El objetivo de este artículo es comentar las prácticas que lleva a cabo el equipo docente de la asignatura Epistemología y Metodología de la Investigación en Ciencias Jurídicas (FCEJS-UNSL) –cuya actividad inició en 2012– respecto de la enseñanza del derecho desde una perspectiva compleja. Concebir lo jurídico desde tal enfoque implica considerar la diversidad de las realidades actuales. Asimismo, si se asume que los entornos son múltiples, heterogéneos, no es posible estudiarlos desde un único campo de conocimiento. Adoptar tales miradas (...) epistemológicas necesita de una actitud pedagógica que se adapte al cambio. Por ende, este texto evidenciará las formas en que una asignatura de grado afronta desafíos cotidianos para plantear estrategias que pongan en cuestión el sentido jurídico dominante y, a partir de ello, trascender el positivismo. Por otra parte, a toda la humanidad sorprendió la situación suscitada a partir de la pandemia por COVID-19, que mostró la importancia de asumir una didáctica dinámica. Por ello, también se dará cuenta de las adaptaciones realizadas por el equipo docente para atender a ese nuevo contexto. (shrink)

: C.S. Peirce defines mathematics in two ways: first as "the science which draws necessary conclusions," and second as "the study of what is true of hypothetical states of things" (CP 4.227–244). Given the dual definition, Peirce notes, a question arises: Should we exclude the work of poietic hypothesis-making from the domain of pure mathematical reasoning? (CP 4.238). This paper examines Peirce's answer to the question. Some commentators hold that for Peirce the framing of mathematical hypotheses requires poietic genius but (...) is not scientific work. I propose, to the contrary, that although Peirce occasionally seems to exclude the poietic creation of hypotheses altogether from pure mathematical reasoning, Peirce's position is rather that the creation of mathematical hypotheses is poietic, but it is not merely poietic, and accordingly, that hypothesis-framing is part of mathematical reasoning that involves an element of poiesis but is not merely poietic either. Scientific considerations also inhere in the process of hypothesis-making, without excluding the poietic element. In the end, I propose that hypothesis-making in mathematics stands between artistic and scientific poietic creativity with respect to imaginative freedom from logical and actual constraints upon reasoning. I argue against the tendency in the philosophy of science literature to link abduction to the inference to the best explanation (IBE), and in particular, to claim that Peireean abduction is a conceptual predecessor to IBE. This is not to discount either abduction or IBE. Rather the purpose of this paper is to clarify the relation between Peireean abduction and IBE in accounting for ampliative inference in science. This paper aims at a proper classification—not justification—of types of scientific reasoning. In (...) particular, I claim that Peireean abduction is an in-depth account of the process of generating explanatory hypotheses, while IBE, at least in Peter Lipton's thorough treatment, is a more encompassing account of the processes both of generating and of evaluating scientific hypotheses. There is then a two-fold problem with the claim that abduction is IBE. On the one hand, it conflates abduction and induction, which are two distinct forms of logical inference, with two distinct aims, as shown by Charles S. Peirce; on the other hand it lacks a clear sense of the full scope of IBE as an account of scientific inference. (shrink)

From our deep interest in the neuroconstructivist framework, we would like to comment on two fundamental aspects of Mareschal et al.'s work: the role of neuroconstructivism for clinical work with people suffering from developmental disorders; and the relation between the process of progressive specialization and the increasing abstraction of representations in development.

We show a sentence and modal square of opposition and equivalence to be expanded into an hexagon according to oe suggestion from William of Sherwood. This expansión is permittedby two sentence and modal rules.The logical relations of the square allow us to formulate several theorems in order to show a glimpse of the Medieval Logic complexity.

