In this article, an intervention aimed at improving quality of care to prevent seclusion in psychiatry by focusing on the first five minutes at admission is analyzed from a care ethics perspective. Two cases are presented from an evaluation study in a psychiatric hospital. In both cases, the nurses follow the intervention protocol, but the outcome is different. In the first case, the patient ends up in the seclusion room. In the second case, this does not happen. Analyzing the cases (...) from a care ethics perspective, we conclude that applying the intervention in the right way implies more than following the steps laid down in the protocol. It requires a new way of thinking and acting, resulting in new relationships between nurses and patients. Care ethics theory can help clarify what good care is actually about and keep in mind what is needed to apply the intervention. Thus, care ethics theory can be highly practical and helpful in changing and improving healthcare practice. (shrink)

Cet article aborde, à partir de la répétition des maltraitances sur enfant dans la relation mère-fille, la fonction du processus de cette répétition selon la théorie freudienne et lacanienne dans un dispositif de soin dans le cadre de la pjj. Une vignette clinique met en évidence que l’insistance de la répétition du fantasme d’infanticide dans la généalogie féminine ne se réduit pas à la narration du traumatisme infantile mais devient une interrogation à l’adresse du Grand Autre pour se définir comme (...) sujet désirant, différent, afin de se soustraire à ce fantasme. Si cette demande sous-jacente à cette répétition n’est pas entendue par les professionnels, les institutions qui sont mis à l’épreuve, dans le transfert et le contretransfert, au profit de la fonction victimaire chez le sujet, les réponses apportées dans la réalité ne pourront que contribuer à assurer la jouissance mortifère de ce dernier dans la transgression, mettant en échec la fonction symbolique de la Loi. Les auteurs montrent, à travers l’efficacité du transfert et de la fonction symbolique de la Loi, que la psychanalyse sans divan peut s’adapter à une clinique du réel, clinique qui peut parfois réinterroger la théorie. The aim of this paper is to show that the nascent field of ethics of collegiality may considerably benefit from a symbiosis with virtue and vice epistemology. We start by bringing the epistemic virtue and vice perspective to the table by showing that competence, deemed as an essential characteristic of a good colleague (Betzler & Löschke 2021), should be construed broadly to encompass epistemic competence. By endorsing the anti-individualistic stance in epistemology as well as context-specificity of epistemic traits, we show (...) how the individual vice of a colleague can have a positive epistemic outcome for the team while individual virtue can be damaging if all team members share it, thereby contributing to the negative epistemic outcome. We argue that the evaluation and analysis of collegial relationships should be done through one’s contribution to the team dynamics: without this collectivist perspective, the ethics of collegiality cannot aspire to become encompassing normative theory. Because of its practical advantages, machine learning (ML) is increasingly used for decision-making in numerous sectors. This paper demonstrates that the integral characteristics of ML, such as semi-autonomy, complexity, and non-deterministic modeling have important ethical implications. In particular, these characteristics lead to a lack of insight and lack of comprehensibility, and ultimately to the loss of human control over decision-making. Errors, which are bound to occur in any decision-making process, may lead to great harm and human rights violations. It is (...) important to have a principled way of assigning responsibility for such errors. The integral characteristics of ML, however, pose serious difficulties in defining responsibility and regulating ML decision-making. First, we elaborate on these characteristics and their epistemic and ethical implications. We then analyze possible general strategies for resolving the assignment of moral responsibility and show that, due to the specific way in which ML functions, each potential solution is problematic, whether we assign responsibility to humans, machines, or using hybrid models. Then, we shift focus on an alternative approach that bypasses moral responsibility and attempts to define legal liability independently through solutions such as informed consent and the no-fault compensation system. Both of these solutions prove unsatisfactory because they leave too much room for potential abuses of ML decision-making. We conclude that both ethical and legal solutions are fraught with serious difficulties. These difficulties prompt us to re-weigh the costs and benefits of using ML for high-stake decisions. This article analyses how recent critiques of secularism in political philosophy and cultural anthropology might productively be combined and contrasted with each other. I will show that Jürgen Habermas' postsecularism takes insufficient account of elementary criticisms of secularism on the part of anthropologists such as Talal Asad and Saba Mahmood. However, I shall also criticize Saba Mahmood’s reading of secularism by arguing that, in the end, she replaces the secular–religious divide with a secularity–piety divide; for example, in her reading of (...) Nasr Abu Zayd’s secular Islamic hermeneutics. This inhibits the use of her framework of analysis for a criticism of a problem central to Habermas' postsecularism, namely that it remains focused on specific intensities of belief. I shall then argue that, combined with the anthropological critiques of the secular, the political-historical nature of the fanaticism–piety–violence nexus should be integrated into political philosophical debates on secularism and postsecularism. The intention of this paper is to point to the dilemma humanity may face in light of AI advancements. The dilemma is whether to create a world with less evil or maintain the human status of moral agents. This dilemma may arise as a consequence of using automated decision-making systems for high-stakes decisions. The use of automated decision-making bears the risk of eliminating human moral agency and autonomy and reducing humans to mere moral patients. On the other hand, it also (...) has the potential to bring tremendous benefits to humanity by decreasing human-induced harm in the world. After presenting how this dilemma may arise, I explore general avenues for addressing it. I will argue that we do not have to solve this dilemma in an all-or-nothing fashion and that a more nuanced approach may be suitable. However, the main point I want to highlight is that we need to have a principled way of addressing this dilemma, which is currently missing. (shrink)

