The intelligibility of nature was a persistent theme of William A. Wallace, OP, one of the most prolific Catholic scholars of the late twentieth century. This Reader aims to make available a representative selection of his work in the history of science, natural philosophy, and theology illustrating his defense and development of this central theme. Wallace is among the most important Galileo scholars of the past fifty years and a key figure in the recent revival of scientific realism. Further, (...) his long and productive scholarly career has been shaped by a continuous effort to bring the resources of the Aristotelian-Thomistic tradition to the solution of contemporary problems of philosophy and science. Through all of these contributions, Wallace has provided the foundation for a renewed confidence in the capacity of human knowers to attain understanding of the natural order. Consequently, the overall aim of this volume is to secure continued access to his scholarship for readers in the new millennium. Intelligibility of Nature will contain twenty-nine previously published essays written by Wallace over a period of some forty years. Many of these essays are currently not readily accessible. Who is to be included in a political community and on what terms? William A. Barbieri Jr. seeks answers to these questions in this exploration of the controversial concept of citizenship rights—a concept directly related to the nature of democracy, equality, and cultural identity. Through an examination of the case of Germany’s settled “guestworkers” and their families, _Ethics of Citizenship_ investigates the pressing problem of political membership in a world marked by increased migration, rising nationalist sentiment, and the ongoing (...) reorganization of states through both peaceful and violent means. Although some of Germany’s foreign workers have gradually attained a degree of social and economic legitimacy, Barbieri explains how they remain effectively excluded from true German citizenship. Describing how this exclusion has occurred and assessing current attitudes toward political membership in Germany, he argues for a just and democratic policy toward the tax-paying, migrant worker minority, one that would combine the extension of the individual rights of citizenship with the establishment of certain group rights. Through a dissection of ongoing public “membership debates” over issues such as suffrage, dual citizenship, and immigration and refugee policy, Barbieri identifies a range of competing responses to the question of who “belongs” in Germany. After critiquing these views, he proposes an alternative ethic of membership rooted in an account of domination and human rights that seeks to balance individual and group rights within the context of a commitment to democracy and equal citizenship. The equal political liberties are among the basic first-principle liberties in John Rawls’s theory of Justice as fairness. Rawls insists, further, that the “fair value” of the political liberties must be guaranteed. Disavowing an interest in fair value is what disqualifies welfare-state capitalism as a possible realizer of Justice as fairness. Yet Rawls never gives a perspicuous statement of the reasoning in the original position for the fair-value guarantee. This article gathers up two distinct strands of Rawls’s argument, and presents (...) it in a straightforward sequence. Justice as fairness is contrasted to a competitor political conception of justice that is just like it but without the fair-value guarantee. Contemporary epistemology has assumed that knowledge is represented in sentences or propositions. However, a variety of extensions and alternatives to this view have been proposed in other areas of investigation. We review some of these proposals, focusing on (1) Ryle's notion of knowing how and Hanson's and Kuhn's accounts of theory-laden perception in science; (2) extensions of simple propositional representations in cognitive models and artificial intelligence; (3) the debate concerning imagistic versus propositional representations in cognitive psychology; (4) recent treatments of (...) concepts and categorization which reject the notion of necessary and sufficient conditions; and (5) parallel distributed processing (connectionist) models of cognition. This last development is especially promising in providing a flexible, powerful means of representing information nonpropositionally, and carrying out at least simple forms of inference without rules. Central to several of the proposals is the notion that much of human cognition might consist in pattern recognition rather than manipulation of rules and propositions. (shrink)

Many clinicians believe that allowing costs to influence clinical decisions is unethical. They are mistaken in this belief, because it cannot be ethical to ignore the adverse consequences upon others of the decisions you make, which is what 'costs' represent. There are, however, some important ethical issues in deciding what costs to count, and how to count them. But these dilemmas are equally strong with respect to what benefits to count and how to count them, some of which expose ethically (...) untenable assumptions about such widely-used clinical criteria as survival rates. One of the advantages of systematic cost-effectiveness analysis is that it exposes these hidden assumptions, and requires explicit judgements to be made about which ethical position is appropriate in a particular policy context. The scientific study of emotion faces a potentially serious problem: after over a hundred years of psychological study, we lack consensus regarding the very definition of emotion. We propose that part of the problem may be the tendency to define emotion in contrast to cognition, rather than viewing both “emotion” and “cognition” as being comprised of more elemental processes. We argue that considering emotion as a type of cognition (viewed broadly as information processing) may provide an understanding of the mechanisms (...) underlying domains that are traditionally thought to be qualitatively distinct. Howard Van Till 's review of my book No Free Lunch exemplifies perfectly why theistic evolution remains intelligent design's most implacable foe. Not only does theistic evolution sign off on the naturalism that pervades so much of contemporary science, but it justifies that naturalism theologically -- as though it were unworthy of God to create by any means other than an evolutionary process that carefully conceals God's tracks.

