The purpose of this paper is to show the pervasive, though often implicit, role of arguments in negotiation dialogue. This holds even for negotiations that start from a difference of interest such as mere bargaining through offers and counteroffers. But it certainly holds for negotiations that try to settle a difference of opinion on policy issues. It will be demonstrated how a series of offers and counteroffers in a negotiation dialogue contains a reconstructible series of implicit persuasion dialogues. The paper (...) is a sequel to van Laar and Krabbe, in which we showed that for some differences of opinion it may be reasonable to shift from persuasion dialogue, aimed at a resolution of the difference on the merits, to negotiation dialogue, aimed at compromise, whereas in the present paper we show that such a shift need not amount to the abandonment of argumentation. Our main aim in this paper as well as in the previous one is to contribute to the theory of argumentation within the context of negotiation and compromise formation. (shrink)

First, an explication of the notion of a critical reaction will be provided, zooming in on the degree of “directiveness” that a critical reaction displays. Second, it will be examined whether (...) there are normative requirements that enhance the directiveness of criticism. Does the opponent have in circumstances a dialectical obligation to provide clarifications, explanations, or even arguments? In this paper, it is hypothesized that the competitiveness inherent in critical discussion must be mitigated by making the opponent responsible for providing her counterconsiderations, if available, thus assisting the proponent in developing an argumentative strategy that defuses them. Negotiation is not only used to settle differences of interest but also to settle differences of opinion. Discussants who are unable to resolve their difference about the objective worth of a policy or action proposal may be willing to abandon their attempts to convince the other and search instead for a compromise that would, for each of them, though only a second choice yet be preferable to a lasting conflict. Our questions are: First, when is it sensible to enter into (...) negotiations and when would this be unwarranted or even fallacious? Second, what is the nature of a compromise? What does it mean to settle instead of resolve a difference of opinion, and what might be the dialectical consequences of mistaking a compromise for a substantial resolution? Our main aim is to contribute to the theory of argumentation within the context of negotiation and compromise formation and to show how arguing disputants can shift to negotiation in a dialectically virtuous way. Contemporary theory of argumentation offers many insights about the ways in which, in the context of a public controversy, arguers should ideally present their arguments and criticize those of their opponents. We also know that in practice not all works out according to the ideal patterns: numerous kinds of derailments are an object of study for argumentation theorists. But how about the use of unfairstrategiesvis-à-vis one’s opponents? What if it is not a matter of occasional derailments but of one party’s (...) systematic refusal to take other parties seriously? What if one party continually forgoes any form of critical testing and instead resorts to threats or blackmail? Can this be countered by the tools of reason? Or should one pay one’s opponent back in the same coin? To gain some grasp of these issues, we describe a number of strategies used in the public controversy about induced earthquakes in Groningen. We check whether these strategies arefair,i.e.balanced, transparent,andtolerant.We also investigate the effects of the choice for a particular kind of strategy. It appears that, in circumstances, choosing a fair strategy may be detrimental for resolving the controversy and choosing an unfair one beneficial. Following up ideas from social psychology and political science, we formulate some guidelines for the choice of strategies. At the end, we stress the importance — especially for those whose opinions carry little weight — of having a society in which the knowledge and skills needed for assessing the fairness of strategies are widespread. When can exerting pressure in a public controversy promote reasonable outcomes, and when is it rather a hindrance? We show how negotiation and persuasion dialogue can be intertwined. Then, we examine in what ways one can in a public controversy exert pressure on others through sanctions or rewards. Finally, we discuss from the viewpoints of persuasion and negotiation whether and, if so, how pressure hinders the achievement of a reasonable outcome.

In the first parts of this study on the concept of the biological clock it has been investigated how it is used in the field of biorhythmology. The analysis of the contents of the concept is preceded by a survey of the current research in this field.There are two general hypotheses with respect to the ultimate origin of rhythmic phenomena: the Endogenous Timer Hypothesis and the Exogenous Timer Hypothesis. Within the Endogenous Timer Hypothesis two contrasting viewpoints with respect to the (...) structure of the biological clock can be distinguished, which have been called: the Discrete Entity view, and the Organizational view.It has been shown that in the application of the general clock-idea upon the organism a logical distortion is present. The organism is conceived tobe a clock and tohave a clock simultaneously.In anticipation of the analysis of the explanatory value of the concept of the biological clock in part II, it has been put forward that in a number of cases time-measurement can be considered as a superfluous element in the explanation of the phenomena involved.Finally it has been demonstrated that in the case of the Exogenous Timer Hypothesis the concept of the biological clock is not relevant. The Exogenous Timer Hypothesis has been compared with the Endogenous Timer Hypothesis with respect to the criterion of the principle of parsimony, orOccam's razor. (shrink)

This paper contains some considerations on the relation between philosophy of science and science, in particular biology. There is a contrast between formalistic and pragmatic approaches to the structure of scientific thought, which is illustrated by the different viewpoints on the nature of explanation. In an appendix some aspects of the logical structure of teleological explanation are discussed.

