Lawyering for the Rule of Law introduces a new model of government lawyering in which government lawyers function as an ancillary mechanism that enables the court to expand its influence on policy-making within the political branches by forming out-of-court settlements. It discusses the centrality of government lawyers with regard to judicial mobilization and the enforcement of social reforms through adjudication, and sheds light on particular functions of government lawyers as adjudicators and facilitators of institutional arrangements. Questionnaire data obtained from 97 supervisory and nonsupervisory employees representing the Production, Production Services, Marketing, and Administration departments of an Israeli metal production plant were used to test the relationship between selected personal and organizational attributes and work related misbehavior. Following Vardi and Wiener''s (1996) framework, Organizational Misbehavior (OMB) was defined as intentional acts that violate formal core organizational rules. We found that there was a significant negative relationship between Organizational Climate and OMB, and between the Organizational Climate dimensions (Warmth (...) and Support, and Reward), and OMB. Also, the activities of misbehavior reported by both managers and employees were negatively related to the Rules, Instrumental and Caring dimensions of Ethical Climates as defined by Victor and Cullen (1988). I use a theorem from machine learning, called the “No Free Lunch” theorem to support the claim that non-epistemic values are essential to theory choice. I argue that NFL entails that predictive accuracy is insufficient to favor a given theory over others, and that NFL challenges our ability to give a purely epistemic justification for using other traditional epistemic virtues in theory choice. In addition, I argue that the natural way to overcome NFL’s challenge is to use non-epistemic values. If (...) my argument holds, non-epistemic values are entangled in theory choice regardless of human limitations and regardless of the subject matter. Thereby, my argument overcomes objections to the main lines of argument revealing the role of values in theory choice. At the end of the paper, I argue that, contrary to common conception, the epistemic challenge arising from NFL is distinct from Hume’s problem of induction and other forms of underdetermination. The article reviews the uses of the term ‘oikonomia’ in Greek-speaking antiquity and illustrates how the term was used in all spheres of human existence and in various arts and sciences, usually denoting the prudent dispensation of the field resources. In this era the arts and sciences also received their own economies, and the term oikonomia, designating in most cases the prudent management of resources, appears in political theory, military strategy, law, finance, medicine, literary criticism, architecture, music, history and rhetoric. (...) Among all the spheres, arts and sciences that were economized, the story of oikonomia in the field of rhetoric is at the center of this article’s attention. As shown, the concept of oikonomia took an intermediate form between the realm of thought – that is, the domain of philosophy – and the realm of public speech – the domain of politics. (shrink)

We define a Lie differential field as a field of characteristic 0 with an action, as derivations on , of some given Lie algebra . We assume that is a finite-dimensional vector space over some sub-field given in advance. As an example take the field of rational functions on a smooth algebraic variety, with .For every simple extension of Lie differential fields we find a finite system of differential equations that characterizes it. We then define, using first-order conditions, a collection (...) of allowed systems of differential equations s.t. the above characteristic systems are allowed. We prove that for every allowed system there exists a generic solution in some extension, and this solution is unique .We construct the model completion of the theory of Lie differential fields by adding axioms stating that every allowed system has almost generic solutions. The construction is a generalization of Blum's axioms for DCF0. We also show that this model completion is ω-stable. (shrink)

