When two people need a kidney transplant, but only one kidney is available, we need to decide who gets it. If one of the potential recipients needs the kidney because of their own voluntary behavior, but the other is not at all responsible for needing a kidney, then we need to decide whether this fault should be a consideration in favor of the other patient getting the kidney. While there has been considerable philosophical debate on this issue, there is far (...) less research into the views of the public. To explore opinions on these issues, we first asked survey participants to ascribe or deny responsibility for the risky behavior for kidney disease, and for being deprived of a kidney in cases of drinking alcohol, drug abuse, smoking and unhealthy eating when the patient did or did not stop the risky behavior after being diagnosed with kidney disease. Next, we asked participants who should get the kidney when the patient who engaged in risky behavior did or did not know, or have easy access to, the information that the behavior was risky. We found that participants generally ascribed responsibility on the basis of knowledge but allocated the kidney on the basis of access to information. These findings have important implications for moral theories as well as medical policies. (shrink)

Ethical issues related to comparative effectiveness research, or research that compares existing standards of care, have recently received considerable attention. In this paper we focus on how Ethics Review Committees should evaluate the risks of comparative effectiveness research. We discuss what has been a prominent focus in the debate about comparative effectiveness research, namely that it is justified when “nothing is known” about the comparative effectiveness of the available alternatives. We argue that this focus may be misleading. Rather, we should (...) focus on the fact that some experts believe that the evidence points in favor of one intervention, whereas other experts believe that the evidence favors the alternative. We will then introduce a case that illustrates this point, and based on that, discuss how ERCs should deal with such cases of expert disagreement. We argue that ERCs have a duty to assess the range of expert opinions and based on that assessment arrive at a risk judgment about the study under consideration. We also argue that assessment of expert disagreement is important for the assignment of risk level to a clinical trial: what is the basis for expert opinions, how strong is the evidence appealed to by various experts, and how can clinical trial monitoring affect the possible increased risk of clinical trial participation. Background In the early stages of the COVID-19 pandemic, many health systems, including those in the UK, developed triage guidelines to manage severe shortages of ventilators. At present, there is an insufficient understanding of how the public views these guidelines, and little evidence on which features of a patient the public believe should and should not be considered in ventilator triage. Methods Two surveys were conducted with representative UK samples. In the first survey, 525 participants were asked in an open-ended (...) format to provide features they thought should and should not be considered in allocating ventilators for COVID-19 patients when not enough ventilators are available. In the second survey, 505 participants were presented with 30 features identified from the first study, and were asked if these features should count in favour of a patient with the feature getting a ventilator, count against the patient, or neither. Statistical tests were conducted to determine if a feature was generally considered by participants as morally relevant and whether its mean was non-neutral. Results In Survey 1, the features of a patient most frequently cited as being morally relevant to determining who would receive access to ventilators were age, general health, prospect of recovery, having dependents, and the severity of COVID symptoms. The features most frequently cited as being morally irrelevant to determining who would receive access to ventilators are race, gender, economic status, religion, social status, age, sexual orientation, and career. In Survey 2, the top three features that participants thought should count in favour of receiving a ventilator were pregnancy, having a chance of dying soon, and having waited for a long time. The top three features that participants thought should count against a patient receiving a ventilator were having committed violent crimes in the past, having unnecessarily engaged in activities with a high risk of COVID-19 infection, and a low chance of survival. Conclusions The public generally agreed with existing UK guidelines that allocate ventilators according to medical benefits and that aim to avoid discrimination based on demographic features such as race and gender. However, many participants expressed potentially non-utilitarian concerns, such as inclining to deprioritise ventilator allocation to those who had a criminal history or who contracted the virus by needlessly engaging in high-risk activities. Historically, scientific and engineering expertise has been key in shaping research and innovation policies, with benefits presumed to accrue to society more broadly over time. But there is persistent and growing concern about whether and how ethical and societal values are integrated into R&I policies and governance, as we confront public disbelief in science and political suspicion toward evidence-based policy-making. Erosion of such a social contract with science limits the ability of democratic societies to deal with challenges presented by new, (...) disruptive technologies, such as synthetic biology, nanotechnology, genetic engineering, automation and robotics, and artificial intelligence. Many policy efforts have emerged in response to such concerns, one prominent example being Europe's Eighth Framework Programme, Horizon 2020, whose focus on “Responsible Research and Innovation” provides a case study for the translation of such normative perspectives into concrete policy action and implementation. Our analysis of this H2020 RRI approach suggests a lack of consistent integration of elements such as ethics, open access, open innovation, and public engagement. On the basis of our evaluation, we suggest possible pathways for strengthening efforts to deliver R&I policies that deepen mutually beneficial science and society relationships. (shrink)

