This paper offers the concept of “justice failure,” as a counterpart to the familiar idea of market failure, in order to better understand managers’ ethical obligations. This paper takes the “market failures approach” to business ethics as its point of departure. The success of the MFA, I argue, lies in its close proximity with economic theory, particularly in the idea that, within a larger scheme of social cooperation, markets ought to pursue efficiency and leave the pursuit of equality to the (...) welfare state. As a result, the core ethical responsibility of business actors is to avoid profiting off of market failure. After reviewing this approach I challenge its emphasis on efficiency. I argue that just as we note the suboptimal efficiency of actual markets, we should also take seriously the suboptimal equality of actual welfare states. Taking this idea seriously results in a whole other set of ethical responsibilities for businesses to take into account; in addition to market imperfections and regulatory lacunae, managers should also avoid profiting from, and exacerbating, structural inequalities and injustices. I offer an outline of the kinds of injustices and inequalities that would have bearing on business ethics, and the kinds of ethical responsibilities that this approach suggests that business actors should take into account. Sometimes individuals act together, and sometimes each acts on his or her own. It's a distinction that often matters to us. Undertaking a difficult task collectively can be comforting, even if only for the solidarity it may engender. Or, to take a very different case, the realization (or delusion) that the many bits of rudeness one has been suffering of late are part of a concerted effort can be of significance in identifying what one is up against: the accumulation of (...) grievances (no doubt well catalogued) is seen, not as an unfortunate coincidence of affronts stemming from various quarters, but as itself a product of a unified exercise of agency. A paranoid conspiracy theorist is not usually to be taken seriously. But he does get right that it certainly would be awful, for example, if everyone were out to get him and were working together to do so. After all, the stability and impact of agency that's shared can be expected to be more serious than the effects of a mere collection of individual acts.[1.. (shrink)

One important thesis Ásta defends in Categories We Live By is that social properties and categories are somehow dependent on our thoughts, attitudes, or practices—that they are inventions of the mind, projected onto the world. Another important aspect of her view is that the social properties are related to certain base properties; an individual is placed in a category when the relevant base properties are thought to hold of them. I see the relationship between the social and the base as (...) connected to the problem of explaining how the social properties are sufficiently stable so as to be taken seriously, both in theoretical endeavors as well as in practical matters of how we relate to each other. In this light, I identify stability constraints for an adequate account of social categories. I argue that certain distinctive aspects of Ásta's conferralist view of social categories, such as the radical contextualism in her account of gender, undermine the stability of categories and are at odds with taking social categories seriously. I end with the suggestion that a distinctive “sheltered” form of normativity might help us do justice to Ásta's insights while avoiding some of the destabilizing elements of conferralism. (shrink)

