The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

Il montre comment, au sein de ce processus, la réglementation change de forme et de nature plus qu’elle ne disparaît réellement. À un contrôle direct par l’autorité publique se substitue progressivement un contrôle indirect par une concurrence encadrée. Les enjeux éthiques de la déréglementation sont abordés à la lumière de cette analyse économique.

Xavier Zubiri entiende que el tema del mundo, a pesar de tener una noble prosapia en la historia de la filosofía, ha sido desatendido por la mayor parte del pensamiento reciente. Posiblemente fue Descartes el último gran filósofo en escribir un tratado dedicado temáticamente al problema del mundo. Es como si la atención a las cosas que hay en el universo hubiera hecho que se perdiera de vista el problema del universo mismo. Por supuesto, no faltan filósofos contemporáneos que (...) hayan hablado del mundo. Pero Zubiri entiende que esos filósofos lo han hecho de una manera unilateral, atendiendo únicamente al diálogo con las ciencias humanas, y desarrollando de esta manera conceptos del mundo en los que no caben las aportaciones de las ciencias naturales. Ahora bien, ya en el año 1960 Zubiri señalaba que no sólo la historia humana, sino también los nuevos descubrimientos en ciencias tales como la astronomía o la biología exigían que la filosofía se volviera a enfrentar sistemáticamente con la cuestión filosófica del mundo. Esto es lo que Zubiri hizo en este curso, impartido en la Cámara de Comercio de Madrid, y que ahora presentamos a los lectores. Sin duda, el medio siglo transcurrido desde entonces haría necesaria una actualización de las informaciones científicas que Zubiri manejaba. Sin embargo, muchos de los conceptos desarrollados por él en aquellas lecciones, precisamente por su novedad, por su radicalidad, y por su apertura a una concepción abierta y dinámica de la ciencia, siguen siendo relevantes en el presente. No sólo eso. En una última y extensa lección Zubiri se planteó una cuestión crucial para la filosofía: la de un posible fundamento del mundo. También aquí su profundo conocimiento de la historia del pensamiento, su rigor y al mismo tiempo su originalidad filosófica, siguen siendo inspiradores para los lectores contemporáneos. (shrink)

Replying to Samuel Knafo and Benno Teschke, this article shows how Political Marxism offers powerful conceptual tools to understand modes of production that structure historical processes as fundamentally constituted by exploitative social and political relations. I explain how structure, or rules of reproduction, should be understood as alienated social relations, which are inherent to all class societies. Understanding structure this way leaves ample space for – and makes inevitable – the consideration of agency.

The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

In this article we defend the inferential view of scientific models and idealisation. Models are seen as “inferential prostheses” (instruments for surrogative reasoning) construed by means of an idealisation-concretisation process, which we essentially understand as a kind of counterfactual deformation procedure (also analysed in inferential terms). The value of scientific representation is understood in terms not only of the success of the inferential outcomes arrived at with its help, but also of the heuristic power of representation and their capacity to (...) correct and improve our models. This provides us with an argument against Sugden’s account of credible models: the likelihood or realisticness (their “credibility”) is not always a good measure of their acceptability. As opposed to “credibility” we propose the notion of “enlightening”, which is the capacity of giving us understanding in the sense of an inferential ability. (shrink)

It is shown that Friedman's problem, whether there exists a proper extension of first order logic satisfying the compactness and interpolation theorems, has extremely simple positive solutions if one considers extensions by generalized (finitary) propositional connectives. This does not solve, however, the problem of whether such extensions exist which are also closed under relativization of formulas.

