The continental drift controversy has been deeply analysed in terms of rationalist notions, which seem to find there a unique topic to describe the weight of evidence for reaching consensus. In that sense, many authors suggest that Alfred Wegener’s theory of the original supercontinent Pangea and the subsequent continental displacements finally reached a consensus when irrefutable evidence became available. Therefore, rationalist approaches suggest that evidence can be enough by itself to close scientific controversies. In this article I analyse continental drift (...) debates from a different perspective which is based on styles of thought. I’ll argue that continental drift debate took much longer than it was usually recognized with two styles of thought coexisting for hundreds of years. These were fixism and mobilism and they were always confronting their own evidence and interpretations and functioning as general frameworks for the acceptability of a specific theory. Therefore, this text aims to bring much broader sociological elements than usually involved in the analysis of the continental drift theory. (shrink)

Yuri Balashov sets out major rival views of persistence--endurance, perdurance, and exdurance--in a spacetime framework and proceeds to investigate the implications of Einstein's theory of relativity for the debate about persistence. His overall conclusion--that relativistic considerations favour four-dimensionalism over three-dimensionalism--is hardly surprising. It is, however, anything but trivial. Contrary to a common misconception, there is no straightforward argument from relativity to four-dimensionalism. This article examines the method of reflective equilibrium (RE) and its role in philosophical inquiry. It begins with an overview of RE before discussing some of the subtleties involved in its interpretation, including challenges to the standard assumption that RE is a form of coherentism. It then evaluates some of the main objections to RE, in particular, the criticism that this method generates unreasonable beliefs. Madhusūdana Sarasvatī wrote several treatises on Advaita philosophy. His magnum opus is the Advaitasiddhi, written in order to reply to the keen objections moved by the Dvaitin Vyāsatīrtha’s Nyāyāmṛta. Advaitasiddhi is verily a turning point into the galaxy of Vedānta, not only as far as its replies are concerned, but also for the reutilization of earlier vedāntic material and its reformulation by means of the highly sophisticated language of the new school of logic. Madhusūdana’s works in a broader context through three looking glasses: the analysis of how Madhusūdana refers to his own works, in order to reconstruct a relative chronology among them; Madhusūdana’s adherence to the tenets of the previous Advaita tradition, how much he is indebted to Vyāsatīrtha, how he quotes him and how he replies to him; Madhusūdana’s acquaintance with other textual traditions, mainly Vyākaraṇa, Pūrva Mīmāṃsā and Nyāya. It is often said that ‘what it is like’-knowledge cannot be acquired by consulting testimony or reading books [Lewis 1998; Paul 2014; 2015a]. However, people also routinely consult books like What It Is Like to Go to War [Marlantes 2014], and countless ‘what it is like’ articles and youtube videos, in the apparent hope of gaining knowledge about what it is like to have experiences they have not had themselves. This article examines this puzzle and tries to solve it by (...) appealing to recent work on knowing-wh ascriptions. In closing I indicate the wider significance of these ideas by showing how they can help us to evaluate prominent arguments by Paul [2014; 2015a] concerning transformative experiences. (shrink)

