The mitigation of pandemics like that caused by the current COVID-19 virus is largely dependent on voluntary public adherence to government rules and regulations. Recent research has identified various individual covariates that account for some of the variance in compliance with COVID-19 behavioral guidelines. However, despite considerable research, our understanding of how and why these factors are related to adherence behavior is limited. Additionally, it is less clear whether disease-transmitting behaviors during a pandemic can be understood in terms of more (...) general behavioral tendencies. The current research has examined the utility of a behavioral-failure lens in predicting adherence to COVID-19 guidelines and in illuminating mechanisms underlying the previously established relationship between Conscientiousness and adherence. In the two studies reported here, individual variations in the predisposition to behavioral failures predicted adherence to COVID-19 measures, and mediated the relationships between Conscientiousness and adherence. The Failure Proneness questionnaire predicted compliance with COVID-19 guidelines, while the Cognitive Failure Questionnaire did not. The results of hierarchical regressions showed that COVID-19 behavior was predicted only through the intentional factors. Hence, our data lend support to the notion that noncompliance with official COVID-19 prevention guidelines is driven mainly by intentional factors related to violation of norms and rules. The theoretical and practical implications of this finding are discussed. (shrink)

A framework is presented to better characterize the role of individual differences in information processing style and their interplay with contextual factors in determining decision making quality. In Experiment 1, we show that individual differences in information processing style are flexible and can be modified by situational factors. Specifically, a situational manipulation that induced an analytical mode of thought improved decision quality. In Experiment 2, we show that this improvement in decision quality is highly contingent on the compatibility between the (...) dominant thinking mode and the nature of the task. That is, encouraging an intuitive mode of thought led to better performance on an intuitive task but hampered performance on an analytical task. The reverse pattern was obtained when an analytical mode of thought was encouraged. We discuss the implications of these results for the assessment of decision making competence, and suggest practical directions to help individuals better adjust their information processing style to the situation at hand and make optimal decisions. One of most pertinent and acute risks that the world is now facing is emerging or re-emerging zoonotic diseases. This article focuses on culling as a measure for zoonotic disease control, specifically the culling of 11,000 badgers as part of the Randomized Badger Culling Trial in the UK and the culling exercises in Singapore. The independent expert panel that devised the UK study concluded that reactive culling was ineffective in reducing the cases of bovine tuberculosis in cattle. The panel also (...) concluded that proactive culling was not cost-effective. Behind the scarcity of empirical evidence to support culling, the resultant reduction in biodiversity can actually harm both animals and humans. Public health policies should be evidence-based, culturally adaptable and ethically justified; a novel biomedical and public health approach, named One Health, plausibly provides a reasonable ethical framework as well as research and interventional methods that square with that framework. OH recognizes that nonhuman animals and humans are interlinked in both sickness and health, since we all share the same ecosystem. OH could potentially replace standard public health strategies, as it provides alternative evidence-based methods for biomedical research and adds a non-anthropocentric component to an ethical decision-making process. In The Quantum Self, Danah Zohar argues that the insights of modem physics can illuminate our understanding of everyday life -- our relationships to ourselves, to others, and to the world at large. Guiding us through the strange and fascinating workings of the subatomic realm to create a new model of human consciousness, the author addresses enduring philosophical questions. Does the new physics provide a basis by which our consciousness might continue beyond death? How does the material world (for (...) instance, ugly inner cities) impinge upon our sense of self? Is there a subatomic wellspring from which our creativity, our empathy with others, and our feelings of unity with the inanimate world originate?Most important, Zohar shows how the vitality of the new