Mobile health research involving pervasive sensors, mobile apps and other novel data collection tools and methods present new ethical, legal, and social challenges specific to informed consent, data management and bystander rights. To address these challenges, a participatory design approach was deployed whereby stakeholders contributed to the development of a web-based commons to support the mHealth research community including researchers and ethics board members. The CORE platform now features a community forum, a resource library and a network of nearly 600 (...) global members. The utility of the participatory design process was evaluated by analyzing activities carried out over an 8-month design phase consisting of 86 distinct events including iterative design deliberations and social media engagement. This article describes how participatory design yielded 55 new features directly mapped to community needs and discusses relationships to user engagement as demonstrated by a steady increase in CORE member activity and followers on Twitter. WellsCatholic and Buddhist priests, monastics, teachers, and community leaders participated in the second of an anticipated four annual dialogues. The series is sponsored by the Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB). The conference took place 4–7 March 2004 at Mercy Center in Burlingame, CA, whose own (...) East-West meditation program, led by Fr. Thomas Hand, celebrated its twentieth anniversary that year. A popular retreat center and home to the Sisters of Mercy of Burlingame, the Center offered participants tree-dotted, spacious grounds and strolling paths, as well as a labyrinth for contemplative walking.Each day began with both Catholics and Buddhists in Mercy Center's Rose Room, a Zen-style meditation space, for an hour of silent meditation in the morning. Catholic liturgy was celebrated in the afternoon in the main chapel, with all participants invited to attend and share prayer and blessings. On the two full days, Friday and Saturday, two sessions of presentations were held each morning, with one session following in the afternoon. Each of the six sessions focused on a position paper, with three papers given from a Buddhist and three from a Christian perspective. Each paper was presented by its authors, followed by two formal responses, one by a Buddhist and one by a Catholic participant. This was in turn followed by an open discussion within the whole group. A minute of silent meditation began and ended each session.The presentations focused on various meanings embraced by the term "precepts" in each tradition. One paper introduced perspectives on Buddhist precepts in three different Buddhist lineages. Another presented six guidelines as "Precepts on the [End Page 155] Mind-Ground" that connect ethical commitments with social engagement. A third paper focused on Bodhisattva practice, which embraces and unifies all sentient beings. On the Christian side, presentations discussed the precepts as signposts on the path that leads away from suffering, as motivations that move us, and as the practice of the presence of God, exemplified by the writings of Brother Lawrence.A glossary prepared by Fr. Francis Tiso helped define Catholic Christian terms for the Buddhist participants in the dialogue. Similarly, a book distributed to all participants by the Dharma Realm Buddhist Association provided background on "Buddhism A–Z." Formal discussion sessions in the evenings, as well as informal talks by the participants while walking outside or in the form of impromptu hallway meetings added to the depth and richness of the dialogue. Some recurring themes were the importance and meaning of a personal teacher in both traditions; another was the "embodiment" of the teachings, the value of teaching through presence. Personal stories and practical experiences offered by individual participants were much appreciated and added poetry and emotion to the headiness of theological discussion.Members of both the Buddhist and the Catholic traditions reported that the encounter with the spiritual practices and beliefs of the other faith provides both affirmation of the familiar and welcome discovery of unexpected riches of the spirit. Skeptics argue that the acquisition of knowledge is impossible given the standing possibility of error. We present the limiting convergence strategy for responding to skepticism and discuss the relationship between conceivable error and an agent’s knowledge in the limit. We argue that the skeptic must demonstrate that agents are operating with a bad method or are in an epistemically cursed world. Such demonstration involves a significant step beyond conceivability and commits the skeptic to potentially convergent inquiry.

