Background In an increasingly globalized world, legal protocols related to health care that are both effective and culturally sensitive are paramount in providing excellent quality of care as well as protection for physicians tasked with decision making. Here, we analyze the current medicolegal status of brain death diagnosis with regard to end-of-life care in Japan, China, and South Korea from the perspectives of front-line health care workers. Main body Japan has legally wrestled with the concept of brain death for decades. (...) An inability to declare brain death without consent from family coupled with cultural expectations of family involvement in medical care is mirrored in other Confucian-based cultures and may complicate care for patients from these countries when traveling or working overseas. Within Japan, China, and South Korea, medicolegal shortcomings in the diagnosis of brain death act as a great source of stress for physicians and expose them to potential public and legal scorn. Here, we detail the medicolegal status of brain death diagnosis within Japan and compare it to China and South Korea to find common ground and elucidate the impact of legal ambiguity on health care workers. Conclusion The Confucian cultural foundation of multiple Asian countries raises common issues of family involvement with diagnosis and cultural considerations that must be met. Leveraging public education systems may increase awareness of brain death issues and lead to evolving laws that clarify such end-of-life issues while protecting physicians from sociocultural backlash. I examine the issue of persistence over time in thecontext of the special theory of relativity (SR). Thefour-dimensional ontology of perduring objects isclearly favored by SR. But it is a different questionif and to what extent this ontology is required, andthe rival endurantist ontology ruled out, by thistheory. In addressing this question, I take theessential idea of endurantism, that objects are whollypresent at single moments of time, and argue that itcommits one to unacceptable conclusions regardingcoexistence, in the context of SR. (...) I then propose anddiscuss a plausible account of coexistence forperduring objects, which is free of these defects. This leaves the endurantist room for some maneuvers. I consider them and show that they do not really helpthe endurantist out. Although considerations based on contemporary space-time theories, such as special and general relativity, seem highly relevant to the debate about persistence, their significance has not been duly appreciated. My goal in this paper is twofold: (1) to reformulate the rival positions in the debate (i.e., endurantism [three-dimensionalism] and perdurantism [four-dimensionalism, the doctrine of temporal parts]) in the framework of special relativistic space-time; and (2) to argue that, when so reformulated, perdurantism exhibits explanatory advantages over endurantism. Yuri Balashov sets out major rival views of persistence--endurance, perdurance, and exdurance--in a spacetime framework and proceeds to investigate the implications of Einstein's theory of relativity for the debate about persistence. His overall conclusion--that relativistic considerations favour four-dimensionalism over three-dimensionalism--is hardly surprising. It is, however, anything but trivial. Contrary to a common misconception, there is no straightforward argument from relativity to four-dimensionalism. The issues involved are complex, and the debate is closely entangled with a number of other philosophical disputes, (...) including those about the nature and ontology of time, parts and wholes, material constitution, causation and properties, and vagueness. In this paper I develop three different arguments against the thesis that knowledge-how is a kind of knowledge-that. Knowledge-that is widely thought to be subject to an anti-luck condition, a justified or warranted belief condition, and a belief condition, respectively. The arguments I give suggest that if either of these standard assumptions is correct then knowledge-how is not a kind of knowledge-that. In closing I identify a possible alternative to the standard Rylean and intellectualist accounts of knowledge-how. In the current era of the Sustainable Development Goals, many countries are attempting to strengthen their health system and achieving Universal Health Coverage. The Korean National Health Insurance system functions as a core element of health financing, contributing to achieving UHC by promoting public health and social security through insurance benefits for prevention, diagnosis, treatment, rehabilitation, childbirth, and health promotion. The Republic of Korea achieved 100% NHI coverage of the target population in 1989, 12 years after the introduction of the (...) social insurance system. However, poor coverage of health services and lack of financial protection are major obstacles to achieving UHC. Therefore, the Korean government announced and implemented ‘Moon Jae-in Care’ in August 2017 to enhance the coverage rate of NHI by 70%. First, this study reviews the existing health insurance system in Korea from the perspective of health financing and UHC. Second, it analyses ‘Moon Jae-in Care’, based on the main framework of UHC. Third, it considers the ethical implications of these developments, with focus on the principles of equity, fairness, autonomy, and solidarity. Although the NHI reform is expected to propel Korean health care closer to UHC, many ethical, social, and political issues remain. (shrink)