The reasons for which I act are normally my reasons; I represent goal states and the means to attaining them, and these guide me in action. Can your reason ever be the reason why I act? If I haven’t yet taken up your reason and made it mine by representing it for myself, then it may seem mysterious how this could be possible. Nevertheless, the paper argues that sometimes one is entitled to another’s reason and that what one does is (...) to be explained in terms of it. The case for this draws on aspects of the interplay between reasons and intentions in individual agency that have not received the attention they deserve. The paper closes by exploring the limits of interpersonal entitlement to reasons by formulating a hypothesis about which reasons one might be entitled to, and by considering how defeaters can undermine entitlement. A meta-ethical analysis demonstrates that care ethics is a grounded in a distinct mode of moral reasoning. This is comprised primarily of the rejection of principles such as impartiality, and the endorsement of emotional or moral virtues such as compassion, as well as the notion that the preservation of relations may override the interests of the individuals involved in them. The main conclusion of such a meta-ethical analysis is that such meta-ethical foundations of care ethics are not sound. Reasonable alternatives (...) for care ethics may be its formulation as an additional principle within an established principlist framework, or the move to a dialogical ethics, where the good to be acted upon is not decided in advance but rather critically discussed and established within the encounter of the parties involved. The growth of global value chains (GVCs) and the emergence of novel forms of value chain governance pose two questions for normative business ethics. First, how should we conceptualize the relationships between members of a GVC? Second, what ethical implications follow from these relationships, both with respect to interactions between GVC members and with respect to achieving broader transnational governance goals? We address these questions by examining the emergence of transnational eco‐labeling as an increasingly prominent form of GVC governance that (...) is redefining the relationship between nominally independent firms. On the first question, we argue that GVCs occupy a middle ground between intrafirm and interfirm transactions, thereby posing a challenge to theoretical frameworks that attempt to apply ethical standards based on transaction types. On the second question, we argue that this unique institutional status leads to a range of novel ethical considerations and dilemmas for GVC members. Lead firms, their suppliers, and third‐party standard‐setters all confront new ethical quandaries when third‐party eco‐labeling is introduced to a GVC. The nature of these quandaries means that, while GVCs may be well‐positioned to serve as instruments of transnational governance, they are frequently not well‐oriented to do so. Our analysis marks an initial attempt to map the ethical considerations that apply to members of a GVC, and in doing so, places the literature on normative business ethics and transnational governance in a closer conversation. What is it for a duty or obligation to be directed? Thinking about paradigmatic cases such as the obligations generated by promises will take us only so far in answering this question. This paper starts by surveying several approaches for understanding directed duties, as well as the challenges they face. It turns out that shared agency features something similar to the directedness of duties. This suggests an account of directedness in terms of shared agency – specifically, in terms of the (...) so-called practical intimacy that holds between individuals when they act together. The final section addresses a challenge to the shared agency approach posed by legal wronging in tort law. (shrink)

This study examines the ends of medical intervention and argues that mainstream contemporary medicine assumes that appropriate ends may be discovered (i.e., naturalism), rather than created or decided upon (i.e., conventionalism). The essay then applies these considerations to the problem of the demarcation of the normal from the pathological. I argue that the common formulations of this dispute commit a fallacy, as they characterize the "normal" as a state of the organism and not as an ongoing process within it. Such (...) a process may be characterized as self-creation and self-repair. Such considerations support the conclusion that normality may be regarded as a regulative idea, rather than as an end-state, and as part of the ends of medical intervention, depending upon choice and context. Este artigo examina a relação entre subjetividade e vontade à luz de alguns resultados parciais obtidos em nossa pesquisa sobre a filosofia de Henri Bergson, cujo carro-chefe é a noção de “duração”. Pensar a subjetividade a partir da duração significa admitir que a transição ininterrupta que vai do passado para o futuro passando pelo presente é a temporalidade atuando no nível mais simples de nossa relação com o mundo. Destacamos a subjetividade a partir da duração porque já na percepção estamos (...) evocando o passado para iluminar o presente e, assim, podemos compreender o “problema” da subjetividade a partir de uma ação na qual se observa uma diferença de funções: a diferença entre o presente que atua e o passado que já não atua. É precisamente esse caráter temporal da ação que leva os comentadores de Bergson a interpretarem de maneira original a gênese da subjetividade, o papel da memória na percepção e a conceberem novos sentidos para o conceito de “vontade”. Por conseguinte, a estrutura argumentativa que adotamos neste texto deverá mover-se em três níveis de análise que correspondem, respectivamente, a três aspectos da subjetividade humana (percepção, memória e vontade). Desse modo, pretendemos ressaltar a temporalidade viva como marca registrada do bergsonismo. (shrink)

However, many take a further step, claiming that corporations are normatively distinct from other market actors because of this governmental provenance. They are mistaken. Like corporations, markets and contracts also require government for their creation. Governmental provenance does not distinguish corporations normatively because our coercive social institutions are pro tanto justified in re-arranging both corporate and non-corporate market activities on behalf of social and political values. It is only in the past 20 years that the concept of 'recovery' from mental health has been more widely considered and researched. This book is unique in addressing philosophical issues - including conceptual challenges and opportunities - raised by the notion of recovery of people with mental illness.

