It is not possible to talk about bioethics without recognizing the plurality inherent in it. In this sense, the notion of person is important due to its multiplicity of possible interpretations depending on its cultural context. This fact is highlighted in the case of organ transplantation in Japan. While there are many critiques against this procedure from scholars in various fields, those that deal with the problem of brain death are especially problematic. This is because the definition of person that (...) is invoked in such debates does not seem to coincide with how the notion of person has been understood in the Japanese tradition. Hence, investigating the Japanese concept of ningen could be helpful in not only partially clarifying some of the attitudes that exist in Japan towards the notion of brain death, but also to illustrate the need to recognize the plurality of views in modern bioethics. One of the most remarkable implications of psychological medicine in the transition from the 18th to the 19th century was the advent of a new way of looking at the human being and new tools for analysing not only behaviour and individual experience, but also historical events, collective behavioural patterns or complex cultural achievements. Unsurprisingly, the deployment of this gaze could not advance without there being a series of disputes and controversies about its reach and the limits to its indiscriminate (...) application. Focusing on the figure of French alienist Alexandre Brierre de Boismont and on the controversial cases of hallucinations and suicide, this article addresses the conflicts generated by the use of certain emblematic concepts and categories present in French psychological medicine throughout the central decades of the 19th-century, as well as the essentially ambivalent relationship of the psychopathological point of view with the criticism of a culture that was made responsible, then, as now, for a great number of psychological disorders and illnesses. I discuss in detail the contents of the adiabatic hypothesis, formulated by Ehrenfest in 1916. I focus especially on the paper he published in 1916 and 1917 in three different journals. I briefly review its precedents and thoroughly analyze its reception until 1918, including Burgers’s developments and Bohr’s assimilation of them into his own theory. I show that until 1918 the adiabatic hypothesis did not play an important role in the development of quantum theory.

Many contemporary thinkers of the Anthropocene, who attempt to articulate a non-modern and relational ontology, all too readily dismiss critical theory inherited from the Frankfurt School for being anthropocentric, failing to acknowledge certain basic similarities. Instead, this article argues that the scaffolding of Anthropocene thinking—the recognition of the origins of the contemporary condition of ‘loss of world’ and the hope of ‘living on in the ruins’—share much with earlier critical theorists’ recognition that the Holocaust necessitated a fundamental break with the (...) past. In reading these two sets of literatures together, we suggest we can get a better grasp of the stakes involved in the contemporary crisis of critique, and in the speculative framings enabling alternative futures to come into being. This paper describes the approach of empirical ethics, a form of ethics that integrates non-positivist ethnographic empirical research and philosophy. Empirical ethics as it is discussed here builds on the ‘empirical turn’ in epistemology. It radicalizes the relational approach that care ethics introduced to think about care between people by drawing in relations between people and technologies as things people relate to. Empirical ethics studies care practices by analysing their intra-normativity, or the ways of living together the actors within these (...) practices strive for or bring about as good practices. Different from care ethics, what care is and if it is good is not defined beforehand. A care practice may be contested by comparing it to alternative practices with different notions of good care. By contrasting practices as different ways of living together that are normatively oriented, suggestions for the best possible care may be argued for. Whether these suggestions will actually be put to practice is, however, again a relational question; new actors need to re-localize suggestions, to make them work in new practices and fit them in with local intra-normativities with their particular routines, material infrastructures, know-how and strivings. Our object in this paper is to study the antecedents, contents, implications, and impact of a not well-known or appreciated paper by EHRENFEST in 1911 on the essential nature of the different quantum hypotheses in radiation theory. After a careful analysis of EHRENFEST’s notebooks, correspondence, and publications, we conclude that the essential points of EHRENFEST’s paper were not perceived to a large extent, and hence that its implications were not considered thoroughly. Specifically, we show that EHRENFEST contributed significantly to the (...) clarifications of the differences between PLANCK’s and EINSTEIN’s respective quantum hypotheses, as well as to those of the concepts ‘‘discontinuity,’’ ‘‘quantization,’’ and ‘‘corpuscularity.’’. ‘Reasoning’ can be considered a general concept that, upon speaking, is the ‘enraonar’, a Catalan word that should not be mistaken with ‘explain’ nor with ‘discuss’ which imply more detail, and cover different situations. This article is presented as an essay on the ancient ideal of ‘enraonar’. To that end, it is explained in what sense ‘enraonar’ and reason are one of the most complex phenomena thought has to deal with. Here it is argued that these natural phenomena require a (...) systematic and ‘scientific’ study, and that withoutthis knowledge computer science cannot simulate people’s every-day ‘enraonar’. Tal definición se aplica a casos provenientes de diversos campos, muchos de los cuales exhiban la propiedad da rotura de las cadenas de objetos relacionados a causa de un cierto parecido.