By exposing and exploring several implicit discussions of flesh in Derrida’s juridico-political texts from the 1990s, this paper outlines the conceptualization of flesh implicit in Derrida’s work and, consequently, argues (...) that this conceptualization is more coherent and significant than it may first appear. Based on this, and drawing on an argument between David Wood and Matthew Calarco about the relation between deconstruction and vegetarianism, I go on to argue that the Derridean concept of flesh offered here puts us in a better position to understand and solve some of the discrepancies and inconsistencies of Derrida’s famous attempts to answer his own “question of the animal” in his later writings. Jacques Derrida’s “question of the animal” was arguably the central philosophical axis of his last decade. In this paper, I argue that Derrida’s discussion of animals and animality started much earlier than is typically thought and that the sources and origins of this question can be traced all the way back to his earliest deconstructive texts. In addition, while it is true that the central vein of Derrida’s “question of the animal” was his deconstruction of Martin Heidegger’s onto-theological definition of (...) the human Dasein, by exposing and exploring the animalistic and non-anthropocentric tones of Derrida’s earliest critiques of both structuralism and phenomenology, this paper also widens and deepens the significance of this question by revealing its origins and implications to be not exclusively Heideggerian. This article studies the Cyclops' scene in the ninth book of the Odyssey in order to demonstrate how the hero's confrontation with the new world and its new rules reflects a fundamental conflict between the values of the heroic age and those of the post-war era. Applying the narratological tools of narration and focalization, the article delineates the hero's convoluted progress toward adaptation to a new reality where formerly privileged values must be replaced. What makes this path especially arduous is (...) the repeated thwarting of all attempts to establish dominance through colonization. The complex nexus of contrasting values culminates in the epic's eponymous hero relinquishing his acquisitive colonialism and drastically modifying his heroic values, thus elevating the humane values of self-restraint and rational conduct based on self-sufficiency to a plane above martial heroism. Since the beginning of the last century, with the development of the Theory of Relativity, an ever-growing gap has come into being between our knowledge about the structure of the world around us and our ability to conceptualize it. Because language plays a major role in our ability to describe the world and our role within it, a need has been created to match the capabilities of language to the knowledge we currently possess about the world we inhabit. This article (...) will focus on two main arguments: (A) our ability to describe and conceptualize the world using a language that is limited, problematic and finite and (B) The possibility of developing a new language based on other principles than those governing verbal speech, which can deal with these limitations and problems and which is better suited to describing the world as we know it today. In Themistius’ Paraphrase of Aristotle’s _Metaphysics_ 12, Yoav Meyrav offers a new critical edition and study of the Hebrew text and the Arabic fragments of Themistius’ 4th century paraphrase, whose original Greek is lost.

My key argument will be that by shifting the debate over Jewish emancipation from the plane of theology, where it had been traditionally fought, to the plane of sociology, Marx was able to circumvent one of Bauer's main arguments against emancipating the Jews. Bauer had contended that as a religion of law, not of faith, Judaism was by its very nature a public creed. It was incompatible, therefore, with life in a free state, where religion could only be a private (...) matter. Marx chose to ignore this argument, treat Judaism as no different from Christianity, and focus his discussion on the nature of the state on the one hand and on the role played by the Jews in civil society on the other. This was less than a satisfactory response to Bauer's argument, but it enabled Marx to present a powerful case for emancipation while, at the same time, launching his critique of economic alienation. Thus, the philosophical advances made by Marx in On the Jewish Question were necessitated by, and integrally related to, his commitment to Jewish emancipation. (shrink)

We identify two pragmatic problems in temporal reasoning, the qualification problem and the extended prediction problem, the latter subsuming the infamous frame problem. Solutions to those seem to call for nonmonotonic inferences, and yet naive use of standard nonmonotonic logics turns out to be inappropriate. Looking for an alternative, we first propose a uniform approach to constructing and understanding nonmonotonic logics. This framework subsumes many existing nonmonotonic formalisms, and yet is remarkably simple, adding almost no extra baggage to traditional logic. (...) We then use this framework to propose a solution to the qualification problem. We also outline a solution to the extended prediction problem, and speculate on a possible connection between the above discussion and the concept of causation. (shrink)

It is suggested that taking into account considerations that traditionally fall within the scope of computer science in general, and artificial intelligence in particular, sheds new light on the subject of causation. It is argued that adopting causal notions con be viewed as filling a computational need: They allow reasoning with incomplete information, facilitate economical representations, and afford relatively efficient methods for reasoning about those representations. Specifically, it is proposed that causal reasoning is intimately bound to nonmonotonic reasoning. An account (...) of causation is offered that relies upon this connection, and compares this proposal to previous accounts within philosophy and artificial intelligence. (shrink)