Several theorists have defended that unpleasantness can be explained by appealing to (intrinsic, simultaneous, de re) desires for certain experiences not to be occurring. In a nutshell, experiences are unpleasant because we do not want them, and not vice versa. A common criticism for this approach takes the form of a Euthyphro dilemma. Even if there is a solution for this criticism, I argue that this type of approach is limited in two important ways. It cannot provide an explanation for: (...) i) the motivation, from a psychological conscious point of view, nor ii) a non-instrumental justification, for having the relevant desires. The lack of these explanations is relevant since these are precisely the type clarifications that we would expect from a theory about unpleasantness. (shrink)

In an important new book on shared agency, Michael Bratman develops an account of the normative demand for the coordination of intentions amongst participants in shared agency. Bratman seeks to understand this form of normative guidance in terms of that associated with individual planning intentions. I give reasons to resist his form of reductionism. In addition, I note how Bratman’s discussion raises the interesting issue of the function or purpose of shared intention and of shared agency more generally. According to (...) Bratman, the function of shared intention is to promote interpersonal coordination of intention and action. I suggest that power sharing amongst participants must also be included as a function of shared intention. (shrink)

Contributors investigate environmental issues concerning the human impact on geohistory, food distribution, genetically modified biota, waste management, scientific mapping, and the rethinking of human identity.

In this Article we explore the evolution of property law and examine the applicability of the prevailing accounts according to which property institutions oscillate between the extreme points of open access and private property. We show that the evolution of property is a much more nuanced process, shaped by the interplay of the following three dimensions: number of owners, extent of dominion and asset configuration. Accordingly, property institutions can assume a myriad of positions along the aforementioned dimensions in response to (...) the constant change in exclusion and management costs. We demonstrate our theory by discussing examples of three dimensional adjustments of real, personal and intellectual property. (shrink)

What are the implications for agency – and in particular, the idea of acting for reasons – if we are to take seriously the notion of collective responsibility? My thesis is that some cases of individuals subject to a collective form of responsibility and blame will force us to make sense of how it is that an individual can be entitled to collective reasons for action, i.e. entitled to a reason had in the first place by a plurality of individuals (...) together rather than any one of them alone. This entitlement makes it possible for the collective reason to be a reason for which one acts, even if one’s contribution on its own makes little or no difference in the collective effort. Although a full defense of this entitlement cannot be undertaken here, I will gesture at how this might work by suggesting that intentions function to preserve reasons for action. . (shrink)

Some of the reasons one acts on in joint action are shared with fellow participants. But others are proprietary: reasons of one’s own that have no direct practical significance for other participants. The compatibility of joint action with proprietary reasons serves to distinguish the former from other forms of collective agency; moreover, it is arguably a desirable feature of joint action. Advocates of “team reasoning” link the special collective intention individual participants have when acting together with a distinctive form of (...) practical reasoning that purports to put individuals in touch with group or collective reasons. Such views entail the surprising conclusion that one cannot engage in joint action for proprietary reasons. Suppose we understand the contrast between minimal and robust forms of joint action in terms of the extent to which participants act on proprietary reasons as opposed to shared reasons. Then, if the team reasoning view of joint intention and action is correct, it makes no sense to talk of minimal joint action. As soon as the reason for which one participates is proprietary, then one is not, on this view, genuinely engaged in joint action. (shrink)