Understanding positive emotions' shared and differentiating features can yield valuable insight into the structure of positive emotion space and identify emotion states, or aspects of emotion states, that are most relevant for particular psychological processes and outcomes. We report two studies that examined core relational themes (Study 1) and expressive displays (Study 2) for eight positive emotion constructs—amusement, awe, contentment, gratitude, interest, joy, love, and pride. Across studies, all eight emotions shared one quality: high positive valence. Distinctive core relational theme (...) and expressive display patterns were found for four emotions—amusement, awe, interest, and pride. Gratitude was associated with a distinct core relational theme but not an expressive display. Joy and love were each associated with a distinct expressive display but their core relational themes also characterised pride and gratitude, respectively. Contentment was associated with a distinct expressive display but not a core relational theme. The implications of this work for the study of positive emotion are discussed. (shrink)

Moral reasoning typically informs environmental decision-making by measuring the possible outcomes of policies or actions in light of a preferred ethical theory. This method is subject to many problems. Environmental pragmatism tries to overcome them, but it suffers also from some pitfalls. This paper proposes a new method of environmental pragmatism that avoids the problems of both the traditional method of environmental moral reasoning and of the general versions of environmental pragmatism. We call it ‘justificatory moral pluralism’ – it develops (...) the intuition that normative ethical theories need not be mutually exclusive. This leaves room for important forms of pluralist environmental ethics that do not require a once-and-for-all prior commitment to an ethical theory when deciding about policies or courses of action related to the protection of the environment. Justificatory moral pluralism offers a viable solution to the recurrent conflicts between efficient environmental decisions and the need for moral reasoning. (shrink)

El objetivo de este artículo es analizar el uso del término cáncer desde una perspectiva social y su representación en la prensa española a comienzos del siglo xx, en los periódicos La Vanguardia y ABC. A partir de la hemeroteca digital de ambos medios se seleccionaron todas y cada una de las veces que se pudo identificar el término «cáncer» y su aplicación metafórica desde una perspectiva de problemática social, procediéndose a la descripción de los rasgos significativos y al análisis (...) del discurso. Encontramos un uso de la palabra cáncer como metáfora social a lo largo del periodo estudiado, siendo común extender la metáfora del cuerpo enfermo a situaciones de orden político o social. El cáncer es una enfermedad con un gran impacto en nuestra sociedad, cuya utilización metafórica es descriptiva y expresa el deseo del cambio, pero su empleo puede comportar la estigmatización de los enfermos afectados por esta patología. Palabras clave: cáncer, metáfora, sociedad, prensa, España.The objective of this article is to analyze the use of the term cancer from a social perspective and its representation in the Spanish press at the beginning of the 20th Century, in the newspapers La Vanguardia and ABC. From the digital mass media library, each and every one of the times that the term «cancer» and its metaphorical application could be identified from a perspective of the social problem was selected, proceeding to the description of the essential features and the discourse analysis. A use of the word cancer as a social metaphor was found throughout the studied period, being common to extend the metaphor of the sick body in situations of political or social order. Cancer is a disease with a great impact on our society, metaphorical use is descriptive and expresses the desire for change, but its use may involve the stigmatization of patients affected by this pathology. This book seeks to arrive at a better understanding of the relationships between the objective and subjective aspects of time. It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. According to Petersen, ‘the individualization argument against NMEF [nonmedical egg freezing]’ states: ‘it is morally wrong to let individuals use technology X [NMEF] – in order to try to handle a problem that is social in nature – if the use of X [NMEF] will somehow work against a social solution to a social problem P [gender inequality in the labor market]’. While there may be individuals making individualisation argument against NMEF, I do not read the scholars he discusses—Karey Harwood,1 (...) 2 Lynn Morgan, Janelle Taylor3 and Angel Petrapanagos4—as making this argument. These scholars agree with the premise of the individualisation argument that NMEF ‘is an individualistic and morally problematic solution to the social problems that women face’, but this does not mean that they agree with the conclusion ‘women should not use NMEF’. In fact, several admit that NMEF can be a good choice for some women; Petropanagos, for example, states ‘individual women may benefit from egg freezing to satisfy their reproductive desires’.4 In this commentary, I argue that Petersen incorrectly reduces these scholars’ positions to the individualisation argument by neglecting three pertinent factors: their feminist orientation, their multifaceted critiques of NMEF and how the rapidly advancing field of reproductive medicine informs their ethical analysis. Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. In this paper I analyze the temporal structures that are appropriate to study the notion of point of view. When we analyze the points of view and their structure, it seems clear that we must take into account the time t in which a point of view is attributed to a subject. A two-dimensional temporal logic which combines a modal dimension for possibilities and a temporal one for the flow of time, offers a clear view of the temporary location of (...) a point of view. In this logic, we have histories, thanks to the temporal dimension, and evaluation is in two indices, time and history. These stories can be seen as different scenarios, providing a clear advantage when applying to the analysis of the notion of point of view. The conclusion is that, in order to give a proper approach for the notion of point of view, all these aspects should be combined. (shrink)