An important task in mathematical sciences is to make quantitative predictions, which is often done via the solution of differential equations. In this paper, we investigate why, to perform this task, scientists sometimes choose to use numerical methods instead of analytical solutions. Via several examples, we argue that the choice for numerical methods can be explained by the fact that, while making quantitative predictions seems at first glance to be facilitated by analytical solutions, this is actually often much easier with (...) numerical methods. Thus we challenge the widely presumed superiority of analytical solutions over numerical methods. (shrink)

In this chapter, we develop the claim that today, in light of the distributed catastrophe called the Anthropocene, the question of ethics first and foremost becomes a question of economy and energy. Supplementing existing ethical approaches to the question of economy and energy, we offer what we understand to be a more fundamental economical interpretation of the Anthropocene by way of Georges Bataille’s philosophical thought on economy. We will argue that inasmuch as it results from what has come to be (...) known as “the great acceleration”, the Anthropocene can be understood as a consequence of an economic consideration of energy that is oriented towards scarcity and utility, which is to say to Bataille’s “restricted economy”. Additionally, we show how for Bataille, such a ‘restricted’ consideration of energy is an ethical affair, since it misunderstands the constitutive abundance of energy associated with “the general economy”, thereby simultaneously and catastrophically misunderstanding the ethos of human existence in servile terms of labour and efficiency. Finally, we investigate how Bataille’s concept of sovereignty seeks to surpass such servility and efficiency by way of a consideration of energy that is oriented towards expenditure. We offer a reinterpretation of the ethics of sovereignty by confronting it with our contemporary deteriorating oikos inhabited in the Anthropocene. We close by arguing that notwithstanding its irrevocable difficulties, the question of ethics in the Anthropocene must be considered as an energetic ethics of sovereignty. (shrink)

The transference theory reduces causation to the transmission of physical conserved quantities, like energy or momenta. Although this theory aims at applying to all felds of physics, we claim that it fails to account for a quantum electrodynamic effect, viz. the Aharonov-Bohm effect. After having argued that the Aharonov-Bohm effect is a genuine counter-example for the transference theory, we offer a new physicalist approach of causation, ontic and modal, in which this effect is embedded.

Uffink and Valente claim that there is no time-asymmetric ingredient that, added to the Hamiltonian equations of motion, allows to obtain the Boltzmann equation within the Lanford’s derivation. This paper is a discussion and a reply to that analysis. More specifically, I focus on two mathematical tools used in this derivation, viz. the Boltzmann–Grad limit and the incoming configurations. Although none of them are time-asymmetric ingredients, by themselves, I claim that the use of incoming configurations, as taken within the B–G (...) limit, is such a time-asymmetric ingredient. Accordingly, this leads to reconsider a kind of Stoßzahlansatz within Lanford’s derivation. (shrink)

In this paper, I present a discrete solution for the paradox of Achilles and the tortoise. I argue that Achilles overtakes the tortoise after a finite number of steps of Zeno’s argument if time is represented as discrete. I then answer two objections that could be made against this solution. First, I argue that the discrete solution is not an ad hoc solution. It is often assumed that chemistry was a typical positivistic science as long as chemists used atomic and molecular models as mere fictions and denied any concern with their real existence. Even when they use notions such as molecular orbitals chemists do not reify them and often claim that they are mere models or instrumental artefacts. However a glimpse on the history of chemistry in the longue durée suggests that such denials of the ontological status of chemical entities do not (...) testify for any specific allegiance of chemists to positivism. Rather it suggests that the dilemma positivism vs realism is inappropriate for characterizing the ontology of chemistry. This alternative shaped at the turn of the twentieth century in the context of controversies about atomic physics does not take into account the major concern of chemists, i.e. making up things. Only by considering what matters for chemists, their matters of concern rather than their matter theories, can we expect to get an insight on their ontological assumptions. The argumentation based on historical data is twofold. Generating new substances out of initial ingredients which is the raison d’être of chemistry raised a vexing puzzle which has been alternatively solved with the Aristotelian notion of mixt and the Lavoisieran notion of compound. I will argue that an essential tension remains intrinsic in chemistry between the two conceptual frameworks. But how are we to make sense of the long tradition of ontological non-commitment in chemistry? I argue that what is usually considered as a denial of the existence of the basic units of matter is better characterized as a focus on more important actors on the chemical stage. (shrink)

