Surgery is an important part of contemporary health care, but currently much of surgery lacks a strong evidence base. Uptake of evidence-based medicine (EBM) methods within surgical research and among practitioners has been slow compared with other areas of medicine. Although this is often viewed as arising from practical and cultural barriers, it also reflects a lack of epistemic fit between EBM research methods and surgical practice. In this paper we discuss some epistemic challenges in surgery relating to this lack (...) of fit, and investigate how resources from feminist epistemology can help to characterize them. We point to ways in which these epistemic challenges may be addressed by gathering and disseminating evidence about what works in surgery using methods that are contextual, pluralistic, and sensitive to hierarchies. Each of us has written about the importance of reframing the debate over public health paternalism. Our individual explorations of the many and varied paths forward from libertarian “nanny state” objections to the “new public health” have been intimately informed by collaboration. This article represents a summary of our current thinking — reflecting the ground gained through many fruitful exchanges and charting future collaborative efforts.Our starting point is that law is a vitally important determinant of population health, and the interplay (...) among law, social norms, cultural beliefs, health behaviors, and healthy living conditions is complex. Anti-paternalists’ efforts to limit the scope of public health law to controlling only the proximal determinants of infectious diseases are utterly unjustifiable in the face of so much preventable death, disability, and disparity. Equally important, the anti-paternalism push is deeply counter-majoritarian and undemocratic, threatening to disable communities from undertaking measures to improve their own well-being. (shrink)

Lloyd (2009) contends that climate models are confirmed by various instances of fit between their output and observational data. The present paper argues that what these instances of fit might confirm are not climate models themselves, but rather hypotheses about the adequacy of climate models for particular purposes. This required shift in thinking—from confirming climate models to confirming their adequacy-for-purpose—may sound trivial, but it is shown to complicate the evaluation of climate models considerably, both in principle and in practice.

Descartes a entrepris de détruire la pratique aristotélicienne de la philosophie : à son savoir seulement probable, les Regulae, puis les Essais opposent une science certaine d'objets clairs et distincts. Mais cette instauration concerne aussi, peut-être même d'abord, l'idéal pratique qu'Aristote ne cesse de viser dans les sciences théorétiques : le sage parvient à la félicité par l'exercice même d'une connaissance si parfaite qu'elle imite celle du dieu, qui pense sa pensée en acte et éternellement. Descartes met décidément en crise (...) la félicité par la contemplation, dont la pensée médiévale avait hérité d'Aristote. Pourtant, une autre figure de la félicité se dégage tout aussi indiscutablement de l'entreprise cartésienne : la méthode, la certitude scientifique qu'elle permet et les principes métaphysiques qui assurent l'une et l'autre restent, à chaque moment, solidaires d'une attitude et d'une ambition proprement morales - la volonté infinie aboutit à la générosité, où la considération du bon usage de notre libre-arbitre permet le - contentement de soi-même -. Ainsi la philosophie atteint-elle, pour Descartes aussi, à une félicité. Mais à une félicité volontaire et non plus contemplative. On tentera donc d'abord de mesurer, dans différents champs de la philosophie cartésienne, l'impact de la certitude jusque sur les questions d'éthique ; ensuite, de souligner la référence constante, quoique souvent implicite, de Descartes à la félicité telle qu'Aristote la visait ; enfin, de suivre leur dialogue au fil conducteur de leurs versions divergentes, mais complices, de l'admiratio et du thaumazein. Cet article s’interroge sur le sens des termes « français » et « allemand » quand on distingue des caractéristiques françaises et allemandes à propos de la théorie de la reconnaissance. Deux manières de distinguer ces caractéristiques sont analysées : la première considère que la promotion philosophique du concept de reconnaissance est une opération allemande à laquelle rien ne correspond de ce côté-ci du Rhin, la seconde affirme que le propre des approches philosophiques françaises de la reconnaissance est de souligner (...) la face négative de la reconnaissance, alors que les Allemands rattacheraient la reconnaissance à l’autonomie et à la réconciliation. This is the first English-language translation of an important book that contributes to contemporary debates about social suffering in sociology, social psychology, political theory and philosophy. Renault provides a systematic account of the ways in which social suffering could be conceptualised.