Time has a highly unstable place between the objective and the subjective. On the one side, there are very well known philosophical arguments trying to show that time has only a subjective reality, even that it is merely a subjective epiphenomenon. On the other side, we are compelled to take points of view as non dispensable elements of reality, at least of a reality capable of containing beings like us. And points of view offer a world of temporal entities existing (...) in an objective way. Moreover, points of view themselves appear to be temporal entities among other temporal entities. We analyse both aspects of time. Our main focus will be McTaggart’s arguments against the reality of a fluent time, what he called temporal series of kind A. We will distinguish three very different arguments in McTaggart works. We analyse them in detail. And we reject their conclusive character. Our final target is to maintain that there is a room for fluent time in what is internal to points of view but external to the subjects adopting those points of view. (shrink)

This paper examines how alternative forms of organising integration in resource-scarce environments expand across settings, by considering the role of local embeddedness and an ethic of care in enabling this expansion. It builds on theories of imitation in organization studies in combination with theories of ethics of care and bricolage applied to welfare and migration studies. The paper is informed by the case of Yalla Trappan, a work cooperative of immigrant women in the city of Malmö, Sweden, and the attempts (...) to diffuse this organization and its methods to other cities in the country. The findings indicate that the expansion of alternative forms of integration into resource-scarce contexts is enabled by simultaneous practices of imitation and bricolage, ingrained in an ethic of care. The article shows, first, how many important practices were developed by imitating accounts of the original ideas, through a broadcasting mode of imitation. Next, it explains why the local translation of these practices in resource-scarce contexts, consisting of ‘bricolage work’ based on material, market, institutional, human, and cultural elements, was necessary. The conclusion is that the expansion of novel forms of integration requires imitation, but of a kind that involves the bricolage of local translations. Such bricolage is always collective (which does not diminish the importance of individual agency), multi-spatial and not just local, and wrapped in an ethic of care, rather than in an economic logic. The article concludes by discussing the implications of these findings with the ethics of migration. (shrink)

In Jurismania, Paul Campos asserts that our legal system is beginning to exhibit symptoms of serious mental illness. Trials and appeals that stretch out for years and cost millions, 100 page appellate court opinions, 1,000 page statutes before which even lawyers tremble with fear, and a public that grows more litigious every day all testify to a judicial overkill that borders on obsessive-compulsive disorder. Campos locates the source of such madness, paradoxically, in our worship of reason and the (...) resulting belief that all problems are amenable to legal solutions. In insightful discussions of a wide range of cases, from NCAA regulations of student-athletes to the Simpson trial, from our most intractable social disputes over abortion and physician-assisted suicide to the war on drugs and the increasingly fastidious attempts to regulate behavior in public spaces, Campos shows that the mania for more law exacerbates the very problems it seeks to remedy. In his final chapter, the author calls instead for a humbling recognition of the limits of reason and a much more modest role for our legal system. Clearly written and laced with a delicious wit, Jurismania gives us a CAT-scan of the American legal mind at work. It reveals not only that the patient is even worse off than we imagined, but also clarifies the many reasons why. (shrink)