Science and technology studies concerned with the study of lay influence on the sciences usually analyze either the political or the normative epistemological consequences of lay interference. Here I frame the relation between patients, knowledge, and the sciences by opening up the question: How can we articulate the knowledge that patients develop and use in their daily lives and make it transferable and useful to others, or, `turn it into science’? Elsewhere, patient knowledge is analyzed either as essentially different from (...) or similar to medical knowledge. The category of experiential knowledge is vague and is used to encompass many types of experience, whereas the knowledge of the `expert patient’ may be assumed to have the shape of up-to-date medical information. This paper shows through a case study of people with severe lung disease that patient knowledge can be understood as a form of practical knowledge that patients use to translate medical and technical knowledge into something useful to their daily life with disease. Patients coordinate this with homegrown know-how and advice from fellow patients, weighing different values - of which `taking good care of one’s body’ is but one - that may conflict in a specific situation. These practices result in sets of techniques that may be made useful to others. The paper argues for two alternatives to state-of-the-art medical research to turn patient knowledge into science: ethnographies of knowledge practices and the collection and making accessible of techniques. Nurses and ethicists worry that the implementation of care at a distance or telecare will impoverish patient care by taking out ‘the heart’ of the clinical work. This means that telecare is feared to induce the neglect of patients, and to possibly hinder the development of a personal relation between nurse and patient. This study aims to analyse whether these worries are warranted by analysing Dutch care practices using telemonitoring in care for chronic patients in the Netherlands. How do clinical (...) practices of nursing change when telecare devices are introduced and what this means for notions and norms of good nursing? The paper concludes that at this point the practices studied do not warrant the fear of negligence and compromised relations. Quite the contrary; in the practices studied, telecare lead to more frequent and more specialised contacts between nurses and patients. The paper concludes by reflecting on the ethical implications of these changes. (shrink)

