With a novel approach to Aristotle's zoology, this study looks at animals as creatures of nature and reveals a scientific discourse that, in response to his predecessors, exiles logos as reason and pursues the logos intrinsic to animals' bodies empowering them to sense the world and live. The volume explores Aristotle's conception of animals through a discussion of his ad hoc methodology to study them, including the pertinence of the soul to such a study, and the rise of zoology as (...) a branch of natural philosophy. For Aristotle, animal life stems from the body in the space of existence and revolves around sensation, which is entwined with pleasure, pain, and desire. Lack of human reason is irrelevant to an understanding of the richness of animal life and cognition. In sum, the reader will acquire knowledge of the animal as such, which lay at the core of Aristotle's agenda and required a study of its own, separate from plants and the elements. This essay pursues the question of vegetal respiration in Presocratics’ doctrines in contrast to Aristotle’s categorical circumscription of this vital process to the blooded animals. It finds that epithelial respiration in DK31 B100 is central to Empedocles’ conception of plants’ breathing, linked to their fructification, deciduousness, and overall life preservation. It also discusses plants’ respiration in relation to their body temperature in Menestor, then, concludes by analyzing Democritus’ psychological doctrine, arguing that the intake of fiery atoms pertained to all living (...) beings, plants included. This essay considers episodes in which phenomena like war and civil strife affected, changed, and revealed the identity of the polis. Even if framed by an understanding of the Peloponnesian War and the imperialistic logic and destiny of Athens, Thucydides' History still provides us with narratives that illuminate the particular history of “minor” poleis, each with its specific events, turning points, and dynamics. Through analysis of Thucydides' historical material, this essay focuses on Plataea, Corcyra, and Mytilene and discusses the notion (...) of the polis in relation to space and in the context of time, thereby testing Aristotle's question—too soon dismissed—about the separation of a community from the space of its city. What did the early Greek philosophers think about animals and their lives? How did they view plants? And, ultimately, what type of relationship did they envisage between all sorts of living beings? On these topics there is evidence of a prolonged investigation by several Presocratics. However, scholarship has paid little attention to these issues and to the surprisingly "modern" development they received in Presocratics' doctrines. This book fills this lacuna through a detailed (and largely unprecedented) analysis of the extant evidence. (...) This essay argues that current advocacy of lesbian and gay rights to legal marriage and parenthood insufficiently criticizes both marriage and motherhood as they are currently practiced and structured by Northern legal institutions. Instead we would do better not to let the State define our intimate unions and parenting would be improved if the power presently concentrated in the hands of one or two guardians were diluted and distributed through an appropriately concerned community.

The dynamic organisational processes in businesses dilute the boundaries between the individual, organisational, and societal drivers of corporate philanthropy. This creates a complex framework in which charitable project selection occurs. Using the example of European tour operators, this study investigates the mechanisms through which companies invest in charitable projects in overseas destinations. Inextricably linked to this is the increasing contestation by local communities as to how they are able to engage effectively with tourism in order to realise the benefits tourism (...) development can bring. This research furthers such debates by exploring the processes through which tour operators facilitate community development through charitable giving. Findings show, with no formal frameworks in existence, project selection depends upon emergent strategies that connect the professional with the personal, with trust being positioned as a central driver of these informal processes. Discretionary responsibilities are reworked through business leaders’ commitment to responsible business practises and the ethical subjectivity guiding these processes. (shrink)

An increasing number of studies indicate that virtues affect brain structure. These studies might shed new light on some neuroethical perspectives suggesting that our brain network activity determines the acquisition and permanence of virtues. According to these perspectives, virtuous behavior could be interpreted as the product of a brain mechanism supervised by genes and environment and not as the result of free choice. In this respect, the neural correlates of virtues would confirm the deterministic theory. In contrast, I maintain that (...) these findings do not undermine the role of willpower and freedom while reinforcing an interactionist view of free will. If virtues affect our neural system, then the predictability of the virtuous behavior follows. The likelihood of our future (moral) actions is primarily virtue-dependent; therefore, the acquired naturality of virtuous behavior is a source of predictable behavioral patterns outlining expected actions, which I propose to call Hypotheses of Action (HAs). However, the predictability of an action indicates its likeliness and not its certainty or necessity. The neural traces of virtues can be interpreted as major indicators of HAs. It is always possible for the agents to depart from their more likely, virtue-induced actions, but their deviations from the virtuous behavioral pattern are rare, as it is rare for the vicious/non-virtuous person to behave well systematically. This implies a reaffirmation of the notions of veto and consent as they provide a universal practical power affecting the subject’s use of moral virtues. (shrink)