Studying populations, be it a microbe colony or mankind, is important for understanding how complex systems evolve and exist. Such knowledge also often provides insights into evolution, history and different aspects of human life. By and large, populations’ prosperity and decline is about transformation of certain resources into quantity and other characteristics of populations through growth, replication, expansion and acquisition of resources. We introduce a general model of population change, applicable to different types of populations, which interconnects numerous factors influencing (...) population dynamics, such as nutrient influx and nutrient consumption, reproduction period, reproduction rate, etc. It is also possible to take into account specific growth features of individual organisms. We considered two recently discovered distinct growth scenarios: first, when organisms do not change their grown mass regardless of nutrients availability, and the second when organisms can reduce their grown mass by several times in a nutritionally poor environment. We found that nutrient supply and reproduction period are two major factors influencing the shape of population growth curves. There is also a difference in population dynamics between these two groups. Organisms belonging to the second group are significantly more adaptive to reduction of nutrients and far more resistant to extinction. Also, such organisms have substantially more frequent and lesser in amplitude fluctuations of population quantity for the same periodic nutrient supply (compared to the first group). Proposed model allows adequately describing virtually any possible growth scenario, including complex ones with periodic and irregular nutrient supply and other changing parameters, which present approaches cannot do. To state an important fact about the photon, physicists use such expressions as (1) “the photon has zero (null, vanishing) mass” and (2) “the photon is (a) massless (particle)” interchangeably. Both (1) and (2) express the fact that the photon has no non-zero mass. However, statements (1) and (2) disagree about a further fact: (1) attributes to the photon the property of zero-masshood whereas (2) denies that the photon has any mass at all. But is there really a difference between (...) saying that something has zero mass (charge, spin, etc.) and saying that it has no mass (charge, spin, etc.)? Does the distinction cut any physical or philosophical ice? I argue that the answer to these questions is yes. Put briefly, the claim of this paper is that some zero-value physical quantities are not mere “privations”, “absences” or “holes in being”. They are respectable properties in the same sense in which their non-zero partners are. This, I will show, has implications for the debate between two rival views of the nature of property, dispositionalism and categoricalism. (shrink)

Is there a successful regress argument against intellectualism? In this article I defend the negative answer. I begin by defending Stanley and Williamson's (2001) critique of the contemplation regress against Noë (2005). I then identify a new argument – the employment regress – that is designed to succeed where the contemplation regress fails, and which I take to be the most basic and plausible form of a regress argument against intellectualism. Surrogacy tourism in Asian countries has surged in recent decades due to affordable prices and favourable regulations. Although it has recently been banned in many countries, it is still carried out illegally across borders. With demand for surrogacy in developed countries increasing and economically vulnerable Asian women lured by lucrative compensation, there are efforts by guest countries to ease the strict surrogacy regulations in host countries. Despite a shift toward “altruistic surrogacy”, commercial surrogacy persists. Recent research carried out by international (...) organizations that seek to establish a legal relationship between the commissioning parents and children in cross-border surrogacy arrangements, under the guise of the “best interests of the child,” appears to promote a resurgence of overseas commercial surrogacy rather than restrict it. Further commercialization of surrogacy should be prevented by carefully investigating the reality of the surrogacy process. (shrink)