Este artículo trata sobre la labor llevada a cabo por el iusfilósofo Luis Recaséns Siches de renovación de la Filosofía del Derecho en España mediante la introducción de los postulados neokantianos y kelsenianos. Lo que se puede denominar el proyecto Recasens fue, sin embargo, abruptamente interrumpido por el estallido de la Guerra Civil. Las críticas al neokantismo que contiene fueron incorporadas en trabajos posteriores de Recasens, así como en la obra del profesor Legaz y Lacambra, conservando de este modo (...) el proyecto algo de su impulso inicial. ABSTRACT. This article addresses the renovation effort conducted by the Law philosopher Luis Recaséns Siches, who aimed to update Philosophy of Law in Spain through the introduction of neokantian and kelsenian postulates. What can be denominated as “the Recaséns’ project” was, however, harshly interrupted by the outbreak of the Spanish Civil War. The judgments targeting neokantism that can be found in such texts were included in Recaséns’ later publications, as well as in the work of the professor Legaz y Lacambra, hence yielding the project to maintain some of its original impulse. Justice and the Integrity of the Person, Cécile Fabre defiende que, en nombre de la justicia, los recursos de una sociedad deben redistribuirse entre los necesitados y que, entre esos recursos, está incluida la sangre humana, para cuya provisión propone la creación de un servicio civil obligatorio de donación de sangre. Justice and the Integrity of the Person, Cécile Fabre argues that, on behalf of justice, resources of a society should be redistributed to the needy and that, among those resources, human blood is included. For the provision of this material, she proposes the creation of a mandatory civilian service of blood donation. After a contrast of the the prima facie complexity of the causality of the rational agent with the received scientific doctrine of causality, it is noticed that the prima facie causal authority of rational action belongs to a macroscopic domain in which all science and philosophy takes place and in which the formal/telic nature of that causality must be taken for granted. Any philosophical justification or philosophical criticism of the status of that macroscopic arena must therefore take place within that (...) same arena. It is then argued that a justification of the ontological status of that arena is possible by an exploitation of the reflexive resource of the rational awareness we exercise within that arena. It is claimed that this resource can be fairly described as the justification of our direct knowing of real beings/entities other than the knower and that such realistic knowing is at the same time an exemplary mode of causality having a complexity that is both formal/telic and hierarchical . This paper provides an interpretation, based on the social systems theory of German sociologist Niklas Luhmann, of the recent paradigmatic shift of mental health care from an asylum-based model to a community-oriented network of services. The observed shift is described as the development of psychiatry as a function system of modern society and whose operative goal has moved from the medical and social management of a lower and marginalized group to the specialized medical and psychological care of the whole population. From this theoretical viewpoint, the wider deployment of the modern social order as a functionally differentiated system may be considered to be a consistent driving force for this process; it has made asylum psychiatry overly incompatible with prevailing social values (particularly with the normative and regulative principle of inclusion of all individuals in the different functional spheres of society and with the common patterns of participation in modern function systems) and has, in turn, required the availability of psychiatric care for a growing number of individuals. After presenting this account, some major challenges for the future of mental health care provision, such as the overburdening of services or the overt exclusion of a significant group of potential users, are identified and briefly discussed. This article offers a comprehensive critical review of the most popular theoretical accounts on the recent processes of deinstitutionalization and reform of mental health services and their possible underlying factors, focusing in the sharp contrast between the straightforward ideas and models maintained by mainstream psychiatry and the different interpretations delivered by authors coming from the social sciences or applying conceptual tools stemming from diverse social theories. Since all these appraisals tend to illuminate only some aspects of the process while obscuring (...) others, or do not fit at all with some important points of the actual changes, it is concluded that the quest for an adequate explanation is far from having been completed. Finally, some methodological and conceptual strategies for a renewed theoretical understanding of these significant transformations are also briefly discussed, including a comprehensive empirical evaluation of the facts, the consideration of the shifting social values and needs involved in mental health care provision and the historical analysis of deinstitutionalization policies within the framework of the broader social and cultural trends of the decades following World War II. This article is devoted to give reasons against the naturalization of logic, in a sense which entails a revision of this science. The paper criticizes each historical important attempt to revise logical laws – intuitionism, quantum logic, alternative logics – and also it tries to argue that the explanation problem of quantum mechanics has nothing to do with a naturalization of logic.

Basadas en un modelo matemático muy simple del razonamiento de sentido común, se presentan algunas reflexiones acerca de lo que podría ser pensar y razonar sin especular. Es decir, si razonar sólo fuese deducir y abducir pero sin inducir.

