Bislang wurde Walter Benjamins Werk nicht auf Staatlichkeit hin gelesen, weist es doch weder eine Staatstheorie noch deren explizite Kritik auf. Der Staat als genuin politische Kategorie wird zwar kaum direkt, dafur aber uber andere Begriffe adressiert, wie Souveranitat und Gewalt, Produktionsverhaltnisse und Warenform oder soziale Kollektive wie Klasse und 'Volk'. Mit Problemen moderner Staatlichkeit beschaftigte sich Benjamin zeitlebens uber die kulturelle Sphare, und sein politisches Denken motivierte sich wesentlich aus Beobachtungen an Alltagsdingen und Konsumgutern sowie der Auseinandersetzung mit neuen (...) kunstlerischen Verfahren und Technologien. Der Band stellt diesen mittelbaren Zugriff heraus und versucht aufzuzeigen, welche Problemfelder von Benjamins politischem Denken je schon auf die Phanomene Staat und Staatlichkeit verweisen, ohne dass diese direkt angesprochen und ausgefuhrt wurden. Hidden Mortgages. Taking the case of Oswald Spengler as an example, this article discusses the politics and practices of canonization and exclusion within the history of science since the 1990s and advocates a critical revision of the discipline's own history, its founding figures and main influences.

Since a couple of decades, the notion of a precautionary principle plays a central and increasingly influential role in international as well as national policy and regulation regarding the environment and the use of technology. Urging society to take action in the face of potential risks of human activities in these areas, the recent focus on climate change has further sharpened the importance of this idea. However, the idea of a precautionary principle has also been problematised and criticised by scientists, (...) scholars and policy activists, and been accused of almost every intellectual sin imaginable: unclarity, impracticality, arbitrariness and moral as well as political unsoundness. In that light, the very idea of precaution as an ideal for policy making rather comes out as a dead end. On the basis of these contrasting starting points, Christian Munthe undertakes an innovative, in-depth philosophical analysis of what the idea of a precautionary principle is and should be about. A novel theory of the ethics of imposing risks is developed and used as a foundation for defending the idea of precaution in environmental and technological policy making against its critics, while at the same time avoiding a number of identified flaws. The theory is shown to have far-reaching consequences for areas such as bio-, information- and nuclear technology, and global environmental policy in areas such as climate change. The author argues that, while the price we pay for precaution must not be too high, we have to be prepared to pay it in order to act ethically defensible. A number of practical suggestions for precautionary regulation and policy making are made on the basis of this, and some challenges to basic ethical theory as well as consumerist societies, the global political order and liberal democracy are identified. Although actions of individuals do contribute to climate change, the question whether or not they, too, are morally obligated to reduce the GHG emissions in their responsibility has not yet been addressed sufficiently. First, I discuss prominent objections to such a duty. I argue that whether individuals ought to reduce their emissions depends on whether or not they exceed their fair share of emission rights. In a next step I discuss several proposals for establishing fair shares and also take practical (...) considerations into account. I conclude that individuals should not always be obliged to reduce their emissions to what is their fair share for they may depend on carbon-intensive structures. Instead, they have a Kantian imperfect duty to reduce their emissions ‘as far as can reasonably be demanded of them’. In addition, they should press governments to introduce proper regulation. This paper maps out various options for thinking about two issues: the structural relationship between practical wisdom and the moral virtues, and the various functions of practical wisdom. With the help of a case study of the virtue of honesty, three main concerns are raised for what I call the Standard Model of practical wisdom. Two other models, the Socratic Model and the Fragmentation Model, are also critically evaluated. BackgroundValue sensitivity – the ability to recognize value-related issues when they arise in practice – is an indispensable competence for medical practitioners to enter decision-making processes related to ethical questions. However, the psychological competence of value sensitivity is seldom an explicit subject in the training of medical professionals. In this contribution, we outline the traditional concept of moral sensitivity in medicine and its revised form conceptualized as value sensitivity and we propose an instrument that measures value sensitivity.MethodsWe developed an instrument (...) for assessing the sensitivity for three value groups in a four step procedure: 1) value identification ; 2) value representation ; 3) vignette construction and quality evaluation ; and 4) instrument validation by comparing nursing professionals with hospital managers.ResultsWe find that nursing professionals recognize and ascribe importance to principle-related issues more than professionals from hospital management. The latter are more likely to recognize and ascribe importance to strategy-related issues.ConclusionsThese hypothesis-driven results demonstrate the discriminatory power of our newly developed instrument, which makes it useful not only for health care professionals in practice but for students and people working in the clinical context as well. This paper provides an introductory review of the theory of judgment aggregation. It introduces the paradoxes of majority voting that originally motivated the field, explains several key results on the impossibility of propositionwise judgment aggregation, presents a pedagogical proof of one of those results, discusses escape routes from the impossibility and relates judgment aggregation to some other salient aggregation problems, such as preference aggregation, abstract aggregation and probability aggregation. Global capitalism is a transnational “operational space” which is produced by the practices of states, policy- and issue-specific government networks, and private organizations such as transnational corporations, global law firms, and standard-setting agencies. This “operational space,” which I call the transnational constellation, works through and beyond distinct spatial settings, endowing them with a global financial capitalistic logic and limiting the scope of democratic self-determination. In the second section, I analyze political protest against this transnational constellation in terms of democratic theory. (...) This paper presents a systematic account of ethical issues actualised in different areas, as well as at different levels and stages of health care, by introducing organisational and other procedures that embody a shift towards person centred care and shared decision-making (PCC/SDM). The analysis builds on general ethical theory and earlier work on aspects of PCC/SDM relevant from an ethics perspective. This account leads up to a number of theoretical as well as empirical and practice oriented issues that, in view (...) of broad advancements towards PCC/SDM, need to be considered by health care ethics researchers. Consider the hypothesis H that a defendant is guilty, and the evidence E that a majority of h out of n independent jurors have voted for H and a minority of k:=n-h against H. How likely is the majority verdict to be correct? By a formula of Condorcet, the probability that H is true given E depends only on each juror's competence and on the absolute margin between the majority and the minority h-k, but neither on the number n, nor (...) on the proportion h/n. This paper reassesses that result and explores its implications. First, using the classical Condorcet jury model, I derive a more general version of Condorcet's formula, confirming the significance of the absolute margin, but showing that the probability that H is true given E depends also on an additional parameter: the prior probability that H is true. Second, I show that a related result holds when we consider not the degree of belief we attach to H given E, but the degree of support E gives to H. Third, I address the implications for the definition of special majority voting, a procedure used to capture the asymmetry between false positive and false negative decisions. I argue that the standard definition of special majority voting in terms of a required proportion of the jury is epistemically questionable, and that the classical Condorcet jury model leads to an alternative definition in terms of a required absolute margin between the majority and the minority. Finally, I show that the results on the significance of the absolute margin can be resisted if the so-called assumption of symmetrical juror competence is relaxed. (shrink)