physics combats the alienation and fragmentation of twentieth-century life, and replaces it with a model of reality in which the universe itself may possess a type of consciousness, of which human consciousness is one expression. Political interaction among citizens who hold opposing moral views commonly requires reaching beyond toleration, toward actual co‐operation with policies one opposes. On the more personal level, however, regarding (e.g.) interactions between healthcare providers and patients, several authors emphasise the importance of preserving integrity. But those who oppose any ‘complicity in evil’ often wrongly conflate instances in which the other's position is (and should be) totally rejected with instances of legitimate, although deep, disagreement. Starting with a striking example from the context (...) of a particular tradition, I argue generally that in the latter sort of disagreements, talk of ‘complicity’ should be largely replaced with a more co‐operative moral stance, grounded in a pluralistic framework. Co‐operation Despite Disagreement (CDD) should be sought either for institutional reasons – akin to the political – or for relational reasons. CDD involves sharing another's perspective and sometimes calls for adopting another's moral judgements in preference to one's own. I seek to identify some of the conditions and circumstances that would justify such a shift, particularly in scenarios involving assistance, such as physician‐assisted suicide (PAS) or the role of an anaesthesiologist in abortion. This discussion is meant to provide examples of the kind of second‐order reasons appropriate for determining the terms for CDD – in distinction from first‐order considerations (e.g., the much‐contested ‘active/passive’ distinction) which are likely to be the subject of the initial disagreement and hence cannot serve to resolve it. The distinction between access consciousness and phenomenal consciousness is a subject of intensive debate. According to one view, visual experience overflows the capacity of the attentional and working memory system: We see more than we can report. According to the opposed view, this perceived richness is an illusion—we are aware only of information that we can subsequently report. This debate remains unresolved because of the inevitable reliance on report, which is limited in capacity. To bypass this limitation, this study utilized (...) color diversity—a unique summary statistic—which is sensitive to detailed visual information. Participants were shown a Sperling-like array of colored letters, one row of which was precued. After reporting a letter from the cued row, participants estimated the color diversity of the noncued rows. Results showed that people could estimate the color diversity of the noncued array without a cost to letter report, which suggests that color diversity is registered automatically, outside focal attention, and without consuming additional working memory resources. In the heyday of eugenics, Rabbi Max Reichler (1916) enthusiastically endorsed its ideology, supporting his position with numerous traditional texts. Similar views of traditional teachings on “chosen people” and on the importance of lineage have a certain contemporary following as well. The paper argues, however, that these views involve a one-sided reading of the Jewish tradition (...) and, particularly, the suppression of traditional critiques of lineage and of the notion of a “Jewish race.”. The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. Whether to allow the presence of family members during cardiopulmonary resuscitation has been a highly contentious topic in recent years. Even though a great deal of evidence and professional guidelines support the option of family presence during resuscitation , many healthcare professionals still oppose it. One of the main arguments espoused by the latter is that family members should not be allowed for the sake of the patient's best interests, whether it is to increase his chances of survival, respect his (...) privacy or leave his family with a last positive impression of him. In this paper, we examine the issue of FPDR from the patient's point of view. Since the patient requires CPR, he is invariably unconscious and therefore incompetent. We discuss the Autonomy Principle and the Three-Tiered process for surrogate decision making, as well as the Beneficence Principle and show that these are limited in providing us with an adequate tool for decision making in this particular case. Rather, we rely on a novel principle and a novel integrated model for surrogate decision making. We show that this model is more satisfactory in taking the patient's true wishes under consideration and encourages a joint decision making process by all parties involved. (shrink)