En este trabajo ofrecemos un panorama al estudio de los sesgos. El creciente interés en ellos durante las últimas décadas radica en que estudiarlos implica hablar de cómo los seres humanos razonamos y emitimos juicios, e igualmente sobre los mecanismos y procesos que subyacen a tales capacidades, esto incluye entender cuándo y por qué frecuentemente nos equivocamos, como lo indica buena parte de la literatura en psicología cognitiva del razonamiento. Dada la existencia de los sesgos, han surgido posturas pesimistas que (...) sostienen que los sesgos muestran que los humanos son irracionales. Frente a estas, la literatura reciente ofrece visiones mas optimistas, y aduce que los sesgos pueden “desaparecer” si se tienen en consideración diferentes aspectos de tipo evolutivo. Otra postura es aquella que sostienen que la supervivencia humana no yace en la inteligencia individual sino en la colectiva. Es decir, que podemos dejar de confiar exclusivamente en el contenido de nuestra mente y en su lugar resolver los problemas colectivamente, gracias a la división de las tareas cognitivas. Para organizar la exposición dividimos el trabajo en tres enigmas de los sesgos cognitivos. El primero consiste en una discusión sobre el origen de los sesgos. El segundo concierne a su clasificación e inventarios. El tercer enigma versa sobre la unidad de análisis de la cognición humana, a saber, inteligencia individual versus inteligencia colectiva. Con estos enigmas queremos poner de manifiesto el abanico de discusiones que giran alrededor de los sesgos, sus problemas, así como la creciente fascinación por entenderlos. Estudiar los sesgos abona a la comprensión de cómo razonamos o pensamos, y esto nos ayuda a mejorar nuestro pensamiento crítico. (shrink)

In this study, we evaluate how individual virtues and inter-organizational management control systems influence buyer–supplier performance through relationship quality. Results from a sample of 232 firms confirm that virtues and IOMCS relate positively to relationship quality and performance, respectively. However, IOMCS lose their positive influence on relationship quality when considered along with virtues. That is, when both variables enter the regression model simultaneously, virtues win. This interesting finding has particular resonance at a time when research on ethics still needs to (...) reinforce its positive effects on the practice of management. (shrink)

Discussions of reproductive responsibility generally draw heavily upon the principles of nonmaleficence and beneficence. However, these principles are typically only applied to women due to the incorrect belief that only women can cause fetal harm. The cultural perception that women are likely to cause fetal and child harm is reflected in numerous social norms, policies, and laws. Conversely, there is little public discussion of men and fetal and child harm, which implies that men do not (or cannot) cause such harm. (...) My goal in this paper is to begin to fill the void in the academic literature about men’s reproductive responsibility by highlighting the health-related, economic, and social harms men can cause to potential fetuses and children and then examining what it would mean to hold them responsible for preventing these harms. Applying the principles of nonmaleficence and beneficence to men, I conclude that men have a moral duty to use contraception if their behavior—past, current, or future—could harm the potential fetuses and children who result from their unprotected sexual behavior. An individual’s right to refuse life-sustaining treatment is a fundamental expression of patient autonomy; however, supporting this right poses ethical dilemmas for healthcare providers when the patient has attempted suicide. Emergency physicians encounter patients who have attempted suicide and are likely among the first medical providers to face the dilemma of honoring the patient’s DNR or intervening to reverse the effects of potentially fatal actions. We illustrate this issue by introducing a case example in which the DNR of a terminally (...) ill woman was not honored because the cause of her cardiac arrest was suicide. We argue that although a terminal diagnosis should change the way health care providers respond to a suicide attempt, many of the theoretical underpinnings for how one should treat suicide attempts—especially the criterion of external reasonability, that is the action to withhold or withdraw life-sustaining measures is reasonable independent of the precipitating event—are common to all situations :3–12, 2013). The presumption that patients who attempt suicide lack capacity due to acute mental illness is flawed because it fails to account for a competent individual’s reasonable preference to not be forced to live in an unbearable, terminal condition. In states without legislation allowing physician aid in dying, patients and providers must grapple with these limitations on a case-by-case basis. In cases where the patient has a limited life expectancy and there is not concern for psychiatric illness as the primary cause of the suicidal action, we argue that the negative right to refuse life-sustaining treatment should prevail. Next, we will look at the possible affinities between the description of Dionysian madness (_Phdr_. 244d5-245a1) and the type of divination practiced by Epimenides of Crete (DK 3 B 1-25). From these approaches, we intend to describe and elucidate the common imaginary with which Plato elaborates (...) his reception and assimilation of the archaic poetic tradition in his philosophy. Em meio às clarividências de Sosípatra, veremos os episódios que a levaram ainda muito jovem às iniciações teúrgicas e algumas poucas cenas adicionais de sua vida adulta. This commentary defines what shared yet differentiated ethical responsibilities to tackle antimicrobial resistance (AMR) mean, by introducing a threefold principled account of AMR global governance. It argues that the principles of solidarity, subsidiarity, and stewardship can be especially helpful for further justifying some of the universal, differentiated, and individual responsibilities that Van Katwyk et al propose. The upshot of my threefold principled account of AMR global governance is a less ambitious AMR treaty, one that can only justify (i) universal duties (...) of global coordination (as per the principle of solidarity); (ii) differentiated duties to local communities, which bear the primary AMR responsibilities (as per the principle of subsidiarity); and (iii) individualized duties for ensuring truthful, evidence-based, consistent, and timely shared accountable communication (as per the principle of stewardship). This paper argues that the existing definition of pandemics is not nuanced enough, because it is predicated solely on the criterion of spread, rather than on the criteria of spread and severity. This definitional challenge is what I call ‘the conflation problem’: there is a conflation of two different realities of global health, namely global health emergencies (i.e., severe communicable diseases that spread across borders) and nonemergencies (i.e., communicable or noncommunicable diseases that spread across borders and that may be severe). (...) To put this argument forth, this paper begins by discussing the existing and internationally accepted definition of pandemics, its requirements, as well as its strengths (section 1). Section 2 then considers the problem with the standard definition of pandemics (i.e., the conflation problem) and some examples of it. Finally, section 3 evaluates some practical implications of the conflation problem to then explore conceptual clarity as the adequate solution. (shrink)