We seem to learn and use concepts in a variety of heterogenous “formats”, including exemplars, prototypes, and theories. Different strategies have been proposed to account for this diversity. Hybridists consider instances in different formats to be instances of a single concept. Pluralists think that each instance in a different format is a different concept. Eliminativists deny that the different instances in different formats pertain to a scientifically fruitful kind and recommend eliminating the notion of a “concept” entirely. In recent years, (...) hybridism has received the most attention and support. However, we are still lacking a cognitive-computational model for concept representation and processing that would underpin hybridism. The aim of this paper is to advance the understanding of concepts by grounding hybridism in a neuroscientific model within the Predictive Processing framework. In the suggested view, the different formats are not distinct parts of a concept but arise from different ways of processing a functionally unified representational structure. (shrink)

BackgroundAt the start of 2021, oncologists lacked the necessary scientific knowledge to adapt their clinical practices optimally when faced with cancer patients refusing or reluctant to be vaccinated against COVID-19, despite the marked vulnerability of these patients to severe, and even fatal forms of this new viral infectious disease. Oncologists at Foch Hospital were confronted with this phenomenon, which was observed worldwide, in both the general population and the population of cancer patients.MethodsBetween April and November 2021, the Ethics and Oncology (...) Departments of Foch Hospital decided to investigate this subject, through an empirical and interdisciplinary study in bioethics. Our scientific objective was to try to identify and resolve the principal bio-ethical issues, with a view to improving clinical practices in oncology during future major pandemics of this kind, from a highly specific bio-ethical standpoint. We used a mainly qualitative methodological approach based on questionnaires and interviews.ResultsIn April 2021, 29 cancer patients refused or were reluctant to be vaccinated. Seventeen of these patients said that making vaccination mandatory would have helped them to accept vaccination. In October 2021, only 10 cancer patients continued to maintain their refusal. One of the main reasons for the decrease in refusals was probably the introduction of the “pass sanitaire” in July 2021, which rendered vaccination indispensable for many activities. However, even this was not sufficient to convince these 10 cancer patients.ConclusionWe identified a key bio-ethical issue, which we then tried to resolve: vaccination policy. We characterized a major tension between “the recommendation of anti-COVID-19 vaccination” and “free will”, and the duty to “protect each other”. Mandatory vaccination, at least in France, could resolve this tension, with positive effects on quality of life, or survival, in cancer patients initially refusing or reluctant to be vaccinated, but only if collective and individual scales are clearly distinguished. Predictive processing, an increasingly popular paradigm in cognitive sciences, has focused primarily on giving accounts of perception, motor control and a host of psychological phenomena, including consciousness. But higher cognitive processes, like conceptual thought, language, and logic, have received only limited attention to date and PP still stands disconnected from a huge body of research in those areas. In this thesis, I aim to address this gap and I attempt to go some way towards developing and defending a cognitive-computational approach (...) to higher cognition within the predictive processing paradigm. To test its explanatory potential, I apply it to a range of linguistic and conceptual phenomena. I proceed in three steps. First, I lay out an account of concepts and suggest how concepts are represented, how they can be context-sensitively processed, and how the apparent diversity of formats arise. Secondly, I propose how paradigmatic higher cognitive competencies, like language and logical reasoning, could fit into the PP picture. Thirdly, I apply the PP account of concepts and language to a range of linguistic-conceptual phenomena as test cases, namely: metaphor, the semantic paradox (specifically the Liar Paradox) and copredication. Finally, I discuss some challenges and objections to the PP framework as applied to higher cognition and in general. (shrink)