Boxing was arguably the most popular and controversial sport in colonial Zimbabwe. To tame the sport's violence, which was considered too extreme, colonial officials in Zimbabwe sought guidance and advice from South Africa from the mid-1930s on how best to regulate the sport. South Africa occupied a unique position in this regard, not only because of the relationship it had with colonial Zimbabwe as a neighbouring white settler colony, but also because of how sections of its white settler community responded (...) to the triumphs of Black boxers over white opponents around the world. The colony of South Africa played a significant role in shaping the control of boxing in colonial Zimbabwe. The relationship between the two colonies culminated in the passage of the Boxing and Wrestling Control Act of 1956 in colonial Zimbabwe, an identical version to a similarly named law that South Africa had passed just two years prior. In this thesis I provide an account of the unpleasantness of pain. In doing this, I shed light on the nature of pain and unpleasantness. I propose to understand the unpleasantness of pain based on the determinable-determinate distinction. Unpleasantness is a determinable phenomenal property of mental states that entails badness. I propose that an unpleasant pain experience has two phenomenal properties: i) the phenomenal property of being a pain, and ii) a phenomenal determinate property (u1, u2, u3, etc.) of the (...) unpleasantness determinable. According to this theory unpleasant pains feel bad, and this explains why we are motivated and justified in avoiding them. This explains, for example, why we are motivated and justified to take painkillers. This theory allows us to account for the heterogeneity of unpleasantness, i.e., we can explain how different unpleasant experiences feel unpleasant even if they feel so different. -/- The thesis is organised into seven chapters and divided by three main themes: i) what the unpleasantness of pain consists in, ii) how we can account for the great phenomenal diversity among experiences of unpleasantness, and iii) which cases suggest that there could be pains that are not unpleasant. Broadly, the first two chapters deal with the first theme, where I analyse two reductive accounts of unpleasantness: the content theories and the desire theories. I deal with the second theme in the third and fourth chapter, where I analyse different theories that try to account for the phenomenal property of unpleasantness. In the fifth and sixth chapter, I focus on the third theme, where I consider different cases that suggest the existence of pains that are not unpleasant. In the final chapter, I offer a conclusion of the three main themes by providing my own view on the unpleasantness of pain. (shrink)

The biblical text accords a great deal of attention to King Solomon’s personal abilities and governmental power. Solomon was described as a judge, poet, constructor and the wisest of all people in the Ancient Near East and Egypt. The current study discusses the interpretation of the midrashim that show how Solomon’s wisdom was manifested in his considerable knowledge of ornithomancy, that is, divination using birds, a practice that was considered as an important wisdom in the ancient world because of its (...) practical applications, particularly in the military sphere. It seems that Solomon’s portrayal as a magician is intended and aimed at emphasising his abilities and his impressive character. Moreover, it may have had the purpose of disproving the conception of Solomon as inferior to his surroundings in this respect and the idea that he or his kingdom could be controlled by nations that command this type of wisdom. Ancient Jewish law took a strict approach to medical relationships between Jews and non-Jews. Sages forbade Jews to provide non-Jews with medical services: to treat them, circumcise them, or deliver their babies, in order to refrain from helping pagan-idolatrous society. Such law created particularly severe social conflicts in cases of mixed societies based on joint systems. The current paper focuses on the attitude of Moses ben Maimon, a medieval Sephardic Jewish Rabbi towards providing medical service to gentiles. Following the classical (...) rabbis R. Moshe ben Maimon in his halakhic tome Mishne Torah, objected to treating non-Jews. His rigid attitude found expression in several aspects of helping and giving medical treatment to non-Jews. Despite the classical rabbinical restrictions on medical relationships between Jews and non-Jews, and his own rigid halakhic verdicts, Maimonides treated gentiles. According to one understanding, Maimonides cured Muslims for a wage, which is permitted. However, it seems that the main factor that may have facilitated Maimonides halakhic position is the identification of Islam as a non-idolatrous faith. Interestingly not only on medical issues did the Maimonides act differently than his halakhic rulings in Mishne Torah, rather in other areas as well. (shrink)

Humor, laughter, joke telling can be frivolous fun or it could act as a sword and a shield to defend and protect us against life. Humor can, at times, illuminate if not completely explain, some of the irresoluble problems and mysteries that individuals face. And, if all else fails, humor can hold off our fear of the unanswerable and the unacceptable.
