener la virtud. Al cabo de la Praktiké, se alcanza la apátheia que constituye una condición propicia del alma para recibir la ciencia presente en las cosas y en los seres racionales. Evagrio llama “gnóstico” a quien ha recibido por lo menos las primicias de esta ciencia o gnosis. Sitúa así aquel “ministerio de la palabra” que el monacato asigna al Abba, en el marco de su esquema de la vida cristiana, atribuyéndole una función medicinal que encuentra en la figura - cara al cristianismo tardo antiguo- del Cristo médico su arquetipo, su especificidad y su raíz. Nos interesa examinar en esta ocasión el modo en que aparece esta figura del Cristo en la obra de Evagrio Póntico y cómo ella constituiría el modelo y la raíz del ministerio terapeútico que, en el pensamiento evagriano, puede ejercer el gnóstico.The Abba figure, central to early Christian monasticism, receives in the thought of Evagrius Ponticus the significant denomination of "Gnostic" because it is the monk who has attained a certain degree of spiritual science after having crossed the Praktiké. The latter constitutes, in the evagriana understanding of the Christian itinerary, the first stage of the spiritual progress characterized mainly by the fulfillment of the commandments in order to obtain the virtue. At the end of the Praktiké, the apátheia is reached, which constitutes a propitious condition of the soul to receive the science present in things and rational beings. Evagrius calls "gnostic" who has received at least the first fruits of this science or gnosis. The "ministry of the word" that monasticism assigns to the Abba, is, for Evagrius, within this framework of Christian life. Our Author attributes the gnostic a medicinal function which finds in the figure - very important for the Late Antique Christianity- of the “Christ Physician”, its archetype, its specificity and its root. We are interested in examining on this occasion how this figure of Christ appears in the work of Evagrius Ponticus and how it would constitute the model and root of the therapeutic ministry that, in Evagrian thought, can be exercised by the Gnostic. Besides “personalism“, and “solidarity“, the “principle of subsidiarity” is the third layer of Christian Social Philosophy. It requires that in a good society political competences should be allocated at the lowest possible level if possible. What the single citizens can achieve should not be taken away from them by higher ranking political authorities. The same rule has to be applied inside a political community among the various levels of the government. In other words, the principle favors Federalism as the organizing (...) structure of the social order.The most important political document in which the principle of subsidiarity plays an important role is the EU-Treaty of Maastricht. Here, however, the principle is misunderstood as a pure procedural process to settle conflicts between the European Commission and the Member States in areas of shared competences. Instead it should be a means to revise the whole existing legal structure of the European Union.Subsidiarity is a constitutional norm. Here, every person in a free society must be respected by the political authorities. This implies that in a civil society political power must be limited, decentralised, and controlled by the citizens.À côté du “personalisme” et de la “solidarité”, le “principe de subsidiarité” est le troisième volet de la philosophie sociale chrétienne. Il requiert que dans une bonne société les compétences politiques soient allouées au niveau le plus inférieur possible. Ce que les simples citoyens peuvent accomplir ne doit pas être réalisé par les autorités politiques d’un rang supérieur. La même règle doit être appliquée à l’intérieur d’une communauté politique aux différents niveaux du gouvernement. En d’autres termes, le principe favorise le fédéralisme en tant que structure d’organisation de l’ordre social.Le document politique le plus important dans lequel le principe de subsidiarité joue un rôle important est le traité Européen de Maastricht. Dans ce cas précis, cependant, le principe est mal compris, car réduit à un simple processus purement procédural pour régler les conflits entre la Commission Européenne et les Etats Membres dans le domaine des compétences partagées. Au contraire il devrait être un moyen de réviser l’ensemble de la structure juridique de l’Union Européenne.La subsidiarité est une norme constitutionnelle. Ici, chaque personne dans une société libre doit être respectée par les autorités politiques. Resumen: El corpus, siendo una herramienta eficaz, se está empleando en múltiples ámbitos, entre los que se encuentran los estudios de traducción. Sin embargo, dicho recurso no se utiliza con mucha frecuencia en las investigaciones traductológicas cuando una de las lenguas en cuestión es chino clásico (la lengua escrita empleada antiguamente en China), y autores que sí hacen estas investigaciones suelen no mencionar los pasos a seguir cuando se trata un corpus paralelo ad hoc. El objetivo del presente artículo es (...) presentar cómo se elabora un corpus paralelo chino clásico-español tomando como ejemplo la novela histórica Romance de los Tres Reinos y sus traducciones al español. Para ello, hemos descrito la problemática de creación y explotación de este tipo de corpus, siguiendo el orden de las fases del proceso. Resulta que algunas fases del proceso son universales, mientras que otras son propias de lenguas clásicas y de la combinación lingüística chino-otra lengua, en cuyo caso sí faltan aplicaciones eficaces. Con el trabajo, esperamos deparar información a los estudiosos que quieran realizar y profundizar las investigaciones basadas en corpus paralelo y en las obras clásicas de China. Abstract: The corpus, being an effective tool, is utilized in multiple fields. One of them is the Translation. However, this resource isn´t used frequently in translation studies when one of the languages in question is classical chinese (written language used anciently in China). And when it comes to an ad hoc parallel corpus, the steps of how to create it are usually omitted by researchers who make such investigations. The objective of this article is to present how to elaborate a classic Chinese-Spanish parallel corpus taking as example the historic novel Romance of the Three Kingdoms and its two translations into Spanish. To reach the objective, we have described the problem of creation and exploitation of this type of corpus, following the order of the phases of the process. We’ve found that some of the phases are universal while other phases are unique for old languages and for the linguistic combination Chinese-other language. And in this latter case, there’s a lack of effective applications. With the current work, we hope to offer useful information to those scholars who are willing to carry out their own investigations based on self-built parallel corpus and at the same time related to the classic Chinese works.