The article appearing previously in this journal entitled “Styles of Thought on the Continental Drift Debate” (Pellegrini 2019) prompted a response from Weber and Šešelja (2020) which they termed as “a defence of rationalist accounts”. They argue that their self-designated “sophisticated rationalism” explains the closure of the continental-drift debate without being affected by my critiques to rationalist approaches. While ignoring the empirical evidence that shows the complexity of the debate and the necessity to include broader social elements in the (...) analysis (such as scientists denying continental drift even after the plate tectonics theory, others supporting it without being familiarized with the literature), they proclaim to be unconvinced about the analysis of the styles of thought. In order to clarify differences in the approach to the continental-drift historical controversy, I respond here to the criticism my paper drew while discussing the place of rationalism when explaining the acceptance of a theory. I will argue that their distinction between “crude” and “sophisticated” rationalism does not solve the problem of social aspects being left aside by rationalists in view of the acceptance of a theory. I will also argue that in order to understand what leads people to embrace a belief (namely scientists in accepting a theory), the analysis of mere cognitive or epistemic arguments is not enough and it leads to a reductionist explanation as to social behaviour. En particular, se analizan los desplazamientos que se producen entre disciplinas al emerger una nueva: la biología molecular. Se presenta en este artículo el caso del Instituto Nacional de Tecnología Agropecuaria (INTA) de Argentina, institución creada en 1956 para realizar investigaciones, innovaciones y extensionismo para el sector agropecuario. De esa manera, el trabajo presenta los cambios en las disciplinas de las que provienen (...) los investigadores del INTA, desde su creación en 1956 hasta 2010. La investigación que se presenta se centra en un análisis cuantitativo en relación a las disciplinas de origen de los investigadores que se incorporaron a la institución. Al mostrar los desplazamientos entre disciplinas, este artículo pretende contribuir al estudio sobre los conflictos entre las mismas. Pues se sugiere que la emergencia de una nueva disciplina no implica solamente la apertura de nuevas profesiones, instituciones, temas y técnicas de investigación, sino también el desplazamiento de otras anteriormente instaladas, y que tales desplazamientos estarían en la raíz de las tensiones que se registran en la institucionalización de una nueva disciplina. This article aims to investigate the process of institutionalization of a new scientific discipline. In particular, the displacements that occur between disciplines with the emergence of a new one: molecular biology. The case presented in this article is the National Institute of Agricultural Technology (INTA) of Argentina, institution created in 1956 for research, innovation and extension to the agricultural sector. Thus, the paper presents the changes in the disciplines from which INTA's researchers come, since its inception in 1956 until 2010. The research presented in this article focuses on a quantitative analysis in relation to the disciplines of origin of the researchers who joined the institution. By showing the displacements between disciplines, this article aims to contribute to the study of the conflicts between them. For it suggests that the emergence of a new discipline involves not only the opening of new professions, institutions, research subjects and techniques, but also the displacement of other previously installed. These displacements would be at the root of the tensions that occur in the institutionalization of a new discipline. (shrink)

Why does the ruling class in all countries of the world today act so weirdly and sometimes irresponsibly? Maybe because they are all bored. They don’t know what to do with themselves, or even what to do with their power. The deepest cause of the modern crisis is the lack of new ideas. First of all, ideas that justify your life and death. These ideas are called meanings of life, final values, final goals, final goods, human life's ends, reasons to (...) live, etc. Philosophers and psychologists pick out from five to twenty known final values that cannot be reduced to one another. The existing final values are not but the final values system itself is outdated and has not been updated for a long time. To get out of the existential crisis, we need to look for new final values. New final values mean new ethical standards, new philosophies, new religions, new ideologies, new social institutions, etc. The more final values we know, the richer our culture is, the freer we are and the more expanded (more flexible, sophisticated, etc.) our consciousness is. We present a sequent calculus for the Grzegorczyk modal logic$\mathsf {Grz}$allowing cyclic and other non-well-founded proofs and obtain the cut-elimination theorem for it by constructing a continuous cut-elimination mapping acting on these proofs. As an application, we establish the Lyndon interpolation property for the logic$\mathsf {Grz}$proof-theoretically.

Practices related to research misconduct seem to have been multiplied in recent years. Many cases of scientific fraud have been exposed publicly, and journals and academic institutions have deployed different measures worldwide in this regard. However, the influence of specific social and cultural environments on scientific fraud may vary from society to society. This article analyzes how scientists in Japan deal with accusations of scientific fraud. For such a purpose, a series of scientific fraud cases that took place in Japan (...) has been reconstructed through diverse sources. Thus, by analyzing those cases, the social basis of scientific fraud and the most relevant aspects of Japanese cultural values and traditions, as well as the concept of honour which is deeply involved in the way Japanese scientists react when they are accused of and publicly exposed in scientific fraud situations is examined. Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