This paper asks whether or not normative political philosophy can face the challenge of the critique of the political. This question is addressed to theories of justice in general, but this paper considers Habermas' position in particular. It advances the thesis that the main theoretical and political problem of theories of justice is that they have not really taken the abolitionist dimension of the concept of justice into account. Facing the flood of contradictory interpretations of Nietzsche’s writings, is it still possible to assert anything positive about the political and intellectual stance of the author of « Zarathoustra »? In his massive study, Domenico Losurdo, Professor of Philosophy at the university of Urbino, argues that Nietzsche’s thoughts, even the most provocative, such as his defence of slavery or eugenics, should not be read as simple metaphors or innocent speculations aiming at the moral improvement of man, but constitute a specific, (...) agressively aristocratic, response to what, according to Nietzsche, is the main threat of his time : the rise of revolutionary ideals, and global democratisation of society. The question of social medicine provides the opportunity to engage in a critical reading of Foucault's theory of biopower. The analyses dedicated by Foucault to `the birth of social medicine' represent one of the few examples of a thorough application of that theory. They allow Foucault to show the heuristic value of the biopolitical hypothesis at the level of the most concrete historical materiality, and not just at that of the general history of the forms of governmentality. These analyses, however, (...) also allow the historiographical and political limits of the biopolitical hypothesis to come to light. From the perspective of the history of sciences as well as from that of the analysis of the modalities of social critique in the first half of the nineteenth century, Foucault appears to provide an interpretation that is too continuist and tends to homogenise the historical phenomena. The disqualification of social medicine relies in part on simplifications that continue to bear great significance today in view of the current transformations in the social question. (shrink)

_Marx and Critical Theory_ examines Marx’s main philosophical, political and social theoretical ideas. Its purpose is twofold: making sense of the concepts and theses of Marx, and showing that they remain relevant for contemporary critical theory.

Whether in characterizing Catharine MacKinnon's theory of gender as itself pornographic or in identifying liberalism as unable to make good on its promises, Wendy Brown pursues a central question: how does a sense of woundedness become the basis for a sense of identity? Brown argues that efforts to outlaw hate speech and pornography powerfully legitimize the state: such apparently well-intentioned attempts harm victims further by portraying them as so helpless as to be in continuing need of governmental protection. "Whether (...) one is dealing with the state, the Mafia, parents, pimps, police, or husbands," writes Brown, "the heavy price of institutionalized protection is always a measure of dependence and agreement to abide by the protector's rules." True democracy, she insists, requires sharing power, not regulation by it; freedom, not protection.Refusing any facile identification with one political position or another, Brown applies her argument to a panoply of topics, from the basis of litigiousness in political life to the appearance on the academic Left of themes of revenge and a thwarted will to power. These and other provocations in contemporary political thought and political life provide an occasion for rethinking the value of several of the last two centuries' most compelling theoretical critiques of modern political life, including the positions of Nietzsche, Marx, Weber, and Foucault. Concern for human vulnerability seems to be at the heart of bioethical inquiry, but the concept of vulnerability is under-theorized in the bioethical literature. The aim of this article is to show why bioethics needs an adequately theorized and nuanced conception of vulnerability. We first review approaches to vulnerability in research ethics and public health ethics, and show that the bioethical literature associates vulnerability with risk of harm and exploitation, and limited capacity for autonomy. We identify some of the challenges (...) emerging from this literature: in particular, how to reconcile universal human vulnerability with a context-sensitive analysis of specific kinds and sources of vulnerability; and how to reconcile obligations to protect vulnerable persons with obligations to respect autonomy. We then briefly survey some of the theoretical resources available within the philosophical literature to address these challenges, and to assist in understanding the conceptual connections between vulnerability and related concepts such as harm, exploitation, needs, and autonomy. We also sketch out a taxonomy of sources and kinds of vulnerability. Finally, we consider the implications for policy evaluation of making vulnerability an explicit and central focus of bioethics. Our investigation is in the form of a broad survey motivating a research agenda rather than a detailed analysis. (shrink)