This paper delves into the use of machine learning-based systems in decision-making processes and its implications for moral responsibility as traditionally defined. It focuses on the emergence of responsibility gaps and examines proposed strategies to address them. The paper aims to provide an introductory and comprehensive overview of the ongoing debate surrounding moral responsibility in automated decision-making. By thoroughly examining these issues, we seek to contribute to a deeper understanding of the implications of AI integration in society.

This paper disucsses the Boolean algebraic axiomatic system of situations suggested by the Polish logician Roman Suszko (1919-1979). The paper will specifically examine the adequacy of the axioms, definitions and theorems of Suszko’s system as a model for Ludwig Wittgenstein’s Tracatus Logico-Philosophicus. It will be shown how the formal properties of Suszko’s system - the atomicity and completeness of the Boolean algebraic system - can be employed in order to clarify key concepts of the situational part of the Tractarian ontology. (...) After considering the formal reconstruction of the Tractarian concepts of teh world and logical space, a controversial issue pertaining to necessary facts in the Tracatus will be addressed. This will be followed by a formal clarification of the Tractarian concepts of logical place and possible worlds, the latter being identified as combinations of states and affairs, which are, according to the Tractarian ontology, the simplest kinds of situations. Forensic psychiatry is pervaded by moral dilemmas. Although professionals in forensic psychiatry are trained in law and psychiatry and are certainly aware of ethical issues in the care for patients, they tend to make decisions in an implicit way and not to discuss their moral concerns or doubts. More structural attention for ethics seems to be required. In this paper, we show the value of moral case deliberation in forensic psychiatry. Moral case deliberation is a specific kind of clinical ethics (...) support in which healthcare professionals discuss a moral issue from practice in a structured way, facilitated by an ethicist or specifically trained facilitator. It is applicable to a wide array of situations in healthcare practice. In contrast to other models of clinical ethics support, such as individual consultation, the focus is on the moral experience of professionals and using a structured method to foster dialog and joint moral learning. In this paper, an example of case on a forensic ward is presented. The case shows that moral case deliberation leads to reflection on values and stimulates openness and honesty regarding uncertainties. Moreover, the deliberation provides room for new insights and creates a basis for a joint decision on how to proceed further, recognizing the tensions and difficulties involved. (shrink)

This paper intends to critically consider the idea put forward by Johan Gamper that the principle of causal closure can be reconciled with the possibility of pluralism. This idea is based on redefining causal closure and on the introduction of so-called interfaces between the universes. By reconstructing and analyzing the author's argumentative steps, we will try to show that this approach is methodologically and explanatory unfounded. Firstly, this way of redefining the principle of causal closure is inconsistent with the very (...) reasons why this principle was introduced. Secondly, the proposed view does not bring the explanatory benefits it promises, that is, it cannot solve difficulties such as the problem of the first cause. Moreover, the position itself produces many additional concerns and perplexities that remain unresolved. The conclusion of our analysis is that certain aspects of the proposed position may be sustainable and plausible, but only if novel arguments should be offered. (shrink)