Both Ricoeur and Foucault, apparently independently of each other, dedicated much effort to provide an account of truth that goes far beyond the truth of sentences, propositions, or judgments. While well aware of the speech act theory and pragmatics, they want to go beyond a formalism of rules of speech or arguments and integrate the attitude of the one who speaks in the very notion of truth. They see truth not merely as a property of statements, but as an existential (...) process in such a way that the truth of statements is linked to the historically situated speaker. Truth as a property of statements is related to truth as an event. However, both reject any form of historicism or relativism. I examine Ricoeur's notion of attestation and Foucault's notion of parrhesia, showing how both notions represent a kind of “poetics of truth”, which combines the existential position of the speaker and the historical circumstances of utterance. I show the extent to which both poetics of truth are political and ethical and how successful each poetics is: Ricoeur believes that he can maintain a claim to universality whereas Foucault abandons such a claim and instead subscribes to a radical singularity of the event of speech in a mode of truth that is, as he says, “polemic”. El cálculo proposicional se basa proposiciones que son tautologías, antilogías y de tipo contingente, construidas con las operaciones de disyunción, conjunción, y negación, así como con el llamado condicional material para trasladar los enunciados condicionales. Con todo ello se obtiene una estructura de álgebra de Boole, que permite equiparar el cálculo proposicional al cálculo algebraico booleano. En parte, la simplificación conceptual que se obtiene resulta de ser el orden parcial del álgebra equivalente a la afirmación del condicional material. Además, con (...) tal metodología cabe ver qué partes del cálculo proposicional clásico pueden trasladarse, aun con limitaciones, a estructuras más débiles y, a la vez, más generales, como son los ortoretículos no booleanos o las álgebras de De Morgan.El cálculo proposicional trata con la deducción. Por ello, el artículo lo desarrolla a partir de un operador de consecuencias en el sentido de Tarski. Ampliado el modelo deductivo, es fácil ver otras consecuencias que las usualmente consideradas en los textos elementales; en particular, se analizan cuatro esquemas de razonamiento deductivo típicos y, entre ellos, se presta especial atención a los usuales Modus Ponens y Modus Tollens. En el caso de las estructuras algebraicas de conjuntos ‘borrosos’, ninguna es de álgebra de Boole ni siquiera de orto-retículo y sólo cabe trabajar, en algunos casos, con álgebras de De Morgan-Kleene. Por lo tanto el cálculo proposicional ‘fuzzy’ debe construirse de acuerdo con la estructura algebraica que corresponda en cada caso y una vez elegida como representación del condicional una función que verifique el Modus Ponens. We analyze the evolution of EHRENFEST's thought since he proved the necessity of quanta in 1911 until the formulation of his adiabatic hypothesis in 1914. We argue that his research contributed significantly to the solution of critical problems in quantum physics and led to a rigorous definition of the range of validity of BOLTZMANN's principle.

The human enhancement debate typically centres on moral issues regarding changes in human nature, not on the means for these changes. We argue that one cannot grasp what is morally salient about human enhancement without understanding how technologies affect human action and practical reasoning. We present a minimalist conception of human agents as bounded practical reasoners. Then, we categorise different effects of technologies on our possibilities for action and our evaluation of these possibilities. For each, we discuss whether enhancement technologies (...) have morally salient effects; which technologies show these effects; and whether these differ significantly from those of other, non-enhancement technologies. We conclude that enhancement technologies are morally salient in several respects, that not all enhancement technologies share all those morally salient respects, and that continuities with traditional technologies may be found in all morally salient respects. This article analyzes how the recent call for accounting in health care interferes with daily care practice and raises the question of how accounting practices relate to the aim of good care. The most influential accounting methods in the Netherlands suggest ways for professionals to legitimize their activities. The analysis of washing patients in long-term mental health care shows that different styles of accounting evaluate and legitimize care while structuring notions of what good care is. A specific style of accounting (...) enforces certain values but does not tell about the tragic or unexpected effects that come with it, nor does it provide a repertoire to deal with these. Thus, care practices incorporating specific styles of accounting remain dependent on forms of care that are not accountable or ask for new forms of reflexivity. (shrink)

Dignity is a fundamental concept, but its meaning is not clear. This paper attempts to clarify the term by analysing and reconnecting two meanings of dignity: humanitas and dignitas. Humanitas refers to citizen values that protect individuals as equal to one another. Dignitas refers to aesthetic values embedded in genres of sociality that relate to differences between people. The paper explores these values by way of an empirical ethical analysis of practices of washing psychiatric patients in nursing care. Nurses legitimate (...) the washing of reluctant patients with reference to dignity. The analysis shows the intertwinement of humanitas and dignitas that gives dignity its fundamental meaning.