On the 24th June 2015, Feminist Legal Studies and the London School of Economics Law Department hosted an afternoon event with Professor Wendy Brown, Class of 1936 First Professor of Political Science, University of California. Professor Brown kindly agreed to discuss her scholarship on feminist theory, and its relationship to both the law and neoliberalism. The event included an interview by Dr Katie Cruz and a Q&A session, which are presented here in an edited version of the transcript. Sumi (...) Madhock, Professor of Gender Studies, LSE chaired the interview and discussion and introduced Professor Brown’s work. Katie Cruz asked Wendy Brown to reflect upon topics that span her scholarship and activism, including the state of critical, feminist, and Left approaches to rights, neoliberalism, despair and utopianism, and the future of feminist theory and practice in the context of neoliberalism and current debates about intersectionality. Participants in the discussion asked questions on a wide range of issues, including the limits of feminist engagement with law as a tool for social change, the dominance of neoliberalism, imperialist feminism, Islamophobia, secularism, and our attachment to the figure of homo politicus. La théorie deweyenne de la nature humaine permet de clarifier le sens du naturalisme deweyen ainsi que ses implications politiques. La première partie de l’article analyse la manière dont Dewey défend une conception processuelle, interactionnelle et intégrative de la nature humaine. La deuxième partie analyse la fonction classificatoire du concept de nature humaine et la troisième la manière dont Dewey attribue une fonction explicative à ce concept en discutant les références politiques conservatrices ou progressistes, voire révolutionnaires, à la nature humaine.

ABSTRACT Dewey's critical conception of work deserves consideration because it combines two types of models of social critique that are usually considered separately in contemporary Dewey scholarship. In the syllabus Social Institutions and the Study of Morals, Dewey contends that the valuation of social settings should be grounded on criteria immanent to social experience, and he applies his model of immanent critique to work-related issues. In his philosophy of education, he highlights that institutional settings should be valued from the point (...) of view of their formative effects, and in Democracy and Education, the formative effects of work are put to the fore. The case of work illustrates the fact that specific institutional settings require that immanent critique be complemented by critique of the formative effects. The psychological and social centrality of work implies that the problems met in the social experience of work produce effects that concern not only the social experience of work but also life outside of work. Therefore, these effects cannot be accurately tackled by an immanent critique of work. (shrink)

With both wit and empathy, Kaminer takes on what many people hold sacred. Kaminer is an eloquent and incisive critic and rationalist living in a superstitious, evangelical age. The interpretation of Marx’s references to work and to domination is a vexed question. Can we say that Marx criticizes capitalism in terms of its effects on work? Or does he criticize capitalism from the standpoint of those subject to domination, and with whom his position is one of solidarity? Or does he elaborate a description of the unprecedented transformations brought about in the relations of power, which the category of domination is unable to apprehend effectively? The article argues that (...) these differences in interpretation are actually based on a series of false oppositions. Marx’s aim is in effect to articulate the question of the domination of work and the question of domination at work, insofar as he accords a position of political centrality to the connection between domination and work. Unable to answer the call of our patients: mental health nurses’ experience of moral distress When health practitioners’ moral choices and actions are thwarted by constraints, they may respond with feelings of moral distress. In a Canadian hermeneutic phenomenological study, physicians, nurses, psychologists and non‐professional aides were asked to identify care situations that they found morally distressing, and to elaborate on how moral concerns regarding the care of patients were raised and resolved. In this paper, we describe the experience of (...) moral distress related by nurses working in mental healthcare settings who believed that lack of resources (such as time and staff) leads to dispiritedness, lack of respect, and absence of recognition (for both patients and staff) which severely diminished their ability to provide quality care. The metaphors of flashlight and hammer are used to elaborate nurses’ possible responses to intolerable situations. (shrink)

To study Earth’s climate, scientists now use a variety of computer simulation models. These models disagree in some of their assumptions about the climate system, yet they are used together as complementary resources for investigating future climatic change. This paper examines and defends this use of incompatible models. I argue that climate model pluralism results both from uncertainty concerning how to best represent the climate system and from difficulties faced in evaluating the relative merits of complex models. I describe how (...) incompatible climate models are used together in ‘multi-model ensembles’ and explain why this practice is reasonable, given scientists’ inability to identify a ‘best’ model for predicting future climate. Finally, I characterize climate model pluralism as involving both an ontic competitive pluralism and a pragmatic integrative pluralism. (shrink)

A participatory democracy necessarily minimizes legal restraints on its citizens, substituting, for the common good, moral obligations to contribute with their activities. This article argues that a democratic society is endangered unless both media and citizens accept reciprocal moral obligations related to the distribution and use of information. Journalists are expected to facilitate distribution of information and engage citizens usefully in the knowledge process, fueling the participatory engine that drives a democracy. Citizens, in return, have a reciprocal obligation to expose (...) themselves to useful information, respond publicly, tolerate (and even encourage) diversity, and protect media autonomy. (shrink)