Je propose d’analyser une pratique de la recherche en mathématiques constructives, celle qui consiste à reformuler constructivement les théories physiques. Je discute plus précisément trois aspects de cette pratique. Je montre d’abord que celle-ci a la particularité d’être motivée par des considérations philosophiques et comment la physique est utilisée pour arbitrer un débat de philosophie des mathématiques entre constructivisme et classicisme. Ensuite, j’identifie la méthodologie de la recherche en mathématiques que cette pratique implique et montre qu’il s’agit, selon une terminologie (...) empruntée à Poincaré, d’une méthodologie de « logiciens ». Enfin, je montre que dans cette pratique, les théories physiques ont un rôle heuristique sur le développement des mathématiques constructives. Elles permettent avec succès de stimuler la recherche d’énoncés constructifs et d’orienter la recherche en mathématiques constructives vers de nouveaux domaines. (shrink)

In metaphysics, there are a number of distinct but related questions about the existence of “further facts”—facts that are contingent relative to the physical structure of the universe. These include further facts about qualia, personal identity, and time. In this article I provide a sequence of examples involving computer simulations, ranging from one in which the protagonist can clearly conclude such further facts exist to one that describes our own condition. This raises the question of where along the sequence the (...) protagonist stops being able to soundly conclude that further facts exist. (shrink)

Scientific models need to be investigated if they are to provide valuable information about the systems they represent. Surprisingly, the epistemological question of what enables this investigation has hardly been investigated. Even authors who consider the inferential role of models as central, like Hughes or Bueno and Colyvan, content themselves with claiming that models contain mathematical resources that provide inferential power. We claim that these notions require further analysis and argue that mathematical formalisms contribute to this inferential role. Both Dewey and Bourdieu emphasize the extent to which human practices are inherited practices, and the extent to which inheritance is a function of imitation. Affinities between Dewey's concept of habit and Bourdieu's notion of habitus are explored. This essay focuses on four variations on the theme of doing the done thing: philosophers doing philosophy in a recognizable form , nations perpetuating war as the unwitting enactment of a repetition compulsion, cultures fostering such democratic practices as communal deliberation, and simply (...) the done thing as an integral part of human practices. The paper centres on a particular pattern of argument in Bernard Bosanquet aesthetic writings. This pattern is one which has roots in a more general Idealist response to Kant's formulation of the problem of aesthetic judgment. In other words, it has roots in thinkers such as Schiller, Schelling and Hegel. The core of the pattern of argument concentrates on the relation, in both artistic production and contemplation, between reason and sensuousness and form and content. The paper tries to show how (...) Bosanquet, in formulating his aesthetic theory, fashions his argument into what I call a 'social aesthetic'. He is helped in this process of formulating a 'social aesthetic' by subtly linking his Hegelian-based arguments with the ideas of both William Morris and John Ruskin. Throughout the paper the various arguments revolve therefore around the central relation of reason and sensuousness and form and content. (shrink)

Americans have recently had thrust into their faces multiple media borne medical and social ethics dilemmas ranging from Dr. Kevorkian's euthanizing a patient on national television to payments by managed care providers for experimental medical treatments,to the nationally telecast situation which this paper will attempt to address. The case at hand concerns a minor in need of a repeat(third) kidney transplant who has been offered a kidney by her father. He also provided a kidney for her second kidney transplant some (...) years ago. The teenage girl went into her current kidney failure/organ rejection state because, feeling well, she stopped taking her antirejection medications. Her father appears to understand the consequences of this offer and is willing nonetheless to donate his remaining kidney to his daughter. His ex-wife and daughter want the kidney and will take it knowing what it will do to him. Of additional interest is that he is incarcerated as a prisoner for a crime for which he will be eligible for parole in the not distant future. This means that although altruistically self-induced, the State will become financially responsible for his medical care and dialysis treatments. This paper will attempt to analyze the competing issues presented by this dilemma and address the underlying conflict between the parameters patient autonomy, parental beneficence and the deontologically based responsibilities of the state and of the health care team.