From the viral social media feeds showing Chief Justice Mogoeng Mogoeng in fervent prayer for the nation, to professed Christian Thuli Madonsela’s careful expression of the separation between religion and state, faith identity in the public sphere emerges as anything but a straightforward matter. By placing ‘Christian’ in parenthesis, the 2019 theme of the Theological Society of South Africa conference acknowledged that leaders operate in negotiated spaces and confirmed the complexity of the context in which we attempt to conceptualise leadership (...) from a theological perspective. This raises the question of the role that personal faith convictions play and may be allowed to play in public life. While conceptualising leadership from a faith perspective in a context that is at once secular and post-secular may be complex, evidence emerging from leadership studies of the importance of spirituality in leadership necessitates such a reflection. This article considers the problem from a theological point of view, drawing on Schleiermacher and Bonhoeffer’s later letters from prison to provide a theological foundation for a public spirituality of leadership. This article presents hospitality as a pivotal value in the context of increasing diversity that characterises the complex relations in which leadership emerges. After reviewing the concept of Otherness in philosophy, the notion of hospitality as developed by Richard Kearney in relation to his philosophy of religion is introduced. The case of Nobel Peace Prize Laureate Chief Albert Luthuli is then presented as a biographical leadership study from the African context to illustrate how hospitality as open response to radical Otherness (...) may inspire collaboration and foster positive change. The article then addresses ways in which the notions of hospitality and Otherness present new opportunities to leadership studies for responding to the relational challenges of the globalised world. Amidst an increased scholarly focus on relationality and the need for relational intelligence, globalisation routinely confronts leaders and their followers with radical Otherness. Through dialogue between theology, philosophy of religion and leadership studies and by presenting a case from the African context, the article offers in print what is called for in the global context, namely an open response to the alterity of the Other that enables collaboration amidst increasing diversity. CONTRIBUTION: Proceeding from a transdisciplinary engagement, the article illustrates that leadership studies stood to benefit from dialogue with theology and philosophy of religion, which offers ways of addressing the Otherness that characterise the globalised context of leadership. This article provides an overview of Richard Kearney’s attempt at re-imagining God post-metaphysically. In the context of a continental dialogue on the topic, Kearney has responded to onto-theology with a hermeneutic and phenomenologically informed attempt to rethink God post-metaphysically. This eschatological understanding of God is expounded in the article and is placed in relation to Kearney’s more recent concept of Anatheism. In this chapter, I introduce three different types of AI-based moral enhancement proposals discussed in the literature – substitutive enhancement, value-driven enhancement, and value-open moral enhancement. I analyse them based on the following criteria: effectiveness, examining whether they bring about tangible moral changes; autonomy, assessing whether they infringe on human autonomy and agency; and developmental impact, considering whether they hinder the development of natural moral skills. This analysis demonstrates that no single approach to AI enhancement can satisfy all proposed criteria, (...) suggesting a need for pluralism in devising AI-based enhancement tools. The most advisable approach to AI-based enhancement is to explore and develop a variety of tools that cater to the diverse needs of users and address different weaknesses in moral decision-making. Certain characteristics make machine learning a powerful tool for processing large amounts of data, and also particularly unsuitable for explanatory purposes. There are worries that its increasing use in science may sideline the explanatory goals of research. We analyze the key characteristics of ML that might have implications for the future directions in scientific research: epistemic opacity and the ‘theory-agnostic’ modeling. These characteristics are further analyzed in a comparison of ML with the traditional statistical methods, in order to demonstrate what (...) it is specifically that makes ML methodology substantially unsuitable for reaching explanations. The analysis is given broader philosophical context by connecting it with the views on the role of prediction and explanation in science, their relationship, and the value of explanation. We proceed to show, first, that ML disrupts the relationship between prediction and explanation commonly understood as a functional relationship. Then we show that the value of explanation is not exhausted in purely predictive functions, but rather has a ubiquitously recognized value for both science and everyday life. We then invoke two hypothetical scenarios with different degrees of automatization of science, which help test our intuitions on the role of explanation in science. The main question we address is whether ML will reorient or otherwise impact our standard explanatory practice. We conclude with a prognosis that ML would diversify science into purely predictively oriented research based on ML-like techniques and, on the other hand, remaining faithful to anthropocentric research focused on the search for explanation. In this article we address the social value of bioethics research and show how a participatory approach can achieve social impact for a wide audience of stakeholders, involving them in a process of joint moral learning. Participatory bioethics recognizes that research co-produced with stakeholders is more likely to have impact on healthcare practice. These approaches aim to engage multiple stakeholders and interested partners throughout the whole research process, including the framing of ideas and research questions, so that outcomes are tailored (...) to the interests and context, and the type of impact stakeholders envisage. There is an emphasis on realizing social change through the conduct of the research, and it is believed that the engagement of stakeholders in the research process will promote their intrinsic motivation to change their practice. Another distinctive feature of participatory bioethics research is that its central normative commitment is to reflection and dialogue, not to a particular substantive ethical approach. In reflection and dialogue there is an emphasis on inclusion and the co-production of knowledge. Furthermore, empirical and normative research are combined, and there is a deliberate attempt to give voice to otherwise marginalized positions. This provides a model of social impact which is relevant not only for bioethics research, but also for other areas of health care research. We will show the merits of a participatory approach to bioethics research with a case example. It concerns the reduction of coercion and in particular seclusion in Dutch mental healthcare. (shrink)