Neste artigo, buscaremos refletir sobre como Hannah Arendt concebe um certo tipo de educação ao mesmo tempo _conservadora_ e _revolucionária_. Este será, assim como a indicação de que pensar sobre a questão educacional das crianças e jovens diz respeito a uma crise mais geral na modernidade, um ponto de tensionamento rumo à hipótese segundo a qual é possível refletir sobre como inserir os imigrantes, refugiados ou apátridas em um local ao qual se dirigiram e que lhes é estranho. Para tanto, (...) o fio condutor desta argumentação será o conceito de natalidade, pois consideramos ser a partir dele que Arendt evoca a radicalidade da qual todos os seres humanos são portadores, isto é, a potencialidade de começar algo novo. Assim, articulam-se os tensionamentos entre conservar um mundo que é precedente aos que lhe são recém-chegados, tanto as crianças como os migrantes, ao mesmo tempo em que estes adicionam algo de si mesmo neste mundo para os que ainda estão por vir. This article examines the relation between the dialectical program established in Plato’s Republic and the practice of dialectic in other dialogues, such as the Parmenides and the Theaetetus. The author argues against those scholars who have sustained a sharp distinction between an intuitive conception of knowledge and the discursive practices characteristic of Plato’s concept of dialectic. In his view, Plato has been overinterpreted from the modern perspective of the distinction between intuitive and discursive forms of knowledge. As a consequence, this (...) article also examines the relation between the dialectical practices displayed in the Parmenides and the Theaetetus and the anhypothetical condition that Plato attributes to “the principle of everything” in the Republic. Este trabajo esboza una forma de justificar el principio estructurador central de una teoría veritista de la evaluación epistémica, en respuesta a críticas planteadas por Eleonora Cresto a mi defensa del veritismo frente a una serie de objeciones en el sentido de que no es capaz de explicar la naturaleza y el valor del entendimiento. La primera sección presenta el esbozo de justificación del núcleo de una teoría veritista; la segunda responde a críticas más específicas de Cresto. This paper sketches (...) a way to justify the central tenet of a veritistic theory of epistemic evaluation, in response to problems raised by Eleonora Cresto concerning my defense of veritism, against a series of objetions to the effect that veritistic epistemology is uncapable of explaining the nature and value of understanding.
