Skepticism about ethical expertise has grown common, raising concerns that bioethicists’ roles are inappropriate or depend on something other than expertise in ethics. While these roles may depend on skills other than those of expertise, overlooking the role of expertise in ethics distorts our conception of moral advising. This paper argues that motivations to reject ethical expertise often stem from concerns about elitism: either an intellectualist elitism, where some privileged elite have supposedly special access in virtue of expertise in moral (...) theory; or an authoritarian elitism, where our reliance on experts in ethics risks violation of autonomy and democracy. The paper sketches an anti-elitist conception of ethics expertise in bioethics as continuous with an anti-elitist conception of ethics expertise in common moral practice, undercutting the intellectualism, and then uses this anti-elitist conception to reject arguments that ethical expertise violates autonomy or democracy. An anti-elitist picture of ethical expertise both renders it consistent with our general moral practice and allows us to resist skeptical concerns. (shrink)

Despite the fact that psychedelics were proscribed from medical research half a century ago, recent, early-phase trials on psychedelics have suggested that they bring novel benefits to patients in the treatment of several mental and substance use disorders. When beneficial, the psychedelic experience is characterized by features unlike those of other psychiatric and medical treatments. These include senses of losing self-importance, ineffable knowledge, feelings of unity and connection with others and encountering ‘deep’ reality or God. In addition to symptom relief, (...) psychedelic experiences often lead to significant changes in a patient’s personality and worldview. Focusing on the case of psilocybin, we argue that the peculiar features of psychedelics pose certain novel risks, which warrant an enhanced informed consent process–one that is more comprehensive than what may be typical for other psychiatric medications. We highlight key issues that should be focused on during the consent process and suggest discussion prompts for enhanced consent in psychedelic psychiatry. Finally, we respond to potential objections before concluding with a discussion of ethical considerations that will arise as psychedelics proceed from highly controlled research environments into mainstream clinical psychiatry. The social psychology of science is a compelling new area of study whose shape is still emerging. This essay examines why coerced conduct tends not to have the moral and legal consequences that non-coerced conduct often has. In it, I argue against the “incapacitation approach,” the view that coerced conduct tends not to result in the coercer acquiring a permission or an entitlement because the coercee is typically incapable of exercising her rights to change the coercer’s permissions or entitlements. After demonstrating that coercees retain the ability to exercise those rights, this article develops an alternative account: that (...) coerced conduct tends not to have a licensing effect because coercees typically do not elect to effect a change in their coercers’ permissions or entitlements. This essay argues that Japan's resistance to the practice of transplanting organs from persons deemed “brain dead” may not be the result, as some claim, of that society's religions being not yet sufficiently expressive of love and altruism. The violence to the body necessary for the excision of transplantable organs seems to have been made acceptable to American Christians at a unique historical “window of opportunity” for acceptance of that new form of medical technology. Traditional reserve about corpse mutilation had (...) weakened and, especially as presented by the theologian Joseph Fletcher, organ donation was touted as both expressive of agape and a way of “updating” Christianity via the ethics of Utilitarianism. Many Japanese, largely Buddhist and Confucian in their orientation, view these changed valorizations as neither necessary nor patently more ethical than those of their own traditions. (shrink)