The biopsychosocial model is characterized by the systematic consideration of biological, psychological, and social factors and their complex interactions in understanding health, illness, and health care delivery. This model opposes the biomedical model, which is the foundation of most current clinical practice. In the biomedical model, quest for evidence based medicine, the patient is reduced to molecules, genes, organelles, systems, diseases, etc. This reduction has brought great advances in medicine, but it lacks a holistic view of the person. To solve (...) the problem, we propose an early team based approach where the primary care physician leads a group of people that can help her/him address the psychosocial issues while she/he attends to the biomedical issues. This article addresses one case where the clinical ethicist facilitating a team based biopsychosocial model for the care of a patient worked as a bridge between the primary team, the critical care team, and the psychosocial team to advance the argument that good communication among the groups can lead to a true biopsychosocial model where the collaboration of the social worker, psychologist, chaplain, ethicist and the different medical teams can improve the overall patient experience. Contextualism is a view about meaning, semantic content and truth-conditions, bearing significant consequences for the characterisation of explicit and implicit content, the decoding/inferring distinction and the semantics/pragmatics interface. According to the traditional perspective in semantics (called "literalism" or "semantic minimalism"), it is possible to attribute truth-conditions to a sentence independently of any context of utterance, i.e. in virtue of its meaning alone. We must then distinguish between the proposition literally expressed by a sentence ("what is said" by the sentence, its (...) literal truth-conditions) and the implicit meaning of the sentence ("what is implicated" by a speaker uttering the sentence). Over the past forty years, however, an increasing number of linguists and philosophers have begun to underline the phenomenon of semantic underdetermination: the encoded meaning of the sentence employed by a speaker underdetermines the proposition explicitly expressed by an utterance of that sentence. According to the extreme version of this perspective – labelled "radical contextualism" - no sentence of a natural language expresses a complete proposition, or has fixed truth-conditions, even when unambiguous and devoid of indexicals. A sentence expresses a proposition only when completed and enriched with pragmatic constituents that do not correspond to any syntactic element of the sentence and yet are part of its semantic interpretation. More broadly, "contextualism" may be used to refer to a family of views which includes moderate contextualism (also called "indexicalism"), radical contextualism and non-indexical contextualism – and which contrasts with semantic minimalism. Gray zones, which develop wherever oppression is severe and lasting, are inhabited by victims of evil who become complicit in perpetrating on others the evils that threaten to engulf themselves. Women, who have inhabited many gray zones, present challenges for feminist theorists, who have long struggled with how resistance is possible under coercive institutions. Building on Primo Levi's reflections on the gray zone in Nazi death camps and ghettos, this essay argues that resistance is sometimes possible, although outsiders are rarely, (...) if ever, in a position to judge when. It also raises questions about the adequacy of ordinary moral concepts to mark the distinctions that would be helpful for thinking about how to respond in a gray zone. (shrink)

In this article, I argue that the concept of disposition is often unclear in teacher education programs, sometimes referring to general personal values and beliefs, and sometimes referring to professional commitments and actions. As a result, it is unclear whether teacher education programs should focus on selecting the right kind of person, or on educating the student for a profession. I suggest that a clearer distinction should be made between predispositions (value commitments that a person may or may not act (...) upon) and professional dispositions (characteristics attributed to a person based on actually observed actions), and that teacher education programs should focus their attention on the latter, not the former. The question is not whether student-teachers have the ?right? personal beliefs but whether, if the dispositions required by the profession are at odds with their personal beliefs, the former will override the latter. Derogatory epithets are terms such as “nigger” and “faggot” targeting individuals and groups of individuals on the basis of race, nationality, religion, gender or sexual orientation. There is no consensus on the best treatment of derogatory epithets. The aim of my paper is to evaluate a proposal recently put forward by Rae Langton, the speech acts account. Assessing SAA is far from an easy task, since the proposal is little more than an outline, deeply intertwined with Langton’s general view on (...) hate speech and pornography. My goal is first of all to disentangle a coherent account from Langton’s observations; second, I will raise and partially address some key objections against it. I will argue that, although SAA gives us significant insights into a number of phenomena, it is in need of a clearer formulation and further investigation. (shrink)