Intergroup competition over resources is attested since the dawn of history. Written and archaeological evidence go back to at least the fourth millennium BC. According to accepted views, evolution has favored humans because of their ability to have cumulative cultures, which has made flexible adaptation possible. One major aspect of this adaptation has been the ability to handle power contests without engaging physical force. Instead, increasing prestige dynamics has allowed contest management by displaying symbolic assets. These have growingly been instrumental (...) in deterring external assaults, thus guaranteeing the possession – or expansion – of a group’s resources. However, while material assets are believed to create status by the evidence of their tangible usefulness (such as foods, husbandry and tools), symbolic assets are by definition subject to ongoing negotiation, entirely dependent on being socio-semiotically recognized as types of capital. Symbolic stock exchanges thus appear to have been determinative since antiquity in hierarchizing ethnic and political groups fighting over resources, prioritizing ones over the others. They have culminated in repertoires of more solid tangible and intangible assets, from impressive buildings, city gates, gardens and temples, to ideas such as freedom, quality of life and wealth, justice, personal security, or whatever values that have gained universal recognition. The article discusses the creation and expansion of such symbolic repertoires and their uncertain position in recent times. (shrink)

The argument advanced by Giubilini and Minerva is an important one, but it suffers from some shortcomings. I briefly criticise their reasoning and method and argue that after birth abortion should be limited largely to infants with disabilities. My argument is based not on solid scientific evidence or cold rational reasoning but on intuition, something that has long been discounted as irrelevant in biomedical discourse. I end with a recommendation to all of us: in order to make a change, one (...) should not only choose one’s battles, but also one’s weapon and mode of attack. (shrink)

This paper applies the argumentative perspective to the concept of scientific fact by combining the rhetorical and the sociological perspectives. The scientific fact is presented as an entity having both an epistemic and a social meaning, and the scientific paper is presented as a discourse that has both an epistemic value and role related to knowledge and to the description of the ‘world,’ and a social value, fulfilling social roles within its relevant discourse community. The discussion leads to some insights (...) into the connection between scientific language and facts. Scientific language reflects the degree of facticity of the utterance at every stage: various linguistic and discursive elements reflect the current factual status of the utterance. This conception of fact is dynamic and open to discussion, and it is presented from the author’s point of view. On the other hand, language, or the choice of language usage, creates facticity in the sense of social acceptance: by using language, the researcher reports on his belief that what he is describing is indeed a fact. The essence of the scientific paper as an argumentative text is that its point of departure is the faith of the speaker in the facticity of the new information, and its rhetorical aim is to convince the audience, based on its disciplinary rationality, to accept that same faith and thereby usher the new claim into the shared disciplinary body of knowledge. Voting lies at the center of collective decision-making in corporate law. While scholars have identified various problems with the voting mechanism, insincere voting—in the forms of strategic voting and conflict of interests voting—is perhaps the most fundamental. This article shows that insincere voting distorts the voting mechanism at its core, undermining its ability to determine transaction efficiency. As further demonstrated, strategic and conflict of interests problems frequently coincide with one another: voting strategically often means being in conflict, and many fact (...) patterns present aspects of both problems. Finally, this article claims that although the two problems have seemingly different solutions, these solutions are essentially similar in nature: all solutions to insincere voting are variations on two basic rules, namely, property rules and liability rules. This text reads into the work of Ibrahim Nubani (1962—), a Palestinian-Israeli painter who was diagnosed with schizophrenia in 1988, during the first Intifada. Nubani’s painting has undergone a tremendous change from the 1980s and the period of his hospitalization to his painting style today: from geometric, Modernist-type painting, gradually moving into his contemporary chaotic and saturated style of expression. I draw parallels between Nubani’s personal and psychological condition and the political events that affected him. I refer to his state (...) in relation to the discourse of mimicry and camouflage in nature, comparing his position to that of the invisible presences in the background in a perfect camouflage, referring to Roger Caillois’ interpretations. I look at his diagnosed psychiatric state of schizophrenia as the materialization of the meaning of being a Palestinian-Israeli in a life of fragmentation and rejection, by referring to Bhabha and Shammas. I relate to Deleuze and Guattari’s notions of schizophrenia as a cultural rebellion against the moderating mechanisms of cultural/national identification. I demonstrate how Nubani’s work and speech undermine the modalities of mainstream Israeli society, acting like a cultural insurgent, terrorizing Zionist axioms. While analysing Nubani’s iconography I identify several tropes, images and icons that serve as signifiers of his personal crisis and artistic development. I link Nubani’s eyes/ocelli images to Lacan’s discussion of ‘symbolic castration’ as the core of his personal becoming part of Israeli society and his collapse, the in-between desire to assimilate in the early stages of his life, and his current desire to fully live his life as a Palestinian. The text moves between his images and images from other sources that open Nubani’s world into the discourses of Western painting, schizophrenia, high Modernism, the postcolonial condition and so forth. The text is fragmented into eight pieces, following the schizophrenic break-up of Nubani’s personal state and his painted work. I read his work as a destabilizing agent, and identify visual references drawn from the wider context of art history, and specifically referring to masterpieces of the Israeli art canon. (shrink)

