How do legal texts determine legal content? A standard answer to this question—sometimes called “the standard picture”—is that legal texts communicate something and what they communicate is identical to legal content. Mark Greenberg criticizes the standard picture and offers in its place his own “moral impact theory.” My goal here is to respond to Greenberg by showing how the standard picture better explains legal practice than the moral impact theory does. To that end, I first clarify certain aspects of the (...) moral impact theory. I then critique the theory, focusing on its inability to explain (i) why practitioners reason about legal content as they do and (ii) why they agree on legal content as often as they do. We cannot apply the principles of morla law and obligation without intimate knowledge of the subject - the human being, who has to act morally. This text argues that an anthropology is required to provide accurate information of human nature in its relationship to moral science if the universal principals are to be located in their total human context.

Faces carry key personal information about individuals, including cues to their identity, social traits, and emotional state. Much research to date has employed static images of faces taken under tightly controlled conditions yet faces in the real world are dynamic and experienced under ambient conditions. A common approach to studying key dimensions of facial variation is the use of facial caricatures. However, such techniques have again typically relied on static images, and the few examples of dynamic caricatures have relied on (...) animating graphical head models. Here, we present a principal component analysis -based active appearance model for capturing patterns of spatiotemporal variation in videos of natural dynamic facial behaviours. We demonstrate how this technique can be applied to generate dynamic anti-caricatures of biological motion patterns in facial behaviours. This technique could be extended to caricaturing other facial dimensions, or to more general analyses of spatiotemporal variations in dynamic faces. (shrink)

This study compares involuntary and voluntary autobiographical memories in depressed and never depressed individuals. Twenty depressed and twenty never depressed individuals completed a memory diary; recording their reactions to 10 involuntary and 10 voluntary memories over 14–30 days. Psychiatric status , psychopathology, rumination and avoidance were assessed. For both groups, involuntary memories more frequently lead to strong reactions than voluntarily memories. For both modes of retrieval, depressed individuals reported more frequent negative reactions than never depressed individuals and rated memories as (...) more central to identity with higher levels of rumination and avoidance. Depressed individuals retrieved both positive and negative memories during involuntary retrieval. These findings support the view that involuntary memory retrieval represents a basic mode of retrieval during healthy and disordered cognition, and that during depression, both involuntary and voluntary memories are central to identity and associated with rumination and avoidance. We test conformity-related values applying the value-pragmatics hypothesis by evaluating how personal values related to compliance moderate the relationships between situational factors and unethical decisions. We examine the direct and indirect effects of the values of traditionalism, conformity, and stimulation, as they combine with the situational factors of rewards and punishments in the person–situation interaction model. We find strong support for the value-pragmatics view of ethical decision making and further build support for the person–situation interaction model.

This paper is an investigation into the introduction of the term ‘system’ and its conceptual background in the writings of Bartholomew Keckermann. This includes a brief summary of the literature and evidence identifying Keckermann as the first to make significant usage of the term in logic, philosophy, and theology. Then, after a survey of his life, work and milieu, this paper will look closer at three of Keckermann’s own ‘systems’; Systema logicae (1600), Praecognitorum Logicorum (1606), and Systema SS. Theologiae (1602). (...) Finally, I will touch on the influence Keckermann’s innovation had on subsequent ideas of method in modern philosophy, especially how his innovative use of this term gives the logician the directing role as a technical expert in mining the truth of theology, philosophy, and other sciences. This, of course, flies in the face of the medieval view of the Church and its elders controlling that role, characterizing the discovery and refinement of knowledge as being a process of electing and using worthy passive subjects as conduits of divine knowledge. Thus Keckermann’s systems can be considered an important step away from this, towards the early modern epistemology requiring an active thinking subject, best characterized in Descartes’ Meditations. This article is a response to Nancy Bauer's How To Do Things with Pornography. The main argument of the book is presented and evaluated. In particular, Bauer's criticisms of Catharine MacKinnon's work on pornography are considered and a defense of MacKinnon's views offered.

The care of elderly people with dementia poses ethical problems in several respects. This paper considers the problems in relation to treatment, withdrawal of treatment (including nutrition and hydration) in terminal care, and consent to involvement in research. It is ultimately the responsibility of the physician to take the decision about whether or not to proceed with treatment, according to the best interests of the patient, but nurses, families and significant others can be involved in making the decision. When withdrawal (...) of treatment or withdrawal of nutrition and hydration in the terminal stages of dementia are being considered it is necessary to take into account the nature of the treatment, whether or not it is extraordinary, and the goals of continued nutrition. In some circumstances it may be possible for them to be withdrawn. Only research which is aimed at evaluating treatment for dementia may involve subjects who are suffering from dementia. Soigner des personnes âgés souffrant de la démence pose plusieurs problèmes éthiques. Cet article considère les problèmes concernant le traitement, cessation de traitement (y inclus nutrition et hydration) dans la phase terminale, et consentement de participation dans les recherches. C'est ultimement la décision du docteur si oui ou non de continuer avec le traitement selon les meilleurs intérêts du malade, mais les infirmiers/ères, les familles et les personnes importantes autour du malade peuvent jouer un rôle dans les décisions. Si la cessation de traitement ou cessation de nutrition et hydration dans la phase terminale de démence est envisagée il est nécessaire de tenir compte de la nature du traitement, s'il est 'extraordinaire' ou non, et le but de nutrition si on continuait. Dieser Artikel betrachtet die Probleme in Beziehung auf die Pflege, Zurückziehung von Pflege (auch von Nahrung und Getrank) der Sterbenden und der Entscheidung, in der Forschung beteiligt zu sein. Der Arzt hat die schlussendliche Verantwortung über die Entscheidung ob mit der Pflege weitergefahren werden soll oder nicht nach dem besten Interesse der Patienten. Aber das Krankenpflegepersonal, die Familie und bedeutende Andere können auch an dieser Entscheidung teilnehmen. Wenn es sich um Zurückziehung der Pflege, oder Zurückziehung von Nahrung oder Getrank in der Sterbepflege von Personen mit Demenz handelt, is es nötig, das Wesen der Pflege und die Ziele einer fortfahrenden Nahrung zu kennen. Commentators on Epode 11 generally begin by comparing the opening couplet with Archilochus : κα μ' οτ' μβων οτε τερπωλων μλει, and sometimes also Catullus 68. 1–40. In both of these the poet explains that grief at the death of a loved one has expelled all desire to compose verses. According to the comparison, Horace, in 1–2, is stating that the onset of love has, similarly, so absorbed his attention that he cannot write verse. The translation will then run ‘Pettius, (...) Reginald Williams in (Think Autumn 2011) argued that the psychological need offers for endorsing atheism over theism. My article outlines six objections to his thesis, questioning how empirically verifiable the evidence he adduces is, and pointing out various logical fallacies such as illicit use of generalizations and begging the question. It concludes that atheism needs defending on stronger grounds.

In this article I address the ethical implications of the legal issues the U. S. Supreme Court resolved in New York Times v. Sullivan and its progeny. In a ruling with far-reaching moral implications, the Court addressed truthtelling-journalism's primary ethical directive-and undermined it by favoring other moral principles and social goals. Much of this article focuses on the ethical arguments addressed to the Court in legal briefs that sought rulings that would support fundamental principals of ethical journalism. The creation of (...) actual malice as a legal concept in the Sullivan case owes more to the Court's pursuit of other moral and social values than strict legal reasoning, according to the descriptive theory of pragmatic instrumentalism, which informs this analysis.