This book is the first detailed reconstruction of the late work of John Rawls, who was perhaps the most influential philosopher of the twentieth century. Rawls's 1971 treatise, A Theory of Justice, stimulated an outpouring of commentary on 'justice-as-fairness,' his conception of justice for an ideal, self-contained, modern political society. Most of that commentary took Rawls to be defending welfare-state capitalism as found in Western Europe and the United States. Far less attention has been given to Rawls's 2001 book, Justice (...) as Fairness: A Restatement. In the Restatement, Rawls not only substantially reformulates the 'original position' argument for the two principles of justice-as-fairness but also repudiates capitalist regimes as possible embodiments. Edmundson further develops Rawls's non-ideal theory, which guides us when we find ourselves in a society that falls well short of justice. (shrink)

Frank and William DriscollScholars do not have access to a complete bibliography of the new rhetoric project. We have redressed this problem by compiling what we believe is the most comprehensive bibliography to date of the works of Chaïm Perelman and of those he coauthored with Lucie Olbrechts-Tyteca. The bibliography includes all the English and French titles, as well as (...) titles that saw first publication in other languages. Translations we believe Perelman may have authorized or endorsed are included.With this bibliography, scholars can now better understand how the new rhetoric project was conceived and how it unfolded. Within the larger constellation of the project, Perelman's bibliography is the most extensive, numbering almost three hundred entries. The trajectory of Perelman's scholarship reveals the origins of the new rhetoric project and how it evolved between the time of his announcement in 1949 that he and Olbrechts-Tyteca had embarked on a program designed to rehabilitate reason and the period of his final articles in the 1980s. A review of the articles and books that came out of the Perelman and Olbrechts-Tyteca collaboration reveals both a phase of conceptualization and development of the project and a phase of culmination. In the first phase, commencing with Rhétorique et philosophie, the authors established the need for a rhetorically grounded philosophy. As they built toward the publication of the Traité, [End Page 449] the culmination of their ten-year effort, they wrote articles elaborating on "notions" in argumentation (1955) and on the tenets of the "new rhetoric" (1956). The recent accounting scandals have raised concerns regarding the closeness of auditor–client relationships. Critics argue that as the relationship lengthens a bond develops and auditors’ professional skepticism may be replaced with trust. However, Statement on Auditing Standards No. 99 states that auditors “should conduct the engagement with a mindset that recognizes the possibility that a material misstatement due to fraud could be present, regardless of any past experience with the entity and regardless of the auditor’s belief about management’s honesty and (...) integrity” (AICPA 2002, Statement on Auditing Standards No. 99, paragraph 13, p. 10). The purpose of this study is to investigate whether auditors develop trust in a client’s management and whether this trust affects auditors’ decisions. Specifically, this study examines whether auditors’ satisfaction with a client’s management during a prior audit engagement affects auditors’ self-reported trust in that client’s management and whether that trust affects their fraud risk assessment. The decision to trust a client’s management should be an ethical decision because excessive trust may impair auditors’ skepticism, which auditors are required to maintain by their professional responsibilities. We therefore also investigate whether auditors’ trust is affected by their moral reasoning. An experimental case was completed by 89 professional auditors, all with experience assessing the risk of fraud. The results suggest auditors’ satisfaction with the client affects their trust in the client (higher satisfaction associated with higher trust and lower satisfaction associated with lower trust). Further, after an overall unsatisfying experience, auditors’ trust affects their fraud risk assessments. However, after an overall satisfying experience, their trust does not affect their fraud risk assessments. The results indicate auditors are able to maintain their professional skepticism after satisfying past experiences with the client regardless of their beliefs about the honesty and trustworthiness of the client’s management. Lastly, auditors’ moral reasoning was not related to their trust in the client’s management. (shrink)