In this essay, I examine aspects of Walzer's exposition of The Jewish Political Tradition (=the title of a multi-volume work of which he is leading editor) as they intersect with his work on political theory more generally. The Jewish tradition seems to present a radical example of "anti-politics": of a people existing outside the political realm. This is due both to the historical fact of their long exile, and to the shadow cast upon human politics by the prophetic ideology of (...) Divine Sovereignty. Despite their long-lasting lack of sovereignty, Jewish communities sustained a significant political life and a rich political discourse; this can serve to illustrate the primacy of the people's common life over the state, whose function is to support this life. As for divine sovereignty, it need not negate human political agency; instead, it can furnish – as in the case of the biblical prophets – the grounding for effective social criticism; though it is far from clear who, if anyone, is heir to the prophetic-critical mantle in post-biblical Judaism. Conflicts of interest in corporate law can be addressed by two main alternatives: a requirement of a majority of the minority vote or the imposition of duties of loyalty and fairness. A comparison of Delaware, the UK, Canada, and Israel reveals that while the conflicts of interest problem within publicly-traded corporations receives different treatment in the different jurisdictions — either a fairness rule or a majority of the minority rule — closely-held corporations receive the same treatment of an imposition of (...) duties of loyalty and fairness. This article explains this finding, demonstrating that determining which of these rules is adopted is, in fact, a choice between liability rule protection and property rule protection. This choice depends on the total and relative transaction costs. These costs include both the negotiation costs attendant upon a property rule, as well as the adjudication costs associated with a liability rule. The sum of these costs is influenced by the efficacy of the judicial system and of extralegal mechanisms such as the market for corporate control, the capital market, and the types of investors active in the market. Because the different jurisdictions have different relative costs, due to differences in the economy and the legal systems, publicly-traded corporations are treated differently in each system. However, sometimes conflict of interest situations share the same main characteristics — as with closely-held corporations—leading to the domination of one solution, and thus the same solution is applied for closely-held corporations in the different jurisdictions. This article examines the Israeli government’s role in supporting living conditions conducive to health in the occupied Palestinian territories. Limiting the discussion to public health, the authors argue that—whether justified in its overall political policy—the Israeli government and people are legally and ethically obligated to care for the well-being of the Palestinian people. The authors first review the current situation in the OPT and compare health statistics with Israel. Next, the authors make three arguments as to why the Israeli government (...) and citizens should assist the Palestinian people: moral responsibility, legal responsibility and solidarity. Based on these, the authors make the case for Israel’s moral duty to ensure that Palestinian people living in the OPT achieve equitable levels of health as compared to Israeli citizens, while minimizing restrictions on Palestinian self-determination. The authors urge the Israeli government and citizens to improve Palestinian’s daily living conditions, tackle inequitable distribution of power and allow international support in these efforts. Hospital Admission must therefore be open to every patient that needs it, irrespective of whether he has money or not, whether he be Jew or heathen. (shrink)

One Health is a novel paradigm that recognizes that human and non-human animal health is interlinked through our shared environment. Increasingly prominent in public health responses to zoonoses, OH differs from traditional approaches to animal-borne infectious risks, because it also aims to promote the health of animals and ecological systems. Despite the widespread adoption of OH, culling remains a key component of institutional responses to the risks of zoonoses. Using the threats posed by highly pathogenic avian influenza viruses to human (...) and animal health, economic activity and food security as a case exemplar, we explore whether culling and other standard control measures for animal-borne infectious disease might be justified as part of OH approaches. Our central premise is that OH requires us to reformulate ‘health’ as universal good that is best shared across species boundaries such that human health and well-being are contingent upon identifying and meeting the relevant sets of human and non-human interests and shared dependencies. Our purpose is to further nascent discussions about the ethical dimensions of OH and begin to describe the principles around which a public health agenda that truly seeks to co-promote human and non-human health could potentially begin to be implemented. In 2015, the Israeli Knesset passed the force-feeding act that permits the director of the Israeli prison authority to appeal to the district court with a request to force-feed a prisoner against his expressed will. A recent position paper by top Israeli clinicians and bioethicists, published in Hebrew, advocates for force-feeding by medical professionals and presents several arguments that this would be appropriate. Here, we first posit three interrelated questions: 1. Do prisoners have a right to hunger-strike? 2. Should governing (...) institutions force-feed prisoners and/or is it ethical to force-feed prisoners? 3. Should healthcare professionals force-feed prisoners? We then focus on the first and third questions. We first briefly provide several arguments to support the right of prisoners to refuse treatment. Next, we critically review the arguments presented in the Israeli position paper, demonstrating that they are all misguided at best. Lastly, we briefly present arguments against force-feeding by medical professionals. We conclude that healthcare providers should not participate in the force-feeding of prisoners. (shrink)

