    Evaluation as institution: a contractarian argument for needs-based economic evaluation.Wolf H. Rogowski - 2018 - BMC Medical Ethics 19 (1):59.
There is a gap between health economic evaluation methods and the value judgments of coverage decision makers, at least in Germany. Measuring preference satisfaction has been claimed to be inappropriate for allocating health care resources, e.g. because it disregards medical need. The existing methods oriented at medical need have been claimed to disregard non-consequentialist fairness concerns. The aim of this article is to propose a new, contractarian argument for justifying needs-based economic evaluation. It is based on consent rather than maximization (...)

Purpose This paper aims to explore the ethical and social impact of augmented visual field devices, identifying issues that AVFDs share with existing devices and suggesting new ethical and social issues that arise with the adoption of AVFDs. Design/methodology/approach This essay incorporates both a philosophical and an ethical analysis approach. It is based on Plato’s Allegory of the Cave, philosophical notions of transparency and presence and human values including psychological well-being, physical well-being, privacy, deception, informed consent, ownership and property and (...)

(1 other version)Rethinking Integration of Epistemic Strategies in Social Understanding: Examining the Central Role of Mindreading in Pluralist Accounts.Julia Wolf, Sabrina Coninx & Albert Newen - 2021 - Erkenntnis 88 (7):1-29.
In recent years, theories of social understanding have moved away from arguing that just one epistemic strategy, such as theory-based inference or simulation constitutes our ability of social understanding. Empirical observations speak against any monistic view and have given rise to pluralistic accounts arguing that humans rely on a large variety of epistemic strategies in social understanding. We agree with this promising pluralist approach, but highlight two open questions: what is the residual role of mindreading, i.e. the indirect attribution of (...)

  23. Hegel's Metametaphysical Antirealism.W. Clark Wolf - forthcoming - International Journal of Philosophical Studies:1-22.
This essay defends a reading of Hegel as a metametaphysical antirealist. Metametaphysical antirealism is a denial that metaphysics has as its subject matter answers to theoretical questions about the mind-independent world. Hence, on this view, metaphysical questions are not, in principle, knowledge transcendent. I hold that Hegel presents a version of metametaphysical antirealism in the Science of Logic because he pursues his project by suspending reference to all supposed objects of metaphysical theory as practiced before him. Hegel introduces reference in (...)

Transnational Governance, Deliberative Democracy, and the Legitimacy of ISO 26000: Analyzing the Case of a Global Multistakeholder Process.Christian Weidtmann & Rüdiger Hahn - 2016 - Business and Society 55 (1):90-129.
Globalization arguably generated a governance gap that is being filled by transnational rule-making involving private actors among others. The democratic legitimacy of such new forms of governance beyond nation states is sometimes questioned. Apart from nation-centered democracies, such governance cannot build, for example, on representation and voting procedures to convey legitimacy to the generated rules. Instead, alternative elements of democracy such as deliberation and inclusion require discussion to assess new instruments of governance. The recently published standard ISO 26000 is an (...)

Implementing Regulatory Broad Consent Under the Revised Common Rule: Clarifying Key Points and the Need for Evidence.Holly Fernandez Lynch, Leslie E. Wolf & Mark Barnes - 2019 - Journal of Law, Medicine and Ethics 47 (2):213-231.
The revised Common Rule includes a new option for the conduct of secondary research with identifiable data and biospecimens: regulatory broad consent. Motivated by concerns regarding autonomy and trust in the research enterprise, regulators had initially proposed broad consent in a manner that would have rendered it the exclusive approach to secondary research with all biospecimens, regardless of identifiability. Based on public comments from both researchers and patients concerned that this approach would hinder important medical advances, however, regulators decided to (...)

The emergence of nanotechnology, and specifically nanobiotechnology, raises major oversight challenges. In the United States, government, industry, and researchers are debating what oversight approaches are most appropriate. Among the federal agencies already embroiled in discussion of oversight approaches are the Food and Drug Administration , Environmental Protection Agency , Department of Agriculture , Occupational Safety and Health Administration , and National Institutes of Health . All can learn from assessment of the successes and failures of past oversight efforts aimed at (...)