Here we will examine one version of Margery William’s classic nursery tale The Velveteen Rabbit, or How Toys Become Real, where the theme of “real” and imaginary characters and worlds is construed both linguistically and pictorially. We will show how the theme is construed in both text and image, and how the two complement one another, together keeping the two worlds apart while at the same time representing the Velveteen Rabbit’s transformation from toy rabbit to real rabbit. This essay investigates the change in the Catholic attitude toward nuclear weapons as articulated by Pope Francis. Francis has generally followed the position of his immediate predecessors with regard to the Catholic teaching on just war. While the resort to armed force remains a morally justifiable option if the principles of just war have been met, the pope forcefully emphasises the tools of nonviolent peacebuilding. Recently, however, Francis made an original just war argument when he broke with the Church’s established (...) position on nuclear weapons. The pope declared both the use and possession of nuclear weapons “immoral” and, thus, abandoned the Church’s reluctant acceptance of nuclear deterrence that had survived the end of the Cold War. In this essay, I analyse the rationale behind Francis’s decision to break with nuclear deterrence, which is mainly grounded in the disillusionment about the failed promise of nuclear disarmament. Furthermore, I assess the impact of the new position with regard to Catholic soldiers serving in nuclear armed militaries. (shrink)

Monitoring the environment for visual events while performing a concurrent task requires adjustment of visual processing priorities. By use of Bundesen's (1990) Theory of Visual Attention (TVA), we investigated how monitoring for an object-based brief event affected distinct components of visual attention in a concurrent task. The perceptual salience of the event was varied. Monitoring reduced the processing speed in the concurrent task, and the reduction was stronger when the event was less salient. The monitoring task neither affected the temporal (...) threshold of conscious perception nor the storage capacity of visual short-term memory nor the efficiency of top-down controlled attentional selection. This paper deals with Keynes’s distinction between entrepreneurship and speculation, regarding business people in general and especially investors’ behaviour. Based on Keynes’s thoughts about financial markets, it analyses how different motivations influence the decision-making process of investors and its consequences for stock markets and the real economy and clarifies that Keynes’s considerations are still useful for understanding contemporary developments and risks in the financial system. Furthermore, it points out that Keynes’s theories and policy recommendations should be understood in the context (...) of his moral considerations, especially relating to individual responsibility of investors. The IOC and WADA have announced their ambition to develop control program in order to detect athletes' illegitimate use of genetic technology for enhancing performance. Although it is far from clear what such uses should be counted as illegitimate, as well as to what extent the idea of control programs for such things is a feasible idea, I will assume that such programs will concern so-called somatic genetic modifications that aims at altering the athlete's initial bodily biochemistry in a way (...) that may enhance performance without the presence of any medical reason for undertaking such modifications. This means that the envisioned control-program will have to make use of the method of genetic testing in order to detect the possible presence (or non-presence) of various genetic variants within the athlete. As a consequence of this, several ethical issues familiar within the field of genetic testing for health purposes are suddenly actualised within the area of doping control. These issues concern primarily how to handle and communicate the information about the athlete that is uncovered by such testing. However, due to the ways in which gene doping may be performed, in the case of atheletic control programs, issues of medical safety and the question of what hardships it is reasonable to require of athletes to endure also become paramount. As a consequence, one may ask whether or not sporting ethics will have to consider applying the rule of informed consent in connection to testing programs of the kind here discussed. (shrink)

Bestehen Maximen den Test, dann ist es zulässig oder sogar geboten, nach ihnen zu handeln; bestehen sie den Test nicht, so sind ihnen entsprechende Handlungen unmoralisch und verboten.

This article contributes to the debate among just war theorists about the ethics of using armed drones in the war on terror. If violence of this kind is to be effectively restrained, it is necessary first to establish an understanding of its nature. Because it is difficult to conceptualize drone-based violence as war, there is concern that such violence is thus not captured by the traditional jus ad bellum framework. Drone strikes probably do not constitute a law enforcement practice, so (...) the peacetime ethics of criminal justice do not apply either. One possible solution is to develop and apply a legitimization framework of jus ad vim in which vim is “force short of war,” although this depends upon a vim–bellum distinction being a sustainable one. Moving beyond discussion of these three alternative concepts of drone-based violence, the article suggests a fourth—vis perpetua —and explores the ethical implications thereof. As a form of violence that presents no physical risk to individual users of force, a program of drone strikes poses a moral problem if it is intended to continue indefinitely, leading to the systematic endangerment of innocents without the eventual promise of peace.