In this essay we discuss an ethical dilemma that recently arose in our institution, involving healthcare workers who lamented the requirement to shave their facial hair as a condition to care for COVID-19 patients. The essay represents a genuine attempt to grapple with the dilemma sensibly and vigorously. We first provide a brief introduction, focusing on the tension between religious tolerance and the institutional obligation to optimize patient care and public health in the age of COVID-19. We then discuss the (...) complex relationship between facial hair and cultural as well as religious factors throughout history. Next, we make a case, based on several principles in Islam jurisprudence, that Muslim healthcare professionals in our institution should be expected to shave their facial hair so they could care for COVID patients. We end with considering two alternative solutions that were offered in the literature. (shrink)

Capps and Lederman, in a paper published in this journal in 2015, argued that, at the time, the dismal circumstances of the Ebola outbreak in West Africa was an opportunity to revisit public health responses to emergent infectious diseases. Using a One Health lens, they argued for an ecological perspective—one that looked to respond to zoonoses as an environmental as well as public health concern. Using Ebola virus disease as an example, they suggested shared immunity as a strategy to vaccinate (...) both humans and great apes. Since then, vaccination as a conservation strategy in this case has been debated and at least one great ape vaccination trial has been proposed: some, however, are less convinced of the ethical arguments to pursue vaccinating wild animals. Using this opportunity, we review Capps and Lederman’s arguments and directly respond to the plausible objections to them. (shrink)

Johnson and Degeling have recently enquired whether one health requires a comprehensive normative framework, concluding that such a framework, while not necessary, may be helpful. In this commentary, we provide a context for this debate, and describe how pragmatism has been predominant in the OH literature. We nevertheless argue that articulating a comprehensive normative theory to ground OH practice might clear existing vagueness and provide stronger guidance in relevant health dilemmas. A comprehensive theory will also be needed eventually to ground (...) notions such as universal good. We, thus, call for the systematic articulation of a comprehensive, metaethical theory, concomitantly with already ongoing normative work. (shrink)

We contrast two theoretical positions on the relation between phenomenal and access consciousness. First, we discuss previous data supporting a mild Overflow position, according to which transient visual awareness can overflow report. These data are open to two interpretations: (i) observers transiently experience specific visual elements outside attentional focus without encoding them into working memory; (ii) no specific visual elements but only statistical summaries are experienced in such conditions. We present new data showing that under data-limited conditions observers cannot discriminate (...) a simple relation (same versus different) without discriminating the elements themselves and, based on additional computational considerations, we argue that this supports the first interpretation: summary statistics (same/different) are grounded on the transient experience of elements. Second, we examine recent data from a variant of ‘inattention blindness’ and argue that contrary to widespread assumptions, it provides further support for Overflow by highlighting another factor, ‘task relevance’, which affects the ability to conceptualize and report (but not experience) visual element. Loneliness is a major public health concern, particularly during pandemics such as Covid. It is extremely common, and it poses a major risk to human health. Technological solutions including social media, robots, and virtual reality have been advocated and implemented to relieve loneliness, and their use will undoubtedly increase in the near future. This paper explores the use of technological solutions from a normative perspective, asking whether and to what extent such measures should indeed be relied upon. The conclusion is (...) that technological solutions are unquestionably part of the solution to loneliness, but that they cannot and should not constitute the whole solution. It is important to note that this is not a straw‐man argument, as several organizations and scholars have strictly focused on such technological solutions for loneliness. (shrink)

This essay discusses and weaves together three interrelated topics: loneliness as a neglected bioethics problem, solidarity as one potential solution to loneliness, and the Israeli‐Palestinian Conflict as a neglected bioethics problem in which loneliness is stark. I first present and define various kinds of loneliness, focusing on ethical loneliness, defined as suffering injustice without a proper repair process. I next discuss current health conditions in Gaza, focusing on healthcare providers who, according to the UN, are being intentionally targeted by Israel. (...) I explain how the various kinds of loneliness are reflected among people in Gaza. I lastly relate together the notions of solidarity, responsibility and personal autonomy, arguing that bioethicists and healthcare providers have a duty to support the people in Gaza, stemming from solidarity and an extended responsibility perspective.