ONE might characterize the late twentieth century as a period when men have become oblivious of nature. Not only- is the concept of human nature under attack, but the broader awareness of nature itself, of things that exist by nature as opposed to those that exist through other causes, is no longer part of our mental equipment. The ecological crisis and the near exhaustion of many natural resources bear eloquent witness to this state of affairs. The scientific and industrial revolutions (...) have made us proficient at converting the objects that surround us into artifacts, at "manipulating nature," if you will, but they have dulled our appreciation for the intelligibility of nature in its own right. As an example I would cite the latest theme to attract attention in the philosophy of science, that of scientific revolutions and theory change, which has sought to substitute the notion of progress for that of truth. According to Thomas Kuhn and Larry Laudan, among others, science can no longer be said to be concerned with investigating the truth about the universe in which we live-another way of speaking about the truth of nature. Instead, the goal of science is seen by them to be progress, progress defined in terms of problem-solving effectiveness rather than as an approach to truth. In their view rationality has ceased to have an extrinsic norm; men are rational to the extent that they can solve puzzles or problems, not to the extent that they can understand the world of nature that surrounds them. The purpose of this study was to assess the presence of ethics committees in rural critical access hospitals across the United States. Several studies have investigated the presence of ethics committees in rural health care facilities. The limitation of these studies is in the definition of ‘rural hospital’ and a regional or state focus. These limitations have created large variations in the study findings. In this nation-wide study we used the criteria of a critical access hospital (CAH), as defined by (...) the Medicare Rural Hospital Flexibility Program (Flex Program, 2007), to bring consistency and clarity to the assessment of the presence of ethics committees in rural hospitals. The Flex Monitoring Team conducted a national telephone survey of 381 CAH administrators throughout the United States. The survey covered a wide variety of questions concerning hospitals’ community benefit, impact activities, and whether the hospital had a formally established an ethics committee. About 230 (60%) of the respondents indicated they had a formally established ethics committee or ethics consultation program at their CAH. The prevalence of ethics committees declined as the CAH location became increasingly rural along a rural–urban continuum. Unlike CAHs, all rural Department of Veterans Affairs Medical Centers have ethics committees. The results of this study provide an understanding of the limited presence of ethics committee in rural America and the need to consider new approaches for providing ethics assistance. A virtual ethics committee network may be the most efficient and effective way of providing rural hospitals access to a knowledgeable ethics committee or consultant. (shrink)

Life is preserved and enhanced by coordinated selectivity in local neural circuits. Narrow receptive-field selectivity is necessary to avoid the curse-of-dimensionality, but local activities can be made coherent and relevant by guiding learning and processing using broad coordinating contextual gain-controlling interactions. Better understanding of the functions and mechanisms of those interactions is therefore crucial to the issues Clark examines.

It is commonly supposed that citizens of a reasonably just state have a prima facie duty to obey its laws. In recent years, however, a number of influential political philosophers have concluded that there is no such duty. But how can the state be a legitimate authority if there is no general duty to obey its laws? This article is an attempt to explain how we can make sense of the idea of legitimate political authority without positing the existence of (...) a general duty to obey the law. The explanation makes use of a distinction between laws of general application, on one hand, and on the other the particularized, directed efforts by state officials to channel and resolve disputes (including those arising from violations of the law). Emotionality is a basic feature of behavior. The argument over whether the expression of emotions is based primarily on culture (constructivism, nurture) or biology (natural forms, nature) will never be resolved because both alternatives are untenable. The evidence is overwhelming that at all ages and all levels of organization, the development of emotionality is epigenetic: The organism is an active participant in its own development. To ascribe these effects to “experience” was the best that could be done for many years. (...) With the rapid acceleration of information on how changes in organization are actually brought about, it is a good time to review, update, and revitalize our views of experience in relation to the concept of basic emotion. Urban sprawl and aggressive driving are two problems that afflict many of America’s major cities. The two affect Atlanta to a notoriously high degree. The two problems are connected. Aggressive driving is not so much a symptom of “road rage” as it is an attempt to communicate with slower drivers. The aggressive driver tailgates other drivers with the intention of letting them know that they are impeding the flow of faster traffic. Aggressive drivers are engaged in what “New Chicago School” (...) legal theory calls “norm seeding.” These drivers are trying to get others to conform to a different norm than what the posted speed limit dictates. The posted speed limit, which is the legal norm, reflects legislative judgments based on concerns of safety and fuel economy. The higher, informal, speed limit reflects something else: the impatience many drivers feel as they drive larger distances and spend correspondingly greater amounts of time in traffic. (shrink)

The Physical Intentionality Thesis claims that dispositions share the marks of psychological intentionality; therefore, intentionality is not exclusively a mental phenomenon. Beyond the standard five marks, Alexander Bird introduces two additional marks of intentionality that he argues dispositions do not satisfy: first, thoughts are extrinsic; second, the direction of causation is that objects cause thoughts, not vice versa. In response, this paper identifies two relevant conceptions of extrinsicness, arguing that dispositions show deep parallels to thoughts on both conceptions. Then, it (...) shows that Bird’s discussion of direction of causation overlooks complexities of dispositionality and intentionality that problematize apparent differences between thoughts and dispositions.