In a recent essay review of William R. Newman, Atoms and Alchemy (2006), Ursula Klein defends her position that philosophically informed corpuscularian theories of matter contributed little to the growing knowledge of "reversible reactions" and robust chemical species in the early modern period. Newman responds here by providing further evidence that an experimental, scholastic tradition of alchemy extending well into the Middle Ages had already argued extensively for the persistence of ingredients during processes of "mixture" (e.g. chemical reactions), and (...) that this corpuscular alchemical tradition bore important fruit in the work of early modern chymists such as Daniel Sennert and Robert Boyle. This article examines the sexist work experiences of a sample of women lawyers in a mediumsized midwestern city. Specifically, it focuses on reports of discrimination, gender disparagement, and sexual harassment as components of gendered systems that maintain and reinforce inequalities between men and women on the job. The relationships between these experiences, professional role orientation and structural work characteristics are explored. Respondents report lower levels of discrimination at the more visible and legally protected “front door” than on the job. For (...) the most part, private sector employees and those in token positions report higher levels of sexist behavior. Contrary to expectations, those with careerist orientations report more sexual harassment. The interrelations and implications of these findings for women's careers in the law are discussed. Sections 1 through 4 define, in the usual inductive style, various classes of object including one which is called the “combinatory terms of polymorphic type”. Section 5 defines a reduction relation on these terms. Section 6 shows that the weak normalizability of the combinatory terms of polymorphic type entails the weak normalizability of the lambda terms of polymorphic type. The entailment is not vacuous, because the combinatory terms of polymorphic type are indeed weakly normalizable, as is proven in Sect. 7 (...) using Tait and Girard’s computability predicates. The remainder of the paper is devoted to arguing that interesting consequences would follow from the existence of an “ordinally informative” proof, i.e. one which uses transfinite induction over recursive ordinal numbers and otherwise finitary methods, of normalizability for as large a class of the terms as possible. : A highly detailed application of Dewey's "dramatic rehearsal" to a particular ethical dilemma situation is developed here. This illustrates the role of moral imagination and creativity, and of self-discovery and self-transformation, within dramatic rehearsal. A primary concern is to show how decisions emerge through unification; what sorts of decisions emerge; how they can be evaluated; and whether the choices and evaluations accord with what is generally taken to be ethical/moral. Sartre's dilemma of a French student during World War II—who (...) is torn between staying with his mother who needed him and making his way to England to join the Free French Forces—provides the illustrative case. Using this case leads to a comparison of Dewey's and Sartre's approaches, and to a Deweyan reinterpretation and reconstruction of the process of decision in Sartre's early ethical theory. Criteria that Sartre, rightly, rejects as determinants of decision are shown to function in dramatic rehearsal as instruments for exploring the meanings of the dilemma. Sartre's analogy between making an ethical decision and creating a painting is explored in terms of Dewey's esthetic theory. This illuminates how dramatic rehearsal develops, and how it culminates in ethical decision. The idea that one makes oneself as one makes one's decision is shown to flow from the painting analogy, in both Sartre and Dewey. How this Deweyan account relates to Sartre's theory of radical choice is considered. Openings for the Deweyan perspective are sought in a brief exploration of Sartre's later ethical theories. The field of cognitive imaging is explodingboth in terms of the amount of our scientificresources dedicated to it and the associatedpublication rate. However, all of this effortis based on a critical question – Do cognitivemodules exist? Both of the reviewers of my book(Uttal, 2001) and I agree that this questionhas not yet been satisfactorily answered and,depending on the ultimate answer, the cognitiveimaging approach as well as some other parts ofthe quest for mechanistic models of mind mightnot be successful. Our views (...) of how our scienceshould respond to this serious problem,however, are quite different. Both ProfessorBechtel and Lloyd argue for an optimisticattack on the problem of the localization ofcognitive processes in the brain based on thehistory of other sciences. I argue that arealistic appreciation of the limits of thisapproach should temper the enthusiasm for whatultimately will go the way of other attempts tounravel the mind-brain problem. (shrink)

Lawsuits alleging illegal and unethical insurance sales practices have received widespread publicity in recent years. Although many observers have argued that one source of ethical conflicts for insurance agents is the industry's reliance on straight commission compensation, there remains a paucity of empirical data to support the claim. Therefore, we tested whether different forms of compensation influence insurance agent recommendations of products. We obtained survey responses from 336 insurance agents. Respondents were presented with a composite sketch of a hypothetical client. (...) Following this description, they were asked to identify which one of eight specified life insurance products they would recommend to the client. A between-groups design was employed to manipulate differences in compensation associated with the eight products. Results indicated that neither amount of coverage nor type of coverage (term life versus cash value) recommended was associated with compensation. However, an unanticipated finding was that amount of coverage recommended was significantly higher when the insured was male than when the insured was female. (shrink)

(2) In books where there are images such as portraits, maps, sketches etc We have endeavoured to keep the quality of these images, so they represent accurately the original artefact. Although occasionally there may be certain imperfections with these old texts, we feel they deserve to be made available for future generations to enjoy.