In this Article I argue that the citizenship status of Israel’s Palestinian citizens has been eroding since the "events" of October 2000 and that, as a result, Israel, within its rpe-1967 borders, may be moving from a form of democracy that has been termed "ethnic democracy" towards a form of non-democratic state that has been termed "ethnocracy." My argument is based primarily on two legal documents: the new Citizenship and Entry into Israel Law, 2003, which denies Palestinian citizens the right (...) to unite with their closest family members who are residents of the Occupied Territories, and the decision of the High Court of Justice that upheld the constitutionality of this law in 2006. Two other developments that seem to support my thesis are analyzed as well: the "events" of October 2000 themselves and the report of the state commission of inquiry that investigated these events, and the plan, advanced by Yvette Lieberman and his political party, "Yisrael Beytenu," to shift the border between Israel and the West Bank westward, depriving tens of thousands of citizen-Palestinians of their Israeli citizenship. IN MY PREVIOUS ESSAY, I concentrated on the importance for Derrida of regarding a text, qua text, as an ahierarchical phenomenon, and of the unity of contradictions necessary for a deconstructive reading. In this essay I shall discuss in detail the realization of the latter principle in Derrida's reading of Plato's Phaedrus. This will illuminate the problematic relationship between the deconstructive interpreter and his text. This article tackles Giorgio Agamben's critique of Michel Foucault's genealogy of governmentality in two ways: first, by presenting an alternative model of the relations between pastoral and theological economy and, second, by conducting a genealogy of the former as revealed in the state of exception, when canon law is suspended. Following the author's genealogy of oikonomia in the state of exception, he argues that politics and economy are distinct from one another by virtue of the fact that the primary relation (...) of the latter is one of inclusion while that of the former is one of exclusion. Finally, the author traces three of oikonomia's prolific qualities in the operation of governmentality in civil society and of market economy: (i) its inclusiveness; (ii) the constant representation of the irreconcilability of law and authority; and (iii) its operation by accommodating to the ways of the governed. Reading numbers aloud involves visual processes that analyze the digit string and verbal processes that produce the number words. Cognitive models of number reading assume that information flows from the visual input to the verbal production processes—a feed‐forward processing mode in which the verbal production depends on the visual input but not vice versa. Here, I show that information flows also in the opposite direction, from verbal production to the visual input processes. Participants read aloud briefly presented multi‐digit strings in (...) Hebrew, in which the order of words is congruent with the order of digits (21 = twenty‐and‐one), and in Arabic, in which the ones word precedes the tens word (one‐and‐twenty). The error‐by‐digit‐position curve was affected by language: relative to Hebrew, in Arabic the error rate was slightly lower for the unit digit and slightly higher for the decade digit, indicating that in Arabic the unit digit was processed earlier and the decade digit later, in accord with the Arabic word order. This language‐dependent processing order originated in the visual level and was not a verbal confound, because it persisted even when I controlled for the serial position of the decade/unit word in the verbal number by using numbers with 0 (two hundred three/two hundred thirty). I conclude that the visual analyzer's digit scanning order, decade‐first or unit‐first, is not fixed but affected by the language in which the number is produced—a top‐down, verbal‐to‐visual information flow. On the basis of two large scale diary studies (n = 2022, n = 762) We study differences in the effects of dispositions and situations in the formation of positive and negative retrospective affect (retrospective-PA and retrospective-NA, respectively), the affect associated with extended (e.g. daily) experiences, as opposed to very short (episodic) experiences. We suggest that the differences between retrospective-PA and retrospective-NA is due to the fact that positive retrospective evaluation (i.e. the evaluation of positive retrospective affect) involves primarily top-down (...) processing, in which people resort to their dispositions in making these evaluations, whereas negative retrospective evaluation (the evaluation of negative retrospective affect) is primarily based on the cumulative affects of individual experiences. The collected volume Jewish Veganism and Vegetarianism: Studies and New Directions aspires to explore the growing phenomenon of Jews adopting a meat-free way of life from different perspectives and disciplines. Despite a number of standout contributions, it does little to advance scholarship in the field. The present review first discusses the various articles included in the volume and then reflects on the problematic editorial approach that hinders its enormous scholarly potential.

While logical theories of information attitudes, such as knowledge, certainty and belief, have flourished in the past two decades, formalization of other facets of rational behavior have lagged behind significantly. One intriguing line of research concerns the concept of intention. I will discuss one approach to tackling the notion within a logical framework, based on a database perspective.

In analyzing evidence indicating that K'ung-ts'ung-tzu was a forgery, Yoav Ariel questions current views of the Confucian school in the time between the Sage's death in the fifth century B.C. and the emergence in the eleventh century of Neo-Confucianism. The text, traditionally ascribed to a descendant of Confucius, K'ung Fu, provides a setting for a series of philosophical debates between K'ung family members and representatives of such non-Confucian schools as Legalism, Mohism, and the School of Names. However, finding that (...) this text was probably fabricated by the controversial Confucian master, Wang Su, Ariel explains how it sheds light on the third-century philosophical milieu: Confucianism then is seen to have been not only Taoistically metaphysical, individualistic, and escapist, but also aggressive in advocating early Confucian values. The first part of Ariel's book deals with the general characteristics, history, dating, authenticity, and authorship of the text. The second part is a fully annotated and analyzed translation of the first of the two traditional volumes that constitute the K'ung-ts'ung-tzu. Originally published in 1989. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions.