In this paper, I argue that Marx's central concern, consistent throughout his works, is to challenge and overcome hierarchical oppositions, which he considers as the core of modern, capitalist societies and the cause of alienation. The young Marx critiques the hierarchical idealism/materialism opposition. In this opposition, idealism abstracts from and reduces all material elements to the mind (or spirit), and materialism abstracts from and reduces all mental abstractions to the body (or matter). The mature Marx sophisticates this critique with his (...) theory of the commodity fetish. The commodity fetish abstracts the exchange-value (the mind) from the commodity's use-value (the body). Although Marx aims to challenge capitalism by abolishing the hierarchical relation among binary oppositions, I show that in his early and later writings on the working-class woman, he reinforces hierarchical binaries, pointing at the gendered unconscious structure of capitalism. In this paper I expose and criticise the distinction between pure indexicals and demonstratives, held by David Kaplan and John Perry. I oppose the context of material production of the utterance to the “intended context” (the context of interpretation, i.e. the context the speaker indicates as semantically relevant): this opposition introduces an intentional feature into the interpretation of pure indexicals. As far as the indexical I is concerned, I maintain that we must distinguish between the material producer of the utterance (...) containing I and the “intended agent of the context” - i.e. the individual designated by the material producer as the responsible for the utterance. The precautionary principle (PP) aims to anticipate and minimize potentially serious or irreversible risks under conditions of scientific uncertainty. Thus it preserves the potential for future developments. It has been incorporated into many international treaties and pieces of national legislation for environmental protection and sustainable development. In this article, we outline an interpretation of the PP as a framework of orientation for a sustainable information society. Since the risks induced by future information and communication technologies (ICT) are social risks for (...) the most part, we propose to extend the PP from mainly environmental to social subjects of protection. From an ethical point of view, the PP and sustainability share the principle of intergenerational justice, which can be used as an argument to preserve free space for the decisions of future generations. Applied to technical innovation and to ICT issues in particular, the extended PP can serve as a framework of orientation to avoid socio-economically irreversible developments. We conclude that the PP is a useful approach for: (i) policy makers to reconcile information society and sustainability policies and (ii) ICT companies to formulate sustainability strategies. Within the context of increased global migration and mobility, education occupies a central role which is being transformed by new human movements and cultural diversity, flows, and networks. Studies under the umbrella terms of migration, mobility, and mobilities reveal the complexity of these concepts. The field of study ranges from global child mobility as a response to poverty, to the reconceptualising of notions of inclusion in relation to pastoralist lifestyles, to the ways in which new offshore institutions and transnational diasporas (...) shape the educational experiences of students, families, and teachers. At the heart of this new research is a need to explore how identity, integration, and social stratification play a role in the story of global migration between and within the Global North and South. This volume focuses on three major themes: poverty, migration, social mobility and social reproduction; networks of migration within and across national education systems; and higher education and international student mobility, and the concerns and opportunities that go along with this mobility. The international group of researchers who have contributed to this book demonstrate how educational institutions are part of a common global project characterised by fluidity, how the social fabric of educational institutions responds to demographic diversity, and how new social differentiations occur as a result of human movement. By bringing together these contributions, a number of important theoretical and empirical methodological dimensions are identified that need more attention within the growing field of migration and education studies. This volume shows how mobilities and transnational interconnectedness create multiple interactions that tie our different educational projects together. Neste artigo, apresentamos algumas experiências realizadas na disciplina de Estágio Supervisionado em Educação Infantil I, do curso de Pedagogia da UNIVATES, no qual investigou-se as possibilidades de conciliar a funcionalidade do espaço da sala de aula dos bebês com objetivos pedagógicos. Os dados foram obtidos mediante a realização de filmagens, fotografias e do uso de Diário de Campo. Observa-se que buscar contemplar na sala de aula de Educação Infantil os interesses e necessidades das crianças e dos adultos, exige dos docentes (...) uma escuta sensível do que as crianças manifestam, bem como, a criação de novos materiais e uso de diferentes estratégias a fim de garantir a multissensorialidade do espaço. In "Demonstratives" Kaplan claims that the occurrence of a demonstrative must be supplemented by an act of demonstration, like a pointing (a feature of the objective context). Conversely in "After-thoughts" Kaplan argues that the occurrence of a demonstrative must be supplemented by a directing intention (a feature of the intentional con-text). I present the two theories in competition and try to identify the constraints an intention must satisfy in order to have semantic rele-vance. My claim is that the analysis of (...) demonstrative reference pro-vides a reliable test for our intuitions on the relation between objective and intentional context. I argue that the speaker's intentions can play a semantic role only if they satisfy an Availability Constraint: an inten-tion must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective con-text. This thesis implies the reconciliation between "Demonstratives" and "Afterthoughts". (shrink)