Several prominent writers including Norman Daniels, James Sabin, Amy Gutmann, Dennis Thompson and Leonard Fleck advance a view of legitimacy according to which, roughly, policies are legitimate if and only if they result from democratic deliberation, which employs only public reasons that are publicised to stakeholders. Yet, the process described by this view contrasts with the actual processes involved in creating the Affordable Care Act (ACA) and in attempting to pass the Health Securities Act (HSA). Since the ACA seems to (...) be legitimate, as the HSA would have been had it passed, there seem to be counterexamples to this view. In this essay, I clarify the concept of legitimacy as employed in bioethics discourse. I then use that clarification to develop these examples into a criticism of the orthodox view–that it implies that legitimacy requires counterintuitively large sacrifices of justice in cases where important advancement of healthcare rights depends on violations of publicity. Finally, I reply to three responses to this challenge: (1) that some revision to the orthodox view salvages its core commitments, (2) that its views of publicity and substantive considerations do not have the implications that I claim and (3) that arguments for it are strong enough to support even counterintuitive results. My arguments suggest a greater role for substantive considerations than the orthodox view allows. (shrink)

Directed to scholars and senior-level graduate students, this book is an iconoclastic survey of the history of dualism and its impact on contemporary cognitive psychology. It argues that much of modern cognitive or mentalist psychology is built upon a cryptodualism--the idea that the mind and brain can be thought of as independent entities. This dualism pervades so much of society that it covertly influences many aspects of modern science, particularly psychology. To support the argument, the history of dualism is extended (...) over 100,000 years--from the Paleolithic times until modern philosophical and psychological thinking. The questions regarding this topic that are answered in the book are: 1) Does dualism influence the scientific theories of psychology? 2) If so, should dualism be put aside in the search for a more objective analysis of human mentation? From the beginnings of thought, through the period of ancient Greece and including the medieval and early modern period, knowledge was sought after and looked upon as an integrated totality. In recent years certain scientific fields have progressed at greatly accelerated rates, leading to extreme complexity. The specialization necessary for comprehension of any of these fields has tended to destroy the integration of knowledge. Yet there are some hopeful signs amid the confusion of modern philosophy. The present note attempts to (...) sketch a perspective toward integration of a large portion of scientific knowledge, the perspective which has been opened by modern researches and was not known at the time when the old dichotomies of mechanism versus vitalism, determination versus freedom, cause versus purpose, etc., arose. The discussion was stimulated by a series of lectures at Carleton College given by Henry Margenau, lectures which seek encouragingly to reverse the trend toward rigid compartmentalization. Its substance is drawn largely from two recent books, What Is Life? by Erwin Schrödinger and Cell and Psyche by Edmund W. Sinnott. (shrink)

Gabriele Badano offers three criticisms of my challenge to the orthodox family of theories of legitimacy in bioethics. First, I assumed an ‘oversimplified version of the orthodoxy’. Second, I failed to appreciate its domain of application. Third, I only addressed the ways in which orthodox theorists incorporate substance as an ‘afterthought’—and, even then, only by rehashing Gopal Sreenivasan’s argument. Here, I respond to each, taking up the first and third before ending with reflections on the second. The first underestimates the (...) insight that criticism of the simplified version provides to that of the more complex relatives. The third misunderstands the relationship between my view and Sreenivasan’s and neglects an entire argument of my paper. The second fails in light of these two, but raises interesting questions about how the method I suggest might be extended to other domains. (shrink)

William Uttal is concerned that in an effort to prove itself a hard science, psychology may have thrown away one of its most important methodological tools—a critical analysis of the fundamental assumptions that underlie day-to-day empirical research. In this book Uttal addresses the question of localization: whether psychological processes can be defined and isolated in a way that permits them to be associated with particular brain regions. New, noninvasive imaging technologies allow us to observe the brain while it is (...) actively engaged in mental activities. Uttal cautions, however, that the excitement of these new research tools can lead to a neuroreductionist wild goose chase. With more and more cognitive neuroscientific data forthcoming, it becomes critical to question their limitations as well as their potential. Uttal reviews the history of localization theory, presents the difficulties of defining cognitive processes, and examines the conceptual and technical difficulties that should make us cautious about falling victim to what may be a "neo-phrenological" fad.