In this paper, the ethical, legal, and social implications of Thailand’s surrogacy regulations from both domestic and global perspectives are explored. Surrogacy tourism in Thailand has expanded since India strengthened its visa regulations in 2012. In 2015, in the wake of a major scandal surrounding the abandonment of a surrogate child by its foreign intended parents, a law prohibiting the practice of surrogacy for commercial purposes was enacted. Consequently, a complete ban on surrogacy tourism was imposed. However, some Thai physicians (...) and surrogate mothers cross into neighboring countries to provide foreign clients with the commercial surrogacy services that are forbidden in Thailand. Under this legislation, the needs of Thai couples who are unable to conceive are accommodated by legally accessible, non-commercial surrogacy services; however, there is currently no provision in place aimed at protecting the rights and interests of surrogate mothers and children. It is widely believed that the abolition of surrogacy tourism, an industry that give rise to several major scandals, and legal access to surrogacy by Thai couples were the Thai government’s primary goal in implementing this legislation. The Paper is dedicated to philosophical fundamentals of the Marx’s theory of product value. The author proves that in the Marx’s theory the value of the product of labour and, correspondently, of the commodity is defined inaccurately. He thinks that the concept of labour, presented in the economic theory of K. Marx, undeservedly ignores the role of intellectual activity of an individual in production of material goods. Marx considered mental activity as integral part of physical labour. This Marx’s viewpoint takes (...) in account only the controlling mental activity of an individual in the process of labour. The author thinks that such form of labour existed only in conditions of primitive manufacture, when a worker himself invented the product of labour and then created it with the help of materialactivity. In the period of industrial production of material goods, starting from the late 18th century, the intellectual labour separated from the physical labour and by its status became a sufficient independent stage of public production process. In this connection it is necessary to reconsider a number of such important concepts of philosophical fundamentals of economics as labour, value and wealth. (shrink)

This ambitious book looks into the reasons for the exceptional durability of the Chinese empire, which lasted for more than two millennia (221 B.C.E. - 1911 C.E.). Yuri Pines identifies the roots of the empire's longevity in the activities of thinkers of the Warring States period (453-221 B.C.E.), who, in their search for solutions to an ongoing political crisis, developed ideals, values, and perceptions that would become essential for the future imperial polity. In marked distinction to similar empires worldwide, (...) the Chinese empire was envisioned and to a certain extent 'preplanned' long before it came into being. As a result, it was not only a military and administrative construct, but also an intellectual one. Pines makes the argument that it was precisely its ideological appeal that allowed the survival and regeneration of the empire after repeated periods of turmoil. "Envisioning Eternal Empire" presents a panoptic survey of philosophical and social conflicts in Warring States political culture. By examining the extant corpus of preimperial literature, including transmitted texts and manuscripts uncovered at archaeological sites, Pines locates the common ideas of competing thinkers that underlie their ideological controversies. This bold approach allows him to transcend the once fashionable perspective of competing 'schools of thought' and show that beneath the immense pluralism of Warring States thought one may identify common ideological choices that eventually shaped traditional Chinese political culture. Knowledge-how often appears to be more difficult to transmit by testimony than knowledge-that and knowledge-wh. Some philosophers have argued that this difference provides us with an important objection to intellectualism—the view that knowledge-how is a species of knowledge-that. This article defends intellectualism against these testimony-based objections.

In this paper I develop three different arguments against the thesis that knowledge-how is a kind of knowledge-that. Knowledge-that is widely thought to be subject to an anti-luck condition, a justified or warranted belief condition, and a belief condition, respectively. The arguments I give suggest that if either of these standard assumptions is correct then knowledge-how is not a kind of knowledge-that. In closing I identify a possible alternative to the standard Rylean and intellectualist accounts of knowledge-how. This alternative view (...) illustrates that even if the arguments given here succeed it might still be reasonable to hold that knowing how to do something is a matter of standing in an intentional relation to a proposition other than the knowledge-that relation. Background In an increasingly globalized world, legal protocols related to health care that are both effective and culturally sensitive are paramount in providing excellent quality of care as well as protection for physicians tasked with decision making. Here, we analyze the current medicolegal status of brain death diagnosis with regard to end-of-life care in Japan, China, and South Korea from the perspectives of front-line health care workers. Main body Japan has legally wrestled with the concept of brain death for decades. (...) An inability to declare brain death without consent from family coupled with cultural expectations of family involvement in medical care is mirrored in other Confucian-based cultures and may complicate care for patients from these countries when traveling or working overseas. Within Japan, China, and South Korea, medicolegal shortcomings in the diagnosis of brain death act as a great source of stress for physicians and expose them to potential public and legal scorn. Here, we detail the medicolegal status of brain death diagnosis within Japan and compare it to China and South Korea to find common ground and elucidate the impact of legal ambiguity on health care workers. Conclusion The Confucian cultural foundation of multiple Asian countries raises common issues of family involvement with diagnosis and cultural considerations that must be met. Leveraging public education systems may increase awareness of brain death issues and lead to evolving laws that clarify such end-of-life issues while protecting physicians from sociocultural backlash. Surrogacy tourism in Asian countries has surged in recent decades due to affordable prices and favourable regulations. Although it has recently been banned in many countries, it is still carried out illegally across borders. With demand for surrogacy in developed countries increasing and economically vulnerable Asian women lured by lucrative compensation, there are efforts by guest countries to ease the strict surrogacy regulations in host countries. Despite a shift toward “altruistic surrogacy”, commercial surrogacy persists. Recent research carried out by international (...) organizations that seek to establish a legal relationship between the commissioning parents and children in cross-border surrogacy arrangements, under the guise of the “best interests of the child,” appears to promote a resurgence of overseas commercial surrogacy rather than restrict it. Further commercialization of surrogacy should be prevented by carefully investigating the reality of the surrogacy process. (shrink)