Meses después publicó la última de esas lecciones bajo el título de La dimensión histórica del ser humano. El presente volumen recoge el texto de las tres conferencias, más la versión escrita de la última de ellas. La tesis que Zubiri desarrolla en estas lecciones es que el ser humano es (...) a la vez y necesariamente individual, social e histórico, y que estas dimensiones vienen exigidas por su propia realidad específica, que es pluralizante, continuante y prospectiva. Many if not most sperm donors in the early years of IVF donated under conditions of anonymity. There is, however, a growing awareness of the ethical cost of withholding identifying parental information from donor children. Today, anonymous donation is illegal in many jurisdictions, and some jurisdictions have gone as far as retrospectively invalidating contracts whereby donors were guaranteed anonymity. This article provides a critical evaluation of the ethics and legality of anonymous donation. We defend Australian and British legislation that has (...) outlawed donor anonymity, and we argue for the establishment of a central registry that provides donor children with the ability to easily and reliably access identifying information about their donor parents. In the half-century that elapsed between 1830 and 1880, the city of Barcelona, while industrializing and tripling its population, saw how rich scientific collections (mainly naturalistic, archeological, and anatomical) could be created or lost, opened to the public or forgotten. The complexity and variety of the movements of these collections go beyond the narrow historiographical framework defined by a supposedly linear evolution towards greater accumulation and openness to the public. There has been significant debate about whether the moral norms of medical practice arise from some feature or set of features internal to the discipline of medicine. In this article, I analyze Edmund Pellegrino’s conception of the internal morality of medicine, and situate it in the context of Alasdair MacIntyre’s influential account of “practice.” Building upon MacIntyre, Pellegrino argued that medicine is a social practice with its own unique goals—namely, the medical, human, and spiritual good of the patient—and that the (...) moral norms that govern medical practice are derived from these goals. After providing an overview of Pellegrino’s work, I discuss some forceful objections to his theory—specifically, that it is too rigid and incapable of entering into dialogue with contemporary values systems; that it is dependent on an external conception of human flourishing; and that it is incompatible with the rapidly changing nature of modern medicine. In the final section of this article, I consider how theorists working in the Hippocratic tradition might respond to these objections against ethical essentialism by drawing upon MacIntyre’s historico-cultural method as well as what he calls Aristotle’s “metaphysical biology.”. In this paper, I show that Polleit and Mariano (2011) are right in concluding that Credit Default Swaps (CDS) are per se unobjectionable from Rothbard’s libertarian perspective on property rights and contract theory, but that they fail to derive this conclusion properly. I therefore outline the proper explanation. In addition, though Polleit and Mariano are correct in pointing out that speculation with CDS can conceivably hurt the borrowers’ interests, they fail to grasp that this can be the case only in (...) some peculiar circumstances that I identify. In other words, they miss the bigger picture, the one outside special circumstances, in which CDS trading has the opposite effect. That is, CDS facilitate debt accumulation, including government debt accumulation. Finally, I point out how this can precipitate the collapse of fiat money regimes. An incidental goal of the analysis is to provide a better account than Polleit and Mariano of recent government interventions in and around CDS markets. (shrink)