In this paper, the ethical, legal, and social implications of Thailand’s surrogacy regulations from both domestic and global perspectives are explored. Surrogacy tourism in Thailand has expanded since India strengthened its visa regulations in 2012. In 2015, in the wake of a major scandal surrounding the abandonment of a surrogate child by its foreign intended parents, a law prohibiting the practice of surrogacy for commercial purposes was enacted. Consequently, a complete ban on surrogacy tourism was imposed. However, some Thai physicians (...) and surrogate mothers cross into neighboring countries to provide foreign clients with the commercial surrogacy services that are forbidden in Thailand. Under this legislation, the needs of Thai couples who are unable to conceive are accommodated by legally accessible, non-commercial surrogacy services; however, there is currently no provision in place aimed at protecting the rights and interests of surrogate mothers and children. It is widely believed that the abolition of surrogacy tourism, an industry that give rise to several major scandals, and legal access to surrogacy by Thai couples were the Thai government’s primary goal in implementing this legislation. This ambitious book looks into the reasons for the exceptional durability of the Chinese empire, which lasted for more than two millennia (221 B.C.E. - 1911 C.E.). Yuri Pines identifies the roots of the empire's longevity in the activities of thinkers of the Warring States period (453-221 B.C.E.), who, in their search for solutions to an ongoing political crisis, developed ideals, values, and perceptions that would become essential for the future imperial polity. In marked distinction to similar empires worldwide, (...) the Chinese empire was envisioned and to a certain extent 'preplanned' long before it came into being. As a result, it was not only a military and administrative construct, but also an intellectual one. Pines makes the argument that it was precisely its ideological appeal that allowed the survival and regeneration of the empire after repeated periods of turmoil. "Envisioning Eternal Empire" presents a panoptic survey of philosophical and social conflicts in Warring States political culture. By examining the extant corpus of preimperial literature, including transmitted texts and manuscripts uncovered at archaeological sites, Pines locates the common ideas of competing thinkers that underlie their ideological controversies. This bold approach allows him to transcend the once fashionable perspective of competing 'schools of thought' and show that beneath the immense pluralism of Warring States thought one may identify common ideological choices that eventually shaped traditional Chinese political culture. RaTG13, MP789, and RmYN02 are the strains closest to SARS‐CoV‐2, and their existence came to light only after the start of the pandemic. Their genomes have been used to support a natural origin of SARS‐CoV‐2 but after a close examination all of them exhibit several issues. We specifically address the presence in RmYN02 and closely related RacCSxxx strains of a claimed natural PAA/PVA amino acid insertion at the S1/S2 junction of their spike protein at the same position where the PRRA (...) insertion in SARS‐CoV‐2 has created a polybasic furin cleavage site. We show that RmYN02/RacCSxxx instead of the claimed insertion carry a 6‐nucleotide deletion in the region and that the 12‐nucleotide insertion in SARS‐CoV‐2 remains unique among Sarbecoviruses. Also, our analysis of RaTG13 and RmYN02's metagenomic datasets found unexpected reads which could indicate possible contamination. Because of their importance to inferring SARS‐CoV‐2′s origin, we call for a careful reevaluation of RaTG13, MP789 and RmYN02 sequencing records and assembly methods. (shrink)

Automated classification of legal documents has been the subject of extensive research in recent years. However, this is still a challenging task for long documents, since it is difficult for a model to identify the most relevant information for classification. In this paper, we propose a two-stage supervised learning approach for the classification of petitions, a type of legal document that requests a court order. The proposed approach is based on a word-level encoder–decoder Seq2Seq deep neural network, such as a (...) Bidirectional Long Short-Term Memory (BiLSTM) or a Bidirectional Encoder Representations from Transformers (BERT) model, and a document-level Support Vector Machine classifier. To address the challenges posed by the lengthy legal documents, the approach introduces a human-in-the-loop approach, whose task is to localize and tag relevant segments of text in the word-level training part, which dramatically reduces the dimension of the document classifier input vector. We performed experiments to validate our approach using a real-world dataset comprised of 270 intermediate petitions, which were carefully annotated by specialists from the 15th civil unit of the State of Alagoas, Brazil. Our results revealed that both BiLSTM and BERT-Convolutional Neural Networks variants achieved an accuracy of up to 95.49%, and also outperformed baseline classifiers based on the Term Frequency–Inverse Document Frequency test vectorizer. The proposed approach is currently being utilized to automate the aforementioned justice unit, thereby increasing its efficiency in handling repetitive tasks. (shrink)