How should intellectualists respond to apparent Gettier-style counterexamples? Stanley offers an orthodox response which rejects the claim that the subjects in such scenarios possess knowledge-how. I argue that intellectualists should embrace a revisionary response according to which knowledge-how is a distinctively practical species of knowledge-that that is compatible with Gettier-style luck.

Are the laws of nature real? Do they belong to the world or merely reflect the way we speak about it? If they are real, what sort of entity are they? This study contributes to the ongoing discussion of these questions by emphasizing the importance of a cosmological perspective on them. I argue that the evidence coming from modern evolutionary cosmology presents difficulties for certain currently fashionable philosophical accounts of laws, in particular, for the Dretske-Tooley-Armstrong theory. I defend, in light (...) of this evidence, the idea of laws as grounded in irreducible nomic properties of basic objects and examine its cosmological implications and consequences for the philosophy of modality. ;If the laws of nature are real, they must represent an integral aspect of the universe as a whole. From a cosmological point of view, these two totalities, the laws of nature and the universe, may be related. I begin by showing that a concern about the consequences of such possible relationship was an important factor in the historical rivalry between the steady-state and big bang cosmologies . ;The cosmological perspective on laws has still more striking implications in the context of the contemporary interplay between big-bang cosmology and high energy physics in the effort to understand the processes at work during the first moments of cosmic evolution. In a sense, the evolution of the physical state of the universe as a whole may have "carried" with it the evolution of certain nomic properties of matter. I contend that this poses problems for some nomic ontologies, such as the relations-between-universals theory, and favors the view of laws as grounded in causal powers of particulars. I show how the universe of causally powerful basic substances provides a natural framework for an interesting sense of modality characteristic of laws and how this illuminates the notoriously difficult problems of essential properties and natural kinds. The article analyzes the structure and manifestations of everyday life as the sphere of the empirical life of the individual believer and the religious community. Patterns of everyday life are not confined to certain universal conceptual or value systems, as there is no ready-made standards and rules of their formation. Everyday life is intersubjective space of social relations in which religious individuals, communities, institutions self-identified based on form of reproduction of sociality. Religious everyday life determined by ordinary consciousness, practices, social (...) aspects of life in the religious community, which are constituted by communication. The main religious structures of everyday life is mental cut ordinary religious consciousness, religious practice, religious experience, religious communication, religious stereotypes. Everyday life is the sphere of interaction between the social and the transcendental worlds, in which religious practices are an integral social relationships and the objectification of religious experience through the prism of individual membership to a specific religion, a means of inclusion of transcendence in the context of everyday life. Religious practices reflect understanding of a religious individual objects of the supernatural world, which is achieved through social experience, intersubjective interaction, experience of transcendental reality. The everyday life of the believing personality is formed in the dynamics of tradition and innovation, the mechanism of interaction of which affects the space of social existence. It exists within the private and public space and time, differing openness within the life-world. Continuous modification of everyday life, change its fundamental structures is determined by the process of modern social and technical transformation of society. (shrink)

The life of the brain is believed to be a major factor determining the existence of subjective reality during clinical death. The duration of the existence in question cannot be measured in the units of astronomical time for two reasons. Firstly, it is impossible to determine once and for all how long the brain survives after cardiac arrest and termination of breathing. Secondly, the duration of subjective time during near death experience (NDE) differs from that typical of daily regular experience. (...) Immobilization, loss of the sensation of one’s body, state of affect and severe sensory deprivation ensure that consciousness is focused and fixated in and onto itself exclusively which, in its turn, diminish and slacken the course of time so that it expands to eternity and subjective reality goes beyond the usual limits of the temporal “past-present-future” paradigm.