Résumé Cet article met en évidence la complexité des enjeux psychiques familiaux et individuels dans différentes cultures. La variabilité de la notion de famille et de celle de parenté fondée sur le tabou de l’inceste consanguin et symbolique introduit ces enjeux complexes. Les enjeux familiaux sont aussi différents selon le rang de l’enfant dans la fratrie, la différence des sexes ne manquant pas d’influer sur les relations fraternelles et les enjeux psychiques individuels.

Cet article tente de mettre en évidence que ce n’est pas le trouble du sommeil de l’enfant et le mode de coucher, objets de controverses dans les études épidémiologiques, qui favorisent le contexte incestuel ou encore entravent l’autonomie de l’enfant. Mais ce contexte incestuel au sens où l’entend Racamier s’inscrit dans la phase de séduction narcissique mutuelle dans l’interaction intersubjective mère-enfant (ou parent maternant-enfant) et favorise la distorsion de cette relation à cause du déni d’un manque imaginaire chez le parent, (...) déni qui contamine l’enfant. Il se perpétue alors une relation fusionnelle de nature incestueuse qui transforme les liens entre les deux partenaires en alliances narcissiques perverties pouvant mener à l’inceste génitalisé ou psychique. Des études cliniques montrent que cette distorsion relationnelle se retrouve aussi bien dans le contexte incestuel père maternant-fille que dans l’inceste père-fille. (shrink)

The relationship between history and justice traditionally has been dominated by the idea of the past as distant or absent . This ambiguous ontological status makes it very difficult to situate the often-felt “duty to remember” or obligation to “do justice to the past” in that past itself, and this has led philosophers from Friedrich Nietzsche to Keith Jenkins to plead against an “obsession” with history in favor of an ethics aimed at the present. History’s ability to contribute to the (...) quest for justice, as a result, often seems very restricted or even nonexistent. The introduction of the “presence”-paradigm in historiography can potentially alter this relation between history and justice. However, to do so it should be conceived in such a way that it offers a fundamental critique of the metaphysical dichotomy between the present and the absent and the underlying concept of time that supports this dichotomy. The “presence”-paradigm can be emancipatory and productive only if presence and absence are not perceived as absolute dichotomies. In the first part of this article I elaborate on the influence that the present/absent dichotomy has on the notion of justice by introducing a conceptual contrast between what I will call the “time of jurisdiction” and the “time of history.” The second part of the article focuses on the way certain aspects of the dominant Western chronosophy reinforce the present/absent dichotomy and thereby prevent us from thoroughly exploring the ambiguous but often very problematic presence of the past. Throughout the article I refer to the relatively recent phenomenon of truth commissions and the context of transitional justice to discuss some challenges for the “presence”-paradigm. (shrink)

This paper focuses on the relation between logic and ontology. In particular, it demonstrates how classical logical theory can clarify the ontological part of Ludwig Wittgenstein’s Tractatus Logico-Philosophicus. To this end, the work examines the adequacy of a formal system that was devised by the Polish logician, mathematician and philosopher Roman Suszko (1919–1979) as a model for the Tractatus. Following a brief explanation of the Tractarian ontology, the main ideas of Suszko’s system and its philosophical significance will be considered. The purpose of the present paper is to demonstrate the inconsistencies between ethical theory and legal practice of animal treatment. Specifically, we discuss contemporary legal solutions, based on three case studies – Serbian, German and UK positive law, and point out the inconsistencies in them. Moreover, we show that the main cause of these inconsistencies is anthropocentric view of moral relevance. In this paper, we consider the relative significance of concrete and abstract features for the identity and persistence of a group. The theoretical background for our analysis is the position according to which groups are realizations of structures. Our main argument is that the relative significance of the abstract features with respect to the significance of concrete features can vary across different types of groups.