We shall investigate the similarities and dissimilarities between old and new dialectic. For the ‘old dialectic’, we base our survey mainly on Aristotle’s Topics and Sophistical Refutations, whereas for the ‘new dialectic’, we turn to contemporary views on dialogical interaction, such as can, for the greater part, be found in Walton’s The New Dialectic. Three issues are taken up: types of dialogue, fallacies, and strategies. Though one should not belittle the differences in scope and outlook that obtain between the old (...) and the new dialectic, the paper will show that in many respects the old dialectic foreshadows the new dialectic. This paper attempts to systematically characterize critical reactions in argumentative discourse, such as objections, critical questions, rebuttals, refutations, counterarguments, and fallacy charges, in order to contribute to the dialogical approach to argumentation. We shall make use of four parameters to characterize distinct types of critical reaction. First, a critical reaction has a focus, for example on the standpoint, or on another part of an argument. Second, critical reactions appeal to some kind of norm, argumentative or other. Third, they each have (...) a particular illocutionary force, which may include that of giving strategic advice to the other. Fourth, a critical reaction occurs at a particular level of dialogue (the ground level or some meta-level). The concepts here developed shall be applied to discussions of critical reactions by Aristotle and by some contemporary authors. (shrink)

Criticism may degenerate into quibbling or nitpicking. How can discussants keep quibblers under control? In the paper we investigate cases in which a battle about words replaces a discussion of the matters that are actually at issue as well as cases in which a battle about minor objections replaces a discussion of the major issues. We survey some lines of discussion dealing with these situations in profiles of dialogue.

What if in discussion the critic refuses to recognize an emotionally expressed argument of her interlocutor as an argument, accusing him of having presented no argument at all. In this paper, we shall deal with this reproach, which taken literally amounts to a charge of having committed a fallacy of non-argumentation. As such it is a very strong, if not the ultimate, criticism, which even carries the risk of abandonment of the discussion and can, therefore, not be made without burdening (...) oneself with correspondingly strong obligations. We want to specify the fallacies of non-argumentation and their dialectic, i.e., the proper way to criticize them, the appropriate ways for the arguer to react to such criticism, and the appropriate ways for the critic to follow up on these reactions. Among the types of fallacy of non-argumentation, the emphasis will be on the appeal to popular sentiments. Our aim is to reach, for cases of non-argumentation, a survey of dialectical possibilities. By making the disputants themselves responsible for the place of emotion in their dialogues, we hope to contribute to a further development of the theory of dialectical obligations. (shrink)

Jan Albert van Laar and Erik Krabbe’s paper “Splitting a difference of opinion” studies an important type of dialogue shift, namely that from a deliberation dialogue over action or policy options where critical and persuasive argumentation is exchanged about the rational acceptability of the policy options proposed by various parties, to a negotiation dialogue where agreement is reached by a series of compromises, or trade-offs, on the part of each side in the disagreement.