On the battlefield of ‘ Theorie ’ Koselleck reads L. von Stein with Carl Schmitt’s eyes.Wolf Feuerhahn - 2023 - History of European Ideas 49 (1):72-88.
The shadow cast by National Socialism over the German academic world, and Koselleck’s close relations with the Nazi lawyer Carl Schmitt, constitute a challenge for a historical inquiry of Koselleck’s historiography. To address this challenge, I propose a ‘close contextual reading’ of an article published in 1965 (‘Geschichtliche Prognose in Lorenz von Steins Schrift zur preussischen Verfassung’) in which Koselleck puts forward one of his major diagnoses of how the conception of history had evolved since 1750. This article praises Lorenz (...)

Promising stabs in the Dark: theory virtues and pursuit-worthiness in the Dark Energy problem.William J. Wolf & Patrick M. Duerr - 2024 - Synthese 204 (6):1-40.
This paper argues that we ought to conceive of the Dark Energy problem—the question of how to account for observational data, naturally interpreted as accelerated expansion of the universe—as a crisis of underdetermined pursuit-worthiness. Not only are the various approaches to the Dark Energy problem evidentially underdetermined; at present, no compelling reasons single out any of them as more likely to be true than the other. More vexingly for working scientists, none of the approaches stands out as uncontroversially preferable over (...)

  38. Kant's Conclusions in the Transcendental Aesthetic.W. Clark Wolf - forthcoming - Journal of the History of Philosophy.
In the Transcendental Aesthetic (TA), Kant is typically held to make negative assertations about “things in themselves,” namely that they are not spatial or temporal. These negative assertions stand behind the “neglected alternative” problem for Kant’s transcendental idealism. According to this problem, Kant may be entitled to assert that spatio-temporality is a subjective element of our cognition, but he cannot rule out that it may also be a feature of the objective world. In this paper, I show in a new (...)

The Law of Incidental Findings in Human Subjects Research: Establishing Researchers' Duties.Susan M. Wolf, Jordan Paradise & Charlisse Caga-Anan - 2008 - Journal of Law, Medicine and Ethics 36 (2):361-383.
Technology has outpaced the capacity of researchers performing research on human participants to interpret all data generated and handle those data responsibly. This poses a critical challenge to existing rules governing human subjects research. The technologies used in research to generate images, scans, and data can now produce so much information that there is significant potential for incidental findings, findings generated in the course of research but beyond the aims of the study. Neuroimaging scans may visualize the entire brain and (...)

The Continuing Evolution of Ethical Standards for Genomic Sequencing in Clinical Care: Restoring Patient Choice.Susan M. Wolf - 2017 - Journal of Law, Medicine and Ethics 45 (3):333-340.
Developing ethical standards for clinical use of large-scale genome and exome sequencing has proven challenging, in part due to the inevitability of incidental or secondary findings. Policy of the American College of Medical Genetics and Genomics has evolved but remains problematic. In 2013, ACMG issued policy recommending mandatory analysis of 56 extra genes whenever sequencing was ordered for any indication, in order to ascertain positive findings in pathogenic and actionable genes. Widespread objection yielded a 2014 amendment allowing patients to opt-out (...)

Determining the Function of Social Referencing: The Role of Familiarity and Situational Threat.Samantha Ehli, Julia Wolf, Albert Newen, Silvia Schneider & Babett Voigt - 2020 - Frontiers in Psychology 11.
In ambiguous situations, infants have the tendency to gather information from a social interaction partner to regulate their behavior [social referencing ]. There are two main competing theories concerning SR’s function. According to social-cognitive information-seeking accounts, infants look at social interaction partners to gain information about the ambiguous situation. According to co-regulation accounts, infants look at social interaction partners to receive emotional support. This review provides an overview of the central developments in SR literature in the past years. We focus (...)

In contrast to the juxtaposition of representative democracy and Confucian meritocracy that is currently being discussed in international political theory, we start from the hypothesis of a historical, intercultural and logical, simultaneous provenance of democracy and meritocracy in the evolution of the modern constitutional state. To this end, we examine the reception of Confucianism in the republican history of ideas of European Enlightenment using selected examples ranging from Leibniz to the classical constitutional and government theory of Sieyès. The widespread ignorance (...)

Teleofunction in the Service of Computational Individuation.Nir Fresco, Marc Artiga & Marty J. Wolf - unknown
One type of computational indeterminacy arises from partitioning a system’s physical state space into state types that correspond to the abstract state types underlying the computation concerned. The mechanistic individuative strategy posits that computation can be uniquely identified through either narrow physical properties exclusively or wide, proximal properties. The semantic strategy posits that computation should be uniquely identified through semantic properties. We develop, and defend, an alternative functional individuative strategy that appeals—when needed—to wide, distal functions. We claim that there is (...)