This paper reflects on quality assessment and performance evaluation in higher education, namely by analysing the insufficient link between those two aspects. We start by reviewing the current state of the art regarding different processes and mechanisms of quality assessment and performance evaluation and discuss some of the major issues regarding the implementation of some of them. In particular, we analyse the current limitations regarding data collected, available and publicised on the performance of HEIs and the problems those limitations bring (...) to a fair evaluation of higher education. Through this analysis we intend to contribute to a better understanding of the mechanisms of evaluation in higher education and the way these may lead to the promotion of better quality assessment practices and institutional management. From the viewpoint of Political Theory, digital technology presents both risks and opportunities for the democratic public sphere. Public discourse is now more complex and fragmented than ever before. Against this background, this paper uses the metaphor of a “communicative universe” to analyze the latest structural change of the public sphere. It emphasizes the significance of achieving a balance between different actors and powers in contemporary political discourse. Arising in the study of Quantum Logics, PBZ \(^{*}\) -_lattices_ are the paraorthomodular Brouwer–Zadeh lattices in which the pairs of elements with their Kleene complements satisfy the Strong De Morgan condition with respect to the Brouwer complement. They form a variety \(\mathbb {PBZL}^{*}\) which includes that of orthomodular lattices considered with an extended signature (by endowing them with a Brouwer complement coinciding with their Kleene complement), as well as antiortholattices (whose Brouwer complements are trivial). The former turn out to have (...) directly irreducible lattice reducts and, under distributivity, no nontrivial elements with bounded lattice complements, since the elements with bounded lattice complements coincide to the sharp elements in distributive PBZ \(^{*}\) -lattices. The variety \(\mathbb {DIST}\) of distributive PBZ \(^{*}\) -lattices has an infinite ascending chain of subvarieties, and the variety generated by orthomodular lattices and antiortholattices has an infinity of pairwise disjoint infinite ascending chains of subvarieties. Torture is like slavery (and unlike murder and genocide) in that it is not inconceivable that torture might be justifiable. But the circumstances that would make it tolerable are unrealistic in philosophically interesting ways. It is unrealistic to think we can predict when torture will be effective and containable; unwarranted to suppose that humane alternatives are impossible; disastrous to remove motivations to create alternatives; unacceptable to be satisfied with available evidence regarding suspects’ identity, knowledge of critical detail, ability to recall (...) it, or reasons for not providing it. Most importantly, the costs of even successful interrogational torture would negate the gains sought. Or so this essay argues. (shrink)

This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. As currently understood and practiced, global development and climate justice appear irreconcilable. In fact, global development has been and remains a key driver of climate inequalities. We hold that this is not an accident, but instead is a result of global development being established within worldwide systems of oppression. We define global development as setting the goals for, and the processes for achieving, what constitutes a good life for all communities, and taking the steps needed to reach those goals. This (...) article provides an outline of how the theories of two moral and political philosophers – Achille Mbembe and Charles Mills – point us in the direction of an ethical framework for the relationship of humans to each other and to the natural world. We examine two contexts that should motivate development practitioners to move from the current development regime toward the direction of a transformational ethical framework built off the work of these philosophers: (i) the perpetual failure of global development practice to foster a humane approach to migration; and (ii) the inability of global development solutions, like SDGs and leapfrogging, to stray from the very problems they are intended to address. This article explores the extent to which Christian traditions, especially the monastic way of life, possess a transformative potential toward a socio-ecological society. Christian ideas are not unbroken utopias, but they possess an eschatological proviso based on God's otherness. Neither is monastic life a prefiguration of the Kingdom of God, nor do Christians or the Church prefigure a heavenly society, but Christian action and religious communities can be regarded as forms of _refigurative practice_, which can fail again and again without (...) losing hope. This article describes the relationship between niche and transformation, between monastic cell and utopia, as such a refigurative practice. (shrink)

The importance of economic freedom for economic development can no longer be denied. What is often denied, however, is respect for individuals’ rights and personal choices. The role of individual choice is often dismissed or set aside by the development community. In this essay, I argue that inherent to economic freedom’s economic success is the promotion and acceptance of individual choice. Development theory should include recognition of and respect for personal choices, a theory I call “Catfish Man of the Woods” (...) theory of development. (shrink)

La hipótesis que me interesa defender es que, por un lado, las nociones de individuo y de cosa singular no son totalmente equiparables. Por otro lado, que tanto la cosa singular como la acción pueden entenderse en un sentido amplio y en uno restringido; y, por (...) otro, que comprender al individuo como cosa singular acentúa un aspecto crucial de ellos: su acción y operación. Is it true that utilitarianism can accommodate the modern belief that human beings have certain moral rights against everybody ‘just in virtue of their human nature?’ I should have thought the most a utilitarian could grant was that we had rights just in virtue of the utility of respecting such rights, not just in virtue of our human nature. In fact, that is more like the view Professor Brandt actually supports. What he argues is that there is not the a (...) priori difficulty with the idea of utilitarian moral rights that some philosophers have thought there was. However, I think the possibility of utilitarian moral rights is not the same as the view that we all have human rights against everybody just in virtue of our human nature. As I hear it, ‘just in virtue of our human nature’ is an alternative to a utilitarian basis for rights. I'll return to that. (shrink)