The success of deep learning in natural language processing raises intriguing questions about the nature of linguistic meaning and ways in which it can be processed by natural and artificial systems. One such question has to do with subword segmentation algorithms widely employed in language modeling, machine translation, and other tasks since 2016. These algorithms often cut words into semantically opaque pieces, such as ‘period’, ‘on’, ‘t’, and ‘ist’ in ‘period|on|t|ist’. The system then represents the resulting segments in a dense (...) vector space, which is expected to model grammatical relations among them. This representation may in turn be used to map ‘period|on|t|ist’ (English) to ‘par|od|ont|iste’ (French). Thus, instead of being modeled at the lexical level, translation is reformulated more generally as the task of learning the best bilingual mapping between the sequences of subword segments of two languages; and sometimes even between pure character sequences: ‘p|e|r|i|o|d|o|n|t|i|s|t’ → ‘p|a|r|o|d|o|n|t|i|s|t|e’. Such subword segmentations and alignments are at work in highly efficient end-to-end machine translation systems, despite their allegedly opaque nature. The computational value of such processes is unquestionable. But do they have any linguistic or philosophical plausibility? I attempt to cast light on this question by reviewing the relevant details of the subword segmentation algorithms and by relating them to important philosophical and linguistic debates, in the spirit of making artificial intelligence more transparent and explainable. This article attempts to outline some critical aspects of the accelerationist movement. More specifically, it argues that light can be shed on key aspects of the political proposals of Williams and Srnicek by considering them from the perspective of the socio-political reflections of both Lacan and Deleuze and Guattari. Anti-Oedipus is one crucial starting point for accelerationist thinking, in terms of the concept of the ‘machinic’ and the explicit reference to ‘acceleration’, but it is equally obvious that Lacan has been (...) an important figure in the debate on the topic of ‘desire’. Likewise, and for the same reasons, accelerationism offers the potential for a fruitful reconsideration of Deleuzian philosophy, and of the difficult relationship between schizo- analysis and psycho-analysis. We argue that, in the light of accelerationism, the perspectives of Deleuze and Guattari and Lacan do converge, in particular around the theoretical articulation of the concept of the ‘political’. Accelerationism, as many critics have noted, has numerous implications in the field of subjectivity and often falls into a general plea for a strong neo-Enlightenment. Hence we will attempt to explicate these implications by attempting to read accelerationism via the psychoanalytic categories of jouissance and fantasy. This last category, as Stavrakakis has shown, is directly linked to the political category of ‘Utopia’, and therefore provides an adequate theoretical basis for such a psychoanalytic reading of accelerationism. Should accelerationism be considered the only way out of the socio-political constraints of neoliberalism today? However we approach this question, the argument pursued here is that the best starting points for a critique of accelerationism are the concepts of jouissance, the state/capital relationship, schizo-analysis and paranoid ways of functioning. A new method of coding Diophantine equations is introduced. This method allows checking that a coded sequence of natural numbers is a solution of a coded equation without decoding; defining by a purely existential formula, the code of an equation equivalent to a system of indefinitely many copies of an equation represented by its code. The new method leads to a much simpler construction of a universal Diophantine equation and to the existential arithmetization of Turing machines, register machines, and partial (...) recursive functions. A partir do que apresentam pesquisas em diferentes campos dos estudos em linguagem, faz-se incontestável a heterogenericidade com que diversas formas de narração do eu em diferentes tons de autorreferência têm insurgido numa sociedade altamente midiatizada e globalizada. Nesse entrever, ancorados no edifício teórico da análise dialógica do discurso em confluência com estudos que se debruçam sobre as escritas de si, propomo-nos a (...) discutir a ressignificação como ato característico do movimento de autorreferência constitutivo da autobiografia e de algumas outras formas de narrativas do eu. Dentre outras observações, destacamos, na construção discursiva de textos autorreferentes, como a autobiografia, um entrecruzamento entre sentidos, memórias e vivências em uma relação de ressignificação sob a luz do que o sujeito não só foi como agora é. ABSTRACT The great profusion of different forms of biographical narrativity in contemporary society is increasingly sensitive. From what is presented by studies in different fields of language studies, the heterogeneity with which diverse forms of narration of the self in different tones of self-reference have emerged in a highly mediatized and globalized society becomes indisputable. Therefore, anchored in the theoretical propositions of the dialogic analysis of discourse along with studies that focus on life writings, we discuss re-signification as a characteristic act of the movement of self-reference, constitutive of autobiographies and some other forms of narratives of the self. Among other observations, we highlight in the discursive construction of self-referential texts, such as autobiography, a cross-linking between senses, memories and life experiences in their relation of re-signification in the light of what the subject not only was, but is now. How should intellectualists respond to apparent Gettier-style counterexamples? Stanley offers an orthodox response which rejects the claim that the subjects in such scenarios possess knowledge-how. I argue that intellectualists should embrace a revisionary response according to which knowledge-how is a distinctively practical species of knowledge-that that is compatible with Gettier-style luck.