Xavier Landes | : Happiness has become a central theme in public debates. Happiness indicators illustrate this importance. This article offers a typology of the main challenges conveyed by the elaboration of happiness indicators, where happiness can be understood as hedonia, subjective well-being, or eudaimonia. The typology is structured around four questions: what to measure?—i.e., the difficulties linked to the choice of a particular understanding of happiness for building an indicator; whom to include?—i.e., the limits of the community monitored (...) by such an indicator; how to collect the data?—i.e., the difficulties stemming from objective and subjective reporting; what to do?—i.e., the concerns about the use of happiness indicators in public policy. The major points of normative contention are discussed for each of these dimensions. The purpose of this article is to contribute in a constructive manner to happiness research by offering an overview of some major philosophical and political challenges of building happiness indicators. The conclusion underlines the importance of the strategy of diversification- hybridization, which consists in setting a variety of indicators or composite indicators that articulate different understandings of happiness. It is stressed that happiness indicators raise democratic and institutional issues with which normative thinkers should deal. | : Le bonheur est devenu un thème central dans les débats publics. Les indicateurs de bonheur illustrent cette importance. Cet article offre une typologie des principaux enjeux contenus dans le travail d’élaboration d’indicateurs de bonheur quand ce dernier est compris comme hedonia, bien-être subjectif ou eudaimonia. La typologie est structurée autour de quatre questions : 1) que mesurer?, où sont en jeu les difficultés liées au choix d’une compréhension particulière du bonheur pour construire un indicateur; 2) qui inclure?, c’est-à-dire comment tracer les limites de la communauté morale qui est l’objet d’un tel indicateur; 3) comment collecter les données?, où on interroge les difficultés propres aux techniques subjectives et objectives de collecte de données; 4) que faire?, où on soulève l’enjeu des craintes quant à l’usage d’indicateurs de bonheur dans les politiques publiques. Les points majeurs de dispute normative sont discutés pour chaque dimension. Nous espérons ainsi contribuer de manière constructive à la recherche sur le bonheur en offrant un aperçu de quelques défis philosophiques et politiques majeurs relatifs à la construction d’indicateurs de bonheur. Nous concluons en soulignant l’importance de la stratégie de diversification-hybridation qui consiste à mettre en place des indicateurs variés ou composites articulant différentes compréhensions du bonheur. L’article réexamine la signification, dans la pensée de Phérécyde, du témoignage de Damascius sur la génération des dieux des cinq recoins par les trois éléments créés par Chronos. Les modèles par lesquels on explique la génération de cinq familles de dieux ou de cinq régions du monde à partir de ces trois éléments comportent des difficultés internes, ainsi que des anachronismes qui ont conduit à penser que Phérécyde préfigurerait par exemple les théories d’un Empédocle sur le mélange des éléments. Ces (...) difficultés sont issues d’une interprétation erronée du texte : rien n’indique que la génération des cinq recoins comporte cinq familles ni que ces familles ont des caractéristiques différentes. Lever ce faux problème permet de mieux apprécier le sens du témoignage dans l’entreprise de Phérécyde : il ne s’agit pas de rationaliser le mythe au sens d’une préfiguration de la pensée présocratique, mais de produire une généalogie mythique dont la structure rationalise la théogonie d’un Hésiode à l’intérieur de la pensée mythique. Loin de faire de feu, souffle et eau des éléments physiques (des στοιχεῖα), Phérécyde les traite ici comme des éléments naturels conçus de façon abstraite, sans qu’on ait besoin d’admettre un anachronisme. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. Scientific journals may incur scientific error if articles are tainted by research misconduct. While some journals’ ethical policies, especially those on conflicts of interest, have improved over recent years, with some adopting a uniform approach, only around half of biomedical journals, principally those with higher impact factors, currently have formal misconduct policies, mainly for handling allegations. Worryingly, since a response to allegations would reasonably require an a priori definition, far fewer journals have publicly available definitions of misconduct. While some journals (...) and editors’ associations have taken significant steps to prevent and detect misconduct and respond to allegations, the content, visibility of and access to these policies varies considerably. In addition, while the lack of misconduct policies may prompt and maintain a de novo approach for journals, potentially causing stress, publication delays and even legal disputes, the lack of uniformity may be a matter of contention for research stakeholders such as editors, authors and their institutions, and publishers. Although each case may need an individual approach, I argue that posting highly visible, readily accessible, comprehensive, consistent misconduct policies could prevent the publication of fraudulent papers, increase the number of retractions of already published papers and, perhaps, reduce research misconduct. Although legally problematic, a concerted approach, with sharing of information between editors, which is clearly explained in journal websites, could also help. Ideally, journals, editors’ associations, and publishers should seek consistency and homogenise misconduct policies to maintain public confidence in the integrity of biomedical research publications. The book by Magali Année, Tyrtee et Kallinos, claims to establish new and ambitious grounds on which to found an interpretation of Tyrtaeus’ and Kallinos’ works. By analysing the underlining networks of phonic‑syllabic repetitions in the available fragments, she studies how those two poets have elaborated a paroenetic‑incantatory diction to make the audience accept the content of the exhortation as an already‑lived experience. For instance, she argues that any item in the phonic sequence ‑μεν/μην/μον/μν‑, even as a palindrome, refers to (...) the action denoted by the verb μένειν, “to resist”. Année elaborates the conditions for the plausibility of her original interpretation through a re‑evaluation of the frameworks through which archaic poems are usually interpreted, and she proposes a new edition of the testimonies and fragments on the ground of radical textual conservatism. After summarising the author’s arguments in detail, I conclude that, in spite of their merits, they fail to meet the author’s objectives completely. I discuss in turn : how the author arranges the new edition of the testimonies and fragments ; how she argues for her central view about phonic‑syllabic repetitions and the elaboration of the secondary layer of meaning ; and how she analyses meter, which she presents as one of the bases for phonic‑pragmatic constructs ; and how she conceives of her hermeneutical approach. On this last point, I specifically address the author’s view on the relationship between testimonies and fragments, the type of meaning she focuses on, the deconstruction of pre‑interpretations, and textual conservatism. I argue that the Année’s proposed underlying network of meaning comes at the expense of “meaning” in the more usual sense ; we could however have expected her to elaborate on how her proposed layer of meaning enriches or enhances our understanding of the more usual layer. Tyrtee et Kallinos therefore represents an alternative to traditional interpretative approaches, with limits of its own, rather than a re‑founding. (shrink)