The pressures that led to the evolution of episodic memory have recently seen much discussion, but a fully satisfactory account of them is still lacking. We seek to make progress in this debate by taking a step backward, identifying four possible ways that episodic memory could evolve in relation to simulationist future planning—a similar and seemingly related ability. After distinguishing each of these possibilities, the paper critically discusses existing accounts of the evolution of episodic memory. It then presents a novel (...) argument in favor of the view that episodic memory is a by-product of the evolution of simulationist future planning. The paper ends by showing that this position allows for the maintenance of the traditional view that episodic memory operates on stored memory traces, as well as explaining a number of key features of episodic memory: its being subject to frequent and systematic errors, its neural co-location with the capacity for simulationist future planning, and the potential existence of non-human episodic memory. Scott Blanchard The morality of thought lies in a procedure that is neither entrenched nor detached. --Theodor Adorno Perhaps no author within or outside of the canon of Western literature wrote as extensively on the topic of solitude as did Francesco Petrarch. While many of our modern associations with (...) the term may find some of their origins traceable as far back as Petrarch's career, the term "solitude" carried with it much different associations in his century than it does for us today, influenced as we are by the Romantic tradition and especially by Wordsworth's absorption with the idea of solitude as an ideal state for self-conscious reflection on the individual's personal history and its meaning. No less than three of Petrarch's major prose works--the De otio religioso, the De vita solitaria, and the Secretum--confront the topic of solitude directly, and we can also point to many letters, poems, and portions of his treatises that either directly or indirectly reflect Petrarch's virtual obsession with solitude. In Petrarch we are confronted with an author who was at once the most politically connected intellectual of his century--we are even tempted to call him a "public intellectual"--and yet who constantly invoked his desire for solitude, for an escape from the many distractions and seductions that the cities and courts of his society offered. For Petrarch these were invariably places where desire lurked and power held sway, so that the life of solitude was often invoked as an alternative--a counter-cultural locus, perhaps--where freedom from temptation and subjection was imagined as an escape from the negotium of worldly life. There is much in Petrarch's writings on the solitary life that is wishful and that we might characterize as merely compensatory in a life that was otherwise quite active and engaged, but there is also a [End Page 401] strain of thought in these works that indicates a certain intransigence beneath Petrarch's overdetermined attachment to the idea, if not the practice, of withdrawal and detachment. An inquiry into Petrarch's idealization of the solitary life may even yield a somewhat reactionary aspect of his complex mind, a conservative strain in an author who was in almost every other way the literary herald of a humanism that was at the center of the cultural avant-garde of the Trecento. Is the Petrarch that in so many accounts of his character is construed as the "first modern man" actually something else, a reluctant ascetic holdover from the Middle Ages? How did Petrarch use his unique understanding of the life of solitude, of ascesis, as a pose from which to construct his sense of himself as an author and intellectual? Or are we simply confronted in the figure of a worldly and an ascetic Petrarch with yet another set of contradictions so appropriate to the "immensely complex" author whose poetic signature was the oxymoron? 1"Asceticism" and "solitude" are of course not synonymous terms, but any examination of a number of Petrarch's works as they fall within what might be called a genealogy of asceticism must recognize from the start that Petrarch's brand of asceticism was somewhat unique, especially insofar as it was deeply influenced by ancient Stoicism as well as by his reading in authors from the early Christian era. Sir arthur edington's brilliantly phrased article, “Physics and Philosophy,” which appeared in the January 1933 issue of Philosophy, seems to me to contain a number of things which are calculated to be provocative to the mere philosopher. And I propose in this article to discuss what appears to be one of the most important of these provocative things, namely, Sir Arthur's view of the status of the physical world.

This paper starts from the remarkable habit of yoik singing among the Sámi people and the notion of togetherness in ‘singing together’, being confronted with the role of technology in the contemporary manifestations of ‘singing’. An important link appears to exist between several forms of grooming and the social dimensions of language and singing, as previously shown by Robin Dunbar. These types of interaction surpass the physiological, hormonal and psychological roles of grooming in humans, in non-human primates and in other (...) mammals. For they also determine the constraints of group-forming processes in mammals, and social structures in humans too. The characteristic group size of grooming mammals has been reported to determine the necessity of social stratification. Number constraints therefore form a silver lining throughout this paper. The analogy with artificial language models, and modern language models (MLM) in particular, has been chosen following the suggested applicability of AI for the deciphering of the language of Whales (Cetaceans). The polemic discussion between Noam Chomsky’s so-called classical generative linguistics and propagators of the nonlinguistic MLM approach (referring to Steven T. Piantadosi) is found an instructive heuristic for analyzing the future impact of AI on human culture. It is suggested that AI-generated analogues of ‘singing together’ will profoundly interact (or already do so) with social stratification and with the conservation of human values. (shrink)

In 1992 M.W. Evans proposed the O(3) symmetry of electromagnetic fields by adding a constant longitudinal magnetic field to the well-known transverse electric and magnetic fields of circularly polarized plane waves, such that certain cyclic relations of a so-called O(3) symmetry are fulfilled. Since then M.W. Evans has elevated this O(3) symmetry to the status of a new law of electromagnetics. As a law of physics must be invariant under admissible coordinate transforms, namely Lorentz transforms, in 2000 he published a (...) proof of the Lorentz invariance of O(3) symmetry of electromagnetic fields. As will be shown below this proof is incorrect; more, after simple correction it will turn out here that the O(3) symmetry cannot be Lorentz invariant. (shrink)