This article examines the method of reflective equilibrium (RE) and its role in philosophical inquiry. It begins with an overview of RE before discussing some of the subtleties involved in its interpretation, including challenges to the standard assumption that RE is a form of coherentism. It then evaluates some of the main objections to RE, in particular, the criticism that this method generates unreasonable beliefs. It concludes by considering how RE relates to recent debates about the role of intuitions in (...) philosophy. (shrink)

It is often said that ‘what it is like’-knowledge cannot be acquired by consulting testimony or reading books [Lewis 1998; Paul 2014; 2015a]. However, people also routinely consult books like What It Is Like to Go to War [Marlantes 2014], and countless ‘what it is like’ articles and youtube videos, in the apparent hope of gaining knowledge about what it is like to have experiences they have not had themselves. This article examines this puzzle and tries to solve it by (...) appealing to recent work on knowing-wh ascriptions. In closing I indicate the wider significance of these ideas by showing how they can help us to evaluate prominent arguments by Paul [2014; 2015a] concerning transformative experiences. (shrink)

Most four-dimensionalists, including both worm and stage theorists, endorse mereological universalism, the thesis that any class of objects has a fusion. But the marriage of fourdimensionalism and universalism is unfortunate and unprofitable: it creates a recalcitrant problem for stage theory’s account of lingering properties, such as writing ‘War and Piece’ and traveling across the tennis court, which take time to be instantiated. This makes it necessary to impose a natural restriction on diachronic composition.

Debates about material coincidence tend to start with common-sense intuitions but quickly leave them behind and lead to highly problematic conclusions. Reconciling the latter with common sense is the next stage in the process, which often requires revision of some of the initial beliefs and has been used to adjudicate many rather abstract and technical proposals in the metaphysics of composition and persistence, ranging from natural (constitutionalism) to radical (nihilism). -/- I have no disagreement with this overall strategy: theories do (...) need to turn abstract at some point, move beyond common sense, and eventually force upon us interesting, novel, and often counterintuitive revisions in our overall conceptual scheme. This applies to all theoretical areas, and contemporary metaphysics is no exception. But while the latter is widely regarded as being quite extreme in this respect, I want to argue that, in one sense, it is not extreme enough. I do it by developing a new case of material coincidence that is initially motivated not by common sense but by physical considerations, and is not susceptible to any of the standard solutions. -/- One lesson of science is its ability to expand our imagination beyond the limits of common sense. A recent debate has ensued over the claim in Pikovski et al. that systems with internal degrees of freedom undergo a universal, gravity-induced, type of decoherence that explains their quantum-to-classical transition. Such decoherence is supposed to arise from the different gravitational redshifts experienced by such systems when placed in a superposition of two wave packets at different heights in a gravitational field. Here we investigate some aspects of the discussion with the aid of simple examples. In particular, we first resolve (...) an apparent conflict between the reported results and the equivalence principle by noting that the static and free fall descriptions focus on states associated with different hypersurfaces. Next, we emphasize that predictions regarding the observability of interference become relevant only in the context of concrete experimental settings. As a result, we caution against hasty claims of universal validity. Finally, we dispute the claim that, at least in the scenarios discussed in Pikovski et al., gravitation is responsible for the reported results and we question the alleged ability of decoherence to explain the quantum-to-classical transition. In consequence, we argue against the extraordinary assertion in Pikovski et al. that gravity can account for the emergence of classicality. (shrink)
